WHEREAS, it was the intent of the Town Board to allow for parades, assemblies and carnivals within the Town of Islip subject to certain restrictions; and

WHEREAS, it is necessary and proper, pursuant to the powers granted unto the Town of Islip by virtue of Town Law § 130, to regulate parades and public assemblages; and

WHEREAS, the Town Board has determined that some restrictions in Chapter 36 of the Islip Town Code, as amended, need to be altered; and

WHEREAS, certain modifications are deemed necessary to portions of the Islip Town Code, Chapter 36, entitled “Parades, Assemblies and Carnivals”; and

The National External Diploma Program offers adults 21 and over, the opportunity to receive credit for their life experiences, and earn a high school equivalency diploma without the challenge of taking lengthy timed examinations.

NEDP, is a competency based program for students who are unable to attend classes or who prefer to work at home. Successful candidates for NEDP include former ESL students, students who have been out of school for prolonged periods of time, or students who fare better without the structure of tests.

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024 and May 31, 2024 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter

section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation or, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date

This Executive Order shall take effect immediately.

3. Specify the highway or street in the Town of Islip to be used by or for the assembly, race or parade.

4. Specify the time when the assembly, race or parade will convene or commence.

5. Specify the time when the assembly, race or parade will terminate.

6. Specify the exact purpose of the assembly, race or parade.

7. Specify persons or organizations taking part in the assembly, race or parade.

8. Specify the symbols, flags or emblems to be displayed or carried.

9. Specify whether an American flag, no less than 36 inches by 60 inches, will be displayed during the course of the assembly or parade.

10. Specify whether any speeches are to be made during the course of the parade, race or assembly and, if so, by whom.

11. Specify whether any firearms are to be carried or displayed and, if so, the type of the same.

12. Specify whether any fireworks or colored fire is to be carried or displayed in the course of the parade, race or assembly.

13. Specify whether any torches or any inflammable material is to be carried or displayed in the course of the parade, race or assembly.

14. Specify whether any arrangements have been made for private policing or disciplining of those engaged in the parade, race or assembly.

15. Specify whether any exercises or maneuvers are to be made during the parade, race or assembly and, if so, the nature thereof.

The solemnly, affirm that all of the answers to the above questions are true and correct, and unconditionally guarantee the quiet, lawful and peaceful conduct of the parade, race or assembly for which the permit is hereby applied.

An application for a carnival, circus, fair or amusement event shall be fully completed and signed by the person, organization and/or business entity seeking a permit. The application shall be submitted no less than 45 60 days prior to the time of the commencement of such carnival, circus, fair or amusement event or at least 60 75 days prior to such commencement where such event involves audience capacity or attendees in excess of 1,000 persons. The application shall include and/or be accompanied by the following:

A. Written proof that all necessary permits and/or approvals required by the Suffolk County Department of Health Services, New York State Department of Labor and any other governmental or regulatory agency having jurisdiction have been obtained.

B. The applicant shall specify whether the number of attendees is expected to reach 1,000 or more. In the event the number of attendees is expected to reach 5,000 or more, same shall also be indicated on the application.

C. The date(s), time(s) and place of the amusement event.

D. A complete description of all activities, games of skill, rides and special events.

E. A notarized letter signed by the property owner of the premises upon which the proposed event is to be held stating the nature, extent and duration of the amusement event and granting permission for the operation of the amusement event on the property.

F. A certificate of insurance and surety bond pursuant to § 36-14 of this article.

G. The name, address and phone number of the applicant and of the amusement company, if one is being utilized to organize, operate and/or manage an amusement event. In the event an amusement company is being utilized, then a full and true copy of the contract and/or agreement entered into between the applicant and the amusement company must be provided to the Town Clerk. No portion of the financial aspects of the agreement filed with the Islip Town Clerk shall be released to third parties in accordance with the provisions of Public Officers Law § 87(2)(d).

