St. Albans Homeowner Charged in Slaying of Tenants

By Forum Staff Queens District Attorney Melinda Katz announced that David Daniel was charged last Wednesday with murder in the stabbing deaths of two tenants and his girlfriend inside his St. Albans home. After the attack, Daniel turned himself in to police.

Daniel, 54, of Milburn Street, St. Al-

bans, was arraigned on a criminal court complaint charging him with three counts of murder in the first and second degrees and criminal possession of a weapon in the fourth degree.

If convicted, Daniel faces a sentence of life in prison without the possibility of parole. Judge Scott Dunn ordered him to return to court on Nov. 17.

According to the charges:

DA Katz described the crime as one of “extraordinary brutality.”

On Tuesday, Nov. 14, at approximately 7:00 am, Daniel turned himself in at the 113th Precinct.

At approximately 7:16 a.m., officers from the 113th precinct went to 122-39 Milburn Street in St. Albans. In the basement, they found a man and a woman, Daniels’ tenants, laying on the floor. Each had sustained multiple stab wounds. In a second-floor bedroom, officers found

a woman, Daniels’ girlfriend, lying on a bed. She also had sustained multiple stab wounds.

The three victims were pronounced dead at the scene.

District Attorney Katz said: “The bloody crime scene was the result of extraordinary brutality. In court, what we will show is that the defendant viciously stabbed his defenseless victims to death.”

MTA Completes Aqueduct Station Renovations

The Metropolitan Transportation Authority (MTA) recently announced that transit crews completed functional and aesthetic upgrades at Aqueduct Racetrack station in Ozone Park. This work is part of New York City Transit (NYCT)’s Re-NEW-vation Program, which utilizes planned service outages to perform repairs, deep cleaning and station upgrades, providing customers with brighter and better station environments when service resumes.

At Aqueduct Racetrack station, workers made extensive concrete repairs mitigating tripping hazards. The iconic subway globes located at the station’s entrances were deep cleaned. Workers updated lighting with LED fixtures and installed 80 new LED lights in previously darkened areas.

Overgrown vegetation that had been encroaching on the platform was trimmed back. The board protecting the platform from damage as trains pass by was repaired and surfaces throughout the stations were scraped, primed, and repainted totaling over 30,000 square feet.

“The MTA worked to revitalize the Aqueduct Racetrack Station which will benefit the residents of Ozone Park, and the surrounding community," said Assemblywoman Stacey Pheffer Amato (DHoward Beach). "This work also adds an enormous benefit for the employees and patrons of Resorts World NYC and the Hyatt Hotel who use that station. The station has new safety improvements, lighting upgrades, and I am thrilled to see the intense cleaning and repairs made to this station. I applaud the re-NEW-vation Program for their success in helping our community with these important and sought after upgrades. Let’s all shout ‘all aboard.’”

Food allergies or food intolerances affect nearly all of us at some time. People having unpleasant reactions to food often wonder if it had something to do with what they had to eat.

One out of three people believe food allergies have something to do with another family member having the same allergy. In reality though, numbers show only about 5% of children and 4% of teens and adults have family related allergies.

The difference between clinically supported food allergies and what people think is causing the problem is maily because of reactions brought on by what we call a food intolerance.

Lactose intolerance is something we've all heard about and seen many products that deal with the condition.

It’s important to know the difference between intolerance and a true allergic reaction.

A food allergy is an abnormal response to food triggered by the immune system.

The immune system is not responsible for symptoms of a food intolerance, even though these symptoms can resemble one another. Being allergic to milk is very different from not being able to digest it due to lactose intolerance.

Th relatively small percentage of people with true alergies to certain foods, have to identiy the allergies beacuse it could save their lives. People who have true food allergies must prevent these al-

lergic reactions because they can cause devastating illness and, in some cases, be fatal.An allergic reaction to food can affect the skin, the gastrointestinal tract, the respiratory tract, and, in the most serious cases, the cardiovascular system.

Reactions can range from mild to severe, including the potentially life-threatening condition known as anaphylaxis.

In the U.S., food allergy symptoms send someone to the emergency room every three minutes.

Mild symptoms may include one or more of the following: hives, Eczema,redness of the skin or around the eyes,i tchy mouth or ear canal,nausea or vomiting, diarrhea, stomach pain, nasal congestion or a runny nose, sneezing, slight dry cough, odd taste in mouth and uterine contractions.

If you experience any of these symptoms you should discuss them with your pharmacist or physician right away.

Remember, being prepared for an allergic reaction can often mean the difference between an unpleasant experience and a life threatening situation.

City Councilwoman Joann Ariola (R-Ozone Park) on Wednesday hosted her Thanksgiving Feast Giveaway at her Ozone Park and Rockaway district offices.

The feast included a pre-cooked meal for a family of four that is experiencing food insecurity.

“We are giving out over 100 pre-cooked meals here at our Ozone Park office and nearly another hundred at our Rockaway office,” Ariola said. “We are serious about fighting food insecurity in District 32—nobody should be hungry this Thanksgiving!! And a big thank-you to Louis Calemine and his son for delivering these trays to homebound residents!!!”

