School Bus Driver Charged in Fatal Ozone Park Accident

By Michael V. Cusenza A school bus driver has been charged in an accident that killed a 73-year-old pedestrian in Ozone Park on Friday, police said on Saturday.

Maria Marte, 47, of East Elmhurst, has been charged with failure to yield to a pedestrian/bicycle and failure to exercise due care.

On Friday, at approximately 7:25 a.m., police responded to a 911 call of a motor vehicle collision involving a pedestrian struck in the vicinity of 107th Avenue and 86th Street, within the confines of the 106 Precinct. Upon arrival, officers observed a 73-year-old woman unconscious and unresponsive. Emergeny Medical

Services responded and pronounced the woman dead at the scene. Further investigation by the City Police Department’s Highway District Collision Investigation Squad determined that the pedestrian was attempting to cross 86th Street, walking eastbound in the marked crosswalk, when she was struck by a 2013 Starcraft EC3 school bus, which was making a left turn from westbound 107th Avenue to southbound 86th Street. The operator of the school bus remained on scene. There were no other injuries reported as a result of the collision.

Addabbo Hosts Diabetes Awareness Event

By Forum Staff In honor of Diabetes Awareness Month, State Sen. Joe Addabbo, Jr. (DWoodhaven) organized an interactive diabetes information session at All Saints Episcopal Church in Woodhaven. Addabbo said that with the event he aimed to empower individuals living with diabetes by providing them with valuable knowledge, practical tips, engaging activities and healthy giveaways, such as fresh fruit and vegetables, to lead a fulfilling life despite the challenges posed by the disease.

Addabbo expressed his enthusiasm for the event when he noted, “It’s crucial that we come together as a community to raise awareness about diabetes and support those affected by it. By hosting this interactive session, we hope to equip individuals with the tools they need to manage their condition effectively and live healthy, vibrant lives.”

According to the American Diabetes Association, an estimated 1,717,067 people in New York, accounting for 10.7 percent of the adult population, have been diagnosed with diabetes. In Queens, that percentage is higher at 11 percent. There may be an additional 456,000 individuals in New York who have diabetes, but are unaware of their condition, putting their health at significant risk.

The event started with a live cooking demonstration conducted by Cornell University Cooperative Extension-NYC. Attendees were treated to the preparation of ratatouille, a French vegetable stew. To further promote healthy choices, everyone in attendance received a sample of the dish, accompanied by refreshing fruitinfused water. The culinary experience was followed by light exercises designed to invigorate participants and promote circulation.

Danny Morales, the director of Agriculture at Queens County Farm Mu-

seum, delivered a speech on the benefits of growing one’s own vegetables. Morales encouraged attendees to take up gardening and provided them with packets of tomato seeds and coupons to visit the Queens County Farm Museum. As one of the longest continually farmed sites in New York State, the museum serves as an excellent resource for individuals interested in learning more about sustainable agriculture.

Jane Giordano, a Certified Diabetes Educator/Dietitian at St. Francis DeMatteis Center / Catholic Health, delivered remarks on the importance of portion control and dividing one's plate to achieve a well-balanced meal. She emphasized that half of the plate should consist of vegetables and fruits, while at least half of the grain serving should be whole grains.

Giordano also stressed the significance of choosing fat-free or low-fat (1 percent) milk and water over sugary beverages like soda and sports drinks.

To further demonstrate the possibilities of delicious, diabetes-friendly cuisine, a complimentary dinner was provided by Fidelis and catered by Caribbean Cabana of Richmond Hill. The menu featured a delightful array of dishes, including lentil soup, grilled chicken, grilled tilapia, string beans, broccoli, carrots, brown rice, and for dessert, plain yogurt with fresh berries and a touch of honey on the side. This scrumptious meal showed that healthy eating can be both satisfying and flavorful.

State Comptroller Examines Fiscal Hurdles Facing Key NYC-Supported Agencies

By Forum Staff New York City is financially accountable for numerous entities that are legally separate but can impact its budget. On Friday, State Comptroller Tom DiNapoli released updated reports on three major city-supported agencies — the New York City Department of Education (DOE), the New York City Housing Authority (NYCHA) and New York City Health + Hospitals (H+H) — highlighting the major financial and other issues they are confronting.

