Welcome to 2022
We are working through new initiatives constantly for access to Australian Standards, therefore it is imperative to be a Member of Master Plumbers SA.
2022 is going to bring with it new challenges and hopefully new opportunities. With State and Federal Elections knocking on the door, there could be some changes or new developments with existing Government policies.
Membership will allow you to access important information, save money and be up to date with current industry requirements.
I hope all of our members and industry stakeholders had a wonderful Christmas and New Year.
MPA will be developing a number of key priorities and will therefore be seeking commitments from all parties to ensure our industry remains strong and vibrant. The plumbing industry needs more support and guidance from the Government and nothing has proven this more than the COVID-19 Pandemic. Safe drinking water and sound infrastructure around the sewerage infrastructure is paramount to the community and this message will be given high priority. Stormwater installations by licensed plumbers is another area we will be targeting, as the current situation is not sustainable. Our concern is that it will cause major costs to home owners in the future and increase problems to our state’s waste water infrastructure. MPA will be seeking input from industry during this process.
Australian Standards
MPA would like to thank Members who supported the association to gain access to the latest editions of the plumbing and gas standards. In the past, the cost of the Standards was incorporated into Membership fees, however due to excess increases and an unconventional pricing model that seemed more like the process of “the spinning of a money wheel at the casino”, we were unable to continue with that arrangement. On the upside, we were able to strike a deal which means that Members can now access the AS/NZS 3500 and 5601 standards at a heavily reduced rate. We are currently working with SA Government for better support to the industry and aim to assist in having all Standards available at a more affordable price.
Master Plumbers have constantly advocated to industry that installations that do not comply are expensive to rectify and often the work is not insured.
Jack Holder - Rest in Peace, but never forgotten
2021 ended in a very sad way, with the passing of our industry icon Jack Holder. We recently recognised Jack for his contributions to the industry and life as a whole with the renaming of our MPA Gold Medal to the “Jack Holder Medal”. More is written about Jack in this edition of the magazine. I personally wish to pass on our sincere condolences to Jack’s immediate family, who have been incredibly supportive throughout.
Don Sims – Retirement (3rd time lucky)
I think I may have written similar words a few times before as Don has retired at least twice, but we (MPA) keep pulling him out of retirement. Don is a legend of the industry and has an incredible level of passion to see young students exceed -not only in their chosen careers, but particularly in plumbing. His dedication to MPA, our VET in Schools programs and to all of the students involved has been nothing short of incredible. The programs will be changing in 2022 due to the new VET in Schools reforms, meaning MPA and Don will be stepping away in all facets of the program. I wish Don, his wife Maureen and family all of the best going forward and please enjoy what life has to offer. (P.s. You may need to leave the State, as we have some new initiatives coming that involve training the industry.)

