State Legislature Strips Cuomo of Emergency Powers

By Michael V. Cusenza The State Legislature on Friday voted in favor of legislation repealing the temporary emergency powers that the Legislature granted to Gov. Andrew Cuomo last year at the start of the COVID-19 pandemic.

The legislation revokes the governor’s authority to issue new directives while allowing those that are now enforced and that pertain to preserving public health to continue under significantly greater legislative oversight. This system restores the pre-existing balance of power, ensures genuine checks and balances even during a state of emergency, and mandates a better flow of information between the governor, the Legislature, and the State’s localities for the remainder of the pandemic, said State Senate Majority Leader Andrea Stewart-Cousins.

“I think everyone understands where we were back in March and where we are now. We certainly see the need for a quick response but also want to move toward a system of increased oversight and review.

The public deserves to have checks and balances,” Stewart-Cousins added. “This legislation creates a system with increased input while at the same time ensuring New Yorkers continue to be protected.”

• Requiring the governor to respond publicly to any comments they received from the Legislature or from local leaders if a directive is extended.

resolution.

“The details in the newest New York Times report, which was released March 4, highlight that Gov. Cuomo’s aides altered a New York State Health Department report on the number of deaths in nursing homes. If these actions are proven true by an independent investigation under the authority of the NYS Attorney General, it would be an egregious abuse of power that affected the lives of thousands of New Yorkers and their families,” State Sen. Joe Addabbo, Jr. (D-Howard Beach) said.

“With New York administering the COVID vaccine, it is time that we strip Gov. Cuomo of the emergency powers that were granted at the start of the pandemic.

That is why I am voting today to support Senate bill S.5357, which will do not only that, but allow for increased oversight and review of future governor’s proposals.”

Community Helps Stop St. John’s Episcopal ‘Micro-Hospital’ Proposal

Roughly a day after news spread that the State Department of Health was looking into turning St. John’s Episcopal Hospital into a 15-bed “micro-hospital,” the agency pumped the brakes on the alleged proposal.

“The Department of Health has been working with the management of St. John’s Episcopal for several years in an effort to achieve improved health outcomes and access in the Far Rockaways. Contrary to published reports, the Department has not recommended nor decided on any of the recent proposals developed that would make changes at St. John’s Episcopal, and thinks it would be premature to do so without further analysis and stakeholder engagement,” DOH said in a statement released Thursday. “The State’s operating support for St. John’s Episcopal has increased by 50 percent since 2019 and totaled approximately $60 million last year. Gov. Cuomo’s Executive Budget will provide at least this level of financial support for St. John’s Episcopal in the upcoming fiscal year so that additional options to provide a sustainable and higher quality healthcare delivery system in the Far Rockaways can be fully explored and shared with the community.

DA Katz Files Joint Motion with Defense Counsel to Vacate Convictions in 1996 Double-Murder Case

By Forum Staff Queens District Attorney Melinda Katz on Friday announced the filing of a joint motion with defense counsel to vacate the convictions of George Bell, Gary Johnson, and Rohan Bolt, who were convicted of the Dec. 21, 1996, murders of Ira “Mike” Epstein and NYPD Police Officer Charles Davis in the course of robbing Epstein’s check cashing business.

Davis lost his life in his efforts to protect Epstein while working off-duty as security for Epstein’s business.

After an exhaustive investigation of these decades-old convictions, the DA’s Conviction Integrity Unit has concluded that trial prosecutors inadvertently failed to disclose records favorable to the defense, Katz said.

These included: Documents indicating that a member of a different gang known as “Speedstick” had implicated himself and other gang members in the robbery and killings at the check cashing store; and Mental health records of a purported accomplice who first implicated the defendants and who testified against two of the defendants at their trials.

volvement of Speedstick gang members in the check cashing robbery and shootings, but the documents were not contained in the defendants’ files and were only discovered by the CIU years later in files pertaining to unrelated prosecutions of Speedstick members.

While the CIU determined that the prosecutors assigned to defendants’ cases

were unaware of these records at the time of the defendants’ trial, under New York Law, even the inadvertent failure to disclose exculpatory evidence requires vacatur of a conviction if there is a “reasonable possibility” that the outcome of the trial would have been different.

