Homeless Man Charged in Attempted Sex Attack in Forest Park By Michael V. Cusenza A homeless man has been charged with attempted rape and other crimes for allegedly assaulting a woman as she walked in Forest Park Saturday evening, Queens District Attorney Melinda Katz announced Tuesday. Cuauhtemoc Cardenas, 32, was arraigned Tuesday on a complaint charging him with attempted rape in the first degree, assault in the second degree, sexual abuse in the first degree, and criminal obstruction of breathing or blood circulation. Cardenas was remanded into custody and ordered to return to court on Aug. 28. According to the charges, at approximately 6:30 p.m. on Saturday, July 25, Cardenas approached the woman as she walked on the OrangeTrail inside Forest Park and tapped her on the shoulder. As she turned towards him, Cardenas allegedly struck her in the face and then attempted to kiss her. The sudden movement caused the woman to fall

to the ground. Cardenas is accused of dragging her into the bushes, pulling down her pants and getting on top of her. He is also accused of wrapping a cloth around the woman’s neck and choking her. Her screams alerted a passerby which prompted Cardenas to run off towards the nearby Jackie Robinson Parkway.The victim was

immediately transported to a local Queens hospital, where she was treated for her injuries. After receiving a tip, investigators caught up to Cardenas on Monday in Woodhaven. “A casual walk through one of the borough’s parks turned into a living nightmare for this woman.

She bravely thwarted being raped, but this kind of depraved violence should not happen in our parks or anywhere in our community,” Katz added.“The defendant has now been apprehended and will be prosecuted for his alleged actions.” If convicted, Cardenas faces up to 25 years in prison.

In August 2017, Richmond Hill resident Mark Andrade was arrested for allegedly committing six sexual assaults in Forest Park between March 2011 and August 2013. DNA swabbed from a beer bottle discarded inside Forest Park several years ago led City Police detectives to slap cuffs on an alleged serial sexual predator.

By Forum Staff Three bills aimed at treating and supporting U.S. military veterans as they return to civilian life recently passed the State Senate, one of the measures’ sponsors announced Friday. According to State Sen. Joe Addabbo, Jr. (DHoward Beach), S.2741A allows service members to earn college credits based on experience

and training from their military transcript which is recognized and accredited by the American Council on Education. “I’m pleased we are taking action to help veterans manage mental health issues, earn college credits for applicable training, and raise awareness about veteran suicide,” said Addabbo, sponsor of the legislation. Additionally, a measure co-sponsored by Addabbo would create a veterans’ mental health and suicide prevention task force to address concerns with the health, safety, and welfare of all returning veterans and the high rate of mental health problems and suicides. Another bill co-sponsored by Addabbo and passed by the Senate designates Sept. 22 as “Veteran Suicide Awareness and Remembrance Day.” The U.S. Department of Veterans Affairs has reported that, on average, 22 veterans commit suicide each day. The rate of suicide among veterans was 1.4 times higher among male veterans and 1.8 times higher among female veterans when compared to the general adult population. This day would honor the fallen and their families by raising awareness that many wounds of war are invisible and persist long after military service ends, Addabbo added. “It is imperative we recognize the lasting consequences often associated with active military service and ensure [veterans] are provided appropriate resources to successfully return to civilian life,” the senator said. The bills now head to the Assembly for consideration.

By Forum Staff A former NCAA Division I men’s basketball coach has received no jail time as part of his sentence for punching a man in Long Island City in August 2018, Queens District Attorney Melinda Katz announced Thursday. The man later died at the hospital. Jamill Jones, 37, ex-head coach at Wake Forest University in North Carolina, was found guilty in February of assault in the third degree. On Thursday, he was sentenced to three years’ probation, 1,500 hours of private community service, and a $1,000 fine. According to trial testimony, it was shortly after 1:40 a.m. on Aug. 5, 2018, when Jones was in his SUV with a companion in Long Island City. Sandor Szabo, who had earlier in the day at-

