City Adopts New Zoning Rules to Protect Coastal Areas from Climate Change

By Forum Staff Mayor Bill de Blasio recently announced that a major package of zoning rules will now help to protect homes and businesses in New York City’s vast floodplain from climate change. The package of zoning rules, known as Zoning for Coastal Flood Resiliency, helps buildings better withstand and recover from major disasters and sea level rise, which could lead to lower insurance costs.

Zoning for Coastal Resiliency rules will: Encourage resiliency in current and future flood-prone neighborhoods: ZCFR greatly expands where flood resilient zoning rules apply. New and substantially rehabbed buildings in areas of the city that, by 2050, are expected to have a 1 percent chance of a flood event in any given year, are now permitted to meet or exceed flood-resistant construction standards set by the U.S. Federal Emergency Management Agency or NYC’s Building Code. The expanded floodplain geography increases the number of buildings that can be retrofitted to resiliency standards by nearly 50 percent, allowing new construction in these areas to be more resilient and more building owners to proactively raise living space and important equipment out of harm’s way.

Support long-term resilient design: Previously restrictive zoning could inadvertently lead resiliency retrofits to create very narrow, poorly designed homes in small lots. Through ZCFR’s flexible zoning rules on height and yards, building owners can both raise their structures and produce a well-designed, resilient home that fits with the surrounding neighborhood character while achieving a better floorplan.

Adapt to a changing climate through incremental retrofits: ZCFR lets buildings elevate or relocate important mechanical, electrical and plumbing equipment, or backup systems like generators, above the

expected height of floodwaters. This can be done either within the building, atop of the structure, or on a separate platform. For example, a NYCHA or Mitchell-Lama complex in Lower Manhattan or Manhattan Beach can construct an elevated mechanical building in its yard to address the needs of the campus while keeping equipment out of the path of damaging floodwaters. An industrial business in the South Bronx can build a mezzanine to safely store sensitive machinery or important files above where floodwaters might seep in. The mezzanine would be exempt from floor area, preventing loss of building space elsewhere.

Speed up future recovery by reducing regulatory obstacles: ZCFR places recovery provisions in the Zoning Resolution that can be quickly selected based on the issues caused by the disaster and recovery period. These provisions include cutting down on red tape and providing additional time for an affected business to reopen, even if it predates and no longer matches the current zoning.

In addition to ZCFR, changes to further limit flood risk in three neighborhoods as part of DCP’s Resilient Neighborhood Initiative – Gerritsen Beach and Sheepshead Bay in Brooklyn, and Old Howard Beach in Queens – are now active. These actions address resiliency challenges specific to these areas: In Old Howard Beach, zoning changes limit the construction of attached homes, which are harder to retrofit and elevate than detached homes because of their shared walls.

In Gerritsen Beach, zoning changes, including the establishment of a new Special Coastal Risk District, limit future density and cap building heights at 25 feet above the potential height of floodwaters to more closely match the area’s built character.

In Sheepshead Bay, the existing Special Sheepshead Bay District now prohibits below-grade plazas, which are prone to flooding and difficult to make resilient.

This year’s Summer Reading Program theme is “Tails and Tales,” and libraries across the state are encouraging kids and teens to explore some new and exciting books this summer.

By continuing their learning throughout the summer, parents can help their children avoid what is commonly known as the “Summer Slide.” The Summer Slide is the loss of skills students gained during the school year while students are not in school for summer recess and it can affect students of every skill level and household income, Addabbo noted.

By Michael V. Cusenza Beginning Wednesday, May 19, New York State will adopt the Centers for Disease Control and Prevention’s “Interim Public Health Recommendations for Fully Vaccinated People” for most business and public settings, according to Gov. Andrew Cuomo.

Consistent with the CDC guidance, Pre-K to 12 schools, public transit, homeless shelters, correctional facilities, nursing homes, and healthcare settings will continue to follow State’s existing COVID-19 health guidelines until more New Yorkers are fully vaccinated.

Business Mask Rules Given that the CDC has advised that fully vaccinated individuals do not need to wear masks and over 52 percent of New Yorkers over the age of 18 are fully vaccinated, the State will authorize businesses to continue to require masks for all in their establishments, consistent with the CDC guidance. In most settings, vaccinated individuals will not be required to wear a mask.

