Feds Probing Mob Capo’s Possible Link to Howard Beach Home-Invasion Crew: Report Authorities accrue informants in second shot at Asaro after Luthansa Heist acquittal

Cusenza The Department of Justice once again has reputed Bonanno family capo Vinny Asaro in its crosshairs, with federal prosecutors looking to link the 81-year-old legend to a motley crew of mob associates responsible for a series of brutal homeinvasion robberies in south Queens and Long Island, according to an explosive new report.

La Cosa Nostra expert Jerry Capeci, citing law enforcement sources in his Sept. 8 GangLandNews.com column, said that Asaro is one of the “subjects of an ongoing federal grand jury investigation” centered on the team of thieves that terrorized residences in Howard Beach and Ozone Park from 2012 to 2014.

Eastern District prosecutors seeking indictments have been presenting evidence and witnesses to the grand jury for several months about “dozens” of violent robberies in which masked intruders beat victims, force them to strip naked and

tie them up before making off with cash and jewelry.

Federal attorneys, still smarting from Asaro’s acquittal last year following a dramatic trial that saw the government attempt to tie the Howard Beach resident to the 1978 Lufthansa heist, are reportedly relying on two star informants to cinch any loose ends.

“Feeding the feds the inside info on the home invasion ring, sources say, are Frank Nunziata, and Gene Borrello, two 31-year-old members of the robbery crew that also preyed on residents in other sections of Queens and on Long Island,” Capeci wrote. “Both men are said to be cooperating in a probe by the FBI, the Brooklyn U.S. Attorney’s office and the Queens District Attorney’s office.”

The offices of the Eastern District U.S. Attorney and Queens DA did not respond to requests for information on Nunziata. Court records show that he is due to be sentenced on Sept. 19 on drug and weapons charges. However, his sen-

tencing appearance has been adjourned to a later date seven times since March 11, 2015, though it is unclear why.

As Capeci noted in his column, Nunziata has been cooperating with the NYPD since he was arrested in Howard Beach in 2013 for the drugs and guns. Borrello reportedly

recently told federal investigators that, indeed, he has been working for Asaro.

Last November, after a threeweek trial that featured testimony from turncoat mobsters, including two of Asaro’s cousins, and two days of jury deliberations, the reputed Bonanno captain was cleared on

all counts of murder, murder conspiracy, racketeering, extortion, and other crimes.

Perhaps most notably, Asaro also beat the Hobbs Act robbery conspiracy charge for his alleged role in the infamous Lufthansa job at what is now known as John F. Kennedy International Airport, which netted the brazen Bonanno bandits nearly $5 million in untraceable cash and $875,000 in jewelry.

Asaro’s 2014 indictment included the 1969 murder of mob associate Paul Katz, because federal investigators have long believed that Asaro and Jimmy Burke whacked him. Some time in the 1980s, Asaro ordered his son, Jerome, to move Katz’s bones from an Ozone Park home, which was owned by Burke, because investigators were looking into Katz’s mysterious disappearance. According to the New York Post, federal agents acting on a tip descended on the house in 2013 and found Katz’s partial remains.

Mayor, Chancellor Kick off First Full School Year of ‘Equity and Excellence for All’

Equity and Excellence take front and center stage this year— the first full school year implementing the initiative since its formal introduction last September.

The targeted goal of the initiative is to support progress across all schools so that, by 2026, 80 percent of students graduate high school on time, two-thirds of graduates are college-ready, and all students are reading in 2nd grade.

These commitments build on critical administration initiatives including Pre-K for All, which provides every 4-year-old in the City with a free, full-day, high-quality pre-K seat, and the 130 Community Schools, which bring schools, families and communities together as partners to provide wrap-around services that increase opportunities and eliminate barriers to learning for underserved students.

In addition progress is slated to build in New York City schools across multiple measures: a graduation rate over 70 percent for the first time that puts the City on track to reach its 80 percent goal, the lowest-ever dropout rate, and the highest-ever rate of students enrolling in college.

“With the investments we are making as part of our Equity and Excellence agenda, we are shaking the foundation of our education system,” said Mayor Bill de Blasio.

