Jim was in trouble. He had forgotten his wedding anniversary, and his wife was really angry.

She told him, “Tomorrow morning, I expect to find a gift in the driveway that goes from 0 to 100 in six seconds, and it better be there!”

The next morning, Jim got up early and left for work. When his wife woke up, she looked out of the window and, sure enough, there was a boxed gift in the middle of the driveway.

Excited, the wife put on her robe and ran out to the driveway, brought the box back inside and opened it. Inside the box was a brand new bathroom scale.

Jim has been missing since last Friday.

As you read through this edition of Master Plumber, you’ll see there’s a lot happening within the legislation and regulation space, with Security of Payments legislation, proposed changes to Minimum Financial Requirements for contractors, and also changes in the Plumbing and Drainage Act and Wastewater Code.

We also have some great stories from some of our members with a few of them participating in the ‘Help Get Henry Home Initiative’ in South East Queensland, and one of our Corporate Supporter members, Tiffany English from Modus Operandi, winning an Aspiring Young Businesswoman Award.

We’ve also included a write-up from our 2018 plumbing and apprentice ambassadors, David Keys and Sarah Condie on their experiences over the past year and how they feel they have contributed to the future of our industry.

Executive Director Are you ready for changes in 2019?

Welcome to 2019! I hope you and your family enjoyed a break and recharged the batteries for a huge year ahead. There are so many changes coming for our industry and MPAQ wants to prepare you for what’s to come.

Building Industry Fairness (BIF) Reforms Chapter three (3) came into play on 17 December 2018, and it’s not all about Project Bank Accounts.

From 17 December, all payment claims (including invoices) are given the protections of the BIF Act. This means you no longer need to include specific wording on a payment claim or invoice indicating that they are made under the legislation in order to pursue your rights to recover monies.

Also, there is a requirement that a payment schedule must be issued within 15 business days in response to every payment claim, unless the recipient intends to pay the full amount of the claim by the due date.

This gives claimants certainty about the cash flow for their business.

There are also changes to the QBCC Act that establish a statutory defects liability period of 12 months where none is provided in the contract and the requirement to notify of the end of the defects liability period. You can read more on the BIF Act from the Queensland Building and Construction Commission (QBCC) on page 9.

Minimum Financial Requirements Changes came into effect from 1 January 2019.

The new Minimum Financial Requirement (MFR) for licensing reforms will be implemented in two phases. The reforms are a key element of the Palaszczuk Government’s landmark security of payment measures that will ensure subcontractors are paid for the work they do – in full, on time, every time.

These reforms will vastly improve the QBCC’s oversight of contractor licensees to reduce risk and mitigate the impacts of company collapse as much as possible.

National Construction Code (NCC) Including the Plumbing Code of Australia – new code will be released in May 2019.

For NCC Volume Three (3), in addition to the quantification and readability changes, heated water temperature control, cross-connection control and rainwater harvesting and use requirements will be included.

Additionally, some sections of Volume Three (3) that were only enacted in a minority of States or Territories, such as on-site wastewater systems, heating, ventilation and airconditioning (HVAC), and stormwater, will be relocated to the relevant State or Territory appendix.

Other areas currently under review: • Fire licensing • Mechanical services licensing • Review of the Project Bank Accounts for all projects between 1 – 10 million in 2019.

• A new Queensland Plumbing and Drainage Regulation and Queensland Plumbing and Waste Water Code are currently under review. These proposed changes are due to take place in mid-2019.

Welcome back to another year! I hope you all had a wonderful Christmas and a safe and prosperous New Year. If you’re anything like me, you’re still wondering what happened to 2018!

One of the last agenda items discussed by the MPAQ Council in 2018 was the supervision requirements for apprentices. As we all know, the current requirement for supervision of an apprentice is 100% of the time when performing regulated plumbing, drainage and gasfitting work. This relates to all apprentices regardless of whether they are a first year or fourth year, and how many competencies they have completed at college.

The frame work we were presented to evaluate was a step away from the 100% supervision model and was tiered to reflect both the progression of the apprentice through their time and the number of competencies that had successfully been completed at college. From the outset the plan looked to have some merit, but after some discussion it was decided that the proposal was far too vague and lacked any measure of competence. The plan would basically open a huge grey area on who was able to make the decision if an apprentice could work 10%, 50% or 100% unsupervised. It would also remove any ability for the regulator to enforce a breach of the supervision conditions.

The removal of this enforcement tool would, in my opinion, open the door for the unscrupulous operators in the industry. It would allow them to exploit cheap labour and give the employer the ability to have a second-year apprentice running around performing menial tasks unsupervised for the duration of his or her time.

In an era when we are all striving to make our trade more professional, the MPAQ Council and I believed that this would be a huge step backward for our industry. It would seriously reduce the quality of on the job training received and would have the potential to lower the standard of service that we deliver to our customers.

While we all agree there is room for further discussion on the topic, the discussion guideline in its current form is not the way to move forward on this important issue.

This year MPAQ has organised a plethora of events and I will be attending as many as possible. If you see me around and have an issue, please feel free to come and have a chat. I always have time to support our members and look forward to another busy year representing each and every one of you.

What to Expect from the National Construction Code (NCC) 2019

Energy Efficiency The commercial building energy efficiency provisions have undergone their first major overhaul since 2010, consistent with the Council of Australian Governments (COAG) National Energy Productivity Plan. A package of measures for Volume One will focus on reducing energy consumption by a potential 35%, representing a step-change for commercial buildings.

