government to provide relief to the financially struggling authority due to the COVID-19 pandemic.

and from work. Instead of cutting the program, the federal government must step up and provide the MTA with much needed economic relief. Our region accounts for 10 percent of the nation’s Gross Domestic Product, and the MTA makes sure our economy stays on track. There would be a disastrous financial impact on my constituents, this region, and this country quite frankly if the MTA does not get the relief it needs.”

The MTA is facing historic budget deficits, and as a solution they

have proposed cutting the Rockaway Resident Rebate for the Cross Bay Veterans Memorial Bridge, and the Staten Island Resident rebate for the Verrazano Bridge. The Cross Bay Veterans Memorial Bridge is the only tolled intra-borough crossing in the entire state. The toll on the bridge originated with a 10-cent toll, and has grown to more than $4 for motorists without an EZ-Pass.

“Many of my constituents rely on the MTA to get to their jobs and access different parts of the borough, such as those on the geographically isolated Rockaway Peninsula,” Addabbo said. “My concern is that if the MTA does not get the federal funding, it may have to seriously consider raising fares on riders who are already suffering financially from the COVID-19 pandemic with hundreds of thousands of New Yorkers unemployed.”

By Forum Staff A borough grand jury has handed up an indictment charging a homeless man with first-degree rape and other offenses for allegedly attacking a woman this summer in Forest Park, Queens District Attorney Melinda Katz announced Friday.

Cuauhtemoc Cardenas, 32, was arraigned Friday on a four-

count indictment charging him with rape in the first degree, sexual assault in the first degree, assault in the second degree, and criminal obstruction of breathing or blood circulation. Cardenas was remanded and ordered to return to court on Nov. 6.

The sudden blow knocked the woman, 51, to the ground. Cardenas then allegedly dragged the victim into the bushes, pulled down her pants and sexually assaulted her. As the victim fought back, Cardenas allegedly wrapped a cloth around her neck that

restricted her breathing. The victim was able to scream for help, which alerted a passerby. Cardenas then ran away from the area.

The victim was treated at a nearby hospital for her injuries.

Cardenas was apprehended two days later after surveillance photos of him were circulated in the press.

turned into a maelstrom of violence for the victim in this case, who courageously fought off her attacker. Fortunately, a passerby heard her and startled the defendant, who will be prosecuted to the fullest extent of the law,” Katz said. “We are all entitled to enjoy our neighborhoods without fear.”

If convicted, Cardenas faces up to 25 years in prison.

Man Indicted for Violent Rego Park Attacks

The second attack occurred inside an apartment building on 64th Avenue and 98th Street in Rego Park.

By Forum Staff A Queens grand jury has indicted a Brooklyn man for two alleged surprise attacks this summer on women in Rego Park, Queens District Attorney Melinda Katz recently announced.

Richard Smalls, 58, has been arraigned on an eight-count indictment charging him with burglary in the first and second degrees, robbery in the second and third degrees, strangulation in the second degree and assault in the second degree. Smalls was remanded and ordered to return to court on Oct. 21.

According to the charges, around 4 p.m. on July 3, a 50-year-old woman stepped into the elevator inside her apartment building on Wetherole Street followed by Smalls. Seconds later, he allegedly shoved her into a corner, wrapped his arm around

her neck and squeezed. During the attack, Smalls allegedly said, “Give me your stuff.”

After taking a ring off the woman’s finger, Smalls allegedly bolted from the building.

According to Katz, at approximately 4:15 pm on July 28, a 72-year-old woman was checking her mailbox inside the lobby of her 64th Avenue apartment building when, without warning, Smalls allegedly grabbed her from behind, placed his arm around her neck and choked her. Smalls allegedly told the victim to shut up and then ordered her to give up the bag she was carrying. The elderly victim gave Smalls $60 in cash. Smalls allegedly grabbed her watch and removed three rings from her fingers.

The assailant then fled the building.

Smalls was apprehended days after the July 28 attack. If convicted, he faces up to 50 years to life in prison.

