As City Sweetens Rikers Deal with $391M in Investments, Council Votes to Close Archaic Jail System

By Michael V. Cusenza The City Council on Thursday voted in favor of a polemic plan to permanently close Rikers Island and replace it with four new borough-based facilities.

The tally was tied to a commitment by the City to invest $391 million—including $126 million in previously planned investments and $265 million in new programming—to reform Gotham’s criminal justice system and address the root causes of incarceration.

Four Borough-Based Jails in Queens, Brooklyn, the Bronx, and Manhattan, will replace Rikers. The World’s Borough site is the Queens Detention Center at 12602 82nd Ave. in Kew Gardens. According to the administration, the City would demolish the existing facility and replace it with a modern one. The new jail would have housing units for detainees, programming and recreational space, and a new above-ground public parking facility. On the ground floor there would be publiclyaccessible community space.

According to Mayor Bill de Blasio, the City plans to add more than $71 million for alternatives to detention and incarceration and reforms to the Department of Correction, building on $126 million in annual investments “to reduce justice involvement, support communities, and make the justice system smaller, safer, and fairer.”

Highlights of those investments and policy changes include: • $54 million expansion of pretrial services including Supervised Release, the City’s primary diversion program, which has prevented 15,000 people from entering jail since its inception in March 2016.

This program will be expanded to become an option for people facing every type of criminal charge.

• $17 million in new funds to expand and continue Alternatives to Incarceration programs that will now serve 7,300 people per year, which will reduce the number of people serving sentences in City jails.

• Mayor’s Office of Criminal Justice will invest in a planning grant for The Imagining Project, a collaboration between Brooklyn District Attorney Eric Gonzalez and the Columbia University Justice Lab, an organization whose long term mission is to create a plan for getting to zero incarceration and minimal convictions for youth age 25 and under. A similar effort with the Center for Court Innovation will create a community justice center to provide communitybased programming in Far Rockaway, with a focus on providing alternatives to arrest and incarceration and reducing recidivism post-incarceration.

services and access to paid transitional employment post-release for everyone leaving City jails.

• Services to support incarcerated individuals facing medical and mental health issues, including: doubling the number of therapeutic treatment units in the jails, known as the Program for Accelerated Clinical Effectiveness; expanded mental health discharge planning services; and a new program to help ensure continuity of medical care for those exiting City jails.

• Expanded programming for social and emotional learning to help school commu-

nities be more proactive in changing school culture and climate, with the goal to foster and maintain a supportive school environment while reducing conflict.

• Requiring every detention facility to have dedicated administrative space for community-based providers as well as dedicated space for services and programming in every housing unit. Also requiring new trainings for correction officers, program staff, and healthcare staff to participate in together.

• Expanded pre-arraignment diversion that will allow more people to avoid prosecution and have their arrests sealed.

• Increased funding to communitybased restorative justice programming, with a particular focus on serious felony level cases that would otherwise result in detention and incarceration.

Additionally, to increase investment in neighborhood-based and community-led programs that improve public safety and reduce violence, the City has promised to invest additional $2.7M in new investments and expanded Cure Violence programming in six areas, including the 113th Precinct in Southeast Queens, encompassing South Ozone Park, St. Albans, Hollis, Springfield Gardens, South Jamaica, Addisleigh Park, and Locust Manor.

The administration has also pledged to establish new neighborhood investments to support communities surrounding the borough-based jails through new affordable housing, youth programming, community, and cultural centers. In Queens: capital improvements at PS 99 in Kew Gardens and PS 139 in Rego Park; and upgrades to Queens Community House located at 8002 Kew Gardens Rd. “Putting an end to Rikers Island is a mission that goes far beyond the walls of the jails themselves. In addition to criminal justice reforms at every level, it will also take investments in communities and in supportive housing, mental health treatment, alternatives to incarceration, and reentry services to help keep people out of jail and out of the justice system altogether,” said Hon. Man Convicted of Killing Richmond Hill Resident, Beating Mom in 113th Street Home

By Forum Staff A Far Rockaway resident has been convicted of murder, assault, and other crimes for the 2016 beating death of a man and the wounding of his mother inside of the victims’ Richmond Hill home, Acting Queens District Attorney John Ryan announced Thursday.

Following a six-week trial, Sahquane Jones, 35, was found guilty last Wednesday of second-degree murder, first-degree assault, and four counts of third-degree criminal possession of a weapon.

