Legislature needs to work on requiring preliminary hearings for civil cases Q: In my 66 years, the closest I’ve ever come to the legal system was getting my marriage license at the courthouse and receiving two parking tickets. Now I am a defendant in a lawsuit brought by a guy I sold my house to almost two years ago. He claims I lied to him about the condition of the house and he is suing me for $250,000. I’m not writing to ask about my particular situation, since I have a lawyer who’s working on my case, but more to vent about the legal system. As I said, I’m 66 years old and, soon after my wife passed away, I sold the house we had lived in for 23 years. I did everything right. I hired a good, experienced Realtor who walked me through everything. I read all the paperwork very carefully before signing anything. I disclosed every problem with the house I could think of, including my noisy neighbors. When in doubt about whether an item amounted to a problem, I followed my Realtor’s advice and disclosed it. Now I find myself in this lawsuit and the costs are cutting a big chunk out of my retirement savings. If this keeps up at this pace, I’ll be broke before the end of the year. Why do we have a legal system that allows someone like me, who didn’t do anything wrong, to be driven into bankruptcy by the astronomical expense of defending himself? If I was charged with a crime, the court would appoint a lawyer for me. But because I’m being sued in civil court, I’m condemned to going broke, regardless of whether I did something wrong or not. Am I the only one who sees a problem with this system? A: Great question! And no,
Tim Jones you certainly aren’t. The plain truth is civil litigation is expensive, not to mention time-consuming and emotionally draining. The mere fact that a lawsuit can cost a party more than the claim is worth is the overriding reason why cases settle on the courthouse steps. After months of writing huge checks to their lawyers, the courts and various inspectors, investigators and the like, people get fed up and just want out. This causes plaintiffs who really have been hurt by someone to accept less money than they should have gotten in court, and for defendants who shouldn’t have to pay anything to pony up large sums of money just to buy peace. If Exxon is suing Texaco, nobody is particularly sympathetic since they have plenty of money and the disputes are usually in the millions, if not billions, of dollars. But for the mom-and-pop buyer or seller, litigation costs can destroy a person’s financial security. Additionally, modern real estate sales contracts contain what’s known as a “prevailing party” or “attorney fee” provision. These simply say when one party to the sale sues the other (and it’s almost always the buyer suing the seller as in your case) the prevailing party gets, in addition to any damages they’re awarded, an additional amount of money to cover their
attorney fees. As I’ve written about before, the problem is there is always a threat, even a probability, the buyer will get something. Maybe only $50 for an undisclosed torn screen. But if that buyer had spent $15,000 on attorney fees, they could wind up with a judgment for $15,050. Knowing this almost always forces sellers to pay blood money to the buyer to go away long before there’s a trial. So let me take this opportunity to suggest that parties negotiating a purchase contract seriously consider striking out the preprinted prevailing party provision. Legislators have tried various methods to put some limits on the amount of costs incurred by the parties, but they’ve all been pretty ineffective. In the U.S., the law generally doesn’t provide for reimbursement of attorney fees as it does in most other western countries, absent a contractual attorney fee provision such as the one in your purchase contract. If everybody had to pay their own costs and fees regardless of the outcome, plaintiffs would think twice about spending five figures in fees on a three- or fourfigure case. Do I have a solution? Other than don’t get yourself caught up in a prevailing party provision, nope. But one idea that has been put forward would require, at

