Selectmen approved re quests from five restaurants for tem porar y mo di fic ations for outdoor seating – plus outdoor entertainment for four of them. The board granted three of these outdoor requests last week and is scheduled to consider six more when selectmen meet again via Zoom at 7 p.m. next Tuesday (June 16). “We’re trying to accommodate everybody and provide something for the public,” Cogliano said.

During this week ’s session, the board approved requests for Hooters, 110 Grill, Fuddruckers, Hammersmith Restaurant and the 99 Restaurant.

For many of the restaurants, seating is limited to a fraction of the number of customers the restaurants are able to accommodate while observing social distancing. But the sit-down meals along with alcoholic beverages greatly expand upon business that was previously dependent on serving just takeout or delivery meals.

But Selectman Jeffrey Cicolini suggested that the business would be better off expanding its hours of operation by an hour, to 11 p.m. on Fridays and Saturdays.

During a review of each of the restaurant requests, selectmen suggested an expansion of hours and also a provision for background music as a matter of convenience so that the respective businesses wouldn’t have to return for additional requests later.

Each of the restaurants is subject to seven conditions established by the police and fire departments to ensure that adequate protection is provided to the customers.

Each restaurant is subject to a review of the request for temporary modification on July 14.

Cogliano said he expects to see more restaurants seeking the temporary modification for outdoor seating as the summer progresses. “It’s trial mode. They want to see how everybody else is doing,” he said.

The Coronavirus count State reports 19 new confirmed Saugus COVID-19 cases; town has 20th highest COVID-19 rate in the state

T

here were 19 new cases of Saugus residents testing positive for COVID-19 over the past week, bringing the total of confirmed cases to 545 – a 3.7 percent increase, according to new data released late Wednesday afternoon by the state Department of Public Health (DPH).

Meanwhile, the DPH notified the town that its death total from the virus had risen to 31 – an increase of one over the same period. No information was available on the Saugus residents who died from the virus. As of Wednesday, DPH officials reported 7,152 deaths statewide linked to COVID-19. Of those, 979 have been reported in Essex County.

The DPH has been releasing numbers of COVID-19 cases for all 351 municipalities, broken down by city and town, every Wednesday. The agen-

cy on its website will post the number of cases of people testing positive for the Coronavirus, and the number of cases per 100,000.

The 545 cases reported for Saugus averages out to a rate of 1,917.30 per 100,000 – which is above the state average of 1,437.65 per 100,000 and is the 20th highest rate among all communities across the state, according to the data released Wednesday.

But officials believe the numbers are substantially underreported in most communities because of the lack of aggressive testing for the virus. “The Saugus Health Department strongly believes that additional unrecognized cases DO exist in Saugus,” the town advised in a press release.

“Due to the fact that they are undetected, some of these infected individuals may not be properly isolated or quarantined, which is why Gov.

Baker has a safer at home advisory and continues to strongly request that everyone wear a cloth face cover over their face when around others, practice social distancing, avoid gatherings, and to follow the CDC and MDPH guidance.”

Of the 2,882 people tested in Saugus so far, 18.91 percent tested positive for COVID-19.

The state average for people testing positive is 15 percent.

As of Wednesday, there were 15,365 confirmed cases of COVID-19 reported in Essex County, the third highest among the state’s 14 counties.

There were 104,156 confirmed cases of the Coronavirus statewide and 7,454 virus-related deaths. There were 1,024 COVID-19-related deaths in Essex County.

The Nursing Facility Audit Survey Results through May 29 show that both local nursing homes were “not in adherence” due to deficiencies in core competency. They were each designated to receive “targeted infection control training” and were also subjected to being audited

by May 29. The latest state reports showed that 100 percent of the residents and 93 percent of the staff at both facilities had been tested for COVID-19.

There were 17 deaths reported at the Chestnut Woods Rehabilitation and Health Care Center, which is licensed for 88 total beds. There have been more than 30 cases

Selectmen may vote on a one-month budget Tuesday night

own Manager Scott C. Crabtree is expected to ask selectmen at their meeting next Tuesday night (June 16) for a one-month budget so there

are no disruptions of critical town services when the 2021 fiscal year begins on July 1. The agenda for Tuesday’s meeting includes the entry “Request for the selectmen to review and approve a 1/12th budget for FY21.”

