City Cop, Four Others Arrested for Roles in Cocaine-Distribution Organization

By Forum Staff An indictment was unsealed Monday in federal court in Brooklyn charging Amaury Abreu, an NYPD police officer, and two co-defendants, Julio Bautista and Gustavo Valerio, with conspiring to import and distribute cocaine, according to federal prosecutors.

Between at least January 2016 and October 2020, Abreu, 34, Bautista, 35, and South Ozone Park resident Valerio, 38, were allegedly members of a multinational drug trafficking organization (DTO) with distributors in the New York-metropolitan area and the Dominican Republic.

The indictment also charges Bautista and a fourth defendant, Cesar Diaz-Bautista, 43, with possession with the intent to distribute cocaine. A fifth defendant, Junior Ortiz, 29, is charged in a complaint with cocaine importation conspiracy.

Abreu, Julio Bautista, Cesar Diaz-Bautista, Valerio and Ortiz were arrested Monday morning.

As set forth in the indictment and other court filings, the DTO imported multi-kilogram quantities of cocaine into the U.S. through a variety of means, including by sending drug couriers on flights to the U.S.

via John F. Kennedy International Airport, concealing narcotics in mail and tractor trucks that entered the U.S. from Mexico, and concealing narcotics in produce shipments that were imported into the United States. Since 2016, law enforcement agents have seized more than 350 kilograms of cocaine belonging to the DTO. As alleged, Abreu, Bautista and Valerio played key roles in the DTO. Specifically,

Bautista and Valerio were high-ranking members of the DTO based in New York, and were responsible for distributing and overseeing the distribution of cocaine once it arrived in New York. Abreu, who worked out of the 113th Precinct in Southeast Queens, used his position as a cop to protect his co-conspirators by providing information to the DTO about law enforcement procedures, performing warrant checks on

DTO members on the NYPD arrest database and, on at least one occasion, distributing cocaine for the DTO. For example, in January 2016, Abreu messaged the DTO’s leadership, stating: “Today I’m going to find out the thing I couldn’t yesterday because there were too many people at the office.” One day later, Abreu messaged the DTO’s leadership that an associate of the DTO was “fine, because here in New York you don’t see information from another state when we run a license from another state only if they’re wanted so if they stop him tell him to say he lives in Pennsylvania and not in New York and it’s cool . . . .”

On March 11, 2016, the DTO’s leadership sent Abreu a message containing defendant Valerio’s full name, date of birth and social security number. An audit of the NYPD’s arrest database revealed on that same day, Abreu searched for Valerio’s name in the warrants database despite having no legitimate law enforcement purpose for doing so. Ortiz allegedly operated a produce importation business that accepted shipments of cocaine from the DTO. If convicted, the defendants each face a mandatory minimum sentence of 10 years’ imprisonment and a maximum of life imprisonment on each of the charges.

City Council Releases Report on NYPD Official’s Inappropriate Online Behavior

Cusenza City Council Speaker Corey Johnson and Oversight and Investigations Committee Chairman Ritchie Torres on Friday released a Council Oversight and Investigations report containing substantial evidence pointing to the identity of an anonymous online persona responsible for “numerous and repeated unacceptable and disgusting online posts.”

The evidence reveals that the anonymous poster, who went by the name “Clouseau” on the vitriolic public online message board known as “Law Enforcement Rant,” appears to be Deputy Inspector James Francis Kobel.

Deputy Inspector Kobel was the commanding officer of the NYPD’s Office of Equal Employment Opportunity (EEO), which is a sub-unit of the NYPD’s Office of Equity and Inclusion (OEI). This division of the NYPD is responsible for promoting “a fair, safe, inclusive and accommodating work environment for all members of the [NYPD]” and “for ensuring [the NYPD’s] employees are treated with digni-

ty and respect in the workplace… and promoting a fair and inclusive workplace that is free from discrimination and harassment,” according to the office’s website. He has held this position since May of this year. His previous role was to serve as the executive officer (second in command) of the EEO for at least four years.

a public hearing on the matter in the coming weeks.