COPING WITH ANXIETY ABOUT COVID-19 RESTRICTIONS EASING
Cut down or stop the behaviours that are fuelling your anxiety – There are certain actions, when performed frequently, that can fuel anxiety further such as constantly reading the news and checking social media, or excessive alcohol consumption. Being aware of these behaviours, understanding how they’re making you feel, and replacing them with more helpful coping strategies can alleviate disproportionate feelings of anxiety. Use evidence-based mental health and wellbeing tools – Black Dog Institute has a range of free digital tools and apps that are backed by research and demonstrated to be effective in preventing symptoms of mental health conditions. To access these resources, please visit blackdoginstitute.org.au/resources-support Many of us around the country have been counting down the days till lockdowns end, restrictions ease, and borders open so we can see our loved ones again and start living life as normal. But as governments around Australia make cautious moves towards lifting COVID-19 restrictions, some of us are experiencing anxiety around re-entry into the world and what the new normal is. If you’re feeling anxious or worried during this time, you’re not alone. Even if you are not typically an anxious person, it’s common to feel some anxiety during periods of change or uncertainty. Signs and symptoms of anxiety include feeling tense and on edge, nervous, panicky, or irritable. You may not be able to focus on anything but your worries, and experience physical reactions such as stomach aches, light-headedness, and sweating. When constant repetitive thoughts and feelings take over, we can feel overwhelmed, lose sleep, feel exhausted, and start to avoid social situations. If you notice these signs and symptoms in yourself or someone else, it’s important to act and seek help early.
Adjusting to changes and times of uncertainty
Take it slowly – You don’t have to rush out or travel as soon as restrictions ease. Slowly build your confidence and take time to adjust. Make plans that you feel comfortable with and express your feelings with friends, family, and colleagues. Focus on what you can control – We often feel anxious when events feel out of our control, and when we think we don’t have the capacity, skills or ability to cope. Anxiety tricks us into thinking about the worstcase scenarios in vivid and frightening detail. Instead of worrying, try your best to focus on what’s under your control for example, exercise, get sufficient sleep and follow health advice.
Seek professional advice – It’s okay to ask for help. If you’re feeling overwhelmed by anxiety, seek professional support. You can access Black Dog Institute’s free online clinic for an anonymous assessment that you can take to your GP or psychologist to discuss further. There are also a range of other support services available. When you feel overwhelmed take a few slow, deep breaths to help you calm down. Be assured that for most people, the anxiety will be temporary, and will reduce over time. IN MEMORIAM | JACK HOLDER
Vale Jack Holder
In this issue, we pay tribute to plumbing industry icon, John “Jack” Holder, who passed away in November. Born in 1924, Jack was the youngest of five children. Even before his plumbing career, Jack was a high achiever. From a young age, Jack developed a passion for cycling. He got a job at a bakery – which, due to the early finish times allowed him to practice his riding. Jack then went on to become a successful cyclist, winning the State Junior Track Cycle Championship. Jack began working for LJ Hill Plumbing in 1940. During this time, he found his passion for plumbing and enjoyed the physical labour, which kept him fit and strong for bike racing.
He served on various boards and committees, including Building Homes for disabled persons, Independent Living for Mentally Handicapped and the McLaren Vale Hospital Board.After his retirement, his passion for the community continued. In appreciation of his outstanding community work, a council reserve was named in his honour - ’The Jack Holder Reserve’, which is located in Port Noarlunga South. In 2012, Jack received an Order of Australia Medal for his service to the Building and Construction industry, professional organisations and the community of Noarlunga. Anyone who knew Jack, would agree that it is extremely difficult to sum up his extraordinary life in a short tribute.
Jack’s plumbing career was put on hold in 1942 when he was called up for service in the Military, during World War II. After several postings, Jack was discharged from the Army in 1946. Following the completion of his apprenticeship, Jack then went on to start his own plumbing business in 1952.
Jack’s life is best summed up in his own words through his biography, “I nearly missed you”. This book, which includes Jack’s incredible story, poems and photographs is available from our office for Members who would like a copy.
From this point on, Jack continued to lead the way for the industry, which included serving as President of Master Plumbers SA, Master Plumbers Australia, the Institute of Plumbing Australia and the SA Building Industry Specialist Contractors Association.
Not surprisingly, Jack donated these books to Master Plumbers and only requested that in return, Members consider making a small donation to a charity which supports Veterans.
He also helped form the South Australian Building Advisory Committee, as well as the National Training Advisory Committee for the Federal Government in 1976.
Jack has become an honourary and inspirational figure in the plumbing industry and he will be truly missed. We will continue to honour Jack’s memory and we hope that his achievements will continue to inspire tomorrow’s leaders. We pass our sincere condolences to Jack’s family and friends at this difficult time.
He was a Member of both of these committees for lengthy periods. In addition, he served as a councillor for the City of Noarlunga Council, amongst many others.

Jack was not only passionate about serving the plumbing industry, but also about the community. After his son became quadriplegic at the age of 10, Jack became an advocate and passionate leader for people with disabilities.