Additionally, new non-mandatory Verification Methods have been introduced to demonstrate compliance with the relevant Performance Requirement by way of NABERS and Green Star.

New Heating and Cooling Load Limits

The Australian Building Codes Board (ABCB) recently gave consideration to the content of the 2019 edition of the NCC. Some of the key changes from the 2016 edition are described below:

New heating and cooling load limits for the NatHERS compliance pathway will be introduced for Volume Two. Energy efficiency provisions for Volume One and Volume Two will have a transition period of 12 months until 1 May 2020 during which either the new provisions or those from NCC 2016 may be used.

Quantification

Volume Two Acceptable Construction Practice

The most significant change to the NCC, since the performance-based code was introduced in 1996, is that an estimated 40% of the Code’s Performance Requirements will be quantified either directly or by a NCC Verification Method. This work stems from the Board’s increased and competent use of performance initiative, which is aimed at assisting the reduction of non-compliance caused by poor application of Performance Solutions.

Improvements have been made to the provisions of numerous Acceptable Construction Practices (ACPs), and new ACPs have been introduced for earth retaining structures, masonry, and attachment of decks and balconies.

Condensation Management

It is intended that the remaining Performance Requirements will be quantified in the same manner for NCC 2022.

Provisions to reduce the likelihood of risks associated with condensation within buildings will be introduced to help deal with potential health risks and amenity issues.

Readability

Roof-top Spaces

The NCC has undergone significant structural change to improve access, awareness and understanding, including the introduction of consistent governing requirements across all three Volumes and changes to the format and structure of NCC online. NCC Volume Three has been redrafted consistent with a new information architecture that aims to improve access and readability of the document in a digital environment, as well as in preparation for a consistent volume structure in 2022.

New provisions clarifying the application of requirements to occupiable outdoor areas, such as occupiable roof-top spaces, will be introduced in Volume One.

Accessible Adult Change Facilities Volume One will include new requirements for accessible adult change facilities to be provided in large shopping centres, sporting venues, museums, theatres and airport terminals.

Fire Safety

For NCC Volume Three, in addition to the quantification and readability changes described above, heated water temperature control, cross-connection control and rainwater harvesting and use requirements will be included. Additionally, some sections of Volume Three that were only enacted in a minority of States or Territories, such as on-site wastewater systems, heating, ventilation and air-conditioning, and stormwater, have been relocated to the relevant State or Territory appendix.

A new Fire Safety Verification Method (VM) will be introduced with a delayed adoption date from 1 May 2020.

The new VM, which is a voluntary tool under a Performance Solution pathway, provides for a documented process in the design of fire safety Performance Solutions and is based on the International Fire Engineering Guidelines.

Fire Sprinklers in Class 2 and 3 Buildings

A requirement for fire sprinklers to be installed in apartment buildings and other residential buildings four storeys and above and up to 25 metres in effective height will be included in the Deemed-to-Satisfy Provisions. This means, anyone using a Deemed-to-Satisfy pathway for compliance for these types of buildings will need to install a fire sprinkler system. As part of these requirements, two new types of fire sprinkler systems have been included, as well as concessions for other fire safety features on account of the additional protection afforded by the fire sprinkler systems.

Bonded Laminate Concession The ability to use a bonded laminated material with specified characteristics and controlled fire hazard properties, where a non-combustible material would otherwise be required, will remain for NCC 2019.

Getting Paid for the Work You do Has Just Got Easier The Queensland Government has developed the Queensland Building Plan to create a safer, fairer and more sustainable building and construction industry: one where businesses benefit from better processes, consumers have confidence in the industry, and subcontractors have improved security of payment.

The new security of payment laws in Queensland will be included in one security of payment Act, making it easier for subcontractors to find and interpret the laws that protect their payments.

What has commenced?

• Phase one of Project Bank Accounts commenced on 1 March 2018 and applies to Government projects between $1 and $10 million.

• Chapters three, four and five of the Building Industry Fairness (Security of Payment) Act 2017 (BIF Act) commenced on 17 December 2018 • The BIF Act has replaced the Building and Construction Industry Payments Act 2014 (BCIPA) and Subcontractors’ Charges Acts.

• The BIF Act inserts new sections into the Queensland Building and Construction Commission (QBCC) Act.

What does this mean for you?

Your right to get paid for your invoices is protected by the law. In summary, the reforms aim to: • Make it easier and simpler for subcontractors in the building and construction industry to get paid by providing effective, efficient, and fair processes for securing payment.

• Improve the process for progress payments. When you now issue payment claims (your usual invoices), the respondent will be required to pay in full by the due date or respond with a payment schedule within 15 business days. It is now an offence to not respond to a payment claim.

• Reduce opportunities for head contractors to delay payment and allow subcontractors to take action to resolve payment issues faster. If a subcontractor lodges an adjudication application and a decision is made in their favour, the respondent must pay the decided amount within five business days. Up to 200 penalty units may apply for non-compliance.

Changes to the QBCC Act The BIF Act inserts new sections 67NA- 67NC into the QBCC Act, which relate to retention monies and the defects liability period.

67NA - Statutory defects liability period A default defects liability period of 12 months will apply if under the contract a retention amount or security may be withheld. If the contract does not provide for the release of that retention or security at the end of an identifiable period then the default 12 months will apply.

67NB - Failure to pay retention amount Contractors are required to release all retention money to the contracted party in accordance with the building contract unless there is a reasonable excuse. There is now a maximum penalty of 200 units or one year’s imprisonment.