The 31-page report is littered with examples of Kobel’s alleged posts, including several focused on Eric Garner and the Garner family: “Clouseau wrote that Eric Garner was ‘a morbidly obese, diabetes havin’, high blood pressure ignorin’, asthma havin’, chicken wing eatin’, grape soda drinkin’,

loosie sellin’ fat bastard,” who died because of his “poor dietary choices.’ In another post, he wrote that Garner ‘should have made an effort to make himself a productive member of society… [instead of] planting his seed everywhere, and having everyone of his spawn living off of the Federal Government Teet [sic].”

Johnson said, “The abhorrent racist, misogynist, and homopho-

bic messages, which our evidence reveals was posted by NYPD Deputy Inspector James Francis Kobel, are deplorable and intolerable. It is outrageous that any public servant—let alone the person in charge of handling harassment and equal opportunity at the department—would behave in this reprehensible and unprofessional manner. This council will take immediate action to find out how this could have happened, what steps are needed to make sure someone like this is never empowered again in the NYPD, and to investigate the work this officer and his office has done in the past, all of which has been called into question by this investigation.”

Kobel has been relieved of his command and placed on modified assignment after the council’s findings were shared with the NYPD. “The virulent bigotry of Deputy Inspector James Francis Kobel has no place in the NYPD, much less in the Office of Equal Employment Opportunity,” Torres added.

“The shocking nature of the misconduct in this report would call for nothing less than termination.”

By Michael V. Cusenza On Friday, Gov. Andrew Cuomo announced updated COVID-19 micro-cluster focus areas in New York.

Based on data metrics, including testing results and hospitalization rates, Queens— Far Rockaway’s yellow zone has been removed. The focus zone in Kew Gardens/ Forest Hills will not change, Cuomo added.

“In general, downstate New York is doing better than Upstate New York, which is a total reversal from the first phase of COVID, where it was primarily a downstate problem and Upstate New York said oh, this is not a problem, this is not a problem. It’s a total reversal,” the governor said.

“If you look at the numbers, Queens, the micro-cluster approach is working. We had two micro-clusters in Queens. We had one in Far Rockaway, and that micro-cluster is going to be extinguished as of today, because the numbers were under control, the micro-cluster worked, and the micro-cluster for Far Rockaway is being terminated.

The micro-cluster in Queens in the Kew Gardens area is unchanged. The Brooklyn micro-cluster, the red zone, is working, and it’s working well, and we’re going to reduce the size of the red zone by 50 percent. And we’ll put out a map today that shows the exact parameters of that reduction, but it’s a reduction of 50 percent and the yellow zone is also reduced 50 percent. So it’s working in Queens, it’s working in Brooklyn.

“When I said there’s a different picture across the State,” Cuomo continued, “individual actions matter: Orange, congratulations; Rockland, congratulations; Queens, congratulations; Brooklyn, congratula-

tions. Long Island, good news. Southern Tier, good news. North Country, good news. Mohawk Valley, good news. Erie, Monroe, Onondaga—not good news. So that’s that.”

The governor said several aspects of attacking the virus still worry him.

“Number One, we’re worried about the holiday season,” he said. “We’re worried about behavior in the State, we’re worried about behavior out of the State. I’ve cautioned before, people should beware of small gatherings this year. I’ve said that we have a very strict quarantine policy in place for the holiday weekend travel, period.

We’re going to be increasing enforcement personnel at the New York airports. You should not land if you do not have proof of a negative test upon landing. You’re supposed to take a test where you’re coming from within three days and it is supposed to show a negative test. I’m increasing the National Guard. I spoke to New York City Mayor Bill de Blasio about increasing the New York Police Department at the airports, but I want people to know we’re serious.

“Second: colleges, which have been highly problematic,” Cuomo continued, “SUNY is going to send kids home for the Thanksgiving break. They’re going to do what’s called exit testing, another new concept. They’re going to test every student on the way out so students that are infected will know where they’re going and what to do and how to get there. SUNY is also going to cancel the return from the Thanksgiving break and do remote learning for the rest of the semester which takes us to about February and then we’ll figure out in February what we do.”

UNDERSTANDING SEASONAL AFFECTIVE DISORDER When Daylight Saving’ s Time ended at the beginning of this month, millions of people turned their clocks back one hour. Few take as much pleasure turning the clocks back in autumn as much as they enjoy turning them forward in spring.