According to trial testimony, shortly after 1 a.m., on Aug. 14, 2016, Jones entered the 113th Street home of public-school teacher Kenny Schemitz and his mother, Vivian Schemitz. Jones, with the help of an unapprehended man, pummeled and stabbed the son with two cans of paint, a weed whacker, a lamp, and knives. After the attack, Jones and his accomplice were seen on video surveillance fleeing the area covered in white paint.

According to trial records, despite being badly beaten, Vivian Schemitz, then 68, managed to call 911. Upon entering the home, police found Kenny’s lifeless body behind a door. The 37-year-old victim’s body showed signs of bluntforce and sharp-force trauma to both his head and neck. Vivian sustained numerous facial fractures, lacerations, and a concussion and

was rushed to Jamaica Hospital Medical Center where she underwent surgery.

According to trial testimony, Jones’s right pinky finger was a match to a fingerprint left in white paint at the Schemitz home.

“The defendant in this case relentlessly beat and battered the victims in their home with whatever objects he could grab from inside the

residence. After the attack, the house was a torrent of violence with white paint and blood splattered everywhere with one man literally beaten to death and his mother severely injured,” Ryan said. “The jury weighed all the evidence and found the defendant guilty of these heinous crimes.

He now faces a very lengthy term of incarceration for his actions.”

Sentencing has been set for Nov.

1, at which time Jones faces up to 50 years to life in prison.

Though the victims undoubtedly were targeted, detectives had difficulty determining a motive for the early-morning attack. Also of note: A blaze broke out at the two-family Schemitz abode a few months prior to the murder. After an investigation, City fire marshals concluded that the inferno had been deliberately set.

Addabbo Bolsters Push for Mobile Sports Betting in NY by Pointing to NJ’s Bank Account

By Michael V. Cusenza State Sen. Joe Addabbo, Jr. (DHoward Beach) this week said another month of massive revenue raked in via New Jersey’s sportsbetting operations only galvanizes support for legalizing wagering in the Empire State.

According to the New Jersey Department of Gaming Enforcement, the Garden State’s Sports Wagering Gross Revenue for the month of September—which includes the use of mobile devices—was $37.9 million, up from $23.8 million in September 2018, a 59.3-percent increase over the one-year period.

Since January, Addabbo noted, New Jersey has gained $ 190.6 million in gross revenues from sports betting. The senator stated that, based on that figure, the lost revenue for New York could be more than $47 million.

“New Jersey continues to release astounding sports wagering numbers month after month, while New York remains largely out of the conversation since we do not allow mobile sports betting as of now,” said Addabbo, chairman of the Senate Racing, Gaming and Wagering

Addabbo also noted this week that illegal sports wagering is still thriving in New York since residents do not have an easily accessible way to place a bet.

“Just because New York does not allow mobile sports betting does not mean that people are not making sports wagers; they are just doing it illegally,” the senator said.

“Many residents do not want to take a long care ride to make a sports bet, so they go to their local bookie. I believe with mobile and an increase in accessibility to authorized sports betting, we can recapture the revenue currently being lost to illegal sports wagering and as a consequence, increase educational funding as well. I will continue to push for mobile sports betting when session begins again in 2020.”

The U.S. Supreme Court in May 2018 lifted the federal ban on sports betting, indicating that it is up to individual states to decide if they want to allow wagering on athletic events.

By Forum Staff A California man has pleaded guilty to conspiring with the operator of a borough-based nonprofit organization to bring Armenian nationals illegally into the United States, and to committing visa fraud, federal prosecutors announced Monday.

According to authorities, between January 2013 and December 2014, Hrachya Atoyan, 32, an Armenian national living in Glendale, Calif., and Stella Boyadjian, the operator of Rego Park-based Big Apple Music Awards Foundation Inc., engaged in a widespread visa fraud scheme to bring foreign nationals illegally into the country by falsely representing to the U.S. Citizenship and Immigration Services that they were members of a traditional Armenian performance group and thus qualified for P-3 visas as “culturally unique” artists or entertainers.

In furtherance of the scheme, federal pros-

ecutors said, the conspirators solicited foreign nationals and, in exchange for fees of up to $10,000, prepared and filed fraudulent P-3 visa applications. The conspirators acquired fraudulent documentation to support the applications, including fake dance certificates and staged photo sessions where the foreign nationals wore Armenian dance costumes to make it appear as though they were traditional Armenian musicians, singers and performers.

