We wish to welcome Jemma Trotta and Kat Turner to the Master Plumbers SA Administration team. Jemma and Kat’s roles will be focused on Administration, Payroll and accounts following the exciting news that Frances is expecting her first child in December. We are confident that both Jemma and Kat will excel in their roles at Master Plumbers SA and we extend a warm welcome to them.

Upholding high service standards

As an Association we entrust our members to adhere to our Code of Ethics which simply put, means adhering to a level of professionalism that is conducive to best practice for the industry. Simple measures that enhance best practice include prompt communication / follow up with attendance to jobs and return to jobs if required, a level of compassion with explaining work practices, greater emphasis on respecting clients, industry stakeholders and the wider community’s property and surroundings.

The number one complaint we get as an Association is a lack of communication on the work tasks being performed and what are the expected outcomes to be achieved. Many clients have the outcomes in their mind, but they are not advised of the realistic outcomes of the work performed. In today’s crazy working environment (with the advent of COVID-19), changes need to be made and best practice needs to be adhered to more than ever.

The Association is working to promote the use of members via radio advertising and social media platforms, so we need to ensure that the effort is made to up hold best practice. The Association is also lobbying hard to increase the scope of work for licensed plumbers to combat poor practices from other tradespeople (more on that subject later).

Scope of Work for Advanced Licensed Plumbers

MPA have spoken to a number of people at Consumer and Business Services (CBS) regarding the scope of work that an Advanced Plumber can complete.

Plumbers can only do INCIDENTAL WORKS. Meaning, plumbers can only remove and reinstate the affected area in-order to carry out their works.

Plumbers cannot do an entire bathroom renovation. That type of work is outside the scope of the Plumbing licence. An Advanced Plumber can only carry out Plumbing work, remove and reinstate affected areas; Excavating – Can excavate an area to lay or repair plumbing works. Cannot dig footings etc Concrete, tiling, waterproof, gyprock - can remove and reinstate the area that needs to be worked on. Cannot gyprock, flush areas outside of the immediate repair zone, tile square meterage, install stud walls, etc 2nd fix – Can install mixers, basins, pans, etc. Cannot install shower screens, hand rails or access rails including backrests, etc If carrying out work that is outside of general plumbing you must obtain a Building Work Supervisor Licence. This applies to anyone who carries out bathroom renovations or other general work that is outside of plumbing.

Plumbers are also unable to arrange other trades, Tilers, Electrician, etc, as

this also comes under the supervisor licence. If you do this type of work and do not hold a current supervisor licence, you are at risk of not being paid by the consumer. CBS could also investigate, which could result in a loss of licence/and or a fine, which is a huge problem for our industry.

To obtain a Building Work Supervisor Licence, you will need to apply on the CBS website. They will require copies of your trade certificates, technical qualifications and evidence of experience, including references from licensed Builders. A Technical Interview Assessment will also be conducted to assess your knowledge of: - NCC standards - Australian Building Standards - Timber framing codes - Manufacturer requirements - Engineer Specifications Prior to applying, be prepared with references, proof of skills, photos, work done with builders, etc. If you need further advice prior to applying for this licence, please contact myself or Troy Swan.

MPA visited Darwin mid-September and hosted one information night which although had disappointing numbers, provided some good intel into a number of issues arising in the Territory. One of the key areas that needed consultation was the proposed Continuous Professional Development (CPD) program being proposed by the NT Department of Infrastructure Planning and Logistics as well as the Building Advisory Committee.

The proposed model establishes a robust, flexible schedule of training, educational and resource driven outcomes and objectives which all lead to an accumulation of points to achieve licensing renewal. The process for introduction is not 100% known from our end but it is based around Certifying Plumbers that operate under the NT Building Act 1993. Both Certifying Plumbers and Advanced / Journeyman tradespeople that we consulted agreed that the proposed model was a positive step and would like the CPD proposal to be expanded to those licensed trades operating under the Plumbers and Drainers Licensing Act 1983.

We will continue to work with members of the NT to achieve greater outcomes and lobby Government to ensure that the license is protected and noncompliant work is actioned accordingly. Further information will be released once known.

In order to work at their best and contribute to the success of their organisation, the health and wellbeing of staff is crucial. When staff aren’t feeling their best, they can’t work at their best.

NATIONAL SAFE WORK MONTH

National Safe Work Month in October is a time to commit to a safe and healthy workplace.

Master Plumbers SA is a strong advocate of National Safe Work Week and ensuring the health and safety of our Members, Apprentices and the wider community.

Work Health and Safety consists of: • Physical Health, Safety and Wellbeing – including the minimising of risk and hazards to prevent accidents and injury.

• Mental and Psychological Wellbeing – ensuring employees are provided with a supportive and inclusive workplace, free of bullying and harassment.