Meng Touts FAA Provisions in Spending Bills

By Forum Staff Congresswoman Grace Meng (DFlushing) recently announced that she secured several provisions that seek to increase the Federal Aviation Administration’s engagement with communities, expand security funding for houses of worship and nonprofits, improve outreach by the Small Business Administration, and enhance protections for consumers. The measures are items that Meng included in spending bills for Fiscal Year 2021.

According to Meng, the provisions would accomplish the following: • Allocate an additional $5 million so that the FAA can hire more staff to increase the agency’s community engagement capacity. This increased engagement, which stands to benefit areas such as Queens, would include the FAA’s participation in community roundtables and meetings with local officials. It would also allow for improved contractor support in order to make additional data publicly available about aircraft positions and altitude, as well as preparing air traffic histories and analyses, and conducting environmental reviews.

• Require the FAA to submit a report to Congress on activities undertaken by its Regional Ombudsmen, who serve as the regional liaisons on issues regarding airplane noise, pollution and safety. The report must log all FAA programs related to airport, aircraft, and environmental noise. It must also detail the current FAA in-take and response process for noise complaints, and the process expected after the Noise Complaint and Inquiry Database and Tracking System (a noise portal) is implemented nationally. The report must be provided no later than 180 days after the enactment of the provision.

• Boost the Nonprofit Security Grant Program to a record breaking $180 mil-

lion. The program is the federal initiative that provides houses of worship and nonprofit entities such as synagogues, churches, mosques, schools, community facilities and nonprofit organizations with funding to protect their properties against threats and attacks. In July, Meng announced that 16 Jewish and two Christian facilities throughout Queens received a total of more than $1.7 million under the program.

The grants, which are administered by the Federal Emergency Management Agency, cover target-hardening and other physical security enhancements such as barriers, gates, safety gear, surveillance equipment, and other safety measures.

• Call on the SBA to increase outreach and direct support to women entrepreneurs and small businesses in underserved communities such as those in Queens, including the Asian American community, and to increase engagement with minority serving institutions in its programming and grant making. Small businesses play a critical role in neighborhoods and communities across the borough, Meng said. They provide jobs, important services and drive the region’s economy. It is critical for female entrepreneurs and businesses in underserved areas to be made aware of and afforded all the opportunities and resources that the SBA has to offer, particularly as these establishments recover from the impact of the COVID-19 crisis.

• Require a report to Congress on the effects of direct and indirect food additives to determine if they pose physical and behavioral health risks to children. There are more than 10,000 additives to preserve or modify the taste, appearance and nutrients in food.

Food additives and their effects are dramatically under-studied and probing this issue would increase safety and transparency in the foods that kids eat, according to Meng.

Borough Health Care Professionals Charged in Nationwide Medicare, Medicaid Fraud Takedown

By Michael V. Cusenza Fifteen individuals, including borough doctors, pharmacists, and pharmacy owners, have been charged for their participation in schemes that fraudulently billed the Medicare and Medicaid programs for more than $15 million, federal prosecutors recently announced.

According to authorities, the charges filed in Brooklyn are part of a nationwide health care fraud takedown led by the Medicare Fraud Strike Force, which resulted in criminal charges against more than 300 individuals for their alleged participation in health care fraud schemes involving approximately $6 billion in fraudulent claims.

Schemes charged in the Eastern District of New York, detailed in three indictments, five complaints and three criminal infos, include the following: United States v. Dalmacio Francisco and Michael Othman: The complaint charges Dr. Dalmacio Francisco, 75, and Michael Othman, 48, with oxycodone distribution. The complaint alleges that Francisco, who operated two medical offices in Queens, provided large-quantity oxycodone prescriptions to “patients”—individuals he never actually evaluated—who were recruited by Othman in exchange for cash. Francisco also prescribed oxycodone in the names of two individuals who were incarcerated when the prescriptions were issued. During a search of Francisco’s home, Drug Enforcement Administration agents found $150,000 in bundled cash in a hidden lock box.

Xuan Di Huang: The complaint charges Xuan Di Huang, also known as “Wendy Huang,” an owner and operator of Zhiqing Social Adult Day Care in Flushing, with aiding and abetting and a substantive violation of the Anti-Kickback Statute. The charges stem from a scheme in which Huang, 59, allegedly paid and offered to pay kickbacks to Medicaid beneficiaries for their attendance at Zhiqing Social Adult Day Care. Between August 2019 and March 2020, Huang, through Zhiqing Social Adult Day Care, billed approximately $3.2 million to long term managed care plans for Medicaid beneficiaries.

