As NYPD Remembers PO Eddie Byrne, Killers Look for Parole in November

By Michael V. Cusenza City cops, their extended family, and a grateful Gotham gathered early last Wednesday morning at an infamous Jamaica intersection to mark the 32nd anniversary of Police Officer Eddie Byrne’s sacrifice.

“Gang-ordered, the execution stunned our city and our nation, changing the course of American policing,” Police Commissioner Dermot Shea noted. “He may be

gone, but his legacy will never be forgotten.”

While they honored Byrne and the brief life he led, his four killers, who have sat in prison since being rounded up by detectives less than a week after Byrne’s assassination, look forward to November, when they’ll get yet another opportunity to convince the Parole Board that they should be released.

“By granting parole to the cop killers who assassinated NYPD Officer Eddie Byrne in 1988, the Parole Board is telling law enforcement officers that their lives don’t count, and the lives of these convicted murderers matter more. They don’t!” said former City Police Commissioner Bill Bratton.

In the early morning hours of Feb. 26, 1988, Eddie Byrne gave up everything for this borough, this city, this country. That Friday, Eddie Byrne made the kind of onceevery-millennium sacrifice that you might only have read about in comic books.

That sacrifice certainly changed the city he loved.

Byrne, a rookie cop just seven months out of the academy and assigned to the 103rd Precinct, was summarily executed on Feb. 26, 1988, as he sat in his marked radio motor patrol car at 107th Avenue and In-

wood Street in Jamaica, guarding the home of a critical witness in a major drug case.

The four men that were convicted of the killing—Philip Copeland, Todd Scott, Scott Cobb, and David McClary—were members of a drug gang that had been instructed by Howard “Pappy” Mason to slay a City cop. At approximately 3:30 a.m., one of the men knocked on the passenger-side

window of Byrne’s car to distract him as McClary opened fire just outside the driver’s side window. Byrne was shot five times in the head.

He was 22 years old.

Copeland, Scott, Cobb, and McClary were sentenced to 25 years to life in prison in 1989. Each has been denied parole several times.

City Launches Campaign to End Idling

By Forum Staff The City has launched a new anti-idling advertising and publicity campaign, part of a larger antiidling initiative aimed at boosting public awareness on the harmful effects of idling, expanding enforcement of anti-idling laws, and encouraging individuals to file citizen complaints, Mayor Bill de Blasio, joined by rocker and environmentalist Billy Idol, announced Thursday.

“We’re sending a loud message with a ‘Rebel Yell’: Turn off your engines or pay up,” Hizzoner said with a smile on the steps of City Hall.

According to the administration, the million-dollar ad campaign launched throughout the five boroughs and features Billy Idol and his message “Billy Never Idles, Neither Should You. Shut your engine off.” The effort includes 12 high-profile billboard locations, gas station TV, radio, and multiple social media platforms (hashtag #billyneveridles), as well as LinkNYC and NYC TaxiTV, exposure and placement on City fleet vehicles equipped with anti-idling and emission con-

“Like most New Yorkers, I’m troubled when I see cars and trucks sitting idle while polluting our neighborhoods,” Idol added.

“New Yorkers are some of the most hardworking, passionate people in the world and I hope they will join me in turning off their engines.”

The City will also be adding seven air and noise inspectors to the Department of Environmen-

tal Protection to help process the increased complaints. The inspectors will focus on verifying and compiling citizen complaint filings sent to the Office of Administrative Trials and Hearings and help increase inspections of priority zones identified by 311.

This builds on the efforts of Local Law 58 of 2018, sponsored by Councilwoman Helen Rosenthal (D-Manhattan), which expanded the citizen enforcement program.

The eight priority zones identified thus far are Roosevelt Avenue, Flushing, Chinatown, Port Authority, World Trade Center, Fulton Street, Richmond Terrace, and Commercial Fordham Road.