the beginning of every lawsuit, the plaintiff to present his case before a judge and let the court decide if there is enough evidence to even allow the suit to move forward. This is done in every criminal case and is known as a preliminary hearing. If the state cannot show there is a likelihood it can win, the defendant is set free. We could do the same thing with civil cases. But to date, nobody in the Legislature, at least to my knowledge, has taken any steps to create such a process. In the meantime, I wish I had some good advice to give you. You may want to sit down with a bankruptcy attorney and explain your situation now. Mortgage rates spike to highs not seen in nearly 3 years THE WASHINGTON POST The days of record-low mortgage rates are over. Driven up by inflation and global conflict, the 30-year fixed average hit a high not seen since May 2019. According to the latest data released Thursday by Freddie Mac, the 30-year fixed-rate average jumped to 4.16% with an average 0.8 point. (A point is a fee paid to a lender equal to 1% of the loan amount. It is in addition to the interest rate.) It was 3.85% a week ago and 3.09% a year ago. Freddie Mac, the federally chartered mortgage investor, aggregates rates from about 80 lenders across the country to come up with weekly national averages. The survey is based on home purchase mortgages. Rates for refinances may be different. It uses rates for high-quality borrowers with strong credit scores and large down payments. the first increase in the federal funds rate in more than three years. The news came too late to be factored into Freddie Mac’s survey, which was done earlier in the week. The Fed does not set mortgage rates, but its decisions influence them. “The mortgage market had already priced in the Fed’s increase [Wednesday] and was anticipating further increases in the coming months,” said Marty Green, principal at Polunsky Beitel Green, a mortgage law firm in Texas. “The uncertainty created by the crisis in the Ukraine, however, has moderated the impact of some of those anticipated rate increases as a flight to safety increased demand for U.S. Treasurys and mortgage bonds.” The Fed also signaled the potential for six more hikes this year and the intention to beginning shrinking their balance sheet as soon as May. ended its bond-buying program last week. During the pandemic, the Fed bought Treasurys and mortgage-backed securities in an effort to prop up the economy and hold down borrowing costs. Those purchases helped send mortgage rates to record lows. “The Fed’s rate-raising campaign will affect homebuyers, homeowners and even home sellers, too,” Lewis said. “Homebuyers might have to shop at lower price ranges to adjust for their reduced buying power. Homeowners will find that the interest rates and minimum payments on home equity lines of credit will go up. And home sellers will want to make sure that when buyers make offers, they can afford the monthly payments at current rates, which may be higher than when they got preapproved a few weeks earlier.” Investors reacted to the Fed news by pushing the yield on the

to rise to around 4.5% this year. “Mortgage rates have been exceptionally volatile in recent weeks, given the profound uncertainties both with respect to the geopolitical situation and monetary policy,” said Mike Fratantoni, MBA’s chief economist. “Hopefully, the Fed’s actions and explanations can help to reduce the policy uncertainty, which would then diminish some of the current volatility.”

I also see a lot of young people who loved the weekly checks from the Fed during the pandemic and many of these are employees who do the bare minimum for their employer when they do work and make just enough to get by. Many men take paternity leave very seriously and help their spouse and truly bond with their child, but I would bet 50 bucks that 50% consider it a vacation, do almost no housework, rarely change a diaper and play golf and video games daily during the eight to 12 weeks. My operations manager is now in her mid-40s and has had two babies in the past seven years. She worked up till the day before delivery on both and I couldn’t convince her to stay
home on maternity leave for more than 30 days on each kid because she is ambitious and is focused on her financial security and her career. I have no issue or problem with people who take time off work for vacation and family but one thing for sure all kids today better figure out soon is there is no free lunch in America and almost every middle- and upper-middle-class person who is older than 65 and financially secure for life had to work their rear-ends off for 35 to 45 years to get there. Q: My neighbor in my highrise condominium rents his unit to a Section 8 tenant. The tenant tracks grease onto the hallway carpets, leaving ugly stains, often makes a mess of the common area laundry room, and often smokes in common areas where it is not allowed. I have documented these complaints to the property manager with no visible action. What further action do you suggest? — Harry A: Before I can address the core of your question, I need to clarify that the tenant’s rental assistance has nothing to do with their rights and responsibilities. In some jurisdictions, it is discriminatory for a landlord
or community association to even consider a tenant’s source of income. Stated otherwise, the tenant receiving rent assistance has no effect on your situation. That said, when a tenant, or unit owner, damages association property, they can and should be held responsible. The same goes for rule violations. While it will not be possible to evict a tenant for violating community rules or damaging the property, their landlord can be held financially responsible for the damage and face fines for the tenant breaking the rules. If the owner does not pay, the association can collect rent directly from the tenant to get

It is the association’s responsibility to make sure the community rules are followed. Your condo can sue the unit owner and tenant to get an “injunction,” which is the court’s order to stop a specific behavior. Not abiding by a court’s order can have serious ramifications, including spending some time in jail, although it rarely comes to that. If the tenant’s behavior directly damages a neighbor’s use and enjoyment of their home, the aggrieved unit owner can sue the landlord and tenant if the association does not.
