Are your showers ticking time bombs?

Despite builders best efforts, leaking showers are consistently listed in the QBCC's top ten defects.

Sadly, sometimes this is due to substandard workmanship, but most of the time it is the design of the shower itself which is creating the potential for disaster.

WI IDENT The 2021-22 Queensland Budget promised some welcome and solid capital works projects, but these have been overshadowed by the threat of additional red tape and the continued lack of a visible pipeline of work.

As an employer of more than 230,000 Queenslanders, our industry plays a huge role in keeping the cogs of the economy turning, generating close to a tenth of the total at $28 billion.

of millions upgrading existing schools, is a welcome relief – but as was the case with last year’s budget, builders remain without a clear picture of the pipeline of work over the coming years.

The budget commitment to invest $1 billion into a new Housing Investment Fund to drive supply of social housing will go a long way to support our quickly-growing communities.

On the flip side, the government also seems insistent on sticking with its so-called Best Practice Principles for major government projects, despite the growing chorus of protest around Queensland taxpayers forking out at least 30 per cent more, no matter whether they’re in regional or metropolitan areas.

While the budget had some good news, the residential sector remains in disarray in

the face of continued labour and materials shortages and cost hikes (which were a result of the welcome but unprecedented demand driven by government stimulus, such as HomeBuilder and the Regional Home Building boost, ultra-low interest rates and strong interstate migration). These issues have been exacerbated in south-east Queensland in the face of lockdowns and border closures, which have further hampered the industry’s ability to respond to this unfolding situation.

With the ABS recording 30,000 new residents moving from the southern states to Queensland last year alone – and projecting 800,000 new homes will be needed across South East Queensland over the next 25 years, the last thing the industry needs is more red tape hampering its efforts.

2021 was the year we all thought we’d say goodbye to COVID-19, leaving all the stress and drama wrought by the pandemic behind us. However, as the year has progressed, it’s become clear the challenges are far from over.

Since the pandemic first sank its teeth in, our members have excelled in the face of adversity, and are continuing to amaze us with their never-give-up attitude. That spirit of determination and exceptional quality of workmanship for which they’re renowned has definitely translated into our 2021 Housing & Construction Awards program.

For more than three decades, our Awards program has been and remains the pinnacle aspired to by our members across their careers. All of our entrants are in esteemed company, and are a valued part of why Master Builders are so widely trusted and respected.

While the demand on our industry is a firstclass problem to have, the resulting trade and materials shortages and skyrocketing prices haven’t made things easy on anyone. The June survey reveals the lead time across all key building materials continues to blow out, with 100 per cent of respondents now facing wide-ranging delays on timber – 40 per cent waiting more than a month. Delays to access steel is also reaching a critical level.

The shortage in supply is also playing out in price increases, with one in four respondents slugged with hikes of more than 25 per cent for timber and roofing materials, and ten per cent on steel. Available tradies are increasingly thin on the ground, with two out of three builders waiting more than a month for roof installers, and steel workers, tilers, carpenters and bricklayers not far behind.

prices and delays for so long – and unfortunately, we’re predicting this situation could explode around September and October. Hopefully the shortages situation will begin to resolve itself after that.

While the state government’s Accelerated Building Consumer Dispute (ABCD) framework is a good thing, both builders and consumers need further assistance when the situation goes beyond mediation, through no fault of either party.

We’re in talks with Minister Mick de Brenni’s department on a permanent rapid dispute resolution process for the residential sector, similar to what’s available to commercial builders, in the hope of providing a fair and speedy resolution when these challenging conditions see projects fall apart.

When it comes to Japanese home design, it’s maximising available space that counts. So, with new blocks of land in Queensland at a premium, and most of them smaller than available in years gone by, Sekisui House is drawing on those Japanese principles of space efficiency and adapting them to the Australian way of life.

Launching the four new ‘Shavida’ homes at the Ecco Ripley community west of Brisbane, project director Taku Hashimoto told Master Builder the designs had been developed specifically for the local market.

“As you know, Japanese homes are very small, so we have to be careful and make sure the efficiency of space is there. So, we keep importing those design efficiencies into each of the elements; we work together with the customer to make sure that those efficiencies will translate into value for them.”

Ranging from a two-storey four-bedroom home on a 234m² block, to a single-storey with three bedrooms on a 142m² block, each home packs a punch in terms of inclusions, without losing the sense of space Aussies crave.

Studies at the Comprehensive

Research and Development Institute in Kyoto shape the finer details and points of difference.

“For example, the location of the kitchen, the pantry and the laundry, and even the toilets – there’s a key to how we’ve set up their location,” he said.

“We’ve calculated the space in the corridor, the ceiling heights, the benchtop heights – everything’s been looked at. ” The new homes showcase a selection of colour schemes executed by renowned interior stylist Bree Pullinger (pictured) in partnership with Brisbane's The Retail Designers.

While feng shui principles are considered and a Japanese-style cloak room included, the outdoor space loved by Aussies hasn't been forgotten – with the Capri design leaving room for a pool.

“300m² lots are difficult of course – you need to go up to the second storey. So, we are demonstrating how the backyard can be used efficiently, and I think people are surprised with how much you can fit in to the backyard and twostorey homes (like this) – they think, this is really 300m²? That’s our purpose,” Taku said.

Lysaght VENT-A-ROOF® — EASY INSTALLATION AND NO MOVING PARTS — There’s no doubting the benefits of roof ventilation, especially in a country like Australia with our extremely hot summers, and in some states, year-round heat. Just a few days of moderate to high temperatures can result in heat build-up, and that becomes trapped in the roof cavity as the sun beats down, while warm air from inside the house also rises.

Flicking the switch to the aircon is usually the first course of action when the temperature rises, but it’s not the best one. Running air conditioning for long periods isn’t cheap, and for those with ducted systems – which are often routed through ceiling spaces – efficiency is lost because the cool air moving through the ducting ends up cooling the ceiling cavity rather than just the living spaces.

Good ventilation is also needed in the cooler months when humid air can get caught in roof cavities – if there’s no escape, it gradually turns to liquid, clinging to timber trusses and moistening insulation and plaster, which can lead to damage.

What if there was an easy-to-install system that could help to cool roof cavities leading to a cooler building in summer, while also providing airflow during lower temperatures to minimise condensation? It would be even better if it was a ‘passive’

solution, that didn’t need energy to do the job. The concept of passive ventilation isn’t new with a number of systems available on the market. None though are quite like Lysaght VENT-A-ROOF®.

