Quitclaim deed transfers title of property with no promises Q: Can you explain about the different types of deeds? My husband, daughter and I are all on title together. The house has been fully paid off and my husband and I want my daughter to have the house, and so we no longer want to be on the title.

What document do we use to get us off of the title to the property?

We have read the deed we got when we bought the property and it’s really confusing. A lot of legal mumbo-jumbo. Somebody told us about quitclaim deeds. Is that what we use, or is there something else? Thanks in advance.

A: Transferring title to a property appears to be perplexing, given the volume of legal statutes and case decisions that affect property ownership in California. But for the most part, it’s really not that hard.

Let me caution that we’re not talking about selling a property, which is a whole other kettle of kombucha. All we’re talking about here are the mechanics of transferring title to real estate.

First, we have to get past some of the terminology.

Transferring title can mean a couple of things.

The term “title” typically means something like “the person who appears to own the land” or “the (person) whose name is on the deed at the recorder’s office.”

There are many instances when the person who “appears” to own the land really doesn’t, which is the subject of many lawsuits. Usually, the name, or names, that are on the deed at the county recorder’s office are the true owners, as I presume is true for you.

So the most common definition of transferring title is: giving ownership of the land from one person to another.

Pretty simple so far.

A basic principle of real estate law, and one that constantly confuses both student Realtors and

Tim Jones lawyers, is that real estate ownership isn’t just one thing. It’s accurately described as a bundle of sticks, with each stick being a particular ownership “thing,” or, more properly, “right.”

You may think you own your home, but you don’t. At least not all of it.

There are easements running through your property. An easement means someone else has certain sticks (rights) to your land.

For example, the city may have an easement across your front yard, maybe 2 feet from the

curb, for landscaping purposes.

I remember my surprise 35 years ago when I bought my first brand new house in Suisun City. After we moved in the city came by and planted a tree in the middle of my front yard. When I complained, they explained the tree was planted in a city easement and that I couldn’t remove it.

They were right.

PG&E likely has easements through your backyard, under which they have buried utilities. If they need to get to them, they can just walk into your yard and start digging. They own that particular stick in the bundle, and you don’t.

It’s likely you don’t own any oil, natural gas or gold for that matter, which is buried under your yard.

All real estate is like that.

Different deeds promise to deliver different things to a buyer, or your daughter in this case.

A grant deed, which is typically what you get when you buy a house, carries a guarantee that what the deed says you’re getting is actually what you’re getting.

Consequently, it will exclude all the easements, liens and other sticks from the bundle that

someone else owns. That’s the mumbo-jumbos part that makes the deed look pretty complicated and intimidating.

A quitclaim deed carries no promises. It simply says that whatever rights I have to the property, if any, are now yours.

But I, the seller, ain’t guaranteeing nothin’.

How the pandemic changed our concept of home, how we use our spaces

eid and Heather Collier love their home. Located in Richmond, Va.’s historic Museum District, the 2,024-square-foot Victorian was a sanctuary during the pandemic. The couple strung up a hammock under the shade of the big magnolia in the backyard, where the family enjoyed picnics and their son played in the sandbox.

As the pandemic wore on, though, the Colliers didn’t particularly like their house. They couldn’t stop seeing all the things that needed attention: paint colors they didn’t like, a lack of storage in the kitchen. And with the addition of their second child and both parents working from home, they felt squeezed, at times bumping up against the confines of the house: Their active toddler kept bonking his head on the glass-top dining table.

The Colliers had to reassess their domestic situation from top to bottom. They painted, renovated a bathroom, added shelving, built a patio, updated the landscaping. And after a particularly hard collision with that dining table, they decided it was more important for their kids to have room to play than to have formal dinner. The dining room became a second living room.

For the past two years, homes have had to work overtime, serving as schools, offices and gyms. We were confronted with the brokenness of our homes – the leaky faucet, the dated sofa, the patchy lawn – and the limits of our walls. The rush to buy real estate in the suburbs and rural areas was about gaining existential square footage as much as physical. We craved space, places for our children and our

Impossibly tight housing markets prompted many to stay put and make the most of their dwellings. Renovations and furniture sales soared; home design shifted to accommodate the new rhythms of people’s lives. Life turned inward, and living spaces changed too, accelerating movements toward wellness at home, nostalgia and maximalism that were already underway.