When sentenced, Atoyan faces up to 10 years’ imprisonment. Boyadjian pleaded guilty to conspiring to bring aliens unlawfully into the country, visa fraud, and aggravated identity theft in March 2019, and also awaits sentencing.

“Exploiting the P-3 non-immigrant visa classification system for culturally unique artist and entertainers makes a mockery out of the legitimate performers for whom that visa was intended,” said Assistant Attorney General Brian Benczkowski.

Area law-enforcement officials this week emphasized the importance of vigilance when it comes to seemingly commonsense actions such as locking doors or leaving your vehicle idling and unattended—regardless of the duration of the errand.

By Michael V. Cusenza Officials from a nonprofit organization that provides community-based services to individuals recovering from mental illness sat down last week with State Sen. Joe Addabbo, Jr. (D-Howard Beach) to discuss a psychiatric/emotional crisis program recently renamed in honor of legendary Howard Beach civic leader, Joel Miele, Sr. During the confab, Transitional Services for New York, Inc. CEO Larry Grubler, and TSINY Associate Director of Public Affairs & Fundraising Avé McCracken explained to Addabbo that Miele’s Respite program, formerly known as Parachute NYC, is a care service that is part of NYC Crisis Respite, which provides a “soft landing” for individuals experiencing an emotional or psychiatric crisis.

According to TSINY, Miele’s Respite uses Intentional Peer Support to provide a warm, calm, and safe alternative to hospitalization as they assist a mixture of clinicians and peers in working with the patient on their recovery.

Miele’s Respite, located at 80-45 Winchester Blvd. Building 20, in Queens Village, offers services including: peer support; optional groups to fit interests; recreation and socialization; private guest accommodations; access to Wi-Fi (laptops available upon request); walking distance to Alley Pond Park; kitchen and dining area for daily meals; living room with cable television; access to community resources; stay is from 1 – 14 days; self-service laundry facility onsite; close to public transportation; and guest rooms equipped with a telephone.

TSINY officials added that in order to meet eligibility requirements, a person needs to be 18 years of age or older, have

a safe and reliable place to return at the conclusion of their stay, be a resident of NYC, currently experiencing an emotional or psychiatric crisis, is not an imminent danger to themselves or others, medically stable, largely able to care for personal needs such as their hygiene and meals, voluntarily accept Respite services, and have no diagnosis of dementia or organic brain syndrome.

“To learn about such an amazing program that was named after an even more amazing person, was a great experience,” Addabbo said. “Joel Miele, Sr. was firmly entrenched in the Howard Beach community, as the Chairman of Community Board 10 as well as Department of Environmental Protection Commissioner. I believe that through the respite program, Joel’s name remains associated with helping others in their time of need.”

Miele, a U.S. Navy veteran, died in May 2013. His name also adorns the 163rd Avenue Pedestrian Bridge in Howard Beach.

In March 2017, CB 10 voted unanimously to indicate its support to City Councilman Eric Ulrich (R-Ozone Park) to commemorate Miele, who was well known in south Queens for his dedication and service to others. In April of that year, the board submitted its formal request to Ulrich.

In its request letter, CB 10 identified the 163rd Avenue Pedestrian Bridge as a very “suitable and fitting location to note Miele’s long-standing and commendable service to his country, state, city, borough and the community in which he was almost a life-long resident.” Located between 99th Street and Hamilton Beach, the bridge is less than 200 feet away from Miele’s family home, where he and his wife raised their three children. The span is also just six blocks away from Miele’s childhood home.

EDITORIAL The Forgotten According to the U.S. Census Bureau, in 2015, 8.5 percent of the world’s population was aged 65 and over. This older population is expected to reach 1.6 billion in 2050. The older population is expected to represent 16.7 percent of the world total population by then—more than double that of children under age 5 (7.2 percent).

For the first time in human history, people aged 65 and older will outnumber children under age 5, according to the bureau.

However, for a population that is dramatically increasing year after year, seniors and the elderly quite often don’t receive the attention commensurate with those figures.

That’s why we were thrilled to see this week two pieces of legislation aimed at aiding some of the most vulnerable among us.

