It feels like this year has just begun, but here we are, wishing you all the best for Christmas and the new year. We have listened to our members’ feedback and there is undeniable support to change the way the plumbing industry is administered in Queensland. As the peak industry association Kent Vickers, President for plumbing and gas in Queensland, we will commit to continuing to champion and advocate for the interests of our members and the industry. In the coming months, we will release our priorities document that outlines the key focus areas for the plumbing and gas industry, and we will be reaching out to all political parties, urging them to consider and commit to our industry’s key priorities in the upcoming October 2024 elections. This year there was a major project rolled out by the team at MPAQ. We now have an online safety system available, MPAQ Safety, which has been specifically designed for plumbers and gas fitters. It is free to contracting members. It has been well accepted by all and has attracted some new members. I would ask you all to tell your fellow plumbers and gas fitters to join the association to receive the free benefit of the safety system as part of their membership. The twenty-third Plumbing and Gas Industry Awards was held on 6 October and the bar was raised to another level again this year. I would like to congratulate all the finalists and, especially, the winners. I would like to call out one winner in particular, Kirsty Train from Grace Gas Fitting Pty Ltd, as the Tradesperson of the Year. Congratulations to Kirsty for her excellent nomination and for the amazing work she does in a male-dominated industry. This year, a new award category was launched, and I was delighted to award the first-ever MPAQ President’s Award to Mr John Salmon from Salmon Plumbing Services. John has been in the industry for over 30 years and is one of the stalwarts of the Queensland plumbing and gas industry. John has contributed so much to the trade and is a fitting winner of the inaugural President’s Award. As this is the last article for the year, I must thank two groups of extraordinary people who make it possible for MPAQ to represent our members at all levels of government. Firstly, without the support of our sponsors, the events that are organised and executed so magnificently throughout the year would not be possible. Thank you to all our sponsors who come back year after year and support our members. The second group is the team at MPAQ. Most of our members would not understand the amount of work and representation they deliver, day after day, to make our plumbing association the best and largest in the country. PERSPECTIVE The team at MPAQ has experienced a period of high activity in recent months, and I wanted to take this opportunity to provide you with an update on all the advocacy activities that the team has been involved in.

Work Well Awards 2023 MPAQ was recently honoured as a finalist during the Work Well Awards Ceremony 2023, recognising Penny Cornah, Executive Director exceptional contributions to work health, safety, and successful returnto-work initiatives. Collaborating with CC Group and Beavis and Bartels Group, MPAQ identified the imperative need to enhance safety within their workforces. This initiative, supported by WorkCover Queensland, concentrated on reducing musculoskeletal injuries among plumbers in the construction industry. Acknowledgments go out to Leanne Loch from Back on Track, who orchestrated site visits and engaged workers across various levels. Back on Track devised a series of ‘Own safety onsite’ toolbox talks and resources to empower plumbers in taking charge of their health and wellness. We extend our gratitude for the acknowledgment as a finalist in this awards ceremony, with heartfelt appreciation to Sharon Stratford from WorkCover for her dedicated efforts on this project.

MATES in Construction In October, I had the opportunity to attend the MATES in Construction QLD & NT luncheon, marking 15 years of MATES’ commitment to diminishing suicide rates within our industry. The MATES annual lunch stands as a pivotal fundraising event supporting MATES in its ongoing mission to aid construction workers in Queensland and the Northern Territory. Congratulations to Nick Thompson, CEO of MATES in Construction, for organising a remarkable day.

Unfair Contract Terms As of 9 November 2023, Australia’s approach to unfair contract terms has undergone a significant transformation. This includes the extension of the unfair contract terms regulations to encompass small businesses with fewer than 100 employees or a turnover below $10 million. Additionally, new civil penalty provisions will be in place for instances of non-compliance. Under these amendments, it will be deemed illegal to include or depend on an unfair term in contracts covered by the law. Details around the changes are available on the MPAQ website: www.mpaq.com.au.

Diploma of Hydraulic Services Design MPAQ is aware that the Diploma of Hydraulic Services Design is currently unavailable, and this has raised significant concerns within the industry.​This course is a licensed requirement from QBCC, and licensees must hold this qualification to comply with the law and failure to do so could have severe consequences.​The Association of Hydraulic Services Consultants Australia (AHSCA) Qld Chapter has engaged in discussions with MPAQ on this matter, and both parties agree that it is a significant issue for our members. To gather further insights, we conducted a survey among industry professionals, and 162 responses were received. Based on the feedback MPAQ has been working with the Department of Youth Justice, Employment and Small Business and Training, the Department of Energy and Public Works, QBCC, TAFE QLD, and TAFE NSW to come up with solutions.