“As the chief law enforcement officer of Queens County, I cannot stand behind

these convictions in light of the Brady violations that my Conviction Integrity Unit identified. However, there is at this time insufficient evidence of actual innocence and therefore we are taking this opportunity to re-evaluate and examine the evidence,” Katz said.

The district attorney has assigned Executive Assistant District Attorney Pishoy Yacoub, who has been in charge of Queens DA’s Supreme Court Trial Division and Legal Training since appointed by Katz in January 2020, to lead the continued investigation and any further trial proceedings.

The indictments of the defendants remain pending, but under the unusual facts and circumstances of the case, they have been released on recognizance bond while the DA’s investigation continues.

CIU Director Bryce Benjet said, “These prosecutors did not intentionally mislead the Court, but we cannot ignore the fundamental unfairness in which key exculpatory evidence never came to light during the trial. The constitutional safeguards in our criminal justice system failed here, and the result has deprived everyone involved of the certainty and finality of justice in this case.”

The Conviction Integrity Unit’s investigation has spanned 11 months in which more than 30 witnesses were interviewed, Katz noted.

By Forum Staff Mayor Bill de Blasio on Tuesday announced a set of new citywide zoning actions to bring more grocery stores to local communities, improve accessibility, and support a range of small businesses across the city.

These changes will each start public review this spring and remain on track to be adopted by the end of this year, Hizzoner noted.

The coming new citywide text amendment proposals are: FRESH II In partnership with the City Council, the Department of City Planning will seek to expand the existing Food Retail Expansion to Support Health (FRESH) program, which offers zoning incentives and financial benefits to encourage the creation of convenient, accessible stores that provide fresh fruit, meats and vegetables, and other perishable goods in addition to a full range of grocery products.

The new FRESH proposal aims to bring the program to 11 more community districts – in addition to 19 districts currently in the program – including: • Queens Community Districts 1, 3, 4 and 14 • Bronx Community Districts 8 and 9 • Brooklyn Community Districts 1, 2, 12 and 13 • Staten Island Community District 1 Elevate Transit: Zoning for Accessibility Text Amendment In collaboration with the MTA, City Council, and advocates, the City will expand and improve zoning rules that allow the MTA to leverage private development to add elevators or other station access to New York City Transit, Staten Island Railway, Long Island Rail Road, and Metro-North stations in the city. According to the indictment, an FBI investigation revealed that in 2019, Cincinelli, 37, a domestic violence officer assigned to the 106th Precinct, demanded that her boyfriend, Howard Beach resident John DiRubba, hire a hitman to murder Cincinelli’s estranged husband, Isaiah Carvalho, Jr., and DiRubba’s 14-year-old daughter, who resides in New Jersey.

As of Wednesday afternoon, Feuerstein had not issued an order with the new date.

‘Queens Leads, Queens is Rising’ Richards Delivers First State of the Borough Address

By Michael V. Cusenza Queens Borough President Donovan Richards recently delivered his first State of the Borough address, detailing his administration’s accomplishments over its first 100 days, while also outlining Queens’ path out of the COVID-19 pandemic.

Richards presented his speech, titled “Queens Leads, Queens is Rising,” at the Museum of the Moving Image in Astoria and streamed it live on the borough president’s website and social media channels. The address, according to Richards, centered on rooting Queens’ recovery in true equity for all borough families and combating the existing injustices in healthcare delivery, economic development, transportation services, housing, and environmental policy in The World’s Borough.

These injustices are often exacerbated by the COVID-19 pandemic, Richards added.

“The state of our borough is not where it ought to be, for we have been decimated by the health pandemic, the economic crisis and racial injustices. But these issues do not need to define us,” the borough president said. “We, as a borough, as a people, have an opportunity to choose how we define ourselves. As a borough, we will not stay down. Queens, we will rise.”

Below is a breakdown of initiatives outlined by Richards in his address, including some that have already launched over the course of the Richards administration’s first 100 days: Healthcare Work with city, state and federal partners to greatly expand the network of culturally competent, grassroots COVID-19 testing and vaccination centers, especially in historically underserved communities hardest hit by the pandemic.