Unvaccinated individuals, under both CDC and state guidance must wear masks in all public settings.

The Department of Health strongly recommends masks in indoor settings where vaccination status of individuals is unknown. Mask requirements by businesses must adhere to all applicable federal and state laws and regulations.

This recommendation will apply across commercial settings, including retail, food services, offices, gyms and fitness centers, amusement and family entertainment, hair salons, barber shops and other personal care services, among other settings.

Businesses will only be limited by the space available for patrons or parties of patrons to maintain the required social distance of 6 feet.

However, given that the CDC has advised that fully vaccinated individuals do not need to maintain social distance, businesses may eliminate the 6 feet of required social distancing, and therefore increase capacity, only if all patrons within the establishment -- or a separate designated part of the establishment -- present proof of full vaccination status. Proof of full vaccination status can be provided by patrons through paper form, digital application, or the State’s Excelsior Pass.

For areas where vaccination status of individuals is unknown and for patrons who do not present proof of full vaccination status, the required social distance of 6 feet still applies until more New Yorkers are fully vaccinated. This change will apply across all commercial settings, except the exempt settings outlined by the CDC.

Small- and Large-Scale Event Rules Small-scale events will be able to apply the revised business mask and capacity rules.

Specifically, for events below the State’s social gathering limit of 250 indoors or 500 outdoors, event venues will be able to require masks for all patrons -- and DOH strongly recommends masks in indoor settings where vaccination status is unknown -- and social distancing of 6 feet will be required between parties of attendees, unless all attendees present proof of full vaccination status. Unvaccinated people should still wear masks.

Meng Hate Crimes Act Heads to Biden’s Desk for Approval

By Forum Staff U.S. Rep. Grace Meng (DQueens) on Tuesday applauded the House of Representatives’ passage of her COVID-19 Hate Crimes Act, which seeks to help combat the increase in anti-Asian hate that has occurred during the current COVID-19 pandemic. The bill passed late this afternoon 364 to 62. It follows the Senate’s approval of the measure last month by a nearly unanimous and overwhelming bipartisan vote of 94 to 1. The legislation now heads to President Joe Biden who has said that he will sign it into law.

The bill, which Meng reintroduced in March with Senator Mazie Hirono (D-HI), would among other things, create a position at the Department of Justice to facilitate expedited review of COVID-19 hate crimes, encourage more reporting of incidents in multiple languages, and help make different communities feel more empowered to come forward and report these incidents. It would also direct federal agencies to work with community-based organizations to raise

in fear, and being frightened about their kids or elderly parents going outside. There have been over 6,600 reported acts of violence, with over two-thirds being reported by women. And those are just the reported numbers. As I have said, everybody in our country deserves to feel safe, and that includes the Asian American community. I want to especially thank Senator Hirono for partnering with me to sponsor this legislation, as well as Speaker Pelosi and Majority Leader Schumer for making the bill’s passage in Congress a reality, and strongly standing with the Asian American community during this difficult time.”

Meng discussed the legislation this morning with Speaker Pelosi and Members of the Congressional Asian Pacific American Caucus, of which she serves as the First Vice Chair. She also spoke about the bill this afternoon on the floor of the House.

Last month, Biden in his first address to Congress, thanked the Senate for passing Meng’s bill and called on the House to approve the measure as well, adding that he would sign the legislation into law.

MTA Encourages Return to Mass Transit

MEIDCATIONS ARE WORKING FOR MIGRAINES For the last two weeks, we’ve offered you a lot of information about migraine headaches and what steps you can take, within your living environment, your diet to help you through this debilitating condition. this week we will tell you about several medications that have been introduced to treat migraines effectively. In 2018, the Food and Drug Administration, FDA, has introduced a medication, the first of its kind, that promises to reduce the number of migraines among the millions who suffer from these crippling headaches.

The majority of drugs on the market back then acted on migraines by helping to alleviate symptoms.

But the first approved migraine drug, Aimovig, wasthe first medicine in a new class of drugs designed to reduce the number of migraines in frequent sufferers.

The generic name of the drug is erenumabaooe, is being sold here by pharmaceutical giant, Amgen.

