Members of the Lower Nicola Indian Band (LNIB) are voting this week in a community referendum that could have a historic impact on the band’s self-determination.

The referendum has been in the works for more than a year, and this week LNIB members will vote on whether they approve the band’s new land code, which would transfer authority on all reserve land-related issues from Indigenous Affairs (IA), to the LNIB membership, explained LNIB Chief Aaron Sam. Under the current system, “everything that we want to do on reserve, whether it be surveys, or leasing, everything has to be approved

by Indigenous Affairs.� Sam explained. “This would just give us the authority.�

At the LNIB open house on Aug. 9, signs promoting the vote were scattered throughout the Shulus arena, and band members wearing blue “Land vote� t-shirts were busy signing up the membership to be eligible to vote.

In order to be approved, the referendum must have enough ‘yes’ votes to match at least 25 per cent of the sum of all eligible voters, regardless of whether they cast a ballot of not. With those provisions in mind, the magic number of “yes� votes for the LNIB to attain full control of their reserve land rests at 242. “There’s First Nations all across the country that have a land code, that’s been passed,�

Sam said, adding that he’s been busy encouraging all eligible community members to vote.

Thirty-four bands in B.C. have approved their own land code, of the 59 groups across Canada which have re-appropriated control from IA. Should Indigenous Affairs cede control of reserve land to the LNIB, it would not only allow Chief and council to have more authority on how their lands are used, it would also unlock any money held in trust by Indigenous Affairs, from profits made off of historical land use.

Additionally, LNIB would receive $204,536 from IA in the first and second fiscal years following the approval of the code to offset the cost of managing the reserve lands. “It’s a big vote. It’s an important vote. We encourage as many community members to vote as possible,� said Sam. “I support the land code — but it is up to each community member to decide.�

The vote is scheduled to take place on Aug. 11 and 12, but mail-in ballots were accepted in advance, and community members can also vote online at landcodevote.lnib.net.

To bring any charges against three gangsters found in a local motel with drugs and guns, Merritt police will need to make their case to the Crown as to why they searched the room without a warrant.

Back on Aug. 1, police tracked down a woman at local motel who allegedly broke into an apartment and sprayed five women with bear spray earlier that evening.

The warrantless search of the room turned up drugs and guns that were seized by police. In the room with the woman they discovered three men with ties to the B.C. gang known as the Independent Soldiers.

RCMP Sgt. Norm Flemming said police need to justify how they got access to the room, and why they felt it was in public interest to go in without a warrant because the matter was exigent, or show they had a reasonable belief they had permission to enter the room.

He said police had consent to enter the room from the person who was renting it, but it’s not clear whether or not that person knew the woman was in the room at the time.

He said police still need to determine if they think the Crown will agree they were acting on an honest belief that there was an exigent circumstance, and that they had single party consent to enter the room without warrant. “And if we determine that that’s the case then we’ll push it forward and we’ll let the lawyers fight it out from there,� Flemming said.

Police are forwarding charges — assault with a weapon and break and enter with intent — against the woman to Crown. “If it’s determined that we did not have the right to enter that room, then anything we seized as a result of it cannot be used in court,�

Flemming said, adding he doesn’t think that evidence would play a factor in the charges against the woman. “Certainly, if we’re looking at including [the three] others in the charge, it would be very crucial to their involvement,� Flemming said.

Police still need to gather some witness statements that might be able to turn the tide and determine if charges against the men will be possible and forthcoming. “At the end of the day, if it’s not possible, then at least we have removed drugs and guns from those that had them,� Flemming said.

A recent letter to the editor suggesting not administrating naloxone, the life-saving medication for those overdosing on opiates, would mean, “one less individual that will continue to be a burden to society…,” compelled me to respond.

As the Executive Director of ASK Wellness Society in Merritt and Kamloops, I am responsible for the overall management and strategic direction of an agency of over 100 employees tasked with helping any person in need to find housing, access appropriate health care, and to consider opportunities for employment in Kamloops and Merritt. We call this the Streets to Homes to Health to Employment continuum and all our programs fit within this model. We believe that with the right support, and with some good fortune and sense of hope, everyone and anyone deserves the opportunity to reach their potential.