67NC - Notice about end of defects liability period Contractors are now required to notify subcontractors at the end of the defects liability period by providing the ‘Notice of End of Defects Liability Period’ form 10 business days prior to the end of the defects liability period. The maximum penalty for non-compliance is 100 penalty units.

• Streamline the payment claim process – a payment claim (or invoice) no longer needs to include the words “this is a payment claim under the Building and Construction Industry Payments Act 2014” to make it valid. Also, the claimant no longer has to notify the other party that they intend on lodging an adjudication application.

What else is new?

Important Note: Any invoices issued before 17 December 2018 will continue under the requirements of BCIPA until the matter is resolved.

• New Annual reporting under the Minimum Financial Requirements began from 1 January 2019.

• A sliding scale of demerit points (which could be four, eight or 10 demerit points) for section 73 - failing to comply with a direction to rectify or remedy. 10 points can also be issued in the first or second circumstance in the cases of structural defects, significant financial loss caused, or if the work is found to be unsafe.

Water Reticulation Design Considerations

Design and Documentation Tenders – Just What Is the Hydraulic Consultant to Deliver?

No matter what type of building we are designing for, be it a hospital, aged care, child care or residential, there is a need for us to consider the proposed water reticulation design in terms of ease of maintaining and monitoring the system to help minimise and manage the risk of Legionella and other bacteria within the water systems.

The provision of hydraulic services documentation can take many different forms based on the commission we have with our client.

Firstly, the quality of the water supply source should be considered to determine suitability and if further treatment or filtering is required.

Cold water reticulation should be installed in locations that minimise or eliminate any heat transfer from surrounding areas such as external walls or close proximity to hot water pipes and the like. Both hot and cold reticulation should have the ability to be easily flushed and treated and completely drained for maintenance purposes.

Other considerations, such as Thermostatic Mixing Valves (TMV), should be a type that allows flushing of the cold supply side of the valve, and shower roses should not have a rose that is too fine to eliminate “misting” of the spray. Similarly, tapware without aerators should be considered to again eliminate the “misting” of the water.

Pipework design should be such that there are no “dead legs” where stagnation of the water can occur. Any redundant pipework within an existing system should be disconnected at the main line and the branch replaced with a straight connection.

These are only a few areas where we can improve our designs, by monitoring the systems by way of alarms or similar on thermostat controls of recirculated systems, as well as any electrical heating elements in water heaters, to ensure correct temperatures are maintained.

Our design of water systems are only as good as the maintenance and monitoring of the system and for this reason a comprehensive water risk management plan must be implemented in all instances to avoid any high readings of Legionella or other bacteria that may be considered a health risk.

By good design, maintenance and monitoring of water systems and pipework, we can live with Legionella, not die from Legionnaires disease.

However, predominantly, it generally falls into the following categories: • Traditional Delivery • Non-traditional Delivery Traditional Delivery is when we are commissioned to provide full tender drawings and specifications where all hydraulic systems have been fully documented, coordinated with the other services and structures, and authorities’ approvals have been obtained (or at least have been submitted for approval).

Under this delivery method there are no questions about the extent of documentation we are to produce for our client. Non-traditional Delivery relates to the provision of design and construct documentation and is where there can be a substantial variation in the documentation expectations from our client.

There is a design process that we generally follow on most projects. This process includes milestones and drawing issues. Larger projects could include the following: • • • • •

Concept design Schematic design Design development Tender documentation Construction documentation

Each of the above milestones has an expected level of documentation to be produced to allow reviews to be undertaken by the client and the rest of the design team. When it comes to the documentation produced for a design and construct delivery, it can be anywhere from concept to design development, or even fall somewhere in between.

There is no doubt that the more detailed documentation we produce, the less contingency that the plumbing contractor needs to include in their pricing to the builder. Most of our clients are aware of this and this is where the difficulties occur for the hydraulic consultant. We submit our fees based on the type of delivery required. However, during the design process, the difference between traditional and non-traditional delivery becomes blurred with our clients pushing us for more and more detail on the drawings. In many cases, what we end up producing appears to represent a fully documented project. For the plumbing contractor, they can believe that they have full tender documentation and price the project accordingly. This can lead to even more issues for them during the design component of the Design and Construct (D&C) contract where further design development takes place that could lead to additional costs.

So, how do we resolve this issue? There are chapters of the AHSCA that are endeavouring to define the deliverables for the various delivery methods. The Queensland Chapter has also discussed this issue with a view of providing some direction to its members. However, with all the best intentions, we will still be pressured by our clients to produce more and more documentation (while paying us less) to ensure that their tenders include the least contingency possible. Unless we are prepared to lose our client for any future work, we normally give in to their demands, produce the additional documentation and then explain to our directors why we made a loss on the project.

Proposed Improvements to the Minimum Financial Requirements for Licensing in theBuilding and Construction Industry High profile insolvencies and corporate collapses continue to occur in Queensland’s building and construction industry with wide-ranging financial and social impacts.

Queensland’s building regulator, the Queensland Building and Construction Commission (QBCC), has historically required that financial information be provided to them with any application for a new licence or licence renewal.

This requirement helps the QBCC identify applicants or licensees who may not be operating a financially sustainable business and take appropriate action to minimise the potential impacts.

Since 2014, however, the QBCC’s access to a licensee’s financial information and, therefore, its ability to monitor companies potentially at-risk of insolvency or collapse, has been reduced. This is because the current Minimum Financial Requirements (MFR) Policy removed the requirement for a licensee to lodge financial information annually. This means that regular, detailed information about a licensee’s financial situation is no longer being provided to the QBCC. Through the Queensland Building Plan, the Queensland Government committed to creating new laws that strengthen the MFR for licensing. The Building Industry Fairness (Security of Payment) Act 2017 allows for the introduction of an MFR regulation, which will be a step towards making the provisions more transparent.