These zones will see an expansion of NYPD Traffic Enforcement Agents to educate drivers on the City’s laws surrounding idling.

These efforts will be overseen by an interagency task force comprised of individuals from the

NYPD, Department of Environmental Protection, Department of Sanitation, and Department of Transportation. The task force will convene for the first time in the coming weeks to discuss further tactics to curb idling pollution.

According to the City, every year, motor vehicles contribute approximately 11 percent of the local fine particulate matter and 28 percent of the nitrogen oxide emissions. High levels of fine particulate matter, nitrogen dioxide, and nitric oxide continue to be observed in areas of high-traffic density, building density, and industrial areas, including Western Queens, South Bronx, and Northern Brooklyn. These pollutants have been linked to adverse health outcomes, including an exacerbation of cardiovascular and respiratory disease.

“Every New Yorker deserves to breathe clean air,” NYC Chief Climate Policy Advisor Daniel Zarrilli said. “That’s why we are launching a new campaign to reduce idling, a zero-cost way to save money, cut down on the carbon pollution that causes climate change, and improve air quality all over the city.”

By Michael V. Cusenza A stubborn brush fire in Spring Creek Park in Howard Beach shut down the Cross Bay Veterans Memorial Bridge and snarled area traffic for several hours late Sunday afternoon, according to City officials and eyewitness accounts.

City fire crews responded to 165th Avenue and 84th Street after receiving the initial calls around 3 p.m. of a blaze in the federal green space, according to FDNY officials. A second alarm was quickly trans-

mitted, and Fire Department Marine units were requested on scene. Though Bravest were still putting out additional small pockets of flames, the fire was deemed under control shortly after 5 p.m.

There were no reports of injuries or evacuations.

Since smoke-eaters doused the blaze in part from the bridge, City Sanitation crews were dispatched for de-icing purposes, according to the Office of Emergency Management.

Brush fires are not uncommon in the area. In March 2013, firefighters battled

another two-alarm blaze, this time near the intersection of 159th Avenue and 78th Street, and made a grisly discovery after the vexing flames were finally extinguished.

The bodies of two men, fully clothed and both bound and gagged were found lying face down in Spring Creek Park near the Belt Parkway. Police identified the victims as Rudy Superville, 22, and Gary Lopez, 25, both of Brooklyn.

one area resident told The Forum. “But to find bodies is something else. That’s enough to shake anybody up.”

And in March 2014, more than 100 Bravest from 25 units battled a massive brush blaze in the park.

According to the FDNY, City firefighters are trained in fighting wildfires in other parts of the country; and the City has a group—known as an Incident Management Team—specifically designated to respond to the infernos that can quickly spiral out of control.

State Senate Passes Legislation for Veterans and Active Duty Military Personnel

By Forum Staff The State Senate recently approved six pieces of legislation supporting New York veterans and active duty military personnel, Sen. Joe Addabbo, Jr. (D-Howard Beach) announced Monday.

The Outdoor Rx Act, co-sponsored by Addabbo, requires the Division of Veterans’ Services to work with other State offices to review issues facing veterans and their abilities to access state parks, lands, and facilities. Outdoor-based therapeutic programs have been effective for people suffering with posttraumatic stress disorder and substance use disorder. The Outdoor Rx Act will be the first step in the progress of how New York can better address the needs of those veterans who are trying to readjust back to the civilian life by being outside.

After unanimously passing the Senate, the Outdoor Rx Act was returned to the Assembly where it already received approval on Feb. 13.

A second bill co-sponsored by Addabbo, a long-time member of the Senate Veterans, Homeland Security and Military Affairs Committee, provides an increase of the Alternative Veterans Exemption for a household with two qualifying veterans.

A household with two veterans who served during wartime would receive an exemption up to 22.5 percent of the assessed value of the property with an additional 15 percent if both veterans served in a combat zone. Each county must still opt in to grant this alternative exemption. This proposed law properly recognizes and rewards all veterans who have served their

New York systems to assist veterans in resume building and career searching. It will provide veterans with the tools to translate their military experiences and skills into a resume, and supportive employment placement services.

