Homeless Man Charged in Murder of Ozone Park Shop Employee

By Michael V. Cusenza A homeless man has been charged with murder and other crimes for the Monday evening shooting that claimed the life of a 26-year-old man inside an Ozone Park smoke shop, Queens District Attorney Melinda Katz announced Tuesday.

Steven Cohen, 63, was arraigned Tuesday on a complaint charging him with murder in the second degree, attempted murder in the second degree and 2 counts of criminal possession of a weapon in the second degree.

Cohen was ordered remanded and to return to court on

According to the charges, on Monday, Oct. 26, at approximately 6:15 p.m. inside the Cross Bay Express Deli, at 137-02 Cross Bay Blvd., the defendant became engaged in a verbal dispute with the victim, Tarwala Mahmadkhurshid, an employee at the store. The defendant was asked to leave the deli and shortly after allegedly returned with a Colt revolver, fired multiple times and struck the 26-year-old once in the abdomen. The defendant then turned to another employee and allegedly fired again, but missed his target.

The defendant was disarmed and immediately apprehend-

ed by a patron of the store, a police officer who was off duty at the time.

Mahmadkhurshid was transported to a local Queens hospital where he was pronounced dead.

“The incident started with a dispute and ended with the accused allegedly taking of the life of a 26-year-old man,” Katz said. “We need to thank the off-duty police officer for his bravery and swift action, tackling and disarming the defendant, assuring that no other lives were lost. The defendant will be held accountable.”

If convicted, Cohen faces up 25 years to life in prison.

By Forum Staff On Friday afternoon, City Councilman Eric Ulrich (R-Ozone Park) joined representatives from the City Department of Parks & Recreation and the Jamaica Bay Ecowatchers for a demonstration that removed an abandoned boat in Jamaica Bay. Earlier this year, Ulrich secured $55,000 in funding for a clean-up initiative, which will remove derelict vessels from the bay. The funds were allocated to the City Department of Parks & Recreation through the

“NYC Cleanup Initiative.”

Many vessels are abandoned when an owner can no longer afford to maintain them, and thus leave them to drift into Jamaica Bay instead of doing a proper removal. Despite having removed about two-dozen abandoned boats from the waters and marshlands of Jamaica Bay over the past several years, the Parks Department estimates more than 100 vessels remain in New York City’s waterways.

abandoned house boat from the Bay. Prior to being towed by a tug boat, the abandoned vessel needed to be patched to ensure it did not sink. Weather conditions - in this case, an ideal high tide - also play a role as to when tows are feasible. The clean-up effort was contracted out to Custom Marine. According to the Parks Department, it is a multi-year contract, bid through the New York City Dept. of Administrative Services.

Cusenza A new “Welcome to Ozone Park� sign was stolen Monday night—hours after elected officials and community leaders gathered to unveil it. “Last night’s brazen theft of the newly installed ‘Welcome to Ozone Park’ is not only despicable - it is a slap in the face to all residents of Ozone Park. This sign was much more than a greeting - it served as a symbol of the strength and resiliency of this great community and its residents. Police are currently investigating the matter.

Make no mistake about it - the heartless individual(s) responsible for this selfish act will be identified and punished to the fullest extent of the law,� wrote City Councilman Eric Ulrich (R-Ozone Park), State Sen. Joe Addabbo, Jr. (D-Howard Beach), and Assemblywoman Stacey Pheffer Amato (D-Howard Beach) in a joint statement issued Tuesday.

On Monday morning, the pols were joined by Community Board 10 Chairwoman Betty Braton and Howard Kampf, president of the former Ozone Park Civic Association to unveil and reinstall a refurbished “Welcome to Ozone Park� sign. The sign, located at the intersection of 149th Avenue and Cross Bay Boulevard, had been deteriorating since it was first installed in 2003.

