Pending NY Bail Laws Could Handcuff Judges, Prosecutors and Endanger Public Safety

EFFECT OF bail NEW BAIL LAWS On January 1, 2020, the people charged with crimes included in the list of criminal offenses no longer requiring for release, will walk out the doors of Rikers Island. The above graphic map is designed to show where they committed the crimes they are charged with. Each blue pin shows the location of the crime they are currently incarcerated for.

On January 1, 2020, New York State judges will no longer be able to set bail on residential burglaries, robberies “aided by another” (both of which are classified as violent felonies), all but one of the most serious narcotics felonies, most non-violent felonies (including manslaughter in the second degree and other crimes you may consider violent) and most misdemeanors.

Based on a snapshot we did of the Queens Rikers population on June 6, 2019, we estimate the new laws, if in effect today, would result in the release of approximately 363 inmates currently incarcerated on Rikers Island who committed the above types of crimes in Queens County. These inmates have an average of six prior felony arrests, five misdemeanor arrests, two felony convictions and six misdemeanor convictions. On January 1, 2020, the people charged with these crimes will walk out the doors of Rikers Island. The attached map is designed to allow you to see where they allegedly committed the crimes they are charged with. Each blue pin shows the location of the crime they are currently incarcerated for.

Effective January 1, 2020, New York State judges will no longer be able to set bail on, among other crimes, residential burglaries, robberies “aided by another” (both of which are classified as violent felonies), all but one of the most serious narcotics felonies, most nonviolent felonies (including manslaughter in the second degree and other crimes you may consider violent) and most misdemeanors.

When these measures are implemented effectively, New York will see a minimum of a 40% reduction in the state’s pretrial jail population.

Of the average daily jail population in 2018, nearly 70% in NYS were held pretrial. There has been a dramatic reduction in NYC’s jail population from the early 1980’s through 2019, dropping by about 60%. Despite the drop in NYC, across the rest of the state, populations in jail has either been steady or actually increased in either rural or suburban areas.

Under the new bail laws, effective January 1, 2020, Judges in New York State can-

not set bail on any of the following crimes (and most attempts to commit these crimes), and must release the defendant on nonmonetary conditions, regardless of criminal record, ties to the community or previous bench warrants on other cases.

This list is not a complete listing of the charges outlined under the provisions of New York Bail Laws set to go into effect in a couple of weeks January 1st.

The New York State Legislature, according to whom intend the new laws as a means to end the use of monetary bail, reduce unnecessary pretrial incarceration and improve equity and fairness in the criminal justice system, and Gov. Andrew Cuomo approved the new laws as part of the budget earlier this year, making New York the latest in a number of other states seeking to reduce or eliminate cash bail over the past few years.

Critics who maintain that poor defendants remain in jail are opposed by law enforcement agencies throughout the state and those who say bail is necessary to make ensure defendants return to court and those with financial resource go free.

According to a report published by the John Jay College of Criminal Justice in September, the new laws could free 20,000 people or more from pretrial incarceration in New York. The report goes on to say that judges in New York City released about 105,000 people without bail ahead of their criminal hearings in 2018 and the number of defendants released without bail may grow to 125,000 or more in 2020 because of the new state laws.

NYPD brass has expressed serious concern about the potential impact on public safety from the new bail policies. Clearly at the heart of the issue is the opinion that mass incarceration is supported while there is also grave concern for the safety and protection of the public.

While success in similar programs has been enjoyed by other states, especially neighboring New Jersey, lawmakers are quick to point out that judges in New York have no power or authority to hold people based on concerns that they will pose a danger to the community if released. This section of the law is consistent with standing legislation in New York, which has prohibits considering dangerousness in imposing bail for more than four decades established to ensure those accused of crimes have the presumption of innocence.

Mure Christmas Brings Smiles

By Patricia Adams More than two decades after Joe Mure started the Christmas tradition of the Little North Pole at his Rockaway Beach home when the criminal defense attorney was called to court and missed his daughters first Christmas, it’s still going stronger than ever.

This week in a guest spot on the Tamron Hall show with finance Jodi Tucci on Monday morning, Mure said that was that event that made him vow there would never be another missed Christmas.

But over the years his personal endeavors have grown far outside family obligations. Mure’s decision never to miss Christmas again has turned the Christmas display, known as The Little North Pole,

into an event that each year leaves thousands of revelers thrilled to stand in the bone chilling cold to marvel at what “Joe did this year.”

When Hall asked about how much planning goes into the Little North Pole, Mure was all smiles describing the work he and a devoted band of volunteers do every year.

