Fey Goodbye: 106th Precinct Commander Announces Retirement

NYPD captain set to lead Columbia Univ. security after 27 years with Finest

By Michael V. Cusenza Captain James Fey, commanding officer of the 106th Precinct, surprised many constituents last Thursday when he announced his retirement during Community Board 10’s monthly meeting in South Ozone Park.

“I have to tell you, after 27-plus years with the department, the decision to leave, even for a great job prospect, was gut wrenching,” the married father of three young boys told The Forum on Monday, adding that he has accepted the position of director of Security Operations for the main campus of Columbia University.

“I’ve grown up with this job, and take a lot of pride in it. I had a real sense of conflict – the thought of leaving my career, my officers, the community, who have been through a lot in the last eight months, was troubling. I had to grapple with what was best for my family, and in the end, that is what won out.”

Fey has led the south Queens command for the past eight months, taking the reins from Inspector Jeff Schiff, who now runs the 105th Precinct in Queens Village.

“Although he was only assigned to the 106th Precinct for less than a year, Capt.

Fey proved himself an able commanding officer here,” said Betty Braton, long-time

Capt. James Fey’s final tour with the NYPD will be Oct. 16.

chairwoman of CB 10. “Crime is down in the precinct, and he had established good working relationships with community residents. As I said at Community Board 10’s meeting at which he announced his retirement plans, we wish him well in his future endeavors and thank him for his exceptional service here in our community.”

Fey’s career with the Finest began in July 1989, walking a beat in the Bronx.

Less than a year later he was assigned to the 13th Precinct in Manhattan. The move from Parkchester to Gramercy Park changed everything for Fey.

“That’s where I really came into my own,” he said of the 1-3. “I was really comfortable doing what I was doing.”

That comfort helped to shape a confidence that would permeate most aspects of Fey’s life. It sparked a singular drive to take NYPD exams and earn promotions; to satiate his curiosity and earn an education, which led to degrees from Nassau Community College, St. John’s University, Marist College, and John Jay College of Criminal Justice.

“I believe in growing as an individual,” Fey said. “I think if you hit a plateau, it’s

necessary that you create new goals. You get better as you go along, through experience.”

As he prepares for his final tour this Sunday, Oct. 16, Fey said he appreciates how the department, and his brothers and sisters in Blue, have helped him grow these past 27 years, “Simply stated, the NYPD has provided me the opportunity to further myself more than I could have possibly imagined,” he concluded. “I’m going to miss it terribly.”

Senator Slams City for Zoning Change to Ozone Park Elementary School

By Michael V. Cusenza An elected state official this week blasted the City for changes that were made to the zoning regulations of a new elementary school set to open next fall in Ozone Park.

State Sen. Joe Addabbo, Jr. (D-Howard Beach) on Tuesday denounced the administration’s decision to allow large numbers of students from neighborhoods outside of Centreville to enroll in PS 335.

Addabbo, a member of the Senate Education Committee, reached out the Department of Education in July, asking the agency to ensure that PS 335 is opened strictly to children who live nearby. In a letter to the DOE Queens Office of District Planning, Addabbo urged the department to see that Community Education Council 27’s vote in favor of keeping PS 335 zoned for families in area neighborhoods is upheld in order to help ease overcrowding in not only this new Centreville school and in other Ozone Park schools, but also the overcrowding that exists in nearby schools, like PS 146 in Howard Beach.

“The construction of PS 335 has the potential to help ease some of this congestion, but only if done right,” Addabbo noted. “It is vital that the DOE makes sure PS

The Big Apple kicked off Domestic Violence Awareness Month last Thursday with “NYC Go Purple Day.”

By Forum Staff Mayor Bill de Blasio last Thursday announced that the City will host programming throughout the month designed to raise awareness around domestic violence and the resources available to victims, survivors, and their children.

October is National Domestic Violence Awareness Month.

“No New Yorker should feel unsafe, especially within their own home and surrounded by the people they love. That’s why we’re raising awareness about healthy relationships and the resources available to those who find themselves in unhealthy or abusive situations,” de Blasio said. “Since we opened the doors to the Staten Island Family Justice Center earlier this year, I’m proud to say that every New Yorker – regardless of age, race, language, gender or sexual identity or immigration status – can walk into a center in their own borough to receive critical services, from legal counseling to housing assistance.”

