HOAs rules govern what actions may be taken Q: We moved into our home seven years ago. We were told we had a homeowners association and we were given a set of the CC&Rs governing our development. We went to an association meeting and were told the association isn’t incorporated. We have some renters in our home who won’t follow the rules. Is there anything the association officers can do about this? Also, under the law, is it even possible to have a homeowners association that isn’t incorporated?

A: I’m not entirely sure I understand the first part of your question, so I’m going to try and provide answers to several different questions and hopefully I’ll hit on the information you’re looking for.

Homeowners associations are becoming the norm for new housing developments, not that there’s a lot of those right now.

An HOA is a type of city council (except, unlike council members, the board members work for free) that exists only by the agreement of all the homeowners. Like a city council, its purpose is to govern the dayto-day management of the development.

Some HOAs, like in Fairfield’s Rancho Solano or Eastridge, have sweeping powers and relatively large budgets with which to manage streets, fences, street lights, security, green space, etc.

They can fine homeowners for parking their cars on the street at night or painting their home an unapproved color. They typically have a private security force to monitor the security of the development as well as serve as a surrogate police force capable of breaking up parties and even making arrests.

Others are not given all of those powers, or money, and simply set rules related to the

Tim Jones operation of the development while having very few tools to enforce those rules. Typically, these types of HOAs leave any enforcement to the individual homeowners who are left with no option other than to ignore the problem or file a lawsuit against their neighbor.

The powers given, or not given, to an HOA are mostly contained in the CC&Rs, which functionally serve like local ordinances defining what the HOA can and cannot do.

When it comes to making tenants follow the rules, regardless of the type of HOA, ultimately the property owner or landlord is responsible to the neighbors and the association.

No HOA has the ability to fine a tenant. Though the tenant is liable to their homeowner/landlord, liability to the HOA rests with the homeowner herself.

So, the answer to the question I think you’re asking is: No, the officers of the association, incorporated or not, can’t be relied upon to supervise your tenants.

That’s your responsibility as the homeowner.

To answer the second part of your question concerning incorporation: No, I guess an HOA doesn’t technically need to be incorporated.

If the CC&Rs lay out the existence of the HOA, and each homeowner’s deed requires the homeowner to adhere to the CC&Rs, then it’s possible to have a de facto association that operates without the benefit of the corporate structure or protections. But I can’t imagine why anyone would want to do so.

Although it’s true that pros generally purchase most furniture and other decorative items from trade-specific vendors, many also rely on tried-and-true retailers accessible to the general public. We asked 11 designers to share their favorite pieces that anyone can buy, and why those items never let them down. Here are their picks.

Picture lighting is a simple way to bring a museum-like quality to any home. Tucson designer Priya McCulloch suggests the 18-inch brass picture light from Circa Lighting ($399, circa lighting.com). “I love using these for built-in bookshelves or to highlight art,” she says. They also are available in bronze and antique or polished nickel and “add a classic touch to any space,” McCulloch says.

They can give an old lamp a chic update, she says. Grandma Jane uses reverse mortgage to improve her life

randpa Dick and Grandma Jane paid off their house in 1999. Dick was 70 and Jane was 65.

Dick died peacefully a couple of years ago at 90 and left Jane in great financial shape with a $750,000 home free and clear, no other debt and $70,000 in savings. Jane’s income went down upon his death by about 30% but she had one less mouth to feed and her monthly cost of prescriptions and auto insurance went down.

Jane’s three kids are all over 55 and, thankfully, none are financially dependent on Jane but none of the three kids are millionaires.

Jane’s house is now appraising at $870,000 and she survived the miserable pandemic. Jane’s

net take home each month is $4,000, which isn’t bad, but she is taking $1,000 per month from her savings each month and continues to have home and auto repairs. Jane and her kids realize the savings will be gone in two years.

Jane and the kids decided to take a one-hour HUD sponsored counseling class on how a reverse mortgage might help her over the next 10 to 15 years because they all agree, Grandma Jane will probably make it to 100.

They decided to move forward with a reverse home

equity conversion line of credit and take out $50,000 now to totally renovate the swimming pool and take the entire family to Hawaii for 10 days. The line of credit is $450,000, which allows her to take a monthly distribution of $1,000 per month so she doesn’t have to see her savings account dissipate any further, and if ever she needs a lump sum of $10,000 to $20,000, she can simply make a call for the amount needed.

