Borough Restaurant Owners Sue City and State over Indoor Dining Ban

By Michael V. Cusenza Owners of a Little Neck restaurant recently filed a class action lawsuit against the City and the State on behalf of restaurateurs across the five boroughs, seeking an annulment to the indoor dining ban, and more than $2 billion in damages.

Tina and Joe Oppedisano, proprietors of Il Bacco on Northern Boulevard, held a press conference Thursday featuring support from several area elected officials and community leaders, including City Councilmen Eric Ulrich (R-Ozone Park) and Bob Holden (DMiddle Village).

Howard Beach civic leader and Queens borough president candidate Joann Ariola easily delivered the most full-throated defense of the Oppedisanos and all beleaguered borough restaurant owners begging to open their doors to sit-down clientele.

“Queens is the most diverse county in the world. Many restaurant owners and their employees are minorities and immigrants who came here in search of the American Dream but instead, found de Blasio’s Nightmare,” Ariola said. “Bill de Blasio’s cruel indifference to industrious business owners and to the hardworking minorities and immigrants they employ must never be forgotten. de Blasio care about them? If you think it’s bad now, just wait. Wait until more of our businesses are forced to permanently close, laying off all their hardworking employees. Where will they live when they can’t pay their rent? Where will their children go?”

Ariola, fresh off an impressive fundraising

period that saw her accrue $73,336, while her opponent, City Councilman Donovan Richards (D-Laurelton), raised a paltry $6,855 in the same time, ripped Mayor Bill de Blasio and his administration Thursday.

“We are here because we believe that Queens is the most wonderful place in the world—and

worth fighting for. I want all our grandchildren to stay here in Queens and I want them to be able to eat in great restaurants like Il Bacco,” she added.

“We’re standing 500 feet away from the Nassau County border, where some indoor dining is allowed, along with every other part of New York.

Queens patrons can drive a few minutes into Nassau and dine indoors, which makes no sense and is quickly killing Queens restaurants.”

City Council Speaker Corey Johnson agrees.

“It’s time to allow indoor dining in New York City with reduced capacity and clear guidance to ensure social distancing and safety,” he said.

“This is crucial for restaurant owners, who have been particularly hard hit by the pandemic and the resulting drop in tourism. Summer is winding down, and they need to begin planning for the colder months. Of course, we will continue to monitor the City’s COVID-19 rates, just as we must for all of our businesses. We know that the restaurant industry employs many New Yorkers, including many immigrants. Its health and wellbeing are imperative to our city. The rest of the state has been allowed to reopen their restaurants for indoor dining, and New Jersey is allowing indoor dining come Friday. Now is the time to allow it in New York City. Our restaurants and our city’s economy can’t wait.”

New York Casinos Reopen with Limited Capacity

By Michael V. Cusenza Casinos and video lottery terminals—including Resorts World NYC in South Ozone Park—reopened Wednesday with a 25 percent occupancy limit.

According to Gov. Andrew Cuomo, all venues that choose to reopen will be subject to strict safety protocols, including enforcement of face coverings except when eating or drinking, social distancing, additional staff to control occupancy, traffic flow and seating to avoid crowding, and enhanced cleaning and disinfection protocols. Casinos must also have enhanced air filtration, ventilation and purification standards in place in order to open.

Additionally, casinos must leave six feet of distance between operating machines. No table games will be allowed unless and until casinos put in place physical barriers between players and the Gaming Commission approves those barriers. No beverage or food service will be allowed on the gaming floor.

The State Gaming Commission will be deployed to monitor casinos and ensure strict enforcement of these measures, Cuomo noted.

the curve in a way that no expert thought was possible,” Cuomo said. “We’ve made the determination that we can safely reopen casinos with enhanced air filtration and strict safety protocols including mandatory masks and social distancing. Area elected officials recently toured the Resorts World NYC facility to review the new health and safety measures the casino put in place. During the tour, casino officials detailed RWNYC’s 21-point safety plan. All Resorts World team members will receive training on COVID-19 safety and sanitation protocols. They will all have to wear masks and will

go through thermal screenings to ensure no one has a temperature of 100.4 or higher. Staffers will also be required to fill out a daily health screening each day prior to entering the property.