The explanation for that is simple–turning the clocks forward affords many people, in particular working professionals who spend much of their weekdays working indoors, a chance to enjoy some sunlight when leaving their offices each day. However, once the clocks are turned back, professionals typically find themselves leaving their offices under a cover of darkness.

Some people easily adjust to less daylight, while others experience a condition known as season affective disorder, or SAD. SAD is a disorder related to changes in seasons.

According to the Mayo Clinic, the majority of people with SAD begin to experience symptoms in the fall and continue battling those symptoms throughout the winter. The end of Daylight Saving Time occurs in early November, and the onset of SAD symptoms is no doubt related to the decreased exposure to daylight many people experience once clocks have been turned back. Those who suspect they might be susceptible to SAD can get a better grasp of the condition so they are capable of recognizing and responding to it should any symptoms appear.

WHAT IS SAD? Mental Health America, a leading community-based nonprofit dedicated to addressing the needs of those living with mental illness, defines SAD as a mood disorder associated with depression and related to seasonal variations of light. Though many people may be saddened when

the clocks are turned back and the sun sets earlier than it does in the warmer months, MHA notes that a diagnosis of SAD can only be made after the symptoms of SAD have appeared for three consecutive winters and have gone into remission once spring and summer have arrived.

WHAT ARE THE SYMPTOMS OF SAD? Simply feeling bummed out that winter is on the horizon does not mean a person has SAD. The following are some of the more common symptoms of the disorder: • Depression marked by feelings of misery, guilt, hopelessness, despair, and apathy. A loss of self-esteem may also occur.

• Feelings of anxiety that include tension and an inability to tolerate stress • Mood changes that are sometimes extreme; some SAD sufferers experience feelings of mania in spring and summer.

• Changes in sleeping habits, such as a desire to oversleep and difficulty staying awake. Some people may experience disturbed sleep and find themselves waking up in early morning when they are unaccustomed to doing so.

• Feelings of fatigue and an inability to adhere to one’s of four SAD sufferers are women. Young people are more normal routine likely than older people to get winter SAD, with MHA reporting that the main age of onset of SAD is between 18 and 30. By Forum Staff A Long Island man connected to two borough heroin overdoses has pleaded guilty to his role in the incidents, Queens District Attorney Melinda Katz recently announced.

Justin Lum, 31, pleaded guilty on Monday, Nov. 2. to two counts of criminally negligent homicide and one count of criminal sale of a controlled substance in the third degree. Sentencing has been set for Jan. 13. Lum will be sent to prison for three to six years.

According to court records, on April 27, 2017, Lum provided heroin to his girlfriend, Brooklyn resident Patricia Collado, while the two of them watched a movie at a College Point theater. After leaving the moviehouse, they again used heroin supplied by Lum inside a parked car. The 28-year-old woman suddenly stopped speaking and lost consciousness. Lum sought help and pulled Collado from the vehicle at 56th Avenue and Main Street, where first responders administered Naloxone to the woman and transported her to a nearby hospital.

Lum stayed at the hospital with the victim until she was discharged shortly after 11 p.m., when the couple went to Lum’s grandfather’s house in Flushing. There, the pair again snorted heroin supplied by Lum, and Collado abruptly went into cardiac arrest. This time, however, the defendant did not call for medical attention, nor did he attempt to provide her with medical care. For an hour, while Collado needed medical aid, Lum continued to use drugs and then fell asleep.

Sometime after 8 a.m. the next morn-

ing, Lum woke up to find the victim beside him unconscious. Only then did he call 911 and administer CPR per the instructions of the medical dispatcher on the phone. Collado was dead when emergency medical technicians arrived. An autopsy showed she died from acute intoxication due to the combined effects of fentanyl, heroin and cocaine.

According to the charges, in March 2018, Lum sold heroin to Calvin Brown, who lived in Bayside. Brown was inside Lum’s residence on March 1, 2018, when he took the drugs Lum gave him and immediately had a medical emergency. The defendant called 911 and gave the 24-yearold man CPR until first responders got there. Brown was taken to an area hospital for treatment and survived.