Recently, I attended the Ministerial Roundtable event, joining the Minister for Energy, Renewables and Hydrogen and Minister for Public Works and Procurement, the Hon. Mick de Brenni MP and the Federal Minister for Energy and Climate Change, the Hon. Chris Bowen MP. This roundtable provided ongoing engagement and insights for the Queensland Government as they continue to roll out the Queensland Energy and Jobs Plan. This meeting provided an opportunity to hear from MPAQ and other stakeholders on those aspects of the transition in which Queensland is doing well and where future efforts could be focused – particularly in partnership with the Commonwealth. The Queensland Government was provided feedback on what Queensland is doing well in the transition. Queensland has a strong pipeline of projects, their planning processes are four to five times faster than New South Wales, and their levels of engagement with stakeholders are really strong. Exploring the Plumbing and Heating Engineering Landscape in the UK A Meeting with the Chartered Institute between August 2022 and July 2023 only 21,920 were installed during that period. To encourage adoption, the government has increased its funding incentives (on 23 October) from £5,000 to £7,500, while the usual installation cost ranges from £13,000 to £15,000. Much depends on the thermal efficiency of the property and whether existing pipework and radiators need to be replaced. 5. Licensing: Interestingly, while no licence is required to be a plumber or drainlayer in the UK, a licence is mandatory for gasfitters. It’s not surprising that the UK and Australia face similar challenges in certain areas, especially when it comes to global issues like skills shortages, climate change, and the transition to net zero emissions. Australia, the UK, and numerous countries globally are grappling with skills shortages. These deficits have arisen from a combination of factors, including an aging workforce, evolving industry requirements, and reduced migration due to the impacts of COVID-19. Achieving net-zero emissions is a global goal to combat climate change. Both the UK and Australia have made commitments to reduce their carbon emissions and transition to clean energy sources. This involves policy changes, investments in renewable energy infrastructure, and efforts to reduce reliance on fossil fuels. I was surprised to learn that the UK doesn’t have a licensing system for plumbers and drainers, and this highlights the fortunate situation in Australia.

In September, I embarked on a three-week personal holiday that led me to the bustling streets of London, where I had the privilege of meeting with Kevin Wellman, the CEO of the Chartered Institute of Plumbing and Heating Engineering. The purpose of our meeting was to gain insights into the challenges, initiatives, and membership details of this esteemed institution operating in the United Kingdom.

Challenges During our conversation, Kevin Wellman shed light on several challenges facing the plumbing and heating industry in the UK: 1. Skill Shortages: One of the primary concerns is the shortage of skilled professionals across the country, posing a significant challenge for the industry. 2. Water and Sewage Issues: The water and sewage sector in the UK has faced its share of problems, partly due to the privatisation of water companies back in 1989. This has led to issues such as poor management of services and delays in fixing water main leaks. 3. Transition to Net Zero: As the world grapples with environmental issues, the UK is no exception. The transition to a net-zero carbon footprint is a top priority, and the plumbing and heating industry is actively involved in this effort. The UK government is pushing hard for the installation of heat pumps and continues to explore the effectiveness and safety of hydrogen. A recently proposed hydrogen trial in a town called Whitby in the north-west of England was abandoned after public protests rallied against hydrogen in their homes. 4. Heat Pump Installations: The UK is looking to install a staggering 600,000 heat pumps each year by 2028 as part of its green energy initiatives. However, according to the Energy & Utilities Alliance (EUA),

Here are some key details regarding the Chartered Institute of Plumbing and Heating Engineering’s membership: • The institute boasts a membership of 7,500 individuals, with 2,000 members based in Hong Kong. • It produces a quarterly magazine, aimed at fostering industry knowledge and addressing challenges. • There are approximately 5,000 to 6,000 qualified installers for heat pumps, a vital part of the green energy initiative. • Membership is available at various levels, including a trainee/apprentice membership. • All members are required to sign a code of professional standards, ensuring the highest levels of ethics and conduct. • Members and individuals must commit to 30 hours of Continuing Professional Development (CPD) annually to maintain their membership. • The institute offers a comprehensive learning academy with a wide range of training programs to enhance the skills of its members. • A positive membership recruitment campaign is anticipating membership growth in the years ahead. • With a dedicated team of 12 staff members, some working part-time, the institute efficiently manages its operations. • As a token of their hospitality, the Chartered Institute of Plumbing and Heating Engineering provided us with a copy of their history book, a gesture greatly appreciated, especially since MPAQ is currently in the process of creating a similar historical record. The meeting with Kevin Wellman and the insights gained from the Chartered Institute of Plumbing and Heating Engineering underscore the challenges and opportunities within the UK’s plumbing and heating industry. As the country strives to address issues like skill shortages and transition to sustainable energy solutions, organisations like this Institute play a crucial role in shaping the industry’s future. NEW REQUIREMENTS FOR THE GRADING OF FLOORS TO FLOOR WASTES With the commencement of the NCC 2022 on 1 May 2023, the requirements for floors to be graded to floor wastes have been amended. The new requirements aim to reduce water overflow from showers and other wet areas when a floor waste is installed. The requirements apply: • where a floor waste is installed because of a mandatory requirement (e.g. showers); • in other wet areas not required under the NCC (e.g. laundries and bathrooms). Before the commencement of the NCC 2022, the requirement to grade floors in wet areas only applied where floor wastes were installed because of a mandatory requirement.