Throughout the facility, Resorts World has upgraded all air HVAC filters to MERV 15, the hospital inpatient care standard, to ensure that all airborne con-

taminants are contained and filtered out of the building. There will be “healthy messaging” in the form of digital traffic signage in all parts of the building, reminding guests to wear a mask, wash their hands and maintain social distancing.

When guests enter, they will be required to pass through a thermal screening. Any guest that posts a temperature above 100.4 degrees will be asked to step aside for a cool down period and will have their temperature taken again the confirm the results. If the individual still posts a high temperature, they will be asked to leave. Density counters have been installed to monitor how many people enter and exit the casino, so that Resorts World can adhere to required capacity guidelines.

“I appreciate all of the changes Resorts World has made to their facility to protect their staff and guests in preparation of their reopening,” State Sen. Joe Addabbo, Jr. (D-Howard Beach), chairman of the Senate Committee on Racing, Gaming and Wagering, said.

“This is a big day for the casino, and I fully believe they will be able to face all the challenges ahead and keep their staff and customers safe as they begin to reopen.”

By Michael V. Cusenza Several elected officials praised Gov. Andrew Cuomo for issuing Friday an executive order barring any tax and water lien sales by local governments.

According to the City, a lien sale is administered by the Department of Finance, which sells overdue property taxes, water and sewer charges, and other property charges to a non-profit trust. The agency sends out four warning notices to property owners starting three months prior to the sale, alerting them that the property is at risk of being on the lien sale list. More than 80 percent of owners pay the full amount owed, enter into payment plans, or obtain an exemption that removes them from the at-risk pool. DOF also advertises at risk properties and conducts extensive outreach to property owners at risk of having their liens sold, often partnering with community groups and elected officials to reach as many property owners as possible.

The sale was originally scheduled to occur in May 2020, but it was previously postponed until Friday, Sept. 4, as the City focused its efforts on the COVID-19 outbreak.

“Due to the COVID-19 pandemic, thousands of New Yorkers have been pushed into financial disarray and uncertainty due to job and income losses, leaving many unsure of how they will continue to provide for their families or meet their overall housing expenses,” said Assemblywoman Stacey Pheffer Amato (D-Howard Beach). “Having a lien sold on their property and/or home during a global pandemic is reckless and would only further the economic strain of thousands of families throughout our city including seniors and those most susceptible to the COVID-19 virus.”

Additionally on Friday, Mayor Bill de Blasio and Department of Finance Commissioner Jacques Jiha announced today the postponement of the annual tax lien sale until Sept. 25 to give New Yorkers additional time to pay debt or enter into payment plans.

“It was simply inhumane and unjust to proceed with the 2020 New York City tax lien sale today,” Acting Queens Borough President Sharon Lee said on Friday.

“Thanks to intervention by Attorney General James as well as Governor Cuomo’s Executive Order today, thousands of families and homeowners—many of whom are here in Queens—are granted precious reprieve and will be able to breathe a little easier during this ongoing state of emergency. Without it, the City’s untimely lien sale would have displaced families, destabilized communities and disrupted generational wealth build.”

In a recent letter to de Blasio, Lee noted her support State Senate Bill S8921, introduced by Sen. Leroy Comrie (D-St. Albans) and supported by City Council Resolution 1387-2020 introduced by Councilwoman Adrienne Adams (D-Jamaica), which would postpone the lien sale until one year after the currently active COVID-19 state of emergency is lifted.

De Blasio also pointed out that property owners who are facing hardships making their property tax payments can take advantage of several existing DOF programs. These include exemption programs to lower the amount of taxes owed, standard payment plans, or a new Property Tax and Interest Deferral program, for those who qualify. DOF also provides a monthly property tax billing service to facilitate budgeting for property owners billed on a quarterly or semi-annual basis.

Queens restaurants must open with indoor dining At a time when so many of our beloved neighborhood restaurants are on the verge of losing their place in communities throughout Queens, Borough President candidate Joann Ariola, last week addressed a crowded assembly, taki ng a strong stance on the vital reopening of restaurants for indoor dining. Below are her remarks.