DiNapoli also launched a new data tracker (at osc.ny.gov/reports/osdc/agency-services-monitoring-tool) to monitor trends for New York City agencies’ performance data, staffing, and spending.

DiNapoli’s New York City Agency Services Monitoring Tool enables users to track agency-specific delivery of services, staffing levels, and spending to track trends affecting the agencies and help identify areas of potential risks to the city budget. The tool features data for more than 40 city agencies and departments and will be updated monthly.

New York City Department of Education DOE is the largest public school system in the nation, serving roughly one million students in more than 1,800 schools (including charter schools) and child care centers. The DOE’s budget, which reached $38.4 billion in fiscal year (FY) 2024, accounts for 36 percent of the city’s total expenditures.

Issues facing DOE include: • Asylum Seeker and Migrant Student Enrollment: The city estimates that approximately 30,000 children of migrants and asylum seekers are enrolled in city schools during the 2023-24 school year including 12,000 since June 30, 2023.

DOE spent $22 million on initiatives related to these students in FY 2023, despite not having budgeted for such costs. There are no budgeted costs for spending on these students in FY 2024 either. Fair Student Funding allocations alone for these students are likely to exceed $125 million in FY 2024; however, additional per-pupil state aid would likely defray a portion of such costs.

• Enrollment: The number of K-12 students enrolled in New York City public schools fell nearly 9.2 percent between the 2019-20 and 2022-23 school years, with the pandemic exacerbating an existing downward trend. Some projections expect enrollment to continue declining.

Most education aid is calculated on a perpupil basis, meaning the city may also need to adjust its expectations of support from federal and state sources.

• Class Size Mandate: The state recently required the city to lower class sizes

by FY 2028, which is expected to cost $1.3 billion annually in additional operating costs once fully phased in. If DOE fails to

meet certain benchmarks, the state has the authority to withhold a portion of its aid until the city achieves compliance.

• Special Education Services: City spending on federally mandated special education services has more than quadrupled in the past decade, reaching $1.07 billion in FY 2023. DOE has reported that it does not expect either the demand for such services or their costs to decline, and that it is facing a significant backlog of cases.

• Charter School Per-Pupil Tuition: Even as enrollment in traditional public schools declined during the pandemic, enrollment in charter schools rose. Based on enrollment projections, the city’s preliminary estimates show that charter school tuition costs could increase by $47 million in FY 2024 and rise to $449 million by FY 2027 if not offset by additional aid.

New York City Housing Authority NYCHA, the nation’s largest public housing authority, is also the city’s largest landlord (maintaining 7.1 percent of all rental apartments) and its greatest source of affordable housing, with 177,569 apartments. NYCHA’s adopted 2023 budget is expected to total $4.4 billion, with city funds comprising 5.3 percent, federal subsidies accounting for 65 percent and tenant rental revenue making up 19 percent.

Issues confronting NYCHA: • Declining Rent Collections: Tenant rent revenue, which prior to 2016 made up about a third of NYCHA’s operating budget, has been on the decline and fell substantially during the pandemic.

Collections have continued to decline even as the Public Health Emergency has ended. In 2023, rent collections are budgeted at $850 million — 17 percent less than what was collected in 2016. This has contributed to budget gaps that are projected to be as high as $56 million in 2027.

• Capital Needs: NYCHA’s facilities require $78.3 billion in physical repairs and upgrades to bring them into a state of good repair. Costs have grown due to rising construction prices and the ongoing physical deterioration of the properties. The 2023 physical needs assessment estimated that the authority’s capital needs had increased by 73 percent (or $33 billion) from 2017; two-thirds is attributed to market price escalation.

• Maintenance Issues: NYCHA’s backlog of open repair requests is significant and has grown in recent years, with 604,645 open work orders as of June 2023. NYCHA attributes a portion of this backlog to the pandemic when nonemergency work orders were put on hold.

From FY 2022 to FY 2023, the average time to resolve both emergency and nonemergency repair requests rose by 27 percent and 33 percent respectively. NYCHA has suggested recently that its financial issues, including rental arrears, are making it more difficult to address these issues.