According to Tony, another benefit for building owners – and installers – is that the two-piece VENT-A-ROOF® system is cost effective to install and much easier to fit than a comparable ventilation system, plus needs little to no maintenance.

“Installers will really appreciate the fact that unlike products such as wind-driven rotary ventilation systems, VENT-A-ROOF® doesn’t need any penetrations of the roof – this avoids leaks, maintenance issues and call-backs. It also means a faster install because there’s no need for flashings,” he said.

Over the last five years the Gold Coast region has grown on average 2.3 per cent per year. While key infrastructure projects including the Coomera Connector, Light Rail and M1 Upgrade (Robina to Tugun) are all traditionally civil construction, they're drivers for general building activity.

The Scenic Rim is also seeing steady growth, with many southerners and those seeking a regional change moving into the area. Both councils continue to approve and fast track new developments as needed. The residential sector is leading the way with over 3,100 apartments approved in the past 12 months, up 16 per cent on 2019-20. With renovations and knockdown-rebuilds also in high demand, the stage is set for the Gold Coast and Scenic Rim region to have an extremely busy couple of years.

ow that we're into the new financial year, it is important to take some time for reflection. The past six months have been turbulent to say the least. We have ridden the highs with positivity and optimism as we looked at a full book of work for the next 12 months. Then we came crashing down when faced with shortages of material and ever-increasing prices. Whilst we live in uncertain times, the Gold Coast and Scenic Rim regions are faring relatively well.

Right now, our city and the South East Queensland region is experiencing significant investment in residential and commercial development, as well as a spike in state capital works expenditure.

The accelerated activity is now starting to have downstream impacts on both supply of materials and availability of subcontractors.

I applaud the work Master Builders is doing to try to alleviate these growing challenges.

Our council has long supported two key pillars: protecting our lifestyle and broadening our economy.

As Mayor, I want my kids and future Gold Coasters to be able to live, work, invest and raise a family here. I don’t want Gold Coasters having to leave to chase the ‘capital city jobs.’

Our strategies are working, with more people finding stimulating employment in the marine, health, sports, screen (film and television) industries, to name a few.

Scenic Rim communities continue to show their rich underlying strength in the face of fires, floods, drought and the recent pandemic. Sometimes it takes a challenge far bigger than our individual circumstances for us to open our eyes and see the bigger picture.

I believe this has been the case for us with local communities rediscovering and reaffirming their richness of character in the way they have supported those most impacted through those difficult times.

Like many regions, our gross regional product is down slightly recognising some of the flow on economic impacts from COVID-19, bushfires and drought, which continues to be a challenge for our main economic contributor agriculture.

In May, building approvals for the financial year to date were $122.95 million. For the full previous financial year, they were $89.74 million, so that's a positive sign of a growing population and business confidence. In late June,

for tackling the ‘hidden’ cost of COVID-19

T

he impacts of COVID-19 have been front and centre of our lives for more than 18 months now. From trade and materials shortages and cost hikes, to border closures, contracts at risk and new health and safety considerations, the challenges of adapting to ‘the new normal’ are everywhere.

Equally as important is acknowledging the heavier mental load we’re all carrying – and finding ways to lighten it.

Counselling, Consulting and Clinical Psychologist Dr John Barletta said the pandemic had forced many people to reconsider if “business as usual” is the best, or only way forward – and in many cases, it’s not.

“To solve building and construction problems, people have building and construction knowledge and skills. So, to solve customer/ colleague challenges, and psychological wellbeing problems, people need relationship and psychological knowledge and skills. It’s simple, foundational stuff, but absolutely critical,” Dr Barletta said.

“As with most areas of health and education, 18 | Master Builder

as Ben Franklin famously said; “An ounce of prevention is worth a pound of cure.” It’s not respectful waiting to intervene when difficulties arise, because we all know they will arise.

“It’s about acknowledging the challenges of the building and construction sector and developing and implementing evidencebased programs to decrease the likelihood of problems occurring. Making it easier for leaders to circumvent significant negative events occurring is also important – problems in the building and construction industry can be dramatic and catastrophic because the stakes are high.”

Dr Barletta has spent more than a decade working with businesses across the industry through workshops and training, keynote speeches, as well as in one-onone consultations, to shed light on issues including self-care, resilience, relationship building, having difficult conversations, conflict resolution, and mental health issues, just to name a few.

Aside from the obvious goal of improving general mental health and wellbeing, Dr

Barletta said there are positives to be had in other aspects of the business, such as reduced staff absence and turnover, improved morale, a better return on investment in training, and minimising industrial disputes.

“A focus on mental health and wellness conveys to workers and their families that a business really cares for them and has their eye on the long game. Do otherwise, and employees see themselves as only a tool of production, simply cogs in the machine, and a means to an economic end for others.

“Employees feeling valued honours the reality that we are all connected, and that resilience is about a set of skills that people can learn and use whenever needed.”

Starting a mental health and wellbeing program is also not out of reach for smaller businesses.

“They can, and do, already check-in and share with their mates. Employers and leaders simply putting on a lunch or morning tea and asking people what’s working and not can be an easy place to start,” Dr Barletta said.

Sometimes, smaller subcontracting businesses can ask the bigger companies they work with to be included in their training programs.”

Among the many businesses Dr Barletta has helped over the years is Brisbane’s Dixon Homes, who have taken a whole-of-business approach to making sure everyone is clear about why their role is important, and in good shape psychologically.

“Broadly the aim is to have staff being healthy, happy, and interpersonally skilled in working with customers and colleagues,” Dr Barletta said.

“With the business developing reflective leaders, a psychologically safe work environment, staff wellbeing and capability have increased. Everyone knows that they have a responsibility to arrive fit and ready for work, and to engage in their tasks to meet explicit expectations.”

Dixon Homes’ Non-Executive Director Lev Mizikovsky described the current environment the industry is operating in as “really difficult,” and said giving his employees vital tools for dealing with conflict has helped them communicate more effectively.

“Internal relationships are of critical importance,” Lev said.

“If you can say well, we have an issue here, and this is a more appropriate way of resolving the issue, then you get a lot of mileage.

“The issues are when people would feel personally affected by change or the need for change, by conflict, eventually where you get a difference of opinions. Once you’re able to communicate without creating stress, things improve dramatically.

