PERSPECTIVE On Friday 22 April 2022, MPAQ celebrated World Earth Day to raise awareness of how businesses can reduce waste and contributions to landfill by recycling PVC off cuts for a more sustainable future.

MPAQ and the Plastics Industry Pipe Association of Australia (PIPA), in conjunction with Iplex, Reece, Tradelink, and Vinidex, joined forces to launch the Construction Plastics Penny Cornah, Executive Director Recycling Scheme in October 2021.

The Queensland Government has provided funding support to ensure the delivery of the Scheme’s pilot program.

The Construction Plastics Recycling Scheme aims to educate and change behaviours when it comes to the disposal of PVC offcuts, working collaboratively with the broader industry to provide easy and accessible drop off points and helping to divert waste from landfill, which can be recycled into a new long-life recyclable pipe product. In total, the Scheme has collected 1,091kg of PVC off cuts (as of May 2022), of which 893kg has been useable material that can be recycled The Scheme has been developed to help industry understand the volume of PVC pipe off cuts and fittings that are removed from construction sites every year. This scheme highlights the environmental commitments of not only the partners involved but also the industry. There isn’t one person who can do it all, but now is the time for us to try. If, individually, we do our bit, together we can make a difference. Sustainability is the answer to

environmental prosperity, and plastic pipe systems are smart, efficient, and sustainable.

Breakfast events were held at Enoggera Reece Plumbing Centre and Tradelink Woolloongabba on World Earth Day to promote the progress of the Scheme, as well as launch a video that highlights why and how businesses should participate and contribute to reducing waste in trade industries. A special thanks to all the plumbers who attended the event.

PRESIDENT’S MESSAGE As the President of MPAQ, I am often asked why I do it. The answer is always the same: because I love representing the plumbing and gas fitting industry in Queensland. Our members are such special people, and I feel a duty to the 12 gentlemen who started MPAQ 122 years ago to continue to protect the legacy that has stood the test of time.

Our membership base is the reason for our being, and it is so important that we maintain our presence and numbers in our industry.

Some of you might think that being a sole operator means you cannot make a difference, but I can tell you that it’s not about one person. The reason MPAQ has prospered is because we have such a large member base, and this generates respect from the government and the other associations operating in our industry. As an association, we provide credibility and valuable contributions to the decisions, reviews, and legislation amendments that govern the plumbing and gas fitting trades in Queensland.

I urge you all to maintain your membership and continue to support MPAQ. Our biggest event for the year is the Plumbing and Gas Industry Awards (PIA). We were unable to hold the PIA in 2020 due to COVID-19, but last year all the stops were pulled out, and the MPAQ team organised a magnificent evening. It was one of the first social events we could all attend after the lockdown and it was great to see so many familiar faces at the event.

MPAQ, Australian Gas Infrastructure Group, and Pure Hydrogen have been in joint discussions with the Queensland State Government to develop and build Australia’s first 100% hydrogen, domestic house here in Brisbane. All parties believe it is the way of the future for this renewable, green energy, and the cohesion between industry and government has been refreshing. The opportunity to develop this project has so many positive attributes. It will raise the acceptance level of hydrogen being used in densely populated residential environments. It will give the Resource Safety Health Queensland (RSHQ) a fantastic opportunity to be involved in a ground up build. It will allow us to learn the best techniques to install and maintain these specialised appliances.

It will also give us an insight into writing the training documents for the skills required to install this renewable energy. From an industry perspective, there are no negatives to progressing this project as quickly as possible.

Each year MPAQ raise funds for a charity. This year the members have chosen Mates in Construction. When you attend an event this year, one of Penny’s amazing staff will be asking you to support this worthy cause. I hope you all dig deep and support this extremely important charity.

APPRENTICE TRAVEL FUNDING Recently there has been discussion around regional apprentices and their requirement to travel so they can access to training.

The Department of Employment, Small Business and Training provides a travel and accommodation subsidy to eligible apprentices and trainees, who are required to travel at least 100kms return to attend off-the-job training for their apprenticeship or traineeship.

Eligibility Requirements

In order to claim any part of the travel and accommodation subsidy: • The apprenticeship or traineeship must be registered in Queensland.

• The apprentice or trainee must travel at least 100kms return (by direct route), to their training organisation, from their usual place of residence. The apprentice or trainee’s usual place of residence may not be a home address if they usually live away from home to attend work (e.g. living in a mining camp for work purposes).

• The apprentice or trainee must attend their closest training organisation able to deliver training in the relevant qualification.

Claims must be submitted to the department within six months from the completion of the training block or attendance period being claimed for. Claims submitted more than six months after the last training day will only be paid in exceptional circumstances and will be assessed on a case-by-case basis.

The Travel and Accommodation Allowance: Policy Statement and Guidelines provides further detailed information about eligibility and: • rates for land, rail, air, and ferry travel and accommodation; • advance claims (apprentices and trainees experiencing financial hardship may apply for the subsidy prior to attending off-the-job training); and • special provisions for additional financial assistance or attendance at a training organisation that is not the apprentice or trainee’s closest training organisation.