During the warmer months, it is even more important to ensure you and your workers are sun smart. Below is a range of tips from SafeWork SA for maintaining your health and safety at work this summer.
Tips for Employers
Employers have a duty of care to ensure they are not putting their workers’ health and safety at risk. Unless it is specified in workplace employment agreements, the work health and safety legislation does not set temperatures at which a worker may be sent home, nor does it determine acceptable levels of ultraviolet radiation (UVR) exposure. Each workplace environment is different, and the onus is on the employer to manage any risks, in consultation with their workers. If it is not possible to eliminate exposure to UVR or increased temperature, the risk of skin damage and heat-related illness must be minimised so far as is reasonably practicable.
Some practical suggestions for minimising these risks include:
• identify hazards associated with working in the heat and UVR exposure
Tips for Employees
Workers have a responsibility to contribute to the management of risks and to take care of their own health and should: • follow all reasonable instructions from their employer • drink enough water to remain hydrated • check their urine colour as a darker colour can be an indication of dehydration • look after their work colleagues, recognise symptoms of heat related illness and know when to seek medical treatment • take responsibility for the health of their skin by wearing a broad brimmed hat, sun protective clothing that cover both arms and legs, and close-fitting sunglasses, applying sunscreen and working in the shade where possible • be role models and encourage co-workers to protect their skin and eyes from UV radiation • raise any work health and safety concerns with your employer or Health Safety Representative.
• plan ahead and ensure all practicable measures for preventing heat illness and overexposure to UVR can be implemented • alter work schedules so that work is done on a different day, during cooler times of the day or outside of peak UV times (such as early morning or late afternoon) • provide cool drinking water, which is close to the work area to encourage hydration • ensure all workers are aware of heat stress symptoms • provide workers with access to shelter, additional rest breaks and encourage people to stay hydrated • create cool down areas • enable workers to take regular breaks or rotate with others where possible to reduce their exposure to UVR and heat sources • utilise fans, misters and air-conditioners • move workers away from other heat sources in the workplace • provide sun protective clothing (such as collared tops, long sleeved shirts and long trousers) and sun protective hats and/or hat attachments (eg broad brimmed), SPF 30 or higher broad-spectrum water resistant sunscreen and close fitting sunglasses • encourage workers to keep an eye on each other • most importantly, make your controls available to workers and encourage their use.

MANY TRADIES DO THE RIGHT THING. CLEANING UP THE REST.
With thousands of building and trades jobs undertaken every year in South Australia, it is pleasing that so many tradies operate within the law and provide high quality trades services to their customers. Consumer and Business Services (CBS) is constantly monitoring the building and trades sector to check for compliance and take action where potential breaches are detected. Building and trades matters investigated over the past year relate to unlicensed activity, non-compliant building quotes and poor conduct. As a result of CBS’ compliance and enforcement activities there were court imposed fines issued and written assurances received from traders that they will not engage in unlawful conduct. In one particular case, the company was licensed to contract for plumbing, gas fitting and electrical work, however its conduct was unfair, improper and negligent. The company provided false or misleading information to customers about the price of materials and services and also about the need for particular services. The company and its two directors were formally reprimanded by the South Australian Civil and Administrative Tribunal and fined a total of $20,000.
In some cases once compliance action has been taken, traders will subsequently apply for a licence. In weighing up whether to grant a licence CBS will consider things such as previous breaches and the extent of any detriment caused to consumers, and of course whether the applicant meets all the licensing criteria – e.g. qualifications, experience, net assets and a police check. Compliance and enforcement action helps to clean up individuals and companies that flout licensing and consumer protection laws and taint this very hard-working industry. It also helps to remind all builders and tradies that they must know their legal requirements and fulfil their responsibilities. CBS is reminding plumbers to make sure that they: • Hold the correct licence/registration to cover the work that they currently contract for and/or perform. • Only subcontract out work to a suitably licensed business or company. • Only advertise for work that is covered by their licence. • Include their licence number in any advertising to the public, including on their website, business card and trade vehicle, as well as any paid advertising on radio, television, online or in a newspaper. • Provide an itemised bill to consumers within 7 days if requested by the consumer.