The following is a breakdown of initiatives by-the-numbers breakdown for the 2016-17 school year:

Universal Literacy

Through Universal Literacy, every school will receive support from a dedicated reading coach who will work with teachers to ensure all students are reading on grade level by the end of 2nd grade.

Algebra for All

Through Algebra for All, by 2022, every student will have access to Algebra in 8th grade, complete Algebra no later than 9th grade, and there will be academic supports in place in elementary and middle school to build greater Algebra readiness.

AP for All

AP for All is adding Advanced Placement courses at underserved schools across the City; by fall 2021, students at all high schools will have access to at least five AP classes.

Ozone Park Step-Mom Get 15 Years for Beating, Starving Stepdaughter

By Forum Staff The evil step-mother from Ozone Park who was convicted of beating and starving her stepdaughter in July, has been sentenced to 15 years in prison. Maya Ranot,12, was abused by Sheetal Ranot and her biological father Rajesh for two years, repeatedly being denied food and suffering brutal beatings. On one occasion, the child was left on the kitchen floor of the family’s apartment with a cut to her wrist from a broken metal broom handle that was so deep, the bone was exposed.

That beating resulted in surgery and a lengthy hospitalization.

the defendant also wantonly beat and abused the girl inflicting pain still evident by the scars that mark her body today.”

The defendant Sheetal Ranot, 35, of 96th Street in Ozone Park, was convicted of first-degree assault

and endangering the welfare of a child. Maya’s father, Rajesh Ranot, is also charged with second- and thirddegree assault, first-degree unlawful imprisonment and endangering the welfare of a child. The couple’s case was severed at the start of the

proceedings and he will be tried at a later date.

Testimony in the trial shows that Sheetal Ranot repeatedly hit her stepdaughter about her body and face, causing bruising and severe pain. She locked the youngster inside her bedroom and for extended periods of time refused to feed her between December 1, 2012, and May 6, 2014. In one instance, on December 21, 2012, Sheetal Ranot kicked the girl in the face while wearing footwear, causing bruising, swelling and substantial pain about her eye and face. On another date, April 16, 2014, she struck Maya in the face with a wooden rolling pin causing a laceration, swelling and pain to her left cheek that required the girl to be treated at a local

Queens hospital. Doctors observed the child to be underweight and thin, weighing just 58 pounds.

In May 2014, Sheetal Ranot hit Maya with a broken metal broom handle. The blow caused a deep laceration to the left wrist and right knee. When medical personnel arrived at the family residence, they found Maya lying in a pool of blood in the kitchen with the tendons of her left wrist exposed. At that time, Maya was transported to Elmhurst Hospital where she underwent surgery for her wrist and received stitches to her knee. Doctors observed several bruises, marks and scars in various stages of healing throughout Maya’s body.

Jamaica Man Charged with Murder after Allegedly Firing Shots into Occupied Auto

By Forum Staff A 28-year-old Jamaica man has been charged with murder, attempted murder and other crimes for the fatal shooting death of one man and the injuring two others on Saturday, September 3, 2016.

District Attorney Brown addressed the killing, pointing it out as yet another senseless act of violence plaguing our communities. “The defendant is charged with firing a loaded weapon into a vehicle occupied by several individuals. One man was killed and two others injured. Gun violence has no place in a civilized society and those involved must be held accountable and severely punished for this alleged brazen act.”

The defendant was arraigned on a complaint charging him with second-degree murder, second-degree attempted murder, first- and

second-degree assault, second-degree criminal possession of a weapon, first-degree reckless endangerment and tampering with physical evidence. He was held without bail and ordered

to return to court on September 23, 2016.

According to the criminal charges, at approximately 9:30 p.m. on Saturday, September 3, 2016, the defendant approached a vehicle parked near the intersection of 89th Avenue and 139th Street in Jamaica, and allegedly asked the three occupants “Are you kings?”

Seconds later the defendant allegedly fired several rounds into the car. A bullet hit 20-yearold Albert Schaper, of New Jersey, in the shoulder and traveled into his chest killing him. Dirty Dozen Dealers Charged in Massive Drug Sweep at Astoria Houses

By Forum Staff Three gang members were among a dozen drug peddlers arrested and charged with selling drugs and weapons to undercover police officers at the New York City Housing Authority’s Astoria Houses after a year- long anti-drug initiative investigation. More arrests are expected.