Cancelled Training Contracts

Applicants whose training contracts have been cancelled must seek permission from the Department prior to attending any training relevant to their apprenticeship or traineeship. Otherwise, claims for travel and/or accommodation to attend a training organisation while ‘cancelled’ may not be approved. The ATIS-031 Assistance for Cancelled Apprentices and Trainees Information Sheet provides further details.

Applying for the Subsidy

Apprentices and trainees can apply for the travel and/or accommodation subsidy via Travel and Accommodation Online. This is the most efficient way to apply, when the apprentice or trainee is eligible and all information/supporting documents have been provided.

LOOK UP AND LIVE: RISE IN WORKSITE INCIDENTS SPARKS SAFETY WARNING After an alarming increase in heavy vehicles and machinery contacting powerlines, Ergon Energy and Energex are appealing to workers in high-risk industries to Look Up and Live and dial before you dig.

There were 432 accidental contacts with powerlines in Queensland last year compared to 360 reported in the previous twelve months.

“We are especially concerned that incidents in South East Queensland have more than doubled.

“In the last month we’ve seen a truck roll into a power pole and bring down overhead powerlines at Darra, excavators damaging overhead and underground cables, and a survey peg hammered into an underground cable at New Farm.

“Fortunately, no one was injured in these incidents, but the next person may not be so lucky.

“If you are working around powerlines, whether they are overhead or underground, there are tools and information available to help you reduce the risks.

“Use our free Look Up and Live mobile app to plan work near the overhead network and contact Before You Dig Australia to check the location of underground cables on your worksite,” Community Safety Manager Aaron Smith said.

Last year there were marked increases in powerline contacts involving road transport, construction and demolition, earthmoving and agriculture.

“We understand that truck drivers have a lot of risks to think about on the road, but anyone who is in control of an oversized vehicle or carrying a high or wide load needs to be aware of power poles and powerlines because their life is on the line.

“Contacting powerlines could be lethal, cause serious injuries or destroy your plant and equipment, so please Look Up and Live and dial before you dig.

“We are working together with high-risk industries to make worksites safe because we all agree that any incident is one too many, Mr Smith said.

In the northern region, accidental powerline contacts increased from 130 in 2020 to 143 in 2021, while in the southern region there was a significant drop from 158 to 132.

KNOW YOUR LEGAL RESPONSIBILITIES WHEN USING WORK VEHICLES National regulator offers guidance for users of light to medium heavy vehicles on their legal obligations.

Did you know that if you use a vehicle with a Gross Vehicle Mass (GVM) greater than 4.5t in your activities, you’re considered to be a heavy vehicle operator and must comply with Chain of Responsibility (CoR) obligations under the Heavy Vehicle National Law (HVNL)?

Just like your responsibility under WHS law to minimise any risks to workers and others at your workplace (so far as is reasonably practicable), if your business engages in operating, driving, loading, or unloading a heavy vehicle, you have a responsibility under the HVNL to ensure the safety of your transport activities.

While you’re not required to complete a work diary to manage driver work and rest hours for this category of vehicle, officers authorised under the HVNL, including police, can pull over vehicles to check for safety risks associated with such things as overloading, dimensions, load restraint, roadworthiness, compliance with vehicle standards, and registration and driver licence status.

QUEENSLAND LAUNCHES CAMPAIGN TO LURE INTERSTATE TRADIESTO PARADISE Tradies across Australia are being lured to paradise with a new campaign that will bolster the state’s skilled trade labour force and keep Queensland’s economy growing.

Up to $1,750 will be paid to the first 1,000 tradespeople who move to Queensland and work for eight weeks’ rebuilding communities impacted by the recent South East Queensland flood.

Acting Premier Steven Miles MP said Tradies in Paradise supported immediate flood reconstruction efforts and encouraged qualified tradies to stay for other long-term projects.

“The Palaszczuk Government is inviting up to 1,000 tradespeople from interstate to join Queensland in restoring local homes and businesses after the recent flood disaster,” the Acting Premier said.

“The devastating flooding events have put skilled tradespeople in high demand and we need more boots on the ground to help communities get back on their feet as soon as possible.

“While they are here, they can get a taste of what it’s like to work, live, and play in our great state… and maybe even stay forever and trade up to paradise.

“Queensland is the best state – our unmatched lifestyle, attractions and natural wonders coupled with a pipeline of major infrastructure projects in the lead-up to the 2032 Olympic and Paralympic Games, simply makes for a tradies paradise.”

Tradespeople who relocate to Queensland and undertake eight weeks’ reconstruction work in one of the 19 eligible local government areas will be rewarded with an incentive and travel payment of up to $1,750.

Minister for Training and Skills Development the Hon. Di Farmer MP said the Tradies in Paradise campaign is recruiting carpenters, electricians, plasterers, roof tilers, tilers, painters and decorators, plumbers, cabinetmakers, planners, architects or building designers, surveyors, building-related engineers, building certifiers, refrigeration and air-conditioning mechanics, and gas fitters.

“The Tradies in Paradise campaign is targeting tradies across Australia, except for New South Wales, who like Queensland is also tackling a significant reconstruction effort,” Ms Farmer said.

