Contingency offer allows you to back out of purchase if your home doesn’t sell Q: We’ve been watching homes values rise for about a year now, then suddenly we see in the news that prices are going back down. We’ve been thinking of selling and moving up so now seems like a good time. The problem is that we understand there are relatively few homes on the market now. We don’t want to sell our house until we are sure we have a house to move into. On the other hand, we can’t commit to buying another house until we are sure this house will sell. I don’t think we’re the only people in this dilemma. How do other people handle this situation? A: I can’t speak to whether or not this is a good time to sell or how many houses are on the market. For that you’ll need to work with a good Realtor. But to answer your question regarding the process I can tell you the classic solution is to make the sale of your home contingent upon the close of escrow of your new home. Over the past year we’ve seen the Solano County market flooded with money from investors. As a result, values of homes shot up. The problem for many would-be home sellers like you was if you put your house on the market, someone will suck it up in no time. The problem then is finding something else to buy when you’re competing with so many others. As a result, contingency sales were rare. Buyers with cash knew that your odds of finding another place were slim and they didn’t want to be hanging around for a month or two waiting to find out if the sale was going to go through. If the situation is changing, then contingency offers may make sense.
Tim Jones There’s a question of whether or not making your sale contingent will affect the final sales price. Some buyers will undoubtedly pass you by rather that deal with the contingency. Discuss the pros and cons with your Realtor and get his or her take on the current market conditions. If you do offer your home for sale with a contingency provision, here’s how it works. You do the normal listing agreement and your Realtor markets your home. Your listing on the Multiple Listing Service will indicate you’re wanting a contingency in any purchase offers you receive to give you time to find a new home. In other words, if for some reason you can’t close escrow on a new property, you aren’t committed to close escrow on your property and your buyer is out of luck. The practical reality, however, may well be that buyers will either not want to The Law Offices of
enter into such a contract or will demand a lower sales price to compensate for the uncertainty of the sale. If you put yourself in the buyer’s shoes, you wouldn’t feel comfortable going through the entire buying process only to have the sellers pull out because of an event for which you have no control. The alternative is to find a seller who will accept your purchase offer with a contingency that you will not have to purchase the property if your home doesn’t sell. This is a more common type of contingency. The problem here is the same as with the first contingency. Sellers don’t want to commit to the sale of the property if your house isn’t already in escrow. If they are willing to do so, they may demand a slightly higher sales price to offset the uncertainty. So what do you do? The truth is, there’s no solid way to ensure that when your home closes escrow you will make a smooth transition into a new property. At least not if you want to get the most money
Mortgage rates pause ahead of next week’s Fed meeting THE WASHINGTON POST After several weeks of volatility, mortgage rates settled in ahead of next week’s Federal Reserve meeting. According to the latest data released Thursday by Freddie Mac, the 30-year fixed-rate average ticked up to 5.54% with an average 0.8 point. (A point is a fee paid to a lender equal to 1% of the loan amount. It is in
addition to the interest rate.) It was 5.51% a week ago and 2.78% a year ago. Freddie Mac, the federally chartered mortgage investor, aggregates rates from about 80 lenders across the country to come up with weekly national averages. 2007 versus 2022 I will never forget going to a loan officer sales seminar in late 2006 and listening to a renowned mortgage speaker talk about how there was no bubble in the real estate market because unemployment was so low. Historically, strong employment numbers support a healthy real estate market. I am not naming the speaker because he was dead wrong about the bubble that began to lose air quickly in April 2007, when lenders across the nation stopped doing risky stated income ARM loans. I was angry from 2008 to 2012 because of this speaker and so many big Wall Street CEOs sat back from 2003 to 2007 and kept their mouths shut while a few trillion

dollars worth of risky ARM loans were done across the country. Unemployment was low because Americans were buying tons of homes and many existing homeowners were using the huge amount of equity they suddenly had in 2005 and 2006 to buy boats, planes, trains and automobiles. here is a new Superbells calibrachoa making its debut in 2023 that is so beautiful and unusual, I’ve even wondered if Proven Winners knows what they have. Had calibrachoas been around in 1800 as Empress Josephine was constructing the gardens at Le Château Norman de MalmaiWinter son, Superbells Prism Pink Lemonade would have been her first choice. While the name perhaps doesn’t sound like the Empress, each blossom looks as though it was already painted by her famed artist Pierre-Joseph Redoute. His rose paintings are undoubtedly the best there have

