Long bond market hits highest rate in 24 years

M

ost of us remember Silicon Valley and First Republic, along with a bunch of other regional banks, failing between 2022 and 2024. They could not afford to pay their depositors 5% for sixmonth and one-year certificates of deposit after funding billions of 3% interest rate mortgages during the refiJim Porter nance mania from 2020 until St. Patrick’s Day 2022. The one-year treasury bill and the two-year T-bill are yielding 4.56% and 4.9% today, which is lower than what shortterm treasury yields were from 2022 to 2024. The long end of the market, on the other hand, is at a 24-year high this week, which is making me sick to my stomach because mortgage rates ride with the 10-year treasury. The 10-year hit 5.31% (Wednesday) and the 30-year treasury is now a whopping 5.64%. This has not been this high since the middle of 2002. The Bankrate national average mortgage rate is 7.34%, and Mortgage News Daily is quoting 7.6%. Kalshi Contracts is predicting a 64% chance of 7.4% mortgage rates this Christmas, and the Polymarket Odds makers are quoting a 57% probability of 7.25%. Remember to account for drying and curing times, ventilation needs and the movement of furniture before deciding when to begin. pected expenses. Older homes can be especially unpredictable because opening a wall or removing flooring may uncover outdated wiring, plumbing problems, water damage or other issues that must be corrected before the remodel can continue. Put the scope, payment schedule and process for approving changes in writing. If you want the project completed before Thanksgiving or the December holidays, discuss that deadline with your contractor before signing an agreement.

Build in extra time for permits, inspections, material deliveries and unexpected repairs. Avoid scheduling a major remodel to finish immediately before guests arrive, since even a well-planned project can encounter delays. The biggest advice is to remodel with purpose. Think about what is not working in your home and which improvement would make the greatest difference in your daily life. Fall can be a convenient time to begin, but the right project is more important than the season.

Jones From Page 2 real estate. However the term “Realtor” (always capitalized) is a trademark of the National Association of Realtors. To use the title, a real estate sales agent or broker must belong to the Association of Realtors. By joining, they submit themselves to a specific ethical code of conduct which is established by the association, not the State of California. It amounts to a higher form of ethics than the law requires. A Realtor who breaches any of those ethical codes is subject to discipline by the association as well as being sued by their client under the higher Realtor standard. California has two types of real estate licenses: sales agent and broker. A sales agent, which is what most real estate agents have, can do most things a broker can do but they must actually work for a broker. They can’t go out on their own and hang a shingle. Ultimately, the broker is the one responsible for anything their sales agent does. A broker requires more experience and education. And while both types of licensees must pass a state test, the broker’s test is different and about twice as long. If you were to hire a real estate agent to list your house, as far as the law is concerned, you have really hired the broker who, in turn, hired the sales

agent as their representative. As far as life as a real estate agent, that’s a great question that too many people don’t ask before they actually get into the business. I think that accounts, in part, for the high professional drop-out rate. The upside of being a real estate sales agent is a combination of the independence and the potential for a good income. Sure, you work for a broker, but in actuality you are an independent contractor who has to make their own business, marketing and financial decisions. Don’t go into this expecting your boss/ broker to simply assign business to you, it’s not the way it works. You live or die by your own effort and skill. You have to find clients, both buyers and sellers. You have to foot the marketing bill

and support yourself between commissions. You have to be responsible for keeping yourself educated regarding the changing legal landscape and the constantly changing, and ever expanding, legal forms you’ll use with and on behalf of your clients. When you are involved in a sale and a commission is generated, you split that commission with your broker on a percentage basis which you negotiated when you went to work for her. Generally, the more experienced you are and the more commissions you generate, the more of the commission you get to keep. From my 40-plus years in the industry, one of the personal attributes which so obviously points to someone’s success or failure in the profession is whether they go into it

with a confident “I’m going to go out and get it” type of attitude coupled with a love of being around people. If you doubt any of that, just go party with a group of successful Realtors and try to keep up. Shy, shrinking violet personalities generally don’t last long in the business. Long term, people in the profession are successful because they build their practice on referrals from their past clients. That means they long-ago took to heart the legal obligation to protect their clients and a willingness to be open and honest with them regarding what is in their client’s best interest. There are few similarities between, say, a car or department store salesman and a real estate sales person. The first two have a legal obli-

gation to produce the most profit they can for their employer; while the Realtor has an obligation only to their client’s well-being, whether it results in a commission or not. I’m not making that up; it’s the law here in California. My best advice would be to go talk to a broker at one of the larger companies. Tell him what you’re thinking about doing and see if they can set it up so you can shadow a few of their most experienced agents. That’s probably the best way to see if you think this would be a good fit. Tim Jones, Esq., is a real estate attorney in Fairfield. If you have any real estate questions you would like to have answered in this column, you can send an email to AllThingsRealEstate@ TJones-Law.com.
