South Richmond Hill Pharmacy Owner Gets 3 Years in Prison for Role in Healthcare Fraud Conspiracy

By Michael V. Cusenza The owner of a South Richmond Hill pharmacy has been sentenced 36 months in prison for his participation in a health care fraud conspiracy, distribution of Oxycodone, and illegal financial transactions, federal prosecutors announced Thursday.

Harris Hussnain, 41, pleaded guilty to the charges in September 2020.

According to federal officials, between July 2016 and December 2019, Hussnain falsely claimed to be the pharmacist at New Moon Pharmacy in South Richmond Hill.

Although Hussnain lawfully owned the business, he was not a licensed pharmacist and was not permitted to dispense prescription medications to patients. Hussnain operated the pharmacy on a daily basis, dispensing prescription medications for years with no medical oversight, including controlled substances and over 10,000 Oxycodone pills, billing Medicare and Medicaid for the medications dispensed.

cally. Hussnain filed, and caused Diler to file, falsified paperwork with government entities in New York State in order to cover up Diler’s absences from New Moon Pharmacy. Between 2016 and 2019, Medicare and Medicaid reimbursed New Moon Pharmacy approximately $3 million for pharmaceutical claims. Hussnain transferred significant amounts of the reimbursed funds to accounts in his and his family’s names.

In September 2020, Diler pleaded guilty to conspiring to defraud Medicare and Medicaid and subscribing a false tax return.

doctors, pharmacists, and pharmacy owners that were charged last year in Brooklyn federal court for their participation in schemes that fraudulently billed the Medicare and Medicaid programs for more than $15 million. According to authorities, the charges filed in Brooklyn were part of a nationwide health care fraud takedown led by the Medicare Fraud Strike Force, which resulted in criminal charges against more than 300 individuals for their alleged participation in health care fraud schemes involving approximately $6 billion in fraudulent claims.

Andrew Cuomo announced at total of $3.5 billion in assistance programs to help those groups recover from financial hardship, State Sen. Joe Addabbo, Jr. (D-Howard Beach) noted Tuesday.

The New York State Emergency Rental Assistance Program will provide $2.7 billion in funding for eligible households experiencing financial hardship due to the COVID-19 pandemic. The Small Business Recovery Grant Program will provide $800 million in funding to small and micro businesses, as well as small for-profit independent arts and cultural organizations to help them recover from the economic impact of the pandemic.

“I encourage all those who meet the programs’ requirements to apply and get the financial relief they deserve,” Addabbo said.

Administered by the state Office of Temporary and Disability Assistance, the ERAP will provide assistance for households behind on their rent and that have experienced financial hardship, that are at risk of homelessness or housing instability and that earn at or below 80 percent of area median income. Eligible renters will receive up to 12 months of past-due rent, three months of prospective rental assistance and 12 months of utility arrears payments to eligible New Yorkers, regardless of immigration status. This program is expected to serve between 170,000 and 200,000 households.

During the first 30 days, the program will prioritize the unemployed, those with income at or below 50 percent of area median income and other vulnerable populations. After the first 30 days, applications will be processed on a first-come, firstserved basis, as long as funds remain available. The Senator noted that since funds

for the program are limited to $3.5 billion statewide, individuals are encouraged to file an application at their earliest convenience.

Once approved, eligible households will receive up to 12 months of past due rent. Those eligible could also receive up to 3 months of additional rental assistance, if the household spends 30 percent or more of its gross monthly income on rent. The program also will provide up to 12 months of utility arrears for eligible applicants.

In addition to fiscal relief, ERAP will provide significant tenant protections. In order to receive assistance, the landlord must agree to waive any late fees due on past-due rent; and not increase the tenant’s monthly rent or evict them for one year, except in limited circumstances.

The Small Business Recovery Grant Program will provide funding to small and micro businesses and small for-profit independent arts and cultural organizations with priority given to socially and economically disadvantaged business owners, including minority- and women-owned business enterprises, service-disabled veteran-owned businesses and veteran-owned businesses, and businesses located in economically distressed communities.

Grants will be for a minimum award of $5,000 and a maximum award of $50,000 and will be calculated based on a State business’ annual gross receipts for 2019. Reimbursable COVID-19 related expenses must have been incurred between March 1, 2020 and April 1, 2021 and can include: • Payroll costs; • Commercial rent or mortgage payments for NYS-based property; • Payment of local property or school taxes; • Insurance costs; • Utility costs; • Costs of personal protection equipment • Heating, ventilation, and air conditioning costs;

Livery Driver Charged in ’96 Rape of Passenger in Jamaica

By Forum Staff A Manhattan man has been indicted by a grand jury for the 1996 rape of a female passenger in Jamaica, Queens District Attorney Melinda Katz announced Thursday.