“As part of the campaign, tradies will also have access to a wide variety of information on areas such as sourcing accommodation and employment, licensing requirements and mutual recognition application and safety inductions.”

Minister Farmer said the Tradies in Paradise scheme was on top of the Palaszczuk Government’s annual $1 billion investment in training and skills, supporting Queenslanders to undertake training for jobs in demand.

“As we head towards the Brisbane 2032 Olympic and Paralympic Games and our renewable energy boom, the longer-term opportunities for skilled tradespeople in Queensland are endless,” Minister Farmer said.

“This investment is providing skilled workers for the future but following the recent floods we need more qualified tradespeople now.”

CARAVANS AND THE SILENT KILLER As the colder months approach, it’s a good time to remind our caravan owning customers about the dangers associated with ventilation and carbon monoxide (CO) poisoning.

Ventilation has been identified as a defect on the increase.

This issue has become evident as there have been several gas fitters finding serious ventilation flaws in vehicles.

Many caravan owners don’t know the dangers associated with insufficient ventilation or incomplete combustion. They could, therefore, be oblivious to the possibility of carbon monoxide poisoning.

It is our duty as gasfitters to ensure that gas installations are designed and installed safely but it is also called upon in AS/NZS 5601.2 Clause 9.10.1 – Commissioning of an appliance to make sure the user knows how to operate it correctly: “Instruction of the consumer, where available, on the safe and correct operation of the appliance and auxiliary equipment”.

This means we have a duty to ensure a customer understands how to use the appliance. It is always necessary to reinforce this subject in case the caravan has a new owner, or they were never shown how to operate the appliances in the first place.

Owners have been known to block ventilation openings in the colder months to keep the warmth in. We have heard stories of gas oven doors being left open to heat the caravan like a space heater. We have heard about gas cook tops being turned up full to take the chill off the caravan.

Mix incorrectly used gas appliances with blocked ventilation and you have the recipe for disaster. The CO levels in an unventilated small space such as a caravan can increase very, very quickly.

That’s the scariest part about carbon monoxide poisoning. Once you realise that something is wrong, it is too late for your body to react. You’re simply stuck there waiting for the inevitable to happen.

Education is key with the winter camping season upon us.

You may find yourself explaining why you have to install additional ventilation to a customer’s caravan, but don’t limit this important conversation to this situation!

Even when working on a fully compliant installation, remind the owner that blocking ventilation or using the oven to heat the caravan can put the occupants in a seriously dangerous situation.

We believe carbon monoxide detectors should be installed as standard in caravans.

Why not keep some on your vehicle and suggest them as an additional measure caravan owners can take to keep their occupants safe?

CO detectors will give peace of mind to the customer knowing that the presence of CO, “the silent killer”, will trigger an audible alarm.

The CO alarm sounds if your sensor detects a buildup of carbon monoxide in its vicinity. It is designed to do so before you start to have any health symptoms. It will usually be activated at low levels of CO such as 50 PPM (parts per million).

The occupants can then safely remove themselves from a hazardous situation.

In early stages of CO poisoning, the best treatment is fresh air so getting outside is the best course of action.

Gas is a safe and efficient fuel source when used correctly. This information is not to frighten our customers about using gas in caravans; it is to educate them and keep them safe. Your clear and concise knowledge as their trusted gas installer could potentially save lives.

The symptoms for minor CO exposure may present as a dull headache but not removing yourself from the area to fresh air early on can lead to far worse symptoms.

As caravans are usually small spaces, CO can reach dangerous levels in a short space of time.

If carbon monoxide poisoning progresses and takes hold of your body, you will become confused, weak, and fatigued. Your organs and muscles are no longer receiving enough oxygen to function and will begin to shut down.

Using your arms and legs won’t be an option at this stage, and you will eventually lose consciousness.

LICENSING

APPROPRIATELY LICENSED PERSONS Employers and nominees should be aware that they are required to be appropriately licensed in order to direct or supervise work being performed.

As an example, a business might employ someone who holds a backflow prevention endorsement so they can perform valve testing for the business; in this situation the employer/nominee who provides direction/supervision of that employee would also be required to hold the backflow prevention endorsement on their licence.

Additionally, if a business uses a subcontractor to perform a task they are not licensed for (as above), the same would apply—the person directing/ supervising the work would be required to hold the equivalent licence. In this circumstance, instead of using the other person as a subcontractor and having them contract for the work directly with the customer would eliminate the issue.

The Plumbing and Drainage Act 2018 states: 57 Supervising or directing work without appropriate licence 1. Subject to section 58, a person (a supervisor) must not supervise another person carrying out plumbing or drainage work unless the supervisor holds a licence for the work.

Maximum penalty— a. for a first offence—250 penalty units; or b. for a second offence—300 penalty units; or c. for a third or later offence, or if the plumbing or drainage work is grossly defective work—350 penalty units or 1 year’s imprisonment.

2. Subject to section 58, a licensee must not supervise another person carrying out plumbing or drainage work unless the other person holds a licence for the work.