tended a family wedding, was walking in the LIC neighborhood after exiting a ride-share vehicle. Szabo, 35, wandered over to the rear of Jones’s vehicle and banged on the window. Szabo then ran away and Jones pursued him. Jones caught up to the victim and punched him once in the face. Szabo collapsed to the ground, striking his head on the concrete pavement. Szabo was rushed to a nearby hospital. His injuries included a laceration to his chin, a skull fracture, and other traumatic brain injuries. Two days later, on Aug. 7, Szabo died as a result of those injuries. “This was a tragic incident that ended the life of a man and devastated his family, a violent run-in that should never have happened,” Katz added.“Violence is never the answer to settling a dispute.”

EDITORIAL DON’T WALK THE LINE Maintaining clear thinking during the pandemic/BLM era is presumably a great challenge for all. The situation is compounded by the apparent collapse of reliable leadership that has a stranglehold on our city and state. Should we hold down business? Should we wear masks? Should we reopen the schools? These critical questions are among those our political leaders should be answering best to suit our needs and ensure our safety and well-being. Instead, however, we find ourselves completely mystified at the lunacy being parceled out at every level of our government. We curse them, we complain incessantly, we shake our heads, we have angry discussions, but mostly we are mired in a state of disbelief. We blame the mayor, the governor and the bevy of elected officials comfortably situated between them. But we fail to remember that it is not their fault that they have been issued a license to make decisions and implement measures that are dangerous and

counterproductive. It is not their fault that they make life-changing choices based on ill-advice, misinformation and personal gain. Of course. None of it is their fault. It is unequivocally our fault. We crowned them kings and queens, allowing them to take the wheel and steer us into the dismal abyss in which we live. This is the consequence of voting down the line

of the party we support. The acceleration of party-line voting has had devastating consequences in the House of Representatives and the U.S. Senate. It has all but assassinated the effectiveness of both of these bodies and has resulted in disastrous ramifications, the most notable of which is the fact that party-line voting is now considered normal. The path of voting booth puppets will continue to wreak hav-

oc on our society if we do not spring into action. Yesterday. A massive undertaking is not essential here. To undo the evils we have perpetrated on ourselves we must strip power from individuals not suited to wield it. We are not merely blackening circles on a scan sheet when we vote. We are giving endorsement to the people with whom we are entrusting our lives and our future.

It could be effectively argued that most politicians seem to care only about how a vote will best set them and their respective party up for the next election, with no concern about the quality of the legislation they introduce and pass. Deliberation and the creation of effective policy have been trounced by the frenzy to market political parties and win elections. Like lambs assigned to the slaughter we scurry in to vote carrying the weight of “our party” on slumping shoulders. What we need do is to be armed with information about individual candidates, regardless of party affiliation. We need to elect people not a party and we need to do it now. If you’re one of millions crying for change, one whom has obviously forgotten that it is your vote that has the power to change everything, we implore you to recognize the line you’re walking is a tightrope. Only when we stand up against the peril of party-line voting will anything change.

City Launches NYC Recovery Data Partnership

By Forum Staff Mayor Bill de Blasio on Thursday announced the NYC Recovery Data Partnership and called on community, non-profit, and private organizations to share data with the City to aid in COVID-19 response and recovery efforts. According to de Blasio, the partnership will be a first-of-its-kind effort for the City, centered on principles of privacy, fairness, accountability, and transparency. Partner organizations are providing data free-ofcharge to bolster understanding of how New Yorkers have been impacted by the pandemic, and will help to inform programmatic and policy decisions for an equitable recovery. The RDP will be chaired by the Mayor’s Office of Policy and Planning, the Mayor’s Office of Data Analytics, and the Mayor’s Office of Operations, with counsel from the City’s Chief Privacy Officer. According to officials, all partners have agreed to adhere to City privacy and confidentiality guidelines. The RDP team will review all proposed City uses of data, and will make information about how this data is being used available to New Yorkers. “As we recover from COVID-19 and build a fairer city, it’s essential that we make decisions based in data, facts, and an understanding of the lived experiences of all New Yorkers,” de Blasio said. “That’s why we’re launching the NYC Recovery Data Partnership to harness data from partner organizations that will help us identify and support local industries and communities that are most in need. I call on other civicminded organizations to join the Recovery