United States v. Harris Hussnain: The information charges Harris Hussnain, 40, with conspiracy to commit health care fraud, narcotics distribution and

unlawful financial transactions.

The charges stem from Hussnain’s ownership of a Queens pharmacy, New Moon Pharmacy in South Richmond Hill, and dispensing of prescription medications, including large amounts of Oxycodone, when the pharmacy did not employ a full-time licensed pharmacist. Instead, Hussnain paid a coconspirator, Nisha Diler, a licensed pharmacist, to hold herself out as the full-time pharmacist despite the fact that she visited the pharmacy only sporadically. Between 2016 and 2019 Medicare and Medicaid reimbursed New Moon Pharmacy approximately $3 million for pharmaceutical claims. Hussnain pleaded guilty to the information at the federal courthouse in Brooklyn on Sept. 29.

macist, with conspiracy to commit health care fraud and subscribing a false tax return. The charges stem from Diler’s role in a scheme to hold herself out as the supervising pharmacist at New Moon Pharmacy, when in fact she did not work at the pharmacy. Diler was paid kickbacks

by Hussnain for her role in the scheme, which she then underreported on her taxes. Between 2016 and 2019, Medicare and Medicaid reimbursed the pharmacy approximately $3 million for pharmaceutical claims submitted through New Moon Pharmacy. Diler pleaded guilty to the information at the federal courthouse in Brooklyn on Sept. 16.

United States v. Aleah Mohammed, Aripha Mohammed and Shejer El Maliki: A criminal complaint charges Aleah Mohammed, 35, Aripha Mohammed, 33,

and Shejer El Maliki, 33, the owners and operators of the pharmacy Village Stardrugs Inc. in South Richmond Hill, with conspiracy to commit health care fraud. Additionally, Aleah Mohammed was charged with health care fraud and aggravated identity theft, and Aripha Mohammed and Shejer El Maliki were each charged with money laundering. The charges stem from their alleged roles in a scheme to submit claims through the pharmacy for medications that were not in fact prescribed as claimed, including claims for purportedly dispensing medications when the pharmacy was no longer licensed by the State of New York.

From March 2019 to March 2020, Medicare Part D plans reimbursed the pharmacy approximately $1.5 million for pharmaceutical claims, $1.4 million of which was reimbursed when the pharmacy was no longer licensed.

“As alleged today, the defendants took advantage of programs established for the benefit of those less fortunate, illegally profiting by ripping off the rest of the law abiding public,” said FBI NY Assistant Director-in-Charge Bill Sweeney, Jr. “This is not a victimless crime—health care fraud is a theft against all of us who contribute hard earned income and taxes into the system. While today’s charges are a victory for the public at large, and those who play by the rules, they also highlight a constant glaring problem. It is easy to illegally profit in the health care field, and the FBI’s New York office will continue to investigate and hold accountable those who break federal law while lining their own pockets.”

By Michael V. Cusenza A new State cluster initiative will address COVID-19 hot spots that have cropped up in Queens, Brooklyn and Upstate counties Broome, Orange, and Rockland, Gov. Andrew Cuomo announced Tuesday.

Working with the top public health experts, the administration developed a science-based approach to attack these clusters and stop any further spread of the virus, including new rules and restrictions directly targeted to areas with the highest concentration of COVID cases and the surrounding communities. The new rules will be in effect for a minimum of 14 days, Cuomo noted.

According to the governor, the initiative is composed of three steps: Take dramatic action within the cluster; take action in the area surrounding the cluster to stop the spread; take precautionary action in the outlying communities.