“Customers when they’re working with us get that feeling of calm, and it all helps. At the end of the day, it’s not all about money – we spend literally most of our lives at work, and clearly it needs to be pleasant, so people want to be here.”

If detected early, treatment can result in full recovery in 98 per cent of cases. All men aged over 40 are encouraged to have an annual prostate check.

New scaffolding rules keeping builders safe A

fter years of extensive lobbying and negotiation by Master Builders, the Scaffolding Code of Practice has been updated and is now in effect.

The changes are an important step in addressing construction industry safety and aim to protect the lives of Queensland construction workers.

Statistics from the Queensland Government show more than 60 workers each year are seriously injured using scaffolding, with their workers’ compensation claims meaning they need to spend five or more days off work.

Industrial Relations Minister Grace Grace said the revised Code of Practice would make working on scaffolds much safer.

The key changes include: •

New entry and exit requirements for scaffolds to allow emergency stretcher retrievals

A requirement for engineers, rather than scaffolders, to design and sign off on scaffolds

•

A smaller step height between scaffold stairs and work platforms

•

More detailed requirements around managing the risk of debris, falling objects and hazardous substances

•

Regular testing of scaffold welds.

The code brings a raft of features to substantially boost safety for workers.

Master Builders Workplace Health and Safety Manager Melanie Dawson said the changes to the Code were an important step in addressing construction industry safety and are supported by WHS experts.

“In particular, reducing the step height between scaffolds and working platforms addresses a significant risk of falls," Ms Grace said.

“We will work closely with government and industry on the introduction of the Code as there will be an inevitable cost posed on industry," Ms Dawson said.

It’s been close to 10 years since the current work health and safety laws commenced, and in that time nearly 6,000 notices have been issued for non-compliant scaffolding, leading to fines totalling around $150,000.

This annual initiative puts the spotlight on the health and injury risks affecting those who work in a trade. ith our industry busier than ever right now, it’s all too easy to put ‘selfcare’ on the backburner. However, statistics show almost three out of every five serious workplace injuries involve a tradie, while 60 per cent of tradespeople have aches and pains as a result of their job.

CYBER CRIMINALS TARGETING BUILDERS & CLIENTS I

t all started with what seemed like two regular business emails. A simple note from a builder, letting his clients know they needed to put their next progress payment into a different bank account.

Unfortunately, not all was what it seemed.

The emails were fake – the work of scammers, who tricked two clients of a Brisbane construction company* into placing a total of $85,000 into two different bank accounts.

The Australian Cyber Security Centre (ACSC) reports there’s a growing trend affecting construction companies and their customers.

In the six months to July, there’s been an increase in cybercriminals targeting builders and construction companies with business email compromise (BEC) scams in Australia.

BEC scams involve cybercriminals sending fraudulent emails, posing as a legitimate business, usually targeting their customers and asking them to change bank account details for future invoice payments. Victims assume the request is legitimate and send their payment to a bank account operated by the scammer.

The client then sent on an email he’d received, stating the bank account details had changed, and asking for payment.

At the same time, the bookkeeper followed up on a final payment of $70,000 owed by a second client who had always paid on time.

They also confirmed they had deposited the funds into the “new” bank account after receiving an email.

“We had a situation where it was just a plain email, not even an attempt at a copied logo, there were no phone numbers, and the customer with the larger amount said they couldn’t believe they accepted it. In hindsight it didn’t sound right, but of course that’s after the event,” the accountant said.

The $15,000 was tracked to a bank account in Central Queensland, with local police discovering its owner was unconnected to the scam, and unaware the account still existed.

The funds were returned to the client, who then paid the builder.

Unfortunately, the $70,000, which landed in a bank account in Sydney, went straight back out into a cryptocurrency account – and vanished without a trace.

After falling victim to a BEC scam, the Brisbane company’s accountant is sharing their story in the hope it will stop the same thing happening to others.

The accountant said the bank involved claims it is unable to help any further – while the NSW Police Fraud Squad is “running into closed doors.”

“One of the clients happened to ring to get confirmation of his bank transfer. Our bookkeeper told him we didn’t have the funds in the account yet. So, he emailed in his banking transmission, and the bookkeeper realised they weren’t our bank account details,” he said.

“The clients have also reported it to the Australian Financial Complaints Authority, but they won’t do anything until the police close the file, so we’re basically 70 grand out of pocket…while the other people can say they have paid that money and it hasn’t gone to the right place.”

The ASCS says these types of emails usually come from hacked accounts, or via domain names that look similar to legitimate companies, typically by swapping a couple of letters or adding extra characters. Successful BECs may go unnoticed for weeks or months, until the construction company follows up on missing payments.

With both the builder and the client left in limbo, and neither of them at fault, the business is now taking extra precautions when it comes to cyber-security – and urged others to do the same.

“Instead of the old ways of relying on public liability insurance, ticking the boxes and paying the money and that’s all you do, people are now going to have to look at insurance around cyber-fraud,” the accountant said.

“Even on your email signature, letterhead, and statements, just include a cyber-fraud warning. In the past nobody worried about it…but the more people see it, the more it’s going to sink in, so if they do get one of those emails they’ll think twice and pick up the phone. It’s either that, or we all go back to writing cheques!

“It’s all very well to say fancy someone falling for that, it won’t happen to us – it can happen to anyone.”

Joist and bearer tapes are essential, but they’re not all the same Today’s high-performance composite deck boards, like those from Trex Company, are warrantied to last for 25 years. But what about the substructure supporting the deck? If the posts and bearers are made of timber, they will deteriorate long before a composite decking warranty elapses. A Trex Protect survey of builders revealed that timber foundations typically begin to show signs of splitting, rotting or decay after just eight years.

Easily one of the timber’s worst enemies, moisture contributes to mould growth and can accelerate structural deterioration.

When joists and beams are exposed, water seeps into screw holes and sits on the surface, causing it to rot and the screws to rust. Additionally, timber’s natural expansion and contraction throughout the year can cause beams to split and weaken over time, posing serious safety concerns.

Deck flashing tape is a cost-effective and straightforward way to protect the timber from the damaging effects of weather and time. Designed to shield timber joists and beams from moisture that can lead

to deterioration, it also acts as a barrier between the timber and galvanized metal and helps screws and fasteners hold longer for enhanced structural integrity.