Data Partnership as a way to contribute to the City’s recovery efforts.” According to the administration, the goal of the Recovery Data Partnership is to responsibly build a repository of data to help serve communities most in need, with the knowledge that new potential uses of data to support Covid-19 response and recovery will continue to emerge over time. The types of data being shared by the initial cohort include: weekly real estate market metrics from StreetEasy, Zillow Group’s NYC brand; real-time measures of hiring activity from LinkedIn; rates of illness from aggregated smart thermometer readings from Kinsa; sociodemographic information about New Yorkers seeking personal bankruptcy services from Upsolve; foot traffic data aggregated by neighborhood and business type from Foursquare. City officials indicated that they are particularly interested in data in the categories below that reflect communities and industries that have been acutely impacted by the pandemic or are traditionally underrepresented in data: housing and accommodations; food/beverage industry; retail purchasing; arts and entertainment; transportation; public safety; public health; experiences of children and elderly. “We can’t do this alone—the Mayor’s Office of Data Analytics knows firsthand that high frequency data and insights are pivotal for COVID-19 crisis response and recovery,” said Kelly Jin, NYC Chief Analytics Officer and director of the Mayor’s Office of Data Analytics. “Better data makes for better analysis, and this economic and community data will empower our analysts and policymakers as NYC continues to recover.”

Cusenza New Yorkers this week face three “dangerous cliffs,” Senate Minority Leader Chuck Schumer said Sunday as he sounded an alarm and making the case for New York’s urgent need for federal action amid the continued blows of the COVID-19 pandemic. New York’s senior senator said that according to reports, Senate Republicansscrapped their plans to release a proposal for the next coronavirus relief bill last week after continued differences within the party and the White House on myriad issues, including unemployment insurance. Schumer said, because of this inaction, New Yorkers are now on three dangerous cliffs: • Unemployment insurance and the federal $600 boost has expired • Renter and homeowner eviction protections are now gone • State and local governments are going broke The federal unemployment insurance benefit of $600 is expired,

Schumer also said that approved payments to New York recipients for Unemployment Insurance totaled $32.1 billion from March 1 through July 17. Schumer says these figures prove how critical the issue of unemployment has been for New Yorkers and their families, and how essential the additional $600 is to keeping families above water. On the issue of evictions, “more than 325,000 of New York City's lowest-income households—almost a million people—are at risk of severe income loss and may be unable to pay rent,” according to Win, a NYC nonprofit that works with City Hall to provide temporary, emergency shelter to families with children experiencing homelessness. “What has sadly happened here is that needless inaction in the senate by Leader McConnell has put millions of New Yorkerson the edge of these three cliffs and people could be in for a fi-

Joe Addabbo, Jr. (D-Howard Beach) said it is crucial for the federal government to extend the $600 portion of unemployment payments before they expire on Friday, July 31. “As our country continues to battle the COVID-19 pandemic, with many local businesses still either completely shut down or only partially open, it is imperative that the federal government extend the $600 unemployment boost,” Addabbo said. “This extra money will help the more than one million New Yorkers—many of them my constituents—who cannot return to work yet or who have lost their jobs due to the shutdown. As expenses continue to pile up, it is our responsibility as elected officials to ensure that none of our residents who are unable to work suffer due to this pandemic. This month, the U.S. surpassed 4 million reported COVID-19 cases. More than 144,000 people have died in the U.S. from the virus, and the economic blow has been unprecedented.


