Teen Driver and Parents Charged in North Conduit Collision that Killed 14-Year-Old Girl

By Forum Staff Queens District Attorney Melinda Katz announced that a teenage driver and his parents have been charged in connection with the May 17, 2023, death of a 14-year-old girl who was a passenger in a car sheared in half after crashing at more than 100 miles an hour into a parked UPS truck on a busy Queens thoroughfare.

The victim, Fortune Williams, was ejected from the BMW and shortly afterward pronounced dead at the scene on North Conduit Avenue near 160th Street in Jamaica.

The unlicensed 16-year-old driver of the BMW, a gift from his father, is charged with manslaughter and reckless driving.

While his junior license allowed him to drive when accompanied by a licensed driver at least 21 years of age, the defendant was alone in the car with the victim at the time of the May 17 crash. Prior to the fatal collision, in November 2022, witnesses from the defendant’s school began seeing him regularly driving the same BMW to and from school unaccompanied by an adult. He was ticketed in November 2022 for driving without a license and driving while using a portable electronic device.

The now 17-year-old, of 227th Street in Springfield Gardens, was arraigned on Tuesday on charges of manslaughter in the second degree; three counts of assault in the second degree; assault in the third degree; reckless endangerment in the second degree; endangering the welfare of a

child; reckless driving; driving in excess of the maximum speed limit; unsafe lane change on a roadway laned for traffic; making an unlawful turn; two counts of operating a motor vehicle with a tinted windows; operating or driving a motor vehicle without a license; and operating a motor vehicle in violation of a restricted permit or license.

According to the charges: • On May 17, at approximately

6:38 pm, the defendant was driving a red 2005 BMW 325I westbound on North Conduit Avenue near 160th Street at a speed calculated at 101 miles per hour.

The posted speed limit was 30 miles per hour.

• The teenager lost control of the vehicle when attempting to move from the left-center lane to the right-center lane and crashed into the back of a parked UPS truck. After hitting the truck, the BMW spun across the roadway and struck a tractor-trailer traveling westbound.

• As a result of the initial collision, Williams was ejected from the front passenger seat of the BMW into the back of the truck. She suffered severe head trauma and was pronounced dead at the scene.

• As a UPS employee was getting into his truck the BMW collided with the back of it, throwing the employee to the ground. He was taken to a local hospital where he was treated for a large hematoma to his leg, a laceration to his face and a bruise to his chest. He has not returned to work since the incident and will require surgery to repair a torn muscle in his shoulder.

He faces up to 15 years in prison if convicted. His parents, Deo Ramnarine, 43, and Sean Smith, 39, each face up to a year in prison.

Richmond Hill Man Killed in Jamaica Moped Accident

On Monday, at approximately 12:30 a.m., police responded to a 911 call for a vehicle collision on 146th Street and Jamaica Avenue.

By Michael V. Cusenza A Richmond Hill man was killed shortly after midnight on Monday while riding on the rear passenger seat of a moped in Jamaica.

Severo Gonzalez, 62, lived on 129th Street.

On Monday, at approximately 12:30 a.m., police responded to a 911 call for a vehicle collision on 146th Street and Jamaica Avenue, within the confines of the 103 Precinct. Further investigation by the NYPD’s Collision Investigation Squad determined that a 25-year-old male was operating a gaspowered moped while traveling eastbound on Jamaica Avenue approaching the inter-

section of 146th Street when he swerved to the right in an attempt to avoid striking a vehicle making a left turn from westbound Jamaica Avenue onto southbound 146th Street. The operator then failed to properly navigate the roadway and was ejected from the vehicle. The operator was transported

by EMS to Jamaica Hospital Medical Center in stable condition. A 62-year-old male rear passenger of the moped was also ejected from the vehicle. The passenger was transported by EMS to Jamaica Hospital Medical Center where he was pronounced deceased.

The investigation remains ongoing by the NYPD's Collision Investigation Squad.

MTA Announces New Wide-Aisle Fare Gates at Sutphin Boulevard–Archer Avenue–JFK Airport Station

By Forum Staff The Metropolitan Transportation Authority (MTA) on Monday announced the first-ever low turnstile fare array replacement with new wide-aisle fare gates at Sutphin Boulevard–Archer Avenue–JFK Airport E, J, Z Station in Jamaica.