There are two primary options when it comes to deck flashing tapes — asphaltbased and butyl tape. Although asphaltbased tape is generally less expensive, it tends to dry out more quickly, curl up and hold water. In addition, when penetrated by screws, it allows water to seep through to the timber. The acrylic tape also does not adhere immediately to timber and can take up to 72 hours to fully bond. Since acrylic tapes do not withstand water as well as their butyl counterparts, they tend to come with warranties that last less than one year or with no warranty at all.

Butyl tape offers several advantages over asphalt. The butyl material acts as a sealant that prevents water from penetrating the timber and holds deck screws in place longer. It is stickier, performs better in a wider range of temperatures and is more pliable, which allows it to create a tighter seal around screws to prevent water from infiltrating screw holes. Additionally, butyl-based

protection tapes typically come with long warranties.

Building hope in tough times Master Builders was among the corporate partners who took part in the Australian Industry Trade College (AITC ) 'I’m In New Hope Cambodia Campaign', contributing $10,000 to the total of $30,040 funds raised, through the former Master Builders Foundation.

The AITC’s members and directors, families, alumni and employees also worked together through activities on campus, and young person's VET projects, securing additional donations and even blueberry picking to surpass the original goal of $20,000.

The funds will also help feed more than 1,000 families in Siem Reap with supplied food parcels, and educate over 450 children, for a month. The town is dependent on tourism, so with their main source of income cut off as

the global pandemic continues to put a stop to travel, the locals are doing it tough.

Housing Committee and Electoral College member Shane Summers was part of the steering committee for the campaign, and said he was proud to have been involved.

“AITC’s fundraising and community work builds character. I have seen first-hand how they grow in a very short time and the change that comes about in the young people when they are confronted with poverty and real hardship, and the difference their effort makes,” Shane said.

“We have been pleased in previous years to have Master Builders’ members join us in Cambodia on our bi-annual International Service Project, helping us build homes for poor people. We find Master Builders to be visionary and generous in their care, not only for their members but also for the broader community," AITC Executive/Principal Mark Hands said.

The idea, sparked by Master Builders, followed a successful pilot trial by Queensland’s Department of Transport and Main Roads (TMR) of digital driver’s licences across the Fraser Coast.

“Having all trade licences in an app or online would ensure that all workers have the relevant documents to hand as and when needed. This also prevents the opportunity for a worker to be in a situation where they have 'forgotten' or 'lost' their cards.”

The success of this trial shows the technology already exists for the leap from the road to the worksite, meaning plastic cards could soon be a thing of the past. It’s already been done with the White Card in NSW, with more to come.

“You always have your phone on you, so a simple app that holds the licences makes sense. You can pay using your phone, why not hold a licence? It will help with knowing the expiry date/renewal dates.”

Master Builders floated the concept with the QBCC, who said it was “a great idea.”

“Reduce damage to physical docs and speed accessibility / legibility to required information.”

We’re hoping a pilot trial could be carried out in one region of the building and construction industry, leading to adaptation of digital building and trade licences.

There were so many crazy and memorable times working with a bunch of blokes (most involving a cold one to celebrate a hard day’s work).

WHO OR WHAT INSPIRED YOU TO GET INTO THE BUILDING & CONSTRUCTION INDUSTRY? In school I struggled sitting down and focusing and always felt like I should be doing something more hands-on. My neighbour was getting his house painted and I gave him a hand and never looked back.

TURNING UP THE VOLUME ON

olours like Day-Glo yellow, hot pink and funky patterns might not be the first things that spring to mind when it comes to mental health, especially in the building and construction industry – but for the team behind TradeMutt workwear, that’s the whole point.

Just 12 months into their mission to get people talking about what’s traditionally viewed as an ‘invisible illness,’ this Brisbanebased organisation is not only starting conversations, it’s shouting out loud – and proud of it.

As young chippies who met on a worksite, Ed Ross and Daniel Allen dreamed of creating workwear far removed from the bland colours of their uniforms.

When Dan lost a close friend to suicide in 2015, the mates decided it was time to raise awareness around mental health, especially among young men, in a more relatable way, encouraging people to really open up.

Three years later, TradeMutt was born, with the men’s and women’s gear featuring signature bright colours and the TIACS logo sitting proudly on the back of each shirt.

5 per cent of all product sales go towards funding the TIACS not-for-profit mental health support service. Those who reach out via text or phone call get free access to a team of psychologists, without the need for a GP referral, and with no cap on the number of chats.

Marc Ahmelman met Dan and Ed soon after they started TradeMutt. Working as head of philanthropy at a wealth management firm at the time, Marc was so captivated by the TIACS mission, he decided to get involved.

After founding the charity arm, Marc thought it was “job done” – but his own connection to what Dan and Ed were working to achieve drove him further. He’s now the CEO. “I’m a bricklayer by trade, and I’ve suffered the effects of really extreme poor mental health…I’ve been suicidal and the like, so it’s something that’s very close to me with lived experience,” Marc said.

“We launched June 2020 – from June to December, we did 900 hours’ worth of counselling and associated work such as referrals to psychiatrists and things like that.

“We’ve now got four clinical staff, and we’ve done over 1,100 hours in the first six months of this year, so it’s growing.

“It’s been a massive learning curve, but it’s just been so encouraging to see people actually reaching out, and the connection between the clothing and the clinical work is huge – it’s

we’re all told to just harden up and get on with it. We’re out there calling out on that. It’s time to show vulnerability, put your hand up and ask for the help you need.

The eye-catching shirts are being spotted more frequently at worksites across the state, with The Block 2020 winning Queenslanders Jimmy and Tam seen wearing them during their stint on the Nine show.

“The shirts act as a catalyst; people say tell me about the shirt you’re wearing or comment about oh, that’s a bright shirt you’re wearing, and we say to people when they buy one, that they’ve become an ambassador

towards better mental health,” Marc said.

“So with that they’ll show empathy, they’ll show their own vulnerability, and that they’re open to having the conversation – and that works. Through that community side of things, that peer-to-peer support, we can actually back that up now with the clinical support.

“We take people on a journey to mental wellness. If you ring up and you need support, we deal with the immediate issue that you’ve got, and then it’s a conversation around ‘Hey do you want to stick with us a bit longer?

What can we do to help you?’ We follow people up – so we do outbound as well as inbound. So even if it’s a 10-minute chat to get you over a hump on a bad day, that’s great.”

Marc said they were proud to bridge a

perceived gap between crisis support, and private sector assistance, where a GP referral is required, or there’s a cap under Medicare.