Pols Respond to Mayor’s Bleak Financial Update

By Michael V. Cusenza Mayor Eric Adams last Thursday released the City of New York’s November Financial Plan Update for Fiscal Year 2024 (FY24). With the city facing outyear gaps reaching levels unprecedented for this stage of the budget cycle, the Adams administration took targeted but significant and necessary steps to responsibly manage the city’s finances with minimal impact to services New Yorkers rely on and deliver a balanced budget, as required by law. The FY24 budget is $110.5 billion and remains balanced.

The November Financial Plan Update was crafted in the face of significant fiscal challenges, with the city having spent $1.45 billion on the asylum seeker humanitarian crisis in FY23 and set to spend nearly $11 billion on this crisis over just FY24 and FY25 without significant and timely state and federal support. Through strong fiscal management and with the limited fiscal tools available — including a successful Program to Eliminate the Gap (PEG) — the administration kept the FY24 budget balanced with minimum disruption to services and without raising taxes on working-class New Yorkers — despite having received limited state and federal aid.

“For months, we have warned New Yorkers about the challenging fiscal situation our city faces,” said Adams. “To balance the budget as the law requires, every city agency dug into their own budget to find savings, with minimal disruption to services. And while we pulled it off this time, make no mistake: Migrant costs are going up, tax revenue growth is slowing, and COVID stimulus funding is dry-

ing up. No city should be left to handle a national humanitarian crisis largely on its own, and without the significant and timely support we need from Washington, D.C., today’s budget will be only the beginning.”

In August 2023, Adams laid out new projections estimating the cost of the asylum seeker crisis to grow to at least $12 billion over three fiscal years — between FY23 and FY25 — if circumstances do not change. With sunsetting COVID-19 stimulus funding, slowing FY24 tax revenue growth, expenses from labor contracts this administration inherited after being unresolved for years, and a lack of significant state or federal government action on the asylum seeker crisis, the mayor took action the following month, announcing a 5 percent PEG on cityfunded spending for all city agencies with plans for additional rounds of PEGs in the Preliminary and Executive Budgets. New city-funded spending was limited to those protecting life and safety, fulfilling legal mandates, maintaining necessary operations, or generating revenue.

The FY24 budget has grown $3.4 billion since budget adoption in June, in recognition of $2.6 billion in grant funds and $776 million of better-than-expected revenue growth, primarily driven by income and sales tax collections. Outyear gaps are $7.1 billion in FY25, $6.5 billion in FY26, and $6.4 billion in FY27.

To meet skyrocketing costs associated with care for asylum seekers, the city added $6.2 billion over FY24 and FY25 in this plan, bringing total funds budgeted for migrant needs over the two fiscal years to $10.8 billion. The administration added the following on top of

previously budgeted funding: city funds of $1.4 billion in FY24 and $4.8 billion in FY25, state grants of $447 million in FY24 and $272 million in FY25, and federal aid of $10 million in FY24.

The PEG implemented by the administration in the November Financial Plan Update to keep FY24 balanced was successful, setting up the city to save $3.7 billion over two fiscal years. Every agency met their savings target.

Looking forward, asylum seeker costs in this plan contributed significantly to a historically large $7.1 billion FY25 budget gap — $2 billion greater than it was in June’s FY24 Adopted Budget — despite the successful PEG in this plan. By law, this gap must be closed in mid-January, two months from last Thursday.

“The Council recognizes that the City’s budget has serious forthcoming gaps from the expiration of federal COVID stimulus funds, economic impacts of the pandemic, and additional spending.

This includes expenditures on services in response to an increased number of asylum seekers arriving in the city, but those did not create our budget gaps and are not the only factors contributing to our fiscal reality. This moment requires effectively managing with precision to protect vital services for New Yorkers. The administration’s approach of reducing budgets of all agencies broadly through additional cuts and a hiring freeze, along with inflicting cuts on our libraries, CUNY, and cultural institutions, is too blunt and not the prudent or sole choice.

With clear evidence that city agencies are lagging in their ability to provide New Yorkers with necessary benefits and services at historic levels, the administration

must prioritize real exemptions from cuts to turn around city agency performance issues,” City Council Speaker Adrienne Adams and Finance Chair Justin Brannan said in a statement.

“The administration’s response in providing services for asylum seekers has relied far too much on expensive emergency contracts with for-profit companies that cost the City billions of dollars,” they continued. “We urge the administration to shift as many contracts as possible to non-profit organizations with more expertise and commitment to the long-term public interest of the city. It is also essential that the City explores new revenues that can support our budget without impacting working-class New Yorkers, which in some cases will require authorization from Albany for the city to reduce ineffective tax breaks and have revenue options to preserve our fiscal health. Additional aid from all levels of government will be necessary, and the City must be united with stakeholders in advocating for increased support from the state and federal governments. We will closely examine the Mayor’s November Plan for the impact on New Yorkers, and will voice our concerns, and negotiate with the Administration to further address them.”