Maximum penalty— a. for a first offence—250 penalty units; or b. for a second offence—300 penalty units; or c. for a third or later offence, or if the plumbing or drainage work is grossly defective work—350 penalty units or 1 year’s imprisonment.

BEAVIS & BARTELS

a history

Established in 1952, Beavis and Bartels has become one of Queensland’s Major Contractors.

1952 – 1996 Keith Beavis and Carl Bartels met and became friends while attending trade school in the Valley as part of their plumbing apprenticeship training.

During this time, they became close friends and remained in contact after completing their college commitments.

After completing their apprenticeships (Keith with Hornibrook Constructions and Carl with Mr Bob Anderson) and gaining their plumbers/ drainers licences, they obtained employment with separate employers in their neighbourhood of Bowen Hills. In their early twenties they decided to become business partners and commenced trading as Beavis and Bartels Plumbing and Drainage Contactors. Very quickly the company was commonly referred to in the building industry as B&B. Their first business address was 6 Jeays St, Bowen Hills, which was Keith’s parents’ house, where they stored their tools and material and ran most of the business from under the house. Some of the administration work was done across the street in Keith’s rental house. The company remained at this address for around eight years, in which time they grew from a twoman operation to up to fifty people.

After completing a good number of projects on the Gold Coast, the firm opened a standalone plumbing company, Gold Coast Plumbing, which was managed by their close friend Trevor Morris. Trevor was also to become a mainstay for the Master Plumbers’ Gold Coast Branch for many years. Gold Coast Plumbing was located on the Gold Coast Highway, Miami; their large fluorescent sign was a local landmark.

In 1960, the firm moved to a purpose-built office, store, and hardware show room at 181 Abbotsford Rd, Mayne. The building was designed by architect David B. Bell, did not conform with the traditional commercial building style of the time, and included such design aspects as vertical sun louvers on the front elevation, an open stair with glass panels, and a large wall mosaic of a boy on a dolphin imported from Japan.

Also, in 1960 the firm worked alongside Braybrook Homes in producing modular homes that were sent to the New Hebrides to replace cyclone damaged residences. At the same time, they worked with O’Neil Industries producing demountable and modular buildings including shower blocks, kitchens, and residential quarters, which B&B installed in projects such as Savage River Tasmania, Hay Point, 800-man hostel Gladstone, Gove, offshore drilling quarters Bass Straight, Black Water and Moura mines.

At that point in time Queensland was at the forefront of the prefabricated building industry.

In the mid-1960s to the early-1970s B&B’s workforce grew at times to over 100 employees.

In one of their projects in 1971, the Theatre in Round La Boite, Hale Street, Petrie Terrace, B&B manufactured and donated a stainless-steel time capsule. Both the Brisbane and Gold Coast warehouses incorporated sheet metal manufacturing workshops.

Drainage contracts played a large part in the business, the drainers stood alone in their own right, doing all the inground works and, for the most part, maintaining their own equipment. This provided a very efficient method with a high level of skill and experience developed over the years. During most of this time the drainage contracts were supervised by Joe Gibson who worked for B&B during most of this period.

Until the late 1960s to the early 1970s specialised plumbing design practices where not established in Brisbane. Companies such as B&B priced mainly on architectural drawings and sometimes some civil engineering details and allowed to provide a design and coordinate with the architect.

B&B were also one of the first companies to install two-way radios in their vehicles, which gave them an advantage in serving their maintenance clients. With the advent of mobile phones, a boom for smaller businesses, the radio system became redundant.

Their workforce and the structure of that force played a major part in the company’s success. B&B appointed project supervisors and a works manager, which allowed the directors more time to secure work and manage the business. A great number of the company’s employees had long and successful careers with B&B. In the time before portable long service many employees were able to enjoy long service leave. The company, they believed, also had a responsibility to maintain a healthy workforce, and most years they endeavoured to employ three new apprentices, in addition to a number of apprentices that commenced their trade training with another employer and transferred to B&B to complete their time. It is estimated that nearly 200 apprentices completed their trade training with B&B over this period.

The 1960s, 1970s, and 1980s were a time of great change for Brisbane, emerging from the perception that it was a large country town. The construction of sewers to the entire metropolitan area of Brisbane brought with it major development. B&B worked with many of the major builders and developers of the time in the construction of many landmark projects. Their clients included: • John D Booker • Westfields • N.A Kratzman • Concrete Constructions • F.A Pidgeon and Son • Civil and Civic The directors also diversified over these years, running a construction company, Gibson Constructions, along with their good friend Ron Gibson and investing in commercial and rural property.

Keith’s son Greg served his time with B&B before leaving a number of years later to pursue a career in plumbing design, commencing his own practice in 1992, Beavis and Cochrane. Carl’s son Brian worked for B&B for over 10 years before acquiring Gibson Constructions and moving into building and development.

In 1996 both aged in their late sixties Keith Beavis and Carl Bartels retired from the plumbing contracting part of their business, while maintaining their other interests together. The families remain in business together to this day.

The plumbing contracting business was continued by a consortium of individuals including long time employees and contributors to the company’s success. Gold Coast Plumbing continued under the directorship of Trevor Morris.

