The bungling former owners of a defunct building firm may face criminal charges for fraud.

Rose Built Homes, which folded in September, has left Marlborough businesses out of pocket to the tune of $1.6 million.

Appointed liquidator Brenton Hunt revealed creditors were

unlikely to see any money back, branding the case “one of the worst” he has seen in 25-years.

Treating the company as a “personal cash cow” could see former directors Ryan Butler and Kyle Payne in court, he says.

And the former directors have turned on each other, with Kyle blaming some of their dodgy dealings on his colleague’s “gambling problems”.

Brenton says he can’t stop Kyle from leaving the country.

“I can’t stop him traveling until I actually have judgement against him, and even then, a border alert would require details of his actual flight,” he says.

“Regardless…he can still be bankrupted here in New Zealand.”

Local contractors and businesses

have been left high and dry, with one secured creditor owed more than $500,000.

Investigations uncovered a raft of costly personal purchases bought using company funds.

Boats, motorcycles and cars bought on finance were being paid from company accounts but registered to the company directors.

But Brenton says he doubts any money will be paid out to any

class of creditor.

“There were very few assets to be collected. Some office equipment and limited tools were collected from the office.

“The majority of these were returned to Christchurch and sold

by Mainland Auctions, limited amount were sold to interested parties in Blenheim.”

In addition, Kyle traded a company asset, a Ford Mustang, on an Audi he recorded as his personally.

“The Audi still has a significant amount of finance over and above the trade-in value,” Brenton says.

Tax payments are “well behind” with no annual accounts ever produced.

Brenton says Kyle tried to blame the lack of tax payments on the company’s accountant, however, it is the director’s responsibility to file returns.

PAYE had not been paid since December 2018.

In an interview with the liquidator, Kyle says he was not aware

that non-payment of PAYE was a criminal offence.

“A huge amount of personal expenditure was coded in the company records as business expenditure and GST attempted to be claimed,” Brenton says.

“I have been working in insolvency for ten years, and as an accountant for over twenty-five years.

“Rarely have I seen company records in such a bad state.

“It has been very hard to work out anything from the records kept so I have had to go back to bank transactions.”

GST had not been filed since March 2019 or paid since May 2018.

Brenton says Kyle had appeared to have committed “several items” of fraud and a creditor has offered to assist in filing a criminal complaint to police for fraud.

“Insurance records have been altered to allow customers to make drawdowns.

“Customers have been asked to pay into bank accounts which are not company bank accounts and various customers and creditors have been lied to repeatedly,” he says.

“After recoding a lot of the expenditure which Kyle Payne had recorded as business expenditure but was paid to his own bank accounts, I have made a demand for $335,739.

“I have had no response to this demand so are now commencing judgement against him for this debt.”

Kyle sold his house, on Howick Road, in September.

Brenton says Ryan was cooperative during the liquidation.

“He is apologetic for where everything has ended up and claims

he never knew just how bad everything was.

“Regardless of his regrets he was a director and personally guaranteed several of the debts.”

Brenton says Ryan is looking into bankruptcy.

“As there has been very limited recovery from the company, I am funding a lot of the continued work for the liquidation myself.”

Brenton says the only asset of the company is the money which the directors had withdrawn in various ways.

“The likelihood of recovery of this for creditors is fairly remote so it is not anticipated any distribution for any class of creditor will happen.

“Regardless of this I will continue with my action against the director and see what comes out of it.”

Glass half full for first female wine CEO Paula Hulburt

Final preparations for Marlborough’s longest running fireworks display are underway. Pupils at Whitney Street School in Blenheim are working hard on the finishing touches for an array of fun games for the big night. The annual fireworks event has been a highlight on the community calendar since it first began in 1983. The popular show has raised hundreds of thousands of dollars for the school. A Marlborough wine company has become the first in the country to appoint a woman CEO. Yealands Wine Group has announced the appointment of Tiffani Graydon as their new chief executive officer.