Veteran Civil Service Credit: Allows anyone who has served in the military to receive preferences and additional credits on competitive examinations for civil service appointments. Currently, the credit is only available to veterans who served during time of war.

Tax Exemptions for Property Owners: Authorizes municipalities to offer real property tax exemption for residential property owned by active duty military personnel.

Establishes Military Opportunities Day: proposes Nov. 1 of each year to be Military Opportunities Day, to show support and encouragement of military service recruiters and those who seek to enlist in military service.

Ulrich’s office will collect donations for two food pantries at St. Mary Gate of Heaven Roman Catholic Church in Ozone Park, as well as St. Camillus-St. Virgilius Roman Catholic Church in Rockaway and Broad Channel respectively.

The Rev. Carlos Velasquez, pastor of St. Mary’s, and the Rev. Richard Ahlemeyer, pastor of St. Camillus, provided Ulrich with a list of food items that are needed at the churches’ pantries. Queens gets Shortchanged: BP

“While Queens has long managed to do more with less, it’s time for some overdue parity and a fairer share,” Acting Queens Borough President Sharon Lee said.

By Michael V. Cusenza Call it “Third-Borough Syndrome” or “Outer-Borough Angst.” Regardless—call it like it is: Queens, the biggest of all five boroughs, continues to get shortchanged.

That was the message in Acting Borough President Sharon Lee’s recent letter to Mayor Bill de Blasio, the City Council, and the Office of Management and Budget, that accompanied the Queens Borough Board’s official response to the Mayor’s Fiscal Year 2021 Preliminary Budget, as voted on by the board during its Feb. 24 meeting.

The missive and budget recommendations highlighted substantial resource disparities, particularly for the borough’s schools, seniors, and hospitals.

“Compared to the rest of the City, Queens schoolkids are the least funded per pupil, our elders are the least funded per capita, and our hospitals are the most under-bedded,” the borough president said.

“While Queens has long managed to do more with less, it’s time for some overdue parity and a fairer share.”

Here is Lee’s letter in its entirety: “Queens—the Borough of Families— is the largest borough in the City of New York, and home to 2.34 million New Yorkers. While the needs are diverse and evergrowing, many of these very needs are persistently underfunded and underserved, with troubling disparities relative to the other four boroughs.

“Citywide, Queens schools remain the most overcrowded and underfunded.

Of the City’s entire public school student population, nearly a third is enrolled in Queens schools, yet our kids are terribly shortchanged by receiving the least amount of per-pupil spending from the

City than any other borough.

“Queens elders are also deeply shortchanged. The disparity is particularly sharp when we have nearly double the senior population of another borough, yet only half the City’s per capita spending compared to that same borough. Nearly a third of the City’s seniors reside in Queens, yet our elders receive the least amount of per capita spending from the City than any other.

“Queens hospitals are under-bedded and overburdened, and any Medicaid cost shifts to the City may have a big impact on Queens. Our two public hospitals, Elmhurst Hospital Center and Queens Hospital Center, have done a remarkable job of enhancing services and public confidence in their care. The borough as a whole, however, currently has only nine acute care hospitals serving 2.34 million residents, and the closures of four hospitals since 2008 have further strained access to healthcare.

With a mere 1.66 hospital beds per 1,000 residents, Queens is by far the most underbedded borough in the City.

“Pursuant to Section 241 of the New York City Charter, the Queens Borough Board respectfully submits its response to the Mayor’s Fiscal Year 2021 Preliminary Budget. In our identified budget and funding priorities, Queens requests some long overdue parity and a fairer share.”