De Blasio kicked off the month last Thursday with help from his wife, First Lady Chirlane McCray, and Mayor’s Office to Combat Domestic Violence Commissioner Cecile Noel, who joined him for “NYC Go Purple Day.” To mark the annual day of awareness, buildings and landmarks across the city were lit up in purple, including City Hall, 1 Police Plaza, the Yankee Stadium Jumbotron, all five borough halls, the Queens Museum, and the Parachute Jump at Coney Island. All City agencies were encouraged to participate by asking their employees to wear purple and to post on social media with the hashtag #NYCGoPurple. NYPD precincts also decorated their buildings and cars with purple banners and ribbons. “’NYC Go Purple Day’ is a day for hope, when we see elected officials, City agencies, and New Yorkers across the city come together to bring domestic violence out of the

shadows. We know that domestic violence can affect anyone, and this Administration is committed to doing all that we can to help New Yorkers leave their abusers and rebuild their lives,” said Herminia Palacio, deputy mayor for Health and Human Services. “Thank you to everyone who is out there today making sure that the people of our city know the many vital domestic violence resources available to them. The more we all know, the more we are able to help those around us find the help they need.”

Among the series of domestic violencerelated events taking place in the city throughout the month of October two are set for Queens: • Friday, Oct. 21 at 10 a.m.: The Queens Family Justice Center will host a full-day medical services/client and partner appreciation fair with offerings that include mobile testing, a client appreciation luncheon, and a domestic violence presentation for hospital and clinic staff in Queens. A Community Healthcare Network Mobile Van will offer primary care health services as well as PrEP and PEP (HIV care) services, HIV testing and treatment, STI testing and treatment, condoms, emergency contraception (Plan B), birth control, pregnancy testing and counseling, mental health care, breast self-exams, and referrals for mammograms.

• Thursday, Oct. 27 at 10:30 a.m.: The Queens Family Justice Center, in coordination with the Borough President’s Office, is organizing an event featuring male speakers to engage and empower men around the issue of intimate partner violence. This event will welcome men of all ages to join the conversation on intimate partner violence with an emphasis on engaging younger men.

Feds set Aside More than $800K for New Bulletproof Vests for Cops across NY

By Forum Staff U.S. Senators Charles Schumer and Kirsten Gillibrand have announced $808,198.45 in new federal funding for the State of New York to purchase 13,005 bullet proof vests for police officers across 192 jurisdictions.

The funding was allocated through the DOJ’s Bureau of Justice Assistance Bulletproof Vest Partnership program to purchase new bullet proof vests for police office and would also provide reimbursement to state and local law enforcement agencies for purchase of bulletproof vests. New York City will receive 8,569 vests; Long Island will re-

ceive 1,477 vests, with the rest being distributed throughout the rest of the state.

“This massive federal investment will ensure that the men and women who put their lives on the line every day to keep our communities safe are equipped with the life-saving gear they need to protect themselves,” said Senator Schumer. “With over 13,000 new bulletproof vests, officers and other law enforcement officials across New York can feel safer...”

“In a dangerous situation, a bulletproof vest might be the only barrier between life and death for an officer. We have to make sure our brave officers are using equipment that is up-to-date and effective. I was proud

Rego Park Man Faces Two-Year Prison Term for Massive Weapons Stash

The defendant pleaded guilty to thirddegree criminal possession of a weapon, and according to court sources will likely be sentenced to two years in prison, followed by two years’ of post-release supervision, on December 7, 2016. According to the criminal complaint, when the review was conducted at Shou’s home, officers observed hundreds

of pounds of smokeless gunpowder, an assault rifle and high-capacity magazines and ammunition laying in plain sight.

A court-authorized search warrant drafted by District Attorney Brown’s Computer Crime Unit was then executed at Shou’s residence.

Law enforcement seized 14 licensed handguns, two loaded shotguns, a licensed rifle that lacked any safety lock devices, 45,000 rounds of ammunition, 225 pounds of smokeless gun powder, unassembled assault rifles, high-capacity ammo magazines, an ammunition press and other items.

According to the charges, Shou did not have a federal firearms license as a gun dealer and is not licensed to sell or manufacture firearms or ammunition.

None of the items seized will be returned to the defendant.

Parks Department Worker Injured in ‘Horrible’ Fort Totten Building

By Michael V. Cusenza A Department of Parks and Recreation worker recently had to be rescued by firefighters and hospitalized after falling through the floorboards of a decrepit building in a Bayside park, according to a city parks nonprofit group.

Moments after he began sweeping the feces-covered first floor of a rotten edifice in Fort Totten Park on Monday, Oct. 3, Cory Credell, 45, found himself lodged waist-high in a hole in that floor, Geoff Croft of NYC Park Advocates wrote on the organization’s blog, A Walk in the Park. City Fire Department personnel placed a back-board across a beam and were eventually able to extricate Credell, who later blasted Parks for “forcing” him and his colleagues to work in the decaying structure “even after protesting and sending photographic evidence to their supervisors that showed the building was dangerous,” Croft noted.

Credell also said that they were instructed to continue working “despite not having the proper training or equipment – no face ventilators – just a paper mask,” according to Croft.

“We let our supervisors know that the conditions were horrible,” Credell noted.

“Then they came to us with an email from the [Parks Department] Health and Safety inspector saying that we could do it.”

Credell went on to say that the edifice is obviously unsafe for several reasons.