The refurbishment of the sign was funded by the former Ozone Park Civic Association. The sign had been temporarily taken down for a project to reconfigure the street. It was restored by Cannon

Signs & Awning Inc., located on Rockaway Boulevard in South Ozone Park. According to a representative from the business, refurbishing the sign was an extensive process that took approximately three to four weeks. Their work included tracing, cutting and lettering the sign. The company also applied a PVC coating to the sign so that the wood cannot expand. This special coating ensures the sign is protected from any type of weather. “For over 100 years, my family tree has grown its roots deep within Ozone Park. Ever since my grandparents settled into Ozone Park after arriving from Italy around 1910, I have been proud to grow up here and raise my family mere houses from where I was born,� Addabbo said. “During his lifetime, my father moved five times, all within a one mile radius within Ozone Park. While much has changed since my grandparents came here, Ozone Park is still a predominantly working-class neighborhood with a lot to offer its residents and visitors. I want to thank Councilman Eric Ulrich, Assemblymember Stacey Pheffer Amato and Betty Braton, Chair of Community Board 10, for working in tandem for the benefit of our Ozone Park neighbors, who now have an outstanding ‘Welcome’ sign to be proud of, courtesy of the fine work of Joe Cannon at Cannon Signs & Awnings, and the generosity of the Ozone Park Civic Association.�

By Forum Staff State Attorney General Tish James on Monday announced agreements in four cases involving developers failing to comply with rent-stabilization requirements.

The 421-a program provides partial property tax exemptions to real estate developers that build qualifying new housing in New York City. Under New York state law, developers that apply for and receive 421-a tax benefits must register the apartments as rent stabilized and provide the tenants with rent-stabilized leases, rights, and protections, unless the properties are exempt from these requirements because they are operated as a condominium or cooperative. The developers of 63-36 99th St in Rego Park, the Bridgeview Tower Condominium in Long Island City, 5-11 50th Avenue in Long Island City, and 33 Bay 41st St in Brooklyn, all received 421-a tax benefits, but failed to adhere to the relevant requirements.

The final case announced today concerns the sponsor of the Millennium 99 Condominium at 63-36 99th Street in Rego Park, Tuhsur Development, LLC, and its principals, Yan Moshe and Vlad Moshe.

The sponsor failed to treat certain tenants in the building as rent-stabilized and overcharged multiple tenants by thousands of dollars each. The sponsor also attempted to evict tenants of a unit, who were illegally overcharged, for non-payment of rent, even though the tenants actually were owed a refund of $22,042. Tuhsur Development was required to pay $159,592 in restitution to be used by HPD to provide affordable housing, $43,066 to tenants that were il-

legally overcharged, and a $30,000 penalty, as well as lowering the rents of certain units and discontinuing any eviction proceedings against the overcharged tenants.

“Undoubtedly, tenants at 63-36 99 Street, a property in my district, are elated by the intervention of the New York State Attorney General’s office on their behalf,” said City Councilwoman Karen Koslowitz (D-Forest Hills). “I want to offer a profound thank you to Attorney General James and her Real Estate Finance Bureau for their activist role in protecting tenants from unscrupulous landlords abusing the 421-A tax exemption program.”

In the case of the Bridgeview Tower Condominium (Bridgeview Tower) in Long Island City, an agreement was reached with the sponsor of the building’s offering plan, Queens Bridgeview Tower, LLC, and its principals Zehao Fang, Simon Hung, and Austin Ting. The sponsor of Bridgeview Tower submitted an application for 421-a tax benefits to the New York City Department of Housing Preservation and Development (HPD), indicating that the building would be a condominium and thus not subject to rent-stabilization requirements. OAG subsequently discovered that all residential units in the building eventually became occupied by tenants, but the sponsor failed to treat the tenants as rent-stabilized under the terms of the 421a partial tax exemption. As a result of the agreement, the sponsor is required to pay a $150,000 penalty, which will be used by HPD to provide affordable housing in New York City. The sponsor also is required to treat all tenants in the building as rent-stabilized and refund any illegal overcharges.