The S-2 permit won’t become effective until Daaboul takes ownership of the property at 74 Hamilton St. Officials expect that should happen within 90 days.

The hours of operation are 8 a.m. to 6 p.m., Monday through Friday, and 10 a.m. to 6 p.m. on Saturday. The shop must remain closed on Sundays. Daaboul will be limited to 10 vehicles on the property at any one time – seven vehicles for repairs and three for sales. No off-street parking will be allowed. No junked cars can be stored on the property and no vehicles can be stored outside the property. No streamers or balloons will be allowed.

“He’s certainly going to be under the watchful eyes of selectmen,” said Board of Selectmen Chair Anthony Cogliano.

“We’re going to have teeth to hold him to the fire this time. You’re in very good hands,” Cogliano told Precinct 3 Town Meeting Member Rick Smith.

Smith, who has aggressively advocated on behalf of the neighbors, said that at minimum the neighbors deserve a business that “looks beautiful and professional…a clean, tidy place.”

“We’re not asking for much,” Smith said.

House approves Restaurant Relief Act to assist businesses Law Offices of during COVID-19 pandemic

T

he Massachusetts House of Representatives has given initial approval to a bill – known as the Restaurant Relief Act – that would allow restaurants to begin offering mixed drinks with food takeout orders, and to provide expanded outdoor table service with alcohol, subject to local approval. State Representative Donald Wong (R-Saugus) said House Bill 4767, An Act addressing challenges faced by food and beverage establishments resulting from the COVID-19 pandemic, would also allow restaurants to delay the filing of meals tax payments collected this year, while capping the fees charged by third-party delivery service companies for online food orders.

The bill, which passed the House on a vote of 156-0 on June 3, still requires Senate approval. On June 4, the Senate referred the bill to its committee on Ways & Means.

The Restaurant Relief Act builds on the guidelines recently issued by Governor Charlie Baker for the state’s Phase II reopening, which began this week. Phase II allows restaurants to begin offering outdoor dining to customers, but continues to prohibit in-

door table service. The Restaurant Relief Act authorizes local licensing authorities to temporarily approve requests for outdoor table service at restaurants, with alcohol sales, through November 30.

Wong said this change will allow cities and towns to bypass the current licensing review process conducted by the Alcoholic Beverages Control Commission (ABCC), which typically takes seven to 10 weeks to complete. Communities would still need to notify the ABCC once an amended license is approved. Under the bill, licensed establishments can continue to sell beer and wine for off-premises consumption for the duration of the Governor’s State of Emergency, or until Feb. 28, 2021, whichever is later.

In addition, restaurants currently licensed to sell alcohol for on-premises consumption will now be able to offer cocktails for off-premises consumption during the same time period, under certain restrictions.

Mixed drinks must be sold as part of a food order in a sealed container – packaged so it is clear whether the lip, cap or seal has been removed or bro-

ken – and will be limited to no more than 64 fluid ounces per transaction.

Wong said the Restaurant Relief Act addresses concerns raised by restaurants about the excessive fees charged by some third-party delivery companies during the pandemic. He noted that the bill caps delivery fees at 15 percent and other non-delivery fees at five percent of the online order purchase price during the State of Emergency, a restriction that will remain in effect until 45 days after the State of Emergency is lifted.

Restaurants will see additional financial relief from a temporary change in the state’s procedure for collecting meals tax payments. Businesses will have the option of delaying their meals tax payments for the remainder of the year, without being assessed any late-file or late-payment penalties or interest. Businesses that choose this option will have until September 20 to submit meals taxes collected from June 1–August 31, and will not have to submit meals taxes for September 1–December 31 until January 20, 2021.

Investing in education and opportunity for all students

sk yourself if this makes sense: Every year, teachers spend an average of $600 out of their own pockets to buy school supplies.

Districts across the state are considering laying off teachers. Even before this crisis, many schools didn’t have enough money to make sure every kid had access to a school counselor; to art and music; to sports.

