A well-written option agreement protects both parties Q: I’m getting married this summer. Both my fiancé and I are in college so we don’t have a lot of money to buy a house, but we’re really concerned with how quickly homes are going up in price and we are really afraid we’re going to get priced out. My parents are willing to buy the house for us, as long as we make the payments, which I’m sure we can handle with the help of student loans and such. But my parents are concerned that if we wind up being unable to make the payments, a foreclosure would go on their credit record.

Also, the deal is we would put the house in our names after we finish school and start working.

What type of documents do we need to have drawn up so that, if worse comes to worse, my parents’ credit is protected and we will be able to transfer ownership when the time comes?

A: Let me handle the second question first.

If your parents weren’t getting a loan on the property, there are several different ways in which you could set up a transfer of the property at a future

Tim Jones date. But with a mortgage on the property, no matter what your arrangement with your parents, the bank won’t let you just take ownership without the bank’s permission because the loan was granted based upon your parents’ ability to make payments, not yours.

When you go to take title, you will either have to qualify to assume your parents’ loan, or get your own loan and pay off the other one.

With that understood, the easiest way to guarantee you can purchase the property is to enter into an option agreement with your parents.

An option is simply a contract that gives you the exclusive right to buy the property, usually for a set price, within a certain amount of time. For all practical purposes, your parents would be unable to sell the property until

the option period expires.

Although trusting your parents to follow through with the sale may not be an issue, should your parents pass away, the executor of their estate may not be so willing to transfer the property if the option price is below market value at the time.

I suggest you execute an option agreement and record the agreement with the county Recorder’s Office.

As far as protecting your parents’ credit in the event you can’t make the payments, there’s not much I can offer to help put your parents’ minds at ease.

Just like anybody who buys a house, they are at risk for a foreclosure should the circumstance present itself.

Should you not make the payments, your parents can step in and make them. If they either can’t or won’t keep the payments current, they can sell the house long before a foreclosure takes place. Normally, a seller who lets a house go into foreclosure when there is an active option agreement in place is violating that agreement and subjecting them-

selves to a breach of contract lawsuit. For that reason, I would carve out an exception to the option agreement allowing your parents to sell the house should you no longer be able to make the loan payments.

If I were your parent, I would have you make your payment directly to me. I would make the monthly payment to the bank so I know it was made on time.

It’s actually quite common for parents to purchase a home for a son or daughter. But the law considers the owner, your parents, The Law Offices of

to be a landlord and you to be a tenant. Just like any landlord, the bank will hold your parents responsible for the mortgage payment. A well-written option agreement will protect both your interests and the intentions of your parents.

Lemon Coral sedum celebrate the flowers

A

funny thing happened on the way to May: I have what looks to be a million tiny yellow flowers. It happens every year for about four to six weeks, but no one talks about it. Some even look away.

Lemon Coral sedum was the 2019 Proven Winners Annual of the Year, yet I don’t remember flowers being mentioned. While I am at it, I will add, I have never had one die, either. The truth (or caveat) to that is I have lived my whole horticultural life in zones 7b-10 — in other words, fairly mild to warm climates.

When it comes to Lemon Coral, we all love the soft succulent needle-like foliage so much we almost confess apologetically and tell our friends and neighbors, “Oh, that is the sedum blooming.” Proven Winners now say if you are lucky, you may get some blooms. Every year The Garden Guy gets a million yellow blooms and I am not the only one. We aren’t embarrassed, let’s celebrate it! I can even see some town having a Lemon Coral Flower Festival.

Look at it from another perspective. We partner the luxurious chartreuse foliage with our favorite colors of Supertunia petunias, Superbena verbenas or Superbells calibrachoas, and we love it. But then in April and May, it gives way to an explosion of yellow flowers, welcoming spring and creating stunning combinations.

After the bloom cycle, we give it a trim or cut it back, probably to the delight of the companions. Give it a little shot of fertilizer and we’re off for the long, hot summer. When the temperature crosses over from hot to oppressive, this little sedum from Mexico (Sedum mexicanum) is like a living layer of mulch, keeping roots cooler and tough as nails when it comes to water needs.