Lee noted that the budget priorities were developed largely from input received on Jan. 29 at the Borough Board’s Public Hearing on Budget Priorities. While a tendency of basic human nature is to favor those from whom we might profit the most, the Bible calls us to repent of such an attitude because it reflects the values of this status-conscious present world and not those of heaven.

Revealing the favoritism of a reallife church, James, the brother of the Lord, describes in the second chapter of his letter, a worship service attended by two men who are a stark contrast to one another in appearance. The first man arrives wearing a flashy gold ring and luxurious clothing. He is given a prominent seat directly in front of the speaker. The second, whose garment is so filthy it is obviously the only one he owns, is told to further humiliate himself by sitting at a lowly position beside the usher’s footstool.

God levels a searing condemnation against this congregation, “You have become judges with evil thoughts.” He further warns, “Judgment is without mercy to the one who has shown no mercy.”

When we attempt to measure the value of a human soul based merely on external appearances, we not only usurp God’s role as Judge, we also fail miserably in the process.

Our human love prefers one person over another based upon differences such as age, political outlook, or ethnic background. God’s love is based upon how everyone is the same, each a soul created in His own image for whom Christ died.

God so loved the whole world that He gave His one and only Son to die so that whoever believes in Him would not perish but have everlasting life. The group is level at the foot of the Cross.

If God doesn’t play favorites, neither should we.

EDITORIAL Never Forget His Sacrifice In our own little way, The Forum has pledged to never forget the sacrifices of hero cop Eddie Byrne and his family by running a story about the monumental event each and every February.

Hundreds of cops—both retired and active duty—gather at the site of Byrne’s murder, the corner of Inwood Street and 107th Avenue in Jamaica, each year on Feb. 26. And they’re never alone. Borough civic leaders, elected officials, clergy, community members, and firefighters have made that solemn promise to never forget.

A member of the NYPD for only seven months, Byrne was ambushed, shot and killed while he sat in his marked patrol car outside the house of a witness in a drug case in the early morning hours of Feb. 26, 1988.

The four men that were convicted of the assassination were members of a drug gang that had been instructed to kill a police officer. ing job and there can be no greater tribute to Eddie than the drive to fight down crime,” Byrne’s brother, retired Deputy Commissioner Lawrence Byrne, said to his fellow Finest on Feb. 26, 2017.

While it is critically important that we never forget what Eddie and his family have given to our beloved city, there is more than one way to contribute to his memory.

According to the Police Benevolent As-

sociation of the City of New York, Eddie’s assassins are once again up for parole in November. They have been denied release several times.

However, in this new, distinctly antipolice era, another round of “No’s” from the State Parole Board is not exactly a slam dunk. For example, cold-blooded multiple cop-killer Herman Bell, 70, was granted parole on March 14, 2018—his eighth at-

tempt. As we have written before, Bell forfeited his natural right to freedom on May 21, 1971. On that day, Bell and two fellow cowards lured City Police Officers Joseph Piagentini and Waverly Jones to their deaths. As the cops were returning to their squad car in Harlem, the three proud Black Liberation Army soldiers pumped bullet after bullet into their backs.

Piagentini was shot nearly two-dozen times, with the final round coming from the hero’s own department-issue service revolver as he begged for his life.

The Parole Board’s decision to free Herman Bell has to go down as one of the most heinous miscarriages of justice in the history of our beloved state. Because on May 21, 1971, Herman Bell consciously gave up his right to breathe free. There should be no mitigating factors or loopholes that he could take advantage of in order to one day find himself living among the civilized.

As Coronavirus Cases Emerge in Empire State, Officials Update Residents on Efforts to Tackle It

Six people across the Empire State are infected with the China-born pathogen, Gov. Andrew Cuomo confirmed Wednesday as fellow elected officials sought to update residents, tamp down outbreak anxieties, and lend a helping hand to small businesses that have been impacted by the fallout from the swiftly spreading sickness.

On Monday, Mayor Bill de Blasio convened a tabletop exercise with City emergency response teams. Heads of all major City agencies attended to run through scenarios related to the coronavirus.

