Welcome to the 2019 MSBA Legal Summit & Annual Meeting in Ocean City, Maryland! Our Board, Sections, Committees, and staff have worked extremely hard to bring you an action packed week, filled with programs for all members of the legal profession!

The 2019 MSBA Legal Summit & Annual Meeting will kick-off at noon on Wednesday, June 12, 2019 with pre-conference workshops. At 1 pm, we will introduce our slate of keynote speakers, including Former United States Deputy Attorney General, Rod Rosenstein, Maryland Attorney General, Brian Frosh, D.C. Attorney General, Karl A. Racine, Former Maryland Attorney General, Doug Gansler and CNN Chief Legal Analyst, Jeffrey Toobin. We will also be hosting family friendly events and health & wellness seminars at this time. Wednesday evening will feature a host of networking opportunities, including the First-Time Attendees Reception, the Welcome Reception, and a fan favorite, the Crab Feast at Hooper’s Crab House (additional ticketed event - transport provided).

On Thursday and Friday, you’ll find a multitude of programs relevant to your practice, your sector of the legal profession, and your career. In addition, we will be featuring a “Thought Leader Series” to provide programming on emerging areas of law, panels from various legal sector, and perspectives on issues facing the legal profession. As always, networking opportunities and family friendly events are woven into the schedule. Thursday evening will be highlighted with the President’s Reception, and Friday will close with the Executive Director fundraiser “Justice Rocks” benefitting the Maryland Access to Justice Commission (separate ticketed event).

Our Exhibit Hall will open at 11:30 am on Wednesday, and continue through Friday at 4:00 pm. Be sure to visit our many exhibitors to learn how they can help you in your practice and your career. In addition, other daily activities include fitness programs (6:45 am bootcamp, and 3:00 pm afternoon yoga), health screenings brought to you by the MSBA Lawyer Assistance Program, and more.

Saturday morning our event comes to a close with the Business Meeting and installation of the 2019-20 MSBA President, Dana Williams.

MSBA CLE: Raising the Bar For Education Many of our educational programs have been accredited, please see the handout included in your registration packet for a full listing of accredited programs.

Please stop by the MSBA CLE booth to receive a Uniform Certificate of Attendance prior to attending any MSBA educational program. All certificates must be returned and signed by a staff member at the conclusion of each seminar you attend. For Pennsylvania MCLE, a $2.00 charge will be assessed for each credit hour and partial credit hour. Not all programs will carry VA credit.

Three quarters of domestic merits cases in Maryland involve either one or two self-represented parties. While some of the parties are very poor, many would like to be represented, but cannot afford the traditional fullrepresentation model. In 2016, Maryland attorneys Joanna Shapiro and Dave Pantzer developed the Maryland Custody & Divorce Client Workbook, a document organization and caseflow tool designed to give attorneys a safer, easier way to evaluate and accept limited scope family law cases. In the subsequent years, this tool has been used in several counties, and has been studied and

The most recent shutdown of the federal government was the longest in U.S. history, lasting from December 22, 2018 to January 25, 2019. Join the Administrative Law Section as we explore the lingering Constitutional and administrative law concerns related to the 2019 shutdown, including whether forcing federal employees to work without pay violates the 13th Amendment to the U.S. Constitution (and whether the end of the shutdown moots the issue), and the President’s ability to declare a national emergency.

The application of the Free Speech Clause of the 1st Amendment to the new technology of social media raises novel issues for elected officials in 2019. When drafting the 1st Amendment in 1789, James Madison could not have predicted that a government official could abridge a stranger’s right to free speech by clicking the delete button on a computer in her living room. In January 2019, the US Court of Appeals for the 4th Circuit ventured into these novel issues for the first time in Davison v. Randall and ultimately raised new issues for all government officials.

We plan to look at this case and some of the issues that are yet to be resolved.

Counteracting the Invisible: Implicit Bias in the Courtroom CONFERENCE ROOM 5

From influencing how we read the friendliness of facial expressions to who gets called back for an interview, implicit bias (i.e., unconscious attitudes towards people or groups) skews both perception and decision-making in a variety of ways. MRI imagining has revealed that the brain’s amygdala (the part of the brain that reacts to fear) plays a key role in implicit bias. During the adrenaline of a trial, where parties clash in stressful, emotional, and at times vicious ways, implicit bias may impact both your lawyering as well as the perceptions of the judge and jury.

Learn more about implicit bias and increase your litigation savvy by learning where and how it may affect your case.