The recent declaration of a public health emergency due to the dramatic rise in fatal and non-fatal overdoses has challenged our communities to understand and then respond to this crisis. Experts agree that this opiate crisis has many of its origins in the easy access to prescription medications such as Oxycontin and other synthetic pain killers. Other significant factors leading to an increasing number of people succumbing to opiate and other drug addiction is the lack of affordable housing and barriers to employment. Poverty and other social determinants of health play a huge role in people falling into addiction and despair. Today’s crisis is a product of many factors, and we as a society have the responsibility to care for our fellow citizens.

Eyes in the sky a no go for ethical hunters OTHMAR VOHRINGER The OUTDOORSMAN Last month the government of British Columbia amended the provincial Wildlife Act by adding drones as illegal equipment to operate or possess, or use data obtained by drones while on hunting or trapping excursion.

Furthermore, it is illegal for a third party owning a drone to help a hunter or trapper in gathering data with a drone. This is now an addition to section 27 of the Wildlife Act which outlines the illegality of helicopters or other aircraft for hunting.

to $250,000 in fines and up to two years in jail. Steve Thomson, Minister of Forests, Lands and Natural Resource Operations, said that there was no real necessity for this amendment but rather the government wanting to make sure to keep up to the pace with modern technology.

Hunting advocacy organization like the BC Wildlife Federation, the Guide Outfitters Association of BC and the hunting community at large welcomed these changes to the Wildlife Act. With this change B.C. follows Alberta, Saskatchewan, Manitoba, Ontario, and Newfoundland and Labrador in banning drones for hunting and trapping purposes. Jim Glaciar, president of the B.C. Wildlife Federation, summed up what the majority of hunters think about drones: “Using drones to help track your prey just isn’t part of the hunting culture in British Columbia. Hunters are respectful of wildlife and their habitat and very supportive of the steps gov-

ernment is taking to prevent hunters from using drones.”

Indeed, I remember that as early as two years ago the danger of the unethical use of drones had been widely discussed on hunting related social media sites.

“Government should ban drones” was a very widely held opinion among the vast majority of hunters throughout our province. What some of the non-hunting readers of my column may not know is that hunters, by large, adhere to a strict code of hunting ethics. A large part of this ethics code discusses “fair chase.” Fair chase in summary is the legal and ethical sportsmanlike pursuit of a wild animal that does not give the hunter an improper advantage over the animal.

In relation to the use of a drone it is agreed upon that it is highly unethical to pursue an animal with a remote controlled flying object fitted with a GPS and camera. It is also unethical use of a drone to locate and relate infor-

mation about the whereabouts of the animal to the hunter. The ethical fair chase pursuit means that the wild animal at all times must have a chance to evade the hunter. Because of that it does not come as a surprise to me that organizations like the BC Wildlife Federation, the Guide Outfitters Association of BC, and the majority of hunters not only supported the government in amending the Wildlife Act to include drones to the list of illegal hunting and trapping methods, but actively lobbied the government to do so.

Incidentally, the subject of drones in regards to hunting came up elsewhere four years ago. Angels grounded Tradewinds Terrace passed inspection From Page 6

The Tradewinds is a BC Housing owned building operated and managed by ASK Wellness Society for the last five years. Rent is geared to income with the average rent being $320 per month. Tenants must be 55 years or older or must be 19 years or older and living with a disability. This facility is not dedicated exclusively to seniors but supports the housing of both seniors and adults with disabilities as per the provincial building classification.

Rent includes laundry, cable, garbage disposal, parking, the use of all public areas including a scooter room, common room, and most recently a garden gazebo and a public garden built by ASK Wellness.

Concerns of tobacco and marijuana use within the building have been brought to our attention over the past three years. As most apartment managers can attest, battling issues of marijuana and tobacco use within a multi-tenant building is a constant struggle as we are bound by the Residential Tenancy Act. When ASK Wellness assumed management of the Tradewinds five years ago, we agreed to allow those who resided in the building at the time of transfer to continue to smoke in their units as they had done for more than a decade. All new tenants were required to smoke outside the building.

In June of 2015, we informed all the residents that effective September 1, 2015, the Tradewinds would become a no smoking building. This included the consumption of tobacco and marijuana.