“We think about it throughout the year, ” Mure said, “and we actually place the pieces to see where they will go.”

But when the TV host pressed Mure about how much cash he “throws” at the project his answer came from the attorney in the Christmas philanthropist. “The money doesn’t really matter. What matters is the smile that you can put on the kids faces,” said Mure, who drew rousing applause from the studio audience. But Hall was not

so quick to give up and asked, “But how much do you spend?”

The audience was again tickled by Mure’s comeback, delivered with the biggest of smiles, “We spend enough to put enough smiles on as many faces as we can.”

Regardless of what is spent, the event clearly serves it’s alternative purpose which is to act as one of Mure’s fundraising vehicles for the cause that remains as close to him as his own heartbeat.

Year after year Mure raises six figure sums in support of Juvenile Diabetes Research, for JDRF. Last year with the Little North Pole as well as the annual gala held in May and a cigar night organized by close friend Angelo Gurino, they raised over a quarter of a million dollars in support of the cause.

This year, the Little North Pole count is not completed, however Mure says he expects the final total to be around 30K just from that event.

Last year really brought attention to the Little North Pole after it was named the winner of the Great Christmas Light Fight, netting a $50k prize for JDRF. “This is what Christmas is all about,” says Mure’s fiancé Jodi Tucci. “I fell in love with his heart and I am so blessed to be able to be a part of this.”

We know just how she feels. Mure’s constant dedication to his cause and the difference he has made in the advances in fighting Juvenile Diabetes clearly say Merry Christmas exactly the way it was meant to be said.

Queens Soccer Coach Nabbed on Charges of Rape, Sexual Abuse and Other Crimes Against Teenage Boys and Girls

By Forum Staff A 23-year-old Woodhaven resident – who coached soccer with the now-defunct American Eagle Soccer Academy – has been charged with rape, sexual abuse, promoting a sexual performance by a child and other crimes for his contacts with both boys and girls between July 2018 through September 2019.

Harrison Torres, 23, of 89th Avenue in Woodhaven is awaiting arraignment in Queens Criminal Court on 4 separate complaints charging him with first-, second- and third-degree sexual abuse, attempted use of a child in a sexual performance, promoting a sexual performance by a child, second- and third-degree criminal sexual act, third-degree rape, possessing a sexual performance by a child and endangering the welfare of a child.

Authorities say the victims in this case were 13, 14 and 15 years old at the time.

Acting District Attorney Ryan said, “This case is every parents’ nightmare – a coach gains their trust and then betrays them in the most vile ways to feed his own sick, sexual desires. This defendant is accused of forcing one boy against a wall and molesting him.

The defendant is believed to have had oral, anal and vaginal sex with teen boys and girls in his home and other locations. The defendant will be held accountable for these alleged actions. He now faces a lengthy term of incarceration.”

The Queens DA’s office is asking anyone who suspects their child may have been victimized by this defendant to please contact the police by calling 911 or walking into any police facility to report the abuse.

Additionally, if anyone has any information regarding the abuse, they should call the NYPD’s Crime Stoppers tip line at 800-577-TIPS. According to one complaint, Torres had sex with an underage teenage girl in his home sometime between July 20, 2018, and October 1, 2018.

In a separate complaint, he is said to have brought a young teenage boy to his home between November 1, 2018 and December 31, 2018, and sexually abused the boy.

Torres is also charged with making video recordings of the sex acts, copies of which were recovered by the police.

According to a third complaint, Torres shoved a 13-year-old boy against a wall at a high school in Woodside, Queens and forcibly touched his genitals on the afternoon of November 7, 2018.

Torres was at the high school with the American Eagle Soccer Academy, the soccer academy that was operated by his father and had rented space from the school for an event.

According to the last complaint, Torres allegedly asked a 14-year-old boy to send him photos of his penis in exchange for cash sometime during the month of February 2019. Torres is then alleged to have sent his own videos to the teenager – one showing Torres having sexual intercourse with a 14-year-old girl and the other containing images of the defendant having sex with a 13-year-old boy. Both videos were recovered by the police.

If convicted, Torres faces between 15 and 50 years in prison.

Estranged Jealous Husband Pleads Guilty to Manslaughter in Viscious Stabbing of Wife

By Forum Staff William Rivas, 39, of Corona, has plead guilty to manslaughter in the stabbing death of his estranged wife on August 7, 2019, inside the Tu S’tilo Salon and Spa, on 37 Avenue in Jackson Heights, where she worked.