Thousands of students across Massachusetts sit on waiting lists to attend vocational and technical schools, which provide a direct pipeline to good-paying jobs.

ties are the only ones with access to the best-funded public schools. Education, which is supposed to be the great equalizer, is driving us further apart.

Massachusetts spent $3.2 billion last year on prisons and law enforcement - before counting what gets spent by cities and towns. How much less expensive would the criminal justice system be if we put more resources into education and job training?

We need to change this, and it’s clear that just electing any Democrat is not good enough. We need to think beyond the party label. What matters is a legislator’s priorities, what they believe in, and how willing they are to put in the hard work of advocacy.

So here’s what I believe in: education and opportunity.

I believe every student who wants to attend a vocational and technical school should be able to do so. I believe every student who wants to attend community college should be able to go debtfree, and that the $6,000 per year investment we make in that student’s future is much better than spending $55,000 per year to lock someone up.

I believe education should be well-rounded and guided by the principle of caring for and developing the whole person - not just teaching the skills you need to pass a test.

All students should have time for recess and play; access to art, music, and sports; to counseling; and to civics education that prepares them to be 21st century citizens.

I believe that all of our school buildings should be

safe, healthy, and modern, in all of our towns, not just the wealthy suburbs.

I believe the best way to improve educational outcomes is to reduce concentrations of poverty - so we should tackle issues like homelessness, hunger, and lack of access to mental health care.

I believe we can afford to make these investments if we shift our priorities. If we reverse some of the $4 billion in state tax cuts that have largely gone to very few at the top, so we can invest in a better future for all of us. If we extend people not a handout, but a hand up - an opportunity to thrive. If we put less focus on locking people up, and more on lifting our communities up.

I can’t promise that as one voice on Beacon Hill, we can

make all of these changes quickly, or that the work won’t be hard. But I can say the status quo is not good enough. We need strong leadership representing our communities that speaks out on these important issues, and pushes for needed change.

The pandemic has exposed cracks in our foundation that have been there all along.

The good news? Now that the cracks are out in the open, it should be easier to muster the political will to fix them.

Let’s get to work.

Saugus gardens in the pandemic Here’s what’s blooming in town this week to make your walks more enjoyable

ven those who don’t pay much attention to flowers must be aware of all the blossoming activity going on around them this week! Cars are covered with yellow pollen. Great heaps of brown oak catkins cover the ground underneath the trees that have shed them, and birds run around flipping them over in hopes of finding food underneath. Some of the baby birds are larger than their parents, but the adults still bring over a seed and place it in their beaks.

Hummingbirds hover over tubular blossoms and bees can be heard buzzing everywhere.

Although you may have been walking the same streets in the same neighborhood for months, it looks a lot different than it did just four weeks ago.

The air on many sidewalks is lightly perfumed by the fragrance of tall bearded irises.

This flower was named after the Greek goddess of the rainbow because they bloom in such an amazing array of colors, although the most commonly seen are blue-lilac, yellow or white. The inner three petals are upright and are known as “standards,” while the outer three petals droop and are often called “falls.” Bearded irises can be distinguished from the many other kinds of iris by their “beards,” or fuzzy looking structures, resembling a caterpillar on the highest points of the falls. Falls and standards may be the same color, or standards may be a different color from the falls.

The leaves are flat, pointed on top and pale green. They give an interesting structure in the garden even when the flowers are not in bloom. Near the surface of the ground, you may

see the starchy rhizome where food is stored. This helps the iris survive droughts and difficult conditions, so it is often seen right near the sidewalk where the soil may be sandy and get salt from the road in winter.

How many different flower colors can you find on the irises in your neighborhood?

You may also see Siberian irises in bloom now – they usually have a yellow stripe in place of the beard, and their leaves are much narrower and grasslike. They don’t have rhizomes at the soil surface but have a fibrous root system, like most perennials. Siberian irises are likely to be dark purple, bluelilac, white or occasionally yellow. The flower emblem of the Saugus Garden Club is the bearded iris.

While there is plenty to look at blooming near ground lev-

el, you might see some spectacular flowers by looking up into the tall tree branches.