The company’s former sales general manager has returned to the Seddon-based business to take the top job.

“I like to think I was chosen as CEO because I am the best person for the role, irrespective of gender.

“Perhaps the real advantage of any woman in a consumer goods focused business today is that because we make up a large proportion of the ‘buyer population’, we can often bring new ideas to the table which reflect a shopper’s perspective on the category,” she says.

Tiffani, who has taken over from Adrian Garforth, will divide her time between Marlborough and Auckland. The Savignon Blanc fan says she is looking forward to being in Marlborough “Two of my children are still in school, one attends the University of Auckland and my husband runs a well-known, NZ-owned umbrella business, so they are very much entrenched in their day-to-day lives in Auckland.

“We certainly look forward to

spending some more time down in Marlborough however, as there’s plenty for us to do and explore.

“My plan is to work from our Seaview Estate Winery in Marlborough on a regular basis and I consider myself lucky to have two fantastic work sites to choose from,” she says.

Tiffani has worked in the wine industry for 25 years. She began her industry career at Montana Wines in the mid-1990s and has worked in New Zealand and overseas, including Shanghai in China.

Returning to New Zealand in 2009 she joined Pernod Ricard Winemakers and held several senior executive roles within the company.

The psychology major says she is poised to help shape the company’s role as a leader in sustainable winemaking.

A flexible approach is key, she says.

“I consider myself incredibly lucky to have worked in businesses where performance has been recognised and there is a strong commitment to work-life balance and flexible working arrangements.

“Over the years, I’ve tried to pass this philosophy on to my teams, whether it be mums returning to work or team members who have external commitments to sports or other things.

“When you have a high degree of mutual trust, this tends to work well, Tiffani says.

The family of missing woman Jessica Boyce want people to share her photo on social media to help shame her killer into coming forward.

Jessica’s cousin Aaron Goodwin has posted a new profile pic of the smiling Renwick woman, who disappeared on March 19.

He urged people to share the photo in the hope it would prick someone’s conscience.

In the post he says how he hopes

the post would propel people to come forward.

“Beautiful Jess. Keeping her as my profile photo in solidarity with investigators and everyone else trying to get justice for Jess.

“Hopefully seeing Jess everywhere might break the conscience of whoever is involved and propel them to come forward.

“Anything’s worth a shot, eh? If anyone else wants to do this, even just for 48hrs it would be really cool to her smiling face everywhere,” he wrote.

Possible forensic evidence relat-

ing to the homicide investigation has been seized by police from a Blenheim home.

Police working on Jessica’s disappearance searched a house on Warwick Street and another on Henderson Street last week.

Detective Senior Sergeant Ciaran Sloan says the occupant of the Warwick Street address was spoken to by police on Thursday, but no arrests have been made.

“A second warrant was executed at a Henderson Street address and samples of potential forensic value were seized.

steadily working through inquiries that have been generated from that information,” he says.

Forensic scientists from crime scene specialist firm ESR assisted police at both addresses.

Jessica was last seen in a red Holden Rodeo ute in Renwick.

The ute was found three days later at the Lake Chalice car park in the Mount Richmond Forest Park but police bosses think it was left there deliberately to hinder the investigation.

Detective Senior Sergeant Sloan says enquiries are ongoing.

Lauren says all money raised will go towards operating the community space.

“It’s not cheap,” Lauren says. “It costs around $11,000 to $14,000 per month to run.”

She says money will go towards food costs, electricity and providing internet to their customers.

“If this goes well, we’re aiming to do this annually.”

Lauren says there can be “confusion” from members of the public about what service Crossroads pro-

vides to the service – so volunteers will also be handing pamphlets to give people a “better idea” about their core role.

The Blenheim Lions, Beavertown Lions and SBS bank staff have volunteered to collect funds from the public around the Blenheim CBD. But Lauren says they are still looking for volunteers to help on Scott St. “Two hours would be awesome, but an hour would be fine,” Lauren says.