Norman Winter Wherever I have planted the lime green, soft, succulent, needle-like foliage becomes a “look at me” beacon in the landscape.

Its habit is mounding, compact and will compete on your list of toughest plants you have ever grown, reaching 10 inches tall with a 14-inch spread.

Lemon Coral sedum will be a rock-solid perennial in zones 7-11 and among the best buys for your garden dollar when purchased as an annual in zones 6 and colder. Lemon Coral also makes a great container mix for other succulents grown indoors.

Those flowers we sometimes embarrassingly accept outdoors in the landscape and mixed containers may surprise you with a

pollinator or two.

Although I am touting them as an obvious choice for the landscape when the heat is on, they are perfect pansy pals for the winter in zones 7 and warmer. Whether you plant a cool season container, one for the scorching temperatures that lie ahead, or in the landscape, the soil must drain freely, as soggy soil usually proves fatal.

Planting in containers is much the same as planting in the landscape. Place all your plants with the top of the root ball, even with the soil line.

Lemon Coral sedum has won almost 20 honors, including Top Performer Awards in Michigan and Wisconsin to Perfect Score all Season at Penn State. Those trials are in the north where it is an annual, but it is outstanding in the South, where it won in the heat and high humidity at Mississippi State. Love the foliage but celebrate the flowers too with Lemon Coral sedum.

Make cleaning out your closet a priority, says Michelle Gage a designer in Pennsylvania. First, pare down: Toss anything you don’t see yourself using again.

First, tackle storage by stocking up on bins, baskets, an umbrella stand and hooks to corral coats, bags and other items. “Then add paint or wallpaper, new rugs, decor and art, and new lighting for a new look,” Smith says.

Current refinance party over – at least for now

have seen it all over the past 40 years, which is the only benefit of being 63.

In May 1986, after a huge six-month refinance boom, mortgage rates spiked from 6% to 8% in what felt like a week. Millions of Americans with 10% and 12% rate mortgages who applied for a 6% rate from March to May in 1986 didn’t get their loans funded until July through September because the lenders could not handle the volume. Rate locks expired because it was taking 60 to 120 days for an underwriter to approve the loan.

Although your lamps may work fine, they are probably more than three to five years old, and the shades have probably seen better days, says Los Angeles-based designer Jeff Andrews. “We don’t realize how dirty and dingy they can get over time, and updating a lamp with a shade in a new shape or material makes it feel like an entirely new piece of decor,” he says. I would turn in a totally processed $125,000 super easy loan file to my favorite wholesale mortgage company and instead of the usual one – to two-week turn times, it became 60 to 90 days in underwriting.

Loan officers at all the different types of mortgage companies were overwhelmed with great business but the lenders didn’t have the human resources to

handle this 1,000% increase in loan applications over the previous year.

There was a huge refinance mania from 1991 to 1993 that suddenly ended in 1994. There was another huge three-year refinance rush from 2000 to 2003 that abruptly ended in 2004 and because the mortgage companies were so flush with staff, money and resources, rather than lay off 100,000 processing and underwriting staff, they replaced legitimate refinance volume with the 100% loan-to-value stated-income loans and crazy adjustable-rate mortgage loans to stay afloat and keep the volume up, which caused the 2008 crash.

Tens of thousands of loan officers in California left the business from 2008 to 2012.

There was a small refinance

boom in 2012 and again during Brexit in 2016, but these little ones were nothing in comparison to the sub-3% fixed-rate pandemic-induced refinance rush between May 2020 and December 2021. My team was working 60 hours per week for months while teaching our kids on Zoom and working remotely and although we were very distressed with people getting sick, we had to take care of our past and new clients, just like Travis Credit Union and Valley Strong tried like heck to serve their members.

The moral of this story is that mortgage volume across America is down way more than 60% from the same time last year and the business is now 85% purchase and only 15% refinance.

Loan officers and mortgage companies that haven’t seen the ups

and downs and are not prepared for this market will be in a heap of financial trouble. Loan officers who were 100% refinance business will not be making two or three times what a doctor, the local police and fire chief makes in 2022.

The strong, ethical and financially stable great lenders will survive but the refiance party is over for now.