Floor Waste Requirements

Under the NCC 2022, floor waste requirements apply in areas of a building: • a part of a floor that provides drainage for a shower area; • a room containing a urinal; • where a bathroom or laundry is located at any level above a soleoccupancy unit, or public space in a Class 2 or 3 building or Class 4 part of a building. When installing a floor waste in a wet area, the graded floor surface will affect some design aspects for the installation of fittings and fixtures. Installers may need to consider the: • ability to use raised thresholds or the ramping of tiles at bathroom doorways to achieve the necessary fall; • use of linear grates to facilitate large tiles and avoid additional cuts to floor tiles around the floor waste; • use of bedding under toilet pans; • use of adjustable feet and sealant at the base of freestanding bathtubs; • potential to move the location of a proposed floor waste to suit the type of floor finish and the type of proposed floor waste.

It is recommended that the property owner be consulted if it is proposed not to install a floor waste.

Floor Wastes and Floor Waste Gullies

The purpose of a floor waste gully is to provide a means for a floor waste to be connected to the sanitary plumbing or drainage while allowing the floor waste gully water seal to prevent sewer odours and gases entering a room. A floor waste can also be used to connect other waste fittings such as a basin, bath, or shower to the sanitary plumbing or drainage. These connections are not mandatory and the same waste fixtures can be connected directly to the sanitary plumbing or drainage without using a floor waste.

Requirements for Grading Floors to Floor Wastes

The NCC 2022 requires that where a floor waste is installed, both: a. the minimum continuous fall of a floor plane to the waste must be 1:80; b. the maximum continuous fall of a floor plane to the waste must be 1:50. These requirements apply regardless of whether the floor waste installation is required under the NCC 2022, or if the floor waste is installed voluntarily. The new Queensland Development Code Mandatory Part 4.5 – Livable dwellings and grading to floor waste (QDC 4.5) provides additional compliance solutions to those in NCC 2022 for the grading of floors to floor wastes. Voluntary Installations

Floor wastes are regularly installed in wet areas even where it is not a requirement in the NCC 2022. For example, in a house, a floor waste installed in the main floor area outside of a shower recess in a bathroom or in a laundry in a house is considered a voluntary installation. Most homeowners would expect to see a floor waste installed in a wet area. To enable the homeowner to make an informed decision about the installation of a floor waste, it is important for the builder and plumber to discuss the requirements in the NCC 2022 for floor wastes to be installed in a wet area.

MPAQ FREQUENTLY ASKED QUESTIONS Q: When permanently removing a garbage disposal and reinstalling the waste pipe work, would this be Notifiable Work? A: According to QBCC, no. Removing the disposal would be ‘removing an apparatus’, and restoring the waste pipes would considered to be ‘maintaining or repairing a fitting or fixture’. This wouldn’t be considered any higher risk than replacing a fixture, which is considered minor work.

UNSAFE GAS PURGING INJURED AND BURNED FOUR WORKERS Four workers sustained burns when LP gas, that had been released inside a plant room, ignited. The incident occurred at a factory under construction with the capacity of the consumer piping being in excess of 3,000 L, which required purging. Initial investigations have identified that persons working under a Gas Work Authorisation to install and commission a Type B boiler released a significant amount of LP gas into a plant room. The gas was released during purging activities during the commissioning. The accumulation of unburnt gas went unnoticed and ignited when an Oxy/LPG welding torch was used resulting in a flash-over fire, injuring the four workers. The Petroleum & Gas Inspectorate has noted the following issues that led to the incident: the release of unburnt gas inside a building or poorly ventilated area creates a significant risk; the gas system was not purged in accordance with a safe ‘purge procedure’; the large volume of consumer piping was not being purged to the outside atmosphere; the unsafe purge process allowed the accumulation of unburnt gas within the boiler room. The Inspectorate recommends that Gas Work Licence/Authorisation holders should ensure they are familiar with the principles of purging and should undertake refresher training if they are not confident in purging methods. They must only conduct gas work in accordance with their licence or authorisation. Large volumes of gas should always be purged to well-ventilated outdoor areas that are free of sources of ignition. MANAGING HAZARDOUS MANUAL TASKS ONSITE WorkCover Queensland is investing in the construction industry’s injury risk reduction, with its recent collaboration with Master Plumbers’ Association of Queensland (MPAQ). As part of its Injury Risk Reduction Initiatives program, WorkCover funded a project to reduce the risk of musculoskeletal injuries sustained by plumbers. The initiative focused on robust risk controls, including consultative work design and development of engineering solutions. WorkCover and MPAQ worked with industry employers CC Group and Beavis and Bartels Group, as well as occupational health physiotherapists to identify specific concerns regarding hazardous manual tasks and musculoskeletal injuries. The initiative aimed to promote appropriate control measures and materials to educate workers on how to apply a risk assessment approach to hazardous manual tasks onsite. A series of “own safety onsite” toolbox talks and materials were then developed to help plumbers take ownership of their health and wellbeing by using a hierarchical approach to hazard control onsite. This included using and promoting higher order controls, such as lifting aids and engineering controls, to reduce the manual task risk to workers. Lower order controls, such as technique-based lifting advice, team lifting protocols, and prestart warm-ups, were also included where higher order controls were not practicable. The hot topic the plumbing world is talking about

