With no HOA board in place you’ll have to sue neighbor to enforce CC&Rs Q: I moved to town last year and started reading your columns the first week I was here. Now I need your advice. I bought a home in a 20-yearold subdivision. We have a thick set of CC&Rs that, among other things, prohibit people from parking recreational trailers in front of their house and from parking anything on their grass. About a month ago some renters moved in across the street. They have a really big fifth-wheel trailer they half park on the driveway and half across the grass. The big old truck they haul it with is kept parked on the street in front of the house, another violation of the CC&Rs.
Tim Jones I’m sick of even having to look across the street. I abide by the rules and it’s only fair that I can expect others to do so, too. So I talked to my neighbors and we decided to take it to our homeowners board of directors. After spending weeks trying to figure out how to do that, we finally realized we don’t have a board of directors. In fact, it appears there hasn’t been a homeowners
association meeting for years, let alone an election. So we don’t know what to do now. Can the police enforce the CC&Rs? What do we do? A: As surprising as this may sound, this is not the first time I’ve run across subdivisions which technically have a homeowners association but no existing board of directors. When the builder built your subdivision and put the CC&Rs into place, the builder himself acted as the board of directors. Should you consider an adjustable-rate mortgage?

ith mortgage rates spiking in recent weeks to levels not seen for more than a decade, home loan borrowers are considering their options for financing. Approximately 11% of mortgage applications were for adjustablerate mortgages (ARMs) in the first week of May, according to the Mortgage Bankers Association – nearly double the share of ARM applications three months ago, when mortgage rates were lower. We asked three mortgage lenders for advice about ARMs: Brian Koss, executive vice president of Mortgage Network in Danvers, Mass.; Tom Trott, branch manager of Embrace Home Loans in Frederick, Md.; and Kate Gurevich, managing director of Found It Home Loans, a division of Cherry Creek Mortgage in Denver. All three responded via email, and their responses were edited. Q: Are you finding more borrowers want ARMs now? Are these repeat buyers, first-time buyers or both? Koss: Borrowers are more open to ARMs right now due to the potential savings. Each situation is different, but we are seeing interest from both firsttime and repeat buyers. Trott: More buyers are certainly reviewing their options as they relate to adjustable-rate mortgages vs. fixed-rate mortgages. In my experience, most first-time home buyers are continuing with 30-year fixed-rate mortgages. Repeat buyers are more open to choosing an ARM. Q: Why do borrowers want an ARM when rates are rising? Shouldn’t they be worried about rates rising too much? Gurevich: An ARM can still be advantageous if a borrower knows that they will not carry the property for the typical
15- or 30-year term of a fixedrate mortgage. Trott: When rates are rising, borrowers are more likely to consider an ARM with the hopes of rates declining in the future. Some borrowers may know that they only will own the property (or have it financed) for five to 10 years, so an ARM is ideal for their financial plan. Q: What are the advantages of an ARM? Koss: ARMs come with a lower rate for an initial period, such as five, seven or 10 years, so the monthly mortgage payment is significantly less than a 30-year-fixed rate loan. Even if the rate adjusts higher in the future, the borrower will usually be making more income by then. Trott: An ARM provides increased cash flow upfront because of the lower rates associated with the fixed-rate portion of the mortgage before the rate adjusts. An ARM will allow a borrower to more comfortably afford a more expensive home with lower payments. Q: What are the disadvantages of an ARM? Gurevich: An ARM will typically have a lower interest rate than a fixed-rate mortgage. However, the homeowner will be subject to market volatility and unpredictable interest rates down the road. If rates rise much higher, it could significantly increase a consumer’s housing payment and potentially put them in financial hardship. Koss: No one knows for certain what will happen with rates. If rates increase, the borrower might not be in the best financial shape to handle the higher payment. Trott: The disadvantages in an ARM are related to future uncertainty of the interest rate environment. If the interest rate goes up 2% (from 4 to 6%) on a $500,000 loan, the principal and

