Seller can’t just back out of signed contract Q: I found an old 2013 column of yours online about a seller who was trying to back out of a sale. I’m afraid my wife and I are in a similar position to that of the couple from Arkansas. We are in escrow (our offer was accepted and a contract signed June 16), and our Realtor was meeting with the seller’s Realtor and the seller on Friday failed to provide our signed removal of contingencies and letter of intent from the bank to finance the purchase. According to our Realtor, the seller initialed the paperwork, but then refused to sign on the bottom line, informing the two Realtors she’d changed her mind and now wants to lease the property instead. Both our Realtor and the seller’s Realtor were shocked and told her she might be open to legal action, to which she responded she didn’t care, almost seeming to invite a challenge to this situation. I asked our Realtor if the seller had provided anything in writing, to which our Realtor said, “No, she just didn’t sign our removal of contingencies, and told us she was backing out.” As far as we are concerned, we are still in a deal, and are going to continue to perform on our end by finalizing the financing, but what do we do when we want to close escrow and she refuses to sign? The way I read your column, my wife and I are in a contract with the seller, and the decision to accept our offer meant the sale was effectively made at that point, only to be consummated at close of escrow. We lived up to our end of the bargain, providing contingency removal and intent to fund three business days ahead of the due date, no less. However, the seller seems to think she can change her mind. Both our Realtor and hers were livid, suffice to say, but we are fit to be tied ourselves. We appreciate your time and concern.

Tim Jones A: I’m glad my column was helpful and you certainly appear to have analyzed the situation correctly. Just from my experience recently, and given our market conditions, this is becoming a problem the cause of which is easy to figure out. Sellers get into a contract with a buyer with an average closing of escrow date 45 to 60 days in the future. During that escrow period they see, or at least think they think they see, the value going up 4% or 5%. That may not sound like much, but an extra 5% in the sales price of a $700,000 house is $35,000. That’s a new car or a very nice European vacation. So the seller is then motivated to back out, perhaps with some anger toward you, your Realtor or the seller’s own Realtor for having given away the house too cheaply. Still, you are 100% correct in that the deal was made at the time the seller accepted your offer. The Law Offices of

As I’ve said hundreds of times over the years, which bears repeating here, there are very few weasel clauses that allow the seller to back out of a purchase contract upon the happening of some event. For example, in a typical sale, if the buyer is unable to get their loan despite their best efforts, they can back out. If an inspection during the contractual inspection period turns up a problem the seller is unwilling to repair, the buyer can choose to walk away. Similar provisions for the benefit of the seller are rare. Consequently, the seller’s prerogative to back out, as in this case, just doesn’t exist. That begs the obvious second question, “So what do I do now?” Assuming you aren’t interested, or the seller isn’t, in negotiating a buyout of the contract (i.e. the seller gives you cash and you agree to cancel the contract), the only route left to you is a lawsuit. Such a lawsuit involves two major components: the suit itself and the secondary recording of a lis pendens. The lis pendens, as regular readers will likely recall, is simply a notice which, when put on the public record, indicates there is a lawsuit con-

The result of the lis pendens is a cloud on the title of the property that effectively prevents the seller from selling it to someone else while the lawsuit proceeds to its conclusion. I wish there was an intermediary, less expensive way to proceed. But if one or both sides

Which state real estate markets are doing the best, worst during pandemic boom? JEFF OSTROWSKI

efore the coronavirus recession, Utah’s housing market was on fire. Then came the Covid-19 pandemic, which sent residents of Northern California and Seattle in search of affordable homes and more space, and an alreadyhot market grew hotter. Dave Robison, past president of the Utah Association of Realtors, sums up the activity simply. “It’s insane,” says Robison, a real estate broker in Salt Lake City. His assessment isn’t just salesmanship. Utah home prices have been soaring as Californians stream into the state. Utah boasts the nation’s strongest pace of job growth, along with rock-bottom unemployment, few mortgage delinquencies and low state and local taxes. All those factors pushed Utah into first place in Bankrate’s Housing Heat Index when it debuted in 2020. Utah continues to hold the top spot for the first quarter of 2022. Residential real estate has boomed during the coronavirus recession, and Utah has emerged as a particularly desirable market. Other states in the Mountain time zone also are thriving. Montana, Arizona and Nevada rank second, fourth and eighth, respectively, in Bankrate’s index. At the opposite end of the list is Louisiana, where price appreciation is among the slowest in the nation and mortgage delinquencies are among the highest. Hawaii – a state that was hit hard by the Covid-19 pandemic – climbed from the bottom of Bankrate’s ranking. It rose from dead last in the first-quar-

To calculate the ranking, Bankrate analyzed six data points: annual home price appreciation, share of mortgages past due, unemployment, annual job growth, statewide cost of living index and state-by-state tax burdens. These five states had the strongest housing economies in

the first quarter of 2022: 1. Utah – Its home values jumped 26.8% in the 12-month period that ended March 31, third-best among U.S. states, according to the Federal Housing Finance Agency. Utah posted the lowest unemployment rate in the nation in March 2022, according to a Bankrate analysis of Labor Department data. What’s more, Utah’s tax burden is among the lowest in the nation, according to the Tax Foundation. 2. Montana – Home values climbed 25%, and Montana posted top-five finishes in pastdue mortgages, job growth and tax burden. 3. Florida – The Sunshine State’s home values jumped

30%, job growth is strong and taxes are low. 4. Arizona – Home values surged 28%, best in the nation, and few homeowners have fallen behind on their loans. 5. Tennessee – Home values are up 26%, job growth is strong and cost of living is moderate.