Today amid the appearance of COIVD-19, we are becoming increasingly aware of the power of monoclonal antibodies and Amovig is a monoclonal antibody which zeros in on a molecule known as CGRP, which is found in higher levels in people with migraines. The drug binds to CGRB and basically renders it useless. Ex-

perts say the research leading to Aimovig began over thirty years ago in the 1980’s.

Initial tudies leading to the release of the drug revealed that participants in the study dropped from more than 8 headaches a month to fewer than 5.

Since the advent of these drugs three years ago, many other preparations have become available and are proen effective in cases to greatly reduce suffering from migraines and some are aimed at prevention.

Ajovy, Emgality are monoclonal antibldy therapies like Aimovig.

Other drugs currently being used for the treatment and prevention of migraines are not monoclonal antibodies but use different compounds and targeting.

Many patients have been helped with the use of preparations specifically targeted for migraine . But it is very important to remember that Migraine medications do not cure migraines. Instead, migraine drugs treat the symptoms using one of two approaches.

Some migraine drugs relieve symptoms.

Other migraine drugs are used to prevent a migraine attack.

“Signs of Affection” is one of four sub-campaigns aimed at encouraging New Yorkers to return to mass transit.

By Forum Staff The Metropolitan Transportation Authority on Sunday launched a marketing and communications campaign aimed at increasing ridership as the New York Metropolitan region recovers from the pandemic. The #TakeTheTrain, #TakeTheBus campaign will appear beginning today to encourage New Yorkers to return to a more reliable, cleaner system than the one many last used before the pandemic arrived in New York. The launch of the campaign coincides with initial ridership increases in the system, with more than two million riders on subways over the past few weeks and bus ridership reaching 1.2 million.

Recent combined Metro-North and Long Island Rail Road ridership of 160,000 is dwarfing the combined average of 23,000 of a year ago, with weekend ridership now approaching 50% of pre-pandemic weekend levels.

Customers returning to the system will see digital signs at subway entrances, ads on buses and billboards on roadways all promoting a return to the MTA system. The MTA is selling limited edition merchandise to mark the importance of the role that the system plays in fueling the city’s economic and cultural life. Transit officials also revealed that they will be launching a robust advertising campaign that hits radio and the digital sphere in the coming weeks.

“This has been a year of unprecedented and unexpected challenges, but we are at a turning point of the pandemic,” said MTA Chairman and CEO Patrick Foye. “With more than half of New York adults vaccinated with at least one dose of the vaccination and

positive cases down dramatically from just a few months ago, it’s clear that New York’s comeback has begun in earnest. The city’s subways and buses along with our commuter rails are cleaner than ever before and prepared to welcome our riders back with safe, reliable service. We are eager to see folks back in the system again.”

“It’s time to #TakeTheBus and #TakeTheTrain again,” said New York City Transit Chief Customer Officer Sarah Meyer. “A year ago, we were actively encouraging anyone who wasn’t an essential worker not to ride the system. Thankfully those days are now long gone, and we are thrilled to welcome New Yorkers back to their commuter rails, subways and buses that are cleaner and faster than ever before.

The campaign will also include a range of events with partner groups around the region touting the importance and preparedness of the MTA. The MTA is the fundamental backbone of New York and the nation’s economy serving a region comprising nearly 10 percent of U.S. GPD, and removing 17 million metric tons of carbon emissions from the air per year while moving millions of customers and employees to diverse industries from health care to restaurants and Broadway theaters to financial services.

The new ad campaign will appear on buses, on billboards and elevated overpasses, social media and on the MTA’s above-ground digital signs in the system and on the street at station entrances. It is composed of four subcampaigns – “New York is Open,” “Comeback,” “Signs of Affection” and “Public Transit is Better.”

City Announces Major New Plan to Manage Trucks and Freight

By Forum Staff Mayor Bill de Blasio and City Department of Transportation Commissioner Hank Gutman on Thursday released Delivering New York: A Smart Truck Management Plan, a new freight management plan to improve New York City’s freight management and truck safety.