Amid a global push to eliminate lead from drinking water, the Australian Building Codes Board (ABCB) has decided to limit the allowable lead content in certain plumbing products. The 2022 National Construction Code (NCC) Vol 3, Plumbing Code of Australia (PCA) introduces a new 0.25% limit for the allowable level of lead in plumbing products used for drinking water. From 1 May 2026, copper alloy plumbing products containing more than 0.25% lead, on a weighted average basis, will no longer be authorised for installation in a plumbing system used to convey drinking water. This is a move that has the strong support of the International Association of Plumbing and Mechanical Officials (IAPMO) and leading stakeholders in the Australian plumbing industry.

Transition Period The new lead-free requirements will become mandatory beginning May 2026. During the transition period, which commenced in May 2023, products may be WaterMark Lead Free (WMLF) certified and supplied to the market with the WMLF trademark. This means products certified to the non-lead-free requirements will remain authorised for installation during the transition period.

Lead is Toxic There is an ever-growing catalogue of scientific research and data that demonstrates a causal link between lead in drinking water and its irreversible detrimental impacts on human neurological and cognitive development. Lead is a cumulative toxicant, and no blood lead level is considered safe. Once lead enters the blood, it is distributed to the organs such as the brain, kidneys, liver, and bones. The health impacts of lead are most profound in pregnant women and children under four. Irreversible health consequences include cognitive impairment, behavioural changes, anaemia, hypertension, renal impairment, immunotoxicity, and toxicity to reproductive organs. The most common source of lead in drinking water is lead leaching from plumbing products, either within the premises or upstream of the meter since the use of lead (Pb) in the manufacture of plumbing products has been common practice for generations. Lead is mostly found in copper alloys and can be present in fittings, valves, taps, mixers, appliances, water heaters, and dispensers.

Compliance with the NCC Requirements All plumbing products that contain copper alloy and are intended for use in contact with drinking water that are listed in the ABCB WaterMark Schedule of Products that are identified as “Lead-Free Applies” must be WaterMark certified as being “Lead-Free” when assessed in accordance with NSF/ANSI/CAN 372 “Drinking Water System Components – Lead Content”. IAPMO, as an accredited WaterMark Conformity Assessment Body (WMCAB), will review technical information such as drawings, bills of materials (BOMs), material composition, wetted surface areas, and test reports to verify compliance with the lead-free standard. This is in addition to previous WaterMark certification requirements such as dezincification resistance, AS/NZS4020, and the performance requirements outlined in the product

standard. As per the WaterMark Scheme Rules, all lead-free testing must be undertaken by an accredited laboratory. Whilst Clause (a) of A5G4 indicates that compliance can be verified by an accredited NSF/ANSI/CAN 372 test report, this only applies to plumbing products listed on the WaterMark Schedule of Excluded Products (WMSEP) that are identified as requiring NSF/ANSI/CAN 372 as “Evidence of Suitability”. These are products that do not require WaterMark certification but are still connected to a drinking water supply, for example, refrigerators with water/ice dispensing, built-in domestic coffee machines, and domestic steam ovens. In addition to the initial lead-free assessments, ongoing surveillance of the manufacturing locations has been mandated. Factory inspections review the manufacturer’s processes – for example, inwards goods QA checks, design control, lead-free specific processes, and batch release testing program are being undertaken. The certification and surveillance procedures ensure that practitioners can have confidence that the products that carry the Lead-Free WaterMark have been assessed and monitored appropriately.