The initiative will divide clusters and the areas around them into three categories with successively higher restrictions within each one: Red Zone — Cluster Itself • Houses of Worship: 25 percent capacity, 10 people maximum • Mass Gatherings: Prohibited • Businesses: Only essential businesses open • Dining: Takeout only • Schools: Closed, remote only Orange Zone — Warning Zone • Houses of Worship: 33 percent capacity, 25 people maximum • Mass Gatherings: 10 people maximum, indoor and outdoor • Businesses: Closing high-risk

non-essential businesses, such as gyms and personal care • Dining: Outdoor dining only, 4 person maximum per table • Schools: Closed, remote only Yellow Zone — Precautionary Zone • Houses of Worship: 50 percent capacity • Mass Gatherings: 25 people maximum, indoor and outdoor • Businesses: Open • Dining: Indoor and outdoor dining, four-person maximum per table • Schools: Open with mandatory weekly testing of students and teachers/staff for in-person settings. The State Department of Health will establish a percentage of teachers and students/staff that need to be tested by Friday.

The enforcement of the zones will go into effect as soon as Wednesday, Oct. 7, and no later

than Friday, Oct. 9. Cuomo also announced that fines for the sponsors of mass gatherings in violation of State public health rules will be increased to $15,000.

Jackson Heights, Elmhurst, Maspeth, Middle Village, Ridgewood, Woodhaven, Richmond Hill, Jamaica, Flushing, and Corona are in the Yellow Zone, according to the initiative; areas of concern include parts of Kew Gardens, Kew Gardens Hills, Forest Hills, Rego Park, and Far Rockaway have been designated Orange or Red zones.

“A cluster is just that—it’s a cluster of cases, a high density of cases, and it seeps and grows from that cluster almost in concentric circles. Drop a pebble into the pond, the pebble goes in, then there’s a ring, two rings, three rings, and the rings continue across the pond. When you

see the cluster, you have to stop it at that point,” Cuomo said. “Our strategy is to crush the cluster and stop the spread, and we're announcing a special initiative to do just that. Step One, you take the most dramatic action within the cluster itself where you have the highest density of cases. Understanding that the people in that cluster interface with the surrounding communities, take additional action in the communities surrounding the cluster. Then as a precautionary measure, take action in the communities that are outlying that area.”

Additionally this week, Mayor Bill de Blasio sent a proposal to the New York State government to close non-essential businesses, including public and private schools, in nine city ZIP codes where COVID-19 rates have remained over 3 percent for the

past seven days. This plan, which would have begun on Wednesday, Oct. 7, also includes closing down high-risk activities in 11 additional city ZIP codes of concern.

While indoor and outdoor dining will be closed in these nine ZIP codes, restaurants will be allowed to continue serving customers for pickup and to-go meals. If successful, schools and non-essential businesses in the nine ZIP codes should be allowed to reopen after two weeks if rates are under 3 percent. If difficulties remain and cases continue to rise, all should remain closed for four weeks.

The borough communities on this dreaded list are Edgemere/Far Rockaway (5.63 percent 14-day positivity as of Oct. 4); Kew Gardens (3.81 percent); and Kew Gardens Hills/Pomonok (3.86 percent).

The proposal also includes actions in ZIP codes where rates have remained between two and three percent. In these neighborhoods, high-risk activities—like indoor dining, gyms, and indoor and outdoor pools—had been scheduled to be closed starting on Wednesday, Oct. 7. These Queens areas include: Rego Park, Fresh Meadows/Hillcrest, Jamaica Estates/ Jamaica Hills, Auburndale/Fresh Meadows/Pomonok/Utopia.

“New Yorkers have worked hard to fight back COVID-19, and we don’t make this recommendation lightly. But science guides our decision-making in this city—and we go where the facts take us,” de Blasio said. “Once again, it’s time for our city to dig deep and fight this virus the best way we know how: by wearing a mask, practicing social distancing, and looking after our seniors and most vulnerable neighbors.”

Extend Small Biz Debt Relief: Pols

By Forum Staff Senators recently called on Congress to pass legislation to extend the Small Business Debt Relief Program.

According to Sen. Kirsten Gillibrand (D-N.Y.), to date, the program has delivered relief to 320,000 small businesses heavily concentrated in the service industries hardest hit by the pandemic. The Small Business Debt Relief Program was authorized under the CARES Act with $8 billion for America’s smallest, most at-

risk employers. The program provides six months of principal, interest, and fee payments on all preexisting, deferred, and new 7(a) loans, 504 loans and microloans to those unable to make their payments.