“My name is Joann Ariola and I’m running for Queens Borough President. I’m not a government bureaucrat. I’m a civic leader, a healthcare professional, a wife, a mother and grandmother.

I’m proud to stand here with you in support of the world-class restaurants we have here in Queens, before they are gone forever.

Our amazing restaurants, like the great Il Bacco and so many others, whose owners invest their life savings and work their fingers to the bone, have long been the envy of the world.

It was already too hard to run a business in NYC BEFORE the pandemic. Now, thanks to Bill de Blasio, it’s impossible.

So, I’m running for office for the same reason that all of you are standing here with me today: Because our city and our bor-

ough are in grave danger in every possible way, thanks to the worst leadership in history.

If Bill de Blasio cared as much about your rights as he does about the rights of violent criminals, you would all be fully open for business right now.

‘Trump is Trying to Kill NYC’: Cuomo

“It is personal. I think it’s psychological. He is trying to kill New York City,” Gov. Cuomo said of President Trump.

By Michael V. Cusenza Governor Andrew Cuomo on Tuesday lit into fellow borough native Donald Trump during a press availability in which he didn’t mince words, even positing that the president is “trying to kill New York City.”

“There was a headline in the Daily News once: ‘Ford to City: Drop Dead,’ and the City was outraged [President Gerald] Ford wouldn’t provide financial resources.

What Ford did pales in comparison to what Trump is doing; not only did he tell New York City to ‘drop dead,’ Trump is actively trying to kill New York City,” Cuomo said.

“It is personal. I think it’s psychological. He is trying to kill New York City. He passed [the state and local tax deduction], which was targeted just at New York City tax reform; it cost us $14 billion. He’s refused to fund the extension of the Second Avenue Subway from 96th to 125th Street. Every prior administration has funded the Second Avenue Subway. It has always been a federal-state partnership. Only this president, a former New Yorker, refuses to fund the Second Avenue Subway—even after we opened it up to 96th Street and did an amazing turn-around on the construction project that everybody celebrated.”

Cuomo went on to say that post-COVID problems are piling up, especially in NYC—and Trump is among said issues, not part of any solution.

“I can’t tell you how many phone calls I get from people, especially in New York City, who are literally worried about the degradation of New York City—and much

of it stems from the economic problems.

And Washington is doing absolutely nothing. They’re going back and forth with gridlock. This was the last piece of legislation that they were supposed to pass to handle the aftermath of COVID and they haven't done it. The Republican Senate doesn’t want to fund state and local governments and that’s the sticking point. Not to fund state and local governments, but to provide all the money that they did to businesses—but you’re not going to provide funding to state local governments, who basically support police, fire, hospitals and schools is just totally ludicrous to me. And it starts with the president,” the governor said. “Donald Trump caused the COVID outbreak in New York. That is a fact. It’s a fact that he admitted and the CDC admitted and Fauci admitted. ‘The China Virus, the China Virus, the China Virus.’ It was not the China Virus; it was the European Virus that came to New York. They missed it. They missed it. The China Virus went to Europe. It got on a plane and went to Europe. They never even thought of the possibility and then 3 million Europeans got on a plane and came to New York and they brought the virus. January: they brought the virus. February: they brought the virus. March: they brought the virus. And in mid-March, the federal government does a travel ban from Europe. Mid-March. Too little too late, Mr. President. He caused the COVID outbreak in New York. Donald Trump and his incompetent CDC and his incompetent NIH and his incompetent Department of Homeland Security.”

Pastor Stephen Roser Howard Beach Assembly of God For nearly fifty years Christians have been singing the gospel chorus “He Is Lord” without realizing the full impact of the words.

In one sense, to say that He is Lord is only partially true. Surely He is Lord to His followers. They have confessed Him as such and have accepted the life of obedience into which their confession has initiated them. But not yet do they see everyone confessing that Jesus Christ is Lord as the Bible predicts will happen after His Second Coming (Philippians 2:11).

Following Christ’s crucifixion, God highly exalted Him by conferring upon Him the highest of honors, the title “Lord.” The history of earth will consummate with a vindication of Christ’s sufferings upon the cross as “every tongue will confess that Jesus Christ is Lord to the glory of

the Father” (also Philippians 2:11).