State Suspends Liquor Licenses of 12 Borough Bars for Egregious Violations of Virus-related Regulations

By Forum Staff The State has suspended liquor licenses for 12 New York City bars—all located in Queens—after finding egregious violations of pandemic-related executive orders, Gov. Andrew Cuomo announced Tuesday. The 12 establishments issued emergency orders of summary suspension from the State Liquor Authority Board during meetings on July 25, 26, and 27 are: CJ’s Bar and Lounge 139-09 Crossbay Blvd. in Ozone Park, on July 25 The licensee’s non-compliance began on June 27, when SLA Investigators documented five patrons drinking inside the premises, along with outdoor tables not properly spaced and with a party-like atmosphere that extended in front of a neighboring building. On July 18, during a disclosed visit, investigators documented employees without facial coverings serving patrons and provided the licensee with a summary of SLA guidelines. The next evening, SLA investigators made an undercover visit to the establishment, observing thirty patrons partying and congregating directly in front of the premises, without facial coverings or social distancing. Lima at 85-07 Northern Blvd. in Jackson Heights, on July 25 Following numerous complaints and previous charges, the SLA conducted a compliance check of Lima on July 24. Investigators observed over twenty patrons outside the premises standing and drinking in a nightclub-on-the-street atmosphere, ignoring social distancing guidelines and blocking the sidewalk. Previously, on July 18, SLA investigators documented the premises operating well past New York City’s 11 p.m. curfew for outside service, with a similarly large group of patrons standing and congregating in a nightclub-like-atmosphere, without facial coverings or adherence to social distancing guidelines. This location had also been observed and charged with violations of the governor’s executive orders in June.

RubiRosa at 84-07 Northern Blvd. in Jackson Heights, on July 26 On July 24, SLA Investigators conducted a compliance check of Rubi Rosa, observing approximately 25 individuals standing in front of the location consuming beverages, ignoring social distancing protocols, and not wearing facial coverings. An employee inside was observed without a facial covering speaking with patrons who were also not wearing facial coverings. This location was also found to be in violation of the governor’s executive orderson July 18, with patrons similarly congregating outside. Mr. Pancho’s Café at 86-09 Roosevelt Ave in Jackson Heights, on July 26 On July 25, SLA Investigators conducted a compliance check of M.r Pancho’s Café and found the restaurant in full operation well past the City’s 11 p.m. curfew for outside service, with over 30 individuals standing in front of the premise consuming beverages, no food available, no proper facial coverings, and no social distancing. In addition, at least three employees were observed without facial coverings. Blue Angel Lounge at 112-51 Roosevelt Ave. in Corona, on July 26 On July 25, SLA Investigators conducted a compliance check of the Blue Angel Lounge, observing patrons consuming alcohol with no food present. An inspection of the kitchen suggests the restaurant was in violations of the food requirement for some time, evidenced by a rusty grill, deep fryers with no oil, an empty refrigerator, an empty food serving station, the gas to appliances turned off, and no kitchen staff on site. This location, according to SLA, was also found to be in violation of the governor’s executive orders on July 18, with 25 people drinking inside. De La Mora Restaurant at 84-19 Northern Blvd. in Jackson Heights, on July 26 On the evening of July 18, an SLA investigator observed patrons standing,