For families like the Colliers, the adjustments they’ve made have proved beneficial for their family dynamic and allowed them to settle in comfortably for the long haul. “If you put the work into your home, you really feel like being there,” Reid says.

Boundaries have been in short supply the past two years,

especially in the home. Bedrooms became offices, dining rooms became schools. Family roles morphed as parent became teacher, child became colleague.

Work time, school time, mealtime often bled together into one long, chaotic slog without the physical and mental demarcations that helped make sense of the day. And 9-to-5 became a thing of the past.

When gyms shuttered in 2020, many people needed somewhere to work out at home, which meant adding equipment and installing mirrors. As D.C.-based designer Zoe Feldman found, clients didn’t just want an attractive, functional area to exercise in. They wanted a separate one.

“They need to have a dedicated space – and the kids

also don’t play in there and the husband doesn’t man-cave in there,” says Feldman. “You can have those boundaries within our home and with your family too. When Mommy is working out then this is Mommy’s space and Mommy’s time. It helps with the ability to spend more time in our homes.”

“Drawing the line – it’s more important now than ever,” Feldman adds. “We are asking so much of our homes, and we are living in our homes in such a harder and deeper way.”

After more than a year of working side by side at the same table, in a cramped guest room surrounded by baby gear and clothes, the Colliers decided to put a pint-size studio in the backyard. Designed by Reid,

the studio added just 119 square feet but offered a new world: a quiet place for Heather, an ad agency executive producer and vice president, to conduct calls with clients and a workbench to tinker with jewelry for her vintage-fashion side hustle. It also gave Reid, a creative director, a distraction-free place to do his graphic design work.

The studio “allows us to concentrate, which we haven’t been able to do at home,” Reid says.

“The act of leaving the house and walking across the yard – there’s a change that comes over you.

Now I’m in a creatively dedicated zone.”

While some boundaries within the home need to be rebuilt, at least one has been eagerly erased: the line between inside and outside. Confinement has caused many to turn our homes inside out, transforming outdoor See Concept, Page 9

Mortgage rates hit 5% THE WASHINGTON POST Mortgage rates swelled above 5% for the first time in more than a decade – an unexpectedly rapid ascent that has begun to temper the U.S. housing boom and could usher new uncertainty into an economy dogged by soaring inflation.

The 30-year fixed-rate mortgage, the most popular home loan product, hit the threshold just five weeks after surpassing 4%, according to Freddie Mac data released Thursday. The average has not been this high since February 2011.

The run-up comes as the Federal Reserve has launched a major initiative to rein in the highest inflation in 40 years. Fed officials are betting that higher interest rates will slash inflation

and recalibrate the job market.

But their plan also rests on the assumption that higher rates will cool demand for housing, especially while homes themselves are in such short supply.

Low rates fueled the revival of the U.S. housing market after the Great Recession and have helped drive home prices to record levels. But after two years of hovering at historical lows, rates have been on a tear: In January, the 30-year fixed average was 3.22%. It was 3.04% a year ago.

And while mortgage rates had been expected to rise, they’ve done so more quickly than many economists predicted.

Persian Shield is beautifully exotic

Persian Shield, a tropical foliage plant from Burma looks quite at home in partnership with the Ice Cream Blue Java banana.

ecently I stumbled across a plant recipe called “This is the Life.” Not only was it a collection of some of my favorite plants, it was a wake-up call to an old favorite: the Persian Shield.

Known botanically as Strobilanthes dyerianus, it is native to Myanmar and has 8-inch-long iridescent leaves in shades of purple, lilac and pink with purple-maroon on the undersides. If those colors aren’t awesome enough, the foliage looks as though it has a light coat of silver electroplated to the leaf.

It has been around for a while, even in Victorian times, but it kind of slips to the back

Thankfully it has secured its position as part of the Proven Accents section of Proven Winners, which is where you’ll also find all the new ornamental sweet potatoes.

