Consider paying full mortgage, suing friend for her portion to keep home Q: A friend and I purchased a home together and drew up an agreement. My friend didn’t pay anything down but has paid half of the mortgage and property tax. She is a 40% owner. I put down $75,000 and pay half of everything. I’m a 50% owner. My mom kicked in $75,000 and pays nothing else. She is a 10% owner. Her name is not on the loan but my and my friend’s names are. My friend decided she wants out of our agreement and is going to walk away. I cannot afford the mortgage by myself. I’m not really interested in suing her but I want to do whatever I can to protect my assets and credit rating. I would be short about $2,000 each month for her share of the mortgage, which would eat away my retirement savings in about two years and I have no intention of using it to make good on a loan that I’m only half responsible for. My friend is unwilling to pay anything. Any advice you can give would be much appreciated. A: I assume your written agreement didn’t include any instructions about what you would do if somebody wanted out of the arrangement? A written agreement, known as a Tenancy in Common Agreement, could have established a procedure for everyone to follow. If your co-owner is willing to cooperate in selling the property, then that would be the closest thing to an ideal solution. Otherwise, there are other options, none of which are ideal. Absent a Tenancy in Common Agreement to the contrary, as a 40% owner your
Tim Jones friend is responsible for 40% of the mortgage and taxes, at least from your perspective. From your bank’s point of view, both of you are liable for 100% of the mortgage and the bank doesn’t care who contributes how much to the payment. If a full monthly payment is not received by the bank in a timely manner, both you and your friend will see a ding on your credit reports, and eventually a foreclosure. On the other hand, if you make the full payment, you are entitled to walk into court and get a judgment against your friend to reimburse you for her portion of the payments you made on her behalf. But that assumes: 1. You get mad enough to sue her, and 2. She actually has any money you can collect. None of those options directly affect your mom. However, the last two options potentially do. Regular readers are familiar with the term “partition lawsuit.” In a partition suit, one owner sues the other owners to get out from their ownership of a common property. In such a suit, the plaintiff is guaranteed to get what they want, but it could take a year or more and, of course, there could be tens of thousands of dollars in attorney fees and costs. However, a partition suit would preserve most of the home’s equity and probably
repay your mother for her contribution. If you aren’t willing to make the full payment, with or without the hope of forcing a contribution from your friend, and if your co-owner won’t cooperate in the sale, and you’re not willing to file a lawsuit, your only available choice is to walk away yourself. In this instance, the downside of this option is the ding on your credit, the fact that you’ll lose your down payment, the fact your mom will lose her down payment, and the possibility that your bank will sue you for any money it loses. But it could get worse. If the agreement was that your mom kicked in $75,000 and would be allowed to live there for the rest of her life without paying any mortgage or taxes, then she has a right to expect you and your friend to live up to the agreement. If you allow the home to go into foreclosure, and she loses her down payment and home, she can successfully sue both you and your friend. And frankly, she probably should since none of this is her fault. Of all of those choices, maybe you should start with giving some serious thought to paying the mortgage yourself and suing your friend, soon-tobe ex-friend, for her share of the expenses. Mortgage rates moved lower for 3rd straight week THE WASHINGTON POST
According to the latest data released Thursday by Freddie Mac, the 30-year fixed-rate average moved lower for the third straight week, slipping to 5.09% with an average 0.8 point. (A point is a fee paid to a lender equal to 1% of the loan amount. It is in addition to the interest rate.) It was 5.1% a week ago and 2.99% a year ago. Freddie Mac, the federally chartered mortgage investor, aggregates rates from about 80 lenders across the country to come up with weekly national averages. The survey is based on home purchase mortgages. Rates for refinances may be different. It uses rates for high-quality borrowers with strong credit scores and large down payments. Because of the criteria, these rates are not available to every borrower. The 15-year fixed-rate average ticked up to 4.32% with an average 0.8 point. It was 4.31% a week ago and 2.27% a year ago. The five-year adjustable rate average fell to 4.04% with an average 0.3 point. It was 4.2% a week ago and 2.64% a year ago. “Expectations for how the Federal Reserve will attempt to The Law Offices of

Although inflation in the United States eased slightly in April, it remains at 40-year highs. Prices rose 8.3% in April, compared with prices a year ago, down from an 8.5% increase in March. 90-degree line between walls and ceiling, painting the ceiling may be the best choice for a clean, crisp look, Hunnefeld says. “You don’t have a natural break, visually, that you do when you have 90-degree perpendicular angles,” he says. “So you’d have to re-create that line, and re-creating that line is complicated in technique, because you’d basically have to freehand.” Painting that line by hand, he says, can leave you with a less-polished look. Extending the color up the wall to the ceiling mitigates this problem. “In some homes, where you might have a bullnose, or a rounded wall, rather than creating an artificial line – whether it’s a horizontal line or a vertical line – just continuing the paint doesn’t create visual truncation,” Galbreath says. “It allows you to continue your view upward.” The room, she says, runs in a single visual plane, as opposed to in several disconnected and choppy planes that draw the eye back and forth.