Defendants in custody and other individuals are said to have sold heroin, crack, cocaine and other drugs to undercover police officers on nearly one hundred separate occasions since September 2015. Three of the defendants arrested have also been charged with separately selling a firearm to an undercover officer.

In a statement by District Attorney Richard Brown, he said that the investigation was part of an anti-drug initiative begun when he first took office over twenty-five years ago.

“Since that time, we have targeted hundreds of drug dealers operating in and around public housing developments throughout Queens and have put a significant dent in the drug trafficking which has long troubled the residents of these developments. We will continue to work together with our police officers and our elected officials and community leaders to keep our citizens safe.”

The investigation began in September 2015 when detectives assigned to the NYPD’s Queens Narcotics Division teamed up with District Attorney Brown’s Narcotics

Investigation Bureau with the goal of identifying, disrupting and stopping drug dealers and drug-related violence in and around the Astoria Houses. During the course of the investigation, undercover officers purchased narcotics and marijuana, as well as firearms, on nearly 100 separate occasions.

Charges for the defendants include first-, second- and third-degree criminal sale of a controlled substance, third- and fourth-degree criminal sale of marihuana, third- degree criminal sale of a firearm, second- and third-degree criminal possession of a weapon, criminal possession of a weapon, fourth-degree grand larceny, possession of a gambling device, second- degree promoting gambling and fourth-degree criminal facilitation.

The Astoria Houses, which are owned and managed by the New York City Housing Authority, consists of twenty-two buildings that are six- and seven-stories tall. Completed in November 1951, the 32.3-acre Queens development houses some 3,175 residents in approximately 1,100 apartments. The Astoria Houses is bordered by 27 Avenue, 8 Street, Hallet’s Cove and the East River.

Jamaica Honors Innocent Teen Murder Victim with Street Co-Naming Joined last Friday by D’Aja Naquai Robinson’s family, community leaders, and a host of anti-gun violence organizations, City Councilman Ruben Wills (D-Jamaica) led a street co-naming ceremony to observe the fatal 2013 shooting of the 14-year-old girl.

Robinson just left a friend’s Sweet Sixteen birthday party when she was struck down by two gang members who opened fire on the MTA bus she had been riding during their botched attempt to kill a rival. One of the two suspects arrested for her murder was tried and convicted this past spring.

Borough CUNY Schools to Benefit from $73.3M Capital Investment

By Forum Staff City University of New York schools in Queens are set to receive some of the $73.3 million in capital funding allocated by the City Council and state Legislature for muchneeded upgrades to CUNY campuses across the five boroughs.

On Monday, the Council Queens Delegation joined Council Speaker Melissa Mark-Viverito, CUNY Vice Chancellor for Facilities Judy Bergtraum and CUNY Queensborough Community College President Dr. Diane Bova Call to celebrate the $50.7 million investment. This comes in addition to $22.6 million in funding being granted through the state matching the Council’s FY2017 budget. According to CUNY, the money will support state-ofthe-art technology upgrades, public space enhancements, science labs, art and media equipment, student service centers, and more to improve its 24 campuses.

ORDER OF PROTECTION

When a press release detailing the sentencing of Sheetal Ranot came over The Forum’s fax machine this week, it was an instant reminder of the sickened stomach caused by the first press release bearing her name back in July, when news of her arrest came across the very same fax machine.

Sheetal Ranot is a 35-year-old woman of Indian descent, who with her husband Rajesh– the child’s biological father– tortured, beat, and starved her step-daughter, Maya Ranot, now 12, in the family’s Ozone Park home.

For two years, beginning in 2012, Maya was starved, beaten with a rolling pin, locked in her room, kicked in the face by her shoed step-mother and ultimately beaten with a broken metal broom handle. The last injury was discovered by paramedics called to the scene who found Maya on the floor, in a pool of blood, the bones and tendons of her wrist exposed.

LEGALLY SPEAKING Last Sunday was the 15th Anniversary of one of the darkest days in our history. The attack on our nation at multiple locations marked a turning point in our world and changed our lives forever. On that day, almost 3,000 people were murdered with casualties at the Pentagon, in Shanksville, PA, and at the World Trade Center in New York. Once again this year I watched numerous retrospectives on the disaster and the ceremony of the reading of the names of those killed in the attacks.

