What a whirlwind! January came in with a gust of air for the New Year and it did not let up! From representing Delta at the Board installations of the neighboring bay area Associations, such as CCAR, Oakland-Berkeley, Bay East, Alameda… it was an honor and kept every day of the calendar filled! THANK YOU to those of you who attended our Delta Installation of the Board of Directors. Delta is honored to have one of our own, Cecily Tippery, serve as Region 5 Chair this year. She served as installing officer for the DAR Board of Directors on January 16, 2015. California Association of REALTORS® President Chris Kutzkey installed me as President, which was a true privilege. We thanked 2014 President Ron Keefer for his service, and honored Scott MacIntyre as 2014 DAR REALTOR® of the Year, and Steve Margolis of The Real Estate Guide as 2014 DAR Affiliate of the Year. The feedback on the event was terrific, and people danced into the night, and stayed and visited, enjoying the camaraderie that we share within Delta. The DAR leadership that serve as C.A.R. Directors just returned from the 2015 C.A.R. Winter Business Meetings in Indian Wells, CA. It was a terrific set of meetings, with several hot topics, great discussions, and information to share. Of particular interest to you are two potentially critical issues to you and your real estate business. The first is the threat to the independent contractor status. This is at the core of how most salesperson agents, who do not hold Broker licenses, conduct business within a brokerage. C.A.R. is fighting to protect this vital piece of the core of most real estate agent’s businesses. Brokers and Salespersons need to become informed about this and become engaged and involved. One way to do this is to ensure your participation in the voluntary contributions
to the REALTOR Action Fund. This is money used for political issues and to fight to protect REALTOR® interests and the right we feel are best for our consumers. Many of you will say, “oh boy, more money…” I challenge you with the response that if aren’t willing to be part of fighting for your industry, your business and your livelihood, then you need to evaluate your whole business plan and plan for being in the business long-term. This has some potentially devastating impacts to brokerages and to agents. The other hot topic is access to data with regard to real estate inventory/listings. Third party data aggregators such as Zillow and Trulia are definitely not only impacting our business, but they are becoming competition with the independent agents in the business. As they expand their access to the information, they expand their footprint and their power and influence. What does this mean for the local MLS? Should we look at the model of one centralized MLS for California? For the nation? How does this affect the ability to deliver the best market knowledge to a client? So many ideas, and everyone feels strongly about one side or the other. It’s another area you can’t afford to ignore any longer. It’s time to get involved and get informed! We still have committee positions open and NOW is your time to call me and join a committee! We have important work to do this year. We will be completing our DAR Business Plan (AKA Strat Plan) over the next month, in order to comply with NAR’s new Core Standards for Associations. I also invite you to join us for the DRCSF Bowling Tournament on Friday, March 6. This is the first of many fundraisers this year for our Foundation. Your support is vital! Save the date for Wednesday, April 22 which is C.A.R. Legislative Day at the State Capitol. When the REALTORS® come to town, Sacramento takes notice! And this year, the C.A.R. Fall Expo will return to San José from Oct. 6-8. TECH Tuesday is back! When the Expo is located locally to us, we need to make it a priority to attend. Advisory to Examinees and Licensees Regarding Providing the Bureau with Valid Contact Information Pursuant to Assembly Bill 2540 In August 2014, the California Legislature passed and the Governor signed Assembly Bill 2540 (“AB 2540”), amending Sections 10150, 10151, and 10162, and adding 10165.1 to the California Business and Professions Code (“the Code”). The provisions of these Code sections take effect January 1, 2015. AB 2540 requires that examination and license applications, for both the real estate broker and salesperson, include valid contact information (which may include email address and telephone numbers) at which the bureau may the contact the applicant. Furthermore, the bill specifies that examination and license applicants must notify the commissioner of any changes to contact information. AB 2540 further specifies that every real estate broker and salesperson currently licensed provide to the commissioner his or her current office or mailing address, a current telephone number, and a current electronic mail address that he or she maintains or uses to perform any activity that requires a real estate license. Additionally, AB 2540 provides that every real estate broker and salesperson licensee is required to inform the commissioner of any change to this information no later than 30 days after making the change. AB 2540 also provides that the bureau is not required to post or publish electronic mail addresses or telephone numbers collected, as identified above, and if released by the bureau, the information must be released in a way that discourages its use in any unauthorized or unsolicited commercial electronic mail advertisement programs. Effective January 1, 2015, any examination or license application submitted to the bureau that does not contain the required contact information will be incomplete, resulting in processing delays.