Brown was discharged from the hospital on March 6, 2018. Three days later, on March 9, the victim returned to Lum’s home and bought more heroin from the defendant. The next day, Brown was found dead, by his mother, in their Bayside home. An autopsy performed on Brown revealed the cause of death to be acute intoxication from the combined effects of heroin, alprazolam (Xanax), diazepam and phenobarbital.

“Despite knowing how close each had come to dying, the defendant again provided heroin—at least one dose laced with fentanyl—to the victims,” Katz said. “This defendant—an admitted drug dealer—is the first in Queens County to be held criminally responsible for the deaths of people who died after ingesting the poison he supplied to them. He has now admitted his guilt and at sentencing will be ordered to serve time in prison as a result of his criminal actions.”

Where did the NFL get such a pathetic concept of prayer? Certainly not from Jesus. His promise “…ask whatever you wish and it will be given you” reveals true prayer to be an explosive spiritual force.

Even worse than secular misunderstandings of prayer are the anemic clichés that you’ll sometimes hear from believers. “All we can do now is pray” betrays the unbelief of the one speaking. Prayer is not a last resort, and such low expectations arise from failure to claim what the Lord has promised.

Failure to meet the Lord’s conditions for answered prayer also robs prayer of its potency. Christ quali-

fied His promise with two: “If you remain in me and my words remain in you…”

The first suggests that we are to remain where we are. As believers we are to remain in Him by tenaciously clinging to Him, trusting Him, and Him only, with the same simple faith that joined us to Him at first.

The second qualification shows how important are Christ’s words!

Some people talk about Christ being their Lord but show little regard for what His Word proclaims. They presume that as long as their hearts are right toward His person, they can believe as they wish. But He warned us that we dare not call him Lord if we do not do the things which He says.

A life of mighty prayerfulness is available to us. These simple conditions are the two feet by which we climb the mountain.

Queens Announces Full Funding for Cutting-Edge Cancer Treatment Technology at Elmhurst Hospital

By Forum Staff Acting Queens Borough President Sharon Lee on Tuesday announced a $5.4 million allocation to NYC Health + Hospitals/ Elmhurst to fully fund the purchase and installation of a new medical linear accelerator (LINAC) in its oncology unit within months, augmenting the Level 1 trauma center’s ability to provide life-saving, high-quality care to Queens residents battling cancer.

This will be the first LINAC in any of the 11 NYC Health + Hospitals citywide, Lee noted.

The best piece of equipment in the industry, the new Varian TrueBeam linear accelerator — a state-of-the-art external beam radiation device that targets and destroys cancerous cells with high-energy xrays while sparing surrounding healthy tissue — will be installed in early 2021. The existing linear accelerator was originally installed in 2004 and is nearing the end of its useful life. Upon its installation, the innovative radiotherapy technology will be used to image and treat a wide range of cancers, while ensuring faster and more precise care for the patient.

Tuesday’s $5.4 million allocation represents the single largest discretionary allocation to NYC Health + Hospitals/Elmhurst by the Queens Borough President’s Office in nearly two decades.

“Cancer has spared no one in some way, and stolen so many. The battle against cancer is a fierce race against precious time,” Lee

said. “Investing in cutting-edge technology and bringing it right here to Elmhurst Hospital is a direct investment into our families, our futures and more birthdays. Top-of-theline treatment should and will be available for us right here at home, without having to cross a bridge or go through a tunnel.

Two Charged with Selling ‘Virus Shut Out Cards’

By Forum Staff A Long Island man and Flushing woman have been charged with selling “Virus Shut Out Cards,” which they marketed as air sanitizers designed to kill the novel coronavirus (COVID19), but which have not been demonstrated to be effective in treating or preventing the virus, federal prosecutors announced Tuesday.

Specifically, Po Shan Wong, 55, and Zhen Wu, 35, of JCD Distribution Inc. in College Point, are charged with conspiring to distribute and sell one or more pesticides that are not registered with the United States Environmental Protection Agency and that are adulterated or misbranded.