He then will be worshipped by all intelligent beings in the universe: people, angels, and demons. There will be no more rivals to his throne.

When Christians sing “He is Lord,” they are not only acknowledging that He reigns in their hearts, they are expressing their expectation that Christ will ultimately vanquish all the forces of evil in the world.

In the meanwhile, they live between a spiritual D Day and VE Day. When the Allied forces secured the beaches of Normandy on June 6, 1944, they fought for 11 months with certainty of victory. May 8, 1945, VE Day witnessed the unconditional surrender of the Nazi forces. Spiritual D Day occurred when Christ rose in triumph over death, hell and the grave.

VE Day, His coming again to rule this world, is sure because He Is Lord!

By Michael V. Cusenza The TWA Hotel and Fort Totten Building 207 are among the winners of the prestigious 2020 Lucy G. Moses Preservation Awards, The New York Landmarks Conservancy recently announced.

The awards are the conservancy’s highest honors for excellence in preservation.

According to the NYLC, the honors recognize individuals, organizations, and building owners for their extraordinary contributions to the city.

According to NYLC officials, the TWA Hotel opened in May 2019 with an extraordinary attention to detail, design, and

respect for the landmark. Eero Saarinen’s TWA Flight Center is one of the world’s most significant examples of mid-century modern architecture. Since opening in 1962, the building’s sweeping, expressive form has served as a metaphor for flight.

The Moses award marks restoration of the original building, which had been vacant for almost two decades, and reuse of the landmark, with three new structures, as MCR/Morse Development’s TWA Hotel at 1 Idlewild Dr. Building 207 is located within the 136 acres of Fort Totten in Bayside. The restoration and reuse of the stately ColonialRevival style building is the happy end of

a long journey, NYLC officials noted. The building was in terrible condition, with a damaged brick facade, unstable doubledecked porch, decrepit interiors, antiquated systems, and a colony of raccoons in residence.

Building 207 was constructed as a residence by the Office of the Quartermaster General in 1905 and remained active until 1969. Then it was left vacant for decades.

In the 1970s, Fort Totten became a City park, and in 2002, the Center for the Women of New York started negotiations with the NYC Parks Department to adapt it as the organization’s new headquarters. The public-private partnership required review

from multiple City and State agencies. That process, along with a private fundraising campaign, delayed the start of construction for many years.

“This year’s Lucys will be an especially joyous celebration of great preservation work and great preservation leaders,” said Peg Breen, president of The New York Landmarks Conservancy. “It is heartening to see how the awards have grown over the past 30 years and how much preservation has been embedded into the fabric of the city.”

Both Queens projects will be recognized at the Virtual Ceremony on Sept. 23 at 6 p.m., with a Zoom link available at nylandmarks.org.

NY Attorney General Renews Suspension of State Debt Collection

By Forum Staff The State on Saturday again renewed, for the sixth time, an order to halt the collection of medical and student debt owed to NY that has been specifically referred to the Office of the Attorney General for collection for an additional 30-day period, State Attorney General Letitia James announced Friday.

In response to continuing financial impairments resulting from the spread of COVID-19, the OAG will renew orders again through Sunday, Oct. 4. After this period, the OAG will reassess the needs of state residents for another possible extension. Additionally, the OAG will accept applications for suspension of all other types of debt owed to the state of New York and referred to the OAG for collection.

James noted that the OAG collects certain debts owed to the State via settlements and lawsuits brought on behalf of the State and State agencies. A total of more than 165,000 matters currently fit the criteria for a suspension of State

“By again renewing the suspension of state student and medical debt collection referred to my office, we are helping to ease the burden faced by so many individuals and families across our state,” NY Attorney General James said.

debt collection, including, but not limited to: • Patients that owe medical debt due to the five State hospitals and the five State veterans’ homes; • Students that owe student debt due to State University of New York campuses; and • Individual debtors, sole-proprietors, small business owners,

and certain homeowners that owe debt relating to oil spill cleanup and removal costs, property damage, and breach of contract, as well as other fees owed to State agencies.

