By Michael V. Cusenza Ozone Park residents were especially rattled over the past seven days as two horrific crimes called for vigilance throughout the proud South Queens community.

Last Wednesday, the body of a woman from upstate Troy, N.Y. who had been reported missing back in November, was discovered inside the trunk of an abandoned car parked on Lefferts Boulevard near 150th Avenue, according to police and published reports.

Smothers was last seen at a bowling alley in Woodside, according to police.

The City Medical Examiner is still efforting the cause of death. The investigation is ongoing.

In a separate incident, five men early Tuesday morning burst into a house on 109th Street and left the couple who were home zip-tied in the basement while the armed crew, who posed as City cops to gain access, ransacked the residence.

Ring doorbell security footage “of their getaway shows two of the suspects walking by a fence as the minivan slowly pulls up, eventually coming to a full stop in the street. The pair appears to get in, as well as two more people who came from the other side of the street,” according to NBC 4 NY. Several publish stories noted that the crew of crooks made off with more than $30,000 in cash and jewelry.

That investigation is ongoing as well.

City Honors Lives of New Yorkers Lost to COVID-19

By Michael V. Cusenza On Sunday, the one-year anniversary of the first known COVID-19 death in NYC, Mayor Bill de Blasio and New Yorkers from across the five boroughs honored the more than 30,000 Big Apple neighbors lost during the pandemic.

“Shoulder to shoulder, one for another, we will bring our city back together,” de Blasio said. “The people walking around today, they carry the hearts of those we’ve lost with them. The moms, the dads, the grandparents, all that was great about them, all that was warm, their souls continue on in their sons and daughters and then their grandchildren. And so, it is to all of us to do something very simple, very beautiful, very powerful. It is time to make them proud.”

Despite Increases in Spending for homelessness prevention, Shelter Population Remains High: Report

By Forum Staff Despite extraordinary increases in spending for homelessness prevention and permanent housing, the homeless population in shelter has remained stubbornly high, resulting in rising costs for shelter and associated homeless services to meet the legal mandate to provide shelter, according to a new report released Wednesday by City Comptroller Scott Stringer.

This year’s watch list report on homelessness services shows: Total spending for homeless services grew by 138 percent between fiscal years 2014 and 2020, rising to a total of $3.5 billion.

In FY 2020, spending on Family Shelter operations fell for the first time, by $24 million or 2.1 percent. Overall spending grew by 8.7 percent, or $284 million, driven in large part by pandemic-related spending.

Since this time two years ago, the number of children in shelter has declined by 5,358 – a 24 percent drop. Most of this reduction occurred during the pandemic period.

The single adult population has continued its steady growth. There are now 8,208 more single adults in shelter than there were in March 2014, an 80 percent increase.

“Our city was already facing a mounting homelessness crisis before the pandemic hit, and COVID-19 has only exacerbated these challenges,” Comptroller Stringer said.

Most categories of homeless residents saw steep declines in shelter entrances in the first six months of the pandemic. Several factors likely explain the drop, including the eviction moratorium in place during the pandemic, federal assistance including unemployment benefits, and a fear of contagion.

The number of families with children

entering shelter, which typically peaks in the fall at around 1,100, was roughly half that number in October of 2020.

The falloff was even more pronounced among Adult Families, declining from an average of over 100 per month, to under 50.

Single Adult shelter entrants also fell, but less dramatically, to 1,470 in October 2020.

The report also highlighted indica-

tors that could provide the public with useful information, but are not currently reported or only partially reported.

Stringer noted that he has urged the de Blasio administration to expand supportive housing that combines affordability with social services and is desperately needed to ensure homeless individuals and families can transition to independent living. Stringer also called on the City to direct housing capital investment toward the creation of affordable housing within the reach of extremely low and very lowincome households.

“Our city was already facing a mounting homelessness crisis before the pandemic hit, and COVID-19 has only exacerbated these challenges,” Stringer said.

“More New Yorkers are struggling and we need to meet this crisis with solutions that work. The City is spending more money than ever before on services that are supposed to help people overcome and prevent homelessness, but we are not seeing the reductions in homelessness that we should. We simply aren’t creating enough affordable and supportive housing to make a long-term difference in the lives of New Yorkers in need. We must ensure that every single dollar is being spent effectively and actually helping New Yorkers experiencing homelessness.”