As alleged in the complaint, between May 2020 and July 2020, Po Shan Wong served as the general manager, and Zhen Wu served as sales manager at JCD. During that time, the defendants and JCD advertised “Virus Shut Out Cards” on the company’s website and Facebook page, and marketed and sold these products to customers by phone, making various untested claims regarding the effectiveness of the cards. For example, JCD’s Facebook page claimed that the cards emit chlorine dioxide and, thereby, serve as “portable space disinfection and sterilization cards” with a “sterilization rate at 99%.” In fact, chlorine dioxide—a gas—is a bleaching agent and a pesticide as defined by Federal Insecticide, Fungicide and Rodenticide Act. JCD’s Facebook page also contained images that depicted a blue card, approximately the size of a credit card, being used by children and adults. For example, the

images showed the blue card worn on a lanyard around a woman’s neck, hung from the lapel of a man’s suit jacket, hung from the pocket of a medical doctor’s white coat, attached to a boy’s backpack and a girl’s stroller, and attached to computer monitors. JCD’s Facebook page also claimed that the cards “replace masks.” JCD sold the cards in minimum quantities of 50, charging $9.50 per card.

Random samples of the “Virus Shut Out Cards” were tested by the EPA’s National Enforcement Investigations Center and found to contain sodium chlorite in amounts sufficient to convert into chlorine dioxide when exposed to the water vapor and carbon dioxide in the air. Breathing air with sufficiently high concentrations of chlorine dioxide may cause difficulty breathing, irritation in the nose, throat and lungs, shortness of breath, chronic bronchitis and other respiratory problems.

“The brazenly false claims allegedly promoted by the defendants about their product potentially endangered the public not only by claiming to protect against the COVID-19 virus, but also by exposing users to the health hazard posed by a misbranded pesticide,” said Acting Brooklyn U.S. Attorney Seth DuCharme.

“The COVID-19 pandemic has opened a flood gate of fraudsters whose only goal is to take advantage of the public with bogus and unsubstantiated claims of virus protection products, such as this one. Consumers should be skeptical of any device, elixir, lotion or potion claiming to prevent or cure COVID-19 because to date, there is no such product,” added USPIS NY Inspectorin-Charge Philip Bartlett.

If convicted of the charge, the defendants face up to one year in prison.

Teams to Respond to Mental Health Crises

“For the first time in our city’s history, health responders will be the default responders for a person in crisis, making sure those struggling with mental illness receive the help they need,” Mayor de Blasio said.

By Forum Staff New Mental Health Teams of Emergency Medical Services health professionals and mental health crisis workers will be dispatched through 911 to respond to mental health emergencies in two highneed communities, Mayor Bill de Blasio announced Tuesday.

According to the administration, currently, NYPD officers and FDNY Emergency Medical Services Emergency Medical Technicians respond to nearly all mental health 911 calls, regardless of the severity of health needs, whether a crime is involved, or whether there is an imminent risk of violence. In the health-centered pilot announced Tuesday, new Mental Health Teams of health professionals and crisis workers from FDNY Emergency Medical Services will be the default response to mental health emergencies in two high-need precincts.

Beginning in February 2021, new Mental Health Teams will use their physical and mental health expertise, and experience in crisis response to de-escalate emergency situations, will help reduce the number of times police will need to respond to 911 mental health calls in these precincts. These teams will have the expertise to respond to a range of behavioral health problems, such as suicide attempts, substance misuse, and serious mental illness, as well as physical health problems, which can be exacerbated by or mask mental health problems. NYC Health + Hospitals will train and provide ongoing technical assistance and support. In selecting team members for this program, FDNY will prioritize professionals with significant experience with mental

health crises.

In emergency situations involving a weapon or imminent risk of harm, the new Mental Health Teams will respond along with NYPD officers. Over 65 percent of all operational staff in NYPD patrol precincts across the City have now been trained in Crisis Intervention Team training, which improves the way officers recognize and respond to behavioral health problems experienced by people they encounter. In all precincts other than the two precincts selected for this pilot, NYPD officers and FDNY Emergency Medical Services EMTs will continue to provide coordinated responses to mental health emergencies.

The new health-centered approach builds on significant work undertaken over the last few years to strengthen mental health crisis prevention and response. In partnership with the NYC Crisis Prevention and Response Task Force, the City is reducing the number of mental health crises that result in 911 calls by expanding the number of mental health teams who can intervene before crises occur and stabilize people in the weeks following a crisis.

And to ensure those with the most serious needs stay connected to treatment, the City has also expanded intensive, mobile treatment for New Yorkers with serious mental illness.