Enforcement of the no smoking policy posed many

challenges; specifically in regards to encouraging tenants to report issues of second hand smoke within the building and that several of the tenants who had smoked in their units for years refused to abide by the new no smoking rule. Over the winter of 2016 several of these residents were supported to find housing in the community that allowed them to smoke in their suites. While we were committed to making the building smoke free, we were also determined to ensure that smokers who couldn’t or wouldn’t refrain from smoking in their suite would not become homeless or experience unwarranted hardship.

Recently BC Housing conducted an extensive investigation of all Tradewinds operations. This was completed in response to complaints from a few tenants about ongoing tobacco and marijuana consumption and the apparent poor condition in the building.

ASK Wellness fully cooperated with this investigation as it did with the annual inspection conducted in October 2015. The investigation concluded the complaints were not substantiated nor supported in any way and no further action would be taken.

ASK Wellness operates over 200 apartments throughout the region. Housing is provided to a wide range of people experiencing a diversity of challenges and needs including affordability.

We are proud of the living environment and our management of the Tradewinds and would welcome a community tour at any time.

Or would we refuse cancer treatment because a person smoked cigarettes? I would suggest that some of us continue to treat those who live with addictions as pariahs in our community even though they don’t cause others harm. This bias is no more apparent than in this letter. I wonder what a parent, brother, sister, or daughter would say when their loved one was refused access to life saving treatment because addiction was seen as self-inflicted.

ASK supports a Four Pillar approach to substance abuse. We believe in enforcement where and when necessary. For those people whose addiction leads them to crime and harm to oth-

ers, we need a strong enforcement response. For many, however, whose addiction is primarily hurting themselves and possibility spreading illness into community, we need access to harm reduction resources. These include access to clean drug using equipment, shelter, and the provision of food and other basic resources. Linked to both of these pillars is the need for adequate treatment services.

Whether it is through the courts or through the engagement that harm reduction services provides with this population, we need to have in communities like Merritt easy access to detoxification and residential treatment services to help people find the skills and hope needed to break their addictions. And finally, if we are to really learn from our mistakes, we need the tools to prevent crisis such as the one we are facing. Prevention is a vital

Unfortunately for PETA, after hunters reported “Air Angel” drones to the authorities the animal rights group was reminded by the USA government, and later by the Canadian government, that it is a criminal offence to harass wildlife and to interfere with legal hunting.

A few animal rights activists were arrested in America and successfully charged. In one case an animal rights activist was sentenced to pay a $25,000 fine and serve a two year term in jail for harassing hunters and interfering with the legal taking of wild game. After that PETA quickly dropped their anti-hunting crusade, realizing that they could be on the hook for aiding and encouraging criminal activity.

A wet July has helped to alleviate concerns of a drought this summer, but government officials aren’t ready to say if we can expect to ride out the rest of the summer without water restrictions having to be put in place.

“Hard to say — it can change quickly” said Patrick Farmer, senior authorization specialist with the Ministry of Forests Lands and Natural Resources.

“Our streams are determined by snowpack, so when the snowpack is gone, then you depend on rain,” he said adding that the Nicola Valley’s snowpack usually lasts until July, but this year it essentially disappeared before June. “It’s just been rain keeping us afloat for June and July — so it all depends on the weather,” Farmer said.

But if August follows suit with July there shouldn’t be too much cause for concern.

Environment Canada meteorologist Lisa Coldwells told the Herald that Merritt received 73.4 millimetres of rain in the month of July this year.

“Now normally you only get about 33 [millimetres] so that comes out to 252 per cent more than normal,” Coldwell’s said.

She said three one-day records for rainfall in the area make up the majority of that wet stuff.

On July 8 Merritt received a record 17.4 mm of rain, beating the previous record of 13 mm set back in 1993. On July 18 a total of 20.4 mm of rain fell to top the previous one-day record of 14.2 mm set in 1980 and on July 26 Merritt received 26 mm of rain topping the 22.2 mm record from 1986.

summers in the Nicola Valley have been very dry and hot due to weather conditions such as El Niño.

The Nicola region currently sits at level one of four according to the provincial government’s scale for drought conditions, dropping from a level two rating, which is classified as “dry conditions, with first indications of a potential water supply problem.”

“The whole province has gone from the two category, which is where we were in the spring and early summer, and now we’ve all been downgraded to a one,” said Farmer.