Mazie Hirono (D-HI) recently announced their plan to reintroduce the COVID-19 Hate Crimes Act, which seeks to address the ongoing hate and violence targeted toward Asian Americans and Pacific Islanders by providing greater assistance with law enforcement response to COVID-19 hate crimes and creating a position at the Department of Justice to facilitate expedited review of such cases.

Specifically, the bill would: • Designate an officer or employee of the Justice Department to facilitate expedited review of COVID-19 hate crimes reported to federal, state, and/or local law enforcement; • Issue guidance for state and local law enforcement agencies to: • establish online reporting of hate crimes or incidents, and to have online reporting available in multiple languages; • expand culturally competent and linguistically appropriate public education

campaigns, and collection of data and public reporting of hate crimes; and • Issue guidance describing best practices to mitigate racially discriminatory language in describing the COVID–19 pandemic, in coordination with the Secretary of Health and Human Services and the COVID–19 Health Equity Task Force and community-based organizations.

“The ongoing anti-Asian hate crimes and incidents, especially against our elderly Asian Americans, are absolutely horrific. I am honored to introduce the COVID-19 Hate Crimes Act with Senator Hirono to address this disgusting pattern of hate,” Meng said. “Before this pandemic started, I urged everyone—including elected officials—to not blame Asian Americans for the virus.

My words were not heeded. The former president and his congressional Republican enablers trafficked racist, bigoted terms to describe COVID-19. In doing so, their language stoked people’s fears and created an atmosphere of intolerance and violence, which persists even today. Since the beginning of the pandemic there has been nearly 3,000 reported incidents of physical, verbal,

3. Take care of your refills before you run out HBM needs to be taken without skipping a dosage-you can’t skip a day or cut it in half to last longer—that’s not the way it works.

4. If you are not feeling right and think you are having adverse effects from your meds, talk to your pharmacist and/or physician at once. Your dosage may very well have to be adjusted. This is a common occurrence with HBM. DO NOT STOP YOUR MEDICATION ON YOUR OWN! 5. HBP meds may have interactions with OTC preparations. Many have warnings about not taking them with HBP meds.

and online attacks against Asian Americans.

Even in my own district in Queens, Asian Americans have been attacked. To combat those acts, we need DOJ to prioritize addressing these heinous acts by designating a point person for these COVID-19 related hate crimes; make it easier for victims to report crimes committed against them; and expand public education campaigns to address COVID-19 hate crimes and incidents.

This must end and it is why we are working to ensure our justice system has the people and resources to effectively account for and mitigate anti-Asian hate crimes. I look for-

ward to this bill becoming law.”

Hirono added, “We’ve seen the horrifying consequences of racist language as AAPI communities across our country experience hate crimes and violence related to the pandemic. The COVID-19 Hate Crimes Act addresses the surge in violence against AAPI communities by dedicating an official at the Department of Justice to expeditiously review hate crimes reported to law enforcement. The bill also provides resources for communities to come together and fight intolerance and hate. This is no less than victims deserve.”

Cuomo Gotta Go: Richards Queens Borough President Donovan Richards on Saturday issued a joint statement with Manhattan Borough President Gale Brewer in response to allegations surrounding Gov. Andrew Cuomo.

“New York needs a leader at this critical time during our State’s history—a leader with integrity and a leader in which all New Yorkers have confidence,” they wrote. “While we support the ongoing investigations, we believe that the experiences recounted by the now seven women who have come forward warrant a call for the governor’s resigna-

tion. We cannot condone this behavior and don’t believe that government can work effectively amid, nor should it try to work around, such a serious situation.

“All survivors need our support and deserve justice, and the people of Queens and Manhattan support them every step of the way,” Richards and Brewer concluded.

“Gov. Cuomo must resign and be held accountable as he has due process and the independent investigation due to his behavior continues. New Yorkers deserve better.”