Danny Stewart, 58, was arraigned Thursday on a one-count indictment charging him with rape in the first degree.

Stewart has been ordered to return to court on June 15.

According to the charges, on Sept. 15, 1996, at approximately 4 a.m., the then-

23-year-old victim was on her way home after completing back-to-back shifts at two restaurants. She flagged down a livery cab in the vicinity of Parsons and Archer Avenues. As the vehicle approached her residence, she attempted to exit the car, but the defendant allegedly refused to let her out. Instead, he drove to a dark parking lot nearby, allegedly displayed what appeared to be a firearm, choked the woman and then raped her. After the assault the defendant allowed her to exit the vehicle, at which time she walked home and then

DA Katz said that at the hospital a sexual assault evidence kit was collected but it was not immediately tested for DNA for the simple fact that no DNA databank existed at the time. In 2000, the New York State criminal DNA databank system was launched, and NYC was then able to test every rape kit in its possession, including the victim’s—and a male DNA profile was produced. In the fall of 2020, Stewart was swabbed for his DNA in New York State. The NYS DNA databank generated a match to the victim’s rape kit, which then alerted the NYPD and the Queens DA’s office. The matter was presented to a borough grand jury, which ultimately indicted Stewart.

“The break in this 25-year-old cold case, the oldest sexual assault case ever prosecuted in Queens County, came from a DNA match that had been previously unattainable,” Katz said. “The victim in this case was just attempting to go home after work, but unfortunately met up with this alleged predator, who at long last faces prosecution for this crime. Justice is not always immediate, but a victim’s suffering deserves closure.”

If convicted, Stewart faces 12 1/2 to 25 years in prison.

Council Votes for Bills that would Affect Borough

A bill recently passed by the City Council would establish an interagency task force to examine the City’s procedures for removing from streets within the city, vehicles that are abandoned or parked without a license plate or valid registration.

By Michael V. Cusenza The City Council on Thursday voted in favor of three bills that, if signed into law by the mayor, would have a profound effect on The World’s Borough.

Int. No. 146-C would remove time limits on the amount of time where an otherwise qualifying recipient of rental assistance vouchers established by the Department of Social Services would receive the voucher. The bill will also require that the maximum rent toward which rental assistance vouchers may be applied is set at levels equal to those established pursuant to section 982.503 of the Code of Federal Regulations, otherwise referred to as “Section 8.” The requirements set by the bill would be subject to appropriation.

In New York City, Section 8, the country’s most successful rental assistance voucher, is pegged at $1,945 for a one-bedroom apartment or $2,217 for a two-bedroom apartment. Meanwhile, CityFHEPS vouchers are capped at $1,265 per month for a single adult and $1,580 for a family of three or four. By increasing the amount the voucher pays, the City would increase the number of units available to individuals and families with vouchers.

“This bill will be transformative for thousands of New Yorkers experiencing homelessness and will allow many families to finally find permanent, stable housing,” said Councilman Steven Levin (D-Brooklyn), the bill’s sponsor. “This is the result of years of hard work by advocates and impacted people who demanded a usable City FHEPs voucher. In my time at the council, my office has tried to help countless constituents who qualify for vouchers find acceptable housing. But there were too many applicants and too few available units and

people waited for years with vouchers that were all but worthless. The change to raise voucher amounts is an investment in housing and the fight against homelessness, and an affirmation of the human right to housing.”

Int. No. 176-A, sponsored by Councilman Alan Maisel (D-Brooklyn), would establish an interagency task force to examine the City’s procedures for removing from streets within the city, vehicles that are abandoned or parked without a license plate or valid registration. The task force would develop recommendations to improve existing removal practices, particularly in response to complaints from local residents.

The task force would also invite representatives from the State Department of Motor Vehicles, the State Department of Transportation, and representatives of any other relevant state agency, as identified by the task force, to participate. The task force would meet at least five times, convene at least one public hearing in each of the five boroughs, and submit a report of its findings and recommendations to the mayor and speaker of the City Council.

And Int. No. 1128-A, sponsored by Councilman Bob Holden (D-Middle Village), would require that, where work at a construction site has stopped for at least two years, the green wooden fence surrounding the site be replaced with a chainlink fence after a registered design professional has certified that all construction or demolition equipment and any hazardous or otherwise dangerous materials have been either removed from the site or secured. When construction work at the site is ready to resume, this bill requires that the chain link fence be replaced with a green wooden fence.