Homebuyers seek affordability, space The prominent rankings of states in the Mountain time zone illustrate a shift in the housing market: Americans are still drawn to healthy labor markets, but even before the coronavirus pandemic, they were growing less willing to pay up to live in

places like San Jose, Seattle and Boston. Covid-19 has pushed many – especially those who can work remotely – to leave the priciest areas for more affordable regions. “We are seeing the makings of a renewed affordability migration,” says Mark Vitner, senior economist at Wells Fargo. “The beneficiaries of that shift have largely been the midsized metros in the mountain states of the West.” The median price of a single-family home sold in Silicon Valley during the first quarter was a whopping $1.88 million, according to the National Association of Realtors. The typical price in Salt Lake City was $556,900 – above the national median, but not dramatically so, and just a fraction of the price paid by residents of Northern California. The price gap has spurred many in high-cost markets to consider moving. The notion is especially appealing to workers who can take their highwage jobs to areas with lower costs of living. “People suddenly have the ability to choose where they live, because they’re not tethered to an office,” says Alicia Holdaway, an agent at Summit Sotheby’s International Realty in Draper, Utah, and past president of the Salt Lake City Board of Realtors. “We’ve had a net in-migration that’s been happening for years, and that’s only increased.” Every boom brings its disadvantages, of course. Design pros share their favorite outdoor lights THE WASHINGTON POST No outdoor entertaining space – even one with quality furniture, beautiful landscaping and a barbecue-ready grill – is ready to take a star turn at an evening event until you add lighting. “When you walk into a great restaurant or a summer wedding and you wonder why it feels so magical, lighting is why,” says Hillary Stamm, founder of HMS Interiors in California. You could just throw up some

string lights and call it a day, of course. But to get the most of your outdoor space – whether it’s an apartment balcony or a sprawling backyard with a pool and gazebo – experts suggest having multiple sources of light. “You’re not trying to create a really bright space,” Stamm says, “but you do need two to three sources of light, such as outdoor can lights, candles or sconces.” Jason Jorgensen, owner of Third Spring Landscape Design in Seattle, says to think in zones.

What are you going to do outside? If it’s reading under a covered deck, you might opt for an LED table lamp. On the other hand, “if you’re dining outside, cozy low lighting works well,” he says. (Think candles and string lights.) And you’ll want to take advantage of the latest technology. Luminary Sunset Coral creates new phlox fanatic L uminary Sunset Coral has turned The Garden Guy into a full-blown phlox fanatic. The rousing color would probably remind you of some electrifying lipstick or fingernail polish, a rare color in the plant world. Our master bath has a huge window overlooking a squareshaped bed with an 8-foot-tall windmill palm in the center. It gives you a touch of the tropics as you soak in the tub. Most plant partnership gurus would never consider a summer phlox, caladiums and elephant ears as an ideal combo, but all I can say

is, holy wow. I first reduced the number and size of existing clumps of Royal Hawaiian Maui Gold Colocasia to three clustered in a triangular pattern around the palm. They were just returning from a winter rest in April. I then planted three Luminary Sunset Coral phlox. They debut next

year and will be in high demand. Next, I grabbed my cordless drill and Twist n’ Plant Auger and planted jumbo Heart to Heart Bottle Rocket caladium bulbs. My first Sunset Coral phlox blooms were in mid-May, a few days ahead of the caladium leaves. If you have the opportunity to plant Heart to Heart jumbo bulbs, you will be amazed. The combination has required watering like everything else this summer, and always making sure the Luminary Sunset Coral phlox has access to sunlight as See Winter, Page 9

From Page 8 its partners start to grow. Even though they reach 28 inches tall with an equal spread, I still from time to time have to remove a leaf and petiole of an elephant ear and caladium too. The size of leaves on the Heart to Heart Bottle Rocket caladiums have been huge, but in a most glorious way, each looking as though they were hand-painted. Every day this bed always gives a new look. In the backyard just over the stacked stone wall, I used Luminary Sunset Coral and Luminary Ultraviolet phlox, alternating with Pyromania Backdraft and Pyromania Blaze torch lilies or kniphofia. The Luminary Ultraviolet can reach 3 feet tall, and I can tell there is some magic of color when partnered with the Sunset Coral. This will be a high priority of mine for next spring planting, especially in proximity to the torch lilies. Then in a new pollinator garden, I used them with the new Meant to Bee Queen Nectarine and Meant to Be Royal Raspberry agastache, Truffula Pink gomphrena, Rockin Playin’ the Blues salvia and Pyromania Blaze torch lily. This gives you a little bit of a prairie habitat look, which I love. The Luminary series of tall garden phlox now totals four gorgeous colors, including Opalescence, which is hot pink and in my front yard, and the white Backlight, which is new in garden centers this year. All of the Luminary series are fragrant as you would expect and tops for disease resistance. I have yet to see powdery mildew on any of them at my house or in any trial. The tall garden phlox, known botanically as Phlox paniculata, is native to 36 states and will thrive at your home, too. The prerequisites are sunlight and consistently moist but well-drained soil.
