Trusting, that family membersâ€™ objection will in any event prevent the desecration of departed relativesâ€™ remains, they see no need to opt-out of the NHS Organ Donor Register. Some people may wish to brand the writer of these lines as a scaremonger or doomsayer. However, it is hoped that those seeking the truth will henceforth be inspired to opt-out, sparing themselves and their family much needless aggravation. Transplants from Deceased Donors Facts & figures: Introduction: It is not without good reason, that the authorities are insistent on carrying out post mortem autopsies to establish the cause of death. Over the past decades, the media has frequently alerted the public to serious allegations, accusing doctors and medical staff of purposely terminating patientsâ€™ life. The Human Tissue Authority (HTA) was established by the Human Tissue Act 2004, following the discovery of establishments removing and retaining human organs and tissues without consent1. Sadly, some people have great faith in 48

There are currently two categories of human body parts, that are commonly used for transplant purposes in the UK. Those classified as organs, e.g. hearts, livers, lungs, kidneys, etc. And those classified as tissues, e.g. eyes, heart valves, arteries, skin, bones, tendons, etc2. Transplantation of limbs, are classified as novel- transplants, and are as yet a rarity. The body parts retrieved from one single dead person, can potentially be used for more than fifty live transplant recipients2. Organs can only be donated by someone who has died in a hospital. Usually these patients are in the ICU

or A&E, and are declared brain dead (but Halachically alive) or die despite medical treatment, generally as a result of a brain haemorrhage, major accident, or stroke2. Tissues on the other hand, can be taken from almost anyone and retrieved outside the hospital2, e.g. from a morgue. Some of these are stored in a freezer at -135Â°C /-211Â°F, until purchased by a medical practitioner or hospital3. Delivery is by recorded next day delivery Postal Service or by courier3 (see appendix). Heart-valves can be stored for up to ten years, eyes for one year, and all other tissues for five years4. It is the NHS policy, that any organs or tissues retrieved from donors or potential donors, which are not used for transplantation, will be incinerated, and disposed of as clinical waste5.

To quote some figures; In the financial year 2017/2018, 4044 organs from 1574 deceased donors, were transplanted6, and 2962 eye donations were received by the NHS7.

When including potential donors, the figures are much higher.

NHS Campaign: The NHS claims, that out of the approx. 6000 people currently waiting for an organ in the UK, three people die every day while on the waiting list8. The NHS has therefor spent millions campaigning for people to become organ donors. The NHS may not remove any organs or tissues from a person who opted out of the NHS Organ Donor Register (ODR) while still alive1. When optingout, one must provide name, date of birth & address. Whereas; Gender, phone number, email address, ethnicity, etc. are entered onto the ODR voluntarily4. The NHS advises that it cannot accept responsibility for inaccuracies, when not made aware of changes in circumstances9. Will a person who opted out today, remember fifteen years later whilst moving to an old age home, that he must register the

change of address on the ODR? So why does the NHS not allow National Health & National Insurance numbers (that unlike an address, do not change) to be entered on the ODR4? The ambiguous and misleading information displayed on the NHS website and conveyed orally by the NHS Blood and Transplant staff & executives, has mislead many community members, making them believe; that relatives can object to organ donation, even where the deceased chose to donate or did not opt-out. Some even assumed, that it is obligatory for the NHS to request permission from the family!

Let us have a look at what the law says. Law & Guidance: In accordance with para. 1(4) Organ Donation (Deemed Consent) Act 2019, a person is deemed to have consented to the retrieval and storage of organs & tissues for the purpose of transplantation, unless a 50

relative or friend provides information which clearly shows that the deceased would not have consented. Alas, even where family do provide such information or can show that the deceased made a decision not to donate, it is no simple matter as to what will be accepted as accurate information, and the final decision rests with the Specialist Nurse for Organ Donation1! In the NHSBT brochure “Organ donation and religious beliefs - A guide to organ donation and Jewish beliefs” it says; “In principle Judaism sanctions and encourages organ donation in order to save lives (pikuach nefesh). This principle can override the Jewish objections to any unnecessary interference with the body after death, and the requirement for immediate burial. … for some Jews the ‘brain stem death’ criteria are acceptable4”. Hence, until such time when the relevant Rabbinical Authority of our community will publish a written declaration, attesting to the fact; “that deceased organ donation is against some of the basic tenets of our religion and consenting to it would be unthinkable for a believing member of our faith”, it will be difficult to contest deemed-consent on religious grounds.

It is important to differentiate between; “providing information which shows that the deceased would not have consented or made a decision not to donate” and “family’s objection”. The first can legally prevent transplantation, whereas the latter cannot1.