VALE CARL BARTELS 15 October 1930 – 3 February 2022 Carl Bartels was born in Brisbane on 15 October 1930 and grew up at Bowen Hills with his parents and sisters Florence and Mari.

Florence and Carl went to Ascot State School in their early years; sadly, Mari died quite young.

During World War 2 Carl and his sister were sent to Auntie Kate’s dairy farm in Tallebudgerra Valley on the Gold Coast in case Brisbane was bombed by the Japanese.

This was when Carl, at the age of around 11 or 12 years, picked up his first rifle and went shooting feral pests around the farm.

After two years, on his return, the school quickly worked out Florence had been doing Carl’s distance education and he had to repeat a year of schooling.

After finishing his education at trade school, topping his class in plumbing, Carl and fellow student Keith “Puddy” Beavis started Beavis and Bartels.

They worked from under Keith’s father’s house with one Ute between them.

Keith also introduced Carl to Carmel Duncan at Coolangatta in the early 50s. Carl and Carmel got married a couple of years later in 1955 and were married up until Carmel passed away in 2014.

Apart from Carl’s plumbing life, he and Puddy Beavis invested in a large cattle property in the Brisbane valley where they went on to breed racehorses and build a large red deer farm.

Puddy focused on the Horse side of things while Carl concentrated on the deer farming and their manager Jack Hughes ran the cattle side of the operation.

Carl went on to travel the world with his mate Bob Grant and the two of them hunted together in faraway places like Mongolia, Africa, Alaska, and, closer to home, fiord land in New Zealand.

Both Keith and Carl received Life Governorship’s from Kirra Surf Life Saving Club on the Gold Coast for their charitable contributions, and the two families still sponsor the Kilcoy Cup held each year at the Kilcoy Race Club.

Carl was a real life character, a gentlemen, a philanthropist, and an adventurer. He is survived by his two daughters, Narda and William Roberts and Leigh and John Finnemore, and son Brian and Angela Bartels, along with 10 grandchildren and nine great grandchildren.

Carl passed away on 3 February 2022; he will be very sadly missed.

If an employer has missed a super payment or it is late, the employer may need to pay the superannuation guarantee charge, which may include paying more super than the employer would otherwise have had to pay, and it is also not tax deductible.

Are You Prepared?

There are some important changes to superannuation that will take effect from 1 July 2022 and employers need to be aware of and prepared for these changes.

The Australian Government announced on 11 May 2021 (as part of the 2021-2022 budget) that the $450 threshold (super payments only had to be made on ordinary time earnings above $450 per month), will no longer be applicable from 1 July 2022. Employers will be required to make super contributions on any ordinary time earnings. Please see notes below regarding under 18’s.

It is important that employers who may engage casual employees, update their payroll system to reflect superannuation guarantee contributions on all ordinary time earnings.

Changes to Super for Under 18s From 1 July 2022, an employee who is under 18 years of age and working more than 30 hours in a week, will also be entitled to superannuation contributions regardless of the amount of gross earnings in that week.

Prior to 1 July 2022, the eligibility for under 18s to receive superannuation contributions included: • Earning $450 or more gross (before tax) per month; and • Work more than 30 hours per week.

However, as the $450 gross per month threshold has been removed, an employee under 18 still must fulfill the eligibility criteria of working more than 30 hours in a week to receive superannuation contributions.

Some things that businesses can be doing now in preparation of 1 July 2022, include: • Checking the payroll system is updated to process superannuation contributions be 10.5% from 1 July 2022.

• Double check that overtime payments do not have superannuation contributions as overtime does not form part of ordinary time earnings.

• Reviewing the requirements for under 18s to ensure superannuation contributions are made when the employee works more than 30 hours in a week.

• Re-evaluating the charge out rates to factor in the 10.5% superannuation contributions.

• Ensuring relevant systems/processes are set up to make the quarterly payments for superannuation contributions to the employees relevant superfund.

END OF FINANCIAL YEAR CHECKLIST With the end of financial year fast approaching there are some things that businesses need to do to prepare and maintain compliance.

Payroll is one area that often needs a bit of focus. Below are some items to consider and potentially develop an internal checklist for your business: F Check and update employees’ personal details – i.e. current address, contact number, banking details, tax file number, emergency contact details, super fund etc.

F Update payroll details reflecting any increases and ensuring employees’ wages/salaries are at or above the minimum wages from 1 July 2022 (taking into account the minimum wage increase from first full pay period on or after 1 July 2022). This may include reviewing salaries, hourly rates, overtime rates, penalty rates, allowances, etc. to ensure the payroll system reflects the minimum Award rate.

F Ensure the business has updated payroll to reflect the increase in superannuation contributions, which will increase to 10.5% from 1 July 2022.

F For employees previously earning less than $450 gross per month, superannuation on ordinary time earnings was not required; however, from 1 July 2022, superannuation contributions are to be made on all ordinary time earnings (except under 18s still have a

threshold of working at least 30 hours per week to receive superannuation).

F Report on reportable fringe benefits tax (RFBT) F Check payroll tax (if applicable) as there may be concessions available for COVID-19.