“Just as we are reimagining how people move to reduce our dependence on private cars, we must reimagine how goods move to reduce our dependence on large diesel trucks,” Gutman said. “We cannot solve this problem with more big trucks, which endanger our aging infrastructure, pollute our air and contribute to climate change. When they travel on residential streets where they do not legally belong, they present safety dangers and harm our quality of life. In Delivering New York, we show how we can and must expand alternatives to bringing goods to and from our City – from loading zones to dramatically expanded overnight deliveries -and much more.”

Major initiatives of the plan target safety, efficiency, sustainability and expanding partnerships/knowledge, and include: SAFETY • Target 70 Truck Safety Priority Corridors citywide over the next five years • Truck-involved traffic collisions disproportionately prove fatal. Starting this year, DOT will implement safety improvements on at least 10 truck priority safety corridors each year, as well as set new design standards to enhance truck safety at intersections where a majority of serious crashes occur.

• Strengthen Enforcement Efforts: Vision Zero Street Teams Corridor Enforcement and Education Initiatives • DOT and NYPD will deploy a multineighborhood, multi-corridor strategy, targeting one high-crash corridor in all eight NYPD Patrol Boroughs. The 2021 Vision Zero Street Team Corridor program is a joint effort between NYPD and the DOT Safety Education and Outreach and Highway Inspection and Quality Assurance units.

• NYPD will engage in two-week deployments with each Precinct, no fewer than three times per year.

• DOT will safely deploy Vision Zero Street Team outreach effort for one week in every Precinct involved in the program, rotating among Patrol Boroughs. DOT will hand out educational materials to New Yorkers at intersections along the corridors.

• Teams will focus on locations with high incidences of truck-involved crashes. Their work will feature outreach to truck drivers, pedestrians, and cyclists about the obstructed views that are unique to large vehicles when interacting with vulnerable road users.

restrictions, DOT will issue new rules to identify new truck routes across New York City. New routes will fill gaps, allow better distribution, and reduce “dead-ends” that lead to truck trips onto prohibited residential streets. DOT will update its map this year and add on-street signage that better identifies both new corridors and prohibited ones.

• Continue and Further Expand OffHour Deliveries (OHD) program • The Off-Hour Deliveries program encourages delivery companies to shift their deliveries to off-peak hours. Deliveries made between 7pm and 6am can help to reduce traffic in the most congested areas of the city. In 2019, Mayor de Blasio set a goal to triple the number of Off-Hour Deliveries from 500 to 1500 locations by the end of 2021 – targeting focus areas in Midtown Manhattan and Downtown Brooklyn.

• DOT will work with DCAS and other City agencies to examine ways the City can lead by example through smart application of procurement policies, making its own freight supply chain cleaner, greener, and more efficient.

• Improving Curb Management • Expansion of Dedicated Commercial Space in Commercial Areas: The increase in truck deliveries has heightened the need for safe and efficient curb access. DOT will increase the number of commercial loading zones citywide with a focus on high-demand Central Business District and outer borough areas. Increased curb access will reduce conflicts between vulnerable road users and double-parked trucks.

• Expansion of Neighborhood Loading Zone (NLZ) program to residential areas: With a primary focus on narrow streets with bus and bike routes, DOT will double the number of Neighborhood Loading Zones citywide to accommodate the growing market share of e-commerce deliveries in residential areas. To date, 111 zones have been installed in neighborhoods citywide.

First introduced in 2019, NLZs discourage double parking by giving delivery and noncommercial vehicles dedicated space at the

curb for expeditious loading of goods and passenger pick-up/drop off activity in residential areas.

SUSTAINABILITY • Creation of a permanent Commercial Cargo Bike Program • As announced two weeks ago, DOT will expand and make permanent its pilot program incentivizing the use of cargo bikes for deliveries in some of the City’s most congested neighborhoods. The program expanded dramatically during the pandemic, growing to over 350 cargo bikes.

It will be made permanent by: • Creating an annual permit for businesses operating five or more cargo bikes for commercial purposes • Creating an annual permit for businesses operating three or more cargo bikes for commercial purposes • Pursuing legislative changes to ensure that wider e-cargo bikes are compliant with State law.

• Designate “Green Loading Zones” • New zones would be dedicated to particular vehicle types and/or reserved for use by particular companies to incentivize electric vehicles, including “Cargo Bike Loading Only” curb regulations.