The proposed changes to the current MFR are a result of consultation with the industry on 18 improvement proposals outlined in the discussion paper ‘The proposed improvements to the Minimum Financial Requirements for licensing in the building and construction industry’, which received over 50 responses.

Many of the key reform proposals were supported, including increased financial reporting (particularly for larger, higher risk entities) and restrictions for accountants making changes to MFR reports. Respondents were also supportive of greater scrutiny around the use of forms of assurance, such as Deeds of Covenant and Assurance and related entity loans to meet minimum asset thresholds.

Based on the consultation results, the Queensland Government is progressing a number of key reforms.

The New Framework The key reforms aim to: • Strengthen reporting requirements • Provide clarity about what can be included when calculating a licensee’s assets and revenue • Improve data quality and availability for the QBCC This will ultimately enable the QBCC to more effectively detect and minimise the impact of potential insolvencies and corporate collapses.

Strengthening Reporting Requirements • Licensees will need to provide financial information to the QBCC each year (as was the case prior to 2014). This is a key measure to provide QBCC with greater visibility over financial reporting.

• Annual reporting will leverage existing reporting requirements to make it as easy as possible for licensees to comply. For example, licensees who already provide the QBCC copies of their audited ASIC reports can continue to do so.

• Categories SC1 and SC2 (those with lower revenue): o Will continue to self-certify that they are meeting the requirements. The revenue threshold for self-certification categories will also be raised from $600,000 to $800,000. o Self-certifying licensees will also need to report their Current Ratio of assets to liabilities, to provide more complete financial information to the QBCC. A new online reporting tool will make it easy for licensees to comply.

• Categories SC1 to category 3: o The current requirement to report decreases in Net Tangible Assets of 30 per cent or more will continue.

• Categories 4 to 7 (those with higher revenue): o Licensees will need to report decreases in Net Tangible Assets greater than 20 per cent.

More sensitive reporting triggers for high risk licensees will let the QBCC know earlier of changes in a licensee’s financial position. o Licensees must provide more detailed financial information in the form of a ‘balanced scorecard’. A more holistic reporting approach will better equip the QBCC to detect potential insolvencies.

• The QBCC will be able to seek advice from a suitably qualified, independent accountant to substantiate information in an MFR report.

• Licensees who provide incorrect information may need to meet the costs of the independent assessment.

• Any ‘material changes’ made by an accountant to an MFR report will need to be clearly identified and supported by updated financial information. This will improve transparency and encourage accountants to improve their practices when preparing MFR reports.

• If a licensee is relying on a Deed of Covenant and Assurance, they will need to provide the QBCC with detailed financial information about the covenantor to show they can honour their agreement.

• Similar requirements will be introduced for related entity loans so the QBCC can assess whether these loans will be collectable when due.

Providing Clarity about Calculating a Licensee’s Assets and Revenue

How Will the Changes be Implemented?

• Personal recreational vehicles, such as dirt bikes and golf carts, can no longer be used to meet minimum asset thresholds.

These types of vehicles have limited liquidity and their value is not easy to determine so should not be used to increase a licensee’s asset position.

The reforms will be advanced in phases to expedite financial transparency and give the industry time to adjust.

• It will be clarified as to when money held in a Project Bank Account can be included as a licensee’s asset or revenue:

• Requires larger, higher risk licensees to report decreases in Net Tangible Assets of 20 per cent or more; and

Phase One commenced on 1 January 2019 and: • Re-introduced mandatory annual reporting;

o Both head contractors and subcontractors will be able to include any amount in the general trust account they have a beneficial interest in as an asset.

• Provides clarity about calculating a licensee’s assets, that is, the exclusion of recreational vehicles and when to include Project Bank Account funds.

o Subcontractors will also be able to include retention amounts and disputed funds that are related to them.

Phase Two will implement the remaining reforms to raise the standard of reporting, particularly for larger, high risk licensees. A later commencement for Phase Two on 1 April 2019 will allow the industry to get ready for the changes. This phase will also provide stronger enforcement provisions under the Queensland Building and Construction Commission Act 1991 (the Act).

What Happens if a Licensee Doesn’t Meet the Requirements?

Penalties for not complying with the MFR will be included in the regulation; for example, if a licensee fails to provide financial information annually.

Existing penalties will continue to apply. Under the Act, the QBCC can place conditions on a licence or take steps to suspend or cancel the licence. Penalties also apply for providing false or misleading information or refusing to supply financial information at the QBCC’s request.

The enforcement provisions under the Act are intended to be further strengthened as part of Phase Two, including executive officer liability and escalating penalties, to help ensure all parties involved in running a licensed company are motivated to meet the new MFR.

A Review of 2018

New Security of Payment Provisions Now in Operation

Many plumbers mistakenly think that because the Project Bank Account provisions of the Building Industry Fairness (Security of Payment) Act (BIF Act) do not yet apply to private industry jobs, the new security of payment provisions in the BIF Act do not yet apply. That is not correct and you ignore them at your peril.

What an interesting (and busy) year 2018 was.

Below is a brief recap of items that will affect us all within the industry in 2019.

Plumbing and Drainage Act After years of review and consultation, the Plumbing and Drainage Act 2018 was released in the latter part of 2018, while most provisions of the Act are not in operation until full proclamation. The new Act introduces (amongst other items) the new Mechanical Services and Medical Gas Licenses and a revised “offence” provisions structure for first, second and third offences, which includes fines and/or imprisonment.