Plumbers who branch out into bigger building projects such as kitchen or bathroom renovations are reminded to make sure they hold a building work contractor’s licence and that they meet all the other obligations of builders where required – e.g. written contracts, building indemnity insurance and the rules around accepting deposits and payments from customers. Over the summer months CBS will continue to keep an eye out for itinerant tradies that approach consumers and businesses offering to provide repairs or maintenance services, particularly as there may be more movement of people across state and territory borders. Itinerant tradies are often not licensed and their work is substandard – if they actually do any work. Some dodgy tradies have been known to take deposits from unsuspecting customers and not return to provide any services. CBS welcomes reports from members of the building and trades industry and also from the public if you suspect unlicensed or unregistered trades activity. YOUR FUTURE, YOUR SUPER LEGISLATION WHAT IT MEANS FOR EMPLOYERS
From 1 November 2021, the Your Future Your Super (YFYS) legislation will see individuals ‘stapled’ to the first super fund they join. They will be linked to this super fund and it will follow them throughout their working life - unless they choose a different fund. While there are several reforms including a YourSuper online comparison tool and an annual performance test, stapling will have the biggest impact for employers and those changing jobs.
What you need to do
• You must provide a new employee with a Choice of Fund form (like the Cbus choice of super fund form found on the Cbus website or the ATO Standard Choice Form) within 28 days of them starting. • New employees can choose to join your default super fund or nominate their preferred super fund by completing a Choice of Fund form. • If a new employee doesn’t make an active choice of fund, you’ll need to use ATO Online Services to determine their stapled super fund. • You must use ATO Online Services to determine a new employee’s stapled fund. • If a new employee has more than one super fund, the ATO will determine the employee’s stapled fund based on a set of rules (the rules act as a tiebreaker). These may include factors such as when the account was created, how recently contributions were made and the account balance. • If a new employee doesn’t have a stapled fund and doesn’t make an active choice of fund, you must pay their super into your default super fund.
When you can request stapled fund information
• You can’t use ATO Online Services to look for your new employee’s stapled fund if they haven’t started work. They must be employed by you when you request the stapled fund information (you can only make the request from the first day they are on your site and on payroll). To make a request, you must have lodged either a Single Touch Payroll event or a TFN declaration.
• You will need to request the stapled fund information for a new employee if they haven’t provided you with a Choice of Fund form. When you request a new employee’s stapled fund information from the ATO, your new employee will receive notification of your request.
How does this impact workers in building and construction?
In the building and construction industry, stapling could have serious implications for employees’ insurance on work sites. Young and low balance members new to the industry could be ‘stapled’ to a fund that does not offer default insurance appropriate for the hazardous nature of their work and therefore are at risk of being uninsured in the workplace. The claim time is not the right time for your employee to discover they don’t have that cover.
Employers still need a default fund
If Cbus is your default fund, you can: • let new employees know that Cbus is your default fund, and • provide them with a Cbus Product Disclosure Statement and a Choice of Fund form (like our Cbus Choice of fund form). You can’t: • recommend or encourage new employees join Cbus.