Best Practices for Creating a Culture that Will Attract and Retain Diverse Attorneys CONFERENCE ROOM 4

Lawyer marketing began with simple print advertising in telephone directories and newspapers; progressed into television and radio commercials; and grew exponentially with the advent of the internet with all its promotional opportunities: individual and firm websites, search engine optimization campaigns, key word auctions, pay-per-click ads, online lawyer directories, and social media. Regardless of the form of marketing employed by the lawyer, the Maryland Attorneys’ Rules of Professional Conduct apply and this can lead to unrecognized and unintended ethical issues. An attorney may not even recognize that something he or she placed into cyberspace may be viewed as advertising under the Rules and subject the attorney to discipline. Moreover, the growing use of social media is rife with opportunities for legal professionals unwittingly to violate the Rules of Professional Conduct.

In this seminar, Timothy Bojanowski, an expert in lawyer marketing, will offer a nuts and bolts presentation on how lawyers market themselves on the internet and in social media. Maryland Bar Counsel, Lydia E. Lawless, will examine the ethical considerations for marketing a law practice.

Alvin I. Frederick, a highly respected and experienced attorney who defends lawyers in grievance actions and against claims of legal malpractice, will address the ethical perils of social media. A panel discussion will follow with an opportunity for audience questions.

Diversity and inclusion is a “hot topic” in the legal industry these days. But, what does diversity & inclusion mean?

Aren’t they the same thing? During this session, Kia Scipio— Diversity & Inclusion Manager at Fish & Richardson P.C., will discuss what diversity and inclusion are and how Fish has approached embedding both in the programs, processes, and culture of the firm.

Immigration law in the United States has long contained exclusion and removal provisions designed to limit

government spending on indigent non-U.S. nationals (aliens). Under the Immigration and Nationality Act (INA), an alien may be denied admission into the United States or adjustment to lawful permanent resident status if he or she is “likely at any time to become a public charge.” An admitted alien may also be subject to removal from the United States based on a separate public charge ground of deportability. The INA’s public charge provisions have drawn heightened attention recently in light of indications that the Trump Administration intends to establish new rules for their interpretation and application. This panel will provide answers to frequently asked questions about new public charge policy implemented by DOS and DHS, including the sources of laws that govern public charge determinations, who is subject to determinations, factors that are considered in determinations, and the consequences of determinations.

Southbound One, Inc., 2015 WL 401251 (D. Md. Jan. 26, 2015), for its use of the mark, SHOREBILLY. Spoiler alert: Mr. Robinson won and was awarded attorneys’ fees. The appropriateness of the company’s response can potentially help the company avoid liability, maintain a customer relationship, and protect its image, among other things. Thus, it is important to develop appropriate procedures for conducting investigations. Topics for this presentation include identifying reasons why investigations may be conducted, developing strategies for structuring investigations – from understanding how investigations are initiated (e.g., intake process, or responding to a lawsuit or public relations matter), to identifying potential investigators (including the role of legal counsel), and forming strategies for fact gathering and evidence preservation – and developing resolutions for the matters being investigated.

Since the April 2018 arrest of the alleged Golden State Killer, law enforcement investigators have made arrests in a remarkable string of cold cases. In each case, investigators compared preserved crime DNA to other DNA profiles in an online genealogy database. These searches, in turn, uncovered partial genetic matches to known but distant genetic relatives of a putative suspect. Through sleuthing in the resulting family tree or trees, investigators have been able to identify suspects for investigation and, in some instances, arrest. But is this use of consumer genetics databases legitimate, legal, or good policy? How should Maryland respond to police use of this new method of investigation—particularly in light of Maryland’s statutory prohibition of familial DNA searches in the state’s official law enforcement DNA database?

Our legal system, at its core, is based on the resolution of conflict; the parties involved can be individuals, groups, entities, and/or the State. The Enneagram Personality System is a tool that allows us to see ourselves and others through the core motivations that drive us. An understanding of these core motivational patterns reveals how different personality types fall into and approach conflict.

Recognizing these distinct conflict styles and then addressing the appropriate motivations and patterns driving the conflict make an effective tool in facilitating amicable resolutions. This class offers an introduction to the nine basic types or styles of coping. Understanding the different styles and the core motivations that drive them is useful in assisting lawyers, fact finders, and anyone who interacts with other personalities understand them with more accuracy and clarity. This tool is also very useful in understanding ourselves, our motivations and our relations with others and conflict situations.