James pointed out that millions of New Yorkers have been impacted—directly or indirectly—by the spread of COVID-19, forcing

them to forgo income and business. Since COVID-19 began to spread rapidly across the country in mid-March, tens of millions of residents across the nation have filed for unemployment, including nearly 3.6 million in New York alone, James noted. The temporary debt-relief policy has also automatically suspended the accrual of in-

terest and the collection of fees on all outstanding state medical and student debt referred to the OAG for collection, so New Yorkers are not penalized for taking advantage of this program, she said.

“Although New York has made tremendous strides in curbing the coronavirus, too many New Yorkers are still suffering from the financial impact of this pandemic,” the AG added. “By again renewing the suspension of state student and medical debt collection referred to my office, we are helping to ease the burden faced by so many individuals and families across our state.”

New Yorkers with non-medical or non-student debt owed to NY and referred to the OAG may also apply to temporarily halt the collection of State debt. Individuals seeking to apply for this temporary relief can fill out an application online or visit the OAG’s coronavirus website at ag.ny.gov/coronavirus#debt to learn more about the suspension of payments. If an individual is unable to fill out the online form, they can also call the OAG hotline at (800) 771-7755 to learn more.

Comptroller Proposes Bike-to-School Plan for NYC High School Students

“We have a unique opportunity to make biking easier, safer, and more accessible and fundamentally shift how the next generation thinks about getting around our city,” Stringer said.

By Forum Staff City Comptroller Scott Stringer on Thursday proposed a first-of-itskind bike-to-school plan to encourage safe and sustainable biking options for city high school students on their commutes to and from school. Stringer’s plan calls on the City, in partnership with the philanthropic community, to build out 1.5 miles each of protected bike lanes around 50 NYC high school buildings in the next year, and to provide free bicycles or Citi Bike memberships to every low-income public high school student.

With reductions in bus and subway service, school buses operating at extremely limited capacity and the continued need for social distancing on public transit, Stringer said his bike-to-school proposal offers a safe and efficient transportation option for New York City’s young people.

“Reimagining our streets is not a job we can postpone until after the pandemic. Congestion is soaring, bus speeds are falling, and New Yorkers are concerned for the quality of life in their neighborhoods.

We should rethink our transportation strategy and encourage sustainable alternatives both now and in the years ahead,” Stringer said.

“Building out bike lanes around New York City high schools and providing bikes to lower-income students would open the door to biking for hundreds of thousands of young people. By taking this action, we can allow New York City’s youth to get around their city, improve health and educational outcomes, and connect with their communities. We have a unique opportunity

to make biking easier, safer, and more accessible and fundamentally shift how the next generation thinks about getting around our city.”

The comptroller said his plan calls on the City and philanthropic partners to: Build Out Protected Bike Lanes The City should build out one and a half miles of protected bike lanes around 50 New York City high school buildings within the next year, and at the remainder of high schools within the next five years, to safely connect residential areas and commercial corridors to local schools. These bike lanes should link to a larger network to improve mobility within and around New York City neighborhoods.

To achieve this ambitious rollout plan, the Department of Transportation will have to overhaul the design and implementation of new bike lanes. Man Indicted in Crash that Claimed Son

By Forum Staff A borough grand jury has indicted an Albany man for an August car crash that killed his 8-year-old son, Queens District Attorney Melinda Katz announced Thursday.

Victor Mitchell, 34, is charged in an 18-count indictment with aggravated vehicular homicide; vehicular manslaughter in the first and second degrees; criminally negligent homicide; aggravated driving while intoxicated; operating a motor vehicle while under the influence of alcohol; operating a motor vehicle while impaired by combined use of drugs or of alcohol and drugs; reckless driving; and endangering the welfare of a child.

Mitchell was arrested Thursday morning at an address in Yonkers and remanded in custody at his arraignment that afternoon.

According to the charges, Mitchell and his son, Sincere, 8, were on a Far Rockaway

road around 6:50 a.m. on Aug. 16, when Mitchell’s Acura slammed into a telephone pole. Sincere was rushed to a nearby hospital and underwent emergency surgery to repair a tear in his heart. Unable to breathe on his own, the child was placed on a ventilator.

Days later, doctors determined Sincere had no brain function. He died on Aug. 21.