Sources say Carmen Iris Rodriguez,35 year old mother of two, and her ex-husband, Rivas, had separated after four years of marriage in January, when Rodriguez left because her husband was abusive. Friends of Rodriguez say that Rivas was insane with jealousy because of Iris’ conversations with other men.

When police arrived at the scene, they found Rivas lying on top of his estranged wife’s lifeless body. Ridriguez was rushed to a nearby hospital, but died from her injuries.

Queens Supreme Court Justice David Kirschner set sentencing for February 7, 2020, and indicated that he would order the defendant to a determinate term of 25 years in prison, to be followed by 5 years’ post release supervision Acting DA John M. Ryan said, “This was a horrific act of domestic violence where the defendant in front of horrified onlookers, took out his anger against his wife at her place of business by mercilessly stabbing her to death. The defendant admitted to this brutal crime and he will spend decades locked behind bars as punishment for his actions.”

Brooklyn Resident Convicted of Manslaughter, Shoots Man for Insulting Female Friends

By Forum Staff A jury convicted a 27-year-old Brooklyn man after they found him guilty of manslaughter and other crimes for shooting and killing a man following a dispute on Steinway Street in July 2016.

Santiago Salcedo, 27, of Madison Street in BedfordStuyvesant grabbed a gun to defend the honor of the women that were accompanying him when someone slung insults at the women in the early morning hours of July 17, 2016.

Authorities say that shortly after 4 a.m., after patronizing several bars on Steinway Street Salcedo and 3 friends - two women and a male - walked near 28 Avenue. The foursome walked past Qsaun Brown, who was with another man. Brown and his friend made derogatory remarks about the two women with Salcedo and one of the women asked the defendant “Are you just going to let them disrespect us like that?”

Salcedo and his friend went to a car, retrieved something from the trunk and walked back and confronted Brown and

the defendant. He was unarmed when he jumped out of his vehicle and ran over to where Salcedo was standing. The defendant then took a gun his friend was holding and fired 5 times at Brown and another unarmed man. The victim was struck once in the neck and died two days later at a nearby hospital.

Brown’s friend was not hit by gunfire.

The jury deliberated for 3 days, finding Salcedo guilty of firstdegree manslaughter, first-degree attempted assault and 2 counts of second-degree criminal possession of a weapon following a 5-week-long trial.

Queens Supreme Court Justice Ronald Hollie, who presided at trial, set sentencing for January 23, 2020, at which time the defendant faces up to 25 years in prison.

Firefighter Dad Ejected From Courtroom, Says his Daughter’s Violent Attacker Could Go Free

Omar Wilks told reporters he fears Ramtahal will be out of jail as early as January 1 because sufficient felony charges have not yet been filed.

By Patricia Adams The dad of a 14-year-old girl, who was chassed into oncoming traffic in Richmond Hill on Jamaica Avenue early last week, was ejected from a Queens courtroom, after an emotional outburst inside a Queens Criminal Courtroom.

Kevin Ramtahal threatened 14-year-old Amara Wilks forcing the teen to run into traffic where she was struck by a car.

Omar WIlks directed his rage toward 23-year-old Kevin Ramtahal, the man accused of harassing his daughter.

“That was my 14-year-old child you attacked,” shouted Wilks.

“I felt like leaping over the table and grabbing him up,” the emotional father told reporters outside the Queens County Criminal Court on Monday afternoon. “But out of respect for the court, I maintained discipline and made it clear to him that I’m determined to get justice.”

In the incident that occurred last week on

December 6, authorities say that Ramtahal was “wandering the streets like a madman shouting at people, lunging at them and threatening them.”

When the unhinged Ramtahal encountered 14-year old Amara Wilks on her way to school, she was so terrified by the way he accosted her, screaming “I’m coming for you,” that she ran into traffic on Jamaica Avenue at 110th Street and was struck by a passing car. The teenage suffered multiple fractures but thankfully survived the incident.

“She’s emotionally devastated. She’s in enormous physical pain. It’s too soon to say. She’s not ever going to be the same. She’s never going to walk normally. And emotionally she’s traumatized. She can’t sleep at night,” said an obviously devastated father. “My daughter was on the brink of death. She asked me “Daddy am I going to die?”

Ironically, Wilks, a firefighter whose firehouse is in the same neighborhood, responded to the 911 call when the accident happened. He had no idea his daughter was the victim involved in the call. Amara was rushed to Cohen’s Children’s Hospital with severe leg injuries Later Wilks joined in the massive search to locate Kevin Ramtahal to get him into custody.

The emotionally charged father expressed serious concerns outside the courthouse saying that the charges were not serious enough. He challenged incoming DA Melinda Katz to “hold this criminal accountable with violent felony charges. There is no reason he should be on the street.”

