Basquiat’s Finest Hour

In May this year, Jean-Michel Basquiat’s painting, Untitled (1982), sold to Japanese entrepreneur Yusaku Maezawa for $110.5 million at Sotheby’s in New York – the fifth-highest price ever paid for an art work at auction.

In many ways, this was a breathtaking result; only Picasso, Modigliani, Bacon and Munch had produced pieces more lucrative. On the other hand, it was simply confirmation of a tendency that has long been evident: that the late New Yorker – who evolved from graffiti on the streets of Lower Manhattan to Neo-Expressionist canvases – is the hottest property in art right now.

His works are collected by the likes of Leonardo DiCaprio and Johnny Depp. The clothing company Uniqlo and footwear company Reebok have reproduced Basquiat’s imagery – on their T-shirts and trainers respectively. Hip hop artists such as Kanye West and Jay-Z have rapped about him. There have also been recent blockbuster exhibitions in major cities, including Paris, Toronto and Rio de Janeiro. London also sees its first ever Basquiat retrospective too: Boom for Real, at the Barbican Centre.

How are we to explain the immense popularity, though? Yes, Basquiat was a star in his own lifetime – renowned for painting in Armani suits, dating Madonna and hanging out with Andy Warhol – but the current adulation is on another level. In part, it’s a product of the myth that has built up around Basquiat since his death from a drug overdose in 1988. Roughly told, the myth involves his running away from an abusive father to live on the streets, where he started making the much-noticed graffiti art that would launch his career. He’d go on to produce a succession of brilliant paintings in the space of a few years, before his untimely death at age 27.

Like Van Gogh, he was active for an intense, solitary decade –and the nagging sense persists of what might have been had he survived. Perhaps not a lot, but the fascination with Basquiat –as with so many artists who die young – is that, tantalisingly, we’ll never know.

Then there are his roots in street art – and the way a street aesthetic (scrawled text, stick figures, obscure symbols and striking colours) even pervaded his canvases. Where once it was considered an illegal eyesore, fast forward a few decades and street art now has a strong case for being the most important artistic movement of the 21st Century. Basquiat certainly didn’t see why being an artist should mean permanently being stuck with a paintbrush in your hand. This open-minded attitude points to a further way that he heralded the 21st-Century: what the Barbican curators, Dieter Buchhart and Eleanor Nairne, call his ‘interdisciplinarity’. In other words, the way he drew on an array of different source material for his paintings. The curators suggest that: “by sampling from everything he perceived”, he anticipated the way we all consume information on the internet and the free-associative hodgepodge that is our browser history at the end of each day.

Jean-Michel Basquiat, then, is in tune with a host of 2017’s cultural trends. It’s too much a stretch to say he inspired them all, of course – but one could surely argue that he was ahead of his time. Almost 30 years since his passing, Basquiat – culturally speaking – has never been more alive.

Ali Baba - the authentic Lebanese restaurant was opened by my father Abdul Rahman Harb in September 1987. Ever since then, we have taken pride in serving typical Lebanese dishes and well as North African, such as couscous. Back in the days, my father used to prepare couscous only on Fridays and on that day of the week we used to have people queuing up to get their share from our couscouseria.

I joined my father in the restaurant back in 1988, when I was still studying. Ali Baba quickly became a trademark of Lebanese cuisine on the island and we still believe in keeping it simple while using only the best quality ingredients from local sources whenever possible. We abide by a very simple philosophy...

To prepare dishes made from natural ingredients and provide an authentic Lebanese taste and experience by preparing almost everything ourselves, including typical Middle Eastern sweets such as Baqlewa - layered pastries with almonds and pistachios.

At Ali Baba we have remained faithful to the Lebanese culture of eating together and sharing a hearty meal with friends or family. Our mezze menu offers a variety of flavours ranging from simple to more complex, and from hot to cold, which can all be well-accompanied by a nice bottle of Arak - a traditional Lebanese alcoholic drink made of two, main simple ingredients, namely grapes and aniseed, which is distilled three times and aged in terracotta jars for at least three years.

The food is wonderfully flavoursome and contains different mixtures of herbs and spices drawn from all around the world. Our menu also offers a wide variety of vegetarian and vegan dishes, salads, grills, stews and desserts for those who like to indulge their sweet tooth.

Should you require help while choosing from our menu, do not hesitate to ask – we will be more than pleased to help you enjoy your dining experience at Ali Baba. We are happy to put together a selection of mezze dishes for you if you are undecided. You will see that having an array of different and carefully-chosen dishes laid out before you is a surprisingly pleasant experience, and we can tell you that it is the best way to savour the many different palates which Lebanese food has to offer.

We usually recommend ordering three to four mezze per person, but there is always the option to order more should you still feel hungry afterwards or want to experience more of what is on offer on our menu. If ordering a main course, one or two mezze per person as a starter is usually recommended.

Malta – Taxation of Resident Not Domiciled Individuals

Most of the principles applied in Maltese tax legislation, are ‘borrowed’ from the old UK tax system, including the principles of residence and domicile. Similarly to the UK, Maltese resident not domiciled individuals (or “res-non-doms”) are subject to tax on a source and remittance basis. While, the UK has imposed considerable amount of charges and limitations to the system over the past few years, and with ‘Brexit’ on the horizon, Malta, which has retained the simpler model, rose to the forefront as an alternative within the EU.

WHAT IS THE SOURCE AND REMITTANCE BASIS OF TAXATION?

A person who is subject to tax in Malta on the basis of source and remittance will be taxed at the resident rates on:

Any income earned in Malta; and Any foreign income to the extent received in Malta.

Malta will not require disclosure of or impose any tax on: Foreign source Capital Gains whether received in Malta or otherwise; and Foreign income not received in Malta.

UNDERSTANDING THE TERM “RESIDENT NOT DOMICILED”

Domicile

When dealing with domicile, we have to keep in mind that the domicile of origin of any individual is obtained at birth, and is the same as the father’s domicile (be it his domicile of origin or of choice). In certain cases an adult individual may change his domicile of origin by taking steps to obtain a different domicile of choice. This is done by showing a clear intention to indefinitely reside in the new domicile while severing ties all ties with his domicile of origin.

One has to keep in mind that when it comes to domicile, Malta does not impose any deemed domicile rules, therefore unless specific action is taken to show that Malta is the individual’s domicile of choice, a person will remain a non-domiciled individual.

Residence

The concept ordinary residence allows individuals obtain residence merely through the setting up of one’s regular course of life in Malta, which when combined with the duration of time

spent in Malta show that those individuals have become residents of Malta in the ordinary course of their lives.

However, Malta also offers other specific residency programmes which provide a special tax status to the individual. Such programmes are the Global Residence Programme (or ‘GRP’) and The Residence Programme Rules (or ‘TRP’). These programmes are intended to attract individuals to take up residence in Malta.

Individuals eligible to benefit under these programmes would be taxable in Malta at the favourable flat rate of 15% on foreign income received in Malta

As such, individuals eligible to benefit under these programmes would be taxable in Malta at the favourable flat rate of 15% on foreign income received in Malta whilst local source income and gains would be taxable in Malta at the higher rate of 35% (flat rate).

It is important to note that under both programmes, the individual would be subject to a minimum tax of €15,000 annually, and the individual is also required to maintain a property in Malta as well as be in possession of a health insurance issued by a locally licensed or a reputable foreign health insurance company.