Using a paint sprayer, which you can probably rent from a hardware store, makes for the smoothest application. Unsure what hue to go with? “Right now, creamy, earthy whites, greens, blacks and muted blues are trending paint colors,” Banks says.

The 15-year fixed-rate average rose to 4.52% with an average 0.8 point. It was 4.4% a week ago and 2.3% a year ago.

The five-year adjustable rate average grew to 3.96% with an average 0.2 point. It was 3.78% a week ago and 2.7% a year ago.

“Mortgage rates rose again this week, just as they’ve gone up almost every week since the beginning of the year,” said Holden Lewis, home and mortgage specialist at NerdWallet. “The mortgage market is responding to skyrocketing prices and the Federal Reserve’s campaign to get inflation under control. The Fed raised shortterm interest rates by half a percentage point at its May meeting, and mortgage rates already had gone up in anticipation of this and future rate increases. Wednesday’s half-apercentage-point increase was expected. With even more Fed rate increases expected in future months, mortgage rates might keep going up.”

On Wednesday, the Federal Reserve raised its benchmark rate, its largest increase since 2000. The news came too late in the week to be factored into Freddie Mac’s survey. The federal funds rate is now set between 0.75% and 1%.

The central bank also released its plans for reducing its asset holdings. The Fed, which has $9 trillion in Treasurys and mortgage-backed securities on its balance sheet, will allow them to mature without reinvesting them. Starting in June, it will allow as much as $30 billion in Treasurys and $1.75 billion in mortgage-backed securities to roll off each month. Beginning in September, it will allow $60 billion in Treasurys and $35 billion in mortgage-backed securities to roll off each month.

At this time, the Fed does not plan to sell its assets on the open market.

Wednesday’s “vote alone is unlikely to spark a new surge in mortgage rates,” said Danielle Hale, chief economist at Realtor. com. “Rather, the broader statement language, including the $17.5 to $35 billion in agency debt and mortgage-backed securities that the Fed will begin to allow to run off of the balance sheet each month, and [Fed] Chair [Jerome H.] Powell’s discussion in the press conference following the meeting are the influencers that matter.”

The Fed doesn’t set mortgage rates, but its actions tend to influence them.

“What matters at this stage in the cycle is not only the Fed’s actions, but their actions as compared to expectations,” Hale said. “This means there’s both upside and downside risk for mortgage rates. If the Fed continues to focus on inflation, and the rate increases and balance sheet reduction it believes are needed to tame price growth, that will reinforce the current market view, and keep mortgage rates climbing. . . . If the Fed shows any hint of hesitancy in its resolve to rein in inflation, markets could expect a slower path of increases, which would give rates a bit of breathing room.”

Investors’ concerns that the Fed was contemplating a bigger rate hike pushed long-term bond yields higher this week.

The yield on the 10-year Treasury crossed the 3% mark on Monday before closing at 2.99%.

It fell back to 2.93% on Wednesday after Powell indicated the Fed has no plans to raise the federal funds rate by 75 basis points. (A basis point is 0.01 percentage point.)

It is not only rising rates that are making home loans more expensive.

don’t remember the first refrigerator my family owned, but I distinctly recall the one my mother bought when she renovated our Massachusetts home in 1988. It was a sleek black glass unit, a contrast to the kitchen’s luxurious cherry wood cabinets and white tile floors and countertops.

Back then, a black glass refrigerator was the kind of appliance that dropped jaws.

But a little over a decade later, when I started looking for apartments of my own, black had been replaced by stainless steel. My first solo apartment in Queens offered a depressing, glossy white fridge and rickety white range. So naturally, when I moved into a two-bedroom in 2012 that boasted a GE Monogram with French doors and a Samsung range, it felt as if I had arrived.

Although stainless-steel appliances have been the standard in mid-tier luxury homeownership for the past two decades, a new trend, ushered in by Café – GE’s mass premium appliance line –

Ilve, Samsung, Smeg and others, is slowly cresting. Kitchens are beginning to reflect whimsy and personal taste with colorful appliances in shades such as bright blue and lemon yellow.