The installation of modern fare gate technology reflects the MTA’s commitment to reimagining fare arrays in the subway system, enhancing accessibility and improving the station environment. The new faregates replace the emergency exit gate at that end of the station, which was a major contributor to subway fare evasion. The wide-aisle design of the new faregates allows customers with strollers, wheelchairs, and luggage to smoothly enter the system. This will allow the MTA to examine the feasibility of placing new fare gates at other stations in the future.

This is the first full deployment of new fare gates in the subway system following a pilot of the wide-aisle gates at Atlantic Av-Barclays Center subway station in March 2023.

In addition to wide-aisle gate installation, four traditional turnstiles were installed at the north end of the mezzanine to enhance customer flow. All new fare gates are equipped with OMNY, the MTA’s new tap-and-go fare collection system.

Adams Launches Lithium-ion Battery-Charging Pilot Program for Delivery Workers

By Forum Staff Mayor Eric Adams on Monday announced plans to launch a new, lithium-ion battery-charging pilot program early next year that will allow an initial group of delivery workers to safely charge their bikes in public. The pilot will test a variety of technologies to charge e-bike batteries at multiple locations across the city, developed as part of the administration’s “Charge Safe, Ride Safe” plan to protect New Yorkers from fires caused by lithium-ion batteries and promote safe electric-micromobility usage. Those technologies will include battery-swapping networks, as well as secure bike parking docks that supply fast charging to delivery workers’ e-bikes.

“By investing in battery-swapping networks and fast-charging e-bike docks, we’re building e-bike-friendly infrastructure and preparing our city’s streets for a new generation of users,” Adams said.

Developed as part of “Charge Safe, Ride Safe,” the pilot being announced today will test out different implementation paths to inform future citywide efforts for public e-bike charging, as well as collect feedback from delivery workers. The DOT developed the pilot through the agency’s DOT Studio, a research and development partnership with the New York City Economic Development Corporation (EDC) and Newlab, the urban tech growth hub. Over the last six months, DOT has worked closely with its Studio partners, as well as with the FDNY and delivery workers, to identify several companies to produce unique potential safe and convenient e-battery charging options.

This pilot builds upon several other initiatives to develop more outside-of-home charging options for New Yorkers, including establishing “deliverista hubs” in vacant newsstands in partnership with Los Deliveristas Unidos and U.S. Senate Majority Leader Schumer, and winning a $25 million U.S. Department of Transportation grant to install 173 outdoor electric-mi-

cromobility charging and storage stations at 53 New York City Housing Authority developments.

“Charge Safe, Ride Safe” focuses on four key areas: promoting and incentivizing safe battery use, increasing education and outreach to electric micromobility users, advocating for additional federal regulation of these devices, and expanding enforcement against high-risk situations.

Additionally, this year, Mayor Adams has also signed several bills to further regulate lithium-ion batteries sold in New York City and strengthen fire safety related to battery fires, including bills that prohibit the sale of unsafe, uncertified lithium-ion batteries or dangerously refurbished batteries.

In June, Mayor Adams, FDNY Commissioner Kavanagh, and New York City Small Business Services Commissioner Kevin Kim launched a new action plan to expedite investigations into potentially hazardous conditions involving lithium-ion batteries, as well as launch a comprehensive outreach and education campaign to educate bike shop and bike repair shop owners about the dangers of lithium-ion batteries and best practices to avoid fires. As part of the plan, 311 calls regarding questionable activity at bike repair shops or any other location where batteries are being charged will get a response from the local fire station within 12 hours.

E-bikes and e-scooters are an affordable and convenient alternative to cars and are essential for delivery workers and other New Yorkers who rely on this mode of transportation for their livelihoods. Fires caused by batteries that power electric micromobility devices are a significant problem in NYC, growing from 30 in 2019 to 253 in 2023. These fires are particularly severe and difficult to extinguish, spreading quickly and producing noxious fumes.

From 2019 to 2022, these fires resulted in an average of approximately three deaths and 66 injuries per year. So far in 2023, these batteries have already resulted in 18 deaths and 133 injuries.

WHEN THE SWELLING GETS TOUGH— DEALING WITH EDEMA Many people suffer from swelling of the feet and ankles, a painful and difficult chronic condition. While there are many reasons for such swelling, some of them can be treated through the use of compression socks and/or medications and supplements, while others could signal serious medical problems involving the heart, lungs, kidneys or thyroid.

Make sure you investigate the source of the edema you are facing and work with your doctor and your pharmacist to relive the swelling and prevent it from recurring.