In addition, para. 1(4) allows the NHS to store the body, in other words to prevent the burial, until either retrieval of organs & tissues has taken place, or the aforementioned information has been provided and authenticated. Section 43 of the Human Tissue Act allows for minimum steps to be taken to preserve parts of a potential donor’s body when it is, or may be, suitable for transplantation, but consent or the absence of consent has not yet been established. Opting out of the ODR, is at present the easiest and safest way to forestall any such scenarios.

For anyone who is familiar and has experience with civil law, this can be confirmed by perusing the Organ Donation (Deemed Consent) Act 2019 & the HTA’s Draft Code of Practice “F Donation of solid organs and tissue for transplantation - (Part two Deceased organ and tissue donation)”. Nevertheless, allow me one quote; “A family’s objection does not nullify appropriate, valid consent from the potential donor”. Other people may for example not realise that certain paragraphs relating to explicit consent, do (according to principles set out elsewhere in the Code of Practice) also apply to deemed consent. So let me quote from Professor Pavlos Eleftheriadis, Faculty of Law Oxford University; “When the law comes into effect families will not have a ‘legal right to object’ to deemed consent in case the deceased has not chosen to opt out” (for copy of letter, see appendix). On the NHS Blood and Transplant website it clearly confirms that where deemed consent applies, family do

not have the legal right to veto or overrule that decision (for full text, see appendix). Do not be misled by the final sentence; “There may, nevertheless, be cases where it would be inappropriate for donation to go ahead if donation would cause distress to the family”. It is obvious that whenever family object, it would cause them distress were donation to go ahead. Nevertheless, it only says; “may”, “inappropriate”, not even “NHS policy is”!

And what about lonely people who have no relatives!? Conclusion: In the past, even though the perpetrator of unauthorised removal of organs and tissues could face a long prison sentence, nevertheless, organ and tissue theft was so common that the government found it necessary to establish the Human Tissue Authority by an act of parliament1. With Deemed-Consent in place, where even the perpetrator of HTA’s Code of Conduct cannot be prosecuted1, what can we expect!? Even more so, when relying on NHS policy, and they are generally speaking not in our favour. Let us rather follow the guidance of our spiritual mentors (see appendix), than to rely on the assumed goodwill of the NHS.

Am I too old for my organs to be donated? There is no maximum age for joining the register. The decision about whether some or all organs or tissue are suitable for transplant is always made by a medical specialist at the time of donation, taking into account your medical and social history.

If Iâ€™ve registered as an organ donor, will my family have a say about me donating my organs? We know that in most cases families will agree to donation if they know that was their loved one's decision. If the family, or those closest to the person who has died, object to the donation even when their loved one has given their explicit permission (either by joining the NHS Organ Donor Register or by carrying an organ donor card) or deemed consent applies, healthcare professionals will discuss the matter sensitively with the family. They will be encouraged to accept their loved one's decision and it will be made clear that they do not have the legal right to veto or overrule that decision. There may, nevertheless, be cases where it would be inappropriate for donation to go ahead if donation would cause distress to the family.

Re Organ Donation (Deemed Consent) ± Urgent Advice

Further to our conversation earlier today here is my response to your query.

The question you put to me yesterday, on which you required a response by the end of today, was whether the statement below sets out fairly what the Organ Donation (deemed Consent) Act 2019 & WKH +XPDQ 7LVVXH $XWKRULW\¶V 'UDIW &RGH RI 3UDFWLFH 3DUW WZR ± Deceased organ and tissue donation) will mean when they come into effect in 2020:

I must say at the outset that the Act introduces an entirely new arrangement, about deemed consent of adult persons to organ donations in England. We are thus not sure yet how the provisions of this Act relate to other provisions about similar matters. I can only offer here a preliminary view for the purpose of basic orientation.

Speaking very broadly the statement above is correct. The Draft Code makes it clear that in all cases of adults normally residing in England the decision of the potential donor either to consent, or not to consent to donation is paramount. There is no legal requirement that a person record their decision about organ and tissue donation in a specific manner. If the person has not made any such statement, the family is not put in the place of the deceased. The decision is still that of the deceased person.

All that a family can do is to provide evidence about the actual wishes of the deceased person to the Specialist Nurse for Organ Donation, who will determine if consent has been given. All that matters here are the wishes of the donor. It follows, thus, that the statement above is correct. When the law comes into effect families will QRW KDYH D µOHJDO ULJKW WR REMHFW¶ WR GHHPHG FRQVHQW in case the deceased has not chosen to opt out. The Code introduces various considerations in relation to the sensitive manner of the donation that reflect matters of faith, but they do not go into the issue of consent.