“It just means that instead of dry, it’s not as dry.”

Last year at this time, the Nicola Valley experienced a level four, classified as extremely dry conditions. A mandatory 10-day shut off of irrigation on the Coldwater River was even issued.

Farmer said that an average year would see Merritt at drought level two.

“This year, July has been pretty wet. Not super wet, but pretty wet,” he said adding that the fire danger rating has been low as well.

Wildfires have been down more than 50 per cent compared to last year in the Merritt Fire Zone (MFZ) thanks to the wet

conditions.

Between April 1 and August 10 of this year there have been just 21 wildfires compared to 47 that popped up between the same time period last year, MFZ fire information officer Rachel Witt told the Herald.

The amount of hectares burned is comparable between the two years as fires have scorched 113 hectares of land so far this year, with 92 hectares burned in the Pike Mountain Road fire back in April alone.

In 2015 fires in the Merritt Fire Zone burned 103 hectares between April 1 and August 10.

If hot weather persist, water restrictions may be needed, but at the moment they’re not likely, Farmer told the Herald.

“If things turn around and we went to a scorcher, 32 degrees every day, we’ll be in trouble. But it doesn’t look like that’s going to happen. I’m not anticipating restrictions this year, but you never say never. We still have August and September to make it through.”

At the moment, the flow of the Nicola River is a little higher than normal for this time of year, and the Coldwater River is lower than average, but still has “a pretty healthy flow, all things being equal,” Farmer said.

Unlike regular sitting, driving causes the body to be subjected to many different forces such as: accelerations and decelerations, swaying from side to side, and to whole body vibrations. These motions, combined with improper low back support and prolonged sitting can increase the

chances of you experiencing low back pain. The use of the right foot on the gas and brake, and/or the left foot on the clutch, can also add to the possible strain on your low back.

When the feet are active they cannot be used to support and stabilize the lower body as when sitting in a stationary chair.

If you must spend excessive time in a vehicle, try to do it in one that has a good quality seat. You can determine the quality of a car seat by checking to see how adjustable it is. At a minimum you should be able to adjust: the seat distance for leg length, the seat height for leg length, and the backrest angle of the seat to adjust the incline for comfort ability. If your seat has only minimal adjustment options, then you can use a lumbar (low back) support pillow when driving. This allows your low

back to conform to the contour of the back support, which helps you to sit more snugly in your seat and keep you from slouching while driving.

By following this simple advice, you will reduce the amount of stress your low back is exposed to when you drive. To be even more proactive, you should also participate in at least a simple but daily exercise program and visit your chiropractor regularly.

If you must drive or sit for excessive periods of time, chiropractic treatment and exercise will increase and maintain your low back mobility and flexibility. This will allow your low back to be better able to handle whatever stress you put it through.

Collector car program grows Tom Fletcher BLACK PRESS

The B.C. government is expanding its collector vehicle licence system to include eligible modified cars made between 1958 and 1974, to capture the popular “muscle car” era of the 1960s.

The ICBC collector plate program gives car enthusiasts a lower-cost licence plate that allows occasional use for parades and classic car shows. ICBC plans to take applications starting in 2017 for eligible modified vehicles up to 1974, and replica cars resembling North American production cars from 1942 and earlier.

Transportation Minister Todd Stone said the collector car industry is significant for B.C., with registered collector vehicles having doubled to 26,000 in the past 10 years.

“We want to see this specialty vehicle program remain viable, preserve vehicle history and evolve with the times,” Stone said.

“That’s why we are opening up the opportunity to owners of specialty cars within the ‘muscle car’ era.”

Marquart kept the Nicola Valley moving Great Falls, Montana.

He would come home with his pay in gold coins and return to his farm chores. He built a shelter for the mares and the milk cows, cut the hay by hand with a scythe and store it for feed in the winter.

Peter could often be seen digging up limestone on Iron Mountain, which he turned into mortar (a kind of cement).

He sold mortar to customers to make repairs on log homes and other buildings. It was used to plaster walls and ceilings, and fix holes. His mortar was also used to make

control gates for local lakes and irrigation systems. One of his best customers was his friend Joseph Guichon who used the concoction for repairs to the Quilchena Hotel and his store.