The new security of payment provisions came into force on 17 December 2018.

Those of you who came to the McKays workshops last year should have a good understanding of how the new law works but several important changes were made to the legislation after the workshops. You need to understand the impact of these as well.

Plumbing and Drainage Regulation As with the Act, this legislation has also been a long time coming. The new Regulation sets out to combine the old Regulation and Standard Plumbing and Drainage Regulation into one document and is to be released by mid-2019.

Also, it is not long now until Project Bank Accounts commence operation for private industry jobs, so now is the time to learn how they can significantly help your business.

There is expected to be another round of workshops in the New Year. These will help you understand how to use the new Act (including the changes made since the last workshops) to your advantage and protect yourself against the traps lurking in the new Act for the unwary.

Keep your eyes open and come along to one of the workshops.

AS/NZS3500 The 2018 set of 3500 (excluding book 0) was released in 2018 but will not actually come into effect until it is called up in the new Plumbing Code of Australia 2019.

Failed Builders Mean Plumbers Face Liquidators’ “Claw-Back” Claims

The National Construction Code (NCC) Volume Three, Plumbing Code of Australia (PCA) has undergone review (three year review cycle) and will be released 1 May 2019.

NCC Volume Three contains technical requirements for the design and construction for plumbing and drainage systems in new and existing buildings. Volume Three applies to these systems in all classes of buildings whenever plumbing work is carried out.

Dozens of plumbers stand to lose because of the recent failure of a number of big builders.

Not only will outstanding progress claims not be paid but the liquidators will now start to try to “claw-back” payments made to subcontractors in the six months before the company failed.

Non-Conforming Building Products

If you receive a claw-back claim, do not automatically pay up before seeking proper legal advice. You may not be obligated to pay at all. And if you pay when you do not need to, you might put in jeopardy your compliance with the Queensland Building and Construction Committee’s (QBCC) new mandatory financial requirements for QBCC licensees. These came into operation on 1 January 2019.

Introduced in 2017, this legislation is designed to increase accountability for everyone in the building product supply chain, including designers, importers, manufacturers, suppliers and installers, to ensure that all building products are fit for their intended purpose.

The wonderful by-product of this legislation is that Queensland now has “Point of Sale” legislation as plumbing products installed in buildings in Queensland are required to have Watermark certification. Under primary duty of the new laws, it is an offence under the Act to supply plumbing products in Queensland that don’t have Watermark certification as these products do not meet the relevant regulatory provisions. Basically making it illegal to sell non-watermarked products if that product is intended to be installed into a plumbing/drainage system.

In a recent claw-back claim defended by McKays, a Queensland plumber faced a claw back claim of over $650,000. After a bit of a battle, we were able to settle it for $13,000. I could give you other examples but the take away message is, if you receive a clawback claim from a liquidator, get legal advice urgently.

The Australian Apprentice Wage Subsidy

What financial support is available to employers?

The Australian Apprentice Wage Subsidy provides support in the first three years of an Australian apprenticeship as follows: • 75% of the first year award wage • 50% of the second year award wage • 25% of the third year award wage

On 31 October 2018, Senator the Hon Michaelia Cash, Minister for Small and Family Business, Skills and Vocational Education, announced a trial apprentice wage subsidy to support regional and rural businesses.

What is the Australian Apprentice Wage Subsidy trial?

The Australian Apprentice Wage Subsidy trial aims to support apprenticeships in skills need occupations in rural and regional areas and encourage participation in apprenticeships by employers who have not previously engaged apprentices, as well as reengaging employers who may have disengaged from the system.

Who is eligible for the Australian Apprentice Wage Subsidy?

Employers who employ a new Australian apprentice undertaking a full-time Certificate III or IV qualification that leads to an occupation listed on the National Skills Needs List in a rural and regional workplace. The Australian apprentice must be employed under the relevant Award (modern award) for their occupation.

This trial is designed to encourage small businesses to employ an additional apprentice above their normal intake.

The employer must also meet all other eligibility requirements under the Australian Apprenticeships Incentives Program.

Are employers of mature-aged Australian Apprentices eligible?

Employers of mature-aged Australian apprentices may be eligible to attract the subsidy for their employer as long as other eligibility criteria are met.

$7,000 Raised for Charity in 2018 MPAQ are pleased to announce that, with the support of everyone that attended our key events throughout 2018, we were able to raise $7,000 to support the good work of the Prostate Cancer Foundation of Australia.

MPAQ members and event attendees raised money through donations and raffles, which culminated in our final fundraising efforts at the 2018 Melbourne Cup Celebration. The Australian Building Codes Board have released an update to the WMTS-040:2016 waste pipe connection outlet and gratings.

This Technical Specification enables product certification in accordance with the requirements of the Plumbing Code of Australia (PCA) and specifies suitable materials for waste pipe connection outlets and gratings. The WMTAC found WMTS-040 had no materials specified, leaving it open to interpretation.

Inclusion of a Materials section avoids confusion which has allowed unsuitable materials including aluminium to be used as waste pipe connection outlets and gratings, either separate or integral.

Aluminium, while generally durable and reliable, is unsuited to specific applications due to corrosion susceptibility in stagnant, oxygen deprived environments. While tolerant to pH values

between 4 and 8.5, Products such as mortar, cement, concrete, tile glue, grout and bricks can generate highly alkaline solutions up to pH 13. When this solution contacts the aluminium, particularly corners or surface scratches, corrosion can occur.

