You may still have a liability to the bank on foreclosed house Q: First off, let me thank you for your long-running column.

I’m one of the masses who read you every week and try to file away the information in case I ever need it. That being said, I have a problem that if you’ve ever written about it, I can’t remember what you said.

But now I need some advice.

I lost my house to foreclosure back in 2014. I lost my job and had to walk away. I have since gotten back on my feet and am trying to get in a position to purchase a new home. This week, I got a notice from a collection company that I owe my old mortgage bank more than $100,000 plus interest. So I got online and pulled my credit report and, sure enough, there it is with my old bank reporting the debt. This week’s letter is the first I have ever heard about the money since I left the house.

From your columns, I believed that if your house is foreclosed you don’t owe the bank any money. I’m at a loss to know what to do at this point.

A: Boy, there are a number of things going on here so let’s take them one at a time.

To begin, I’ve never said that if your house is foreclosed in California you automatically won’t be liable for any money the bank loses, called a “deficiency” in the business. What I’ve said is if you only have one mortgage, or multiple loans if they are the original loans and you lived in the house, you won’t have liability in almost all circumstances.

However, and it’s a big “however,” if you had more than one loan on the house, or had ever refinanced it, there’s a possibility you’re on the hook.

There’s not enough time here to go back through it, but you can look up some old columns on the subject. Suffice to say again that it’s very possible a

To know for sure, I’d have to have more specific information about the financing on your house, when you bought the house, when you got the loan or loans, and the method the bank used to foreclose.

Let’s assume for the sake of argument you really are liable for a deficiency, which is far from certain.

There is generally a fouryear statute of limitations for suing you for nonpayment of the debt. The lawsuit would be based upon a breach of a written contract, which carries the four-year limitation.

The problem you’re going to encounter is there’s not much you can do about it at this point.

A statute of limitations only helps you if you actually get sued. It’s a defensive measure. A credit collection company that makes their living by keeping a percentage of any money they collect The Law Offices of

can continue to hound you. Even reporting it on your credit report.

I can’t even begin to count the number of people I’ve spoken with over the years who have no liability under California law but continue to be pursued by collection companies.

Fortunately for consumers, a law went into effect Jan. 1, 2014, in California that could help.

Senate Bill 426 was an attempt by the state to stop the type of thing you’re experiencing, but only if you really don’t owe the money. The law simply reinforces existing laws, which already eliminate deficiency liability in a majority of foreclosures.

What the law says, in a nutshell, is if the foreclosed homeowner doesn’t owe any money under the law, the foreclosing bank cannot say that they do. In other words, if you don’t owe the money, the bank can’t hound you. Nor can they turn you over to a collection company or report the deficiency on your credit report.

Of course, a law is only as good as your ability to enforce it, which could get expensive.

Under this scenario, it would likely be up to you to sue the bank for violation of SB 426.

You would first have to show

that you had no legal liability under existing law. But if you prevailed, you would be entitled to collect your attorney fees and costs from the bank as well as the possibility of punitive damages.

On that note, never count on punitive damages as your retirement plan. Despite what you may read in the news, punitive damages are rare and far between.

So the first thing you should do is determine for sure that you owe no money. Then figure out step two.

How to avoid panic buying in an ultra-competitive housing market

ith housing inventory still in short supply and historically low mortgage rates starting to inch back upward, the real estate market has gone from brisk to combative. In such a competitive environment, many buyers feel pressure to move quickly and stretch their budgets to make sure a property they love doesn’t slip through the cracks. In fact, according to a homeownership report from Hippo Insurance, 68% of buyers in 2021 paid above asking price.

Kevin Kieffer, a Realtor with Compass’ EastBayPro Team in the San Francisco Bay area, calls this behavior “panic buying.”

In the current market, he says, it can be easy for prospective homeowners to get in over their heads. Don’t let that happen to you. Instead, get familiar with panic buying and its pitfalls, and learn how to avoid them.

What is panic buying?