Edwin Fox families celebrate Paula Hulburt Descendants of the first passengers to arrive in New Zealand on the famous ship, the Edwin Fox, have gathered to mark a milestone in maritime history.

New bonds were formed as families united at a special gathering at the Edwin Fox Maritime Museum in Picton.

And some of the guests discovered distant family members there that they didn’t know about.

People from across New Zealand and Australia gathered in Picton for the muster, which proved so popular it could become an annual event.

Organiser and maritime museum manager Karen McLeod says people met with family they didn’t even know about.

“Attendees were able to meet extended family members they had no previous knowledge of and we were lucky to receive further information and photographs of the original passengers.

“It was a great weekend with a full itinerary, including a Marlborough Sounds cruise with Marlborough Tour Company and finishing off with the community fun day on the foreshore,” she says.

The event was so successful it could be held every year, Karen says.

More than 1000 immigrants, crew and convicts arrived in New Zealand.

The Edwin Fox was chartered by Shaw Savill Company in 1873 to

carry immigrants to New Zealand from England.

She was to make four such voyages carrying a total of 751 passengers to the new colony.

Visitors to the event enjoyed an evening gathering at Endeavour Park Pavilion where they were

treated to a talk from one of the ship’s original salvage crew, Chris Brown, and speakers from Marlborough Heritage Trust.

Karen says a lot of people worked hard to make the occasion special.

Hundreds of school speeders stung in traffic operation A recent speed sting has left Marlborough police “disappointed” with hundreds of drivers flouting road rules.

Almost 300 tickets were issued in four hours last Tuesday to motorists speeding past Marlborough Girls College on Nelson Street in Blenheim.

New Zealand Police Marlborough prevention manager senior sergeant Peter Payne says the result is “incredibly disappointing”.

Mother-of-two Tracey Phillips says it is “just a matter of

time” before someone is seriously injured or killed outside the high school.

“I sit there every day waiting for my daughter and it makes me cringe how fast these vehicles go,” Tracey says.

“It’s a ridiculous, crazy situation and I don’t know why they can’t slow down; I think it’s getting worse too.”

Her concerns come as New Zealand Transport Authority reveal a planned pedestrian crossing controlled by traffic lights may be shelved.

Rubbish success: A free dumping day in Blenheim saw a massive 71 tonnes of rubbish collected.

An initiative by Marlborough District Council to help combat illegal fly tipping saw hundreds of people queue for up to 45 minutes to get rid of their rubbish at no cost. Crews worked hard to get people through as quickly as possible. On the same date last year, the dump took in 18 tonnes.

4G network comes to Canvastown: Plans have been submitted to council for a new 10-metre tower in Canvastown to provide the township with 4G cellphone and internet connectivity.

Thousands of people are expected to descend on Picton’s Foreshore next week as the Tuia 250 dual heritage flotilla is welcomed to Marlborough.

Tōtaranui 250 Trust is responsible for Tuia 250 commemorations in Marlborough, and will begin events by transporting 550 people to Meretoto/ Ship Cove in Tōtaranui/Queen Charlotte Sound next Thursday, November 21.

There, the flotilla, made up of crews from Tahiti, New Zealand and Australia, will be officially welcomed to the region, where many of the first encounters between Māori and European settlers took place 250 years ago.

Four waka, crewed by members of local iwi will greet the flotilla, which is central to Tuia 250 events and celebrates extraordinary feats of navigation and voyaging by Māori, Polynesian and Europeans.

The flotilla, accompanied by the local waka, will continue into Picton on Friday, November 22, ahead of the public portion of this once-in-a-lifetime event.

The vessels will be visible from the foreshore from 10am and the arrival will be followed by a formal welcome by Marlborough Mayor John Leggett and entertainment from 12pm2pm.

During the evening, families are encouraged to take a walk along the foreshore to experience a mesmerising 3D light installation projected onto the War Memorial.