On Tuesday, U.S. Sen. Kirsten Gillibrand (D-N.Y.) announced new, bipartisan legislation that would help protect older adults and longterm care patients from abuse by improving health care worker hiring practices. The Promote Responsible Oversight & Targeted Employee

background Check Transparency for Seniors (PROTECTS) Act would help expand access to the National Practitioner Data Bank for Medicare and Medicaid providers to conduct background screenings on potential employees. Currently, New York has over 269,000 older adults in longterm care facilities.

Health care providers use the National Practitioner Data Bank to screen potential hires to verify that they do not have a history of malpractice. According to Gillibrand, this database is currently inaccessible to some Medicare and Medicaid providers, potentially putting the health of older adults and long-term care

patients in New York and across the country at risk. The PROTECTS Act would give all qualifying long-term care providers access to the database and help make background screenings cheaper to conduct and more comprehensive, allowing Medicare and Medicaid providers to hire more qualified and professional staff.

“Families need to trust that when a loved one is living in a long-term care facility, they will be safe and cared for professionally. Unfortunately, there have been far too many reports of abuse in these facilities, and this is unacceptable,” the senator said.

And last Thursday, Gov. Andrew Cuomo signed legislation protecting patients—many of whom are seniors and the elderly—from excessive out-of-network hospital emergency charges, including hospital inpatient services that follow an emergency room visit. The new law requires health insurance companies to ensure that when enrollees receive care from a non-participating provider, the patient will not incur greater out-ofpocket costs than they would have incurred from a participating provider.

According to the State, the bill also requires that hospital charges for emergency services are subject to an independent dispute-resolution process that was established by New York’s Surprise Medical Bill law, originally enacted in 2014, to comprehensively protect consumers from surprise bills for out-of-network costs.

Man Indicted for ‘Repeatedly Raping and Beating’ Two Women in Laurelton Home: DA

By Forum Staff A Laurelton man has been indicted for allegedly brutalizing two women in separate attacks two years apart inside his 227th Street home, Acting Queens District Attorney John Ryan recently announced.

The first victim was allegedly knocked unconscious after Michael Hosang, 53, offered her a ride home and then brought her to Queens from New Jersey and raped her.

The second alleged assault occurred in May 2019, when another woman was beaten and tortured for six hours, Ryan said.

Hosang was arraigned on a 19-count indictment charging him with predatory sexual assault, first-degree rape, first-degree criminal sexual act, first-degree aggravated sexual abuse, second-degree kidnapping, first- and second-degree assault, seventhdegree criminal possession of a controlled substance, and unlawful sale or possession of an air pistol. Hosang was ordered held without bail. His next court date is this Tuesday, Oct. 29.

According to the charges, on Thursday, May 30, around 6 a.m., Hosang allegedly punched the 30-year-old victim. He followed up the first strike with repeated blows to her face and body and then allegedly placed her in a choke hold, ripped

off her clothes, and raped her vaginally and anally for hours. She broke away from him at one point, rushing for the door to escape—but Hosang caught up to her. He cornered the woman and allegedly dragged her back to the upstairs bedroom.

According to the charges, inside that bedroom the woman’s wrists were handcuffed to the wall and her legs tied with a cord. Hosang allegedly continued to sexually assault her for several hours. He also allegedly told the woman several times that he

was going to kill her. At one point, Hosang left the room; the woman managed to pull her hands free from the cuffs and escaped by jumping from a second-story window and then climbing down a pipe. Naked, bruised, and battered, the victim flagged down a man driving by, who called 911.

The woman was treated at a borough hospital for multiple injuries, including a fractured cheekbone.

According to the charges, shortly after 1 a.m. on Sept. 29, 2017, Hosang hounded

a woman to attend a party with him. After frequent denials the then-38-year-old woman agreed and got into Hosang’s car in New Jersey. Once inside the vehicle, Hosang allegedly punched her and knocked her out cold. When she awoke, she was in Queens, outside Hosang’s 227th Street home. He allegedly forced her inside the house and raped her. Hosang is alleged to have continued the attack by dragging the woman upstairs, but she managed to grab her cell phone and ran into a closet where she tried to call 911. However, the phone’s battery died. But she insisted to Hosang that she’d successfully reached the police, so he permitted her to leave.

After the May 2019 attack, Hosang fled his home and traveled more than 3,000 miles to Bellingham, Wash. He was apprehended there on June 20, 2019. After an extradition hearing, Hosang arrived in Queens earlier this month.

