Pay title company to do complete check, you may still own half of the cabin Q: I’m a really longtime reader and very much appreciate your column, but for the first time I have a question I really need help with. My brother and I inherited a cabin up in Truckee from our parents many years ago. I haven’t been up there in years due to my health. Recently, my eldest grandson turned 18 and I offered to let him go up with some friends to spend the weekend. My brother has always managed the place so I called and left him a message that they’d be coming up. When they got there they knocked on the door and, to their surprise, found a family living there who

I haven’t been able to get a hold of my brother but I have a good friend who is a local Realtor. He contacted a title company who took a quick look and told him it looked like the cabin had been sold last year. I never agreed to sell and didn’t know anything about it.
I haven’t gotten any money. What can I do? A: I actually represented somebody in your position a number of years ago so this isn’t incredibly unusual. Let me start by saying you haven’t given me nearly enough facts to draw a firm conclusion, but I can imagine a couple of possible scenarios. ith numerous municipalities and states considering or enacting strict limits on residential grass, you may have considered ditching your home’s turf. Xeriscaping – or designing a landscape that needs little irrigation to survive – is no longer a radical idea, even if you don’t live in an area where lawns are being restricted. Traditional lawn grasses are thirsty. Because of shallow roots, they need anywhere from 20 to 60% more water than other plants in your yard to appear green and lush, says Haven Kiers, assistant professor of landscape architecture at the University of California at Davis. The shallower the roots, the faster the grass dries out and the more water it needs, which is not ideal when parts of the country are coping with unprecedented drought. At least 50% of the water in the Western United States is used for landscape irrigation, says Lindsay Rogers, a water policy analyst with Western Resource Advocates. “When you replace your lawn with droughtproof landscaping, you save about 40% in outdoor water use,” she says. “Not only is it important to water security, but you save significantly on your water bills.” Converting your lawn doesn’t mean having five spindly plants poking through a rock pile, though, or a sea of cactus and gravel. Native plants generally require less water, because they have naturally evolved and adapted to the environment. “You can have a drought-tolerant garden – emphasis on the word ‘garden’ – that is both beautiful and sustainable,” Kiers says. Here are some steps to transition your yard (or portions of it) to a drought-friendlier – but still inviting – space.

Map your space Sketch out your yard, including a rough estimate of its length and width. Use circles to mark existing trees and shrubs, and note any paths or permanent features. Also, determine whether the soil is clay or sand; when you wet it, clay will roll into a ball, and sand will break apart. Note which areas are sunny or shaded,
and where it is wet, moist or dry. Once you have a blueprint, you can make copies and pencil in different designs and plants. Kiers says you should also take photos of your yard and bring them with to your local garden center or home improvement store to help salespeople visualize your space and offer suggestions. “It is important to research how big plants get,” Colwell says. “If you learn a plant is going to grow to five feet, you want to put it in a space that allows for full growth, so you never have to prune it.”

Choose plants that can handle conditions in your location. “We get 55 inches of rain a year in Atlanta. Drought may not be an issue, but flooding is, and 80 to 90% of water that falls on a mown lawn runs off instead of infiltrating the soil,” Hall says. “Then we deal with hot, dry summers, so we still have to irrigate. I’m looking for plants that can take from 30 to 70 inches of rain per year and can handle hot and dry conditions.”
There are several ways to do this. One is to turn off the water and solarize the lawn by covering it with black plastic. The trapped heat will fry the grass, and you can till it into the soil. This usually takes about two months. Another option is to cover the area with pieces of cardboard, then cover that with a few inches of mulch. As the cardboard degrades, it will kill the grass, and you can replace it with new plants. Or you can dig out the grass, removing the top one to two inches of soil, includ-

Jones From Page 2 estate ownership. Real estate isn’t just one thing. A chunk of land represents a very long list of rights (sticks) that pertain to the land. As the landowner, you may have a pretty big bundle, but you never hold all the sticks. For example, you may hold a deed to the land, but undoubtedly there are others who have easements across your land. Those easements are sticks in the bundle that you don’t hold. You may not have the mineral rights or there could be zoning restrictions. So your neighbors, the city, the county, utility companies, etc. hold those sticks. There’s many, many more examples, but you get the idea. So in any real estate issue you have to look at your bundle to determine what sticks you hold and which ones you don’t have. I presume you and your brother each had a deed to onehalf of the cabin. That means you had a bunch of sticks and your brother had an equal number of sticks. Absent some type of agreement between the two of you to the contrary, your brother had a right to sell his bundle of sticks.
But unless there were some laws broken, such a sale would have no impact on your sticks. So here’s what might have happened. Your brother wanted to cash out. He may have found someone who would buy a deed from him. Maybe it was a friend or a friend of a friend. But in any event the guy was willing to give your brother some cash and your brother signed over a deed and handed the buyer the keys. I deliberately mention it was likely a cash transaction because no mortgage company would issue a mortgage without getting a title insurance policy. Had a title insurance company run a title check, they would have discovered your 50% ownership and the loan company would not have made the loan. But if we presume the buyer doesn’t read this column and therefore didn’t know much about Real Estate 101, they may have thought they were simply buying a cabin the same way they’d buy a piece of furniture. In other words, “Here’s the money, give me the keys.” But don’t worry. If that’s what happened, your half-ownership is still safe and sound. It’s just that you and the new buyer are now partners. could drive up there this afternoon, with your authorization, and legally just let himself in, although it would be a really bad idea from a personal safety point of view. The only other option I can think of is your brother forged your name on a deed in violation of a number of laws. He would have had to get somebody to notarize your signature, but I’ve seen it happen. I’d go back to the title company and pay to have them do a complete title check. That will tell the real story. Assuming it turns out your brother only sold his sticks, you need to contact the new buyer and try to work something out. If you can’t, you may need to file a lawsuit for partition to get your cash out of the place. If your brother told the buyer he was buying the whole thing, the buyer will have a lawsuit against your brother. But if your brother forged your signature, you not only have to file a lawsuit for fraud but the county’s district attorney’s office will need to get involved as well. Evaluate the irrigation In dry climates, a droughtresistant yard still needs
water-efficient irrigation, Hall says. This could mean installing a low-pressure drip system, which delivers water to the root zone; converting your existing sprinklers to drip; or retrofitting pop-up spray heads with waterefficient hardware, such as an MP Rotator, which disperses larger water droplets that fall to the ground instead of evaporating. In wet climates, if you use native plants, you may not need irrigation once the plants are established.
Consider hiring a pro Those who are uncomfortable with do-it-yourself gardening or who have a bigger budget may want to consult a landscape architect.