Q: Please briefly explain how ARMs work. Trott: ARMs are set up with an initial fixed-rate period, which is usually five, seven or 10 years. Once the fixed-rate period expires, the rate typically adjusts every six months or yearly. The new interest rate is determined by a p ublished index plus a margin. If the index is 5% and the margin is 2.25%, then the new rate would be 7.25%. There are caps on how much the rate can increase at the first adjustment as well as subsequent ones. In the above example, if the initial rate was 4.5% and the interest cap on the adjustment period was 2%, then the new rate would be 6.5% instead of 7.25%. Koss: For the initial loan period, usually five, seven or
10 years, you’ll have a lower fixed rate. Depending on your loan terms, at the end of that period, the rate can potentially go up 2% a year, but never more than 5% over the life of the loan. The rate can go down, too. After the initial, fixed-rate period, your new payment will adjust based on the remainder of principal at that time. For example, your rate may go up 2%, but your loan balance may be $40,000 lower. Q: Any advice on who should consider an ARM and who shouldn’t? Gurevich: An ARM may be a good option if the borrower knows they will not be keeping the property longer than the fixed-rate period of the ARM. A borrower may choose an ARM if they have the financial ability to withstand major interest rate fluctuations and potentially a
significantly higher payment as well. Some borrowers also choose an ARM if they strongly believe that the current trend of high and climbing interest rates is unsustainable, and that rates will drop and allow them to refinance in the future. Most borrowers, however, prefer the financial security of a fixed-rate mortgage product. Trott: If you have good financial discipline, an ARM is a viable option. If you carry a significant amount of debt that is likely to increase over time, an ARM can be dangerous for you financially. The borrowers who are best served by ARMs are the ones who know their mortgage will be on the property only for the initial fixed-rate period. This scenario avoids the future interest rate uncertainty.

Mortgage rates move higher THE WASHINGTON POST After wandering lower the past four weeks, mortgage rates sharply reversed course this week. According to the latest data released Thursday by Freddie Mac, the 30-year fixed-rate average increased for the first time in a month, climbing to 5.23% with an average 0.9 point. (A point is a fee paid to a lender equal to 1% of the loan amount. It is in addition to the interest rate.) It was 5.09% a week ago and 2.96% a year ago. Freddie Mac, the feder-

Then, over time, elections were probably held, directors sometimes quit and moved, new directors stopped going to meetings, and at some point no one was even scheduling meetings. Frankly, it’s kind of understandable. Homeowner association boards are very much like city councils and operate much the same way. Board members do the same kind of work and take the same amount of abuse from their constituents. But unlike city council members, board members do it all for free. California law prohibits association board members from getting paid while many council members make a fair amount of income. With nobody ultimately wanting to work for free, everything just comes to a stop. Only now, when you want the HOA to take action against your neighbor, is somebody noticing the association is effec-

tively gone. The process for rehabilitating your HOA and getting it back on its feet is far too complicated for this column. But to give you an idea, you’re going to, at a minimum, go to the California Secretary of State and file documents and pay money to reinstate the HOA’s corporate structure. This could include filing back tax returns and even paying back property taxes on common areas such as streets and community parking lots. Then you’ll have to appoint an interim board of directors, the sole purpose of which is to hold an election that conforms to the newer, more technical guidelines of California law. Once the elections are held and a new board is in place, you’ll be back on your feet. Unless, of course, nobody steps up and volunteers to serve on the board. But doing all of those things is a long process and doesn’t address the problem across the street from you. No, the police cannot enforce the CC&Rs without a court order to do so. Look carefully at your CC&Rs and see if they contain a prohibition against neighbors directly enforcing the provisions of the
CC&R in court. Some CC&Rs do have such a prohibition, but most don’t. Whether there’s a prohibition or not, you are going to have to file a lawsuit against the neighbor. The suit would be against the owner of the property since they are the ones who are subject to the CC&Rs. CC&Rs are nothing more than contracts between all of the property owners. In essence, you are suing the owner for breach of contract since he allowed his tenants to break the contract rules. Even if the CC&Rs have a provision preventing the right of private action, like a lawsuit, a court will likely find that since there is no other remedy available until the new HOA is reinstated, you will be allowed to get a court order that makes the tenants move their vehicles. The order is called an “injunction.” With an injunction in hand, the police can enforce its provisions.

At its May meeting, the Fed raised its benchmark rate by a half-percentage point, its sharpest rate hike in 22 years. Another half-
percentage point increase is on the table this month. The central bank took its first steps toward bringing down inflation in March when it boosted its benchmark rate for the first time since 2018. Although the Fed does not set mortgage rates, its actions influence them. “As the Fed continues its aggressive activities – rolling off billions from its balance sheet and rate hikes – to slow inflation, mortgage rates will climb higher as a result,” said Ken H. Johnson, real estate economist at Florida Atlantic University. It is not just the Federal
Reserve that is raising interest rates. The European Central Bank announced this week that it will raise its key rate for the first time in 11 years next month in an effort to combat inflation. It also said it would cease its bond-buying program in July. Although the Fed’s actions are putting upward pressure on mortgage rates, other factors are dragging them down. “Rates have continued to fluctuate over the past few weeks as volatility persists,” Robert Heck, vice president of mortgage at Morty, an online mortgage marketplace, wrote in an email.