It will also show the Endeavour’s circumnavigation of Aotearoa, marking the first encounters between Māori and Pākehā.

Up to 10,000 people are expected to gather at the foreshore on Saturday, November 23 for a full day of entertainment.

Beginning at 10am, there will be food, live entertainment including headline act Fly My Pretties, and an opportunity to explore the Tuia 250 flotilla vessels and meet the crew.

Children and families will have the opportunity to take part in fun and engaging activities with the Tuia Mātauranga Roadshow, as well as to learn about Pacific, Māori and European sailing and navigation traditions through interactive activities, displays and a star navigation dome.

A mobile app, Tuia Mātauranga will help with the roadshow on the day.

A Kete Kai Street Market on Picton’s High Street will be staged as a contemporary Māori Pā and will showcase traditional Māori ingredients along with a diverse range of cuisines from all over the world.

The Interislander 3D light show will once again be on display before Fly My Pretties take the stage at the free concert on the Foreshore.

Tōtaranui 250 Trust will be operating a bus service from the Blenheim Railway Station for Saturday’s evening events.

Buses will depart the railway station at 6pm and return from Picton iSite at 11pm. Return tickets cost $10 and can be booked at totaranui/250.co.nz/ events.

Commemorations will continue on Sunday, November 24, when the public is invited to bring a picnic and enjoy a relaxed day visiting the flotilla, learning about navigation and conservation and visiting the Tuia 250 Mātauranga Roadshow.

Relaxed beachside motorhome show attracts new exhibitors For over 10 years, the Rotary Nelson Motorhome Show 2019 has been held at our region’s idyllic motor camp by the beach, attracting more than 2000 people annually, with all monies raised going to charity. The event showcases New Zealand’s leading motorhome, campervan and caravan suppliers and designers, with new and used privately owned motorhomes also available for sale and lease. RAAM legend visits Marlborough Peter Jones The man widely regarded as the king of the world’s ultra-distance cyclists celebrated his 37th birthday in true Kiwi style - with a backyard BBQ in Blenheim.

Christoph Strasser, six-time Race Across America [RAAM] solo champion, was in Marlborough at the invitation of local endurance rider Craig Harper and enjoyed a birthday BBQ at his Kiwi rival’s home on Monday.

The pair met during the most recent RAAM - Strasser’s ninth attempt at the iconic race and Harpers’ first - after which the Kiwi invited the Austrian cycling legend to visit New Zealand, a trip that had always been on Strasser’s radar.

He duly arrived for a five-week trip around the country, with partner Sabine, taking a wellearned break from the rigours of training for some of the toughest sporting challenges on the planet.

Strasser was unstoppable in the 2019 RAAM, finishing nearly a day and a half in front of his nearest rival - going west to east in eight days, six hours, 51 minutes.

Harper produced an outstanding rookie effort, coming home fourth among the solo riders, crossing the finish line in 10 days, 15 hours.

Strasser described the 2019 RAAM as his “hardest ever”, due to extreme weather issues, which involved flooding, detours and periods of constant rain.

He has previously been quoted as suggested that the key to conquering the RAAM is, “one third body, one third mind and one

third support team”.

“That’s my personal formula, but of course everyone is different. In my first years I was thinking that there is much more happening in your mind, but over the years I found out that physical fitness is very, very important because it is your body that allows you to go fast or to go slow. He said his RAAM recipe was, “a combination of being fast and keeping your breaks really short”.

In the 2019 race he closely monitored his breaks, sleeping just eight and a half hours over the course of the race, among a total of 15 hours “off-bike time”, which includes toilet stops, red lights and road works.

“It’s nearly the minimum,” he suggested, “it would be hard to improve on that”.

In recent years Strasser has become used to having a target on his back at the start line, but says, despite his favouritism, he felt no pressure to prove anything.

“I never talk about my goals [beforehand], the most important thing is to reach the finish line and stay healthy … even if you have won the race several times you can get sick and DNF the next time.