Now 15 years later our emotions still run high, but so does the toll it has taken on our nation, and in particular, our First Responders and those involved in the clean-up operations. CBS News recently reported that there have been more than 5,000 cases of cancer linked to the poisonous dust surrounding New York City during the days and weeks following the attack. Unfortunately, many of the illnesses striking these workers are slow starting and may not manifest themselves until many years later. It is therefore imperative that the future health and welfare of these brave men and women be given great consideration.

Clearly what needs to be addressed is how this could possibly happen, as we have seen, over and over again. The City’s policy of keeping families together is in dire need of mediation and overhaul.

There is a dangerous lack of information sharing among agencies, as was also evidenced in Maya’s case through a string of missteps and miscommunications between agency workers, police, and hospital personnel.

While we are nearly 100 percent convinced that this will fall on deaf ears, it bears stating (and repeating and repeating and repeating until we no longer have to): Something needs to be done.

IMMEDIATELY. Not now. RIGHT NOW. We look forward to the day when we can say we are proud of how our leaders protect our most precious resource at all costs.

We look forward to the day that our hearts remain calm and our skin doesn’t crawl at the slightest sound from our fax machine.

signed legislation to ensure benefits for 9/11 workers and volunteers. The new law, sponsored by Assemblymen Peter J. Abbate and Assemblyman Phillip Goldfeder and Senator Martin Goldin, extends the deadline to register under the WTC Disability Law until September 11, 2018, for workers and volunteers seeking lost wages and medical benefits as a result of their involvement in the September 11th rescue, recovery, and clean-up operations.

Right after the collapse of the Twin Towers, First Responders were joined by workers and volunteers to assist in removing tons of steel, concrete, and other debris. The term “bucket brigade” was reinvigorated to represent the methodical and cautious removal of debris to safeguard any victims who were trapped. Some of the illnesses caused by the fallout include respiratory issues, mental health issues, and cancer, including prostate, thyroid, leukemia, and multiple myeloma.

Additionally, there is more good news about the James L. Zadroga 9/11 Health and Compensation Act signed into law on January 22, 2011, which reactivated the September 11th Victim Compensation Fund. This fund provides monetary compensation for individuals who suffered physical harm or were killed in the initial attack, or

as a result of the debris removal efforts, and is overseen by a Special Master appointed by the Attorney General.

There are deadlines to register and there are deadlines to file your forms. This program – originally set to expire on October 3, 2016 – was extended and allows individuals to submit their claims until December 18, 2020. Also, the WTC Health program, which has both a responder and survivor program, provides screening and medical treatment for 9/11-related health conditions. This legislation provides continued funding for the WTC Health Registry that tracks the health of more than 71,000 impacted by the attack. This program also was extended and will provide medical coverage for the next 75 years for those affected.

While we are pleased that our government sees fit to take care of our First Responders and workers, it should not be a constant battle to obtain these benefits. They suffer now because they went in without hesitation to try to save lives and then to get our city and our country up and running. This is not a handout. They are entitled not only to our love and admiration, but our assurance that they and their families will be taken care of medically by their grateful country.

11 terrorist attacks on the United States with solemn ceremonies in neighborhoods across the World’s Borough.

Residents of Howard Beach, Hamilton Beach, and Lindenwood on Sunday night gathered outside the Ladder Co. 173/Engine Co. 331 firehouse on Cross Bay Boulevard and 158th Avenue for the annual Candlelight Memorial Ceremony organized

Earlier on Sunday, hundreds gathered at 9/11 Tribute Park on Beach 116th Street and Beach Channel Drive to honor the 57 Rockaway Park residents who lost their lives in Downtown Manhattan 15 years ago.

“After 15 years since 9/11, laying this

rose at the Rockaway memorial service never gets any easier!” said Assemblyman Phil Goldfeder (D-Howard Beach), a native and resident of Far Rockaway. “Truly emotional and beautiful service where we all show our strength, resilience and send a message to our heroes that we will never forget!!!”

Queens Borough President Melinda Katz also laid a rose on the Tribute Park mosaic on Sunday. “’Where were you when the world stopped turning on that September day?’” she wrote on Facebook. “Fifteen years later, commemorations across the borough still strong to memorialize those whose lives were taken, to honor their survivors, and to remember those still fighting illness due to their selfless, heroic efforts. #QueensNeverForgets.”