Justice Department Announces Resolutions of Investigations with Opioid Manufacturer Purdue Pharma and Civil Settlement with Sacklers

By Forum Staff The Department of Justice recently announced a global resolution of its criminal and civil investigations into the opioid manufacturer Purdue Pharma LP, and a civil resolution of its civil investigation into individual shareholders from the Sackler family. The resolutions with Purdue are subject to the approval of the bankruptcy court.

According to Justice officials, Purdue Pharma has agreed to plead guilty in federal court in New Jersey to a three-count felony information charging it with one count of dual-object conspiracy to defraud the United States and to violate the Food, Drug, and Cosmetic Act, and two counts of conspiracy to violate the Federal AntiKickback Statute. The criminal resolution includes the largest penalties ever levied against a pharmaceutical manufacturer, including a criminal fine of $3.544 billion and an additional $2 billion in criminal forfeiture. For the $2 billion forfeiture, the company will pay $225 million on the effective date of the bankruptcy, and, as further explained below, the department is willing to credit the value conferred by the company to State and local governments under the department’s anti-piling on and coordination policy. Purdue has also agreed to a civil settlement in the amount of $2.8 billion to resolve its civil liability under the False Claims Act. Separately, the Sackler family has agreed to pay $225 million in damages to resolve its civil False Claims Act liability.

The Department of Justice recently announced a global resolution of its criminal and civil investigations into the opioid manufacturer Purdue Pharma LP, and a civil resolution of its civil investigation into individual shareholders from the Sackler family.

The resolutions do not include the criminal release of any individuals, including members of the Sackler family, nor are any of the company’s executives or employees receiving civil releases.

While the global resolution with the company is subject to approval by the bankruptcy court in the Southern District of New York, one important condition in the resolution is that the company would cease to operate in its current form and would instead emerge from bankruptcy as a public benefit company (PBC) owned by a trust or similar entity designed for the benefit of the American public, to function

entirely in the public interest. Indeed, not only will the PBC endeavor to deliver legitimate prescription drugs in a manner as safe as possible, but it will aim to donate, or provide steep discounts for, life-saving overdose rescue drugs and medically assisted treatment medications to communities, and the proceeds of the trust will be directed toward State and local opioid abatement programs. Based on the value that would be conferred to State and local governments through the PBC, the department is willing to credit up to $1.775 billion against the agreed $2 billion forfeiture amount. The department looks forward to working with the creditor groups in the bankruptcy in charting the path forward for this PBC so that its public health goals can be best accomplished.

As part of the plea, Purdue will admit that from May 2007 through at least March 2017, Purdue conspired to defraud the United States by impeding the lawful function of the DEA by representing to the DEA that Purdue maintained an effective anti-diversion program when, in fact, Purdue continued to market its opioid products to more than 100 health care providers whom the company had good reason to believe were diverting opioids and by reporting misleading information to the DEA to boost Purdue’s manufacturing quotas. The misleading information comprised prescription data that included prescriptions written by doctors that Purdue had good reason to believe were engaged in diversion. The conspiracy also involved aiding and abetting violations of the Food, Drug, and Cosmetic Act by facilitating the dispensing of its opioid products, including OxyContin, without a legitimate medical purpose, and thus without lawful prescriptions.

In addition, Purdue will admit to conspiring to violate the Federal Anti-Kickback Statute. Between June 2009 and March 2017, Purdue made payments to two doctors through Purdue’s doctor speaker program to induce those doctors to write more prescriptions of Purdue’s opioid products.

Similarly, from approximately April 2016 through December 2016, Purdue made payments to Practice Fusion Inc., an electronic health records company, in exchange for referring, recommending, and arranging for the ordering of Purdue’s extended release opioid products – OxyContin, Butrans, and Hysingla.

The department’s civil settlements resolve the United States’ claims as to both Purdue and its individual shareholders, members of the Sackler family.