• Continue to expand the NYC Clean Truck Program to industrial business zones citywide • Begun in 2012, DOT’s Hunts Point Clean Truck program has grown into one of the agency’s great success stories, as companies in the South Bronx replaced over 500 trucks to cleaner and greener vehicles.

Under this initiative, DOT will invest $9.8 million in advanced transportation technologies and alternative fuel trucks for other industrial areas, including expanding the use of electric trucks.

• Establish off-street freight distribution and consolidation hubs in partnership with private garage operators • By removing the ‘last mile’ truck delivery from the logistics chain, off-street consolidation helps to reduce roadway congestion and competition for curb access and deliveries during the most congested times of the day. DOT will also continue to work with private property owners throughout the city to develop off-street delivery hubs.

• Expand Bridge Strike Reduction Program through signage, pavement markings, & ITS technology • DOT has worked closely with state partners to reduce bridge strikes, where errant truck drivers can cause millions of dollars of infrastructure damage and traffic congestion when they strike low-clearance overpasses, especially on parkways. DOT will: • Leverage and strengthen multi-agency coordination with regional enforcement and infrastructure partners (NYPD, MTA, NYSDOT, and PANYNJ) • Develop digital truck driver resources, targeted radio ad campaigns, and increase awareness through truck associations, rental companies, owner-operators, and conduct outreach to routing and mapping companies.

• Prioritize top 10 frequently hit low bridges citywide, where new signage and pavement markings will be implemented • Add an over-height detection system along the Belt Parkway, which has some of the most frequently hit low bridges.

As more goods than ever flow through our city, it’s time for a smart, thoughtful freight management approach that keeps our communities safe and livable,” said Mayor Bill de Blasio. “Delivering New York charts a path toward a future with fewer and smaller trucks, which will ease congestion, reduce greenhouse gas emissions, and protect our infrastructure.”

Richards Announces Healthcare Investments at NYC Health + Hospitals/Elmhurst

diatric Intensive Care Unit (PICU) at NYC Health + Hospitals/Elmhurst — the first such investment at either of the two NYC Health + Hospitals campuses in Queens.

Currently, Queens children in need of intensive medical care are transferred out of the NYC Health + Hospitals system to systems such as Northwell Health, which operates a PICU at Cohen Children’s Medical Center in New Hyde Park.

NYC Health + Hospitals/Elmhurst’s new PICU will allow the facility to offer lifesaving intensive medical care to children right on site, while also establishing a more centralized location for Queens families to receive such critical care. Cohen Children’s Medical Center is more than 15 miles from Far Rockaway, Long Island City and other sections of southern and western Queens — requiring trips of more than 30 minutes by

car or 90 minutes by public transportation.

The second of two allocations to NYC Health + Hospitals/Elmhurst will support the conversion of two undersized operating rooms at the facility into full-size, full-service operating rooms. The expansion of the two rooms will allow the hospital to perform a wider array of surgical procedures there, while also decreasing overall surgical wait times for patients.

Pols Laud Introduction of PEAKER Act

By Forum Staff U.S. Senator Kirsten Gillibrand (DN.Y.) on Sunday joined Reps. Yvette Clarke (D-Brooklyn), Nydia Velazquez (DQueens, Brooklyn, Manhattan) and Jerrold Nadler (D-Manhattan) at the Sims Recycling Plant in Sunset Park, Brooklyn, to announce the introduction of their new legislation, the Promoting Energy Alternatives is Key to Emission Reductions Act of 2021, also known as the PEAKER Act of 2021.

The PEAKER Act of 2021 would: • Direct the Secretary of Energy, in coordination with the Administrator of the Environmental Protection Agency, the White House Environmental Justice Advisory Council, the White House Environmental Justice Interagency Council, and Council on Environmental Quality, to perform a nation-wide assessment that identifies the location of each dirty peaker plant in the U.S. and determines the quantity and type of pollution each plant is producing.

The assessment will also evaluate the demographic details around the location of each peaker plant to specifically determine whether the peaker plant is located within or adjacent to a disadvantaged community.

• Establish a new 10 percent additional Investment Tax Credit for battery storage and renewable electricity to displace electricity generated by dirty peaker plants in disadvantaged communities.