H. An original and four copies of an accurate site plan drawn to scale showing the location, dimensions and specifications of all stationary and/or temporary structures or enclosures, amusement rides, games of probability, tents and pavilions. The site plan shall include the dimensions of all amusement rides when in motion, the area to be occupied by the proposed amusement rides and the net amount of open space available when all amusement rides are in operation. All site plans shall set forth the dimensions of the parcel to be utilized for the event and the number of acres it comprises

I. Any other documents required to be provided pursuant to any section of this article.

J. Such additional information as the Town Clerk may require.

Resolution of Adoption Granting the Application of 7-Eleven Shirley for a Change of Zone from J Business 2 and A Residence 1 to J Business 5, Special Permit for Motor Vehicle Fueling Station, Special Permit for Convenience Store Accessory to Motor Vehicle Fueling Station, and Waivers of Special Permit Criteria, on Property Located on William Floyd Parkway (County Road 46) in Shirley, New York

WHEREAS, on October 3, 2023, a duly advertised public hearing was held to consider the application of 7-Eleven Shirley for a change of zone from J Business 2 and A Residence 1 to J Business 5, special permit for motor vehicle fueling station, special permit for convenience store accessory to motor vehicle fueling station, and waivers of special permit criteria, on a parcel of property located on the southwest corner of William Floyd Parkway (County Road 46) and Moriches Middle Island Road in Shirley, New York, further identified by Suffolk County Tax Map Numbers 0200-64200-0300-041003, 041004 and 041005; and WHEREAS, after due consideration and deliberation; NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Brookhaven that the above application for a change of zone from J Business 2 and A Residence 1 to J Business 5, special permit for motor vehicle fueling station, special permit for convenience store accessory to motor vehicle fueling station and waivers of special permit criteria is hereby approved subject to the following: Conditions 1. The submission of the land use intensification mitigation fee (convenience store building area) in the amount of $89,100.00 shall be submitted prior to effectuating the zoning per Town Code Section 85-467.B.(3)(b). The check shall be made payable to the Joseph Macchia Environmental Preservation Capital Reserve Fund. 2. The submission of 50% of the land use intensification mitigation fee in the amount of $11,175.00 shall be submitted prior to effectuating the zoning per Town Code Section 85-82.F. The check shall be made payable to the Joseph Macchia Environmental Preservation Capital Reserve Fund. 3. The applicant must submit proof, to the satisfaction of the Town Attorney’s office, that the covenants and restrictions, approved as to form and substance, referenced below, have been filed with the Suffolk County Clerk’s Office. Covenants 1. Submission of the outstanding balance of the land use intensification mitigation fee in the amount of $11,175.00 shall be a condition of final site plan approval per Town Code Section 85-82.F. The check shall be made payable to the Joseph Macchia Environmental Preservation Capital Reserve Fund. 2. The convenience store shall be limited to a total building area of 2,986 square feet and a retail sales area of 1,787 square feet. 3. A minimum 25 foot natural/re-vegetated buffer shall be provided along the southerly property boundary, re-vegetation and landscaping subject to review and approval of the Planning Board at the time of site plan review. No additional clearing of natural/native Pine Barrens vegetation, subject to review and approval of the Planning Board at the time of site plan review. 4. A minimum 15 foot landscaped front yard shall be provided along Revilo Avenue and Moriches Middle Island Road (with exception of signage, site access and utility installation).

5. Subject to Planning Board determination at the time of site plan review, elevations for the building and canopy to be substantially similar to those provided by the applicant’s representative for

the Westhampton Beach 7-Eleven convenience store and fueling station prepared by BAR Architecture PV, last dated October 28, 2021. 6. The three (3) tax lots that make up the subject property (identified as Suffolk County Tax Map numbers 0200-642000300-041003, 041004 and 041005) shall be considered joined in common development. 7. The subject applicant, its successors, heirs and/or assignees, shall provide a paddock style fence along all street frontages as well as a “Shirley” sign at the corner of County Road 46 and Moriches Middle Island Road, similar to the existing 7-Eleven at the southeast corner of Wading River Road and the South Service Road of Sunrise Highway, and that sign shall be monument in style, no higher than eight (8) feet, illuminated by gooseneck style lighting, be of wood, or simulated wood construction, and colonial in character. RESOLVED that the following waivers of special permit criteria are approved:

1. Brookhaven Town Code Section 85-467.B.(3): A maximum of 750 square feet of building area shall be devoted to the retail sale and display area, and the total building area shall not exceed 1,500 square feet: 750 square feet maximum retail sale and display area permitted; 1,787 square feet approved. 2. Brookhaven Town Code Section 85-467.B.(3): A maximum of 750 square feet of building area shall be devoted to the retail sale and display area, and the total building area shall not exceed 1,500 square feet: 1,500 square feet total building area permitted; 2,986 square feet approved. 3. Brookhaven Town Code Section 85-467(B)(7): Buffers and plantings in accordance with the land development standards, except that the rear yard setback shall be 40 feet. 4. Brookhaven Town Code Section 85-467(B)(8): A minimum six-foot-high solid (opaque) fence along any property line adjacent to a residential district or use.