“We don’t have a timeline for this crisis. I think people should assume it will be with us for months and we’re going to be in a high state of readiness as long as it is here,” de Blasio said after the exercise. “But what we do know for sure is that those basic precautions really, really matter. It’s stunning that we have a global health care crisis and the best way to address it individually is to wash your hands, to use hand sanitizer, to cover your mouth when you cough and sneeze—those basics really, really matter here; and to be quick to come forward if you have symptoms. And look, right now, that means particularly if you have a nexus to travel to the countries that have been most affected, whether that means you or someone you’ve been in close contact with who has been in one of those countries recently. But we know community spread is likely, so even if you don’t have that nexus, but you have the symptoms,

it’s important to get to health care right away. We’d rather have many people quickly find out they do not have coronavirus than people holding back who might have it and not getting the health care they need and maximizing the chance of a dangerous spread.”

PAC, introduced legislation aimed at assisting small businesses that suffer economic harm from the coronavirus outbreak.

According to the congresswomen, much of the recent slowing of the economy is linked to the coronavirus, which has weakened demand in travel and tourism.

Besides the decline in foot traffic for many retailers and restaurants, particularly those in Chinese communities, small firms have experienced challenges related to their supply chains. Companies sourcing products and services from China have had delays or complete cancellations of orders, resulting in lower profits for the company. Besides these challenges, small firms must start the process of preparing their companies for the potential to have employees become infected and re-

main home or telework. In many instances, a small employer may be unable to absorb the additional workforce reductions without a coinciding loss in productivity.

Under the “Small Business Relief from Communicable Disease Induced Economic Hardship Act,” small businesses would be able to access Economic Injury Disaster Loans of up $2 million to help meet financial obligations and operating expenses, which would otherwise have been met if it were not for the virus’ spread, according to Meng, Velázquez, and Chu. The bill specifies that the loans would be interest free. Companies that are major employers could be potentially eligible for larger loans.

“Small businesses are the backbone of our economy in Queens and throughout New York City,” Meng said. “They enhance our neighborhoods, bring investment and innovation to local communities, and provide jobs to area residents. But concerns about the coronavirus have hit many small businesses hard. In fact, I have heard from many Asian American-owned small business owners in my district that they are severely struggling. We cannot let them suffer. Government must be a strong partner in helping small businesses succeed and we must not abandon them in their time of need. I call on all my colleagues to immediately pass this legislation so that our entrepreneurs and small businesses can get back on track. When small businesses succeed, America succeeds!”

Top 10 Consumer Frauds of 2019

By Forum Staff For the 14th consecutive year, internetrelated complaints emerged as the No. 1 complaint among New York residents, State Attorney General Tish James announced on Monday as she released the list of top 10 consumer fraud complaints received by her office in 2019.

With 4,436 complaints, the internetrelated category—covering a range of issues, including internet services and service providers, data privacy and security, digital media, data breaches, and frauds through internet manipulation—far outpaced the rest of the pack. Consumer related service complaints were second on the list with 2,659 complaints, in areas such as banking, immigration services, security systems, technical repairs, and schools. Automobile sales, service, financing, and repairs ranked third with 2,510 complaints, followed by 1,910 landlord/tenant complaints, which included complaints about rent security deposits and tenant harassment. Rounding out the top five were 1,811 utility-related complaints, which included complaints about cable and satellite companies, energy services and suppliers, and wireless phone carriers.

“This top 10 list not only reflects the numerous ways in which consumers were unfortunately defrauded, cheated, and conned in 2019, but should serve as a warning sign for all consumers as we forge ahead into 2020,” James said. “Consumers who have helped identify and report issues to our office have been invaluable partners in our efforts to stop deceptive scams and will be vital in our efforts to stop fraudsters dead in their tracks going forward. My office will continue to use every tool at its disposable to protect New York consumers and enforce our laws.”