The kids and her financial adviser are calculating that when Jane turns 97 in 10 years her loan balance may be

$300,000 and because the unused portion of the line of credit grows each year, her available line of credit will be $200,000 that she can use any way she and her kids see fit.

The life insurance industry was brilliant when they decided to call death insurance, life insurance. The mortgage industry wasn’t that smart when they decided to call this loan product reverse because this isn’t Grandma Jane going backward, this is Jane and her kids moving forward. Go, Jane, go.

If Jane dies at 97, she will leave the kids a $1 million home

Fixed mortgage rates move lower for the second week in a row THE WASHINGTON POST For much of this year, mortgage rates had been steadily climbing higher, reaching levels not seen in more than a decade.

But these past few weeks have offered a bit of a reprieve.

According to the latest data released Thursday by Freddie Mac, the 30-year fixed-rate average dropped to its lowest level in five weeks, falling to 5.1 percent with an average 0.9 point. (A point is a fee paid

to a lender equal to 1 percent of the loan amount. It is in addition to the interest rate.) It was 5.25 percent a week ago and 2.95 percent a year ago.

Freddie Mac, the federally chartered mortgage investor, aggregates rates from around 80 lenders across the country to come up with weekly national averages. The survey is based on home purchase mortgages.

Rates for refinances may be different. It uses rates for highquality borrowers with strong

credit scores and large down payments. Because of the criteria, these rates are not available to every borrower.

The 15-year fixed-rate average slid to 4.31 percent with an average 0.8 point. It was 4.43 percent a week ago and 2.27 percent a year ago. The fiveyear adjustable rate average rose to 4.2 percent with an average 0.3 point. It was 4.08 percent a week ago and 2.59 percent a year ago.

“The Freddie Mac fixed rate

for a 30-year mortgage fell for the second week in a row, following Tuesday morning’s sharp dip in the 10-year Treasury,” Joel Berner, senior economic research analyst at Realtor. com, wrote in an email. “Yields quickly fell 14 basis points from the day’s open and have hovered around 2.75 percent since. New Hawaiian Ti varieties create a dazzling taste of the tropics

O

ur Taste for the Tropics just got a lot larger this year as Proven Winners has added five new Hawaiian Ti varieties under their Proven Selections label. This brings the Cordyline group to a total of eight selections. Most of us have never seen a named variety of Hawaiian Ti, known botanically as Cordyline fruticosa or Cordyline australis.

I say that referring to how the plants have often been sold generically, and certainly most of us have not had the opportunity to go to the garden center and have options when purchasing. I am already seeing these in

Norman Winter the market as well as in Proven Winners ready-made mixes, where they are being used as thriller plants.

This could not come at a better time, as Southern states are craving Cordylines to be used in high-profile landscapes like community entrances, front entry courtyards and office complexes. Commercial landscapers

have been bold, challenging us in every misconception we have had about the Hawaiian Ti plant.

Consider names like Calypso Queen, Bali Red, and Hilo Rainbow. Those should make all tropical plant lovers eager with anticipation. On the other hand, know that varieties Prince Albert and Red Sister, while not named with a jazzy topical theme, defy logic with their foliage back that seems to glow in shades of iridescent hot pink and red.

are a good buy. Landscapers are going big, planting several. They are also teaching us that if you are going to use one tropical to create some Martinique magic, why not use partners like crotons and gingers? The look will have you imagining steel drums playing in the distance.

The biggest misconception shot down by the commercial landscape trade is that the Hawaiian Ti can’t take full sun.

Over and over, whether on a coastal highway in Savannah or a hot city street in Columbus, Georgia, these guys can take it and look like a million bucks all summer long, reaching heights of 4 to 6 feet.

The Garden Guy’s biggest surprise came after the winter had frozen them to the ground at

my zone 8a home. I simply cut back to just above the ground after the freezing temps turned the foliage a crispy brown.

Incredibly, when I was prepping for spring planting, I noticed every clump was shooting. I wish I had left them in place, but I was doing a redesign. I stuck them in pots with Superbells calibrachoas and Primo Peachberry Ice heuchera. It took them no time to reach 30 inches in height.

The common name “cabbage palm” is associated with the cordyline or Hawaiian Ti, which is a little odd, but such is often the case in common names. They do get much taller in the tropics, which is probably associated with the palm idea. The variety Red Star, known botanically as Cordyline australis, looks for the world like a thick burgundy red dracaena.