The ADA on the case explained to Wilks that if he [Ramtahal] gets anything less than a violent felony charge he would be out of jail with no bail January 1, when the new bail laws go into effect. “I am determined as a father to not let that happen.

Ramtahal has been charged with child endangerment, reckless endangerment and harassment. Ramtahal remains in custody on $2,500 bail.

The Pharmacist’s Corner Presented by Frank Pantina, R.Ph PROTECTING OUR ELDERS MONITORING SENIOR MEDS

We've spoken to you in the past about mistakes made by chain pharmacies in having dispensed the wrong medication to a child.

And now we'd like to discuss with you something of equal importance about another "at risk" population--especially when talking about medications––our senior citizens.

Whether you’re a full-time caregiver to your parents, a volunteer in a senior service program or you just help out an aging aunt or uncle from time to time, part of that responsibility is likely helping them get their medications.

Our elders use more prescriptions than any other age group in the country. In fact although they comprise roughly 13% of the population, they use at least 34% of all prescription medication.

Because most older adults live with at least one chronic condition and generally have more than one prescribing physician, there are often complications in keeping track of the multiple meds and the interactions between them.

One of the most valuable services your local pharmacy can offer you is a strong effort to educate older adults and their caregivers about every medication the patient takes.

Additionally, as your family pharmacist, we can help to close gaps in the process of managing prescriptions. Opening the lines of communica-

tions between adults with hectic schedules, who also care for their parents on a regular basis, is a valuable asset that cannot be overstated. By Forum Staff Wrap up your holiday season and say goodbye to your tree at Mulchfest.

Join NYC Parks and the New York City Department of Sanitation (DSNY) in the environmentally-friendly holiday tradition of recycling your tree!

For more than 20 years, Parks and DSNY have collected and mulched trees to help planting beds and community gardens around the city grow. Mulch maintains the health of our trees and plants citywide by deterring weeds, retaining moisture, preventing compaction, adding nutrients to the soil, and keeping roots warm. In recent years, Parks has mulched between 25,000 and 30,000 on average annually.

You can drop off your tree at any designated Mulchfest location between December 26, 2019, to January 11, 2020. Trees can be dropped off all day long.

You can bring your tree to a chipping site to take home a tree-mento! NYC Parks will chip your tree and give you your very own bag of mulch to use in your backyard or to make a winter bed for a street tree.

NYC Parks hosts Mulchfest drop-off only locations and chipping sites in select parks and Greenthumb gardens across all five boroughs—67 locations in all. A complete list of all Mulchfest locations can be found on NYC Parks’ website.

Trees are chipped, mixed with leaves and recycled into rich compost for NYC’s parks, institutions, and community gardens. Remember to remove all lights, ornaments, tinsel, stands, and plastic bags from your tree.

For those not wishing to participate in tree drop-offs or chipping, weather permitting, DSNY will collect clean Christmas trees starting on Monday, January 6through Friday, January 17, 2020.

If you have an artificial tree you wish to dispose of you can donate or sell used

artificial trees in good condition at donateNYC at www1.nyc.gov/assets/donate/index.shtml You may set out artificial trees as garbage on regular collection day(s). If possible, take apart your tree to recycle the base and trunk (pole) with metal, glass, plastic and cartons. Remove all lights, ornaments and tinsel before placing at the curb.

You can also make your own mulch following these simple directions. Use evergreen boughs and branches from your Christmas tree as mulch to enrich the soil in your garden or street tree beds. Just cut off the smaller branches of your Christmas tree and remove the twigs from evergreen boughs. Lay three to four inches of these trimmings over the bare soil around street trees or in your garden. After removing the branches for mulch, you can take your tree to MulchFest or leave it out for our collection.