“We bypass all of that sort of stuff. It’s really simple…have an issue? Pick up the phone, talk to a psychologist, repeat for as long as needed. We’re quite open in saying we’re in your corner as long as you need us to be.

“The community appreciates it – the comments we get back through social media or direct comments back to the counselling team…it’s very awe-inspiring. It’s a cracker.”

Paynters steps up to help a family in need W

hen the call went out from Triple M’s Big Breakfast team for Brisbane tradies to help a family in need, the Paynters team sprang into action, making it their mission to build them a positive future.

Seven-year-old Ollie (Olive) Schmidt has been through more than most people do in their lifetime, and her story is truly heartwrenching.

When she was just eight months old, Ollie went into heart failure. Her parents Cory and Mandy were told to prepare for the worst, but Ollie fought hard, surviving with the use of an artificial heart for months, before receiving a donor heart, growing into a healthy and active toddler.

Just before she turned two, Ollie got sick once again, with doctors unable to figure out the cause. After six hospital admissions, the little girl had a two-hour ‘Grand Mal’ seizure, which left her with significant brain damage and severe epilepsy.

Ollie hasn’t had a seizure-free day since 2017, suffering up to 250 each day. Her epilepsy is drug-resistant, she stops breathing several times a day because of the seizures, and a large percent of them are “Atonic,” meaning she loses all muscle control and drops to the ground, often causing significant injuries.

She is now developmentally delayed and intellectually impaired, so can’t do everyday activities.

When Triple M’s Marto and Margaux heard Ollie’s story, they stepped in to help, with Paynters signing on as construction partner.

TAFE Queensland, and more than 60 small businesses, individuals and tradies also joined the cause.

After months of planning and four weeks of building, Ollie’s home was revealed with a new padded deck and safe play space. The team formed a guard of honour for Ollie, older brothers Austin and Max, and their parents, as they returned to their family home.

Paynters General Manager and Director, Brett Johnston said the opportunity to participate in supporting the family and Ollie was one that they could not go past.

“For us, we saw this as a chance to give something back to our local community.

Paynters made it our mission to create this environment that has such a positive impact on Ollie and her family,” Brett said.

“We were blown away when Triple M rang to say Variety had asked them to get behind the project. Not only will this help build Ollie’s strength and development, but it will also give her the freedom to be a little girl, to play in her own space,” Ollie’s mum Mandy said.

“This will be a life saver for our family. Words cannot express how thankful we are that everyday people would invest in her future.”

Higher NCC compliance levels HIGHER NCC COMPLIANCE LEVELS FOR BUILDING PRODUCTS TOOK EFFECT FROM 1ST JULY 2021 Changes to the National Construction Code (NCC) 2019 Amendment 1 came into effect on 1st July 2021 which formalise the Performance Solution process.

Using CodeMarkTM accredited products will save time in developing performance solutions for residential, commercial and industrial projects.

In general, the NCC sets out what is allowable and arguably more importantly what is not an allowable building practice.

The introduction of A2.2(4) is one measure that will assist in ensuring higher levels of compliance with the NCC. The introduction of A2.2(4) is a way of formalising the Performance Solution process. It identifies the process and documentation required in order to develop Performance Solutions. The process demonstrates clear expectations, better information to end users and a greater auditing ability through improved record keeping and documentation.

However, this stringency could be challenging given the increased level of documentation. One ready-made solution is CodeMarkTM. The CodeMarkTM Certification Scheme is a voluntary third-party certification scheme for building products that provides a method for verifying that a building product meets the nominated requirements of the Building Code of Australia (BCA). As well as allowing a certificate to attest compliance with relevant Deemed-to-Satisfy (DTS)

Provisions, the scheme permits a CodeMarkTM Certificate to attest the compliance of a building product with relevant Performance Requirements of the BCA. CodeMarkTM simplifies the Performance Solution process, as the Conformity Body who issued the certificate has undertaken analysis to demonstrate the products meets nominated Performance Requirements.

Terefil® Used to Fill Redundant Stormwater Pipe Underneath Home When a local council was upgrading its ageing stormwater network, a reinforced concrete pipe was found to be running directly underneath a residential property.

The pipe beneath the home was 40m long x 375mm wide. As it was impossible to remove the pipe without demolishing the home, the pipe needed to be filled with a structural fill material before being abandoned to prevent future issues from occurring.

Mainmark commenced the project, working closely with council to arrange the necessary preliminary requirements such as securing the pipe end plates and installing breathers and injection fittings, before decommissioning the 40m stormwater pipe.

Mainmark injected approximately 5m3 of Terefil, a proprietary lightweight cementitious grout, into the section of pipe that was to be abandoned.

COMPLIANCE MADE EASY PRE-QUALIFICATION OF ACRS STEEL MAKES COMPLIANCE WITH AS/NZS STANDARDS EASY The significant growth in major infrastructure and construction projects which has occurred over the past 18 months — together with the associated growth in demand for construction materials — have also resulted in an increased chance of inferior products and materials finding their way onto construction sites in place of materials which conform with the relevant Australian and New Zealand Standards.

As such, matters relating to product conformity and certification of construction materials such as structural and reinforcing steels to Australian and New Zealand Standards is perhaps now more important than ever before.

Ensuring that the steel being used throughout all stages of construction or fabrication conform with all relevant Australian and New Zealand Standards and Building Codes — irrespective of their country of origin — is paramount. After all, these Standards have been considered and developed to ensure that buildings and other structures are not only ‘fit for purpose’, but are also capable of meeting their design life requirements.

Unfortunately, in this day and age, it’s simply not enough to think that just because steel has been ordered to an Australian or New Zealand Standard that the delivered product will automatically conform with that Standard and be fit for purpose. Increasingly, this is not the case.

In fact, there are some instances where even though the materials have been specified and ordered to an Australian Standard, the materials that arrive are non-conforming. The product may meet the Standard; it may be supplied with documents for “an equivalent Standard” (but which Standard and is it really

equivalent?) or it may not meet any Standard at all.

Importantly, whether this nonconformance is an intentional act of deception or ‘counterfeiting’ on behalf of the materials supplier, the builder or the contractor; or simply a matter of non-conformance through lack of correct process or an innocent misunderstanding of what constitutes conformance with Australian Standards, is effectively a moot point. Using non-conforming building materials carries a high risk of ‘built-in’ failure — and the results can be disastrous.