• Establish a new grant program at the Department of Energy, funded at $1 billion annually over the next 10 fiscal years, for clean energy projects that will help to reduce or eliminate the need of existing

who may apply for grant funding include: state or local governments, nonprofit organizations, community-based organizations and electric co-ops, or a partnership between any of the aforementioned entities and an electric utility or a private business.

Communities who wish to first undergo a clean energy assessment and then implement clean energy strategies based on the assessment’s findings will be able to apply for two rounds of grant funding.

“Communities from Sunset Park to the South Bronx bear the brunt of harmful emissions because of peaker plants in their backyards,” Gillibrand said. “To help these communities, and to help our country build a stronger, healthier and more sustainable future, we must shift our energy reliance away from fossil fuels to renewables. Together, we will keep working to bring an end to the use of these fossil fuel plants, to usher in the next generation of green energy technology, and help these communities breathe cleaner air.”

I’m proud to join my House and Senate colleagues in introducing the PEAKER Act, which will address this environmental injustice by facilitating clean energy conversions and battery storage to help replace these aging and dirty peaker plants.”

Elmhurst Man Charged with Spree of Knife Attacks

By Forum Staff An Elmhurst man has been charged in three separate stabbing incidents, Queens District Attorney Melinda Katz recently announced.

Mark Albano, 34, allegedly killed a man at the Grand Avenue-Newtown subway station on April 23, and was apprehended on Saturday, May 8, following two knife attacks within hours of each other in Elmhurst.

Albano has been arraigned on three separate criminal complaints. Regarding the April 23 incident, Albano is charged with murder in the second degree, tampering with physical evidence and criminal possession of a weapon. In the May 7 incident, the defendant is charged with attempted murder in the second degree, assault in the first and second degree and criminal possession of a weapon in the third degree. In the May 8 incident, Albano is charged with attempted assault in the first degree, assault in the second degree and criminal possession of a weapon in the fourth degree.

Katz said that, on April 23, the defendant approached Leroy Williams, 57, on the platform of the Grand Avenue-Newtown subway station around 3:30 a.m. and allegedly stabbed him once in the chest.

According to the charges, around 8 p.m. on Friday, May 7, at 51st Avenue near 90th Street, Albano approached a man from behind and allegedly stabbed him multiple times in the upper back area. The victim, who is 31-years-old, collapsed to the

ground in pain. But he was able to see Albano running past him carrying a gray bag.

The victim in this case was rushed to an area hospital. He sustained partial paralysis as a result of the stabbing.

On May 8, at approximately 5:15 a.m., as outlined in the complaint, the defen-

dant was inside the basement of a building on Van Loon Street when he confronted another man. Albano allegedly took out a knife and stabbed the 40-year-old victim.

The man sustained wounds to his arm and armpit. When police arrived on the scene, the victim was lying in a pool of blood.

The victim of the Saturday stabbing was also taken to a nearby hospital where he received stitches and staples to close the open wounds.

Police apprehended Albano several blocks away from the scene of the Saturday stabbing carrying a bag, which allegedly contained a knife.

“A brutal, unprovoked killing in a subway station stokes dread throughout the entire city. The successful re-opening of our borough and our city depends on New Yorkers being safe and feeling safe, on our streets and in our subways. This defendant’s alleged, senseless attacks resulted in one man being killed and another partially paralyzed,” Katz said. “My Office is committed to holding accountable those who would hold the city hostage to fear with acts of violence.”

If convicted on all three cases, Albano faces up to 25 years-to-life in prison for the April 23 homicide, up to 25 years for the May 7 stabbing, and up to 15 years in prison for the May 8 incident.

By Forum Staff Four Far Rockaway men have been indicted for the beating death of Nazareth Claure, 31, on April 11, Queens District Attorney Melinda Katz recently announced.

The victim’s remains were found in the trunk of a car during a traffic stop by police on April 14.

Allan Lopez, 22, Jose Sarmiento, 21, Anander Henriquez, 28, and Rigel Yohairo,

20, were arraigned last week on a seven-count indictment charging them with murder in the second degree and criminal possession of a weapon in the fourth degree. Lopez, Sarmiento and Yohairo are also charged with concealment of a human corpse and tampering with physical evidence. Henriquez is additionally charged with aggravated criminal contempt.
