At Trigard Memorials, it is our policy to le claims on your behalf for lost, misplaced, missing, stolen or damaged freight. In order to avoid denied claims, we ask that you adhere to the policy below. Trigard will not be responsible for freight claims otherwise handled.

When the manufacturer completes production and the shipment is loaded on to the freight carrier’s truck, the carrier then accepts the freight and signs for it as:

• Being undamaged

• Having a speci c carton count (number of pieces)

• Packaged properly

At this point, the manufacturer’s responsibility ends and the carrier’s responsibility begins. It is then the carrier’s responsibility to deliver the freight:

• Undamaged

HANDLING FREIGHT CLAIMS

When the freight arrives at your door, it is your responsibility to check for obvious damage or missing items. Please inspect the condition and contents of freight immediately upon receipt.

If the shipment is damaged, improperly packaged or has an incorrect carton count, choose an option below to properly submit a claim(s):

OPTION 1 — ACCEPT THE SHIPMENT

• Note the damaged or missing items on delivery receipt BEFORE the carrier leaves your facility

• Contact Trigard at your earliest convenience

• Claims must be led within 5 days of receipt.

Concealed Damage

OPTION 2 — REFUSE THE SHIPMENT

• If you wish to refuse the shipment, contact Trigard BEFORE the carrier leaves your facility.

In absence of visible damage, you have 5 business days to inspect for concealed damage or missing/incorrect items. If discovered, please contact Trigard Memorials for further instruction.

Avoid freight claim issues.

It is imperative that everyone in your organization that is receiving freight shipments understands these issues.

Failure to report damage properly will result in denied freight claims. Trigard Memorials cannot be held responsible for denied claims if the recipient does NOT follow the steps outlined above.

Design proofs for most markers will be turned around in 5 - 7 business days. There will be a $25.00 charge for each proof after three revisions. The proof will be sent to you as part of a PDF form.

PRODUCTION TIME

For expedited services, the following rush fees are available:

• 14 business day completion time: 25% of total (minimum fee of $75.00)

• 7 business day completion time: 50% of total (minimum fee of $75.00)

For expedited services on Veteran Companion markers =14 business day completion time: $247.50 fee

Custom scrolls are extended by two weeks from the current production timeframe.

PHOTOGRAPH QUALITY

At Trigard Memorials, we pride ourselves in producing an exact replica of any photograph onto a bronze memorial. This exact replication can result in the nest bronze if the photograph that we receive is of high quality. Please make sure your le is:

• Scanned and saved as a .TIF or .JPG

• At least 300 dpi

We will contact you immediately if a le we receive is of such poor quality that we feel it will result in a product that is unacceptable to both Trigard Memorials and you, the customer. We will send a Photo Form by email. It will give you the option to:

1. Pause the project while a better photo is found.

2. Allow our graphic artists to enhance the image at an hourly rate of $75.00 per hour with a 2-hour minimum.

3. Produce the product with the photo as is. Trigard Memorials will not be held responsible for an inferior memorial that is produced.

Please understand that Trigard Memorials is not responsible for photographs mailed to us. If possible, please scan the photographs and return originals back to the family or person(s) placing the order with you. We thank you for the opportunity to allow our staff to produce the ultimate in 3-D relief imaging.

If your Trigard Memorials' marker needs re nished, please call 800.798.4900 or email us at orders@trigard.com. If your memorial is under our warranty, you may be eligible for a re nish at no charge.

If the marker has color, the Brilliant Impressions color charge applies in addition to the refinishing fee. See the pricing below.

Not all surface damage is repairable. Noticeable deformities and or surface damage will be quoted based on the condition of each individual memorial.

Thank you for choosing a Trigard Memorials product. Trigard Memorials warrants its Dura-Sheen® nish for a period of ve years from the date of product shipment. This limited warranty applies only to Trigard bronze, aluminum, copper or stainless steel product lines. Trigard Memorials warrants that for the ve years after the product shipment date its Dura-Sheen® will:

a. resist cracking, aking, or blistering.

b. resist chalking and discoloration due to ultra violet rays.

c. not change color more than ve (5) Delta-E Hunter units (square root of the sum of DeltaL, DeltaA, and DeltaB) as determined by ASTM method D-2244. It is acknowledged that fading or color changes may not be uniform if the surfaces are not equally exposed to the sun and elements. Item C applies to Brilliant Impressions® products only.

Any product which proves defective during the warranty period will be repaired or replaced at our option when returned to the factory. Trigard will not incur any costs associated with uninstalling or reinstalling the product(s) in question. Trigard Memorials agrees to pay freight on approved warranty failures.

EXCLUSION

The cost of repair or replacement of a Dura-Sheen® coated product will be the responsibility of the purchaser after the initial 5 year period OR if the product has been subjected to improper usage, accidents, negligence, willful mishandling, chemical damage, improper cleaning or decorating by others, fumes or vapors from the environment, fumes or vapors directly applied to the products, spray from un ltered lawn sprinklers or un ltered irrigation systems, normal wear and tear, vandalism, or failure to provide reasonable and necessary maintenance of the product.

Warranty is void if modi cations or alterations are made by others. Warranty is not transferable. Warranty does not apply to mounting apparatus. Warranty does not cover damage caused by faulty or improper installation or application of the product, settlement, distortion, warping, failure or cracking of the materials to which the product is mounted or attached, bending or twisting of the support structures, earthquakes, hurricane, tornado, cyclone, gale, lightning, ood, re, wind borne objects, direct hits from maintenance equipment, ice and hail damage, weather incidents of a catastrophic nature or Acts of God.

LIMITED LIABILITY

Trigard Memorials' sole responsibility with respect to Dura-Sheen® coated products, whether based branch warranty, breach of contract, negligence or other claim, will be to repair such product or to replace. GREENWOOD INC., D/B/A TRIGARD MEMORIALS SHALL IN NO EVENT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, NOT FOR LABOR, REMOVAL OR INSTALLATION COSTS. GREENWOOD INC., D/B/A reserves the right to discontinue or make changes in products if a product warranted therein is not available to make a replacement here under.

THIS WARRANTY IS IN LIEU OF ALL OTHERS WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. This limited warranty gives you speci c legal rights. However, you may have other rights which may vary from state to state.