The WMTAC concludes that aluminium use should be restricted under WMTS-040, particularly where exposed to wet environments.

Over the course of this year the Australian Government has conducted a Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry.

This Royal Commission has drawn the public’s attention and condemnation. As described in the Royal Commissioner’s interim report, the conduct of a number of providers in the financial services industry has fallen short of community standards and expectations in the pursuit of profit.

Superannuation was a key focus for the commission with the conduct of super funds, financial advice and insurance providers investigated.

The Royal Commission revealed unfavourable practices within a number of super funds, namely retail funds usually run by banks and investment companies. The inquiry questioned their conduct and highlighted that these funds were failing to act in the best interests of their members.

To determine the answer to this question you need to look at your super and a range of factors such as the type of fund you are with, the fees and charges on your account and the insurance included in your super.

There are many types of super funds, with two of the most common types being retail and industry funds.

Although there are several differences between super funds, some key points of difference to consider when looking at your super are: ‘For profit’ vs ‘not for profit’ funds – Some funds, for example retail funds, are ‘for profit’, aiming to make and retain profits and often paying a portion of this profit to shareholders. Brisbane Plumbers Help to Get Henry Home for Christmas

Henry is three years old, and he was left paralysed and on a ventilator after contracting a virus that has destroyed his tiny little body.

Henry and his family have had to move from west of Rockhampton to Brisbane so that he is close to a hospital, but his new house wasn’t wheelchair accessible. So Triple M rallied the troops and together hundreds of tradies, suppliers and businesses renovated Henry’s home in time for Christmas.

MPAQ Member Jetset Plumbing were one of the many trade businesses that donated their time to help Henry out.

“After Triple M put the call out for any tradies who could lend a hand to renovate their family home, we couldn’t not offer our services. In joined forces with a lot of other tradesmen and women, we were able to complete the renos in two weeks. Then on Tuesday 3 December we all came together one last time to welcome Henry home,” Jetset Plumbing said.

“At Jetset Plumbing we want to offer people not only quality workmanship but also quality of life.”

Another MPAQ member involved was Superior Plumbing Brisbane who helped out with the bathroom renovations. They told us that “it was great to be involved in the project and see the energy of all guys giving their time for free, and to see little Henry rock up home was the kicker!”

2019 Rheem Apprentice Plumber Grants Announced We all know apprentices can find it hard to make ends meet financially, so for the seventh year running, Rheem Australia is stepping in to give apprentice plumbers a financial boost. Rheem will help 10 worthy recipients start or continue a plumbing apprenticeship by providing $30,000 in total grants as part of the 2019 Rheem Apprentice Plumber Grants program.

Queensland plumber Eilish Grundon, a 2018 Rheem Apprentice Plumber Grants recipient, says, “Receiving the Rheem Grant has honestly changed my life for the better! [It] has given me the opportunity to complete my solar and hot water endorsement and given me the opportunity to enrol and pay for my Backflow and TMV courses, and these two endorsements put me even further in front in my career, which otherwise would’ve taken me months to save for. It’s safe to say I am so thankful for receiving the Rheem Grant in 2018!”

Rheem Australia’s Chief Operating Officer, Chris Taylor, says the Grants program is a way for the company to give back to the industry that has supported Rheem since the 1930s.

“Rheem has a long legacy in the plumbing industry, and we’re passionate about giving back and supporting that community,” he said. “Feedback from apprentices and employers shows that the financial strain can impact an apprentice’s career, so we aim JANUARY / FEBRUARY 2019

to lighten that burden with the Grants. That’s why in 2019 we’ll again be providing our 10 recipients with $2,000 to go towards TAFE/RTO fees and text books, plus a $1,000 tool voucher.”

In 2018, the 10 grant recipients included males and females from a variety of locations and backgrounds, including Eilish Grundon two former soldiers, a 2018 Grants recipient for QLD young man supporting his terminally-ill mother, and a sci-fi novelist - all of whom share a desire to become part of the next generation of plumbers.

Applications for the 2019 Rheem Apprentice Plumber Grants open on Monday 4 February 2019 and close on Monday 1 April 2019.

Apprentices can nominate themselves or their employer can nominate them on their behalf.

11 Strategies to Prevent Workplace Heat Stress Working in the plumbing and gas industry often includes working under hot conditions, especially in Queensland. There are 11 actionable steps that workers, business owners, safety professionals and managers can follow to minimise and manage productivity-sapping and potentially dangerous heat stress.

Cooling

Crushed ice ingestion acts as a heat sink in the body and is a proven method to effectively lower core body temperatures, providing improved performance in the heat and likely leading to increased worker productivity.

PPE-free areas should be available on site to enable workers to better cool off on a break or as required, while the provision of cooling vests for workers on the job has been proven to be a highly effective method of minimising heat stress. Adequate airflow on site is also critical, with the use of cooling fans significantly helping evaporative cooling, the primary function of sweating.

Heat Tolerance/Acclimatisation and Fitness

As a minimum, workers should be supplied with a bottle of water or electrolyte drink before their shift, consume this and fill up their bottle for further consumption. Water or electrolyte drink bottle refilling stations should be made available for easy access during shifts. Pre-shift and post-shift hydration testing is also recommended.

With exposure and time the human body has the capacity to improve tolerance to hot and humid conditions.

Regular physical activity that results in high sweat rates can improve heat tolerance and make the transition to a hot workplace less stressful.

The harder you work the more body heat you produce.

Work rates need to match individual workers by allowing them to self-pace and adjust their workload based upon how they are feeling.