Swollen feet can be caused by excessive accumulation of fluid in the tissues, generally painless, usually found in older people, overweight persons, pregnant women or a consequence of long periods in standing or sitting position. Here are some of the actions that you can take to reduce the swelling: --Put a pillow under your legs when resting to keep the feet in a higher position than the rest of the body --Wear elastic stockings that your pharmacist can help you choose according to measurements and degree of compression --Do not spend too much time seated or staying in the same position --Exercise can reduce

swelling of the legs. Blood flows naturally from the legs to the heart. Exercises stimulates normal blood circulation. --Raising the legs above the heart- -promotes blood circulation to the brain --Weight loss-obesity slows blood circulation in the entire body. Losing weight helps blood to circulate better and can reduce inflammation in the extremities. --Reduce salt intake and adopt a balanced diet Finally you can try these two fairly successful home remedies: Applications with vinegar – alternation, one hot, another cold is an alternative treatment for leg swelling. Mix two equal parts of water and vinegar soak a towel, and apply for 7-10 minutes. Repeat 2-3 times. --Boil 250 ml water, 1 / 2 tablespoon molasses 1 tablespoon anise. Keep it boiling until only a half of the mixture will remain. Drink this mixture in three or four rounds during the day as it can reduce swelling of the feet, provided it is not triggered by a chronic disease. Remember if the swelling persists or is accompanied by other symptoms like shortness of breath or any discomfort in the chest, seek medical help immediately.

Meng Applauds USPS Audit Following Letter She Sent

Mayor Launches New Effort to Make Thousands of City Intersections Safer

By Forum Staff Mayor Eric Adams on Friday launched an aggressive, three-pronged effort to rapidly accelerate the city’s ongoing efforts to make streets safer for all New Yorkers and road users, as traffic fatalities continues to rise nationally, beginning by doubling down on the administration’s focus on improving safety at intersections. Under this initiative, the Adams administration will make safety improvements to intersections at double its current rate — delivering upgrades to at least 2,000 intersections per year, with lifesaving visibility improvements through a tool known as daylighting to at least 1,000 of those intersections each year. To build on that work, the New York City Police Department (NYPD) will add traffic violence to its regular CompStat reporting — treating traffic safety as a critical public safety issue — and the administration will make significant safety upgrades to city vehicles and vehicles of city contractors and licensees to make more vehicles safer across the city.

“Protecting New Yorkers is my most sacred responsibility as mayor, and that holds true for traffic violence just as much as any other form of violence. Our streets must be safe places for all New Yorkers — pedestrians, cyclists, and motorists alike,” said Adams. “Today, I’m excited to announce that we are doubling our current pace of intersection safety improvements, because that’s where more than half of all traffic injuries and deaths take place. We’re going to include traffic violence in CompStat, to treat traffic violence like the serious crime that it is. And we’re ensuring that the city leads the way towards a safer future, starting with our own fleet.”

Accelerating Intersection Improvements & Slowing Turns Intersections pose a special safety challenge in New York City. Crashes at intersections typically comprise 50 percent of all fatalities and 70 percent of all injuries in a year. For pedestrians, the dangers are more pronounced: 55 percent of pedestrian fatalities and 79 percent of pedestrian traffic injuries occur at intersections.

The Adams administration has made intersections a priority for street safety improvements. In January 2022, Adams announced a plan to make 1,000 intersections safer in one year with design improvements like improved traffic signals, raised crosswalks, and other expanded pedestrian space and visibility measures. The administration exceeded that goal two months ahead of schedule, ultimately completing improvements at 1,400 intersections in 2022.

In 2024, the administration will double that initial goal and make safety improvements at 2,000 intersections with design improvements like raised crosswalks, extended sidewalks, and leading pedestrian signals. Of those intersections, 1,000 will receive daylighting treatments to enhance

visibility along with design upgrades to slow down turning vehicles.

This new target represents a dramatic expansion of daylighting — 10 times the requirement under local law and more than three times the current rate. Daylighting is a recommended tool in the National Association of City Transportation Officials’ Urban Design Guide and has contributed to decreases in pedestrian injuries and overall crashes in cities like San Francisco and Hoboken, NJ. Adding Traffic Violence to CompStat Through the CompStat 2.0 online dashboard, the NYPD provides New Yorkers with weekly data on the administration’s progress on fighting crime and promoting public safety. Starting Jan. 1, that resource will also include statistics on traffic fatalities, putting traffic violence on par with other violent crime and further elevating efforts to combat traffic violence as a top administration priority.