DESIGN WORK BY PLUMBING SUBCONTRACTORS - WHAT TO BE AWARE OF
Plumbing subcontractors often engage in a certain amount of design work, whether or not the subcontract specifically refers to that being part of the scope of works. There are various matters to consider and be aware of when it comes to undertaking design work.
Commercial projects
In commercial projects, particularly larger commercial projects, it is often the case that a hydraulic engineer will be involved. The hydraulic engineer may be engaged by the principal or, where the head contract is a design and construct contract, the head contractor.
Residential projects
Where a head contract is a design and construct contract, the head contractor may, instead of engaging a hydraulic engineer, seek to engage a plumbing subcontractor pursuant to a design and construct subcontract. In that case, the head contractor is relying solely on the plumbing subcontractor with respect to the design work.
Therefore, even if the subcontract does not specify that the scope includes design work, often a reasonable amount of design work is required.
Alternatively, the head contractor might engage a hydraulic engineer and also engage a plumbing subcontractor pursuant to a design and construct subcontract. In that case, both the hydraulic engineer and the plumbing subcontractor concurrently have design obligations to the head contractor.
For residential builds, often there will not be a detailed plumbing design available to the plumbing subcontract that specifies precisely how each part of the plumbing works is to be installed / constructed.
Where a builder seeks to engage a plumbing subcontractor, it is important that, before any subcontract is agreed, the plumbing subcontractor obtains whatever plans and specifications have been prepared (possibly by the builder or an engineer) and determines the extent to which further design work is required. Where a substantive amount of design work is required: • It is important to discuss with the builder what the process will be with respect to finalising the design. • If the builder indicates that the design work will be completed without the plumbing subcontractor having to be substantively involved, then a plumbing subcontractor should ask for more details to be provided so that they can accurately quote for the work. • If the builder indicates that the plumbing subcontractor is to substantively finalise the design themselves, then it is important that the plumbing subcontractor confirm what design outcomes the design is required to achieve. Also, it is a good idea to ensure that the scope of the design work is clearly set out in the subcontract (although it is often the case that subcontracts for residential builds are quite brief).
Where the plumbing subcontractor is engaged pursuant to a design and construct subcontract, the plumbing subcontractor may decide to undertake the design work in-house. Alternatively, the plumbing subcontractor could itself engage a hydraulic engineer. Given the various possible permutations, it is important that each party is clear on what its obligations are. For example, if the head contractor has engaged a hydraulic engineer and, in addition, engaged the plumbing subcontractor pursuant to a design and construct subcontract, it is important that the contracts are clear as to what design work each party is expected to undertake. Where the head contractor does not engage a hydraulic engineer and simply engages the plumbing subcontractor pursuant to a design and construct subcontract, all the design responsibilities fall on to the plumbing subcontractor. This may be a cost saving exercise by the head contractor. In that case, the plumbing subcontractor needs to be particularly aware of the design objections and its design responsibilities, which should be clearly set out in the subcontract.
Where the plumbing subcontractor is expected to provide a quote with respect to undertaking substantive design work and installation / construction work, it can be difficult to quote for a job where significant amounts of the design detail are not finalised.
The problems referred to above with respect to quoting for residential work where the design is not complete also apply to design and construct contracts in commercial projects.
A contract on an hourly rate (and/or on a costs plus basis) can overcome this, but the builder may want to lock in a price.
Also, it is often not an option to enter into a subcontract for the design work and then a subsequent separate subcontract for the installation / construction work.

Defective Design Work
If the defective design work was partly the fault of the plumbing subcontractor and partly the fault of, for example, a hydraulic engineer engaged by the head contractor, then the plumbing subcontractor may be concurrently / jointly liable to the head contractor. Each party may be deemed to be liable for a percentage of the loss, depending on their respective levels of fault.
Even when a contract is vague or silent as to there being a design component, but where design work is undertaken in some form by the plumbing subcontractor, defective design work may still be a breach of contract. This is on the basis that, regardless of the precise wording of the subcontract, the works included some design works, and there is a duty that work under a contract be undertaken with due care and diligence.
Insurance
Where the design work by a plumbing subcontractor is defective, there may be express terms in the subcontract that have been breached. For example, there may be a term that states that the design is fit for purpose.
Where defective design work by the plumbing subcontract amounts to a breach of contract, and where that breach causes the builder or head contractor loss and damage, the plumbing subcontractor will generally be liable for that loss and damage. If the defective design work was undertaken by a design subcontractor engaged by the plumbing subcontractor, while the plumbing subcontractor may be liable to the builder or the head contractor, the plumbing subcontractor may have a claim against the design subcontractor.
Where a problem is caused by defective design work, an insurance policy that responds to installation / construction defects may not apply. A plumbing subcontractor that undertakes design work should consider obtaining professional indemnity insurance that applies to defective design work. There are insurance policies that relate specifically to design and construct contractors that provide cover for defective design work.

DBYD is the national service designed to prevent damage and disruption to Australia’s underground pipe and cable networks. Lodging an enquiry is free and simple; all you have to do is visit www.1100.com.au or download the newly released DBYD app (available for Android and iPhone devices). Most asset owners will generally respond with plans within hours, but it’s always best to lodge your enquiry a day or two before your project starts.
Key points to remember when excavating: -
Asset owners will send the information generally in the form of plans. Their contact details will be available when your enquiry is submitted should you require further information

Asset owners may provide a duty of care statement accompanied with the plans – please make sure to follow these instructions

Look for clues near underground infrastructure. These may include water meters, inspection points and warning signs

Use a DBYD certified locator to help determine the location of the asset

Plans provided by the asset owners detail the presence of underground infrastructure rather than the exact location. Be mindful that the plans do not show the entire domestic connection