According to the charges, a police-administered breathalyzer test showed Mitchell’s blood alcohol content to be .118; and the result of a Draeger drug test was positive for THC, a main ingredient of marijuana.

“This is a tragic case. A little boy is dead, his life cut short by his father’s decision to get behind the wheel of a car after smoking pot and drinking,” Katz said. “If you drive while impaired by drugs or alcohol in Queens, my office will hold you accountable. The defendant now faces serious charges for his alleged actions.”

If convicted, Mitchell faces up to 8 1/3 to 25 years in prison.

Williams and Berkley got into a heated dispute on Labor Day near this Far Rockaway nail salon.

By Forum Staff A Far Rockaway man has been charged for allegedly stabbing a Brooklyn man to death on Monday, Queens District Attorney Melinda Katz announced Tuesday.

James Williams, 51, was arraigned on Tuesday on a criminal complaint charging him with second-degree murder and criminal possession of a weapon in the third degree.

According to the complaint, shortly after 3:55 p.m. on Monday, police responded to reports of a fight across from a nail salon in a common walking path off Beach 20th Street. Upon their arrival, police found the victim, Massiah Berkley, of Brownsville, lying face up and bleeding from his chest. The 20-year-old victim was rushed to a nearby

hospital, but succumbed to his injuries.

According to the charges, witnesses saw Williams and the victim arguing. The heated dispute turned violent with Williams allegedly pulling out a knife and stabbing Berkley. Minutes after the bloody attack, police apprehended Williams a short distance from the scene.

“The defendant instigated a fleeting disagreement and allegedly turned it into a deadly tragedy. Acting out with violence is never the answer to resolve a dispute,” Katz said. “This altercation ended with a man brutally losing his life. This defendant is in custody and will be held accountable for his alleged rage-fueled criminal attack.”

If convicted, Williams faces up to 25 years to life in prison.

ARE EXPIRED MEDICATIONS STILL SAFE? It’s 2 a.m. - the cough and stuffy nose you have been battling is still keeping you up. You reach for the nighttime cold relief medicine only to find it expired a few months ago. If you take a dose to ease your symptoms, will you be putting yourself at risk? This situation is a relatively common occurrence. Many medicine cabinets are stocked with over-thecounter drugs as well as prescription medications that may be past their expiration dates.

It is a good idea to routinely discard expired medicines, but if you happen to take a drug that has passed its expiration date, you will most likely suffer no ill effects. According to the Harvard Medical School Family Health Guide, the expiration date on a medicine is not the dates when a drug becomes hazardous. Rather, it marks the period of time after which a drug company can no longer guarantee the efficacy of the medication. Since 1979, drug manufacturers selling medications in the United States have been required by the Food and Drug Administration to stamp an expiration date on their products. This is the date until which the manufacturer can still guarantee full potency of the drug. Expiration dates also may be a marketing ploy. Some experts say drug manufacturers put expiration dates on products for marketing purposes rather than scientific reasons. It doesn’t make

financial sense to a company to have products on the shelves for years. Therefore, most drug manufacturers will not do long-term testing on products to confirm if they will be effective 10 to 15 years after manufacture. The U.S. military has conducted their own studies with the help of the FDA. FDA research¬ers tested more than 100 over-the-counter and prescription drugs. Around 90 percent were proven to still be effective long past the expiration date - some for more than 10 years.

Drugs that are stored in cool, dark places have a better chance of lasting because the fillers used in the product will not separate or start to break down as they might in a warm, humid environment. Storing medicines in the refrigerator can prolong their shelf life.

Although a pharmacist cannot legally advise consumers to use medication past an expiration date, most over-the-counter pain relievers and drugs in pill form should still be fine.

Certain liquid antibiotics and drugs made up of organic materials can expire faster than others. For those who still want to err on the safe side, routinely clean out medica¬tions from cabinets once they expire. How-ever, if an expired medication is taken by mistake, there's little need to worry about potentially adverse effects.

By Forum Staff City Comptroller Scott Stringer on Friday fired off a letter to the State Department of Environmental Conservation Division of Environmental Permits expressing opposition to NRG Energy’s Astoria Replacement Project—a fossil fuel initiative that would pose environmental risks to the local Astoria community and undermine the fight for a more sustainable city, according Stringer.