“It’s an old building – does it have asbestos? Lead? I know it has mildew. Weeds are growing through the floor,” Credell reported. “The smell is horrible, horrible. We asked about the ventilator masks, but they said this mask is sufficient. We asked about that several times.”

According to Croft, the accident occurred after a Parks official claimed to have inspected the building on Sept. 30 “and gave the workers the go-ahead to clean the toxic

building.”

Credell was incredulous.

“She couldn’t have gone into [Building] 429; if she’d went into to 429, as soon as you go in you see the holes in the roof,” he reasoned. “I know she went to building 430.

There’s no way she could have gone into 429 and deemed it safe.”

That Parks representative later admitted that, indeed, she had not been in the accident building.

“You wrote that email saying it’s safe – you didn’t give a sh*t. You didn’t care who got hurt, who got killed, nothing,” Credell said, ripping the agency official. “How can you give an order like that when you didn’t even check it out? Can you explain that?”

Cops Warn Community about Quartet of Young Crooks

Police believe the four young men pictured are responsible for at least four recent robberies in Howard Beach and Ozone Park.

By Michael V. Cusenza Police recently reached out to the communities of Howard Beach and Ozone Park for help in identifying four young men wanted in connection with a string of lateSeptember robberies.

Investigators believe that the suspects, who are usually on bicycles, are responsible for at least four incidents, including a robbery in Frank Charles Memorial Park, during which they swiped the iPhones of two young boys; and the mugging of a 50-yearold woman in Centreville.

There may be more incidents, police said,

and there may be even more suspects working with this crew.

“That’s a continual problem that we have,” said Capt. James Fey, commanding officer of the 106th Precinct, “young kids getting involved [in crime] at an early age.”

Brooklyn Man Pleads Guilty to Bringing Loaded Gun to JFK Airport

By Forum Staff A Brooklyn man has been sentenced to seven years in prison after pleading guilty to criminal possession of a weapon for bringing a loaded pistol to Kennedy International Airport in April 2015. The unlicensed weapon was found when the defendant went through a scanner during a routine preflight security check.

“Firearms illegally possessed in this City pose a serious and deadly threat to the safety of everyone, and that is especially true when boarding a commercial aircraft,” said District Attorney Richard Brown. “Firearms do not belong on airplanes in the hands of civilians.”

The defendant has been identified as Aquil L. Dunbar, 22, of Bergen Street in Brooklyn. Dunbar, who pleaded guilty to one count of second-degree criminal possession of a weapon in July 2016, was sentenced today to seven years in prison as a predicate felon.

checkpoint. During the pre-flight screening, security agents spotted a .25 caliber automatic pistol in the defendant’s carry-on luggage. The firearm was loaded with six live rounds of ammunition. The pistol was concealed in a sock that was inside of a shoe box and placed inside a plastic bag.

WAR OF WORDS Dear Editor,

Battle lines on issues affecting the election, and the perilous near future, seems to have been sidetracked once again. Another lost opportunity was squandered on the second debate, with the first thirty minutes discussing the use of off-color remarks made in a private conversation (or what was supposed to be). I was nowhere shocked by the contents, of common vulgarity, than I was with Claude Rains’ discovery that there was gambling going on at “Rick’s Place” in Casablanca. Male talk of this nature went on then, as it does now, and not only in a locker room setting, but bars, construction sites, sporting events, and all the ships at sea. In the case of the latter, it was described as salty language. Popeye probably did his share of verbal expression, but not in the company of his girlfriend Olive Oyl. In my own days of early circulation, it was out of order to use the word “hell” in the presence of a female at any age. Over the last thirty years however, young ladies have come to use such terms in conversational dialogue that would make a sailor blush. Part of young men growing up has always included “macho bluster.” Somehow the use of expletives characterized a more manly presence, giving an air of maturity around one’s peers. Word verbiage is simply that, when compared to overt action. The latter has been more used in determining Bill Clinton’s behavior with a variety of women of the years.

In fairness to both Clinton and Trump, events spanning the years of Governorship through the end of Presidency in 2001, along with off the cuff profanity in a private setting twelve years ago, by a private citizen has no relevance, to finding solutions, in a maze of immediate problems facing the bulk of Americans in 2016. All of us have had moments, which we would love to have back, where something was said or done in the haste of expediency. Both campaigns forget that we are all human.

We only have to look at the negative ads perpetuated in the last sixty days, to know that Clinton and Trump are both guilty of positions and comments they wished had never been exposed to the public. We all evolve in one form or another. It is easy to pick the winner of the Belmont, when once the race has been won. Learning from our mistakes builds character, and admitting a renaissance of opinion, beats the continued perpetuation of a lie. Crystal balls solely exist in fairy tales, so that we must be prepared, to update our

stands on the changing conditions of an uncertain world Only a short time remains, to offer answers to the questions Americans need to know now. If the Trump tax returns is so vital, as to his fitness as President, then he should release them. Hillary likewise, should release the transcripts from the quarter million dollar price tag, charged for her speeches, to bankers on Wall Street.