“What these women endured was horrendous,” Ryan fumed before describing the details of one of the attacks as “so vile and unconscionable, what she allegedly experienced is beyond belief. The defendant will be held accountable for the terror he reined on these two women.”

If convicted, Hosang faces up to 50 years in prison.

As part of his guilty plea, Guida agreed to forfeit his interest in the Mastic residence and a Dodge Durango that he used in connection with his drug operation, Donoghue added.

By Forum Staff A City Department of Environmental Protection employee has pleaded guilty to using a stash house in Mastic, Long Island, to produce ecstasy and grow marijuana, federal prosecutors recently announced.

Joseph Guida, 45, who lives in Elmhurst, faces up to 20 years in prison when he’s sentenced later this year.

According to court filings and facts presented at the plea proceeding, between No-

vember 2013 and December 2018, Guida used a house in Mastic to manufacture ecstasy and marijuana for resale. In December 2018, U.S. Customs and Border Protection officers intercepted a package containing PMK methylglycidate, a MDMA precursor, that was mailed to Guida’s Elmhurst apartment from China.

Federal agents then interviewed Guida, and he admitted that he ordered the PMK from China and used the Mastic residence as an ecstasy “cook lab” and marijuana grow-house.

In August 2017, Briar Place at Collier Avenue in Far Rockaway was officially co-named “Detective Randolph Holder Way” in honor of the slain hero.

By Forum Staff Governor Andrew Cuomo recently touted a series of four initiatives targeting job opportunities, business opportunities, and training and education initiatives to benefit the communities around John F. Kennedy International Airport as part of the travel hub’s $13 billion redevelopment program.

According to the administration, the initiatives were developed by the JFK Advisory Council and cover three of the council’s main areas of focus: jobs in construction and airport operations for Southeast Queens residents; opportunities for businesses in Queens; and job training programs and educational opportunities for the community.

The JFK Redevelopment partners— consisting of the Port Authority, The New Terminal One, JetBlue & JFK Millennium Partners, and American Airlines—alongside the advisory council announced the four new initiatives: • A recruiting program to match job seekers in the local community with jobs in construction and airport operations; the program will be carried out by staff at offices in Jamaica and Far Rockaway focused on filling open positions with qualified Queens residents.

• A second chance employment initiative to provide jobs to formerly incarcerated individuals and others with past involvement in the criminal justice system.

This program involves a commitment by the Port Authority, terminal operators, and other employers in the redevelopment program to interview individuals with a justice touch point from the local communities for jobs associated with both airport construction and airport operations.

• A new science and technology educa-

tion program for 300 local students grades 1-12 in Queens to encourage them to seek out jobs in aviation; this program will be carried out through a local partnership with York College building on a successful prior STEM program.

• A two-part initiative focused on providing concession opportunities to local retailers and restaurants. First, The New Terminal One has made a major commitment to reserve at least 50 percent of food and beverage venues for New York City-based restaurants which will include a significant focus on Queens-based businesses. Second, the Port Authority and JFK Airport will roll out an extensive training program to enable and equip area small businesses to qualify and compete for other future concessions opportunities as part of JFK redevelopment.

Cuomo established the JFK Redevelopment Community Advisory Council in October 2018. It is co-chaired by U.S. Rep. Greg Meeks (D-Jamaica) and Borough President Melinda Katz and is composed of elected officials, community boards, nonprofit organizations, civic organizations and clergy leaders in the targeted communities of Southeast Queens, Southwest Queens, the Rockaways and Western portions of Nassau County.

BRONCHIOLITIS WHAT YOU SHOULD KNOW WHEN YOUR BABY GETS SICK

The recent rise in reported cases ofbronchiolitis (no, we didn't spell that incorrectly) raises a red flag for many parents who may be unfamiliar with the condition, and might confuse the illness with the like sounding bronchitis.

Although this condition that affects mainly young children and infants, sounds like the bronchitis, they are very different illnesses.

Bronchiolitis can have a variety of different origins, and most of them stem from a virus. It's actually a rather common lung infection that causes swelling in the smallest of the lungs airways, known as the bronchioles.

When the bronchioles swell, the amount of air able to enter the lungs is restricted, making it difficult for the baby to breathe.

Bronchitis, on the other hand, affects both adults and children. It affects the larger airways in the lungs and causes excessive mucous production. Your body tries to get used to the mucous by coughing.

Bronchiolitis is most common in infants between 3 and 6 months of age but can occur in children as old as two yea Bronchiolitis is a rather common lung infection that rs.