INDEPENDENT, EXPERT, THIRD-PARTY CERTIFICATION The only way to be truly sure that the materials being used conform fully with the appropriate Australian and New Zealand Standards and are fit for purpose, is through independent, expert third party certification with ongoing validation.

ACRS provides a fully independent, expert assessment and certification to AS/ NZS Standards for both Australian and internationally sourced construction steels, including reinforcing steels, structural steels and prestressing steels.

ACRS steel is pre-qualified. The manufacturers and processors have already demonstrated compliance with the relevant Australian and New Zealand Standards. By using ACRS certified construction steels, builders and contractors can be confident that they are getting the AS/NZS compliant materials that they ordered, and engineers and building certifiers can be confident that the steel meets the requirements of the Building Codes and associated Standards and is fully traceable from the point of

manufacture to the point of delivery.

All ACRS certification personnel are fully-qualified metallurgists and engineers with many years of direct experience in manufacture, processing, or design and construction of the steel materials they certify. In addition to factory production control audits and independent testing, the ACRS scheme provides regular review and analysis of all products manufactured and supplied by the certified supplier.

All testing is observed and verified by independent NATA test laboratories, and all processes, including the use of traceability tags, are audited.

The ACRS scheme operates as a verification-based system modelled on international best-practice standards.

Where some certification systems might accept the suppliers’ own quality management systems certification and test reporting without further checking, ACRS doesn’t. ACRS assessors independently select the samples for testing during the audit to prevent any chance of “cherry picking” by the supplier. It then manages the subsequent verification process though independent qualified laboratories selected by ACRS, not the supplier.

The process is further bolstered by ACRS conformity checking on the suppliers’ raw production data, which is undertaken every three months.

ACRS certification makes checking for compliance with the relevant Australian and New Zealand Standards easy. It demonstrates independently and expertly that the supplier consistently meets the Standards stated on the certificate.

I HAVE HEARD THERE ARE RECENT CHANGES TO SUPERANNUATION. WHAT ARE THEY?

I AM COMPLETING A RENOVATION AND THE HOUSE IS OLD, WHAT IS HERITAGE LISTED AND WHAT DO I NEED TO DO?

Increase to 10 per cent.

Historic buildings, structures, and gardens are some of the cultural heritage places Queensland sets out to protect. The Queensland Heritage List records the most important heritage places. Additionally, local governments use a local heritage register to protect local heritage places.

As of 1 July the superannuation guarantee rate rose from 9.5 per cent to 10 per cent. This change must have been applied the first pay period after 1 July. The increase must be on top of the employee’s earnings unless the employment contract specifically describes a salary or wage packet as being inclusive of superannuation. Where the package is inclusive of superannuation, employees should check that the package is sufficient to cover any applicable Award increases as well as the extra super.

As a reminder, superannuation is payable on ordinary time earnings, which are any monetary amounts that are associated with ordinary hours including wages, work-related allowances, multi-storey, leading hand or first aid allowances. Any payments that are associated with overtime such as overtime wages and meal allowances are not ordinary time earnings and so will not attract superannuation.

PART-TIME EMPLOYEES From 1 July 2022, eligible employees who earn less than $450 per month will be paid the super guarantee by their employer if they satisfy the other eligibility requirements. For those under the age of 18, the 30 work hours per week or more requirement will still apply.

STAPLING FUNDS The federal government has introduced new legislation to minimise employees doubling up on the superannuation funds they have, with the doubling up of fees and charges that involves. This is called super stapling legislation and BussQ has provided some great detail on this change in a dedicated article on page 69.

CONCESSIONAL CAPS Concessional superannuation caps have increased for the first time in five years, rising to $27,500. Contributors will also be supported to make additional contributions to their superannuation to make up for amounts that they may have withdrawn due to COVID-19. From the 2021-22 financial year, individuals who released superannuation under the COVID-19 early release scheme will have the option of recontributing these amounts as non-concessional contributions, over and above the existing caps.

SALARY SACRIFICE While not a new change it is timely to remind employers that from 1 January 2020 salary sacrifice arrangements should no longer reduce ordinary time earnings that the employer paid superannuation on.

Queensland legislation regulates the development of heritage places.

The definition of development applying to heritage places covers all types of work as well as minor activities not normally considered as development. For example: altering, repairing, maintaining, or moving landscape features, furniture and fittings, or paint or wallpaper.

This leads us to, how we do manage building work on a heritage listed building? Firstly, is the property State or Local Heritage listed? A local government planning scheme overlay map will identify different types of heritage and character properties.

The overlay mapping for traditional character can be residential or commercial. Residential character, where houses were built in and before 1946 will need to retain the existing building and extensions and alterations are to complement the traditional building style.

Houses built pre-1911 are to be retained. They can be relocated and any extensions cannot alter the original parts of house.

The heritage overlay protects specific buildings and places of heritage significance. They are to be retained and restored to preserve their heritage value. Adjoining properties should not impact on the values of the heritage place. These heritage places can be of local, state, national or world heritage significance.

If the building is State Heritage listed, you will need to understand the cultural significance. The cultural significance means aesthetic, historic, scientific, social or spiritual value for past, present or future generations. The heritage development checklist will help you identify the heritage issues. Have a pre-lodgement meeting to discuss the proposal. In most cases you will need to provide a conservation management plan based on the principles outlined in the Burra Charter.

The Burra Charter defines the basic principles and procedure to be followed in the conservation of heritage places. You will need to engage a specialist heritage consultant/ architect to help you prepare the plan and help you discuss the proposal with the state referral agency.

PIPA CLAIMS EXPLAINED

HOW DO I AMEND A CONTRACT?

Receiving a Notice of Claim to advise you that someone is making a personal injury claim (PIPA Claim) under the Personal Injuries and Proceedings Act 2002 (PIPA Act) can be quite overwhelming.

Sometimes, an executed contract needs to be amended. A simple mistake, omission or a necessary change does not mean a party can simply 'rip up the contract and start again.' However, there are ways parties can amend a contract:

The answers to some of these questions have been outlined below.

WHAT IS A PIPA CLAIM? A PIPA claim is a claim that is is made under the PIPA Act by a claimant (such as someone who has worked on your project, or a member of the public) who is seeking damages for a personal injury they have sustained that they believe you are liable for.