Additionally, DOT will expand its standard traffic fatality data updated daily and provided regularly to members of the press. Beginning in January 2024, the data will better account for the diverse ways that New Yorkers get around now — delineating traffic fatalities by 11 subcategories, up from the current five. The new table will break down data into the following subcategories: pedestrian, traditional bike, motorcycle, e-bike, moped, stand-up escooter, dirt bike/ATV, other motorized two-wheeled device, car, SUV, and other motor vehicle.

Making the City’s Fleet afer In August 2022, Adams and DCAS Commissioner Pinnock launched a pilot program to add active intelligent speed assistance (ISA) technology in 50 city vehicles, restricting maximum speeds and ensuring almost universal compliance with

speed limits across 750,000 miles traveled.

Paired with additional technological improvements, the implementation of this tool has led to a 20 percent decrease in crashes involving city vehicles.

The administration is now expanding that pilot program fivefold and including 50 school buses for the first time — helping keep young New Yorkers safe as they travel to and from school. The city is also applying for a federal grant to add ISA technology to thousands of additional city fleet vehicles.

DCAS will test additional safety improvements to the school bus fleet, including audible turn alerts, safety surround cameras, pedestrian collision warning systems, and back-up sensors. The agency will require that school bus operators participate in urban safety and defensive driver training, with the goal of having all drivers complete that training by the start of the 2025-2026 school year. In the coming weeks, DCAS will release a holistic Safe Fleet Transition Plan, encompassing these and other initiatives to make the city’s school buses safer.

In the coming weeks, Adams will issue an executive order setting forth a framework for contractor heavy duty vehicles to include vehicle safety training and technology, ranging from truck surround cameras to telematics. Separately, the mayor’s office will work with the Business Integrity Commission to further strengthen rules related to heavy-duty trade waste vehicles.

By Forum Staff The Alley Pond Environmental Center (APEC) held a grand opening ribboncutting celebration to welcome visitors to its new $28 million building, marking a significant milestone in the organization's commitment to provide inspiring environmental education and year-round community engagement.

“Today marks a pivotal moment in our journey at the Alley Pond Environmental Center as we proudly unveil our new stateof-the-art facility,” said APEC Executive Director Irene V. Scheid.

Added APEC Board President Michael Agnello, “This center is more than bricks and mortar; it’s a platform for inspiration, education, and positive change.”

Since its founding in 1972, APEC has been dedicated to educating guests about the importance of wetlands and the preservation of Alley Pond Park, the second largest park in Queens, which spans 635 acres of forests, meadows, ponds, and fresh and saltwater marshes and is home to more than 300 species of birds and other wildlife.

APEC serves up to 85,000 people annually, most of them school children.

For four decades, APEC was located on Northern Boulevard in a building that previously housed an outdoor furniture store

abutting Alley Pond Park. The nonprofit outgrew the space and broke ground on the new facility in early 2020. Designed in collaboration with the with New Parks, APEC educators, Board members, and staff, the new building reflects APEC’s mission of education and environmental stewardship.

With its organic green brick wall and dramatic sloping roof, the new Alley Pond Environmental Center offers an innovative and immersive learning experience to more than 50,000 students a year and a new gateway to one of the most beautiful and expansive wetland ecosystems in New York City.

The building’s location – at 229-10 Northern Blvd. in Douglaston - minimizes the impact on wetlands and existing trees.

Among the features of the new building: • The ground floor is elevated to resist flooding and the faceted glazed brick wall creates a barrier to sound from noisy Northern Boulevard and, depending on the light, evokes animal scales or lichen.

• The large roof slopes to capture rainwater while creating a lofty and sheltered space toward the park—connecting students and visitors to the adjacent forest and wetlands. The captured rainwater is used for irrigation of plantings and for flushing toilets.

the entry lobby, where animals welcome visitors as they step inside. The room features reptiles, birds, rabbits, chinchillas and many more.

• Bright and flexible classroom spaces connect students to nature trails and extend outdoors, featuring walls that open to create a single space for events.

• Exterior instructional space includes a sheltered observation deck and stepped seating under the tree canopy.

In addition to achieving sustainability to LEED gold standards, the building doubles as a teaching tool. Mechanical and environmental systems are exposed so educators can share the building’s sustainable

Disbarred Queens Attorney Pleads Guilty to Defrauding his Clients

By Forum Staff Hyun W. Lee, also known as Michael Lee, pleaded guilty at the federal courthouse in Brooklyn to wire fraud in connection with a scheme to defraud his real estate clients and their counterparties of funds held in his attorney escrow account.