Living Wih Lymphadema–– What can you do?

This week, we’re going to talk about lymphedema, a chronic “swelling” condition that involves the blockage of lymph nodes.

Lymph nodes do a very important job—they drain fluid from tissues throughout our bodies and help immune cells reach the areas where they are needed.

When lymphedema blocks the actions of lymph nodes, swelling occurs, most often in the arm or leg. Although a reduction in the amount of swelling sometimes occurs over time, most patients have some permanent swelling, in many cases requiring a lifetime of management.

In addition to the debilitating effects of the condition on patients' everyday lives, lymphedema remains the most “poorly understood, relatively underestimated, and least researched" complication of cancer and its treatment, according to the National Cancer Institute (NCI), the nation's leading cancer researcher.

It is exceedingly frustrating to know that no cure exists for lymphedema and many patients get depressed about the daily bandaging or constant need to protect their affected limb. There are steps to be taken to have some control over this condition, and your local pharmacist should be able to help you with some of them, including sharing information and resources about lymphedema.

First things first: • Anyone with this condition has t learn all about it. Knowing what lymphedema is and what causes it helps you better understand the signs and symptoms you experience.

• Take care of the affected limb.

• Clean the skin daily, looking for signs of trouble, like cracks and cuts.

Apply lotion to prevent dry skin.

The entire body must be considered: • • • •

Eat fruits and vegetables Exercise daily Reduce stress Get enough sleep

Getting support: • attend support group meetings • use message boards and chat rooms • contact the National Lymphedema Network to find support groups in your area.

Treatment: • Treatment will focus on minimizing the swelling in affected areas and managing the pain.

The following is a sample listing of things you can do to minimize the swelling and control the pain. Lymphedema treatments include: • Exercises: Moving the affected limb may help to move the lymph fluid out. These exercises should be light, not strenuous; you should not tire from them. You are only looking for a gentle contraction in this case. Ask your doctor, pharmacist, or physical therapist for a list of exercises suggested for treatment.

• Wrapping your arm or leg: In your local pharmacy surgical supply center you will find a variety of wrapping bandages that can be of great help. Again, speak to your pharmacist about suitable choices for your particular condition.

Bandages wrapped around your entire limb encourage lymph fluid to flow back out of your affected limb and toward the trunk of your body. When bandaging your arm or leg, start by making the bandage tightest around your fingers and toes.

Wrap the bandage more loosely as you move up your arm or leg.

• Massage: Although massage treatment (manual lymph drainage) is not for everyone, it is highly affective in eligible patients. If you have a skin infection, active cancer, blood clots, or congestive heart failure you should avoid this type of treatment. Also avoid massage on areas of your body that have received radiation therapy.

• Pneumatic compression: You'll wear a sleeve over your affected arm or leg.

The sleeve is connected to a pump that intermittently inflates the sleeve, putting pressure on your limb. The inflated sleeve gently moves lymph fluid away from your fingers or toes, reducing the swelling in your arm or leg.

• Compression garments: These can be ordered by your local pharmacist, include long sleeves or stockings made to compress your arm or leg to encourage the flow of the lymph fluid out of your affected limb. Once you've reduced swelling in your arm or leg through other measures, your doctor may suggest you wear compression garments to prevent your limb from swelling in the future. Getting the correct fit for your compression garment is essential. Some people will require custom-made compression garments.

We hope that this extended column proves to be helpful in understanding and managing this condition that has gone unnoticed and underserved by the medical community for far too long.

Cuomo Signs Legislation to Ensure Benefits for Sept. 11 Workers and Volunteers

By Forum Staff On Sunday, Sept. 11, 15 years after the 2001 terrorist attacks on New York City, Gov. Andrew Cuomo signed legislation to extend the period for workers and volunteers seeking lost wage and medical benefits as a result of their involvement in the rescue, recovery, and clean-up operations at Ground Zero in Lower Manhattan.

The bill pushes the deadline for individuals to register under the WTC Disability Law to Sept. 11, 2018. The extension will allow additional individuals to receive workers’ compensation, disability, and accidental death benefits for their participation in the WTC post-attack operations.