The AG also offered consumers some tips they should use to protect themselves and their families in 2020: Internet: you receive a telephone call or a pop-up message from your internet browser indicating that your computer is infected by a virus and that you must call a number immediately, you are likely being targeted by scammers. Microsoft, Dell, Apple, and other companies almost never call or send unsolicited email messages indicating a problem with a computer. Be es-

pecially vigilant if someone asks you to pay in Bitcoin or gift cards. If you have given scammers access to your computer, uninstall any applications the scammer had you install, run antivirus software, and consider reformatting your device. While reformatting a device may be time-consuming and may involve the loss of data, it offers consumers more protection. Apply all security updates as soon as they are available and change your passwords often, James added.

Debt-relief services: Debt relief service scams target consumers by falsely promising to eliminate or otherwise reduce their debt. In some student loan debt relief schemes, the companies impersonate the federal government and promise to help students enroll in government programs that would reduce or forgive their debt.

These companies may charge an up-front fee, which is illegal. Rather than paying for these expensive services, student loan borrowers can obtain these services through their student loan servicer at no charge, the attorney general noted.

CORONAVIRUS REACHES NEW YORK WHAT YOU NEED TO KNOW There are many misconceptions circulating about the current status and the severity of the coronavirus—COVID-19––.

This is especially due to the fact that the first recorded case in New York has been reported and others are certain to follow.

As always the best way to maintain a sense of comfort in difficult situation is to be armed with accurate knowledge. This week NYPD Community Affairs sent out a memo addressing the immediate concerns of New Yorkers with regard to the presence of COVID-19 here in New York.

We hope that in sharing these facts with you, it will help to allay certain fears you may be having and clear up real concerns and those that are unfounded.

NOVEL CORONAVIRUS Coronaviruses are a family of viruses that cause mild illnesses like a clod to more severe illnesses like pneumonia.

Commonly reported symptoms include fever, cough and shortness of breath.

Most people (80%) with COVID-19 will feel like they have a bad cough or the flu. Some will require hospitalization.

Those who are the most risk are elderly and those with other health concerns.

WHAT SHOULD NEW YORKERS DO? Go about your daily lives but take certain precautions: Get the flu shot–it’s not too late. Although the shot will not prevent COVID-19, it will help prevent the flu, which has similar symptoms to this coronavirus.

Cover your coughs and sneezes with a tissue of with your sleeve-not with your

hands.

Wash hands often with soap and warm water for at least 20 seconds. Use an alcohol-based sanitizer if soap and water are not available.

Do not touch your eyes, nose or mouth with unwashed hands If you feel sick, stay at home If you have fever, cough and/or shortness of breath, and recently traveled to an area with ongoing spread of coronavirus, or have been in close contact with someone who has recently traveled to any of those areas, go to your doctor.

If you have these symptoms but no travel history, stay at home and call your doctor If you need connection to a health care provide, call 311 Hospital staff will not ask about immigration status. Receiving health care is not a public benefit identified by the public charge test.

Borough Hall Opens 2020 Census Resource Assistance Center

By Forum Staff The 2020 Census Resource Assistance Center at Queens Borough Hall will open to the public beginning Thursday, March 5, offering residents the ability to access census outreach materials, ask questions of trained volunteers, and apply for 2020 Census-related jobs, Acting Borough President Sharon Lee announced Monday.

From March 5 through July 31, the Census Resource Assistance Center will be open on Tuesdays and Thursdays from 9 a.m. to 6 p.m. On hand to assist visitors to the center will be BP Office staff and trained volunteers from Lee’s Queens Complete Count Committee, a group of more than 100 community leaders and groups tasked with developing outreach strategies and maximizing participation in the 2020 Census, according to the borough president.

Borough Hall is located at 120-55 Queens Blvd., Kew Gardens.

