Road improvements impact some businesses more than others Q: I own a small business. I’ve been here for just going on nine years now. I’ve just learned that the city or county or someone is going to change the road in front of my store. Apparently they intend to widen the road to two lanes in each direction. I have no trouble with that since the road gets really crowded during rush hours. The problem is they intend to put a concrete divider up between the two middle lanes with no turn lane toward my store. In other words, you’ll have to be coming from the south to get to my store. If you’re coming from the north, you won’t be able to make a left turn. That means I could lose 50% of my business. Is that legal? How do I fight the plans? A: Longtime Solano County residents have witnessed sweeping changes over the past 30 years in how we drive around. Maybe I’m aging myself, but not all that many years ago, at least in Fairfield, there were only a couple of stop lights and you could get to anywhere from anywhere pretty much in a straight line. Then the state built a freeway and cut the town in half. Suisun City’s Main Street was severed from Union Avenue in Fairfield so the street wouldn’t cross the railroad tracks, leaving downtown Suisun City much less connected to shoppers in Fairfield. Lately, the first phase of the Suisun bypass was completed, allowing folks to make a bee line to Costco, but along the way bypassing other businesses. All of these changes, along with many, many more over the years, have been done to make transportation safer, faster and more practical for our evergrowing population. The small town format of

The process of trying to change the roads to allow for future growth is generally known as “transportation planning.” But with every change to the “grid” some businesses benefit and some suffer. Some residents find it easier to get to work or their favorite shopping center, while others experience the opposite. Planning laws have evolved over, roughly, the past 100 years or so, with some of the biggest changes occurring in the past 30, mostly through court decisions. You find yourself in a position where the government is making decisions that take money out of your pocket in what you believe will be lost sales revenues. There are constitutional restrictions on the government’s ability to take money or property from you without giving you compensation. Properly called eminent domain, the government has the legal right to take your property for the public benefit, like to build a freeway, but they must pay you the value of what they’ve taken. The questions arise when the government’s actions take something less tangible from you, like lost sales revenues due to a public improvement. This often happens when zoning changes are made that suddenly forbid the very type of business you’ve been running there for years. Twenty years ago court deci-

sions were all over the board regarding how much you had to suffer in lost revenues before the state had to compensate you. But more recent decisions, going right up to the Supreme Court, have determined that the government seldom needs to compensate you if it is leaving you with the property itself and you can put it to any economic use at all. The idea is that we are all citizens who share a common burden for the good of society, and sometimes one person simply suffers a greater burden than someone else. Though that increase can rise to a unreasonable level that requires compensation. So the short answer is if they build the barrier, you’re probably stuck. From a practical viewpoint, you will want to negotiate with whatever agency is running the project. Perhaps you can yell loud enough to get a turn lane. But if the engineers feel the turn lane is impractical, or even dangerous, under the circumstances, there’s not much you can do. However, businesses such as yours are often able to negotiate something. For example, perhaps the agency will agree to erect some signage informing drivers how to get back to your store. Everything is up for negotiation, but you have to start early. Hopefully you can start your lobbying before the plans and budget are finally approved. Mortgage rates held in check as recession fears mount THE WASHINGTON POST After being prodded higher by inflation fears, mortgage rates were dragged down this week by recession concerns. According to the latest data released Thursday by Freddie Mac, the 30-year fixed-rate average dropped to 5.7% with an average 0.9 point. (A point is a fee paid to a lender equal to 1% of the loan amount. It is in addition to the interest rate.) It was 5.81% a week ago and 2.98% a year ago. Freddie Mac, the federally chartered mortgage investor, aggregates rates from around 80 lenders across the country to come up with weekly national averages. The survey is based on home purchase mortgages. Rates for refinances may be different. It uses rates for highquality borrowers with strong credit scores and large down payments. Because of the criteria, these rates are not available to every borrower. The 15-year fixed-rate average also moved lower, falling to 4.83% with an average 0.9 point. It was 4.92% a week ago and 2.26% a year ago. The five-year adjustable rate average rose to 4.5% with an average 0.3 point. It was 4.41% a week ago and 2.54% a year ago. “The rapid rise in mortThe Law Offices of

gage rates has finally paused, largely due to the countervailing forces of high inflation and the increasing possibility of an economic recession,” Sam Khater, Freddie Mac’s chief economist, said in a statement. “This pause in rate activity should help the housing market rebalance from the breakneck growth of a seller’s market to a more normal pace of home price appreciation.” Since the start of June, the 30-year fixed average jumped 72 basis points before retreating this week. A basis point is 0.01 percentage point. The sharp spike has made homes less affordable and cooled sales, putting a damper on what had been a booming housing market. The way financial markets are waffling between anxiety over inflation and trepidation over a recession is leading to the volatility in mortgage rates. “Markets are struggling to price in the competing dynamics of persistent high inflation and the impact of Federal Reserve rate hikes,” said Paul Thomas, vice president of capital markets at Zillow. “The Fed has indicated they are focused on getting inflation under control through See Mortgage, Page 5

Let’s explore ways to keep your low mortgage rate H ow do I hold on to my 2.75% fixed-rate mortgage and move up to a new home? This is a question lots of people who planned to move up or down in 2022 are asking now. Anyone who purchased a starter home between 2010 and 2018 may be busting at the seams with children and pets that they didn’t have when they purchased. Many homeowners bought their first home as an investment with a strategy to sell it in five or six years after their income, net worth, FICO scores and their home’s equity were higher. Some seniors have been planning for years to move down to a one-story home with less maintenance but are now hesitant because, like many folks, they might have a 3% fixedrate mortgage. Here are a few ideas on how to keep your low rate: No. 1: Convert your departing residence to a rental property and keep the home as part of your retirement income plan. Inflation will be your friend. The

rent on the property in 25 years should be 75% higher if the average rate of inflation is 3% and the home value will obviously be a lot higher, too. No. 2: Sell a percentage of your departing residence to a trustworthy family member for them to live in and make the payments with you remaining on title to avoid the lender enforcing the due on sale clause. You could also sell 50% of the property to a friend or a family member for you and your partner to own and manage as a rental. This investor would simply pay you 50% of your equity over the lowrate mortgage. An equity share agreement is like a partnership and should be drafted with legal advice from a lawyer, but it is legal and could be a win-win for the buyer and the seller.