Contrasting sheens Even in a room where the ceiling is the same color as the walls, you can create contrast with a paint’s sheen. Hunnefeld suggests using a semi-gloss or high-gloss paint on accent points, such as the trim, so the eye picks up different elements in the room. “It’s a juxtaposition, and it can be very subtle,” he says. In a room where the color is all the same, the differences are visible in how the light hits the pigment. That’s where sheen can be important. Or, Cesa says, lean into sheen in a different way by using it on the ceiling. “If you want to heighten the drama and bring some more texture into the space, you can also opt for a ceiling in a higher gloss, which

will mean greater shine and reflection,” she says. But glossier sheens, she notes, can affect how a color casts, and that’s worth keeping in mind. If you use a glossy sheen on the ceiling, consider painting your walls in the same finish, “to keep things simple and unified,” she suggests.
The illusion of space Although one common fear of painting a ceiling with darker colors lies in closing a room in, the truth is that a deeply saturated ceiling can actually enlarge a space. “It helps to blur the lines and edges of the space,” Cesa says. “It can make small rooms feel larger.” Galbreath agrees. “It can sort of make the ceiling go away,” she says. When you use different paint colors, she says, you are accentuating the difference between wall and ceiling.
Do a test run Painting your ceiling with color is not without pitfalls, especially if you choose a highly stylized look. Hunnefeld says a ceiling that is both pigmented
and rich in sheen hides nothing, and slight imperfections in drywall are also more apt to leap to the surface. And if your ceiling has a textured finish, it’s best to stick with white paint. “The flatter the surface, the less imperfections show,” Hunnefeld says, noting that one workaround is to reduce the sheen to flat or matte. He adds that color is harder to touch up if the ceiling needs a little bit of work in the years to come. If you decide that color is the way to go, Galbreath says that testing is important to determine how the color will play out in your space and its lighting. She suggests painting large samples next to one another, marked clearly. “I don’t think you can talk about paint color without talking about light,” she says. “Paint a lot of swatches. Make them big enough that you get the impact of what the room would feel like if it were to be painted in that color. weekend was a sad weekend with America’s flags flying at half staff for the 1.4 million who have died in American wars and the 21 lives lost in Texas last week. I thought it would be interesting to write about how and why salespeople, like me, can come to work this week with a positive, winning attitude and friendly smile on our faces. The key is the work and the belief that what you are selling can make a dramatic difference in a person’s financial life for the better. The top salespeople of the world are made up of the top 10% of the population in that industry, and one thing they all have in common is the ability to be positive and upbeat no matter what is going on in their life. It may sound a little fake, but the last thing a new client wants to hear about when interviewing a salesperson is the huge argument he or she had with their spouse yesterday or their mom’s cancer diagnosis at their first meeting. Existing loyal clients who already know the salesperson is awesome and cares about them are a different story. Raving fans who a salesperson already has a longstanding relationship with would probably be OK if the salesperson told them on a Monday that they didn’t feel well or were in a bad mood from a rough weekend, but first impressions are a key to success because it takes time for a salesperson to earn trust and a long-term relationship with a client. I try to write with a hopeful and positive attitude about the American Dream, but the elephant in the room is evil. Let’s assume that 99% of the U.S. population is good
and 1% is evil. This is way more than the cup half full. Majority rules. As a basketball and loan officer coach for 40 years, I believe teamwork is the key to success in business, family and life. It takes a village to raise a child and it will require all 99% of the good population as a team to defeat the 1% evil. The Celtics may lose to the Warriors next week, but I guarantee all 10 of the players will be on the same page and work together if they have any chance at victory. The U.S. must find common ground and work together if we have any chance of winning the American Dream for our kids and grandkids. For the veterans and our active duty, thanks for your service. And for those of you who lost loved ones, we will never forget your family’s sacrifice for our team.