in its description, “this dynamic plant shifts its coloration through the seasons as it reacts to varying light levels and daylength.” In my trials, the shifting of coloration began almost immediately, which is nothing short of breathtaking. I have been so passionate about the Superbells Punch group, I felt that was all I really needed, but when I placed Superbells Prism Pink Lemonade in between Superbells Grape Punch and Superbells Black Currant Punch, it was like the angels sang. The next oohs and ahhs came when I used Superbells Prism Pink Lemonade surrounded by the soft needle-like foliage of Lemon Coral sedum. It was really pretty simple, and everyone can do it. The oohs came when the sedum started blooming with its uncountable tiny
yellow flowers. In another planter I combined the heirloom look of Superbells Prism Pink Lemonade calibrachoa with Superbena Royale Plum Wine verbena, which also has a certain nostalgic appeal. Then I spotted some blue with Superbena Royale Chambray verbena, giving the planter a floral bouquet-like look. The one special trait you will love is its ability to give you different looks during the day as the sun moves from east to west. As we head toward August, I am feeling a tinge of panic because I love to plant all three supers – Superbells, Supertunias and Superbenas – around Oct. 1 here in zone 8a. The panic is, will I be able to get them? The garden centers really want me to plant pansies. Hey, I am willing to mix in a few into my designs.

Superbells calibrachoa are so much tougher than you ever dreamed. The real prerequisite is to grow them in containers. It is a rare gardener I find who can duplicate that perfect drainage in a landscape bed. Make feeding with a water-soluble fertilizer part of your regimen. The Garden Guy does it every other week. Then once the plant seems tired, open and worn out, don’t be afraid to cut back by a third or to healthy green leaves. This is usually in August in my area, but with early triple-digit temperatures, it moved to July this year. The Garden Guy will never be without Superbells calibrachoas, and I am craving more of the look with the white AquaPots filled with Grape Punch, Prism Pink Lemonade and Black Currant Punch calibrachoas together.

Don’t worry: They don’t bite or transmit diseases. You’ll provide a richer, more diverse food source for hummingbirds, and might even attract breeding hummingbirds.”
Mind your pets Cats and dogs are threats to the birds in your yard, so keep them inside or limit their time outside to when someone can keep an eye on them. Don’t think hummingbirds are exempt from these risks because of their speed or small size. “Hummingbirds are hovering by plants, well within reach,” Rowden says. “And they are tasty little morsels for pets.”

The reason there were no foreclosures in 2006 was because every time a homeowner had a financial problem or felt they were not going to be able to make their next house payment, they could escape by selling their home or do what most did and get another refi-
nance before they fell behind. People could do a refinance big enough to skip a couple house payments and get more cash out with no proof of income, like paystubs and tax returns. There were boiler room types of mortgage lenders in California that sold nothing but Countrywide pick-a-pay, and sub-prime ARM loans all day long by phone with their loan officers selling people down the river. “The Big Short,” which is rated R, is a true story. 2022 is nothing like 2007. We not only have a healthy Solano County real estate market with
homeowners having fixed-rate mortgages they can afford, but we are also starting to see a few more homes on the market today with almost 800 active listings for buyers to purchase. Yes, the market has slowed and no, sellers cannot list their house for 10 to 20% more than a comparable house sold for a year ago, but this is now a market where a first-time buyer can negotiate a favorable purchase agreement. Appraisals are based on comps that have sold in the past six months and the market has been soft since
January. Buyers do not have to be concerned about the appraisal being based on comps from 2021 when mortgage rates had a three handle. The last thing I would ever want to do is tell everyone that everything is just hunky dory like that jerk did at that seminar, but I will tell everyone that asks that we will never see anything like that shameful Ponzi scheme and the avoidable residential 2008 bubble again in my lifetime because Wall Street got caught with almost no convictions.