Host regional virtual vaccine town halls with health experts to build community trust in the COVID-19 vaccination process.

Advocate for the construction of new hospital facilities in Queens to address the borough’s unacceptable scarcity of hospital beds.

Advocate for the creation of more community-based health centers that offer preventative medicine, limiting the strain on our borough’s already overcrowded emergency rooms.

Economic Development Continue encouraging participation in the $17.5 million Queens Small Business Grant program, launched by Borough President Richards and the NYC Economic Development Corporation (EDC) earlier this year.

Host town halls with the NYC Department of Small Business Services (SBS) to connect Queens businesses with all available tools to help them thrive.

Establish an Ombudsman within the Queens Borough President’s Office to oversee the quality of the borough’s recovery and rebuild.

By Forum Staff U.S. Senator Kirsten Gillibrand (D-N.Y.) recently announced the introduction of the Pandemic Heroes Compensation Act, which would create a new program for all essential workers and personnel who have been injured or impacted by COVID-19.

Modelled after the September 11th Victim Compensation Fund, the new fund would provide compensation to any individuals, or their families, who were deemed essential workers that were required to leave their home to perform services, and became ill or died as a result of COVID-19.

The Pandemic Heroes Compensation Act: • Establishes a compensation fund for all essential workers, personnel, and their families, across all industries, that were required to leave their homes to perform their services and became ill or died as a result of COVID-19; • Supports essential workers affected

by COVID-19 by providing financial assistance to help with medical costs, loss of employment, loss of business, replacement services, and burial costs; • Authorizes appropriated funds as needed for five years with the fund permanently closing one fiscal year after the Special Master determines that no additional claims can be filed; • Creates a new website and office developed and administered by a Special Master to assist in the application process; and • Maximizes compensation for essential

workers and their families by simplifying the application process to get those affected back on their feet.

Family members who share homes with essential workers and became sick through contact with the essential worker would also be eligible to file a claim. The compensation application would allow claimants to provide information regarding the extent of their loss for consideration. Eligible individuals would receive compensation no later than 20 days after approval.

“As we mark one year since the first confirmed COVID-19 case in New York, much work remains to take care of the essential workers who have helped our state, and our country, navigate this public health crisis,” Gillibrand added. “Congress must pass the Pandemic Heroes Compensation Act to provide critical funds to our nation’s heroes and their families. I am proud to cosponsor this important bill and will work with my colleagues to ensure it becomes law.”

New York’s junior senator previously joined calls to create a federal fund — the Essential Frontline Worker Compensation Fund — to reimburse essential frontline workers for costs incurred while serving the American public during the pandemic.

The Essential Frontline Worker Compensation Fund would help workers safely stay on the job and afford medical costs, transportation, temporary housing, childcare, and care for other long-lasting traumas that may come with serving at the forefront of this pandemic—including testing positive for COVID-19.

New Yorkers 60 Years of Age and Older now Eligible to Receive Vaccine

By Forum Staff Beginning March 10, all New Yorkers 60 years of age and older will be eligible to receive the COVID-19 vaccine, while public facing essential workers from governmental and nonprofit entities will be eligible beginning March 17, Gov. Andrew Cuomo announced Tuesday. This expansion also includes public-facing essential building services workers, Cuomo said.

Additionally, the governor announced that with increased supply of the vaccine, restrictions concerning which segments of the eligible population specific providers can vaccinate will be relaxed to align with the expanded eligibility on March 17.

Previously, certain types of providers were directed to focus their vaccination efforts on specific populations to ensure equitable vaccine distribution. For example, hospitals vaccinated health care workers, local health departments vaccinated essential workers and pharmacies vaccinated New Yorkers 65 years of age and older. Now, providers will be able to vaccinate any eligible New Yorker, with the exception of pharmacies, which will focus on individuals over the age of 60 and teachers, in line with federal policy.

most at risk, such as individuals 60 years of age and older and people with co-morbidities and underlying health conditions.