The civil settlement with Purdue provides the United States with an allowed, unsubordinated, general unsecured bankruptcy claim for recovery of $2.8 billion.

programs, specifically Medicare, Medicaid, TRICARE, the Federal Employees Health Benefits Program, and the Indian Health Service. The government alleged that Purdue promoted its opioid drugs to health care providers it knew were prescribing opioids for uses that were unsafe, ineffective, and medically unnecessary, and that often led to abuse and diversion. For example, Purdue learned that one doctor was known by patients as “the Candyman” and was prescribing “crazy dosing of OxyContin,” yet Purdue had sales representatives meet with the doctor more than 300 times. It also resolves the government’s allegations that Purdue engaged in three different kickback schemes to induce prescriptions of its opioids. First, Purdue paid certain doctors ostensibly to provide educational talks to other health care professionals and serve as consultants, but in reality to induce them to prescribe more OxyContin. Second, Purdue paid kickbacks to Practice Fusion, as described above. Third, Purdue entered into contracts with certain specialty pharmacies to fill prescriptions for Purdue’s opioid drugs that other pharmacies had rejected as potentially lacking medical necessity.

Under a separate civil settlement, individual members of the Sackler family will pay the United States $225 million arising from the alleged conduct of Dr. Richard Sackler, David Sackler, Mortimer D.A. Sackler, Dr. Kathe Sackler, and Jonathan Sackler (the Named Sacklers). This settlement resolves allegations that, in 2012, the Named Sacklers knew that the legiti-

mate market for Purdue’s opioids had contracted. Nevertheless, they requested that Purdue executives recapture lost sales and increase Purdue’s share of the opioid market. The Named Sacklers then approved a new marketing program beginning in 2013 called “Evolve to Excellence,” through which Purdue sales representatives intensified their marketing of OxyContin to extreme, high-volume prescribers who were already writing “25 times as many OxyContin scripts” as their peers, causing health care providers to prescribe opioids for uses that were unsafe, ineffective, and medically unnecessary, and that often led to abuse and diversion.

The civil settlement also resolves the government’s allegations that from approximately 2008 to 2018, at the Named Sacklers’ request, Purdue transferred assets into Sackler family holding companies and trusts that were made to hinder future creditors, and/or were otherwise voidable as fraudulent transfers.

The resolution does not resolve claims that states may have against Purdue or members of the Sackler family, nor does it impede the debtors’ ability to recover any fraudulent transfers.

New York Attorney General Tish James ripped the deal, claiming it “doesn’t account for the hundreds of thousands of deaths or millions of addictions caused by Purdue Pharma and the Sackler family. Instead, it allows billionaires to keep their billions without any accounting for how much they really made.”

Four More Liquor Licenses Suspended for Egregious Violations of Coronavirus-related Regulations

By Forum Staff Governor Andrew Cuomo on Friday announced the State has suspended liquor licenses for 21 additional bars and restaurants in New York State—including four in Queens—after finding egregious violations of pandemic-related Executive Orders, including three establishments illegally operating within focus zones designated by the state as part of its micro-cluster strategy.

These new suspensions bring the total number of liquor licenses suspended during the coronavirus pandemic to 238, Cuomo noted. In total, 1,362 charges have been filed against bars and restaurants for violating coronavirus-related rules. Businesses found in violation of these regulations face fines up to $10,000 per violation, while egregious violations can result in the immediate suspension of a bar or restaurant’s liquor license.

“Rules are only as good as enforcement, and as we have ramped up checks on bars and restaurants, compliance has increased, creating a safer environment for everyone. A small number of business owners still don’t think the rules apply to them -- even in focus zones where the state has tracked increased spread -- and these suspensions should serve as a reminder that we will take action against those who callously put New Yorkers in harm’s way,” Cuomo said. “As we continue to fight clusters across the state, bar and restaurant owners should know that the State’s task force will keep enforcing the law, and if they do not follow the rules they will lose their right to serve alcohol.”