“White was the primary appliance out there for many, many years,” says Albert Fouerti, chief executive of the e-commerce platform Appliances Connection.

“When stainless-steel appliances came out, that was a major differentiation.” Now, Fouerti says, brands are evolving again, recognizing that homeowners spend a lot of time in the kitchen and want to customize the space. So they are offering colors, hardware and bespoke options that allow consumers to express their creativity. “You have beautiful, great-looking, great-working appliances, but also different options of customization that fit your needs,” he says.

Customization used to be reserved for the highest tier of luxury consumers, an appliance market driven by those purchasing items in excess of $10,000 apiece. But truly personalized products, available in finishes that extend beyond stainless or the standard black

and white, are now accessible to a cross section of buyers who are defined as mid-tier. (Those in the market for refrigerators between $3,000 and $5,000, for example, or for single – and dual-fuel stove-oven combinations that range from $4,000 to $12,000.)

These are buyers who like what they like, and what they like is a little pop.

The move toward color in appliances, says Wayne Davis, senior brand director for Café, has been a slow but steady tack. Consumers have been falling in love with colorful appliances from a distance for several years, but they have also known them to be cost-prohibitive. “When they would go to the store, their budget really only allowed them to have stainless as their premium choice,” he says. “And so, we saw an opportunity to say: Well, how can we take what’s going on in luxury and bring it into what we call ‘mass premium’?”

For Café, the result has been a line of appliances – ranges, ovens, dishwashers, refrigerators – available in matte white, matte black and stainless steel that has customizable options for

brushed black, bronze, copper and stainless-steel hardware.

Davis says the black and white matte appliances, in particular, have been met with enthusiasm.

He attributes some of this stylistic change to the coronavirus pandemic. “Because we were all stuck at home, we’re spending a lot more time in our space,” he says. “ . . . We all were saying:

‘What can I do to make this space more mine?’ “ Changing the color of a range, dishwasher or refrigerator was an act that felt personal, and that feeling has continued, he says.

High-balance loans are mortgages above the conforming national baseline limit ($647,200). Fees for high-balance loans increased between 0.25 and 0.75%, tiered by loanto-value ratio. Fees for second

home loans increased between 1.125 and 3.875%, tiered by loan-to-value ratio.

Bankrate.com, which puts out a weekly mortgage rate trend index, found half the experts it surveyed expect rates to go up in the coming week, but the remainder were divided. Twenty-five percent said rates would stay the same, while the other 25% said they would fall.

Michael Becker, branch manager at Sierra Pacific Mortgage, is one who predicts rates

will ease in the coming week.

“The Fed delivered what markets were expecting today,” Becker said. “Jay Powell also ruled out the possibility of a 75-basis point increase in the near future. Treasurys and mortgage-backed securities rallied on this comment. I think this will help mortgage rates improve or move lower ever so slightly in the coming week.”

Meanwhile, mortgage applications were higher last week for the first time in two months.

The market composite index – a

measure of total loan application volume – increased 2.5% from a week earlier, according to Mortgage Bankers Association data.

The refinance index was flat, up just 0.2% from the previous week and 71% lower than a year ago. The purchase index rose 4%. The refinance share of mortgage activity accounted for 33.9% of applications.

“With mortgage rates now more than two percentage points higher than last year, more prospective buyers are applying for adjustable-rate mortgages, which typically offer a lower rate that can still be fixed for up to 10 years. “We love color. We never shy away from an opportunity,” she says. Working with a vibrant appliance, Sims says, can be tricky at times, but one way to bypass overkill is to make careful choices. “Select one to be the main event,” she suggests. “I do see stainless as kind of being jeans in an outfit. It exists for a purpose. If you want a statement appliance, you need every-

thing else to kind of bow out a little bit.”

However, she cautions against purchasing something simply because you’ve seen it everywhere and find it momentarily appealing.

Sims also suggests tailoring the kitchen to meet your functional needs. Focus on choosing appli-

ances first, rather than cabinetry or backsplash first and appliances second. Homeowners can match cabinetry to the appliances or pull from the appliances in the backsplash – decisions that can be made after the appliance colors are determined. “Let it have its moment,” she says of the appliance. “Just have fun with it.”