There was a horse chestnut in my neighborhood when I was growing up. It had tall clusters of white flowers in June. We played with the roundish nuts, which are called conkers, in the fall. That tree is long gone, and there aren’t many horse chestnuts in town any more. However, there are at least two unusual double horse chestnuts on Westford Street. The one on the corner of Westford Street and Westland Avenue has some low branches which bring the flowers to eye level, making the flower details easy to see. Horse chestnuts are unusual in that the compound leaves are palmate, or arranged like the fingers on your hand.

seen the last of the magnolia blossoms for this year when April ended. The most popular magnolia trees are Asian varieties, like saucer and star magnolia, that typically bloom in early spring before the leaves come out. Also popular recently are yellow flowering varieties which are hybrids between cucumber magnolia and Yulan magnolia. It is a delightful sight to see these big blossoms so early in the spring, but a drawback is that freezing temperatures often return when the flowers have started to open, and they brown up before opening fully. One of the readers of this column recently asked me to write about magnolias, but I thought the moment for that had passed.

Then this week I stopped near the Roby School and saw a single flower and a few new buds on the two magnolias on the Main Street lawn of the building, and I was reminded that they will often produce a few flowers later in the spring or summer, now somewhat hidden by the foliage.

While the Asian hybrids are the most frequently planted, there are some native magnolia species you might encounter: cucumber tree, sweet bay and bull bay magnolias. Cucumber tree is a very tall species, often over 60 feet, with small flowers that grows in the southeastern mountains, with some isolated wild stands in Ontario. It gets its name from the shape of the fruit produced after flowering – it starts out looking like a small, bumpy pickling cucumber, eventually becoming pinkish and releasing bright red-orange seeds.

The wild sweet bay magnolia growing in Ravenswood Park gave the village of Magnolia in Gloucester its name.

This hardy native species prefers damp locations and its flowers are less conspicuous, but the fragrance more than makes up for it. You may also have heard of a species native to the southern United States, the bull bay magnolia or southern magnolia. It is at the edge of its hardiness zone in the Boston area and rarely planted here. There are a few at the Arnold Arboretum in Jamaica Plain, and a huge one once grew at the Polly Hill Arboretum on Martha’s Vineyard, but they are seldom planted north of Boston. Unlike the cucumber tree, the bull bay is fully evergreen and the sweet bay keeps some of its leaves throughout the winter.

YNN – The North Shore Navigators continue to finalize their roster for the upcoming Futures Collegiate Baseball League season and have announced the signing of two more native Massachusetts pitchers. Coming to Lynn’s Fraser Field during the summer of 2020 will be Saugus native returnee and former Northeastern Conference MVP Todd Tringale (Northern Essex Community College) and Robert Nadel (La Salle University); President and General Manager Derek January made the announcement on Monday.

The 6-foot-2, 185-pound Tringale joined the Navs for five appearances after finishing his standout career at Saugus High School, posting a 2.38 ERA and 10 strikeouts over his 11.1 innings. After contributing to North Shore’s 30-win regular season, he shut out Bristol over four, two-hit frames in a playoff start. Tringale was a captain,

Boston Herald All-Scholastic and two-time Northeastern Conference All-Star during his time as a Saugus Sachem. He earned league MVP honors as a senior, going 8-2 with a 0.63 ERA and 119 strikeouts in 70.1 innings.

A Senior Roll

Saugus High Class of 2020 turns its cancelled graduation night into a parade of memories for students and faculty

n normal times, some 160 Saugus High School seniors would have graduated last Friday night – joined by family and friends – with a happy outdoor celebration at Stackpole Field. But health concerns about the COVID-19 pandemic forced the postponement of the 149th Commencement Exercises weeks ago.

Although the graduation ceremonies have been rescheduled for Saturday, July 25 at 10 a.m., Saugus Public School officials didn’t want the original date to pass without some pomp and circumstance. So, with an escort from Saugus police and firefighters, a motorcade of Saugus seniors chauffeured by their parents or guardians rode from a staging area at the Blessed Sacrament Church through Saugus Center to the Belmonte Middle School in a short parade that was referred to as “A Senior Roll.” Many teachers – from Kindergarten all the way up to High School – lined the sidewalk along Dow Street leading up to and past Belmonte Middle School. They waved or flashed handmade signs with congratulatory messages to the students.