The Persian Shield prefers well-drained, organic-rich soil. I rarely see it in full afternoon sun looking its best in the South. I love planting it in morning sun and afternoon shade to keep its brilliant colors always photo-worthy. This spring, wait to plant until all danger of frost has passed, then space plants on 18- to 24-inch centers. I think we may finally be safe in my part of Georgia. The plants should reach close to 3 feet in height and are really considered maintenance-free. Don’t be afraid to pinch if needed to keep plants bushy.

This is not exactly a drought-tolerant plant. On

the other hand, those in our display garden when I was with Mississippi State endured much more than I ever believed possible. Keep the plants uniformly moist throughout the growing season. This is a tropical plant that likes summer humidity and performs well in heat.

Keep it growing vigorously by fertilizing monthly with a light application of a slow-release fertilizer. My choice would be something like a 17-5-17 with minor nutrients, but it’s no big deal; just make sure to use a slow- or controlledrelease blend.

think of Persian Shield as annual planting, much like coleus. It is, however, considered a perennial in zones 9-11, and ours came back several years in zone 8.

Don’t expect it, but celebrate if it does. Many find it hard to believe that Persian Shield is in the Acanthus family (Acanthaceae) with relatives like Mexican petunia, Shrimp Plants, Firespike and even Thunbergia that we grow as vines.

There are some great combinations to plant with the Persian Shield, which is where I started with “This is the Life.” The recipe features Truffula Pink gomphrena, Supertunia Mini Vista Pink Star, Plum Dandy alternanthera, also from the Proven Accents section, and of course the Persian Shield. You can also find eight more recipes to choose from.

I love how they look with large bananas or in combination with lime green or chartreuse foliage.

The purple foliage really contrasts with these colors. Another great choice would be to use violet- or white-colored impatiens like those found in the new Soprano series.

Memphis-based designer Carmeon Hamilton started her interior design career 14 years ago in the health-care sector, creating spaces for hospitals and nursing homes for dementia patients. She focused on stimulating memory, using color, texture and scent to activate the senses and energize the mind, and bringing the outdoors in – all techniques she has seen playing out in residential design for the past two years.

“I was dealing with people who couldn’t escape years ago,” says Hamilton, now host of HGTV’s “Reno My Rental.”

“And now most of the world can’t escape, and that’s been a huge part of design.”

Patio furniture sales skyrocketed in the spring of 2020 as people moved social gatherings outside; many customers still face limited selection and backordered listings for outdoor pieces. Noz Nozawa, a San Francisco-based designer, says her clients continue to invest in their outdoor spaces. Plopping down a beach chair and card table is no longer cutting it. Two years in, clients are prioritizing high-end upholstered seating that holds up against moisture, heat and UV rays, and people are willing to buy covers and storage to protect their outdoor cushions.

Indoors, people are opting for an outdoor feel: foliage; earthy color schemes; natural fibers; and materials like cane, jute, raffia and wood. “Being inside for two years, people are realizing how important those exterior elements are,” Hamilton says. “...

That is where that boom in what I call the ‘wellness aspect’ of interior design has been – bringing the outdoors in, bringing in textures and plants and diffusers with essential oils.”

Scenic murals have made

a strong comeback to create a landscape within the home. Wallpapers with natural motifs, like Josef Frank’s whimsical patterns for Svenskt Tenn, also have been rediscovered. And of course there are the houseplants.

“It was a $2 billion industry by the time the pandemic rolled around, and then houseplants became the trendiest thing,” Hamilton says. “... It’s important to have things alive in your space.

Things that have been trendy over the past two years have been good for people.”

For the better part of a decade, the Danish concept of “hygge” (meaning “cozy”) has been popular in the design world, as people sought to imbue their spaces with not just a look, but a feeling of intimacy.

During the pandemic, hygge has taken on a new, all-encompassing dimension. Feldman has been transforming family rooms, studies and dens into intimate refuges.

“We are doing a lot of textured walls, almost like having people feel like their room feels like a warm sweater or a hug.