A loss of appetite is common in the heat; however, six to eight hours without food is considered the limit when high sweat rates are encountered.

Sleep is a major component of post-shift recovery and quality uninterrupted sleep in a cool environment is important.

Environmental Monitoring

Training workers to recognise the signs and symptoms that a heat affected co-worker will exhibit and teaching procedures to manage that heat stress is essential. Topics should include lifestyle factors that contribute to heat tolerance/acclimatisation.

There are a range of indices to assess heat stress risk based on climatic conditions; however, it is unrealistic to expect a single measure to mitigate workplace heat stress.

Any environmental monitoring should be part of an over-arching heat stress management policy.

Analysis of the skin and core body temperatures in response to working in the heat, combined with pre and post-shift hydration monitoring through the analysis of urine samples, along with the evaluation of body mass change can assist workers in fine tuning their hydration to match requirements.

A policy detailing the responsibilities of personnel, team leaders, planners, schedulers and senior management to prevent and manage heat stress in staff is an essential document for organisations that operate in hot conditions.

Industry Development Training Calendar Industry Development Training Calendar January to July 2019 Release The Industry Development Training (IDT) Calendar (Schedule) is produced for the benefit of the Services Trades Industry and identifies courses that will assist students to develop or broaden their careers in the Plumbing and Fire Protection Industry.

The Service Trades College (STC) is pleased to release their Industry Development Training Schedule to the end of July 2019. The schedule is also available on their website (www.tstca.com.au\training calendar).

The STC have leveraged their close relationships with BERT Training Fund (BTF) and Services Trades Queensland (STQ) to obtain funding that ensures they offer you courses at the lowest possible prices. Subject to meeting certain criteria, you may even be eligible for FREE training! Best of all, they take care of all the paperwork. All courses and providers are offered on the basis that learners must satisfy themselves as to the course suitability for their individual needs.

The workplace is changing at an ever-increasing pace and employers actively seek tradespeople who have taken advantage of training to maintain existing and develop new skills. The Service Trades College’s training courses do just that!

The courses within their program are accredited and industry-recognised. They are delivered by some of the best, award-winning trainers in the business. The STC does not conduct the training and does not charge either the learner or the RTO a fee for the IDT services they provide.

RTOs identified in this schedule are an indication only of known providers who regularly provide the training and may not be the final provider applicants are enrolled with.

Where the student is required to contribute some or all the fees, they will not be required to pay more than $1,500 in advance (initial payment).

2018 Ambassadors In early 2018, MPAQ put out the call for volunteers to help us spread awareness of the plumbing and gas industry, to engage, educate and share industry experiences with future potential apprentices.

MPAQ elected two ambassadors at our World Plumbing Day Celebrations in March 2018, David Keys from Obsidian Plumbing, a licensed plumber, and Sarah Condie from the Tradettes, a female plumbing apprentice.

David and Sarah provided apprenticeship information and corresponded with future apprentices at multiple events throughout the year, including school career expos, careers and employment expos and tertiary studies events.

Q. Do you feel you have achieved what you wanted from being appointed in this role?

A. Yes, I believe I changed the mindset of the people I engaged with during our time at the schools and expos and what they thought plumbing was all about. The main message I got across is that the trade is not all about unblocking toilets. But don’t get me wrong though, I did make sure I told them that the trade will make you stop chewing your finger nails!

Q. Having been out there speaking to a lot of young people, have you seen a lot of interest from them towards the plumbing industry?

A: Yes, we received a lot more interest than I expected. To my surprise there was a lot of young women that were interested and wanted to know how to get an apprenticeship. I think it’s great for our industry that more women are getting involved and that it’s not just predominantly a man’s profession anymore. I believe we will have no problem with skill shortages with the

amount of young and old that’s out there wanting an apprenticeship. Where I found the gap was that schools are not getting involved or providing a work experience program or helping students to find school based apprenticeships within our industry.

Q. What did you find the most rewarding about your Ambassadorship, and what did you find the hardest?

A: The most rewarding part was giving back to the industry that has given me so much over the last 12 years in my career.

Just telling the young kids my story and that the trade can take you all over the world, as Australia is the benchmark for the Hydraulic and Gas industries, was rewarding in itself. The hardest part was trying to make sure we always had enough freebies to hand out (everyone loved the shower timers and mini plungers!).

Q. In regards to teaching young people about the industry, what is it that you like most about being a part of it?

A: The public’s perception of our trade is that it’s dirty and all we do is fix toilets and unblock sewer drains. The thing that attracted me to the trade is that it can lead you down so many different career paths. As a Project Manager, I am now part of the corporate world of business and technology. Never would I have thought during my apprenticeship that I would one day wear a dress shirt to work while negotiating and managing multimillion dollar projects both within Australia and internationally.

Q. Did you learn anything new from being MPAQ’s Plumbing Ambassador?

A: I learnt a lot about MPAQ and what their role is in our industry and the great effort they are putting in to grow it.

Q. What advice would you give to anyone who is thinking about, or just beginning, a career in the plumbing industry?

A: Just stick with it! If construction or maintenance is not your thing, you can always go into design. Our industry pays you to learn, try going to a university and ask them if they will pay you to learn!

Q. In regards to teaching young people about the industry, what is it that you like most about being a part of it?

A: By far my favourite part would be knowing that I CAN teach young people, have done so and will continue to make a difference in the plumbing industry. I’m grateful I’ve been given the opportunity to stand by people who have been in the industry for years and learn from them.