drinking and congregating directly in front of the premises, without facial coverings or observing social distancing. The investigator returned shortly before midnight—well past the City’s 11 p.m. curfew for outside service—to find 30 patrons drinking and partying in violation of the governor’s executive orders. This location was previously charged by the SLA on for violations of the governor’s EO on July 13 and 14. El Patio Bar at 218-21 Jamaica Ave. in Queens Village, on July 26 On July 25, SLA Investigators conducted a compliance check of El Patio Bar, observing patrons inside the bar drinking, in addition to bartenders and kitchen staff without facial coverings. Previously, on July 18, SLA investigators documented the premises operating well past New York City’s 11 p.m. curfew for outside service, with a large group of patrons standing and congregating in a nightclub-like-atmosphere without facial coverings or social distancing. The Grand at 37-01 30th Ave. in Astoria, on July 27 On July 23, a joint inspection with SLA investigators and the New York City Sheriff ’s Office found the premises operating well past New York City’s 11 p.m. curfew, with at least a dozen patrons directly in front of the premises, and no facial coverings or social distancing. Inside, the inspection detail observed a patron drinking alcohol and an employee without a facial covering. When the inspection detail arrived, a bouncer was observed encouraging patrons to leave the premises with open containers. El Paisa Café at 87-05 Northern Blvd. in Jackson Heights, on July 27 On the evening of July 18, an SLA investigator observed eleven patrons standing, drinking and congregating directly in front of the premises, without facial coverings or social distancing. The investigator returned at 11:30 p.m., well past New York City’s 11 p.m. curfew for outside service, to find 25

patrons—none wearing facial coverings— drinking and congregating in front of the business in violation of the governor’s executive orders. Romanticos at 76-07 Roosevelt Ave. in Jackson Heights, on July 27 On July 23, an SLA investigator conducted a compliance check of Romanticos, finding 13 patrons drinking alcohol inside the bar and a manager and bouncer without facial coverings. The business, a repeat offender, was found violating the governor’s executive order requiring bars and restaurants adhere to social distancing guidelines to combat the spread of the coronavirus on two prior occasions. By Forum Staff An indictment has been filed in federal court in Central Islip, L.I., charging a Forest Hills man for defrauding pharmaceutical manufacturer of approximately $6.9 million by submitting fraudulent claims under the manufacturer’s Co-pay Coupon Program, prosecutors announced Friday. Arkadiy Khaimov, 37, is charged with conspiring to commit mail and wire fraud. “Khaimov allegedly stole millions of dollars from a program that was established to assist patients in need of high-cost medication,” said Acting Brooklyn U.S. Attorney Seth DuCharme. “Due to the hard work of our investigators and prosecutors, he will now be held accountable.” As alleged in the indictment, the pharmaceutical manufacturer, referred to in the indictment as “John Doe Company 1,” established the Co-pay Program to reimburse pharmacies for dispensing a prescription medication. Between approximately February 2017 and July 2018, Khaimov and his co-conspirators submitted claims for approximately $6.9 million in reimbursements under the Co-pay Program for the medications that pharmacies operated by Khaimov and his co-conspirators never actually dispensed. In most cases, the pharmacies that Khaimov and his co-conspirators operated sought reimbursements for highly unusual 18- or 21-day supplies of the medication, as compared to the 28-day supply that is commonly used in legitimate medical treatment. This enabled Khaimov and his co-conspirators to submit approximately two reimbursement claims in the same month. In some cases, Khaimov and