Strasser does not intend to ride the RAAM in 2020, but has another target on his radar.

He is the current holder of both the world track and road 24-hour records, 896km on the road and 941km inside, and want to go further.

“I hope to be able to get 1000km in 24 hours one day, maybe in the upcoming season, but it will take a lot of organising.”

He is unlikely to race in New Zealand, although quickly developing an affinity with the country.

“I was very impressed with Craig’s north to south crossing.

Before we got to know each other this year I was reading about his achievements, because I want to know about my competitors, and I didn’t realise how difficult [The Long White Ride] actually was, with such narrow roads and constant ups-and-downs.”

The man, who ironically was born the same year as the first RAAM, feels he has a good work/life balance and is relishing his lengthy break.

“I can do five weeks off the bike, so I am not a cycling junkie.

“I may gain three kilograms but it doesn’t matter because when I start training again I will soon be in shape.

“This is just about meeting great people, seeing a great country, having a beer here and there and thinking about other things than cycling.”

Seven young Marlburians were helped along their career paths

by Inspire Foundation Marlborough on Thursday evening.

The Foundation’s fifth grantee evening, at the ASB Theatre, provided a timely financial boost for a group of the region’s high-achieving youngsters, bringing the total number of 15 to 23-year-olds helped by the foundation to 29.

Six were of the second group of 2019 grantees were sportspeople. Rower Kobe Miller represented New Zealand at the jun-

ior world champs, cross country runner Lucy Harman was named in the NZ schools team to attend the world champs next year while cyclist Ethan Batt represented his country at the world under-23 road champs.

Swimmer George Glover has shone competitively plus through his work for the charity I Am Hope, while Jack Bugler has set a host of new para swimming records and PBs, before competing at the 2019 INAS Global Games.

A re-grant was awarded to squash player Quinn Udy, who continues his steady climb up the national ranks, now based in the US. New to the grantees

list was environmentalist and youth leader Shannon McLean, who is a New Zealand delegate for the United Nations Global Development Tour.

The Foundation encourages applications from sports people, music students, all the arts and those with academic achievement who want to go on and make a real difference in their field of excellence of science, design, sport, technology, entrepreneurial and/or innovation.

Guest speaker at the grantee evening was Bradley Hook from the Resilience Foundation who held a workshop the previous evening.

Two tight scorelines marked the latest round of the Marlborough Tennis Association’s Wine Brokers NZ premier competition on Wednesday.

Both games were decided 5-4, Rapaura Wairau Noir defeating Marlborough Forrest Wines on the Rapaura grass courts and Rapaura Wairau Blanc overcoming competition leaders Renwick CPR at Pollard Park.

Noir took out two of the three doubles, Glen Cameron and Adrian Bryant winning, as well as Ross Charlton with Eveline Apthorp.

The singles were shared, with the Geris brothers, Luca and Jay, producing strong performances on the grass to keep the Marlborough side within range of victory.

However, Hamish McRae’s win over Hamish Morrow, plus late victories to Charlton and Apthorp saw the home side prevail narrowly.

In Blenheim, Rapaura Wairau Blanc took advantage of a depleted Renwick combination to pick up some valuable points.

Three matches were defaulted, putting Renwick well behind the eight ball from the outset, but Mieko Kimura and Daniel Riordan won the mixed and both prevailed in

singles to keep the leaders in the game.

However, a double win to Ben Burridge and Hiro Kishida, plus a singles victory by Stephen Dempster saw Blanc take the win.

Tennis trophy back in Marlborough Peter Jones The historic Lucas Cup is back in Marlborough hands.

The much-coveted tennis trophy, which has been at stake between senior players from Marlborough and Nelson for 70 years, was recently contested in Nelson.

Marlborough came away with a 10-6 overall victory, bringing the cup back across the Whangamoas for the first time since 2005.

The doubles matches which started the day were tightly-contested,

Marlborough losing both the men’s encounters but the female combinations of Jade Otway and Eveline Apthorp, plus Sina Walter and Mieko Kimura both getting home in super tiebreakers.