We may not be happy with the candidate choices, but there is a reason. The GOP is angry that the party had no say in the selection of the standard bearer, and that the voters fumbled the privilege. In turn, the Democrat voters are also angry, for the opposite reason, in that the party took away their right, to choose an alternative to what many describe as a flawed candidate. Like it or not, all voters must live with the results, and the time is ripe for Clinton and Trump to present their direct answers, to the most pressing needs facing American households.

De Blah Blah Blasio The City on Monday began moving employed single homeless men into a Maspeth Holiday Inn Express. While the de Blasio administration has said that it has scrapped its original plan to convert the hotel into a 110bed shelter, the Department of Homeless Services will still use 30 of the building’s rooms to house the indigent.

State Sen. Joe Addabbo, Jr. (D-Howard Beach), who has opposed the shelter proposal, issued the following statement: “Wow, the Mayor still doesn’t get it. Bill de Blasio thinks that telling the Maspeth community their protests were successful enough to alter his plans from creating a homeless shelter for adult couples at the Holiday Inn Express to renting single rooms for adult males would resolve the foreseeable, growing homeless issue and pacify the residents.

Does he still not understand that housing any individual in a room without a kitchen – isolated without proper public transportation, under prison-like settings

complete with 24-hour guards, police surveillance, metal detectors and a curfew – is not an appropriate way of truly assisting a human being in need of help?

In addition, the lack of governmental transparency at the Maspeth site by this administration, from a Mayor whose campaign was built on improving governmental transparency, is immensely frustrating. For months, the area elected officials and community leaders

were told by the administration that adult couples were being placed at the Holiday Inn Express shelter, but without notice, NYC Department of Homeless Services vans rolled into the hotel last night to instead place individuals into rented rooms.

This administration does not think the community understands the difference between housing families in a shelter and renting rooms to individuals, which completely changes the

procedural rules for disclosure and financial transparency, but we do understand. How many rooms will be rented? What are the taxpayer-funded costs of renting each room? What is the schedule of additional individuals being brought to the hotel?

I never had the opportunity to ask these critical questions on behalf of my constituents as the Mayor changed the plan because it happened overnight and, once Addabbo represents the 15th again, without any public input Senatorial District

or warning. I guess after being shut out from submitting alternative proposals, and two Mayor-edited propaganda videos later, this is what the people of Maspeth get.

To think that all the unprecedented anger, all the frustration, the peaceful protests by compassionate residents who, like every other New Yorker, care for their community of Maspeth, could have been avoided if the Mayor asked the elected officials for assistance in resolving the foreseeable homeless crisis, instead of dictating inappropriate sites upon us.

There are still alternatives to mishandling the homeless issue and truly helping people in need of housing and services, such as requesting state aid from Governor Cuomo. The Mayor has a choice between seeking to actually address the homeless situation or spending his efforts in continuing to make propaganda videos in response to the ongoing protests. The choice is his.”

City Pledges Reforms to Children’s Services after Latest Tragedy

Cusenza A red-faced Mayor Bill de Blasio and Administration for Children’s Services Commissioner Gladys Carrion recently detailed reforms to the embattled agency after a badly beaten and malnourished Manhattan boy, already part of an ACS investigation, died late last month allegedly at the hands of his guardians.

Zymere Perkins, 6, was pronounced dead hours after his mother rushed him to St. Luke’s Hospital. Zymere’s mom and her boyfriend have been charged in the case.

“This is an unacceptable tragedy – it’s as simple as this. It should not have happened,” de Blasio said. “I look at a young boy who went through unspeakable pain, a young boy who is no longer with us who should still be here and who should have been saved – it’s as simple as that. And we’re going to talk about, today, what we know so far and what we are trying to do as a result of what we know. We’re also going to talk very clearly about the many, many elements we do not yet know, the investigations that are underway, and the things we hope to learn, and the things we will do going forward. But the part we do know is the most important part – it should not have happened. And I want to express my sorrow that this happened. I want to be very clear, the buck stops here, and this is the

• Ensuring that there is a sufficient number of experienced NYPD and ACS personnel that will jointly investigate cases of children suspected of having endured serious abuse.

• ACS must approve ending contracted services for cases that involve allegations of serious physical abuse against children.

• ACS will strengthen oversight of child protective staff by assembling a team outside of their division to hold child protective workers accountable – to scrutinize work, perform audits, and initiate case reviews.

• ACS will work with the Department of Education to establish clear guidelines for when a series of absences should trigger an investigation.

Carrion promised further reforms in the coming months.

“I am devastated by this tragedy,” the commissioner said. “The death of one child is one too many. There is no excuse – there never is. No child should fall through the cracks in our city. It is the mission of my agency, ACS, and my personal goal to protect every child. That’s our mission. There is no mandate that is more important than that.”