“Buyers are so afraid they’re going to miss these low rates, and then they won’t be able to buy a home,” Kieffer says. “They’re just panicking, which creates irrational decisions.”

It’s already common for buyers in especially competitive areas to waive contingencies in their offers or include appraisal gap coverage. But Kieffer says he’s also seeing many people offer significantly more than the asking price. In many areas, homes selling over the asking price have become the norm.

“We’re seeing 10 offers come in on a property, and, like, two of

“I have found that a lot of people, especially in the California, Texas, Florida and New York areas, have not looked at home insurance before they buy the house,” she says. “And then they’re in shock that they’re in a wildfire zone or a flood zone or a hurricane zone.” Those external factors can result in big extra expenses.

How to avoid panic buying

Buyers aren’t just overextending themselves with high offers, either. That practice of waiving contingencies means new homeowners could be on the hook for expensive repairs as soon as they move in. In fact, according to Hippo, 81% of recent first-time homebuyers had unexpected repairs in the first year. And 66% of all new homeowners spent $1,000 or more on repairs in the first year.

Courtney Klosterman, home insights expert at Hippo, notes that Covid added another layer of complication to the

real estate landscape with the need for virtual tours, leading more people than ever to buy homes without first visiting them in person.

Buyer’s remorse: What regrets do new homeowners have?

“There are a lot of people who are buying homes for the first time, and they just don’t realize the volume of things you need to do to maintain a house,” says Steve Wilson, senior underwriting manager at Hippo. “People are having remorse around the upkeep of the home, and how failure to do that maintenance

can lead to a costly issue.”

Things like the plumbing, electrical and climate control systems are important to check before you close, as well as structural parts of the house like the foundation, roof and attic. “Those are all things that are easy to see on a basic walkthrough and can help inform your decision of whether you want to buy this house,” Wilson says.

Even if you waive your inspection contingency, that doesn’t mean you should skip the home inspection altogether. It’s a good idea to still conduct an inspection, so you know what you’re getting into and can budget for any repairs that will be necessary after moving in.

First and foremost, Klosterman says, you should work with a knowledgeable Realtor.

But it’s also a good idea to speak to homeowners in your personal orbit. “It’s really smart to lean on a trusted homeowner during the process. Someone in the area, someone you know and trust, outside of your Realtor,” she says. “No offense to our wonderful Realtors, but they’re going to look at properties very differently than you do.”

Beyond that, it’s important not to rush, and to make sure you are prepared to ask crucial questions about a property’s condition and your mortgage loan as you go through the process.

Kieffer adds that many buyers are also adjusting their expectations as homes keep selling for well over their list price. “A lot of folks are regressing their target price,” he says. “They need to step it back so they’re looking at the properties they’re capable of purchasing.”

iamond Snow has dramatically changed how we look at euphorbias, that not-soglamorous common name of spurge. We all fell madly in love with its sibling Diamond Frost and subsequently gave it hundreds of awards in university trials. Diamond Snow, however, is a game changer.

Although Diamond Snow has only been out two years, it is racking up pages of awards, such as Perfect Score All Season at Oklahoma State, Top Performer at Biltmore Estate and universities like Minnesota, Ohio State, Cornell, Delaware and Florida, just to name a few.

Why, you might ask? Well, the Diamond Snow blossoms are double. To the flower border, mixed container or basket, it is a choice, as the names suggest, frost or snow. Diamond Frost, the original, will always have a place, lending the artist touch to mixed plantings. It is like sprinkles, while Diamond Snow is a main course in your designs.

It can get a “holy wow” alongside the most colorful begonia or petunia.

These plants known as spurges, and euphorbias are related to the poinsettia and copper plant, but don’t let that throw you. They really are, and will always be, the toughest flower you can put in the garden. Although they’re small in stature, reaching about 12 to 18 inches tall and as wide, these award winners will never be without hundreds and perhaps now thousands of tiny white flowers. You would never really be able to count them all.