“New York is marching forward expanding access to the COVID-19 vaccine, addressing underserved communities and getting shots in arms as we turn the tide in the fight against this virus,” Cuomo said. “Supply is steadily increasing and we’re opening new vaccination sites and expanding eligibility to match it. New Yorkers

over 60 years old and those who serve their fellow New Yorkers in the public sector are more vulnerable to COVID-19, and we’re addressing that vulnerability by providing access to the vaccine. The fight against the COVID beast continues on all fronts, and we’re pushing the infection rate down while getting our vaccinations up.”

Under this new expansion of eligibility, the following essential workers will now be eligible to begin receiving the COVID-19

vaccine on March 17: Public-facing government and public employees Not-for-profit workers who provide public-facing services to New Yorkers in need Essential in-person public-facing building service workers This includes workers such as public works employees, social service and child service caseworkers, government inspectors, sanitation workers, DMV workers, county clerks, building service workers and election workers—the everyday heroes who have been showing up day in and day out throughout this pandemic, Cuomo said.

Eligible New Yorkers will be able to schedule appointments at state vaccination sites by utilizing New York’s ‘Am I Eligible’ website or by calling the State’s COVID-19 Vaccination Hotline at 1-833-NYS4-VAX (1-833-697-4829).

“We have been in constant communication with the governor’s office on this issue and are very happy that our members will be eligible to receive vaccinations,” said Uniformed Sanitationmen’s Association Local 831 IBT President Harry Nespoli.

“Upwards of 25 percent of our members have been infected by COVID-19 and, tragically, four died. We greatly appreciate the governor’s actions.”

New COVID-19 Vaccine Site at Flushing Library

By Michael V. Cusenza The City will open a new vaccination site at Flushing Library, with plans to open additional sites in partnership with the Queens Public Library system to serve community members in neighborhoods across the borough, Mayor Bill de Blasio announced Tuesday.

The library, located at 41-17 Main St., will initially replace and expand upon the existing City workforce site in Queens, which is currently operated by FDNY and administering to City employees at John Adams High School in Ozone Park. This new vaccination site, which will initially offer more than 200 appointments per day, will now also include dedicated appointments for eligible Queens residents, and will be open six days a week, from 12 p.m. – 8 p.m. Additional days and appointments will be available as supply increases citywide.

“Flushing Library is uniquely positioned to serve as a site where the vaccine can be distributed to high numbers of people, given its standing as a trusted center of community, prominent location, heavy foot traffic and convenient access to public transportation,” said Queens Public Library President and CEO Dennis Walcott. “We made the decision to temporarily suspend library service at Flushing only after careful consideration of a number of factors, including the high need in the com-

Nursing Homes See 82-Percent Decline in New COVID Cases: Report

By Forum Staff Nursing homes in the U.S. have seen the lowest number of new COVID cases since the Centers for Medicare & Medicaid Services started tracking back in May 2020, suggesting that the vaccines are working, according to a report recently released by the American Health Care Association and the National Center for Assisted Living.

Recent CMS data shows that nursing homes have seen an 82-percent decline in new COVID cases among residents since

the peak during the week of Dec. 20 of last year, when there were more than 30,000 new resident cases. In the same period of time, community cases in the general population dropped by 46 percent, showcasing that vaccines are having an impact in protecting the elderly population in nursing homes.

“We still have a long road ahead, but these numbers are incredibly encouraging and a major morale booster for frontline caregivers who have been working tirelessly every day for a year to protect our residents,” said Mark Parkinson, president and CEO of AHCA/NCAL. “This new data

showcases just how important it is for nursing homes residents and staff, as well as the general public, to get the vaccine because it is clearly working.”

Along with the lowest number of new COVID cases, new data also shows COVID-related deaths in nursing homes declined by 63 percent since Dec. 20, 2020.

“Though this report brings hope, we cannot let our guard down. We must continue to encourage folks to get vaccinated, especially caregivers and staff,” added Parkinson. “Public health officials must also continue to ensure that long term care

residents and staff remain the highest priority for accessing the vaccine, as the onsite clinics with CVS, Walgreens and other pharmacy partners are coming to a close.

“Most importantly, we call on the administration to review its current guidance to nursing homes on restricting visitors and group activities,” Parkinson said. “With millions of residents and caregivers now fully protected thanks to the vaccines, residents must be able to safely reengage in meaningful activities and be reunited with their loved ones.”