“One in five New Yorkers struggle with a mental health condition. Now, more than ever, we must do everything we can to reach those people before crisis strikes,” de Blasio said. “For the first time in our city’s history, health responders will be the default responders for a person in crisis, making sure those struggling with mental illness receive the help they need.”

EAT, DRINK AND PREPARE TO PUT OUT A FIRE The challenge of food and drink indulgences around the holidays is one that all of us face. The most common source of problems we encounter after overeating is dealing with the culprit we know as acid indigestion/aka heartburn.

Heartburn is the result of stomach acid splashing back into the esophagus, which creates that burning feeling we’d be better off without. Thankfully there are many products available both as prescriptions and OTC remedies that effectively neutralize the effects of gorging ourselves.

Reducing the production of acid in the stomach can be tackled through the use of preparations such as Priolosec OTC, Nexium 24 Hour, Pepcid, Zantac and Prevacid 24 Hour. These are all available in pill or capsule form as well as a variety of liquids and chewable tablets. When you know that your stomach is prone to producing excess acids, and all of us who suffer from the condition definitely know we do, and know it is wise to take whatever remedy you prefer in advance of the meal that you know is going to set your stomach aflame, but that you just can’t miss.

Now if by some unfortunate chance you don’t catch the fire before it starts to burn, there is another class of fast acting prepara-

tions known as antacids. Like their name suggests, they work to neutralize the stomach acid that splashes back into your esophagus and creates a burning feeling. Remember it is not only food that causes a trigger for heartburn, which can also be brought on by chocolate, coffee, alcohol and cigarettes. .

Some of the more common products readily available at your local pharmacy include, Tums, Mylanta, Gaviscon, Alka-Seltzer, Rolaids and Maalox.

While these products can offer you the almost instant relief you crave, remember that persistent symptoms may well be the sign of a much more serious problem than just over eating or eating the wrong foods.

Ulcers, gastritis and other serious conditions often send warning signs disguised as heartburn.

If you are experiencing symptoms with the feelings we have described, like burning, gas and bloating, on a frequent and regular basis, or if you experience the burning without having consumed anything you know to be bothersome you should speak to your local pharmacist and consult your doctor immediately. These symptoms are not to be avoided.

Queens District Attorney Melinda Katz on Tuesday presented checks totaling more than $1.5 million to victims of a prevailing wage scam.

The money distributed is the stolen wages recovered by the DA’s Office following an investigation and the prosecution of Laser Electric and its owner Jagdeep Deol.

The defendants pleaded guilty in September to failing to pay a prevailing wage and made restitution at sentencing. This money

is being returned to the nine workers above and others.

Over the course of several years, the employees had been victimized in a con commonly referred to as a prevailing wage scam. After acquiring City contracts, the defendants billed NYC as if they were paying their workers the union rate—when, in reality, they were paying the employees substantially less and pocketing the difference.

ACS Releases Key Findings from Survey of LGBTQAI+ Youth in NYC Foster Care

By Forum Staff More than one out of three youths, ages 13 to 20, in City foster care identify as LGBTQAI+ and those youth are more frequently young people of color, according to key findings of a new survey about lesbian, gay, bisexual, transgender, queer or questioning, agender or asexual and intersex (LGBTQAI+) youth in foster care in the five boroughs.

According to the Administration for Children’s Services, a total of 659 young people in foster care participated in the survey. The survey questionnaire included questions about the sexual and gender status, demographic characteristics, characteristics of the youth’s placement in foster care, the youth’s social connections, and their well-being.

Key findings from the survey suggest: LGBTQAI+ youth are overrepresented in foster care.

More than one out of three youths (34.1 percent), ages 13-20, in New York City foster care is LGBTQAI+. This is substantially higher than the proportion of LGBTQAI+ youth in the general population.

LGBTQAI+ youth in foster care are more frequently youth of color. With almost three quarters of the sample identifying as African American and almost a third identifying as Latinx, the sample reflects the population of New York City youth in foster care, in which people of color are disproportionally represented. Within this already racially and ethnically disproportionate group, LGBTQAI+ youth are less likely to be white and more likely to be Latinx.

The placements of LGBTQAI+ youth in foster care differ from those of non-LGBTQAI+ youth in foster care.