De Blasio reiterated that the tragedy of Zymere Perkins is “fundamentally unacceptable.”

“And I want to find out, in terms of those in government who were engaged directly in this case, what happened, what people did wrong, what people did right, who is responsible, and I want to assure all New Yorkers that anyone who works for the City of New York found to be negligent in this case will pay very serious consequences for that,” he added.

Astoria’s 114th Precinct is the latest command to implement the NYPD Neighborhood Policing Plan, which includes Neighborhood Coordination Officers and new sector boundaries.

By Michael V. Cusenza The City Police Department has rolled out its Neighborhood Policing Plan to more than half of its 77 precincts and all nine Housing Police Service Areas, according to the NYPD. The 114th Precinct in Astoria is the latest borough command to implement the strategy that is the brainchild of Police Commissioner Jim O’Neill and Chief of Department Carlos Gomez. “[T]o close the gap in trust and approval of police, we have to do more than eliminate unnecessary enforcement activity. We have to fundamentally change the way we do our business,” O’Neill noted in recent remarks in front of the Association for a Better New York.

“The NYPD’s Neighborhood Policing Program marks the first time any police department, anywhere, is totally reorganizing to deliver the same cops, in the same neighborhoods, every day. So, now we will know members of the community, know the problems, and work together to solve them.”

The newly minted top cop said the public that the Police Department protects and serves will soon have the names, email addresses, and cell phone numbers of the individual police officers who patrol their streets every single day.

“This is not a repackaged version of prior generations’ ‘community policing.’ This is very much a crime-fighting model – because fighting crime is what we get paid to do. It’s what you need us to do. At the same time, we are strengthening the relationships between cops and the people who live and work in every neighborhood,” O’Neill said. “As I tell all our officers, rookie and veteran alike: New Yorkers in every neighborhood want to see you. They want the police to help them. They’re glad we’re there on their streets.”

As O’Neill explained earlier this year, the Neighborhood Policing Plan divides precincts into four or five fully staffed sectors that correspond, as much as possible, to the boundaries of actual existing neighborhoods. Sector officers assigned to these sectors work the same neighborhoods on the same shifts, increasing their familiarity with the local residents and local problems. The radio dispatchers, supervisors, and sector officers work together to maintain “sector integrity”: the sector officers and sector cars do not leave the boundaries of their assigned sectors, except in genuine emergencies. The plan seeks to foster a sense of ownership among sector officers for the people, the problems, and even the perpetrators in a particular sector; a sense of geographic responsibility and accountability, O’Neill said.

Supporting the sector officers and filling out each sector team are two cops designated as the neighborhood coordination officers.

The NCOs are conceived as liaisons between the police and the community, but also as key crime-fighters and problem solvers in the sector, according to O’Neill. While they answer some radio calls to keep them conversant with the daily workload, the NCOs spend more time actively familiarizing themselves with the community to better respond to neighborhood-specific crime and other conditions. The NCOs immerse themselves in the community by attending meetings with community leaders and clergy, visiting schools, following up on previous incidents, and using creative techniques and adaptive skills to fight crime unique to their particular sectors.

“We’ve now pivoted toward a model of policing that connects better with communities – a plan that not only lowers crime even more, but forges real, lasting relationships with those we serve,” O’Neill said.

City says it has Enrolled 20K Seniors and People with Disabilities in Rent Freeze Program

Mayor de Blasio said the initiative helps those eligible stay in affordable housing by freezing their rent.

The city has enrolled 20,000 seniors and people with disabilities in the NYC Rent Freeze Program since expanding access in June, 2014. The program, which includes the Senior Citizen Rent Increase Exemption (SCRIE) Program and the Disability Rent Increase Exemption (DRIE) Program, helps those eligible stay in affordable housing by freezing their rent.

New efforts to inform tenants about the Rent Guidelines Board’s freeze on one-year rent-stabilized leases, and two-percent increase on two-year leases—both of which took effect this October 1st, have also been launched.

About 1.6 million New Yorkers who live in rent stabilized apartments have leases coming up for renewal during the term affected by these guidelines, and the board ruling means that hundreds of thousands of New Yorkers now have more security and a better shot at making ends meet.

“Keeping New Yorkers in their homes has been a top priority of this administration since day one and our Rent Freeze Program is designed to do just that,” said Mayor Bill de Blasio. “A person should not be forced to leave the place they’ve called home because they’ve been priced out or are unable to work due to a disability."