Fifth Indicted Defendant Apprehended and Charged in JFK Luxury Goods Heist

By Forum Staff A fifth indicted defendant has been apprehended and arraigned in Queens Supreme Court for his role in assisting the crew that allegedly committed two brazen heists, swiping more than $6 million worth of designer merchandise from John F. Kennedy International Airport last year, Queens District Attorney Melinda Katz announced Thursday.

Oscar Asencio, 32, has been arraigned on an indictment charging him with criminal possession of stolen property in the first degree and conspiracy in the fourth degree.

Asencio was ordered remanded and his next court date set for March 25.

According to the charges, a crew of men – some of them former airport workers—used their insider knowledge of how shipments are picked up at the airport to gain access to a cargo importer in January and May of 2020. A co-defendant

went to the receiving office for the importer and used forged documents to gain access to various shipments of designer goods.

According to the charges, more than $800,000 in Prada merchandise was stolen in the first heist. In May, more than $5.3 mil-

lion in Gucci and Chanel products were taken from the importing business.

The DA said that Asencio allegedly helped protect the merchandise that was stolen in May that was subsequently stashed in a nonoperating beauty salon at Guy R. Brewer Boulevard and 147th Avenue in Jamaica. Surveillance video allegedly shows Asencio at the site carrying bags filled with the stolen property in and out of the building. Asencio allegedly also helped sell some of the stolen items out of the stash house.

All but approximately $2.5 million worth of merchandise was sold. There were more than 1,000 Chanel purses, jewelry, sunglasses and accessories and Prada items found inside the empty building.

“On the run since October, this defendant is now in custody and facing very serious charges. The defendant is accused of participating in selling off millions of dollars’ worth of stolen merchandise taken from JFK Airport. Our airports are supposed to be secure for both people and the goods imported into our region,” Katz said. “One of my top priorities is keeping our airports safe for all travelers, as well as imported merchandise— including the much-needed PPE, vaccines and other medical supplies coming into New York.”

If convicted, Asencio faces up to 25 years in prison.

Far Rockaway Rehab Center Social Worker Charged with Stealing Nearly $150K from Patient

By Forum Staff A social worker has been charged with allegedly stealing nearly $150,000 from an elderly patient at a Far Rockaway rehab center where she worked as the Director of Social Services in 2019, Queens District Attorney Melinda Katz announced Friday.

Olivia Gordon, 28, was arraigned Thursday night on a complaint charging her with attempted grand larceny in the first degree, grand larceny in the second degree, criminal possession of stolen property in the second degree, identity theft in the first degree, and unlawful possession of personal identification information in the third degree. Gordon has been ordered to return to court on May 4.

According to the charges, between March and July of 2019, Gordon was a social worker at a rehabilitation and health care center in Far Rockaway. The 90-year-old woman was a patient at that time—she had been transferred there from a hospital following a fall in her Brooklyn home. As part of the defendant’s job duties, she had access to the complainant’s personal information, including bank account statements and an annuity.

allegedly began siphoning money from the elderly woman’s bank account. Beginning in May 2019, the defendant allegedly withdrew $12,996 from the patient’s account. Other withdrawals followed for $2,748; $21,171 and the largest one-time withdrawal of $106,148.

The DA said, according to charges, Gordon’s Bank of America account received a

credit in the sum of $12,996. Gordon’s Capital One Visa account was credited $2,748, and her Discover card was paid $21,171. An examination of records of the defendant’s federal student loan revealed a single lump sum payment of $106,148, which paid off Gordon’s student loan account on or about June 20, 2019.

The company holding an annuity for the elderly woman received a fax on May 7, 2019 of a beneficiary form from Gordon along with a handwritten note. The defendant allegedly told the financial institution that she was the “caretaker/pseudo grandchild” of the 90-year-old and a couple of days later sent a second fax with a note requesting a distribution of cash. The company did not disburse any money because they were unable to communicate directly with the elderly woman to verify the request.

“Instead of doing her job and looking out for this elderly woman’s best interest, this social worker allegedly let greed guide her actions. Not only is this defendant accused of making huge cash withdrawals from the 90-year-old’s bank account, she also set things in motion to take control of a million-dollar annuity,” Katz said. “This kind of manipulation and deceit is not only immoral but criminal, and the defendant now faces very serious charges.”

Gordon faces up to 15 years in prison if convicted.