SIGNS OF MELANOMA: WHAT YOU SHOULD LOOK FOR This year, we are without any doubt, looking forward to the rapidly approaching summer––perhaps more than in any other year we can remember. We will flock to beaches, pools and outdoor celebrations with great anticipation and enthusiasm.

But we need to remember that although this years sunny days to come will bring us more joy and appreciation than we could imagine, the sun is accompanied by the danger of skin cancers like melanoma.

Melanoma is a serious form of skin cancer that begins in cells known as melanocytes.

Melanocytes are skin cells found in the upper layer of skin. They produce a pigment known as melanin, which gives skin its color While it is less common other more common skin cancers, melanoma is more dangerous because of its ability to spread to other organs more rapidly if it is not treated at an early stage.

We’d like to use the alphabet to raise your awareness about what to look for: • A is for Asymmetric Most melanomas are asymmetrical. Imagine a line through the middle of a lesion, the two halves don’t match.

It’s not even like a common mole • B is for Border. Melanoma borders are usually uneven and may have scalloped or notched edges, again unlike common moles which are smoother.

• C is for Color. Multiple colors are a warning sign. Benign moles are usually a single shade of brown, but a melanoma may have different shades of brown, tan or black. As it grows, the colors red, white or blue may also

appear.

• D is for Diameter or Dark. While you should look for melanomas of any size, it’s a warning sign if a lesion is the size of a pencil eraser or larger. Rare, amelanotic melanomas are colorless.

• E is for Evolving. Any change in size, shape, color or elevation of a spot on your skin, or any new symptom in it, such as bleeding, itching or crusting, may be a warning sign of melanoma.

Identifying a potential skin cancer is not easy, and not all melanomas follow the rules.

Melanomas come in many forms and may display none of the typical warning signs.

It’s also important to note that about 20 to 30 percent of melanomas develop in existing moles, while 70 to 80 percent arise on seemingly normal skin.

Watch for any new mole or freckle that arises on your skin, a sore or spot that does not heal, any existing mole that starts changing (growing, swelling, itching) or any spot, mole or lesion that looks unusual.

No matter your risk, examine your skin head-to-toe once a month to identify potential skin cancers early. Take note of existing moles or lesions that grow or change.

Keep in mind that while important, monthly self-exams are not enough. See your dermatologist at least once a year for a professional skin exam Stay safe. Have fun and ask your local pharmacist what they have to help protect you from the sun!

Our short memories give rise to ingratitude, which is why God has established regularly-scheduled ceremonies and rituals such as Communion and Passover to remind us that many of today’s blessings are only possible because of yesterday’s sacrifices.

Howard Beach’s Memorial Day gathering is one such reminder.

Although we did not have permission for our annual parade, faithful

veterans and residents met in front of our church to pay homage to the Veterans of Foreign Wars who made the supreme sacrifice so that we can enjoy the freedoms that we have today. Our flag placed at half-staff was a reminder of the more-than-onemillion men and women who gave their lives in service to their country, while we who are living will, hopefully, rise up in their stead to support the cause of liberty and justice for all.

Every ritual ever established by God or man is repetitious by design because repetition is the first law of learning. Memorial Day helps to ingrain within us the truth that freedom comes at a dear price…lest we forget.

Jackson Heights Rally Kicks off Campaign to ‘Transform Transit’

Riders, workers, and elected officials on Thursday launched a new campaign to #TransformTransit.

The Jackson Heights crowd demanded a shift in federal funding, prioritizing transit upgrades, including modern signals, station accessibility, and bus electrification for the New York Metropolitan Transportation Authority.

The rally echoed demands from across the nation for a new $20 billion in annual federal funding to enable transit systems to maintain and expand transit service levels and keep fares affordable to riders. Of the new $20 billion in nationwide spending, TransitCenter estimates New York’s MTA would receive $3 billion.

Key #TransformTransit Demands: Equitable funding for public transit across the nation: Congress must end the 80/20 split between highway and transit funding that fuels the decay of urban infrastructure, widens racial divides, and worsens climate change.

A debt-free MTA capital program: Congress should provide $20 billion to aid the MTA’s $51 billion 2020-2024 capital program, enabling the agency to perform essential upgrades without borrowing more money, a crucial change after a pandemic year in which debt skyrocketed and revenue plummeted.

Congress should provide $20 billion in annual federal operating support for frequent and affordable transit service, via a formula that delivers at least $3 billion each year to the MTA to rebuild and expand service and freeze fares as ridership rebounds from the pandemic.