The Council Common Sense Caucus, which counts Councilwoman Joann Ariola (R-Ozone Park) and Councilman Bob Holden (D-Maspeth) among its members), penned a joint statement. It reads in part: “No one who has been paying attention to the tens of thousands of migrants flooding our shelter system will be surprised by the severity of the budget cuts proposed by Mayor Adams today.

“However, unlike many of the financial crises our city has faced in the past, this current disaster is almost entirely self-created, the results of decades of terrible policies and irresponsible decisions. And this time around, there will be no State bailout, no federal funding, no silver bullet to save us. The only way to keep our city from falling off the fiscal cliff is to end the so-called ‘right to shelter’ for non-citizens.

“Contrary to popular misconceptions, there is no constitutional obligation, nor any city, state, or federal law that requires the City of New York to house, feed, and provide every service imaginable to foreign nationals at our taxpayers’ expense.

“It is indefensible to cut the essential services [the residents] rely upon because their tax money is being used to pay for those same services for foreign nationals.”

Members of Adams’ administration seemed to concur.

“New York City should not carry this burden on its own,” First Deputy Mayor Sheena Wright said. “The federal and state government must play their part in delivering long-overdue support, funding, and resources.”

By Forum Staff Queens District Attorney Melinda Katz announced that Kassun Brown pleaded guilty Monday to manslaughter for speeding through a stop sign in St. Albans and

crashing into another vehicle, killing its driver, an off-duty NYPD officer.

Video surveillance footage shows that on Jan. 17, 2020, at approximately 11:58 p.m., Brown’s 2006 Nissan Maxima sped past a stop sign at the intersection of Nashville Boulevard and Lucas Street in St. Albans.

The car struck a Nissan Altima driven by off-duty officer Michael Ellis, who was traveling westbound on Lucas Street. Ellis’ car went into a clockwise spin before hitting two parked cars. Brown’s car veered into a telephone pole.

Ellis, who lived in St. Albans and worked at the 63rd Precinct in Brooklyn, was taken to a local hospital for treatment of a traumatic brain injury, a broken neck and facial fractures. He died Feb. 27, the day of his 35th birthday.

At .09 percent, Brown’s blood alcohol content exceeded the maximum legal threshold of .08 percent.

Brown was taken to a local hospital after the collision for treatment of a dislocated right ankle. A passenger in Brown’s car was treated for a fractured femur.

“The defendant’s recklessness prematurely took the life of a young NYPD officer,” Katz said. “We welcome the guilty plea and hope it will provide some solace to Officer Ellis’ loved ones.”

The Hon. Michael Aloise indicated that he would sentence Brown to an indeterminate term of six to 12 years in prison at sentencing on Jan. 11.

Borough Men Sentenced to Federal Prison for Dealing Drugs that Caused Fatal Ozone Park Overdose

By Forum Staff On Tuesday, at the federal court in Brooklyn, Vladimir Esguerra and Jonathan Betancur were sentenced by United States District Judge Eric Komitee to 128 months’ imprisonment and 110 months’ imprisonment, respectively, for conspiracy to distribute controlled substances and distributing the heroin and fentanyl that caused the death of Michael J. Marino in an Ozone Park pizzeria.

As set forth in the government’s sentencing letters and other public documents, Esguerra and Betancur were drug dealers who distributed narcotics together in Queens since at least 2015. Sometimes Esguerra would meet the buyer and handle the transaction himself and sometimes he would send them to Betancur instead. In July 2019, they sold heroin cut with fentanyl to Marino, who suffered a fatal overdose as a result in a pizzeria in Ozone Park.

In September 2019, Betancur was arrested by the NYPD in an unrelated case, and two cell phones that he was carrying were seized. One of them was the same phone he had used to communicate with Marino on the day of the overdose—and the number to which Marino had saved as “Vlad.”

Earlier this year, both defendants pleaded guilty to drug trafficking conspiracy and admitted responsibility for Marino’s death.

“As the defendants admitted in their guilty pleas, they conspired over a period of years to distribute narcotics in our community, and tragically those narcotics had deadly consequences,” said Brooklyn U.S. Attorney BreonPeace. “We are facing a national crisis of opioid addiction, which cuts lives short every day in this district and across the country. Today’s sentences send a message that those who prey on people suffering from this disease will be punished. It is our hope that these sentences will deter others from peddling dangerous drugs and provide some measure of comfort to the victim’s family.”

Sexual Predator Sentenced to 40 Years in Prison for Raping Child Relatives

By Forum Staff Jason Brown was sentenced Wednesday to 40 years to life in prison for sexually assaulting two child relatives beginning when the youngest of the girls was 8 years old and the oldest victim was 10, Queens District Attorney Melinda Katz announced.

Brown, 37, of Rockaway Beach, was convicted by a jury last month of two counts of predatory sexual assault of a child; course of sexual conduct against a child in the first degree; rape in the first and second degrees; three counts of criminal sexual act in the first degree; one count of criminal sexual act in the second degree; two counts of assault in the second degree; two counts of criminal contempt in the first degree; and two counts of endangering the welfare of a child.