Maintenance issues have also led to lower turnover of vacant apartments managed

by NYCHA. New York City Health + Hospitals H+H is the largest municipal public health system in the country and the city’s largest provider of care to Medicaid patients, mental health patients, and uninsured patients. The system includes 11 acute care hospitals, five skilled nursing facilities and over 50 patient community health centers.

Issues challenging Health + Hospitals include: • Operations after the Public Health Emergency: The city was the early epicenter of the pandemic and H+H was confronted with an influx of patients and assumed a significant role in planning for and responding to the City’s COVID-19 public health emergency. The federal Public Health Emergency ended in May

and H+H has transitioned its citywide testing and immunization response to its hospitals and clinics. Inpatient and outpatient visits have returned to pre-pandemic levels and new programs initiated during the pandemic with city financial support continue.

• Asylum Seeker and Migrant Response: H+H is a lead agency in the city’s multi-agency response to the recent influx of asylum seekers and migrants, tasked with managing the vendors selected to operate the central intake center and 15 of the city’s Humanitarian Emergency Response and Relief Centers (HERRCs).

These services could increase, signaled by H+H agreeing to a security contract which could serve up to 19 HERRCs. The city has an agreement with H+H to reimburse it for any costs incurred ($469 million in FY 2023) but the financial impact to the city’s budget resulted in another program to eliminate the gap for FYs 2024 through 2027, reducing other financial support provided by the city.

• Federal/State/City Funding: H+H’s financial condition depends on funding from government sources, but the timing of these funds can be inconsistent.

H+H’s COVID-19 costs reached $3.2 billion through FY 2023 but H+H has yet to receive $1.2 billion from the Federal Emergency Management Agency.

• Nurse Staffing: The pandemic amplified the problem of nurse staffing shortages across the United States including at H+H, which resulted in increased reliance on temporary staff and higher labor costs. In August, the New York State Nurses Association approved a contract agreement that would award pay parity, higher than the pattern assumed by the city in its financial plan, and improved staffing ratios to about 8,000 nurses at H+H. It has yet to be determined if the city will pick up the higher costs as it has done previously.

Amityville Man’s Guilty Plea Highlights Fentanyl Problem

By Forum Staff Charles Carter, also known as “Chase,” an Amityville, L.I. resident, pleaded guilty on Monday in Central Islip federal court to conspiring to distribute more than 40 grams of fentanyl. As part of his plea, Carter admitted that fentanyl that he sold contributed to the drug overdose deaths of two victims (“Victim-1” and “Victim-2”) in 2020 and 2021. Carter also admitted that in, 2021, he sold more than 43 grams of fentanyl to an undercover officer. The plea proceeding was held before United States District Gary R. Brown. As part of his plea agreement, Carter forfeited approximately $3,200 in seized narcotics sales proceeds and a 2009 Jeep Patriot that he used to facilitate narcotics sales. When sentenced, Carter faces five to 40 years’ imprisonment.

Between August 2020 and February 2021, Carter sold more than 40 grams of fentanyl to two overdose victims and an undercover GCPD detective. The investigation revealed that on August 6, 2020, a 23-year-old individual (Victim-1) died of a drug-related overdose at her residence in Glen Cove, Long Island. Cellular telephone analysis and additional investigation showed that the fentanyl that Victim-1 used was purchased from Carter about two days before Victim-1’s death and that Victim-1 had drug-sale-related communications with

Carter. On February 5, 2021, a 40-year-old individual (Victim-2) died of a drug-related overdose at his residence in Farmingdale, Long Island. A search of Victim-2’s phone revealed text messages between Carter and Victim-2, which related to Victim-2’s purchase of fentanyl, shortly before and in the months preceding his overdose death. For example, on January 21, 2021, Carter wrote text messages to Victim-2, stating “im.(sic) around and I got the good stuff[.] Do u (sic) need to see me..??” Autopsies performed on both victims revealed traces of fentanyl in their bodies. Additionally, Carter repeatedly sold fentanyl to the undercover GCPD detective in doses that could have been lethal if consumed, including approximately 43 grams of fentanyl in January 2021.