Doctors will treat bronchiolitis differently, depending on what the cause is. Antibiotics are not the usual course of treatment, but nebulizer treatments or steroids may be employed. These medications can help your child breathe more easy while he or she recovers from the illness.

For most babies, it is no more serious than a cold but some may need hospital care, and in fact it is a common reason for babies to be admitted to the hospital.

Some babies are at greater risk to develop the condition including premature babies or those with certain heart and lung conditions.

Bronchiolitis occurs most often in the months between October and March, and it is possible for a baby to develop it more than once in the same winter.

Most cases, around 75%, are cause by an airborne virus known as Respiratory Syncytial Virus (RSV). Other viruses that can cause it are Adenovirus and Rhinovirus. These viruses are spread through tiny droplets of liquid sent into the air when someone who is infected coughs or sneezes. Your child can become infected if they touch a toy or a surface where one of those virus ridden droplets has landed.

There are simple steps to reduce the risk of your child contracting bronchiolitis which include making sure everyone who touches your child washes their hands, cover their mouth when they cough or sneeze, keep them away from other kids showing signs of a cold, wash or wipe toys down regularly and most important keep your baby away from any form of smoke.

Cultural Celebration ‘Lights’ up Liberty Avenue

By Michael V. Cusenza Thousands of borough Hindus, Sikhs, and Buddhists danced down Liberty Avenue in Richmond Hill Saturday evening as observers marveled at intricate costumes and dazzling floats that mark Deepavali or Diwali—the Festival of Lights.

The highly anticipated cultural celebration kicked off around 5:30 p.m. at Liberty Avenue and 133rd Street with the Diwali Motorcade/Parade. Participants traveled down the thoroughfare to 123rd Street, turned right at 103rd Avenue to return

to 133rd Street and the Arya Spiritual Grounds where the floats were judged for creativity, originality and attractiveness.

Diwali is part of an annual five-day fall observance during which families prepare their homes and themselves for special festivities that symbolize the victory of spiritual goodness and the lifting of spiritual darkness. Known as a colorful and happy celebration, Diwali also represents the awareness of inner light within a person when ignorance is pushed aside by understanding and enlightenment.

By Forum Staff A Howard Beach man has been indicted for causing severe injuries to a City police officer after allegedly striking him with a crowbar as he fled the scene of a burglary in April in Kew Gardens, Acting Queens District Attorney John Ryan announced Thursday.

Andres Tabares, 37, was arraigned on Thursday on an indictment charging him with first- and second-degree assault; aggravated assault upon a police officer or peace officer; assault on a police officer, firefighter, or emergency medical services professional; second-degree attempted burglary; possession of burglar’s tools; resisting arrest; and fourth-degree criminal mischief.

Bail has been set at $150,000 bond/$150,000 cash. As of Wednesday morning, Tabares remained in custody on Rikers Island. He was ordered to return to court on Jan. 9.

Ryan noted that Tabares’s co-defendant is Marlon Morales Moreira. The 28-yearold Elmhurst man was arraigned earlier this month on an indictment charging him with first-degree assault, second-degree attempted burglary, fourth-degree criminal mischief, and possession of burglar’s tools. Bail has been set at $10,000 bond/$10,000 cash.

As of Wednesday morning Morales Moreira

remained in City Department of Correction custody. The Ecuadorian native was also ordered to return to court on Jan. 9.

According to the charges, at approximately 9:40 p.m., on Tuesday, April 16, a man called 911 and said that he heard someone at his back door trying to break into his home. Police officers responded to the home on 59th Avenue near 153rd Street and allegedly spotted both Tabares and Morales Moreira. The defendants immediately fled the scene on foot in different directions and cops gave chase. Police Officer Anthony Spinella caught up to Tabares and grabbed his T-shirt, at which time Tabares allegedly swung his arm around and hit the officer in the face with the crowbar he was holding.

According to the complaint, Spinella sustained an abrasion to his eye with bleeding behind his eye, swelling, and temporary blindness. At the time of his arrest, Tabares allegedly said that “it was a mistake” and that he was just “trying to get away.”

Morales Moreira was apprehended without incident, according to the complaint.

Ryan noted that “police officers face danger every single day on the job,” and hailed Spinella as a “heroic public servant.”

If convicted, both Tabares and Morales Moreira face up to 25 years in prison.