IAPMO

From 1 May 2026, only lead-free versions of identified products will be authorised for use in plumbing systems used to convey drinking water. From this date, consumers, plumbing practitioners, and regulators will need to look for the Lead-Free WaterMark to ensure the product being purchased or installed is authorised for use. International Association of Plumbing and Mechanical Officials Research and Testing (IAPMO R&T), North America’s premier plumbing product certification body, has been assessing and granting lead-free certification for more than a decade. Eliminating lead from plumbing products is vital, achievable, and urgent, with action required now if we are to meet the 2026 deadline. AHSCA Queensland Hydraulic Consultancy Design of the Year Winner: You Foodz, Tru-Flow Services Pty Ltd and BRW Hydraulics In a landmark collaboration, BRW Hydraulic Consultants and Tru-Flow Services united their expertise to realise a pioneering project–a facility previously unconstructed in Australia. Tasked with the hydraulic design, commission, and installation, the joint effort faced a distinctive challenge owing to the water’s pH and temperature upon discharge from the facility. To surmount this, a concerted venture was undertaken to devise a system capable of accommodating these exceptional parameters. Described as a truly one-of-a-kind endeavour, the project posed numerous challenges during its phases of design, construction, and commissioning. MM Kembla Outstanding Copper Plumbing & Gas Project of the Year Winner: Logan Hospital, Beavis & Bartels Beavis and Bartels were entrusted by the Queensland Government with an ongoing and substantial commercial enhancement project at the existing Logan Hospital Precinct. A labyrinth of copper pipework and fittings, spanning kilometres, was skilfully incorporated by Beavis and Bartels to address the intricate hydraulic and gas needs of the project. Mates Supporting Mates

There is no doubt that open conversations around mental health are more widely supported now, both at work and in our communities, than they were 10 years ago. While we still have a way to go, our openness towards the challenges we or our mates may be facing has vastly improved. Ultimately, stigma reduction is driven by people and companies who are motivated to support workers in all aspects of safety – including mental health.

Mental Health Training is WHS Training Mental health issues are work health and safety issues. A worker who may be in mental and emotional distress may find it difficult to do their work properly, which can then lead to risks and hazards in the workplace. This is why MATES in Construction has always been an advocate of mental health training as essential WHS training in the workplace. Since MATES started in 2008, the organisation has made it its focus to provide training around reaching out to your mates when you think they need help or putting your hand up yourself when you think you are not okay. Reaching out and connecting to the proper resources – these are crucial when dealing with mental health issues. MATES General Awareness Training (GAT) is the first step in building a better understanding of how to recognise and what to do when your coworker, friend, or family member might not be in a great space. MATES can come to your workplace to deliver this training to your staff so that your whole team may be better equipped to spot and handle mental health concerns.

Becoming a Connector A level up to this general training is the Connector training. Many tradespeople find that after taking the GAT, they are compelled to undergo additional training to be able to help out their peers better. Think of it as necessary First Aid training, where you can learn how to respond when a colleague is in need of support.


WORK HEALTH & SAFETY Rhys from Tacoma Plumbing in North Queensland has been in the industry for 15 years and has worked on a number of projects around the country. He believes in the importance of conversations around mental health. “I started my plumbing apprenticeship in 2008 and have since worked on many projects: fly-in fly-out jobs like the Olympic dam mine upgrade in South Australia, Cavil Ridge mine in Queensland, and many inner city Brisbane jobs such as the Queens Wharf. During my time on construction sites, I have had the pleasure of communicating with my mates, lending support when they come to me, and giving helpful talks on site. I’ve done my initial MATES training and am currently enrolled to partake in my Connectors course later this year,” said Rhys. MATES Connector Training is a four-hour training session that delves deeper into understanding the signs when a mate might not be in the best place, how to safely and effectively have a conversation with them, and how to connect them to the right resources for additional help. A Connector is not a counsellor or any other kind of professional; they are simply a mate who knows how to help. Most people participating in Connector training have naturally been in the role without even knowing it. The Connector training also provides extra skills for people to handle suicidal thoughts and then facilitate the link to help. “I unfortunately know many men who suffer from mental fatigue and depression due to stresses at home, especially over Christmas and Easter. Generally, I find it’s due to money or not being able to spend time with their kids if they have been divorced, so it’s great that organisations such as MATES and D.A.D.S are around supporting men through these tough times,” said Rhys. “We all spend the majority of our time with our work comrades and I feel it should be up to each of us, if we see them with their head down, to try and have a conversation with them and let them know that they’re not alone. I feel moving forward that we need to be able to open up to each other even while on the tools so that you don’t bottle it up and snap. It takes two minutes to lend a sympathetic ear and a slap on the back – and that could be the difference between a bad day and a good day,” added Rhys. D E L T T E S UN S T B DE A GUIDE FOR CONTRACTORS FOLLOWING A FAILED LETTER OF DEMAND As a member of MPAQ, you are entitled to have a free letter of demand sent by Cornwalls for any debts that you may be owed over $550 (ex GST). But what happens if the letter of demand does not work? What are your options? Cornwalls offers members up to 20 minutes of free advice when your debt is not paid or prior to sending the letter of demand. This article sets out some of the options that are available to you when the letter of demand does not work.