Gillibrand indicated on Thursday that she has cosponsored the Small Business Debt Relief Extension Act to extend this debt relief through at least February 2021 for all borrowers, and the bill proposes additional extensions for businesses struggling the most.

One passenger died and two remain hospitalized in critical condition after a single-engine seaplane on Sunday slammed into a concrete Long Island Sound pier in Whitestone.

City Fire Commissioner Daniel Nigro spoke to reporters at the scene at Riverside Drive and 158th Street.

“We received a call of a seaplane hitting a concrete pier. Units arrived within four minutes. Two of the occupants of the plane were already removed by a good Samaritan who had witnessed the plane hitting the pier and came to their aid. The third victim was removed by

members of the FDNY,” Nigro said Sunday afternoon. “As of now, two of the people—the pilot and one of the passengers—are in critical condition in the hospital. One of the passengers is deceased. Witnesses said that the plane was traveling rather fast along the water, skipped twice, and hit the pier. An investigation will proceed into how this accident occurred.

Two other people, including the good Samaritan, were treated on scene and refused further medical aid. The remaining fuel was offloaded by our HazMat units.”

Sen. Addabbo has been organizing recycling events in Forest Park for many years.

By Forum Staff This Sunday, Oct. 11, State Sen. Joe Addabbo, Jr. (D-Howard Beach), City Councilman Bob Holden (D-Middle Village) and Assemblyman Mike Miller (DWoodhaven) will bring the Lower East Side Ecology Center to the Forest Park Bandshell Parking Lot from 10 a.m. to 2 p.m. for electronic waste recycling.

“Since the suspension of e-waste pickup due to COVID-19, we have been receiving inquiries from residents saying they have old televisions, computers and other electronics they want to dispose,” Miller said.

The City Parks Department is requiring all participants to wear masks when in the parking lot, especially when interacting with a volunteer. Participants are asked to stay in their vehicles as much as possible, for the safety of the staff and volunteers. Please have all items in an easily accessible part of the car, such as the backseat or trunk, to allow a volunteer to safely remove them and bring them to the proper location.

If anyone wishes to exit their car, they must have their temperature taken and fill out a visitor health screening questionnaire—as per Parks Department requirements—indicating if they have any symptoms of COVID-19 or if they have been in close contact with someone who has contracted the virus in the previous 14 days, Addabbo noted. They will also have to provide their name, phone number and email address for contact tracing purposes if it is found that anyone with COVID was present at the event.

“Since we were not able to have electronics recycling at our bi-annual recycling event, Assemblyman Miller and I made it a point to bring an e-waste event to our constituents.

I’m glad to add Councilman Bob Holden as a co-sponsor to this event. Now residents will have an easy way to recycle their electronic waste at a convenient location in their neighborhood,” the senator said.

“It’s important to properly recycle old electronics that are no longer in use, but it can be hard for people to find a place to take them,” Holden added. “That’s why I’m proud to partner with my colleagues, Assemblyman Mike Miller and Senator Joe Addabbo, to bring this service directly to our constituents to make it easy for them to be environmentally friendly.”

Although it’s somewhat of an unlikely topic for a pharmacist, Halloween safety this year represents a paramount concern for all of us.

Halloween is traditionally a time of great excitement for our children. This year however activity on the greatly celebrated day will have to be toned down to accommodate the burden of Covid-19.

We checked with experts in the field and would like to offer you some of their suggestions on how to implement alternatives to your children’s Trick or Treating this year.

Decorate, decorate, and decorate. Bring the holiday to life at your home. Carve pumpkins with your family. You can even do that at a safe distance with friends and neighbors. Decorate your living space in fun and spooky themes. Plan a scavenger hunt with a list of things for kids to look for while enjoying outside decorations at a distance. You can even plan a candy themed hunt for your home.

Have a virtual Halloween costume contest.

Unfortunately, it is the recommendation from the CDC as well as members of the medical community, that we must avoid certain traditional activities this year.

Traditional trick or treating is definitely not recommended—that is for the safety of the children as well as for those home they might visit to collect treats. Trunk or treat is also a no-no this year as are all indoor activities like crowded costume parties or haunted houses.

There are also a number of activities which have been labeled as presenting a moderate risk.

One-way trick-or-treating where individually

wrapped goodie bags are lined up for families to grab and go while continuing to social distance.

