Landlord has to prove he has lawful right to evict tenant Q: My husband and I are longtime readers, first-time writers. We own three rental homes we have had for over 15 years now. Since both my husband and I are retired, we have the time to do the management ourselves and, with only a few bumps in the road, haven’t had a lot of problems. That is until this year. Earlier this year, we put a new tenant into one of the houses. We checked her credit score and did all of that, and she seemed to check out fine. The tenant paid first and last rent when she moved in, but hasn’t paid a penny since. That was almost five months ago. We finally got fed up and used a document preparation service to prepare a three-day notice for the tenant. When she didn’t pay, we filed a lawsuit. The tenant then filed an answer to the lawsuit. It took us weeks to figure out what to do next since the people who did our paperwork aren’t lawyers and wouldn’t tell us anything more about what to do. But eventually, a woman at the courthouse showed us how to request a trial. We went to the court trial and the tenants showed up with a lawyer. He argued that our notice wasn’t right and that repairs were supposed to be made to the house and a bunch of other things. The bottom

It looks to us like we did everything right. Can you help shed some light? A: You know that old saying about bringing a knife to a gunfight? It seldom turns out well for the blade-holder. The truth is that evictions in California aren’t particularly complicated, though they’ve gotten more so as a result of the pandemic. But still, the paperwork is easier, faster and less technical than an ordinary superior court suit. But the devil is in the proverbial details. Eviction lawsuits, known as unlawful detainer (UD) lawsuits, constitute a unique form of court action. Whereas a “normal” lawsuit may take a year or more to resolve through trial, the California Legislature recognized long ago that it wouldn’t be fair The Law Offices of
for a landlord to have to house a tenant for 12 months just to throw them out for not paying their rent. So they devised a system which is, generally, both fast and arguably fair. A landlord can file his lawsuit and actually get to trial in as little as three weeks. If he wins, a deputy sheriff can be at the property to remove the tenant in less than a week after trial. But, and here’s the big “but,” all of the responsibility for doing everything right rests on the shoulders of the landlord. This makes sense since the landlord is, in effect, trying to take away the tenant’s home and the process leaves the tenant with very little time to do something about it. That means your threeday notice had to be perfect. It had to state exactly how much rent is owed, who to pay it to, the address where it could be paid, and a lot of other things. Any problem with any part of the notice invalidates the entire lawsuit. Additionally, the notice had to be served properly and properly attached to your lawsuit’s paperwork. Then, of course, the lawsuit’s written complaint had to be perfect.

I have no doubt a legal document preparer could fill out the papers correctly. But simply based upon your email I have no idea if they were prepared perfectly. Let’s assume, for the sake of argument, the papers were filled out correctly and served properly. When you go to court, the entire burden is upon you to prove you did everything correctly. The tenant showed up with a lawyer. It’s likely the attorney raised a host of questions about your three-day notice with the expectation that you didn’t know enough about the law and the process to defend the quality of the notice.
In other words, once the tenant’s lawyer raised the question it was up to you to prove you did it right. Unlike small claims court, it isn’t the judge’s job to figure it all out without your help. In fact, the judge’s job is to side with the tenant until the landlord can prove he has a lawful right to evict. With regard to the repairs; that’s a far more complicated area of landlord-tenant law. I can guess the arguments were about something called “habitability” issues. In other words, did the house comply with certain health and safety codes? ail Maitland and her husband have been house hunting in the Syracuse, New York area since the fall. She tells Bankrate it’s been a dispiriting experience so far. “It really is a shocking situation that we find ourselves in because we really have to make some deep concessions in what we want in a home,” she said in a recent interview. “Looking at the home prices over the last five years, the same home that’s going for $300,000 now went for like $190,000 in 2017.” All across the country, home prices skyrocketed during the pandemic, rising an average of 20 percent between February 2021 and February 2022, according to CoreLogic. While experts expect a variety of factors – including rising mortgage rates – to slow that growth this year, buyers still need to be prepared to compete in a strong seller’s market with prices that just keep rising.
What’s going on with mortgage rates? Along with climbing home prices and tight inventory, one of the biggest variables hampering housing affordability right now is rising mortgage rates. At the start of the year, average interest on a 30-year fixed loan was hovering around 3.5%. In recent weeks, however, that number has shot up to nearly 5%, driven by Federal Reserve policy and rising inflation. But taking the long view: While a rise of 1.5 percentage