“Though September 11th may feel like an eternity ago, we still feel the pain and the loss like it was yesterday, and the thousands of brave men and women who stepped up in our darkest hour are still grappling with the aftereffects,” said Cuomo, a Queens native. “We vow to do whatever we have to do to provide these brave men and women and their families the benefits they deserve. As New Yorkers, when we are knocked down, we get up twice as strong because we have our fellow New Yorkers to raise us up. The volunteers and workers raised us up in our time of need, and we will ensure they get the resources and the support they need.”

Cuomo added that he also strongly encourages all Sept. 11 responders to consider using the World Trade Center Health Program, administered by the National Institute for Occupational Safety and Health for both treatment and monitoring of their health.

This program, established by the James Zadroga 9/11 Health and Compensation Act of 2010, was recently funded by the federal government for 75 years. Responders at the WTC and related sites in the Pentagon and Shanksville, PA, and survivors who were

in the New York City disaster area are seen at the clinics by experts in the field, without charge. In addition to treating illnesses, the clinics begin monitoring the health of responders. Services are available at many Clinical Centers of Excellence in New York City, Long Island and New Jersey, as well as through a nationwide network of providers, Cuomo noted.

As of June 30, 2016, there are approximately 75,000 responders and survivors enrolled in the WTC Health Program.

“The 9-11 registry reopener law is important and will help our members and other New York first responders who may get sick as result of their work in the wake of the terrorist attack on our city,” said Steve Cassidy, president of the Uniformed Firefighters Association.

“There is no expiration date for the heroic sacrifice of the New York City police officers and other first responders and volunteers who were made ill by their service in the weeks and months following 9/11,” added Patrolmen’s Benevolent Association President Patrick Lynch. “It is critical that they receive the compensation and care they deserve, for as long as they need it. We applaud the Governor and the Legislature for extending these important benefits.”

Retail Workers Union, Medical Marijuana Manufacturer Ratify Historic Contract

By Forum Staff Local 338 of the Retail, Wholesale, and Department Store Union, UFCW, and Vireo Health New York recently announced that they have reached a labor agreement – the first union contract in the history of New York State’s new medical cannabis industry.

The agreement, according to Vireo, covers current and future employees at its cultivation and manufacturing facility in Fulton County’s Tryon Technology Park, and at all four of its dispensaries in Albany, Binghamton, White Plains, and on Queens Boulevard in Elmhurst. The contract provides a living wage with guaranteed raises, paid time off, healthcare coverage and retirement benefits.

“The strong union contract approved by the workers at Vireo will ensure that they have secure, middle class jobs so that they can provide for themselves and their families,” said John Durso, president of Local 338 RWDSU/UFCW. “The workers in this industry are incredibly dedicated to the patients they serve. Vireo opened the borough’s first medical marijuana dispensary at 89-55 Queens Blvd. in Elmhurst in January. Vireo is one of five companies to be awarded a license to manufacture and provide pharmaceuticalgrade cannabis-based medications in the state. Bloomfield Industries runs the city’s only medical marijuana production facility in Long Island City.

Bratton Responds to IG’s ‘Deeply Flawed’ Quality-of-Life Report

City Police Commissioner Bill Bratton last week roared back at the Department of Investigation’s Office of the Inspector General for the NYPD, ripping its June report on quality-of-life policing as a “deeply flawed” analysis “without merit” that “perpetuates misunderstandings about a police strategy that is critical to the well-being of New York City.”

The OIG’s 87-page account, “An Analysis of Quality-of-Life Summonses, Qualityof-Life Misdemeanor Arrests, and Felony Crime in New York City, 2010 to 2015,” examined “what, if any, data-driven evidence links quality-of-life enforcement⎯defined narrowly for purposes of this report as quality-of-life criminal summonses and qualityof-life misdemeanor arrests⎯to a reduction in felony crime.”

The Office of the Inspector General noted that the report “looks solely at the question of whether quality-of-life enforcement has any measurable relationship to felony crime. This report does not speak to the use of quality-of-life enforcement to maintain order, nor does it speak to any type of quality-of-life enforcement other than qualityof-life summons and misdemeanor arrest activity.”

no empirical evidence demonstrating a clear and direct link between an increase in summons and misdemeanor arrest activity and a related drop in felony crime.”