Small group, outdoor, open-air costume parades where people keep more than 6 feet of distance.

Outdoor costume parties where attendees wear protective masks and everyone can remain more than 6 feet apart.

Remember: A costume mask is not a substitute for a cloth mask. But do not wear a costume mask over a protective cloth mask as it can be dangerous if the costume mask makes it hard to breathe. Instead, consider using a Halloweenthemed cloth mask.

Open-air, one-way, walk-through haunted forests where appropriate mask use is enforced, and everyone can remain at least 6 feet apart.

However, if the haunted forest is really scary and attendees may scream, we recommend staying more than 6 feet apart.

Visiting pumpkin patches or orchards where people use hand sanitizer before touching pumpkins or picking apples. As always, masks should be encouraged or enforced, and you should maintain a distance of 6 feet or more from others.

How about an outdoor Halloween movie night with family or friends? With everyone at least 6 feet apart of course.

Number of Violent Crimes in U.S. Decreased for Third Year in a Row: FBI

By Forum Staff For the third consecutive year, the estimated number of violent crimes in the nation decreased when compared with the previous year’s statistics, according to recently released Federal Bureau of Investigation 2019 figures.

Last year, violent crime was down 0.5 percent from the 2018 number. Property crimes also dropped 4.1 percent, bureau officials noted, marking the 17th consecutive year the collective estimates for these offenses declined.

According to the FBI, the 2019 statistics show the estimated rate of violent crime was 366.7 offenses per 100,000 inhabitants, and the estimated rate of property crime was 2,109.9 offenses per 100,000 inhabitants. The violent crime rate fell 1 percent when compared with the 2018 rate; the property crime rate declined 4.5 percent.

Of the 18,667 federal, state, county, city, university and college, and tribal agencies eligible to participate in the FBI’s Uniform Crime Reporting Program, 16,554 agencies submitted data in 2019.

Here is an FBI summary of the statistics submitted, as well as estimates for those agencies that did not report: • In 2019, there were an estimated 1,203,808 total violent crimes. When compared with the estimates from 2018, the estimated number of robbery offenses fell 4.7 percent and the estimat-

ed volume of rape (revised definition) offenses decreased 2.7 percent. The estimated number of aggravated assault offenses rose 1.3 percent, and the volume of murder and non-negligent manslaughter offenses increased slightly by 0.3 percent.

• Nationwide, there were an estimated 6,925,677 property crimes. The estimated numbers for all three property crimes showed

declines when compared with the previous year’s estimates. Burglaries dropped 9.5 percent, larceny-thefts decreased 2.8 percent, and motor vehicle thefts were down 4 percent.

• Collectively, victims of property crimes (excluding arson) suffered losses estimated at $15.8 billion in 2019.

• The FBI estimated law enforcement agencies nationwide made 10.1 million arrests, (ex-

cluding those for traffic violations) in 2019.

• The arrest rate for violent crime was 156.3 per 100,000 inhabitants, and the arrest rate for property crime was 343.3 per 100,000 inhabitants.

• By violent crime offense, the arrest rate for murder and non-negligent manslaughter was 3.4 per 100,000 inhabitants; rape (aggregate total using the revised and legacy definition), 7.4; robbery, 24.7; and aggravated assault, 120.8 per 100,000 inhabitants.

• Of the property crime offenses, the arrest rate for burglary was 52.3 per 100,000 inhabitants; larceny-theft, 263; and motor vehicle theft, 25.1. The arrest rate for arson was 2.8 per 100,000 inhabitants.

• Last year, 13,247 law enforcement agencies reported their staffing levels to the FBI. These agencies reported that, as of Oct. 31, 2019, they collectively employed 697,195 sworn officers and 306,075 civilians—a rate of 3.5 employees per 1,000 inhabitants.

“I am encouraged by the great work being done by law enforcement to combat violent crime across the nation,” said FBI Deputy Director Dave Bowdich. “The FBI continues to make clear that violence will not be tolerated, and we are committed to continuing our work with state, local, and tribal partners across the country to confront and deter violence, dismantle criminal organizations and gangs, eradicate drug trafficking, and bring justice to victims.”