F Check that salary sacrifice items have been reported correctly.

F Check employee termination payments (ETP) have been entered correctly.

F It is recommended to adjust any casual employee’s payslips and employment contracts to have two line items of base rate and casual loading rate which, equates to their casual employees’ total rate as per the recent changes to casual employment legislation.

F Prepare and lodge your quarterly superannuation return as the 1 April to 30 June quarter is due on 28 July.

F The end of June is a good time to review your current employment contracts.

F Policies and procedures should also be reviewed and updated if needed at least once a year.

Once the above is reviewed, it also can be beneficial to review your charge out rates to ensure they are covering off relevant business costs, particularly as superannuation is increasing, and set to continue to increase annually until 12% superannuation contributions are reached.

An Updated Guide to

Calculating Charge Out Rates for Your Plumbing and Gas Business With supply chain issues and recent price increases, all businesses should be reviewing their charge out rates.

MPAQ is concerned about the recent price increases for products and materials being experienced in the plumbing and gas industry.

We would like to ensure the industry can prepare as much as possible, so recently we asked our corporate associates to advise what they are forecasting in potential increases over the next 12, 24, and 36 months.

The feedback from manufacturers and suppliers broadly states that: • All plastics are increasing and, potentially, will increase again by double digits in the next 12 months • 7-9% increase on flexible connectors in the next 12 months • Considerable increases in stainless steel based products due to global issues • Some manufacturers are experiencing problems obtaining raw materials and with freight price increases, which are causing delays. Some base materials are increasing by double digits • Copper is at an all time high; therefore, suppliers who require this material will be forced to increase their pricing Undercharging is easy to do if you do not start with the correct cost base. businesses go under because they are charging less than what is required to cover the costs of their business and a wage for themselves and/or their employees.

Many operators do not fully understand the difference between a margin and mark-up. This can lead to minimal business profits and, universally, overheads not being covered.

Plumbing and gas businesses sell two main items: labour, and materials. Both take time and money to manage, and both need to be marked up to cover their true cost and to allow for a profit margin.

The management of materials requires trade accounts, timely payments to suppliers, time taken to source, specify, store, transport, and return unused items, etc. There is also your administration time to reconcile dockets and accounts, as well as other general business expenses to operate (overheads).

Cost Base for Your Charge Out Rates • Determine the full cost of your labour.

• Add a mark up to your actual cost.

• Add a mark up to your materials.

Calculate Your Margin A 40% gross margin is an ideal target for a plumbing and gas business according to industry standards. You can use the Margin and Mark-up Table in your copy of the Guide. Finding your desired margin in the table, you will be given a mark-up percentage, which can be multiplied by your cost base to give you your desired charge out rate.

CRITICAL LESSONS FOR BUSINESS OPERATORS On 25 March 2022, a sole trader business operator became the first person to serve actual jail time after being found guilty of industrial manslaughter. The offence of Industrial Manslaughter was introduced in Queensland in 2017 as an amendment to the Work Health and Safety Act 2011.

The sole trader was sentenced to five years imprisonment – but suspended after 18 months of actual prison time.

The reality is that a serious work health and safety breach that results in a worker’s death could land you in jail, whether you are a small business operator or a senior officer/manager in a larger business operation, unless you actively manage your work health and safety risk management processes.

What Happened?

The sole trader was operating a forklift. He intended to lift a three-tonne generator from the back of a delivery truck. Unfortunately, the forklift was rated to lift not more than 2.7 tonnes. The sole trader did not have a licence to operate the forklift.

CCTV footage showed that as the forklift lifted the generator from a truck, the forklift’s rear wheels lifted from the ground and the forklift tilted forward. The generator fell from the forklift, rolled to its side, and struck a worker who was standing next to the forklift. The worker was killed instantly from crush injuries. The worker was a friend of the sole operator and was helping the business on a volunteer basis.

The jury accepted the prosecution’s argument that: 1. the business owner was a ‘person conducting a business or undertaking’; 2. the ‘worker’ (although a volunteer died in the course of ‘carrying out work’ for the owner; 3. the manner in which the forklift was operated, caused the worker’s death; and 4. the sole trader (as the forklift driver) was negligent about causing the worker’s death.

When delivering its verdict, the jury rejected the defence argument the friend was not a “worker” because he was a friend helping. Under the WHS Act, a volunteer is a person acting on a voluntary basis and is a worker if they carry out work in any capacity for a person conducting a business or undertaking (PCBU).

Of course, there wasn’t a company entity that operated the business, so in this particular case, the business owner himself was prosecuted as the PCBU. This does not change the outcome in any significant way because if there had been a company entity involved, the sole trader could have been prosecuted as a director/senior officer – resulting in the same outcome.

The business did not have any documented health and safety procedures for using the forklift or for unloading heavy equipment. The Court accepted prosecution evidence that there were safe alternative methods for unloading the generator and that these alternatives were available at low cost.

That there were low-cost safe alternatives was a significant factor upon which the Judge relied when deciding that the sentence needed to reflect punishment, general and personal deterrence, and denunciation of the failure to take active work health and safety risk management steps.