“As legislators and as citizens, we have an implicit responsibility to care for our aging generations,” said Council Speaker Melissa Mark-Viverito. “When the City Council expanded the eligibility threshold for SCRIE and DRIE in 2014, it was to ensure that residents in need would be receiving the resources necessary to remain in the city. I am proud to see the results of our efforts today, as thousands of senior New Yorkers find relief from rising rent costs, and I thank the administration, Council 14 OCTOBER 13, 2016 • Number 41 VOL. 15

Committee on In July, 2014, with support from the de Blasio Administration, the New York State Legislature increased the income ceiling for rent freeze programs from $29,000 to $50,000, to help ensure that vulnerable individuals remain in their homes. Since then, the city has enrolled over 20,000 people.

In an effort to reach the remaining 77,000 potentially eligible individuals and assist with yearly re-enrollment, the Department of Finance, the Mayor’s Community Affairs Unit and the Public Engagement Unit will work in coordination to host “Day of Action” events that involve door knocking and handing out pamphlets in targeted neighborhoods, and will hold subsequent enrollment events. The city has identified the following top five under enrolled and potentially eligible neighborhoods: • Stuyvesant Town/Turtle Bay • Coney Island/Brighton Beach • Kingsbridge/Mosholu Heights • Upper West Side • Upper East Side According to the New York City Department of City Planning, the population of senior citizens in New York City will increase by 40 percent to more than 1.4 million people between now and 2040. The escalating costs of rent and growing income inequality cause many of the poorest New Yorkers to pay a greater share of their income on housing, which means they have less money for other important needs. As a result, it has become more critical than ever to increase enrollment in SCRIE and DRIE programs.

These benefits provide tax credits to landlords that effectively freeze rent for low-income New Yorkers living in rentregulated apartments.

Justice Department Allocates $1.2M to aid NY Survivors of Human Trafficking

By Forum Staff More than $2 million in federal funding has been allocated through Department of Justice (DOJ) to four New York City based organizations to aid in the recovery for survivors of all types of human trafficking by survivor-centered services and interagency communication according to an announcement by U.S. Senators Charles E. Schumer and Kirsten Gillibrand.

“With this critical federal funding, these organizations will be able to continue their important work, prosecuting vile sex- and labor-traffickers and serving the survivors of human trafficking in New York City,” said Senator Schumer.

The Kings County District Attorney's Office has been awarded $600,000 in federal funding. The District Attorney’s office will work with Safe Horizon Incorporated to create a task force to combat all types of human trafficking. This task force will develop strategies to iden-

tify human trafficking survivors; pursue local, state, tribal, and federal sex and labor trafficking cases; and provide a comprehensive variety of services to individual survivors.

Safe Horizon, Incorporated has been awarded $550,000 and will be working with the Kings County District Attorney’s Office to create

a law enforcement agency and a lead survivor service provider within the task force. The task force will support multidisciplinary human trafficking to identify, investigate, prosecute at all levels to address the individual needs of the victims and provide proper services.

Convent House New York/Under 21 has been awarded $588,286.

The organization help homeless and runaway youth survivors of sex and/ or labor trafficking by providing comprehensive and mental health care and related services through local, state, and federal resources. The program will develop interagency partnerships, professional training, and public awareness activities in order to enhance communities’ ability to support survivors of human trafficking.

The Ali Forney Center, Inc. has been awarded $331,736 to will help

the homeless and LGBTQ youth (16-24 years of age) community that fall victim to all types of human trafficking. The center will fund projects to enhance interagency collaboration, community response coordination, and the capacity to respond to survivors.

The Department of Justice’s Specialized Services for Victims of Human Trafficking Competitive Solicitation and Enhanced Collaborative Model to Combat Human Trafficking Competitive Solicitation: Enhancement of Established Human Trafficking Task Forces awards grants to states, units of local government, and nonprofit, nongovernmental organizations with a demonstrated history of providing survivor assistance, social services, legal services, shelter, or mental health services for survivors of human trafficking.

De Blasio Lashes out at Borough Homeless Shelter Protesters

Cusenza Mayor Bill de Blasio this past week continued to contribute to the heated debate over his homeless policies and shelter siting in Queens, blasting opponents of a proposal to convert a Maspeth hotel into a Department of Homeless Services facility as unwilling to sacrifice and help their own City solve a critical social issue.

“If people in Maspeth think they cannot have responsibility for a problem that is their problem, I will happily stare them down,” de Blasio said last Thursday in a questionand-answer session with reporters, according to Time Warner Cable News NY1. “We will put a roof over people’s heads.”

“If Mayor de Blasio truly wanted to help the homeless, he would have worked in cooperation with other electeds, such as asking our Governor for assistance, instead of shutting us out and shaming those who do not agree with his policies,” the senator concluded. “It didn't have to be this way, and this frustrated anger that I have never seen before could have been avoided."

Man Charged with Murdering Mom, Dumping Body in Park Lake

By Michael V. Cusenza A Rego Park man has been charged in the beating death of his mother, whose body was recovered last weekend from the bottom of a lake inside Flushing Meadows Corona Park, according to Queens District Attorney Richard Brown.