She predicts that the overall average mortgage rate for 2022 will be about 4.5%. As recently as February, the Mortgage Bankers Association also predicted that mortgage rates
would be between 4.0 and 4.5% for the majority of this year.
What does that mean for prices? So far, prices keep going up even as mortgage rates rise, though more slowly than they did last year. Maitland has seen that trend firsthand in the six months she’s been in the housing market. At the beginning of her search, “a house in one neighborhood would list for $230,000, (then) would go for $265,000,” she said. “Now houses in the same neighborhood are being listed for $240,000 to $260,000 and they’re going to go for $280,000 to $300,000.”
Most experts expected home prices to rise more slowly this year than last and are not surprised that they are continuing to increase, even with mortgage rates moving upward. “The mortgage market is not at this point putting a ceiling on housing prices and housing demand,” said Susan Wachter, professor of real estate at the Wharton School of the University of Pennsylvania. Wachter’s latest forecast predicts that home prices will rise around 8% to 12% this year, though that pace could slow even further if inflation tails off. As property prices keep going up, more buyers are likely to be pushed out of the market. Evan-

Take control of mortgage by paying extra each month A homeowner can change the term of their mortgage by simply paying extra each month because traditional mortgage loans allow the borrower to pay down their principle as they wish. For example, a $600,000 mortgage at a 5% fixed rate would require a principal and interest payment of $3,221 per month. If the borrower sent in an extra

need to ignore the monthly mortgage statement and send in an extra $739 each month and take control of their amortization. Here is a funny little tip: Nowadays, most borrowers have an impound account to pay the property taxes and insurance monthly. If a borrower is supposed to pay $3,911.33 per month to a mortgage company for their PITI, it’s not a terrible idea to
pay an even $4,000 each month because the extra $88.67 goes straight to principle and reduces the term of the loan, and it is easier to write the check each month because writing out all those numbers on a personal check is a pain in the neck for those of us that have trouble writing with tiny font. Mortgage rates march higher, stoked by rising Treasury yields THE WASHINGTON POST What a difference a year makes. A year ago, you could find a 30-year fixed rate mortgage for under 3%. Today, it is over 5%. According to the latest data released Thursday by Freddie Mac, the 30-year fixed-rate average increased for the seventh week in a row, rising to 5.11% with an average 0.8 point. (A point is a fee paid to a lender equal to 1% of the loan amount. It
is in addition to the interest rate.) It was 5% a week ago and 2.97% a year ago. The 30-year fixed rate hasn’t been this high since February 2011. Freddie Mac, the federally chartered mortgage investor, aggregates rates from around 80 lenders across the country to come up with weekly national averages. The survey is based on home purchase mortgages. Rates for refinances may be different. It uses rates for high-
quality borrowers with strong credit scores and large down payments. Because of the criteria, these rates are not available to every borrower. The 15-year fixed-rate average climbed to 4.38% with an average 0.8 point. It was 4.17% a week ago and 2.29% a year ago. The five-year adjustable rate average grew to 3.75% with an average 0.3 point. It was 3.69% a week ago and 2.83% a year ago. “The Freddie Mac fixed
rate for a 30-year loan kept marching up this week, following the continued surge in the 10-year Treasury,” George Ratiu, manager of economic research at Realtor.com, said. “Markets are also pricing in a likely 50 basis point hike at the central bank’s next meeting on May 4th, so we expect mortgage rates to continue to rise.” A sharp sell-off of Treasurys has caused yields to skyrocket. The yield on the 10-year Treasury is fast approaching 3%, a level not seen since December 2018. This week, it jumped to 2.93% on Tuesday before closing at 2.85% on Wednesday. Mortgage From Page 7 ascent has been striking. “We saw a major sell off of mortgage-backed securities (MBS) and Treasurys (TSY) in the secondary market,” Robert Heck, vice president of mortgage at Morty, an online mortgage marketplace, wrote in an email. “The selloff in bonds (when prices drop, yields go higher) year-to-date is one of the sharpest moves higher in recent history, rivaling the bond crisis of 1994.” The 10-year yield has gone up more than a percentage point since early March. Investors have been selling bonds over fears about inflation. They are concerned about the Federal Reserve increasing the size of its interest rate hikes in an effort to control rising prices. “Inflation remains rampant but it’s also important that rates don’t hit a level that makes it highly restrictive for people to purchase homes,” Heck wrote. “It’s even possible that rates