The emergency suspensions were ordered by State Liquor Authority Chairman Vincent Bradley, Commissioner Lily Fan and Commissioner Greeley Ford at special meetings of the Full Board between Sept. 30 and Oct. 21, conducted by a digitally recorded video under social distancing guidelines. Emergency Summary Suspensions are imposed when the SLA finds the continued operation of a licensed business threatens public health and safety. Suspension orders are served immediately and remain in effect indefinitely, with the maximum penalty including the permanent revocation of the license and fines of up to $10,000 per violation. Licensees subject to an emergency suspension are entitled to an expedited hearing before an SLA Administrative Law Judge.

The 21 establishments issued emergency orders of summary suspension from the State Liquor Authority Board are located in the New York City, Finger Lakes, Long Island, Mid-Hudson, Mohawk Valley and North Country regions.

“Elite Palace” at 69-02 Garfield Ave. On Sept. 25, the New York City Sheriff ’s Office responded to the location following complaints of social distancing violations to find a wedding in progress with nearly three-hundred patrons inside “Elite Palace” at 69-02 Garfield Ave. -- six times the number of attendees currently allowed at events -- along with a band playing and numerous patrons observed standing, mingling and drinking, most without facial coverings.

“Tropical Fantasy Bar & Lounge” at 92-06 173rd St. On October 9th, NYPD officers observed the premises using a tent set up on the sidewalk in front of the premises, which was blocking the pedestrian right of way in violation of New York City’s Open Restaurants program. According to the police, numerous patrons were observed standing, drinking and congregating un- “Zebra Lounge NY II” at 136-11 38th Ave. der the tent. Despite additional warnings, including a follow-up visit by the NYPD on October 15th and an inspection by SLA investigators on October 17th, the premises continued to utilize the illegal tent. The location is a repeat offender, with pending charges for multiple EO violations already issued by the SLA.

On October 18th, New York City Sheriff ’s Office deputies observed several individuals entering the business, which was operating in a “Red Zone” area identified by Governor Cuomo’s Cluster Action Initiative and was limited to take out and delivery only. Despite operating with the establishment’s front lights off to give the appearance the business was closed, deputies heard music playing inside and entered the premises, observing two rooms with about 25 patrons in each -- eating, drinking, and dancing without facial coverings or adherence to social distancing protocols. Deputies then entered an annexed space inside the building called the “Troyka Restaurant” and discovered approximately 45 additional patrons eating, drinking, and dancing to a live band -- with neither patrons, employees, nor band members wearing facial coverings.

According to patrons, the gathering was a wedding reception, which would not have been allowed at this size under statewide COVID-19 regulations, which limit non“Zebra Lounge NY II” at 136-11 essential gatherings to 50 attendees. A Long Island mother and her son have both been indicted by a Queens grand jury on murder and other charges for the shooting death of a Far Rockaway man.

By Forum Staff A Long Island mother and her son have both been indicted by a Queens grand jury on murder and other charges for the shooting death of a Far Rockaway man last month, Queens District Attorney Melinda Katz announced Friday.

Avita Campbell, 38, was arraigned Friday morning on an indictment charging her with murder in the second degree, criminal possession of a weapon in the second and third degree, criminal mischief in the fourth degree, unlawful possession of personal identification information in the second degree, aggravated unlicensed operation of a motor vehicle in the third degree and operating or driving a motor vehicle without a license.

Campbell was ordered held without bail and to return to court on Jan. 19.

Campbell’s son, Raymond Jackson, 22, has not yet been apprehended. When he is caught, Katz said, will have to answer to the following charges: murder in the second degree, criminal possession of a weapon in the second degree and unlawful possession of personal identification information in the second degree.