For best blooming, select a location with as much sunlight as possible. Some shade is certainly tolerated. Despite its rugged nature, you will still want to give it good bed preparation so it will quickly establish and get happy in your flowerbed.

If you are plagued with tight heavy clay, incorporate 3 to 4 inches of organic matter like compost, humus or peat to loosen and improve drainage and aeration. Plant at the same depth they are growing in their container, spacing plants 10 to 12 inches apart.

It’s strange to me, but in the garden world I regularly watch, it seems the mixed container of basket has captured the lion’s share of Diamond Snow cultivation. Diamond Snow, like its sibling, is virtually pest-free and an absolute environmental wonder to gardeners, even more so when you consider the low water requirement. Even if you don’t find these sounds particularly soothing, you may have seen videos of these mundane tasks on TikTok, which has been flooded with clips like this over the past several months. Filed under the hashtag #restock, these bright, bite-size, sped-up videos are racking up millions of views, captivating users who are enchanted by the tidiness of it all.

Some videos show one container being filled over and over, while others show an entire kitchen being restocked from scratch. But most videos tend to follow a few cardinal rules. This is where things get a little weird.

The item being organized must have a perfectly sized corresponding container. If a box of soda cans is going to be moved to a refrigerator bin, that bin should be completely full once the box is empty. It’s best to have an even number of items. Ideally, the container will fit neatly into a larger space. (Think pantry, refrigerator or closet.) If the fit isn’t perfect, it could ignite the ire of

commenters. And perhaps most importantly, everything must be sparkling clean. No fingerprints, watermarks or smudges allowed, and certainly no clutter. God help you if something spills. Finally, the sound effects should be loud and crisp, as if the viewer were in the room.

If this is sounding a little maniacal, or even faintly erotic, that’s because it kind of is. These TikTok clips, along with YouTube videos and Tumblr threads dedicated to “things fitting perfectly into other things,” are part of the Internet phenomenon of material devoted to ASMR, or autonomous sensory meridian response.

This is a relaxing, tingling sensation that some people experience while watching – or listening to – certain audio and video content.

Some of the most famous ASMR videos are of people whispering, but household tasks are a close second: stacking toilet paper, folding towels, scrubbing the refrigerator, etc. The effect can be sensual, and even sleepinducing, but it’s often simply relaxing – providing a satisfying sense of order in an increasingly chaotic world.

In July, the trend had become so popular that TikTok addressed it on its website, describing the videos as a certain kind of motivational, medita-

Posts under the #restock hashtag have amassed more than 8 billion views, while some of TikTok’s most famous restockers, such as Catherine Benson and Kaeli Mae, have upward of 9 million and 8 million followers, respectively.

Kellie Atkinson got sucked into home-organizing shows

when she and her family were stuck inside for months during the pandemic. “I became obsessed with [Netflix’s] ‘The Home Edit,’ ” she said. She followed the hosts on Instagram, where they post before-and-after videos of freshly tidied spaces, then she began watching people organize on TikTok. Last spring, Atkinson, 32, who lives in Hillsboro, Texas, with her husband and two children, bought a new refrigerator and decided to make her own organizing video. She went to The Container Store, bought a bunch of “The Home Edit’s” products and cobbled together a video on

her account, @kellie_atkinson.

Soon, she was posting a couple of times a week. Four months later, she was making enough money from brand and retailer partnerships to support her family.

“My husband is really happy,” she said. “He had a job where he was on the road all day, and now he gets to spend time with his kids at home.”

Many creators don’t experience ASMR, but they are well-attuned to the specific stimulation preferences of organization-obsessed viewers.

After a year or so of posting, she has learned a few tricks: perform the restocks onehanded to avoid blocking the shot; only buy containers that make “popping” noises when you open them; and wait until your toddler is napping, so there’s no external noise. “Audio is huge in ASMR,” she said.

She has noticed that her videos won’t go viral unless the container is being filled perfectly to the brim. “It sounds ridiculous, but it’s true,” she said.