The missive called on the DEC to ensure that the project undergoes a thorough environmental impact assessment that gauges how the plant would be compatible with the State and City’s ambitious climate goals. Stringer noted in the letter that the proposed plant would run on fracked gas—posing a direct threat to the health and well-being of Astoria residents and the broader climate.

The message recommended that NRG undertake a comprehensive review of nonfossil fuel project alternatives that would improve local air quality, and provide strong, resilient power supply to meet demand. The comptroller highlighted how a mix of renewables such as wind, solar, and battery storage systems could help power the energy grid and provide a model for how to retire other peaker plants across the city and state.

Stringer also noted that the proposal comes at a time when the COVID-19 pandemic has revealed stark disparities in health care and disease burden on lowincome communities of color—communities that have been disproportionately im-

pacted by air pollution and thus at greater risk from COVID-19. The letter called on any environmental review to include an analysis of the proposal’s impact on air pollution and the need to properly retrofit the existing plant to mitigate air pollution if the project does not move forward.

The comptroller wrote to DEC Permits official Christopher Hogan that he is “concerned that the proposed scope does not take a holistic enough view of the public health harms posed to the surrounding community. While the proposal promises to update the existing impact statement, it must more fully take into account a decade’s worth of new scientific research on the disparate impacts of air pollution. COVID-19 has cruelly taught us that the burdens of disease are not shared equally and that people of color suffer disproportionate impacts from air pollution. Initial studies have shown that even a small increase in exposure to air pollution drastically increases one’s likelihood to die if infected with COVID-19. Even absent a global pandemic, exposure to fine air pollution claims the lives of more than 3,000 New Yorkers every year. Recent studies show air pollution can impact mental health, childhood development, and worker productivity. I ask that the impact of any level of air pollution linked with fossil fuel power generation be rigorously discussed in the study. I also ask that should the project not be approved, NRG’s study of the ‘no action’ alternative explains how it will retrofit the existing plant to comply with new regulations on air pollution so that the community is spared ongoing exposure to pollution.”

Alternate Side Parking Reform Extended

Residential side streets with multiple alternate side parking days across the five boroughs will continue to be cleaned once per week for another two weeks, through Sept. 19, Mayor Bill de Blasio announced on Friday.

Amended rules pertain to residential “side streets” and not to commercial areas, City Department of Transportation officials noted. Streets with multiple ASP days would be cleaned on the last day of the week, as posted on each street’s currently posted sign. For example, a street with ASP

regulations posted on Tuesday and Friday will be cleaned on Friday only. Daily sweeping regulations in metered areas will not change, and DSNY will continue cleaning streets with posted No Standing, No Stopping and No Parking regulations as needed.

In June, de Blasio and former Sanitation Commissioner Kathryn Garcia unveiled the reform, touting it as the most dramatic change to ASP since 2000, when the City reduced the duration of sweeping windows from three hours to 90 minutes.

New LIRR Technology Identifies Least-Crowded Trains before Riders Leave Home

By Forum Staff The Long Island Rail Road on Tuesday unveiled a first-of-its-kind planning tool that allows customers to choose trains based on recent crowding data.

According to Metropolitan Transportation Authority officials, LIRR is the first transit agency globally to deploy the crowding data feature, which empowers customers with information so accurate and precise that they never have to second guess the best time to use the system.

The newest feature gives customers access to the median ridership of the past seven trips of a specific train, at any station, updated every morning to include the prior day’s data, LIRR officials said. Customers can plan their trip by selecting the time of their trip and which stations they are traveling between, and will see icons below specific trains gauging the capacity of each train. The icons range from 1 to 4, with 4 being the most crowded and 1 being the least crowded. By clicking on a specific train, customers can then see the crowding data.

For instance, someone traveling from Babylon to Penn Station around 7 a.m. can know ahead of time if the 6:49 a.m. or the 7:10 a.m. is least crowded based on the icons. For riders that do not board at end-of-line stations they can track how crowded a train gets at each station by clicking on that specific train. A cus-