The Judge imposed actual jail time despite recognising that the owner was genuinely remorseful over the death of his friend.

WHSQ’s Approach to Industrial Manslaughter to Date To date, all directors, senior officers, and sole traders who have been convicted under the industrial manslaughter provisions have had direct personal involvement with the fatality rather than a more hands off “managerial” involvement with the fatalities.

All of the convictions to date have involved smaller business enterprises that have had more limited safety management systems.

This highlights the need, especially for small business enterprises to review and pay attention to their work health and safety systems – particularly if that involves more dangerous work – because the Regulator is clearly more willing to seek jail time in these circumstances.

Critical Lessons for Business Operators 1. It is critical that a business (especially a small business) undertake a thorough risk assessment of all dangerous activities and ensure a safe system of work is established and documented.

2. If as a sole trader, or as a director of a business, you do not clearly understand how to undertake a competent work health and safety risk assessment, it is critical that you educate yourself. You must know how to properly assess the risk of the work tasks you have your workers undertake. This is even more critical for dangerous work tasks (such as operating forklifts or working from heights, etc.).

3. At the very least, identify and implement the manufacturer’s instructions for the safe use of equipment (the manufacturer’s instructions should never be treated as the manufacturer’s opinion) and make sure that your workers do not exceed or work outside the manufacturer’s limits for safe operation (even as a “just this once”).

4. Make sure that your team knows where to access the documented safety procedures and that they understand what is required to safely operate the equipment. Safety procedures can’t be treated as a “we have to have these as a tick box – but go out there and just get the job done the best way you can”.

5. Not having documented safety procedures is a sure way to end up convicted in an industrial manslaughter prosecution. At the same time, having documented safety procedures, but not applying them is also a sure way to end up convicted in an industrial manslaughter prosecution.

It is critical that your business and your senior managers understand the increased risk of liability imposed on them personally from the industrial manslaughter. Ensure that you and your senior managers always take positive and proactive steps to exercise due diligence.

MPAQ Contracting Member Rhett Johnston and his friend of more than 30 years, Anthony Lee, have designed and produced a product like no other.

Together they have created the Cockatoo Connector, with the purpose of allowing plumbers to connect conduit relief drains effectively and easily into already established downpipes.

A year and a half ago, Rhett, director of Brisbane-based Rhett Johnston Plumbing, was unable to find a part that enabled him to efficiently put a drain into a downpipe. Enlisting the help of Anthony, a pilot, they began researching and soon realised there was a gap in the market for a product that streamlined the process. This sparked an idea for Anthony, who began developing prototypes in his workshop at home. After about 20 or so design concepts, Anthony and Rhett had come up with the design that they have gone to production with.

What Is the Process for Implementing an SBRP?

DEBT LIFELINE FOR STRUGGLING BUILDERS AND TRADIES Legislative changes made in 2021 by the federal government to help small businesses withstand the impact of COVID-19, are now providing a much-needed lifeline for businesses struggling with an overheating building sector.

The Small Business Restructuring Process (“SBRP”) is designed to provide financially distressed small businesses with access to a single, streamlined process to restructure their debts while allowing owners to remain in control of their businesses.

A far more favourable option than the traditional insolvency process, the SBRP has four major advantages: 1. There is no requirement to hand the business over to an administrator.

This means the business owner stays in control and can continue to make everyday operational decisions.

2. Administrative and legal costs are significantly lower than traditional insolvency action – in the order of 10 times cheaper.

3. For those operating in Queensland: In contrast to other insolvency action, the Queensland Building and Construction Commission (QBCC) do not see the SBRP as a trigger event for licence cancellations or exclusions.

4. With the assistance of an SBRP Practitioner, an effective debt restructuring proposal can result in small businesses negotiating a compromise with creditors that is not only formal but also relatively favourable – i.e. “X cents in the dollar” paid over time.

To be eligible for the Small Business Restructuring Process the business must: • Be an incorporated company – i.e. trusts, partnerships and sole traders are not eligible.

• Have total liabilities that do not exceed $1 million on the day the company enters into an SBRP – this excludes employee entitlements like super.

• Be likely to either be insolvent or become insolvent in the near future.

• Appoint a Small Business Restructuring Practitioner to assist in the process, including documentation of debt restructuring plan and restructuring proposal.

• Have all tax lodgements up to date, i.e. activity statements and tax returns all lodged on time. The tax debts do not need to be paid to enter into a plan but must be lodged.

What Debts Can Be Included in the SBRP? • Any unsecured debts incurred prior to the commencement of the SBRP. • Employee entitlements due either prior to or following the SBRP (super, leave, long service leave, etc) cannot be included in the plan.

• Before implementing a debt restructuring plan all current employee entitlements, particularly superannuation, must be paid and ATO lodgements must be up to date (e.g. tax returns, BAS lodgements lodged on time).

• The business must engage a qualified Small Business Restructuring Practitioner who will work with the business owner to design a debt restructuring plan and proposal to be presented to creditors.

• More than 50% in value of creditors must vote in favour of the plan for it to be adopted.

• Once the plan is accepted, payments will be made to each creditor at the same time, at equal “cents in the dollar” amounts until all obligations are paid under the plan.