Minor Debt Recovery In our view, where the amount of your debt is less than about $15,000 it would usually be uneconomical for you to engage a solicitor to pursue the debt any further. In those cases, we recommend that you bring a proceeding on your own behalf in the Queensland Civil and Administrative Tribunal1. We recommend that you commence your claim in the minor civil dispute jurisdiction rather than the building list. A claim for unpaid labour and materials clearly falls within the definition of minor civil dispute/debt. The advantage of commencing the claim in that part of the tribunal is that no legal representation is permitted there. Whereas, in the Building List, legal representation can be and is often permitted.

Statutory Demand In a case where the debt is: 1. owed by a company, 2. above approximately $10,000, and 3. there is no dispute about the debt or claim the work is defective, one option available to you is to issue a Statutory Demand pursuant to the Corporations Act. This is a formal document requiring the company to pay the money or apply to the court to set the demand aside within 21 days of the demand being received. If the demand is not complied with then the next step would be to apply to wind the company up. It is relatively easy to set the demand aside, so it is important to be certain that there is no ground for disputing the debt. The issuing of the demand is relatively cheap and simple. It is also a powerful tool, as most people do not want their company wound up.

Security of Payment Where a debt is disputed for some reason, particularly where it is asserted that the work is defective, then the cheapest and fastest way to recover your money is under the security of payment system. Your unpaid invoice can be issued as a payment claim under the Act and if a payment schedule is received disputing the claim, then you can proceed to an adjudication application under the legislation. If you are successful, then the adjudicator’s decision can be enforced as a judgement of a court.

Court or Other Proceedings In any case where someone owes you money, you can take proceedings in a court or in the QCAT. These are time-consuming and far more expensive than the other options discussed.

Subcontractors’ Charge Finally, we should mention this option. Obviously, as the name suggests, this only applies where you are a subcontractor. It is a claim for a charge over monies owed by the principal to the head contractor/builder. These days, this is only used as an option where the head contractor/builder has gone into liquidation or administration, or you think it is about to. Strict time limits apply. For these reasons, this is an option you should seek advice on prior to issuing a letter of demand not afterwards.

Incidents in Customers’ Residences

WHAT CAN YOU DO WHEN YOU ENCOUNTER INCIDENTS IN A CUSTOMER’S RESIDENCE? Processes

In the plumbing industry, professionals often find themselves working in the homes of customers. During these visits, situations may arise that expose employees to moral and/ or physical concerns relating to the customer and/or other people who are at the house. This article aims to delve into these scenarios, identify warning signs, and discuss strategies for employers to offer assistance and support to their team members.

Recognising the Situations and Signs • Physical abuse: signs of physical abuse can encompass marks such as bruises, burns, lacerations, fractures, or other forms of bodily injury. In some instances, the customer or their caregiver might try to explain the injuries and how they got them, which may appear inconsistent to the employee. • Emotional abuse: signs of emotional abuse can manifest as fear, social withdrawal, mood swings, or unwarranted hostility displayed by the customer. • Neglect: neglect may present as poor hygiene, malnutrition, dehydration, untreated medical conditions, or an unsanitary and hazardous home environment. • Psychological abuse: psychological abuse can be challenging to spot, but it may manifest as excessive control, isolation, threats, or intimidation. • Customer initiated sexual harassment: this can encompass physical advances, suggestive comments, discomfort-inducing behaviour, inappropriate attire, questioning, or conversations.

1. Ensure safety: if an employee witnesses or experiences any of the above or believes someone is in immediate danger, prioritising their safety is of utmost importance. They should remove themselves immediately from the house and call emergency services (000). They can do this anonymously. 2. Document evidence: if it’s safe to do so, take notes, or record any relevant information discreetly. Document the date, time, location, people involved, and any conversations the employee overheard or participated in. 3. Speak to the supervisor/manager: notify their supervisor/manager about the situation, and the employer may need to provide guidance or take internal actions. 4. Self-care: suggest the employee seeks support from friends, family, and/or a counsellor to help with any stress or anxiety it may cause. Respect privacy: while it’s essential to report abuse, respect the customer’s privacy and confidentiality throughout the process. Do not discuss the situation with anyone not involved in the investigation.

Who to Contact If an employee does experience or witness different situations, it could be beneficial to report their concerns to the appropriate authorities. In many cases, this will involve contacting the relevant body: • Child Safety Queensland (1800 177 135) • Relationships Australia QLD (1300 063 232) • Family and Domestic Violence (1800respect) – this can also be via text message using the same number • Law enforcement (000), depending on the situation This can be anonymous if the employee feels more comfortable.