Friday’s proceeding took place before United States District Judge Pamela K. Chen.

Breon Peace, United States Attorney for the Eastern District of New York, announced the guilty plea.

“With today’s guilty plea, Lee has admitted that he preyed upon members of the Korean-American community by holding himself out as a licensed attorney after his suspension and disbarment, only to steal millions of dollars entrusted to him for safekeeping,” Peace said. “Protecting the community while holding accountable those who use their positions of trust to defraud others is, and will remain, a priority of this Office.”

Peace expressed his appreciation to the Queens County District Attorney’s Office for their assistance in this investigation.

According to court filings and facts presented during the plea proceeding, Lee induced clients and counterparties

to entrust funds to him for the purchase of real estate based on misrepresentations that Lee would release the funds deposited into his escrow account. Instead, Lee misappropriated these funds and used them for his own benefit, which included gambling at casinos and to pay expenses at a restaurant that he partially owned.

Lee also misrepresented that he was an attorney authorized to represent clients, including in connection with the purchase and sale of real estate, and to receive and hold funds in his escrow account in connection with real estate transactions. In reality, Lee had been suspended and was subsequently disbarred from engaging in the practice of law in the State of New York. As a result, Lee was not permitted to accept funds from clients and third parties.

In furtherance of the scheme, Lee misled clients about the status of funds held in his escrow account by fabricating documents leading them to believe their funds were secure. While documentation Lee showed to clients reflected a balance in Lee’s escrow account of nearly $3 million, in reality Lee had depleted the escrow account down to only approximately $25,000. Lee then failed to honor requests by clients and their counterpar-

FBI Warns of Charity Fraud during Israel-Hamas Conflict

By Forum Staff James Smith, assistant director in charge (ADIC) of the New York Field Office of the Federal Bureau of Investigation, is warning the public that criminals are soliciting fake humanitarian donations during the ongoing Israel-Hamas conflict. The FBI has received complaints of legitimate email addresses of Israel-based individuals being hacked or possibly spoofed to solicit donations. Schemes have also directed individuals to a website potentially containing malware.

Charity scams are especially prevalent during times of increased conflict such as war, natural disasters, or epidemics.

Criminals use these tragedies to exploit members of the public looking to support humanitarian efforts. This fraud, also known as “disaster fraud,” comes in many forms. Perpetrators may claim to be associated with established charities or creators of new charities associated with emergent conflicts.

Some perpetrators may prey on their own local communities by claiming to collect funds for victimized families abroad while actually using collected funds for their own personal expenses or in support of criminal enterprises domestically or internationally. Foreign terrorist organizations often establish fake charities using

social media platforms to subsidize their operations. Solicitations may begin as a social media post, an email, a cold call, or a crowd-funding website request.

Jamaica Man Sentenced to 11-and-a-Half Years in Prison for Shooting Correction Officer

By Forum Staff Queens District Attorney Melinda Katz announced that Mark Gibbs was sentenced today to 11-and-a-half years in prison for wounding an off-duty correction officer during a shootout in broad daylight on a busy Jamaica street in July 2022. His co-defendant, Sevaughn Green, is awaiting sentencing.

Gibbs, 24, of Jamaica, pleaded guilty last month to criminal possession of a weapon in

the second degree and was sentenced today to 11 and a half years in prison and five years of post-release supervision by Justice Gia Morris. Green, 21, of Dewitt Avenue in Brooklyn, is scheduled to be sentenced December 11.

According to the charges: On July 3, 2022, at approximately 8:03 p.m., David Donegan, an off-duty correction officer, observed an altercation in the intersection of 214th Place and Jamaica Avenue in Jamaica and saw Green approach a man and

Green then walked up to Gibbs and retrieved a gun from Gibbs’ waistband. As Donegan attempted to break up the altercation, Gibbs pulled out a gun from his crossbody bag and began firing at Donegan.

Donegan turned to run away and was hit in the back of his calf. He then drew his licensed firearm and returned fire, striking Gibbs three times in the torso. Gibbs fell to the ground. Green crouched down near him

and shot at Donegan. Donegan returned fire, striking Green in the leg.

Donegan was treated a local hospital for the gunshot wound.

No pedestrians were wounded.

“This kind of reckless gun violence has absolutely no place on our streets and we will not let up in our efforts to end it,” Katz said.

“We applaud Correction Officer Donegan’s extraordinary bravery and commitment to protecting us.”