WHAT IS A NOTICE OF CLAIM? A Notice of Claim is the document served under the PIPA Act, advising you that a personal injury claim is being made against your business, and outlines the details of the claim. This includes details such as a description of the incident that caused the injury, details of relevant parties, any medical treatment received and other information or circumstances surrounding the incident.

WHAT SHOULD I DO IF I RECEIVE A NOTICE OF CLAIM?

•

by striking or crossing out the error

•

inserting the amendment, or

•

using a deed of amendment.

Please seek legal advice to check whether it is possible to legally amend your contract.

THE CONTRACT HAS BEEN SIGNED BY ALL PARTIES AND I HAVE NOTICED A SPELLING MISTAKE, OR I FORGOT TO ADD MY CLIENT’S MIDDLE NAME IN THE CONTRACT. WHAT DO I DO? Handwritten changes to a contract are acceptable if they are legible and initialed by all parties to confirm they agree to the changes.

You can correct spelling mistakes, or insert middle names, in the contract by neatly handwriting the changes, and having all parties initial the change.

For an electronically signed contract (such as via eDocs), you might have to print out a hardcopy to make the changes by hand.

If you have received a Notice of Claim you should firstly read the notice carefully to understand the details of the claim. There are very strict timeframes to respond to a Notice of Claim, so it is important that you contact a reputable law firm or your insurance provider to discuss the claim and ensure these timeframes are met and a proper response to the Notice of Claim is made.

MY CLIENT’S BANK WANTS CHANGES MADE. WHAT DO I DO?

WHAT SHOULD I DO IF I WANT TO DISPUTE THE NOTICE OF CLAIM?

WE WANT TO CHANGE THE PARTIES TO THE CONTRACT. SHOULD WE SIMPLY CROSS OUT THE OLD NAMES AND WRITE IN THE NEW?

Disputes must be handled within strict timeframes and in consultation with your solicitor or insurance provider. If as the respondent you dispute the Notice of Claim, written notice of the defects must be provided to the claimant. Your solicitor or insurance provider is best placed to write any disputes you may have regarding the notice.

Whether you choose to agree to the bank’s changes is a decision for you.

If you do, you can make the changes in handwriting initialed by all parties, or substantial changes can be agreed in a separate signed document (e.g. a deed of amendment).

No. We do not recommend changing the parties with simple handwritten amendments. You need to agree on all the parties’ rights and liabilities after the change. Will the new party fix the old party’s defects? Will the old party be paid for unpaid works they performed?

The contract itself might say how it can be amended. No room for complacency as QBCC crackdown continues

THE QUEENSLAND BUILDING AND CONSTRUCTION COMMISSION (QBCC) IS CONTINUING TO WRAP UP ITS SECOND ROUND OF ANNUAL REPORTING, HOWEVER, IT IS NOT OVER YET. THOSE CONTRACTORS WHO FAIL TO COMPLY MUST BE AWARE THAT THEY COULD FACE THE FULL EXTENT OF QBCC POWERS. Those who have not yet submitted their documents risk having conditions placed on their licence, suspension and even licence cancellation. At the time of publication, there were still about 10,000 Self Certified contractors who had not yet submitted.

These licensees are now at risk of the QBCC taking regulatory action.

Some examples of common issues that continue to catch out licensees include those who hold a company contractor and

an individual contractor licence needing to submit two Annual Reporting submissions.

Also, those who hold a contractor licence but are not currently contracting still need to submit their paperwork.

The QBCC has an online portal, but there is also an Annual Reporting Form that you can email across to make it even easier to comply and avoid a hefty punishment.

Those who have submitted their Annual Reporting will still be assessed by the QBCC for meeting the Minimum Financial Requirements (MFRs). The MFRs are in place to help keep the industry financially healthy, by working to reduce insolvencies and helping ensure that tradies and subbies get paid and consumers get their projects completed. The Annual Reporting submission helps the QBCC to identify contractors who are operating

with poor financial health.

If a licensee has been identified as operating under these conditions, the QBCC will be seeking compliant financial information. If the licensee is unable to comply, then they may follow up with suspensions and cancellations.

To avoid any possible suspensions or cancellations of your licence, ensure you monitor your financial obligations on a regular basis (QBCC legislation states you must complete quarterly) and consult your accountant or bookkeeper. Book in now to review your latest financial year tax and prepare for the round three of Annual Reporting.

HERE, KAREN SHARES SOME OF HER EXPERT ADVICE FOR ALL QUEENSLAND BUILDERS. Building with flood resilient techniques will minimise damage, possibly reduce insurance premiums and help owners move back into their home quicker after a flood event. Firstly, you need to understand the types of flood and where to obtain this information. Most local government planning schemes provide flood mapping and information on flooding like creek, overland flow, and river flooding.

Creek flooding can rise and fall quickly without warning. Overland flow flooding impacts localised areas, can be unpredictable, and its severity will depend on the amount of rainfall. If renovating, building a fence or a shed you will need to understand and consider these natural overland flows.

The level of river flooding will depend on the

speed and volume of the water. Properties downstream can be impacted hours after the rain event has finished. The impact on homes will depend on how close and high they are to the river. Storm tide flooding is caused by a storm surge or a king tide.

The most common building method is to raise the building higher than the flood level. This can be costly and prohibitive. The primary aim is to enable flood water to enter and leave with minimal damage. Therefore, other resilient building measures and design should be considered.

The wet-proofing design includes properly anchoring the structure, use of openings or breakaway walls, use of flood resistant materials and protection of mechanical and utility equipment. A registered structural engineer should be consulted if using this method.

Consider tank waterproofing to the lowerlevel internal area to protect the wall cavities and flooring. Resilient works could include replacing carpet with flooring that can be easily cleaned, for example vinyl or polished concrete. Elevate power points and data points and isolate power separate from the upper level. When replacing plaster board

sheets use wet wall sheets and upgrade windows and doors with materials that better resist flood water.

Alternatively, prevent the flood water from entering the building by using permanent or temporary flood barriers. This method will not be suitable where water depths are high as the risk of property damage may increase.

Importantly, when rebuilding, the existing building materials must dry out to the required moisture level. Depending on how long the structure has been under water you might need to engage a structural engineer.

Additionally, a building approval might be required, for example, replacing more than 20 per cent of a structural element, lifting a house to build under or changing the classification. The Queensland Construction Code part 3.5 Construction of Buildings in Flood Hazard Areas will require certain parts of the building to be above the defined flood level.

Family trusts: Should you use them in the building industry?