Roman Gorbunov, 21, was arraigned on Saturday on a criminal complaint charging him with second-degree murder, fourth-degree criminal possession of a weapon, two counts of tampering with physical evidence, and concealment of a human corpse. He was ordered held without bail and to return to court on Oct. 21.

According to the complaint, on the evening of Sept. 27,

Gorbunov allegedly attacked his mother, Lyubov Gorbunova, 58, after an argument inside their 62nd Drive apartment. He allegedly struck her on the head multiple times with a plate and then a blunt instrument, fatally wounding her. Gorbunov then allegedly stuffed his mother’s body into a plastic bodybag and ordered a car service to take him to Flushing Meadows Corona Park, where he dumped her and the murder weapon into Willow Lake.

‘No Basis’ for Criminal Charges against Cops Involved in Tillman Shooting: DA

Cusenza There is no basis for criminal proceedings against the City police officers involved in the April shooting death of George Tillman in South Ozone Park, according to a thorough 71-page report released last Friday by the Queens District Attorney’s Office, which concludes that the four 106th Precinct cops acted in selfdefense when Tillman pointed his weapon at them.

“Under the circumstances,” DA Richard Brown said, “I believe that any fair and reasonable person would agree that to bring criminal proceedings against the officers would be totally unwarranted. The investigation established that Mr. Tillman was armed with a loaded and operable firearm, that he ignored police commands to drop it and that he pointed it at the police. The involved officers gave consistent accounts that were corroborated in their essential aspects, and in no way contradicted, by video surveillance and civilian witness accounts. Under the circumstances, the police officers were legally entitled to use deadly force to stop Mr. Tillman from firing his weapon at them. I have an ethical duty to institute criminal charges only where there is probable cause to support them. This is not such a case.”

According to Brown, the six-month investigation involved extensive interviews with more than two-dozen witnesses, including the officers involved, police personnel, emergency responders and civilians. The investigation also included the review of video surveillance recordings, police radio runs, 911 call reports, crime scene unit and ballistics reports, the autopsy findings, and DNA analysis.

A man who billed himself to the New York Post as a friend of Tillman’s told the paper that the cops shot Tillman, a father of five, in the back as he attempted to flee.

“He was trying to run away, and he had his back turned,” the friend said. “He didn’t have no gun on him. What he did was run.”

In May, State Attorney General Eric Schneiderman announced that his office, in its capacity as special prosecutor in suspicious police-involved deaths, has declined to conduct an investigation into the Tillman shooting. The chief of the Attorney General’s Special Investigations and Prosecutions Unit said that there wasn’t enough evidence to support a probe.

According to Brown’s report, the investigation revealed: • Two Conditions Unit police officers on plainclothes patrol in an unmarked car observed Tillman at about 1:30 a.m. on

April 17, standing by his SUV with a bottle of vodka in his hand. Video captured just prior to their arrival showed Tillman searching for something in the rear of his SUV and then making a motion toward his waist. The officers identified themselves and informed him that he could not have an open bottle of alcohol and that he could not drive if he had been drinking. Tillman handed the bottle to a friend who was with him. At that point, the officers were planning to leave without arresting Tillman.

• But then one of the officers saw what appeared to be a gun in Tillman’s waistband. When the officer asked to talk to Tillman, Tillman began to run while holding his waist with his right hand. The officers gave chase on foot and ordered him to stop, but he continued to run.

Another unmarked police car with three officers happened upon the scene. The officers shouted to the arriving officers that Tillman had a gun, and the arriving officers joined in the chase, ordering Till-

man to stop and drop the gun. But Tillman continued to run, then turned toward his left and pointed the gun, which was in his right hand, at one of the officers. Four of the five officers fired their weapons. Tillman sustained several gunshot wounds, all of which were consistent with his having turned to his left toward the officer. Only one, a gunshot wound to his left temple, was fatal.

• George Tillman’s DNA was found on the grip, magazine, and slide of the loaded and operable .40-caliber semiautomatic pistol that was found in his right hand when he fell. The evidence shows that only two officers came into contact with the gun – the first officer to arrive at Tillman’s body kicked the gun away with his foot, and a crime scene officer picked the gun up for vouchering while wearing gloves. There was no evidence that any officer touched the gun with bare hands.

• Moreover, although the civilian witnesses did not see the actual shooting, several, including some of Tillman’s family members, stated that Tillman had at some point owned a gun and/or had a gun permit, though the investigation revealed that he was not licensed to own or carry a gun in any state. The gun had been stolen by an unknown person three years before, during a burglary of a home in another state.

The four officers who shot Tillman were visibly distraught in the hours after the incident, according to their commanding officer. Captain James Fey detailed what he observed when he met the officers who were being evaluated at Northwell Long Island Jewish Medical Center.

“They were very upset,” Fey said. “It was clear to me that they had been crying. They were in shock – [they] just took someone’s life.”