A Note of Caution Regarding Trade and Secured Creditors • The SBRP only applies to unsecured creditors, and it is “one in, all in”.

• Unlike creditors like the ATO, many critical trade suppliers will be classed as secured creditors and are not able to be included in an SBRP arrangement.

The SBRP may provide a much-needed lifeline to assist businesses to trade back to financial health; however, business owners must understand their obligations under the process, and even more importantly, look at how they can fix the underlying commercial issues in their business to break the cycle of financial distress.

FOURTH GENERATION TAKES LEAD AT EVERHARD INDUSTRIES Fourth-generation Davis-Boyce family member, Gina Boyce-Rowe, has been appointed Chairman of the Board of the 96-year-old Queensland family company, Everhard Industries.

Gina takes over from her mother, Sue Boyce, the granddaughter and great-niece of the company’s founders, Fred and Alf Davis.

Sue has been in the role for much of the time since Everhard established a formal Board in 1990.

Gina, who has a background in critical care nursing, has been formally involved in the company’s operations and governance since 2015.

Gina undertook formal business education and an executive director traineeship working in every area of Everhard. She was involved in the recruitment of the current CEO, Moira Harris, and will continue to work closely with Moira in her new role.

Sue said, “As we approach our 100th year, I’m absolutely delighted that Gina and her brother Bede, an executive director of Everhard’s holding company, are committed to continuing Everhard as a family business and that our succession planning has come to fruition.”

Penny Cornah, MPAQ, and Sue will continue as a Gina-Boyce-Rowe director of the company.

Everhard began in 1926 making two and threecompartment concrete laundry tubs. Now based at Geebung in Brisbane, the company is a manufacturer, exporter, importer, and distributor of polymer and concrete products primarily used in the plumbing, draining, and construction industries.

BAILEY PLUMBING GLADSTONE CELEBRATE 40 YEAR MEMBERSHIP MILESTONE Written by Ross Bailey

Ross, who originally set up Bailey Plumbing has passed the baton to son Dale who has been running the business since Ross started transitioning to retirement and is now operating it very efficiently and successfully on his own.

I started my apprenticeship with the Bundaberg firm Wyper Brothers when I was 15 years old and worked all over regional Queensland on sewerage contracts until, in 1971, I was transferred to Gladstone for what was to be a six-month stint – and here we are over 50 years later!

I remained with Wypers and worked my way up through the ranks, but at the end of 1980 decided to set up my own plumbing business and R.W. & A.I. Bailey Plumbers and Drainers came into being, with just me and my wife Ann

overseeing the work/office load. I became a member of MPAQ in September 1981, having been involved with the organisation whilst employed by Wyper Bros. In those early days the Association was very active and had a big membership, and Gladstone hosted its first State Conference in the late 70s, which was a great success.

There is absolutely no comparison between running a business back in the 80s to what it is today, and I take my hat off to Dale in that he has been able to embrace and more importantly keep up with all the new rules, regulations, and demands that go with running a business in this era. Not only do you need to be a qualified tradesperson but also an astute business manager— I’m glad my time in the workforce has ended, it’s definitely a young, energetic person’s domain now.

In our early years we took on general “cottage” work, employing tradespeople and putting through some young apprentices. As a sign of the times, we find that now most of our workload is with government and corporate contracts rather than residential maintenance, so the workload has greatly expanded, which in turn requires more staff and enables us to give out more apprenticeship opportunities to the next generation coming through. We still regard our ourselves as a family business and find we have been very fortunate in our choice of employees as all have remained very loyal and have shown no sign of wanting to move on; some have been with us for over 20 years, and another remained right up until retirement age. That is a rare trait these days, especially in Gladstone where big

industry comes to town and poaches trades with the promise of big money, but we seem to have been immune to that. Really notable is the fact we currently have a tradesman in our company who is the son of one of my apprentices from right back in the early days. I feel that is a nice testament to a contented work environment.

We continue with our MPAQ membership simply for the support and professional advice available to us—it is another form of insurance, which can prove invaluable at times.

Paul was a fantastic supporter of the plumbing industry especially in the area of Backflow Prevention.

His business Able Instruments offers calibration and repairs on backflow tests kits and Paul was an expert in this field.

He attended many industry events and meetings and was always generous with a kind word, advice, or opinion when asked.

Paul will be greatly missed as a mate and industry supporter.

This competition is available for contracting members renewing their membership with the Association between 1 January 2022 and 31 December 2022. Receipt or confirmation of payment for renewal must be received by the renewal date in order for the member to gain an entry in the 2022 Membership Renewal Draw. This competition is only applicable to contracting members. Renewing members must elect to enter the draw via a link provided in membership confirmation emails. All entries must be received by 11.59pm AEST on 31 December 2022.

The competition is open to MPAQ contracting members who are Australian residents aged 18 years and over. Only one entry per company is permitted. The winner will be drawn at random on 20 January 2023 at noon AEST at 11/243 Bradman Street, Acacia Ridge, Brisbane, QLD 4110. The winner must accept the prize within 10 business days of this date.