“The whole town came together and pulled it off for our kids,” Saugus High School Principal Michael Hashem said, as he walked behind the parade, making sure there were no problems.

“There was a good turnout tonight. This was a nice event for the High School – students and staff. It provided a little bit of normalcy for a strange school year. Most of the senior class participated. And they showed great community spirit,” he said.

Roy Medeiros, a special education teacher and first year girls’ lacrosse team coach, said that as a newcomer he was impressed by the event. He had four students graduate this year and two girls from the lacrosse team. He came to see them.

“I thought it was awesome,” Medeiros said.

“It was a great thing to do for them. After they lost half of their senior year, it was the least we could do for them,” he said.

ed. And they’ve done a great job so far…If at the end of my teaching career, I were to write a book, this would be a pretty hefty section,” he said.

From what Lavoie observed, the Saugus High Class of 2020 faced great adversity and showed determination and grit in doing what they needed to do. The teacher union

president said he was thrilled that more than 50 percent of the Saugus Public Schools staff showed up near the Belmonte Middle School to wish the graduates well.

“It was more emotional than I thought it would be,” Lavoie said. “Yes. You can say I got misty-eyed watching this.”

ere are a few tidbits that you might want to know about this week in Saugus.

Shout-Outs for two For this week’s paper, we received some interesting “ShoutOuts” from a pair of readers.

Frequent contributor Jeanie Bartolo offered these words of praise for a musician she regrets she didn’t get to thank personally: “The whole of Jackson Street got an unexpected treat Friday afternoon when a gentleman patron of George’s Barber Shop (America’s oldest!) played his Bagpipes outside the shop for all of us to enjoy. You certainly don’t see that every day!! I am sorry to say I did not get the gentleman’s name but this “Shout Out” is for him, thank you Sir!!!”

We also received this recommendation from Natasha Shah, who wanted to express her public appreciation for a doctor who has meant so much for Saugus residents and people who live in other North Shore communities: “I would like to recognize Dr Christine Valdes, who has been providing exceptional health care in Saugus since 2008 and now in the time of the Covid 19 pandemic, is also working with the management teams at North Shore Medical Center to provide new types of care for the North shore (for instance, home visits) as well as heading up a new team working on health care equity.

“She may require an entire story, to fully explore the amazing contributions she is making in the lives of so many patients.”

The local relevance of George Floyd’s death As every newspaper reader or person who gets his or her news from radio or television knows by now, the May 25 killing of George Floyd by Minneapolis police is having a profound impact across this nation and around the world. Floyd’s death has reignited dormant or stifled conversations about racial injustice and police brutality in virtually every American community – including Saugus.

Over the past week, I have received two emails from readers who have suggested that public conversation needs to be had by residents in this town. “I hope that The Advocate will encourage a community dialogue on the subject of systemic racism,” one reader wrote me in an email over the weekend.

“I hope that this subject will be revisited and embraced by the community,” the same reader wrote in an email to a member of the Board of Selectmen.

There’s no question that the subjects of racial discrimination, racial injustice, police brutality, racial profiling and related subjects – matters that many people feel uncomfortable discussing – are worthy of public discourse in Saugus, just as much as they are in Minneapolis. For these kinds of topics have no geographic boundaries. Candid conversations about these matters can only make a community stronger. Ignoring potential problems or perceptions of prejudice can only erode the moral conscience of a community along with its quality of life.

As a local newspaper, we embrace serious discourse of all kinds that leads to the betterment of the community. In today’s issue, we have decided to use “The Advocate Asks” as a vehicle to encourage a community dialogue on the issue of racial injustice and related matters. And we welcome feedback from our readers in future editions.

So, why is what happened to George Floyd in Minneapolis relevant to residents in Saugus?

That’s a worthwhile question for town residents and community leaders to broach. The conversation has already begun.

about police brutality – especially if you have covered law enforcement in places like West Texas or Central Florida.