People are really liking cozy right now,” she says. “The fire is going and it’s very tonal and textural. There’s tons of soft fabrics like sheepskin, chenille, mohair and velvets.”

Color schemes, many natureinspired, are moving to the warm end of the spectrum, too – russet and oxblood, hunter greens and moss tones, navy hues, earthy oranges and curry yellows, along with grays with green undertones.

Instead of starting with a design aesthetic or inspiration piece, Feldman and her clients are using feelings as a launching point. “Really anything that makes you feel really, really warm, put your feet up and read a book, have a big glass of red wine, and put on some music,” she says. “And that’s also the hard part of it. We aren’t relaxed – politically and environmentally. The home needs to feel like a safe space and reprieve.”

The family’s former dining room was converted into a second living room with a mini wood-burning stove designed to fit into a coal-burning fireplace. less for resale-friendly designs and more for highly personalized looks that they can enjoy for the long haul. “They want their homes to tell their stories and be surrounded by something that means something to them,” she said. “That’s happening a lot earlier in the design process.”

In her past work designing for memory care patients, Hamilton incorporated pieces to reflect those individuals: culturally important objects, family heirlooms, travel mementos. “That personal connection with people is important to help people feel grounded and well in their own space,” she says.

“It’s more about feeling great in your home now than it was before.”

The pre-pandemic era was dominated by all-white interiors and minimalist straight lines.

“Everything was white. It was sterile and boring,” Hamilton says. “And I think once people had to live in it during the pandemic they were like, ‘This isn’t the most exciting thing to be surrounded by,’ and that’s when the resurgence of color came back.”

The tedium of the pandemic might be behind a shift toward pieces from the postmodern era. Think psychedelic murals, abstract art, asymmetry

and curves. “There’s a boldness and confidence to 1980s and ‘90s furniture and art that’s just very appealing during these times of questioning and uncertainty – and also as we’ve continued to emerge from the long period of polite aesthetic neutrality that dominated the design scene,” says Anthony Barzilay Freund, editorial director and director of fine art for 1stDibs, an online marketplace for high-end home furnishings and fashion.

The retailer reports that its top sellers include furnishings by Venini, Karl Springer, Mazzega Murano, Ligne Roset and Directional. And in the art sector, pop art and street art by greats like Keith Haring, Jean-Michel Basquiat and David Hockney have been popular.

As buyers grow tired of the “Mad Men” aesthetic and millennials look to echo the surroundings they grew up with, they are turning their attention to recent history. “It makes sense that we’re marching into the brash ‘80s and ‘90s,” Freund says. “Those are decades that are only now distant enough for us to feel nostalgic about them.”

As the pandemic moves to endemic, those of us who have made our dwellings more comfortable may have a newfound appreciation for the steadfastness of our homes – the fortresses we have relied on during this trying time.

“I think people want to escape a lot less now that we have had two years to make changes,” Hamilton says. “People are thinking home is an OK place to be. I don’t have to leave my space to feel connected to something or myself.”

While it feels good to leave, we also now have the pleasure of returning, of opening the door and encountering the sweet familiarity of home. Knowing what we have endured within those walls, we can appreciate it more than ever.

“No matter how sick you get of anything,” Nozawa says, “you have to come home.”

this week, the same loan at 5% would tack on $263, bringing the monthly payment to $1,610.

The Federal Reserve’s efforts to tame inflation are driving the rise in rates.

Although the Fed does not set mortgage rates, it does influence them. The central bank took its first steps toward bringing down inflation in March when it raised its benchmark rate for the first time since 2018.

In addition to the federal funds rate hike, the Fed is soon to begin the process of reducing its balance sheet.

The Federal Reserve holds about $2.74 trillion in mortgagebacked securities. It indicated it will reveal its plans for reducing its holdings at its May meeting.

The more aggressively the Fed sells those bonds, the faster mortgage rates are likely to rise.

The cost of housing doesn’t only weigh on buyers and sellers. It also has proved to be a major complication for the economic recovery, and potentially jeopardizes policymakers’ ability to rein in soaring inflation.