By Forum Staff Three Queens tax preparers have been charged with allegedly knowingly including false information on tax returns that lowered the tax burden for clients while also cheating the City and State out of thousands of dollars, Queens District Attorney Melinda Katz announced Thursday.

Yachun Lin, 53, has been arraigned on a complaint charging her with criminal tax fraud in the fifth degree, offering a false instrument for filing in the first degree, attempted grand larceny in the third and fourth degree, and forgery in the second degree. The defendant was ordered to return to court on April 27.

According to the charges, on March 22, 2019, an undercover investigator met with Lin at ETS Tax Services on Main Street in Flushing. Identifying himself with the fictitious name “Alex Zhukov,” the undercover agent provided Lin with a Social Security number, a Brooklyn home address, and W-2 forms. He told the defendant that he needed tax returns completed for 2017 and 2018.

tax return for 2016 and stated he owed so much money because his employer did not withhold City taxes from his paycheck. The defendant allegedly suggested the man use the address of a friend or family member who lives outside of the five boroughs— stating this would save him $2,000 per year.

The undercover investigator came up with a Westchester County address and Lin allegedly filled out his tax returns using the address she knew was not his residence. She

also allegedly forged her client’s signature on the return—and left the space for a professional tax preparer’s information blank.

The bogus information on the tax return, according to the charges, allowed the “client” to hold on to $2,156 for 2016 and $2,319 in 2017.

If convicted, Lin faces up to 18 years in prison.

Maria Isabel Chabur, 49, and her husband Nayib Chabur, 62, have been ar-

raigned on a complaint charging them with criminal tax fraud in the fifth degree, offering a false instrument for filing in the first degree, attempted petit larceny, conspiracy in the fifth degree, and forgery in the second degree. The pair has been ordered to return to court on April 19.

According to the charges in the Chaburs’ case, an undercover investigator on March 27, 2019, entered La Oficina En Astoria on 69th Street in Woodside and asked for assistance filing a tax return for 2018.

This investigator, who called herself “Carmen Guzman”—also a fictitious name— provided a Social Security number, W-2 form and a tax return for the previous year.

DA Katz said that the Chaburs filed a tax return on behalf of Guzman, allegedly including a $5,500 IRA deduction that was not true and not even discussed with the filer. Maria Isabel Chabur is also accused of signing for her “client” and leaving the required space for professional tax preparer signature blank. The alleged scheme only saved Guzman just under $500.

If convicted, the Chaburs each face up to 9 years in prison.

Flushing Couple Indicted for Allegedly Forcing Korean Immigrants into Prostitution

By Forum Staff A Flushing couple has been indicted for allegedly bringing two female victims from Korea and coercing them to have sex with strangers for cash, Queens District Attorney Melinda Katz announced Thursday.

Jung Ja Ornstein, 62, and Eric Ornstein, 49, were both arraigned on an 18-count indictment charging them with sex trafficking, promoting prostitution in the second and third degree, and grand larceny in the second, third and fourth degree.

According to the charges, in 2015, one of the victims read an advertisement in Korea that stated she could make money in America. The victim called the listed phone number and was told she would be working in a bar/restaurant but must pay back $10,000 for the transportation and assistance in obtaining a passport. When the woman arrived at JFK International Airport, she was met

by Jung Ja Ornstein. This defendant took the victim to an address on Steinway Street in Long Island City and informed her that to pay off her bill she would be engaging in prostitution. Jung Ja Ornstein then allegedly took the woman’s passport and gave it to Eric Ornstein.

According to the charges, at that location, the victim had sex with strangers for money.

These customers were arranged by Eric Ornstein. Jung Ja Ornstein allegedly collected the money from the customers, and Eric Ornstein would come to the location regularly to pick up the money from his wife.

In March 2017, the defendants informed the victim that they would be relocating and returned the victim’s passport and left her alone.

“I created the Human Trafficking Bureau in the DA’s Office to combat this very problem,” DA Katz said.