Marlborough took control in the singles, winning six of the eight match-ups.

Otway’s return was a key factor, the NZ junior rep winning all her three matches, as did the consistent Apthorp.

“I have been trying for seven years, since I returned to Marlborough, to bring the trophy back so it was a special moment for us to finally get our hands on it.

“Our win was the result of a strong team performance across the board, everyone played their part.”

Sport Top-class entertainment: Two high-profile sporting events, designed to kick off their respective competitions, will be played in the top of the south early next year. On February 1, the Crusaders’ 2020 Super Rugby season begins with a match in Nelson, the defending champs scheduled to tackle the NSW Waratahs at Trafalgar Park, kick off 7.05pm. Closer to home, at Blenheim’s Stadium 2000, two of netball’s ANZ premiership rivals will do battle in the first round of that competition on Sunday, March 15. The Pulse, defending champions, will meet the Tactix in the opening round encounter with a 4.10 start.

Female cricketers wanted: A Festival of Women’s Cricket will take place at Horton Park on Sunday, December 8. The tournament, which involves six-a-side teams playing a one-day format runs from 10am until 4pm and is open to all female players over 13 years of age. It offers a chance for those who have not played the game to give it a go. Cost is $10 per player or $60 per team, entries to chicksdigcricket@gmail.com.

There will be prizes on offer for the winning team, the fastest bowler and biggest hitter. The event is designed to raise funds to support the sport at Marlborough Girls’ College and Bohally Intermediate.

Women’s cricket is on the rise in Marlborough.

Over the past two season the MCA have staged a social women’s competition and will do so again, starting January next year. This season there is a fifth grade girls-only team, over 50 girls playing cricket in the Harcourts Superstar Kiwi cricket girls-only competition, for years 3-6, and more than 40 girls participating in Superstar cricket, for years 0-2.

Rain scuttles trophy match: The Marlborough senior cricket team’s first hit-out of the season fell victim to West Coast weather. Sunday’s scheduled encounter between Marlborough and Buller for the Scanlon/Stretch Trophy was called off on Friday due to a particularly wet forecast.

The match was seen as an ideal warm-up fixture for both associations, with Marlborough hosting Nelson on Sunday, November 17, when they defend the Newman Shield.

Athletes frustrated: Marlborough’s young athletes were denied a chance to compete on home turf when the annual Hester Shield children’s athletics meeting, scheduled for Athletic Park on Sunday, was cancelled due to inclement weather. Marlborough Athletics summer season membership numbers have already exceeded last year, reaching 172 members to date.

The Renwick men’s sevens team made the most of home field advantage to take out the second leg of the Turf Hotel Tasman sevens on Saturday.

The Green Machine beat a dangerous Wanderers side in the men’s cup final, prevailing 15-5 at the Renwick Domain. Earlier, in the semifinals, Renwick accounted for Kahurangi 49-5 while Wanderers beat Waimea Old Boys 24-5 in the other.

The men’s plate final was won by Marist, who downed Central 24-12, leaving the Blues in sixth position. The men’s play-off for third and fourth was won by Waimea Old Boys, who downed Kahurangi 15-12.

The women’s title was won by Waimea Old Boys, who beat Wanderers 32-14 in an entertaining final. Waimea added the second leg crown to their triumph in Motueka last weekend, meaning they take the overall title.

At 105-6 the visitors were probably just in the ascendancy. At this stage Stoke Nayland skipper Brendan Hodgson joined the in-form Paddy Howes in a 121-run onslaught. Hodgson attacked from the outset and dispatched five sixes and two boundaries in his 70-ball innings. Howes was unstoppable as he combined beautiful stroke play, brute strength and inventiveness in his second century of the season. He struck 17 boundaries and four sixes in his 135-ball undefeated knock.

Tom Cross gave the run chase a sound enough beginning but wickets fell regularly around him.