According to the Riders Alliance, the MTA carries nearly 40 percent of the nation’s transit riders. With a $17 billion annual operating budget, $51 billion five-year capital program, and heavy reliance on revenue from fares, the MTA was hammered uniquely hard by the loss of ridership dur-

ing the pandemic. The federal government’s $15 billion in aid between March 2020 and March 2021 is expected to last the agency through 2023, enabling buses and trains to keep running as ridership slowly returns from about 40 percent of its pre-pandemic total today.

“When we worked cleaning the trains, we felt powerless, because our work was undervalued,” said Astrid Villalba, member leader of New Immigrant Community Empowerment. “We want dignified and fair jobs for immigrant workers who have endured all this year cleaning the trains.

We’re standing on the precipice of a postpandemic life - why would we disregard what we’ve learned over the last year? We saw firsthand the vital importance of our public transit system, now is the time to press forward with a sustainable, long-term investment in affordable, accessible transportation.”

“Now is the moment to transform public transit for the millions of New Yorkers who rely on it,” added Riders Alliance Executive Director Betsy Plum. “The future of our buses, trains, and paratransit depends on a sustainable federal partnership and investment in new infrastructure and in frequent, affordable service. According to Gillibrand and Bass, the legislation would: Create high-quality local construction jobs for people who need them most through targeted hiring practices that use registered apprenticeships and coordinate with state and local workforce development boards.

The Build Local, Hire Local Act will ensure that underrepresented and underserved communities can access federal infrastructure opportunities that create jobs and spur economic growth,” Gillibrand said. “It will also make sure that we are hiring from those same communities to get the job done, with better wages and better working conditions.”

Bass added, “It’s a common-sense step for our government to make it easier for companies to generate jobs in the very counties and states where their transportation projects are located. Communities shouldn’t have to wait for infrastructure projects to be finished to benefit from the investment. That’s exactly what this bill helps address.”

Jeffries Leads Bipartisan Effort to Advance Goals of the First Step Act

Co-authored by Jeffries and Rep. Doug Collins (R-Ga.), the Formerly Incarcerated Reenter Society Transformed, Safely Transitioning Every Person (FIRST STEP) Act aimed to establish targeted reforms aimed at improving public safety and reducing recidivism.

The legislation addressed the crackcocaine sentencing disparity, curtailed juvenile solitary confinement, reduced mandatory minimums, and focused on dignity for female prisoners, among other measures.

Former President Donald Trump signed the bill into law in 2018.

New ACS Campaign Reminds Caregivers to Never Leave Kids Unattended in Hot Car

By Forum Staff The City Administration for Children’s Services on Thursday launched its “Look Before You Lock” campaign, reminding parents and caregivers to never leave a child unattended in a car.

As the weather gets warmer, vehicles can heat up quickly, which can be extremely dangerous for children as their bodies heat up three times faster than an adult’s, according to the American Academy of Pediatrics.

According to ACS, heat illness occurs when the body cannot cool down. The most serious forms of heat illness are heat exhaustion and heat stroke. Heat stroke occurs when the body’s temperature rises quickly and can rapidly lead to death. Keeping cool can be hard work for the body. This extra stress on the body can also worsen other health conditions such as heart and lung disease.

According to the American Academy of Pediatrics, heat stroke is the leading cause of non-crash, vehicle-related deaths in chil-

dren under 15. Infants and children up to four years of age are at the greatest risk for heat-related illness, according to the Centers for Disease and Control Prevention.

In addition to “Look Before You Lock,” a new report from Consumer Reports revealed that in 2020, almost 38 percent of hot car deaths were children who gained access to a vehicle on their own. ACS is reminding parents to be extra mindful about

keeping car keys and key fobs out of children’s reach.

Throughout the summer, ACS officials said, the agency will be sharing important tips with families about how to prevent hot car tragedies from occurring. For instance, to prevent a harried parent from forgetting a child in the back seat of a car, one might leave necessary items in the back seat (purse, wallet, key fob, cell phone, house

keys, etc.). Before leaving the vehicle, the driver may check the back seat to retrieve the item before locking the car doors.

For other parents, it might help to place a stuffed animal in the front seat of the car every time their child is in the back seat. The stuffed animal will serve as a reminder that the child is in the car. As always, anyone who sees a child left unattended in a parked car, should notify law enforcement immediately or call 911.

“Under no circumstance should a child ever be left alone in a car; even if it’s for a short period of time. It’s critical that parents always look before you lock,” said ACS Commissioner David Hansell. “As the summer season draws closer and the days get warmer, we want all New Yorkers to be aware of the danger of hot cars and the steps they can take to help keep children safe.”

ACS noted that just last month, a 5-month-old baby died after being left in a hot car in North Carolina. According to KidsAndCars.org, last year, 25 children nationwide died after being left in hot cars.
