Random and not so random thoughts on C.A.R. Fall Meetings, Anaheim A. Property Assessed Clean Energy (PACE) Lien • A PACE lien is for financing of energy saving home improvements. Basically, a home improvement loan. • Payment to repay financing is done through homeowner’s tax bill and collected as part of the tax bill. Counties collect a % of payments as a collection fee. • Question arises on lien priority… should PACE be senior or junior to first mortgages? • C.A.R. supported 2008 PACE legislation because, unlike Mello Roos which is mandatory for the community served, PACE provides for voluntary “opt-in”. It is an individual homeowner’s option. • PACE liens stay with the property even after sold, and will continue to be collected on the new owner’s tax bill. • PACE can be paid in full by homeowner at any time, thereby removing the lien. • Question; Does the energy upgrade result in an increase of the home’s value, thereby offsetting the cost? • Up to 10% of the home’s assessed value can be loaned to qualified homeowners. B. Pocket Listings: A big concern • C.A.R. putting attention on this practice because… • Are property owners adequately represented when exposure to the general market is not provided? What establishes market value better what a buyer is willing to pay? • Is the practice of pocket listing in

compliance with our Code of Ethics? (See articles1 & 3) Is this practice an appropriate recruiting tool? In what way does a pocket listing benefit a seller?
C. Solar owned vs. leased equipment and disclosures • This is a new issue requiring Realtor expertise. What and how to disclose? • Is the lease of solar equipment recorded (it should be)? Check with your title company. If not it won’t show up on the title report. Then what happens? D. The new RPA due in November • You just HAVE TO ATTEND a C.A.R. training class. • 8 pages to 10 pages… new and, yes, simplified. • Many disclosures incorporated in the 11/14 revision, eliminate some additional disclosures. • Other associated purchase agreements and disclosures revised too. (See C.A.R. “November 2014 Form Release Quick Summary” available at www.car.org.) As you might guess, many topics important to our business were discussed in detail. You are encouraged to attend future C.A.R. Business Meetings.