JFK Airport Agriculture K-9 Jasper Retires

By Forum Staff United States Customs and Border Protection employees at John F. Kennedy International Airport recently said goodbye to CBP Agriculture K-9 Jasper, an 8-year-old beagle who has officially retired from service after nearly six years at JFK. Customs Agriculture K-9 Specialist Amanda Tripple, Jasper’s handler, adopted him. At the end of his last tour of duty, Tripple turned in Jasper’s collar, badge, and vest, and completed transfer ownership forms.

“We grew accustomed to watching Jasper enthusiastically work to prevent prohibited animal and plant products from entering into the United States,” said Robert Perez, director of CBP New York Field Operations. “We are going to miss seeing him in action.”

“At the end of their shift, Amanda took Jasper around CBP’s area within the airport. Since Jasper officially became a pet, he was led around the workplace without his CBP vest and employees were allowed to pet him,” CBP Deputy Chief (Canine) Gary Walck said. “Jasper loves interacting with people. He enthusiastically enjoyed all of the extra attention that he received on his last work day before heading into retirement. Jasper was a great detector dog and will be missed by all.”

Stringer Unveils ‘NYC Nest Egg’ Retirement Plan for Private-Sector Workers

By Forum Staff City Comptroller Scott Stringer has released a new plan that, he said, takes an innovative, market-driven approach to providing private–sector employees access to a retirement plan at their workplace.

The “New York City Nest Egg” retirement program was developed after 19 months of consultation with the Comptroller’s Retirement Security Study Group, a team that features the nation’s top academics in pension policy.

“The plan we are releasing today offers the best chance to protect hundreds of thousands of New Yorkers who would otherwise face retirement struggling to pay rent, cover medical bills, or put food on the table, especially now that retirement could last 20 or 30 years,” Stringer said. “Today, 58 percent of private sector workers in New York City have no access to a retirement plan at work – and for those at companies with fewer than 10 employees, that number jumps to 89 percent. Unless we act now, what should be the golden years in America’s largest city may well become the darkest years for too many people and a burden for future taxpayers who would be called upon to support a growing population of low-income seniors.”

The Nest Egg proposal, according to Stringer, is designed to mitigate liability concerns for taxpayers and employers. The City would be under no obligation nor would it commit to fund any losses experienced by investors in the normal course of operations. Additionally, for those employers who already provide a retirement plan, the new program requires no action. But for those who don’t, the Nest Egg “provides a comprehensive, flexible approach,” Stringer said, based on three key components: The NYC 401(k) Marketplace: A new, voluntary exchange overseen by an independent board that would offer employers a choice of screened, competing 401(k) and other retirement plans from private and public providers.

The Marketplace would save employers time and money by providing ready access to a “curated” pool of acceptable, easier-touse 401(k) “prototype” plans and IRA options, Stringer noted. By establishing minimum eligibility criteria, offering more than one 401(k) plan, and employing the power of competition, the Marketplace could help provide quality products at a lower price and meet the needs of employees who seek to save more for retirement.

The Empire City 401(k) – One option

available through the Marketplace would be the new Empire City 401(k), Stringer said, the first formal proposal in the nation to take advantage of recent changes in federal law allowing multiple employers who are unaffiliated to join a single, publicly-sponsored 401(k) plan.

This arrangement removes a major obstacle for small employers, the comptroller noted, by allowing them to offer a cost-effective 401(k) plan to their employees without being encumbered by complicated regulatory

requirements under Employee Retirement Income Security Act, the federal law governing private pension plans. An independent governance board would be an ERISA fiduciary for the plan.

NYC Roth IRA – For all private-sector employers who choose not to shop through the exchange or select a plan through other methods, Stringer said, this plan serves as the required default option. Research shows that automatic enrollment in retirement savings accounts vastly improves participation, so employers would be required to automatically enroll eligible employees (although, as with all Nest Egg plans, employees would be free to opt out at any time).

The federal myRA plan would be the automatic investment option for the first $15,000 in savings, with no fees and a guarantee of no loss of principal to those who invest – another first in the nation among proposed city and state plans – which will help lower costs.

According to the Comptroller’s Office, the NYC Nest Egg plan would be overseen by an independent board of experts whose responsibility would be to protect the best interests of participants. The board would periodically select investment management, administrative, and education providers through a transparent competitive bidding process. In addition to the myRA, investment options would be limited to a set of passively managed low-cost index funds.

“Today, too many New Yorkers face a bleak economic future, with Social Security providing only basic protection, because they have little or no real savings to rely on in their retirement years,” Stringer said. “That’s why I’m proposing the NYC Nest Egg Retirement program, an initiative that expands the retirement safety net in our City – without creating any additional liability for taxpayers. We cannot afford to wait another day to tackle this critical challenge – not if we want to keep New York a place where people can look forward to retiring securely after a lifetime of work and sacrifice.”