Reporting abuse in a customer’s home is a responsibility that should never be taken lightly. It requires vigilance, compassion, and a commitment to protecting those who may be vulnerable. By recognising the signs of abuse, documenting evidence, and following the proper reporting procedures, service providers can contribute to the safety and well-being of individuals in their care. NEW BILL INTRODUCED TO AMEND FAIR WORK LEGISLATION The Federal Government has now released the third tranche of proposed workplace relations reform in the form of the Fair Work Legislation Amendment (Closing Loopholes) Bill 2023 (Cth) (Closing Loopholes Bill). On 4 September 2023, the Closing Loopholes Bill was introduced to the House of Representatives. This Bill aims to make further changes to the Fair Work Act 2009 (Cth) by including some of the Labor Party’s election promises and addressing issues discussed during the Jobs and Skills Summit held last year. The Closing Loopholes Bill presents a range of significant reforms, such as: • Amend the definition of ‘casual employee’ and allow eligible workers to switch to permanent employment if they choose. • Increase penalties for underpayments by reviewing civil penalties and criteria for serious contraventions. • Allow the Fair Work Commission (FWC) to mediate disputes over unfair terms in service contracts for independent contractors. • Create a new criminal offence for intentional wage theft – proposing a maximum term of 10 years in jail and fines up to $7.8 million or three times the amount of the underpayment.

• Clarify the definitions of ‘employee’ and ‘employer’ based on the actual nature of the employment relationship. • Give the FWC the authority to set fair minimum standards for workers in the gig economy and road transport sector. • Ensure that labour hire workers are paid the same as agreed upon in enterprise agreements with the help of the FWC. • Union officials will have the power to apply for inspections of members’ pay records without warning if they suspect underpayments. • Introduce a new offence of industrial manslaughter to improve workplace safety under the Work Health and Safety Act of 2011 (Cth). The implementation of this plan depends on the approval and enactment of relevant laws (likely early in 2024) and are designed to strengthen worker protections, address wage-related challenges, and enhance workplace safety standards, which means businesses will need to have a sound understanding of these changes as the implications for non-compliance will be very costly. Plumbing and Gas Industry Benchmarking Report The Plumbing and Gas Industry Benchmarking Report is developed every year based on feedback provided in an annual survey of plumbing and gas business owners in Queensland. This information provides a quick snapshot of the current state of the plumbing and gas industry and is a resource for MPAQ to lobby the government on issues that are most relevant for plumbers, gasfitters, and business owners. Here is some information from the 2023/2024 Plumbing and Gas Industry Benchmarking Report collated from the survey conducted in July 2023. Business Size More than 45% of the respondents have two to five people in their team. 28% said they were sole operators, while 11% said they had six to 10 people in their businesses. Less than 3% had more than 50 staff in their business. While there have always been women working on the admin side of many trade businesses, representation of women on the tools is still lacking. 87% of survey respondents said they employ male apprentices and/or tradespeople while only 21% employ female apprentices and/or tradespeople, which is a decrease of 3% compared to the 2022-2023 report. 2023-2024

Charge Out Rates More than 61% of respondents said they charge an hourly rate. 41% said it differs per job while 41% said they have a fixed price. Other responses include fixed pricing for small or maintenance work and quotes for larger projects or renovations. 31% of survey respondents only disclose charge out rates on request while 29% disclose when quoting and 23% disclose when invoicing. There are many factors that affect businesses when they work out their charge out rates. Factors that affect charge out rates

33% of survey respondents do not charge a call-out fee. For those that do, 28% charge $70 and above. The most common other response from survey respondents was incorporating a service fee into the first 30 minutes/hour of the work by having a minimum charge. While 29% said they do not charge additional fees for travel time, some say they do when they have to drive further than 50km or more than 30 minutes for a job. 4% had a flat rate, 20% charged their normal hourly rate, while 15% charged per kilometre. The most common factor for calculating loading applied for after-hours or emergency work was overtime rates. When it comes to marking up the trade price for materials, the most common response provided for the average markup on materials was 21-30%, which was the same as 2022-2023. Comments note that this is mainly on construction jobs, whereas maintenance work can vary as much as 40%300%, depending on the product. Charge out rates have generally increased overall across different roles and different types of work. There has been an average increase of 20% on rates for sole traders, supervisors, tradespersons, trades assistants, and apprentices. Some of the feedback provided to improve the industry are: • Abolish the industry-specific redundancy scheme. • Address unlicensed plumbers (from interstate) and civil contractors. • Support more small trainers to stop the monopoly that TAFE has on our industry. • Have some kind of enforcement over nonpayment from clients (small debts) and ensure QBCC fines the correct people, not the ones doing the right thing. • More frequent training opportunities, especially in more regional areas. • More member information/training sessions for admin staff. • An increase in the amount for when QBCC insurance is required. $3,300 has been the level forever and has not increased with inflation and costs. • Funding assistance for WHS training. • Better subsidies for apprentices and putting apprentices on. • Consistency through all the councils with interpretation of plumbing code. • Standardise backflow prevention nationally. • Self-certification of plumbing works (as is with gasfitters or electricians).