Peter then bought stagecoach lines from a Mr. M.P. Stewart and began operated a transportation business out of Nicola. His stagecoach ran from Nicola to Princeton, Spences Bridge and Kamloops and back twice a week (as an aside, Tom Hislop, John Clapperton, Marcus Woodward and H.H. Mathews were among the drivers).

He made shoes for Peter’s children Peter, Matilda and Agnes which he then traded to Peter for a large piece of cowhide. What Peter didn’t know was that Miner wanted the hide to make rifle holsters!

Peter’s wife Marie passed away in 1925. In the late 1930s, his last stagecoach was featured in several Nicola Valley Stampede Parades. Eventually stagecoaches were replaced by automobiles, so Peter caved in and bought two solid trucks so he could work the mail run from Merritt to Quilchena and Nicola.

Travelling with his daughter Agnes, he managed to fulfill his dream of seeing the Golden Gate Bridge in San Francisco and watch a large flying boat called The China Clipper take off before he passed away in the Nicola Valley General Hospital in 1943.

It was a great weekend for golf at the Merritt Golf and Country Club, and more than 60 men took advantage of the sun to take part in the annual Coyote Collision Men’s Open.

The tournament got underway on Saturday, with play continuing throughout the weekend, despite some worries of thundershowers on Sunday.

But the sunshine held through, and in the end, Kamloops’ Adam Kirnan walked away with the winning score in the low gross category, shooting two under par.

But while Kirnan entered the competition with the lowest handicap, his victory was somewhat expected. He faced a strong challenge from Merritt’s Steve Doubinin, who came up one stroke short of evening it up with Kirnan.

Darrell Coldwell also played well, equalling Doubinin’s mark of 143.

Van Rensburg called the tournament a success, with about as many golfers entered as there were last year.

“It was a great weekend, the weather held out pretty good. We were scared of thundershowers but they never came,” he said.

But the weather did play a factor to some degree, as this reporter heard plenty of golfers lamenting their work on the greens — as the wettter-than-usual month of July made for slower grass.

“I wouldn’t say it was trickier — but because of the wetness and the rain we’ve had, the greens are a little slower than we’re used to for this tournament,” explained Van Rensburg.

But he fell short of allowing tournament participants to use that fact as an excuse for inflated scores.

“I mean it’s easier to get used to slow greens than it is to get used to faster greens.”

The tournament also handed out some awards for the closest to the pin on par threes, or KPs.

Otters sending a bevy of athletes to provincials Cole Wagner THE MERRITT HERALD

Only one more meet remains in the season for the Merritt Otters swim team, but based on the results of the regional championships last weekend, the local swimmers know how to save the best for last.

Thirty-five Otters competed at the Okanagan regional championship meet, held in Kamloops from Aug. 5 to 7, a day longer than most meets held during the summer.

The extra day on the schedule is due to the increased importance of the meet — top three finishers in individual events, and the top two relay teams in each event automatically qualify for the 2016 provincial championships, hosted later this month in Coquitlam.

The local team will be sending a strong contingient to the provincial championships this year, as 18 athletes qualified for provincials, with 12 of those athletes qualfiying through winning gold in their events.

“Some of the most outstanding performances came from the youngsters of the team who are Evan Hales and Abby Thoms,” said Otters’ head coach Gabriel Lee. Hale was the champion in the 50 metre butterfly, and took silver in his three other events.

Thoms narrowly claimed gold in the 50 metre butterfly and 100 metre free, both by fractions of a second.

“Both of those races had everyone on their feet, she was also apart of the winning 200 Freestyle relay,” added Lee, who took home a collection of gold medals himself.

BCSSA provincials will be held from Aug. 19 to 21.

National Fly Fishing Championships here in October Ian Webster THE MERRITT HERALD

It’s been 24 years since a generation of moviegoers fell in love with the art and science of fly fishing (to say nothing of a hunky Brad Pitt) by way of the Academy award-winning film A River Runs Through It (1992).

Directed and narrated by Robert Redford, the period drama tells the story of two sons coming of age in the mountains of Montana during the 1920s. The beautifully-captured theme throughout the poignant, often depressing narrative is the young men’s unfailing love of fly fishing, and the lessons for and about life that the peaceful pastime bestows.