National Safe Work Month is an important event each year and is a great mechanism for raising awareness about important work health and safety issues and helps us highlight, understand and investigate potential WHS issues in our own workplace.

National Safe Work Month also serves as a reminder for workplaces to review their work health and safety policies and procedures.

The think safe. work safe. be safe. campaign is led by Safe Work Australia and is supported by Safe Work Australia Members and other stakeholders, including Master Plumbers SA.

CAN I ACCESS ADJOINING LAND FOR THE PERFORMANCE OF BUILDING WORK?

Builders and owners often require access to land adjoining a building site in order to carry out work. For example: • to do external rendering of the wall that is situated on the boundary

If they don’t or if they refuse to give access or they propose alternative arrangements for access that are considered to be unreasonable, the party seeking access may apply to the Court for orders as to access.

• for delivery of building materials; or • to bring plant on to the building site.

It used to be the case that, if the builder or owner wanted access to the adjoining owner’s land for construction purposes, they needed to get permission from the adjoining landowner.

If permission or access was not given by the adjoining landowner, there wasn’t much that the builder or owner could do about it. This is no longer the case. The Planning Development and Infrastructure Act 2016 (PDI Act) now address this issue and it can be used to gain access. The PDI Act supersedes the Development Act.

What rights do I have to access adjoining land?

On 19 March 2021, Phase 3 of the PDI Act was ‘switched on’ which meant that s 140 and s 148 also commenced.

Section 140 – Access to neighbouring land

Section 140 of the PDI Act is a new general provision that deals with access rights to neighbouring land. Section 140 applies in circumstances where a builder or an owner reasonably requires access to a part of a building under construction from an adjoining allotment in order to carry out building work or any other prescribed activity.

Notice in the prescribed form

It is not yet clear how long it might take to have a Court consider an application for access but we expect this will not be a quick process. A maximum penalty of $5,000 applies if an adjoining landowner, without reasonable excuse, fails to comply with an access order by the Court.

The same penalty also applies if that landowner hinders or obstructs a person exercising a power conferred by an orders made by the Court.

Section 148 – Rights of building owner

Whilst section 148 appears to have mirrored s 62 of the Development Act with respect to the rights of a building owner and what they can do with party walls, s148 goes further and provides additional rights that relate to the installation of flashings (this will be particularly relevant for plumbers).

It is interesting to note that s148(2) of the PDI Act now allows a building owner (subject to the building owner having satisfied the notice requirements) to install flashings between 2 buildings, including a building on an adjoining allotment and to install a flashing so that it overlaps a boundary.

Anyone exercising a right to access the adjoining land for the above purposes must ensure that they take reasonable steps to protect any adjoining land or premises.

To access adjoining land, a notice in the prescribed form must be served on the adjoining landowner requesting that they provide access. The notice (Notice) must be in the prescribed form and must include the following:

If they fail to do so, they can be held liable to make good any damage to the adjacent premises (which includes the contents of adjacent premises).

• The reason for which access is sought; and

The law has changed for the better. Sadly the new process might be long winded and so it remains desirable that neighbours try to agree access between them.

• The time at which, or a period for which, access is sought; and • Information about who would be entering the adjoining allotment if access were to be provided; and • What those people would bring with them; and • What activity or work is to be carried out; and

Conclusion

It is important to remember that there are special “prescribed forms” that must be used for Notices. You should not assume that you have a right to access adjoining land.

• Any other information required by the regulations.

The adjoining landowner who receives a Notice must then respond within the “prescribed period” (although the period has not been prescribed, we think 21 days would be reasonable in the circumstances).

For builders, you should make sure that you know what access you will need to adjacent sites before you start a job. Then if need be you can arrange for your client to make arrangements for the necessary Notices to be served on the adjoining landowner.

CAN I ACCESS ADJOINING LAND FOR THE PERFORMANCE OF BUILDING WORK?

Providing you the builder with access to the work is the responsibility of the owner, not the builder.

Finally, the timing as to the service of the prescribed forms can be tricky to navigate and it is not yet certain.

For example, s63(2) of the Development Act previously required the building owner to serve on the adjoining landowner notice of intention to enter the premises at least 14 days before accessing the adjoining allotment.

Regrettably section 149(2) of the PDI Act, which replaces s63(2), is silent as to the timing. The advice in this article is of a general nature and should not be relied on.

You can take great satisfaction in your work when a job is done well and you have some happy customers, but running a plumbing business is not always smooth sailing. At times there may be a fault with the work or a part that’s been supplied.