Q. What did you find the most rewarding about your Ambassadorship, and what did you find the hardest?

A: The most rewarding part was having the opportunity to go out and provide young men and women with my insight, knowledge and support, and being able to interact and learn from knowledgeable people in the industry/ MPAQ. The more challenging side would have to be answering some of the weird, thoughtful and wonderful questions students and parents had. I’m glad I learnt a fair bit on the ins and outs of the plumbing industry prior to taking on this role, otherwise it would’ve been a lot harder to provide educational answers.

Q. Did you learn anything new from being MPAQ’s Plumbing Ambassador?

A: I learnt a lot. I was able to learn and improve on my public speaking most of all. Being the apprentice plumbing ambassador I was able to spend time with several people I consider very supportive and inspirational and have taught me a lot, including Carlie Low, David Keys and Penny Cornah.

Q. Moving forward, what goals do you wish to achieve?

A: I hope to have some part in a support system focusing on educating apprentices on their rights, the industry and providing/exchanging advice if needed. From my experience, getting into a trade was like being thrown in the deep end. I knew nothing. I didn’t know where to obtain any answers, get explanations on things I didn’t know I needed to know and didn’t want to ask too many questions.

Q. What are the main challenges you have faced working within the industry over your career so far?

A: I have experienced a fair few struggles and challenges during my short time in the industry. I tend to push myself to learn more than is expected of me.

I demand responsibility so I can prove myself, mostly to myself. My biggest challenge has been learning to step back and accept my mistakes without judgement. It can be a stressful industry and I plan on avoiding unnecessary stress!

Dogs can help improve your mental health Did you know that people who experience depression, are socially isolated, or do not have good social support have a higher chance of developing heart disease?

Depression can also be common in patients with heart disease.

The Heart Foundation resource Depression in Patients with Coronary Heart Disease shows 15% of patients experiencing heart attack or heart surgery (bypass) will have a major depressive disorder. When you also consider milder forms of depression, this figure increases to 40%. Your close friends and family will be an important support at this time, but pets may also have a role to play that’s where dogs come in.

If you’re concerned about your mental health, it is important to speak with your doctor and get help with managing emotional stress.

Dogs can help reduce stress and blood pressure Did you know ongoing stress can increase your risk of developing heart disease?

Studies have shown that walking with your dog can have a calming effect and can help reduce the physical signs of stress, including lowering your blood pressure.

A 2017 study of more than three million people in Sweden, aged between 40 and 80, showed that owning a dog could be linked to a lower risk of developing heart disease. The study tracked the health of dog owners for 12 years and found that, among people

who lived alone, having a dog may decrease their risk of cardiovascularrelated death by 36%. The chances of having a heart attack were 11% lower.

It’s important to note the limitations of this study. The researchers could not identify how or why the ownership of a dog led to positive health outcomes and could not rule out other factors that may have contributed to the study’s findings.

Get active There can be many contributing factors to developing heart disease. To find out more about how your lifestyle could be impacting on your health, the Heart Foundation recommends you speak with your doctor about having a heart health check, especially if you’re over 45 years old (35 years and older for Aboriginal and Torres Strait Islander peoples).

Optus Stadium A Billion Dollar Gateway to the World’s Most Isolated City Opened in early 2018, the circa $1 billion Optus Stadium in Western Australia has transformed the scenic Burswood Peninsula into a world-class sporting and entertainment destination. The multipurpose venue has a capacity of 60,000, making it the third-largest stadium in Australia (after Sydney’s Stadium Australia and the Melbourne Cricket Ground).

Designed, built, financed and managed by the Westadium Consortium, Optus Stadium accommodates cricket, soccer (football), rugby union and league, and Australian Football League and will be capable of hosting major sporting events including Commonwealth Games and international athletics.

Over 15,000 light-emitting diodes are installed across the Stadium Park, making it the biggest LED sports lighting installation in the world.

Vale: Neil Victorsen Retired Plumbing TAFE Teacher 13 April 1934 – 12 October 2018

The plumbing industry has lost a good servant Written by Bruce Wallace, MPAQ Historian

After completing his education at Coorparoo State School and State Commercial High, Neil secured a plumbing apprenticeship with MPAQ member, Mort Nelson, at Stones Corner. This was interrupted by being conscripted into the National Service.

In 1956 Neil commenced his own business and continued until 1967 when he decided to become a TAFE teacher. He served at Eagle Farm, Townsville, Technical Correspondence, Mt Gravatt and Yeronga Colleges till his retirement in 1994.

I first met Neil when he played cricket at Easts with my father. Later in the 1980s we crossed paths again when I became involved in training matters with the Association. He was very supportive of our endeavors to reintroduce gas fitting into our apprenticeship curriculum.

It was in 1988 we were able to witness Neil’s excellent organisational ability when he was appointed Chief Judge of Plumbing in the Work Skills Australia Brisbane Region competition held at the RNA Showgrounds. He fulfilled that role again in 1990 when it was held at the Yeronga Institute of TAFE. Prior to both competitions, Neil conducted “brush up” sessions after hours for competitors to maximise their chances. His articulate attention to detail enabled the competitions to run smoothly and fairly. Neil was disappointed to forego the 1992 competition due to leave that was already booked. His place was capably filled by Allan Perry, head of plumbing at Yeronga TAFE. Outside of work Neil was active in the Masonic Lodge and the National Servicemen’s Association of Australia.

Besides his love of fishing, he was a dedicated family man with his son, Russell, and grandsons carrying on in the plumbing trade. The Association extends its deepest sympathies to his wife Beverly and all of the family who should be proud of Neil’s contribution to the education of our trade.