Bratton and the NYPD have issued a scathing 41-page response to the OIG report, blasting everything from its methodology to “its veiled attack on the concept of Broken Windows policing.” Bratton added that, through its response, the NYPD “must also categorically refute any insinuation that Broken Windows policing is racially discriminatory.”

Enforcement targeting these conditions has become known as “quality-of-life” policing, and it has been frequently disparaged as a vehicle of oppression that creates racially disparate outcomes. That could not be further from

the truth. This type of policing is an essential tool of community engagement and trust building, most often in direct response to community concerns. Quality of life policing will remain a key strategy for the NYPD.” The department also pointed out that it does not stand alone in its rejection of the OIG report.

“Two independent criminologists, Richard Rosenfeld and David Weisburd, have also roundly criticized the report, citing: problems with its research and statistical methodology; the lack of consideration for officer discretion; and the omission of the 16 years prior to 2010 — when misdemeanor arrests strongly correlated to the largest crime decline in New York City history,” the NYPD wrote. “These criminologists have also determined the analysis contained in the report is not strong enough to support its conclusions.”

In conclusion, according to Bratton and the NYPD, “the OIG has issued a report using questionable methodology and has reached unsupported conclusions challenging a police strategy that has been central to the city’s efforts to promote public safety while also enhancing trust and public confidence in the police department. This report perpetuates misunderstandings about a police strategy that is critical to the well-being of New York City and has played a central role in creating the safest big city in America.”

Flushing Man Appointed to Advisory Committee on Minority Veterans

By Forum Staff An Army veteran and former National Commander of the American Legion who calls Flushing home has been appointed to the Advisory Committee on Minority Veterans, according to U.S. Rep. Grace Meng (D-Flushing).

Fang Wong was selected to the prestigious 12-member panel consisting of veterans who represent respective minority groups after Meng wrote a letter to U.S. Secretary of Veterans Affairs Robert McDonald recommending him for the position.

Established under federal law in 1994, the ACMV advises the Secretary and Congress regarding benefits, medical care, programs, and services for the country’s 4.7 million minority veterans.

“Fang Wong is an outstanding individual with an exemplary record of military service to our nation,” said Meng. “After bravely serving with honor and dignity in the U.S. Army for two decades, including two years in the Vietnam War, he continued his service to our nation by fighting for and representing U.S. veterans. He has also served in leadership positions, elected and appointed, on several key veteran service organizations on the local, state, and national levels including National Commander of the American Legion. He will serve the Advisory Committee on Minority Veterans with excellence and diligence, and enhance our nation’s indebted service to our minority veterans.”

As National Commander of the American Legion from 2011-2012, Wong, 68, was the first ever non-white male to head the nation’s largest veterans organization, which boasts more than two million members. He also served as Commander of the American Legion Department of New York. In addition to the Vietnam War, he served tours of duty in Germany, Korea, and several stateside military bases. Wong was awarded several medals including the Bronze Star, and retired from the Army as a Chief Warrant Officer.

“I am deeply honored to have been chosen to serve on this critical panel,” said Wong, whose term on the committee runs through June 2018. “I look forward to sharing my years of experience and advocacy to further help our nation’s minority veterans, and to make sure that they receive the benefits and services to which they’re entitled.

Congress Passes JASTA, but Obama Promises a Repeat Veto

Cusenza Days before the country would solemnly mark the 15th anniversary of the Sept. 11 terrorist attacks on the homeland, the House of Representatives passed the Justice Against Sponsors of Terrorism Act. However, The White House has indicated that President Barack Obama will again veto JASTA and any iteration of the bipartisan legislation that would allow victims to sue foreign states that fund groups like Al Qaeda to commit terrorism on U.S. soil.

An overwhelming majority (15 of 19) of the Sept. 11 hijackers were citizens of Saudi Arabia.

“I’m pleased the House has taken this huge step forward towards justice for the families of the victims of 9/11,” said U.S. Sen. Charles Schumer (D-N.Y.), who co-authored the bill with Sen. John Cornyn (R-Texas). “There are always diplomatic considerations that get in the way of justice, but if a court proves the Saudis were complicit in 9/11, they should be held accountable. If they’ve done nothing wrong, they have nothing to worry about. I hope for the sake of the families who have suffered such losses and fought so hard, the Administration will not veto this bill.”