his co-conspirators fraudulently used the credentials of a Nassau County-based physician to submit the false claims. “Taking advantage of a program established to help pharmacies defray the cost of dispensing vital prescription medicine to those who need it most, Khaimov and his co-conspirators allegedly sought to profit from fraudulent claims totaling more than $6 million. It’s utterly discouraging to see people capitalize on any initiative designed to contribute to the greater good, but when the crime is healthcare related, and manufacturers stand to lose millions, nobody wins in the long run,” said FBI NY Assistant Director-inCharge Bill Sweeney, Jr. “Today’s charges signal an end to this particular instance of fraud, but rest assured, along with our partners, we will continue to seek out and pursue criminal charges wherever else this activity exists.” If convicted, Khaimov faces a maximum sentence of 20 years’ imprisonment. “Fraud schemes that prey on funds intended for the use of those in need in our society, such as the one Mr. Khaimov has perpetrated here, are egregious and a serious concern for law enforcement and the tax-paying public in general,” said IRS-CI Special Agent-in-Charge Jonathan Larsen. “In a case like this, IRS-Criminal Investigation takes pride in working shoulder to shoulder with our law enforcement partners to see that the offenders are punished to the fullest extent of the law.” United States Postal Inspection Service Inspector-in-Charge Philip Bartlett added, “Rebate fraud is not a new crime, it’s been investigated by Postal Inspectors for decades. Three borough residents and one man who calls Richmond, Va., home have been charged for their roles in using the infamous “Iron Pipeline” to smuggle guns purchased in Virginia to NYC that wereeventually sold illegally on the streets of Queens, District Attorney Melinda Katz recently announced. Jessica “Cess Milla” Heyliger, 35, of Jamaica; Laquan Benson, 36, of Richmond, Va.; Mitchell “Mitxh” Myree, 36, of Jamaica; and Sharod “Yayo” King, 32, of Woodside have variously been charged with criminal sale of a firearm, criminal possession of a weapon and conspiracy. The complaints allege that the ring operated with Heyliger as the principal dealer of the weapons—Benson as her main supplier and Myree acting as a backup. King allegedly was Heyliger’s salesman. The investigation began in September 2019, when an undercover police officer allegedly purchased a handgun and two large capacity ammunition feeding devices from defendant King in Queens. In December 2019, the Court authorized electronic surveillance on King’s cell phone. Upon taking office in January 2020, Queens DA Katz expanded the investigation to include the trafficker who brought these firearms into the borough. According to the complaints, the defendants allegedly sold an undercover police officer a total of 23 guns during 13 separate transactions. As part of the conspiracy, DA Katz said, King communicated directly with a buyer (actually an undercover police officer) and delivered firearms, large capacity magazines and ammunition to that “buyer.” Most of the illegal sales occurred in and around Astoria. Heyliger is accused of providing all of the weapons and ammo to King. All but two of the weapons sold by Heyliger and King to the undercover officer were allegedly supplied by Benson, who mainly acquired the guns through the internet—using a classified advertisement website with sections devoted to the sale of firearms. The investigation revealed that Benson would use an alias and make deals with private firearms re-sellers in Virginia. These guns were then transported to New York City and delivered to Heyliger in Queens, according to the charges. Silver Resentenced to 6.5 Years in Prison By Michael V. Cusenza Disgraced former Assembly Speaker Sheldon Silver recently was sentenced—again—to six and a half years in prison and a $1 million fine. Silver was convicted— again—of seven counts of fraud and extortion in May 2018 in a Manhattan federal court. By Forum Staff Transportation Security Administration officers at John F. Kennedy International and LaGuardia airports are using new technology at checkpoints that validates a traveler’s identification and confirms their flight information in near real time, TSA officials announced Monday. TSA at JFK International Airport has 22 credential authentication technology units in use and LaGuardia Airport has 18 of them in operation.

According to TSA, when a traveler hands the TSA officer their ID, the officer places it in the CAT unit, which scans the ID and informs the officer whether the ID is valid. In some locations, the units are positioned to allow passengers to insert their ID into the units. In most cases, travelers who approach the TSA travel document checking podium do not have to show their boarding pass because the CAT unit verifies that the traveler is prescreened to travel out of the airport for a flight that day; however, one may be requested for travelers under the age of 18 and/

or those with ID issues. Even with TSA’s use of CAT, travelers still need to check-in with their airline in advance and bring their boarding pass to their gate agent to show the airline representative before boarding their flight. CAT units authenticate several thousand types of IDs including passports, military common access cards, retired military ID cards, Department of Homeland Security Trusted Traveler ID cards, uniformed services ID cards, permanent resident cards, U.S. visas and driver’s licenses and photo IDs issued by state motor vehicle departments.

A CAT unit consists of the passport reader, an ID card reader, a federal personal identity verification ID card reader, a monitor, a stand and a UV light. Each unit costs a little less than $30,000. “The credential authentication technology units improve upon TSA’s capabilities to detect and identify fraudulent identification documents such as driver’s licenses and passports at checkpoints and increases efficiency by automatically verifying passenger identification,” said John Bambury, TSA’s Federal Security director for JFK.