FOR YEARS, BUSINESS OWNERS HAVE USED FAMILY TRUSTS AS PART OF THEIR OVERALL TAX AND ACCOUNTING ARRANGEMENTS. TYPICALLY, THIS IS FOR FLEXIBILITY AND ASSET PROTECTION REASONS, BUT REGULATIONS UNDER THE QUEENSLAND BUILDING AND CONSTRUCTION COMMISSION (QBCC) LEGISLATION CONTINUE TO CATCH OUT UNWARY BUILDERS AND ACCOUNTANTS. Specialist QBCC regulation expert and CEO of Xact Accounting, Mick Renton, said that since the introduction of mandatory annual financial reporting, he has received an influx of enquiries from builders after their previous accountant unknowingly placed their licence at risk.

“There are a range of issues when it comes to family trusts in the building industry, most

of which are the result of an accountant not understanding how they are treated under the QBCC Minimum Financial Requirements (MFRs). This business-as-usual approach causes headaches for all parties, and can also lead to the suspension or even cancellation of their licence,” Mick said.

“A more effective trust structure could see the QBCC licence and other assets held in a Pty Ltd trading company, with the shares of that company held by the family trust. The trading company could then pay dividends to the family trust, with income distributed to beneficiaries at potentially lower tax rates.”

QBCC regulations are very specific when it comes to trusts, and do not take into account any assets within a family trust when calculating the net tangible assets (NTA) required for the licence.

Non-compliant licence holders looking for a remedy, could consider increasing the capital of the trust by legitimately gifting amounts to increase the Net Assets, ensuring simple items such as intangibles do not catch licensees out.

“Because of how trusts are typically structured, it doesn’t take much to breach MFRs. We often see intangible assets like goodwill and borrowing costs held in the trust, but in our industry these often small, intangible assets create the potential for a negative NTA position,” Mick said.

Be prepared: update on Queensland’s smoke alarm legislation NEXT PHASE OF 10-YEAR ROLLOUT COMING INTO EFFECT IN THE NEW YEAR. Are you a residential builder? Are you licensed to perform electrical work? If so, it’s time to prepare for the next round of changes to the state’s smoke alarm legislation, designed to make Queensland homes the safest in Australia when it comes to fire safety.

From 1 January 2022, all domestic dwellings, whether they’re leased or sold, will be required to have interconnected photoelectric smoke alarms in all bedrooms, in hallways that connect bedrooms with the rest of the dwelling, and on every level.

The existing legislation, which came into effect on 1 January 2017, requires interconnected photoelectric smoke alarms to be installed in all new and substantially renovated dwellings. The final phase will

kick in from 1 January 2027, ensuring the same type of alarms are installed in all other domestic dwellings.

Mediation available for construction delay concerns THE QUEENSLAND RESIDENTIAL CONSTRUCTION INDUSTRY IS EXPERIENCING AN AUSTRALIA-WIDE SHORTAGE OF BUILDING MATERIALS AND SKILLED TRADES, IMPACTING MANY SEGMENTS OF THE SUPPLY CHAIN AND AFFECTING SUCCESSFUL COMPLETION OF DOMESTIC BUILDING CONTRACTS. If difficulties in completing work happen because of material or labour shortages, the Queensland Building and Construction Commission (QBCC) encourages builders and tradespeople to communicate directly with property owners to try and reach agreement. If concerns are not resolved through conversation then mediation may be

considered as an option.

The QBCC has introduced a temporary independent mediation service to help address the challenges currently facing the residential construction industry. The Accelerated Builder / Consumer Dispute Framework (ABCD) matches applicants with a qualified mediator to help facilitate a conversation between the affected parties.

This service will operate until mid-year 2022.

Superannuation stapling STAPLING IS AN AMENDMENT TO SUPERANNUATION LEGISLATION THAT WILL CHANGE THE WAY EMPLOYERS ADMINISTER SUPER FOR NEW EMPLOYEES. Stapling will apply to employees starting employment on or after 1 November 2021.

From this date employees will have their existing super account ‘stapled’ to them as they change jobs, stopping the creation of multiple accounts that reduce employees’ retirement savings.

Stapling will change the process an employer needs to follow to set up super for a new

employee who doesn’t return a choice of fund form.

When a choice of fund form isn’t returned, employers will need to log into the ATO’s online service, enter the employee’s details to find their stapled super account and pay the employee’s super into that account.

Employers will still need their default fund to create accounts for employees who don’t choose a fund or don’t have an existing Super fund (e.g., an employee starting their first job).

Searching for an employee’s stapled account will become an automated process between payroll systems and the ATO in 2022.

Stapling will need to be applied to new employees starting work from 1 November 2021. Full details on how stapling will work and need to be administered by employers should be available soon.

Dozens of industry heavyweights were on hand at the Brisbane Convention and Exhibition Centre as Minister de Brenni outlined his priorities for the issues impacting our residential and commercial sectors, including trade delays and material shortages which are continuing to bite.

“We’re incredibly conscious of the tremendous challenges builders are facing right now,” the Minister said. “I’m conscious that many builders have felt overwhelmed.”

After months of tireless lobbying by Master Builders for a fair go for builders and their clients suffering through no fault of their own, the Minister announced the Accelerated Builder Consumer Dispute (ABCD) process at the event.

“What this is about is a framework for builders and consumers to sit down and talk together,” he said.

“What Master Builders have told us is critical is that we avoid homeowners rushing to cancel contracts…we don’t want to see a wave of bankruptcies out there for builders.”

Deputy CEO Paul Bidwell then led the Q&A session, kicking off by raising the possibility

of developers being licensed by the QBCC, before the topics of project trust account changes, the 2022 National Construction Code, and the proposed changes around accessible housing were raised from the floor.

The event wrapped up with our CEO Grant Galvin rising to the Minister’s challenge, throwing his weight – and arms – behind the Push-Up Challenge, raising vital funds to support mental health programs in the local community. Grant ended the victor, beating the Minister by one by doing 53 push-ups on stage in front of the crowd.

Hannah Ockendon, HSE Advisor at Paynters started out in an admin role there in 2019, and had always wanted to work in a field where helping others was a big part of the job.

Our one-day course (with online assessment) will give you the skills needed to legally test and tag your own electrical equipment or equipment within your workplace. Plus, it gives you the qualifications you need to apply for your Restricted Electrical Contractors Licence (test and tag) through Work Safe. This allows you to test and tag equipment for others or contract your services.