Citizens of the Nicola Valley and surrounding area will have ample opportunity to appreciate all the zenlike attributes of this passionate sporting activity, as the 2016 Canadian National Fly Fishing Championships are being hosted by the Corbett Lake Lodge this fall, from October 5 to 7.

The championships will actually take place at four different venues over a period of three days, said Ann Thomson, the manager at Corbett Lake.

Loch-style fly fishing (from a drifting boat) will happen on Corbett Lake, as well as nearby Tunkwa Lake and 7½ Diamond Ranch Lake.

Stream fishing will take place on the Similkameen River, between the bridges at Princeton and Bromley Rock.

This will be just the third time that the nationals are being held in British Columbia.

The event will attract anglers from all parts of Canada (including the Northwest Territories), as well as from as far away as Texas and Colorado.

“It’s a national championship, so we do give priority to Canadians,” said committee member Todd Oishi. “However, there’s a standing invitation to competitors from other countries. Sometimes, by having international guests, competitors can gain so much by watching and observing, and

Oishi should know what he’s talking about.

The Maple Ridge resident is a many-time Canadian champion, and frequent participant in the Commonwealth and World championships. He’s B.C.’s biggest ambassador when it comes to promoting the sport of fly fishing and our province’s magnificent fisheries.

“There’s a lot to offer in British Columbia. What we have right here in the Merritt area is world class. People who come to this region from around the globe are

thrilled by the experience.”

This year’s Canadian championships are limited to 60 entries.

There are already 54 registrants. Oishi would love to see the final few spots filled by some local anglers.

“We have Mike Ohata from Merritt already on a team, along with Darryl Fisher and Geoff LeClair out of Kamloops. I’d be thrilled if a group of five from Merritt or Princeton joined in.

“When I first competed at nationals in 2005, it was in Campbell River,” said

Oishi. “Five of us socalled locals put a team in — all rookies — and low-and-behold, we won the team gold, and I won the individual gold. I really think our knowledge and understanding of the local fisheries gave us a distinct advantage. Maybe the same thing could happen around here.”

Oishi said the championships aren’t restricted to adults.

“There’s seven youth (ages 14 to 20) signed up for this year’s nationals, including one complete team of five. They will get some coaching and mentoring from the more experienced

people on hand.”

With respect to viewing the competition over the course of the three days, both Thomson and Oishi stated that spectators are more than welcome.

“We’d love to have people come out,” said Oishi. “In terms of the lake fishing, Corbett and 7½ Diamond Ranch Lakes are probably the best because they’re smaller. From the shoreline, you’ll be able to see the boats, see the fishermen and take some great pictures.”

Spectators will not be able to take boats out on the water, said Thomson.

“As for the river fishing — by parking on the side of the old Hedley road, or beside Highway 3, you’ll be able to have a very good view of the fly fishers in the water,” said Oishi.

Event organizers are still looking for volunteers to help out with the river fishing on the Similkameen on all three days of the championships.

“Basically, the volunteer, or controller we call it, brings a lawn chair, a pair of binoculars and a clipboard,” said Oishi. “They’re each assigned to a competitor and sit by the river. Every time a fish is caught, they record it. There’s no measuring or weighing. It’s just catch and release, one point for each fish. That simple. The whole process takes a few seconds.

It’s a great way to learn how to fish rivers.”

artifical fly is generally credited to the Roman Claudius Aelianus towards the end of the second century. Over the centuries, the sport grew steadily in popularity, particularly in Great Britain, Japan and North America. Today, it is enjoyed around the world.

Author Isaak Walton called fly fishing “the contemplative man’s recreation”.

“We picked that month because the water and air temperatures are cooler.

The fish are happier, healthier and feeding.

We wouldn’t even consider holding the championships in the middle of the summer. The fish mortality would be enormous.”

Oishi said the camaraderie at events like the nationals is huge.

“Every team consists of five competitors.

Each member of a team draws a letter, and the competitors from different teams with the same letter are grouped together for the duration of the championship.

“You have a chance to sit together in a boat, or stand side-by-side in a river. Very quickly, you learn to work together and share information for mutual benefit.

“It’s a serious competition, but everybody’s there to have a good time, too,” said Oishi.

“I always say that the biggest winners aren’t the ones with the biggest medals or trophies, but the ones with the biggest smiles on their faces.”