Self-executing Contract/Security Agreement in Event of Unauthorized Use: By this Copyright Notice, both the juristic person and the agent of said juristic person, hereinafter jointly and severally “User,” consent and agree that any use of JIBRAIL SHADEED DAVIS© other than authorized use as set forth above constitutes unauthorized use, counterfeiting, of Secured Party’s common-law copyrighted property, contractually binds User, renders this Copyright Notice a Security Agreement wherein User is debtor and Jibrail Shadeed Davis© is Secured Party, and signifies that User: (1) grants Secured Party a security interest in all of User’s assets, land, and personal property, and all of User’s interest in assets, land and personal property, in the sum certain amount of $500,000.00 per each occurrence of use of the common-law-copyrighted trade-name/trade-mark JIBRAIL SHADEED DAVIS©, as well as for each and every occurrence of use of any and all derivatives of, and variations in the spelling of, JIBRAIL SHADEED DAVIS©, plus costs, plus triple damages; (2) authenticates this Security Agreement wherein User is debtor and Jibrail Shadeed Davis© is Secured Party, and wherein User pledges all of User’s assets, land, consumer goods, farm products, inventory, equipment, money, investment property, commercial tort claims, letters of credit, letter-ofcredit-rights, chattel paper, instruments, deposits accounts, accounts, documents, and general intangibles, and all User’s interest in all such foregoing property, now owned and hereafter acquired, now existing and hereafter arising, and wherever located, as collateral for securing User’s contractual obligation in favor of Secured Party for User’s unauthorized use of Secured Party’s common-law-copyrighted property; (3) consents and agrees with Secured Party’s filing of a UCC Financing Statement in the UCC filing office, as well as in any county recorder’s office, wherein User is debtor and Jibrail Shadeed Davis© is Secured Party; (4) consents and agrees that said UCC Financing Statement described above in paragraph “(3)” is a continuing financing statement, and further consents and agrees with Secure Party’s filing of any continuation statement necessary for maintaining Secured Party’s per-

fected security interest in all of User’s property and interest in property, pledged as collateral in this Security Agreement and described above in paragraph “(2),” until User’s contractual obligation theretofore incurred has been fully satisfied; (5) consents and agrees with Secured Party’s filing of any UCC Financing Statement, as described above in paragraphs “(3)” and “(4),” as well as the filing of any Security Agreement, as described above in paragraph “(2),” in the UCC filing office, as well as in any county recorder’s office; (6) consents and agrees that any and all such filings described in paragraphs “(4)” and “(5)” above are not, and may not be considered, bogus, and that User will not claim that any such filing is bogus; (7) waives all defenses; and (8) appoints Secured Party as Authorized Representative for User, effective upon User’s default re User’s contractual obligations in favor of Secured Party as set forth below under “Payment Terms” and “Default Terms” granting Secured Party full authorization and power for engaging in any and all actions on behalf of User including, but not limited by, authentication of a record on behalf of User, as Secured Party, in Secured Party’s sole discretion, deems appropriate, and User further consents and agrees that this appointment of Secured Party as Authorized Representative for User, effective upon User’s default, is irrevocable and coupled with a security interest. User further consents and agrees with all of the following additional terms of Self-executing Contract/ Security Agreement in Event of Unauthorized Use: Payment Terms: In accordance with fees for unauthorized use of JIBRAIL SHADEED DAVIS© as set forth above, User herby consents and agrees that User shall pay Secured Party all unauthorized-use fees in full within ten (10) days of the date User is sent Secured Party’s invoice, hereinafter “invoice,” itemizing said fees. Default Terms: In event of non-payment in full of all unauthorized-use fees by User within ten (10) days of date Invoice is sent, User shall be deemed in default and: (a) all of User’s property and property pledge as collateral by User, as set forth in above in paragraph “(2),” immediately becomes, i.e. is, property of Secured Party; (b) Secured Party is appointed User’s Authorized Representative as set forth above in paragraph “(8)”; and (c) User consents and agrees that Secured Party may take possession of, as well as otherwise dispose of in any manner that Secured Party, in Secured Party’s sole discretion, deems appropriate, including, but not limited by, sale at auction, at any time following User’s default, and without further notice, any and all of User’s property and interest, described above in paragraph “(2),” formerly pledged as collateral by User, now property of Secured Party, in respect of this “Self-executing Contract/Security Agreement in Event of Unauthorized Use,” that Secured Party, again in Secured Party’s sole discretion, deems appropriate. Terms of Curing Default: Upon event of default, as set forth above under “Default Terms,” irrespective of any and all of User’s former property and interest in property, described above in paragraph “(2),” in the possession of, as well as disposed of by, Secured Party, as authorized above under “Default Terms,” User may cure User’s default only re the remainder of User’s said former property and interest property, formerly pledged as collateral that is neither in the possession of, nor otherwise disposed of by, Secured Party within twenty (20) days of date of User’s default only by payment in full. Terms of Strict Foreclosure: User’s non-payment in full of all unauthorized-use fees itemized in Invoice within said twenty- (20) day period for curing default as set forth above under “Terms for Curing Default” authorizes Secured Party’s immediate non-judicial strict foreclosure on any and all remaining former property and interest in property, formerly pledged as collateral by User, now property of Secured Party, which is not in the possession of, nor otherwise disposed of by, Secured Party upon expiration of said twenty-(20) day default-curing period.