Though the House and Senate approved the Justice against Sponsors of Terrorism Act, Pres. Barack Obama has vowed to veto it.

JASTA, Schumer noted, amends the Foreign Sovereign Immunities Act so that foreign sponsors of terrorism cannot invoke “sovereign immunity” in cases arising from a terrorist attack that kills someone on American soil.

Additionally, the legislation amends the Anti-Terrorism Act so that civil suits against foreign sponsors of terrorism can be held accountable in U.S. courts where their conduct materially supports

an attack that kills an American.

White House Press Secretary Josh Earnest has said that the administration remains concerned that JASTA “could open up U.S. companies and even potentially U.S. personnel to vulnerabilities when they’re engaged in actions or doing business or conducting official government work overseas. There is an important principle related to sovereign immunity. And when you’re the most

powerful country in the world, you’re invested in the idea of sovereign immunity, given how deeply the United States is involved in so many other countries.

So we believe that’s a principle worth protecting. And that is the concern that we have with this legislation, at least the way that the most recent draft was put forward. Doesn’t have to do with any specific country, but rather has to do with our concern about a specific principle that benefits the United States and private U.S. interests in countries all around the globe.”

Schumer, born and raised in Brooklyn, said JASTA “is very near and dear to my heart as a New Yorker, because it would allow the victims of 9/11 to pursue some small measure of justice by giving them a legal avenue to hold foreign sponsors of terrorism on US soil accountable for their actions. [It] is a long-overdue fix—a responsible, balanced fix—to a law that has extended too large a shield to foreign actors who finance and enable terrorism on a massive scale. Council Speaker Outlines Significant Bail, Correction Reforms in Legislative Package

Cusenza City Council Speaker Melissa Mark-Viverito on Monday announced a package of legislation that, according to the Speaker, will ensure that inmates are not brought to court in Department of Correction uniforms, provide inmate transportation to all criminal court appearances, and allow for the return of bail fees collected by the City if an inmate makes their court appearances.

“It is important that New Yorkers who are unable to afford bail are treated equally to those with more financial resources,” MarkViverito said. “This legislation will ensure that those New Yorkers too poor to afford bail are not prejudiced or stigmatized for being incarcerated, increase speedy trials within the court system, and help family members so they aren’t needlessly taxed for posting bail when a defendant makes all their court appearances.”

According to Mark-Viverito, the legislative package aims to achieve the following: DOC uniforms, prejudice in court and inmate release: The proposed law would ensure that inmates are produced at court appearances in their personal clothing, as opposed to a DOC uniform.

Within the past year, Mark-Viverito noted, DOC has begun housing inmates in agencyissued uniforms to help stem gang violence.

The Council, Mark-Viverito said, continues to support the uniform policy within DOC correctional facilities.

The policy is supposed to be that inmates are not produced in court in a uniform if they are on trial or testifying before the grand jury. However, advocates have reported that inmates testify in grand jury appearances in DOC uniforms. Mark-Viverito said this is unfair to the inmates, the vast majority of whom are forced to testify in a DOC uniform “solely because they are too poor to afford bail.”

Court appearances and efficient judicial processes: The proposed legislation would ensure that DOC transports inmates to all of their criminal court appearances. Currently DOC ensures that inmates make court appearances for the offense they are in custody for, but not other court dates they may have for unrelated cases. This causes “a massive amount of delay within the court system,” Mark-Viverito said, and may affect speedy trial. Also, inmates may miss out on jail time credit to which they are entitled, and spend more time in custody because of this.

Restitution of bail fees: The proposed legislation would ensure that the City returns the 3 percent bail fee it collects when an inmate makes their court appearances. Currently the City collects a 3 percent fee for processing cash bail. If someone makes their court appearances, the fee is returned to those who posted the bail, except in the case where an individual is convicted of any offense, including non-criminal offenses. Those posting bail (most often family members) should not have to pay a fee if an individual shows up in court – “which is what bail is meant to ensure,” the Speaker noted.

In recent years, the Obama administration, on many fronts, has sought to expose the bail system, warts and all. The Department of Justice has asserted that fixed bail schedules are unconstitutional because they don’t take into consideration the ability of the defendant to pay.