Electronic devices will be available at the center for residents to fill out the nine-question census form online upon its launch on March 12, while U.S. Census Bureau resources in more than a dozen languages will be available for visitors to take home and distribute to family, friends, and neighbors. No appointments are necessary

The census determines the borough’s representation in the U.S. House of Representatives, as well as how much federal funding Queens receives for schools, roads and bridges, health services and more.

To prevent a repeat of the substantial undercounts in various Queens neighborhoods during the 2010 Census—which dubiously reported the borough’s population rose by only 1,300 people over the prior

decade—then-Borough President Melinda Katz first hosted a Census Town Hall at Borough Hall in November 2018 to propel public discourse and engagement for the 2020 Census.

Additionally, Katz signed an amicus brief sent to the U.S. Supreme Court, along with nearly 200 other elected officials from around the country, opposing the federal government’s attempt to include a discriminatory citizenship question on the 2020 Census.

Lee pointed out that the controversial citizenship question will not be on the 2020 Census, following a decision by the Supreme Court last year to block such a question from being included. Documentation status will have no bearing on any resident’s ability to fully complete and submit a census questionnaire.

“It’s all hands on deck for the 2020 Census,” Lee added. “We must ensure every single Queens resident—of every age and regardless of documentation status— is counted. When we are not counted, we are rendered invisible and irrelevant for our fair share of federal representation and funding. An undercount is something the Borough of Families simply cannot afford.

The future of our county, city, and state depend on a full and accurate 2020 Census count.”

By Forum Staff The total amount of flu cases in New York this season has eclipsed the previous record number of seasonal cases since the State Department of Health began tracking them during the 1998-1999 season, Gov. Andrew Cuomo announced Thursday.

The latest influenza surveillance report for the week ending Feb. 22 shows 131,604 laboratory-confirmed cases so far this season. Previously, the most lab-confirmed cases reported during a single flu season was 128,892 in 2017-2018.

Cuomo also noted that although seasonal flu activity continues to be widespread across the Empire State, for the second consecutive week, the number of laboratory-confirmed influenza cases and hospitalizations decreased. Earlier in February, 10,520 lab-confirmed cases of influenza had been reported and 1,454 people had been hospitalized with influenza. As indicated in the influenza surveillance report, there were three new flu-associated pediatric deaths, for a total of nine flu-associated pediatric deaths this season. Two of the new three pediatric deaths occurred in the five boroughs, while the other was a

resident of the North Country region.

“While I am encouraged to see yet another decrease in the number of flu cases across the state, this year’s flu season has been grueling and New Yorkers must remain vigilant against the spread of the virus,” Cuomo said. “If you haven’t already been vaccinated it’s not too late. I urge you to get a vaccine and to please stay home if you are sick to avoid spreading the illness.”

By Forum Staff A 48-year-old social studies teacher at an elementary school in Oakland Gardens, has been charged with sexual abuse and endangering the welfare of a child for allegedly physically directing a child with autism to touch his genitals and buttocks in class on Wednesday, February 26, 2020.

The incident was captured on video by another individual in the classroom at the time. “The victim in this case is a defenseless child with autism. The defendant - a trusted teacher in our school system - is alleged to have taken advantage of both his position and the little girl’s innocence,” said District Attorney Melinda Katz.

Gaffey on a complaint charging him with sexual abuse in the first degree and endangering the welfare of a child. Judge Gaffey set bail at $5,000 and ordered the defendant to return to court this week. If convicted, Scheibel faces up to seven years in prison.

According to the charges, between 11:39 a.m. and 11:45 a.m., last Wednesday, Scheibel was observed by an eyewitness sitting at a table with a 9-year-old female student. When the defendant placed both his hands below the table the eyewitness began video recording him under the table. The video allegedly depicts defendant Scheibel pull the child’s hand under the table and onto his groin. The video further shows the defendant allegedly point towards his groin and the child puts her hand in the defendant’s crotch for a period of time.