“During the COVID pandemic, when the world was focused on saving lives and the public’s health, Carter was making plans to sell ‘the good stuff ’ which ended lives and fueled the fentanyl crisis. This plea exemplifies law enforcement’s efforts to bring to justice those causing the most harm to our communities,” said Drug Enforcement Administration NY Division Special Agent-inCharge Frank Tarentino.

the United States. The increase in overdose deaths has been driven in large part by fentanyl, a drug that has been described as 50 to 100 times more potent than morphine. In 2019, over 14,000 people died in the United States from a drug overdose involving heroin. From 2013 to 2019, the synthetic opioid death rate increased by more than 1,000 percent.

Of those deaths, over 70 percent involved a prescription or illicit opioid. In the five weeks since the attacks,

tensions have risen across NYC and the rest of the globe, unfortunately leading to a rise in hate crimes in certain communities.

Flushing Man Indicted in Death of Elderly Ridgewood Pedestrian

By Forum Staff Queens District Attorney Melinda Katz announced that Rony Zino was arraigned on Tuesday on an indictment charging him with criminally negligent homicide in the death of a 75-year-old woman he is accused of hitting with his truck as she was crossing a street in Ridgewood with the aid of a walker.

Zino, 27, of Flushing, was arraigned on

a six-count indictment charging him with criminally negligent homicide, two counts of failure to yield, failing to signal, failure to exercise due care and reckless driving.

According to the charges: Video surveillance shows that on Oct. 11 at approximately 11 a.m., Zino, driving a 2020 Dodge Ram pickup truck, stopped at a red light on the corner of 60th Road and Fresh Pond Road in Ridgewood.

When the light turned green, Zino waited about seven seconds before turning northbound onto Fresh Pond Road, where he struck Linda Lee Hirsch, of Seale, AL. Hirsch, who was using a walker to cross the street, had the right of way.

The impact from the pickup truck caused Hirsch to fall and strike her head against the pavement. She was transported to a local hospital and underwent surgery. She was

pronounced dead on Oct. 20.

“We have too often seen the tragic results of reckless driving when motorists ignore the rules of the road,” Katz said. “It is incumbent upon anyone who gets behind the wheel to follow the law, including yielding to pedestrians. We will hold this defendant accountable for his actions.”

If convicted, Zino faces up to four years in prison.

By Forum Staff Queens District Attorney Melinda Katz announced on Tuesday that Goey Charles was convicted of murder in the October 2020 death of his pregnant girlfriend, 29-year-old Vanessa Pierre. He dumped her body on the side of the Horace Harding Expressway in Bayside and drove away.

Charles, 33, of Uniondale, was convicted Tuesday of murder in the second degree.

According to the charges and video surveillance footage: On Oct. 23, 2020, at about 2:50 a.m., Charles pulled a white Dodge Challenger registered to his girlfriend over at 216-07 Horace Harding Expwy.

driver saw Pierre on the ground, unresponsive, a pair of gray sweatpants wrapped around her neck. Emergency responders arrived on the scene and pronounced her dead. “ We achieved justice for Vanessa,” Katz said. “The verdict does not bring her back, but it holds her killer accountable. We will be asking the court

to send the defendant to prison for a very long time for the brutality and callousness he showed in murdering and abandoning the lifeless body of his girlfriend, the woman who was to be the mother of his child.”

Charles faces 25 years to life in prison. He will be sentenced on Nov. 29.

Unfortunately, all this cooking leads to a related peak in cooking fires, according to the fire and water remediation specialist SERVPRO President and COO John Sooker. Cooking fires are responsible for nearly half (49 percent) of all home fires, according to the National Fire Protection Associa-

tion. “To help keep your holidays from, literally, going up in smoke, it's critical to know and use safe cooking practices,” Sooker said.

According to the NFPA, Thanksgiving is the leading day of the year for home cooking fires, with more than three times the daily average for such incidents. Sooker urged home cooks to take some basic safety steps recommended by the NFPA to help prevent cooking fires: Keep your cooking area