Fees for high-balance loans increased between 0.25 and 0.75%, tiered by loanto-value ratio. Fees for second home loans increased between 1.125 and 3.875%, tiered by loanto-value ratio. Bankrate.com, which puts out a weekly mortgage rate trend index, found 70% of the experts it surveyed expect rates to move higher in the coming week. “Another week of Treasurys moving up, another week of rising mortgage rates,” Ralph McLaughlin, chief economist at Kukun, said. Meanwhile, mortgage applications were down again last week. The market composite index – a measure of total loan application volume – decreased 5% from a week earlier, according to Mortgage Bankers Association data. The refinance index fell 8% and is 68% lower than a year ago. The purchase index slid 3%.

Bottom line Rising mortgage rates so far are doing little to put downward pressure on home prices, but strong demand and a persistent housing shortage means the cost to buy property keeps going up, albeit more slowly than a year ago. Buyers need to be ready for the crazy market they face, and make sure they fully understand their budget – and be prepared to adjust it or make compromises – before entering the fray.

Home purchase activity has been volatile in recent weeks and has yet to see the typical pick up for this time of the year.” Kan added: “The ARM share of applications reached 8.5% last week, its highest level since 2019. As ARM loans typically have lower rates than fixed rate mortgages, and as this spread has widened, ARM loans have become more attractive to borrowers already facing home purchase loan amounts close to record highs.”

My fear is the young gardeners may be passing by these verbenas, unaware of not only their blooming possibility, but their ability to bring in pollinators, including hummingbirds. They also may not realize the potential of a return performance for a year or two maybe more. Even if treated as an annual, their value to the garden is worth every penny spent. Superbenas need a lot of sun with a soil that drains freely. This is one of the reasons they are so easy in containers. Good lightweight potting mixes by their nature drain well. Once you have prepared your planting beds as such, you will have one of the best blooming ground covers you can buy. Superbenas need to be in an active state of growth to get the most riotous blooming performance. This requires you to get to know them, feed them occasionally and cut them back to generate new growth. Leaving woody, tired stems sprawling in the garden or hanging over the rim of your containers will rarely yield the performance you desire. If Superbenas could speak,

they would tell you they were created to grow and bloom. Cutting out tired stems and giving a light fertilization will reward you with lush green growth and weeks of blooms. Superbena verbenas are vigorous plants that will grow 12 inches tall and up to 36 inches wide. The Superbena Royale group was bred to be compact and perform in smaller containers. They will also reach close to 12 inches tall but with a spread up to 24 inches. This was my first time planting Superbena Royale verbenas in October and I was thrilled they tolerated my zone 8a winter temps so well. Both the Superbena and Superbena Royale verbenas have become an integral part of my container designs as I combine them with Superbells calibrachoas, Supertunia petunias, Lemon Coral sedum and all colors of heuchera. Spring is here, which means butterfly season is here too, so don’t procrastinate for a minute. Get the award-winning Superbenas incorporated into your containers and landscape beds.