The investigation revealed that another victim responded to a similar advertisement in Korea. This woman met with a man and woman in Korea and they assisted her in obtaining a passport and made travel arrangements for her. The victim was also told that she would have to pay back $10,000 for her travel, but it would be taken out of her earnings. After arriving in the United States, the victim was taken to a bar in Manhattan where her passport was taken from her and she was forced to work. While working at the bar, the victim was only allowed to keep her tips but she had to pay for her room and board. On

tips alone, it was a struggle to also pay the $10,000 due for her travel. After about a year, this victim’s bill was purchased by another female who made the victim work in a massage parlor. Eventually, she was forced to work for the defendants.

The pair took the woman to the Steinway Street location and she, too, was allegedly forced to trade sex for cash. Jung Ja Ornstein again allegedly collected the money from the customers, who were arranged by Eric Ornstein. The victim was only allowed to keep her tips.

worked for the defendants at several different massage parlors and in 2017, the victim was told that her debt was paid and they returned her passport.

Approximately three years later, the Ornsteins found the victim and allegedly informed her that she still had a bill to pay. The victim handed over $8,500 of her savings to the couple.

“I created the Human Trafficking Bureau in the DA’s Office to combat this very problem,” Katz said.

If convicted, the Ornsteins each face up to 25 years in prison.

City Spent More Than $447,000 per Incarcerated Person in FY 2020 as Rates of Violence Rise: Analysis $230,294 in non-DOC costs for each person in custody, including expenses for employee fringe benefits and pensions and health care services provided by other agencies, bringing the full annual cost of incarceration to $447,337 per person.

By Forum Staff New York City spent an average of $447,337 per every incarcerated individual in FY 2020—a 30-percent increase over the previous year—even as rates of fight and assault infractions in City jails rose by 27 percent, according to an analysis recently released by City Comptroller Scott Stringer.

This year’s watch list report on the City Department of Correction highlighted the following data: Budget and Spending The DOC budget declined 7 percent from $1.37 billion in FY 2017 to $1.28 billion in FY 2020 and is forecast to decrease by an additional 11 percent to $1.14 billion in FY 2021.

Uniformed headcount has also fallen, dropping 15 percent from 10,862 in FY 2017 to 9,181 in FY 2020. The City forecasts that the number of correction officers will fall by an additional 23 percent during FY 2021, reaching 7,060 officers by the end of June 2021. However, as of the end of November 2020, headcount was down just 3 percent, to 8,871.

We must reimagine our criminal legal system, dramatically reduce the pretrial population, and invest our taxpayer dollars in the resources and programs—from housing to health care—that prevent incarceration in the first place,” Stringer said.

Pol Touts Expanded Obamacare Benefits, Premium Savings for COBRA Assistance for Newly Unemployed

By Forum Staff As millions of Americans have lost their jobs and employer-based benefits during the COVID-19 pandemic, U.S. Sen. Kirsten Gillibrand (D-N.Y.) is announcing expanded health care benefits for New Yorkers in the recently passed American Rescue Plan and urging New Yorkers to sign up for health care through the New York State of Health Marketplace exchange. The bill includes new premium savings in Consolidated Omnibus Budget Reconciliation Act Assistance to newly unemployed Americans, expands Affordable Care Act and state health insurance exchange benefits, and grants forgiveness to 2020 miscalculations on advance tax credits.

The COBRA provision of the Affordable Care Act and its mirror regulation in NYS allows people who have been laid off from their jobs to continue purchasing their health care plan after their former employer terminates coverage. Until the recent passage of the American Rescue Plan, COBRA premiums were often costly, sometimes costing an individual up to 102 percent of the entire premium cost. Under the recently Senate-passed relief bill, Americans are now eligible for premium savings as the federal government will cover the entire cost of COBRA premiums.

The bill would reduce that premium to zero. Additionally, the ARA would eliminate a “subsidy cliff,” which abruptly stops subsidies for people making

over 400 percent of the poverty level, and instead limits the percentage of income higher earners pay toward their premium to 8.5 percent, resulting in a gradual decrease in the subsidy as income rises.

Additionally, the bill addresses miscalculations that may have occurred at the beginning of 2020 when taxpayers had to estimate their coming year’s income in order to calculate advance tax credit. Due to the rising unemployment rate throughout the pandemic, a “repayment holiday” provision will forgive excess credit received as a result of miscalculated income and will allow people to continue claim-