As a young newspaperman working as a stringer for UPI back in 1978, I spent considerable time investigating and writing stories about a Mexican American who died after getting pummeled by Ector County Sheriff’s Deputies – eight of them – in a jail cell in Odessa, Texas. That was back in 1978, when I collaborated with two out-of-town reporters from Dallas and San Angelo on stories that eventually led to a federal grand jury investigation in Midland, Texas.

Nobody was indicted after grand jurors heard the testimony of about 70 witnesses. But the federal probe determined that then-prisoner Larry Lozano, who had a history of mental illness, didn’t commit suicide by beating his head against a jail cell window of his cell, as the sheriff initially claimed. It was rather from a beatdown inflicted by sheriff’s deputies.

Believe it or not, if you were to google “Mark Vogler and Larry Lozano,” a March 17, 1978, story I co-wrote for The Texas Observer titled “Inquest in Odessa” would pop up on the screen.

Larry Lozano was one of about a dozen Mexican Americans who died while in the custody of Texas lawmen in cases that most of us would find appalling today. That was 42 years ago.

That was long before they had video and cell phones that could have documented police brutality.

When I first learned of George Floyd’s death, it rekindled some bad memories about what happened to Larry Lozano. And I remain convinced that he was unnecessarily beaten to a pulp while in police custody.

I’m confident that this type of incident is not prevalent in most communities across the country. Most cops are hardworking and honest. But it only takes a few bad apples to tarnish the reputation of law enforcement officers.

Kowloon Restaurant feeds frontline workers The Kowloon Restaurant, which is owned and operated by the Wong family, has their team of chefs and sous-chefs cooking-up hundreds of takeaway meals for the frontline workers at the Radiation Oncology Department of Lahey Clinic in Burlington and Peabody, General Internal Medicine at Lahey Clinic in Peabody, and Massachusetts General Hospital in Chelsea. The Kowloon Food Truck is in the midst of delivering loads of Saugus Wings, Pu Pu Platters and other gourmet food now.

The Wong family is showing their appreciation for the hardworking medical staff at these respected hospitals during the Covid-19 pandemic.

Food Pantry still open The Saugus United Parish Food Pantry will continue to remain open on Fridays between 9:30 a.m. and 11:00 a.m. despite concerns over the Coronavirus. But they have made adjustments to protect their core of volunteers and the needy people who receive the food.

“For the protection of our volunteers and clients, and to limit personal contact and crowding/gathering, the food pantry has been distributing pre-bagged groceries,” said Wendy Reed, Clerk of the Saugus Board of Selectmen, who also oversees the operation of the all-volunteer food pantry.

ongress last week passed a bill extending the Paycheck Protection Program (PPP) time period within which to incur necessary payroll expenses from eight weeks to 24 weeks from the date of the PPP loan funding date. Furthermore, the requirement for forgiveness of the loan by paying out 75% of the loan proceeds for salaries has been lowered to 60%. This leaves room for small businesses to use 40% of the loan proceeds for such expenses as rent, mortgage interest, utilities and other business expenses. The President signed the bill on June 5, 2020. The Bill is actually called the Paycheck Protection Flexibility Act. The deadline for applying for a PPP loan remains at June 30, 2020. There are still monies available in the program. The flexibility in the PPP is designed to make it easier for small businesses to achieve complete forgiveness of the loan. The Small Business Administration will be updating the forgiveness application, and a pdf file will be available on its website. DeRuosi asserted his belief as an educator that “there is no room for social injustice in our classrooms, our district and our community.”

“We must reflect on our failings,” he said.

The superintendent said it is clear to him that there is a need to create an environ-

ment where students of color feel comfortable.

“This is not an easy subject to deal with,” DeRuosi said.

“But now is the time to address it and begin the process of listening and moving forward.”

In an interview with The Saugus Advocate this week, Panetta cited three reasons for her votes against the permit and the auto dealer’s license: neighborhood issues and concerns, the lack of public need (There are already four used car dealerships on Hamilton Street) and past issues with the site. “Even though we had the site review, the neighbors reached out to

me after the meeting with significant concerns about the site,” Panetta said. “Over the years being a Selectman, I’ve received more phone calls and e-mails on this site than any other site in Saugus.

“Hamilton Street is about one mile long. With four car dealerships already located on Hamilton Street, there is no public need for a fifth dealership,” she said.