According to the charges, around 5:40 p.m. on Sept. 23, Campbell and Jackson were observed on video surveillance stopping their white BMW, which was being driven by Campbell on Beach 31st Street in Far Rockaway. The pair exited the BMW and approached Lasaaun Lawrence, 27, who was inside of a double parked car at that location. Both defendants were allegedly armed - Campbell with what appears to be a metal pipe and Jackson grasping a handgun. As the pair approached Mr. Lawrence, defendant

Jackson raised his arm and allegedly fired in the victim’s direction over a dozen times.

Continuing, said the DA, the victim was struck by multiple bullets. After her son stopped shooting, Campbell, took the pipe she carried and allegedly slammed it into the windshield of the car that Mr. Lawrence was in causing the windshield to shatter. Then both defendants jumped back into the white BMW and fled the scene.

The victim, who lived in Far Rockaway, died as a result of multiple gunshot wounds.

On Oct. 2, according to the charges, Campbell was pulled over during a traffic stop. Police executed a Court-authorized warrant and searched the vehicle – the same white BMW used in the fatal shooting in September. Police allegedly found a loaded silver and black firearm with two magazines inside a book bag. Defendant Campbell at that time was arrested on weapons charges.

According to the indictment, the Firearms Section of the New York City Police Department performed ballistics tests on the recovered gun and it was allegedly a match for the gun used to shoot and kill Mr. Lawrence.

According to the charges, in addition to recovering the firearm and ammunition allegedly in Campbell’s car police also found $9,640 in cash, multiple credit cards in other people’s names and a detailed ledger containing the names of more than 700 different people along with their personal information, including birth dates, social security numbers, home addresses and more. Some of the credit cards recovered matched the names of people listed in the ledger.

Change Alarm Batteries this Weekend: FDNY City Fire Commissioner Daniel Nigro is urging all New Yorkers to check, and if needed, change the batteries in their smoke and carbon monoxide alarms when changing their clocks for the end of Daylight Saving Time on Nov. 1. City will Advance Funding for Housing NY Plan

By Forum Staff Mayor Bill de Blasio on Thursday announced the acceleration of capital funding within the City’s affordable housing plan, a major step toward ensuring a fair recovery from the COVID-19 crisis.

The City will shift $466 million to the current fiscal year’s capital budget during the upcoming Preliminary Plan to address urgent affordable housing needs, bringing the capital investment this fiscal year to over $1.4 billion.

The Housing New York goal of creating and preserving 300,000 affordable homes by 2026 remains on track, de Blasio noted.

Last week, the City released the Where We Live NYC Plan, the City’s blueprint for fair housing in the five boroughs to break down barriers to opportunity and build more integrated, equitable neighborhoods.

“Rebuilding a fairer and better New York City means investing in affordable housing and making our neighborhoods more inclusive,” said Mayor Bill de Blasio.

In March, the City moved $466 million from HPD’s Fiscal Year 2021 capital budget into Fiscal Years 2022 through 2024.

To support both the ongoing recovery effort and this critical

program, the City will be moving these funds back to Fiscal Year 2021.

According to the administration, since the pandemic began, the City has advanced a robust affordable housing pipeline. The Department of Housing Preservation and Development continued to support projects with limited use of City capital – focusing on developments that serve vulner-

able residents and communities – and sponsored by Minority and Women-Owned Business Enterprises and nonprofit developers.

“This administration has made affordable housing a priority since day one, and especially in this critical moment, we are grateful for the additional funding,” said HPD Commissioner Louise Carroll. “With these restored funds, we’ll be forging ahead on the goals of Housing New York with an even sharper focus on protecting the most vulnerable among us – New Yorkers at the lowest income levels, our seniors, those experiencing homelessness – and helping make this city a more equitable place by supporting M/WBE’s and nonprofits projects as well as those in neighborhoods hit hard by COVID-19.”

This past summer, de Blasio announced that the City financed 30,023 affordable homes in the last fiscal year. To date, the City has financed almost 166,000 affordable homes, of which 44 percent serve extremely low and very-low income families, those earning less than $30,720 or $51,200 for a family of three, respectively.