Atkinson, who now has 3.3 million followers, says her

process is similarly idiosyncratic.

“Not only do the containers need to be completely cleaned and polished, but whatever is going in them needs to be cleaned and polished,” she said. “Or you’ll hear about it.” The brighter and more colorful things look, the better – “like candy.” She shoots the videos on her phone in 50 or so short clips, filters them to make them look crisp and clear, then speeds up each one. “People like these videos to move,” she said.

There’s a certain amount of strategy involved, too. Atkinson knows that TikTok rewards engagement, so she tries to think of concepts that will start a conversation. One time, she posted a video of herself organizing avocados and tomatoes in her refrigerator bin labeled “fruit.”

It sparked a heated debate in the comments about whether they

were actually vegetables, and whether they even belonged in the refrigerator. The next week, she did the same thing with a bin labeled “vegetables.” “I was fully aware that it was fruit, but I wanted to see what would happen,” she said. That clip now has more than 50 million views.

The debate in the comments section rages on.

Videos that feature unusual kitchen gadgets are also more likely to go viral, spurring users to ask where they can buy them in the comments. (Some TikTok creators have basic websites or Amazon stores where they link to products and offer discount codes.) Viewers also seem to enjoy unlikely pairings between item and container, such as sprinkles in a honey jar. “The comments light up with people saying, ‘Oh, put this in it! Put that in it!’” Atkinson said. “It becomes

this talking point, and people get really excited.”

Most comments are about how relaxing and satisfying it is to watch a task be completed.

“They feel a sense of accomplishment without having to actually do anything,” Martin said. “You’re kind of checking a box for them.”

Martin, a stay-at-home mom of two who lives just outside Seattle, is laid-back about her place in the TikTok creator-sphere. “Honestly, ASMR doesn’t do anything for me the way it does for other people,” she said. “I just do these videos because other people like them, and they’re quick.”

She makes money from paid ads and occasional song promotion (she’ll use it as a soundtrack on a refill video), as well as from sporadic payouts from TikTok’s Creator Fund, which she said is

“nice but very unpredictable.”

If her account becomes lucrative enough that she can afford to continue staying at home, she’ll consider taking it more seriously.

“For now, I just think it’s hilarious,” she said. “People get mad at you for anything on the Internet, so you have to laugh.”

Martin recalled a recent video where she poured a jar of pickles into an airtight plastic container, then moved so quickly that a few pickles fell onto her counter.

“People were offended,” she said. “They thought I did it on purpose for views, they accused me of being unsanitary, it was off the rails. . . . So you have to have fun with it. That’s the only way to approach this space where millions of strangers will either tell you they love you or freak out at you for spilling pickles.”

Blackrock bought a home for all cash in Vacaville six months ago for well over the asking price of $700,000 that, according to the local listing agent, appears to still be locked up and vacant as of last month.

This past Sunday, “60 Minutes” interviewed a rep-

resentative of Tricon Residential, which now owns 30,000 singlefamily homes in the U.S., and the CEO made it clear that it is all about the math and good old supply and demand.

We are 4 million homes short in America and there are substantially more buyers in the sunbelt parts of the country than there are sellers. The incomeproducing asset (the house) has historically appreciated in value 3% to 4% annually on average and the rents increase, too, but if these investors think it’s going

to be easy to provide a rate of return over 5% to their investors and stockholders, I think they will be disappointed.

Inflation helps rent increase, but inflation kills profits because of the increasing cost of maintenance, property management and employees. Vacancy can be costly, too, and sure, they can win small claims judgments against tenants who destroy a home and live in the house rent-free for four to six months during the eviction process, but these types of debts are not easy

to collect.

I might buy a few things online, but I would never buy a $1 million house based on the photos or apply for an $800,000 jumbo loan with an online call center out of Texas or India. Middle- and uppermiddle-class people should find ethical, experienced, dedicated and local real estate and mortgage professionals who can speak to you face to face, shake your hand and look you straight in the eye when they help you buy an investment property or