In 1975, Greg Hamilton embarked on a plumbing apprenticeship, unknowingly setting the course for a journey that would leave an indelible mark on the industry and countless lives. Greg’s passion for plumbing was evident from the very beginning. Little did he know that more than four decades later, he would be celebrated not just for his professional achievements but for his unwavering commitment to making the world a better place. Greg’s career took a significant turn when he ventured into hydraulic consultancy over 40 years ago. He didn’t just work on projects; he left an indelible imprint on them. Some of his notable projects include the iconic Q1 building, the elegant Calile Hotel, the transformative Gasworks Newstead, and the heartwarming Tuggeranong Aged Care facility. His work was a testament to his dedication to quality and his pursuit of excellence, and his generosity transcended his professional life. A manifestation of Greg’s generosity was shown in the time he gave to others; he was always available to help people out when they needed it. Greg was well-liked by many of his peers in the industry. He dedicated his skills and time to numerous charity projects, including mentoring troubled teenagers on his farm and supporting an orphanage in Timor Leste alongside his brother, Tony. Together, they raised funds for Martinha, the first disabled female law student in Timor Leste, covering her three-year tuition. In addition to his professional and charitable endeavours, Greg cherished adventure. With a love for flying and a passion for mountain climbing and bushwalks, he truly embodied the work hard, play hard mindset. Greg had a vision to create a lasting legacy in the industry through H Design Hydraulic Engineering Group, nurturing critical thinkers and problem solvers. Greg’s life was marked by unwavering dedication, passion, and boundless generosity. CELEBRATING 50 YEARS MPAQ MEMBERSHIP GRAEME TWADDELL

CONGRATULATIONS,

Melissa Millar!

Congratulations to Melissa Millar for winning the ADCO Constructions Award for Achievement as a Business Woman (Small and Medium Enterprise) at the NAWIC Awards!

Melissa is the founder of Women Of Trades, which is an all-female gutter cleaning crew established to provide a flexible employment environment for women wanting to trial a trade or as a holding company employing Melissa Millar receiving her award women who want to land an apprenticeship. Women Of Trades and Industry delivers several employment and finance workshops written by Melissa using her knowledge of various learning styles and focusing on employment skills trade businesses are looking for. In 2024, it will financially help women complete their apprenticeship, eliminating any barrier they may have to complete. In the future, the vision is to grow enough to support women to start their own trade businesses. Melissa cofounded Millar’s Plumbing Service with her husband. Their business has grown under Melissa’s delivery of business planning and leadership. She actively contributes to MPAQ with the Women’s Plumbing Alliance and as an external council member. Graeme’s journey began with a plumbing apprenticeship in New Zealand, where he developed a solid foundation in the intricacies of the plumbing trade. The allure of new opportunities and challenges led Graeme to make the move to Australia. To become a licensed plumber in Australia he applied for his reciprocal plumber’s licence. He decided to challenge himself further by taking an exam to earn his drainer’s licence, enabling him to work on drainage systems. Graeme’s journey saw him create his own plumbing business, Kagra Investments, a business he ran and owned for more than 35 years, a testament to his steadfast leadership and unwavering commitment to the plumbing profession. At the peak of his career, Graeme provided employment for a dedicated team of eight to 10 individuals, not only contributing to the local economy but also providing job opportunities for aspiring plumbers. Graeme’s wife, Kay, played a pivotal role in supporting his business endeavours. Their partnership exemplified the idea that success in the plumbing industry can often be a family affair. Graeme’s brother Chris Twaddell was also a plumber, and Graeme’s son Mick completed his apprenticeship with his dad after he left school and went on to become a builder and plumber. Graeme undertook a multitude of commercial and residential projects, including townhouses, in Brisbane. He navigated some of the plumbing industry’s most significant challenges, including adapting to evolving products, such as the transition from earthenware pipes to PVC pipes. The introduction of plastic marked a transformative moment for the industry. Graeme passionately expresses that the plumbing industry has been a source of joy and fulfilment. His career is a testament to the transformative power of hard work and dedication. To stay connected and informed about industry trends, wages, and more, Graeme joined the Master Plumbers’ Association of Queensland (MPAQ). His decision to become a member was a strategic one, ensuring he had access to the latest insights and a supportive industry network. Congratulations, Graeme, on your career and membership with MPAQ.