It’s important to know your obligations in these circumstances where remediation work is required under warranty or guarantee. Regardless of whether you offer a warranty as part of your terms and conditions, your customers are automatically entitled to: • warranties under South Australia’s building laws, as they also apply to plumbing work • consumer guarantees under the Australian Consumer Law. This means that: • the plumbing work must be done with due care and skill, and must meet accepted trade standards and all legal requirements • all materials you supply must be suitable for the job and of good quality

• the work must be completed within a reasonable time • the work must meet any particular purpose made clear to you by the customer.

The statutory warranties under building laws are in place for five years, while the consumer guarantees aren’t capped by a specified timeframe. Consumer guarantees apply for a reasonable period of time, although a range of factors will guide what is ‘reasonable’ – e.g. plumbing work that relates to a very old hot water system. These automatic warranties and consumer guarantees cannot be replaced, limited or removed by any agreement, contract or other warranty you offer to your customers. In addition, any other promises you make to a customer through your own warranties or guarantees must be honoured. For example, some plumbers might offer a 10-year guarantee on parts and plumbing work for drain repairs. If a warranty or guarantee is not met, then the customer is entitled to a remedy.

This could include having the work redone, having a part replaced or a refund.

Customers may also be entitled to compensation if the plumbing fault has caused damage to their property. Many of the parts you supply will also come with a

manufacturer’s warranty. It is important to note that because the customer entered into a contract with you for the work and associated parts, it is up to you to sort out of the problem for them. You should not expect a customer to try to sort out the issue for themselves with the manufacturer.

Rights under warranty and consumer guarantees won’t apply where the customer, another tradie or external factors beyond your control have caused the issue. For example, if the consumer digs and breaks a pipe, or tree roots grow back and cause problems. You may need to visit the property to determine the cause of the issue.

If the problem is not due to the quality of your work or parts supplied, you may charge the customer a fee to cover the assessment and also fixing the problem if required. When consumers report concerns to Consumer and Business Services (CBS) about a plumber’s reluctance to fix a problem under warranty or consumer guarantees, the first step is usually an attempt to conciliate the matter.

CBS can provide advice to both parties and try to resolve the dispute. If this is

not successful, a compulsory conciliation conference may be called. This process seeks to avoid legal action, although an agreement reached at a compulsory conference may be enforceable through the court system. Depending on the seriousness of the conduct, CBS can also take action against a plumber for failing their duty to provide a remedy.

Action by CBS could include: formal warning letter; public warning; disciplinary action; or prosecution. Plumbers should ensure that all their staff understand their obligations and building warranties and consumer guarantees, and if there are any areas of uncertainty they should check the legislation. Members can also contact the Master Plumbers Association for advice.

INNOVATIVE TREE ROOT TRIAL HELPING PROTECT SA SEWERS

The first stage of the trial is targeting properties which have experienced higher than usual sewer blockages caused by tree root intrusion. SA Water Innovation Specialist Alex Czura said the liners aim to restrict roots moving towards the pipes, without impacting the tree’s health.

“Tree root intrusion is the leading cause of blockages at customer’s sewer connection points, and when caught up with cooking fats, oils and other foreign objects flushed down the toilet or sink, can lead to everything that goes down coming back up,” Alex said.

“Most sewer blockages can be cleared by cleaning the inside of the pipe, without the need for any excavation. However in some cases, tree roots continue to grow, making it difficult to prevent further blockages occurring at the same location.

A new trial looking to prevent thirsty tree roots impacting South Australian sewers is now underway across metropolitan Adelaide, as part of efforts by SA Water to improve wastewater services for its customers and protect the natural environment.

“We devised a trial to dig an environmentally-friendly barrier around the base of a tree using hydro vac excavation and a root sawing method, which causes minimal disturbance to the tree itself, while preventing the growth of thirsty roots towards nearby sewer connections.

As part of the innovative pilot, a thin layer of high-density plastic liner made from 100 per cent re-used material has been installed below ground between problematic trees and a sewer connection at four customer properties.

“With the dig needed to install the barrier just 150 millimetres wide, the end result also reduces the need to excavate large areas of kerbing, footpath and residential driveways, often required for replacing damaged customer connections.

Throughout the three-year trial period, SA Water will use CCTV to monitor wastewater pipes at regular intervals, helping to assess the viability of expanding root barrier technology to other suitable locations around South Australia.

“We will also use this project to work with local councils and landscape architects and provide our expertise on the most suitable trees and plants to grow near our water and wastewater networks that support tree canopy coverage for greening and cooling, while also protecting our underground infrastructure.

“This is an exciting initiative that can help us save time and money while continuing to deliver the safe and reliable wastewater services that our customers expect.”

“While it is early days, initial works show the installation of root barrier technology comes in at just one-third the cost of a traditional wastewater connection replacement, and takes less than a quarter of the time. This may allow us to improve sewer services for three times as many properties, for the same cost,” Alex said.
