State Public Service Commission Accepts Terms of Settlements Valued at $86M Regarding Alleged Violations Committed by Four NY Utilities for Failing to Adequately Prepare for and Respond to Emergencies, Including Tropical Storm Isaias in 2020

Cuomo Announces $86.2 Million in Settlements with Utilities for Failures Related to Emergencies

Cusenza The State Public Service Commission has accepted the terms of settlements valued at $86.2 million regarding alleged violations committed by four New York utilities— Consolidated Edison of New York, Orange & Rockland Utilities, Inc., Central Hudson Gas & Electric Corporation, and Frontier Communications of New York, Inc.—for failing to adequately prepare for and respond to emergencies, including Tropical Storm Isaias in 2020, Gov. Andrew Cuomo announced Thursday.

For failing to adequately prepare for and respond to the TS Isaias, as well as failures related to the 2019 Brooklyn/Manhattan outages, and a steam outage in 2018, Con Edison and O&R will pay $82.05 million.

For failing to adequately prepare and respond to TS Isaias, Frontier and Central Hudson will pay $2.7 million and $1.5 million, respectively.

An investigation found 33 alleged violations of Con Edison’s emergency response plan related to, among other things, faulty storm classifications, inadequate storm staffing, inadequate communications with municipal officials and the media, and failure to comply with metrics related to contacts with life-support equipment customers. The settlement also includes issues related to a TS Isaias-related outage at the company’s Rainey substation in Astoria.

Thursday’s settlements add to a previously announced $72 million settlement with broadband provider Altice and the $1.5 million settlement with New York State Electric & Gas Corp. related to those companies’ failures to prepare and respond to TS Isaias, and $30 million forfeited by PSEG Long Island to resolve then-pending litigation related to PSEG LI’s management failures during TS Isaias. These settlements resolve all open investigations related to TS Isaias, less than one year after TS Isaias made landfall in New York State.

The total for all the settlements is nearly $190 million. According to Cuomo, the

money from the settlements will be used to offset costs that would have been otherwise borne by customers. Many requirements found in the settlement related to TS Isaias were developed with input from local elected officials and community groups, such as United Westchester. Among the many requirements set forth in the settlement is that Con Edison and the other utilities develop more robust storm-response programs and enhance communication and coordination with municipal and county governments.

On Aug. 4, 2020, Isaias blasted borough enclaves, including Howard Beach, leaving millions in damage and tens of thousands of

Queens residents without power for days.

A week after the weather event, borough elected officials ripped Con Edison’s disastrous management of power restoration in the county.

“Unfortunately, this situation isn’t a new one. Many of my constituents have been victimized by major storms in the past and were prepared before, during and after this recent Isaias storm. I’d like to make sure Con Ed is just as prepared going forward,” State Sen. Joe Addabbo, Jr. (D-Howard Beach) said at the time. “There needs to be a long-term plan to this problem, and not just reactionary measures after service has been interrupted.”

rent state of New York City’s streets and respond equitably to the uniqueness of the City’s many neighborhoods and local needs.

According to State Sen. Joe Addabbo, Jr. (D-Howard Beach), the workshops hosted by DOT will primarily be soliciting broad feedback from community members about how to best prioritize NYC streets. Public input will help DOT prioritize transportation projects and programs in neighborhoods across the City.

More Alleged Child Molesters from Catholic Posts Named

By Michael V. Cusenza For the first time, the names of nearly 180 New York alleged child molesters affiliated with Catholic institutions were recently released publicly. Each person on the list was recently named in civil suits brought by survivors of child sexual abuse.

The suits were filed by Jeff Anderson & Associates, a law firm that represents victims of childhood sexual abuse under the New York Child Victims Act. Among the newly named are Catholic priests, church officials, church employees, coaches, teachers and other people who have worked with kids. Some accusations go back decades. Others were raised in the 2000’s.

The Anderson firm highlighted one particular name—Robert Caldera—in its release of the new list. According to the firm, Caldera, until recently, was the director of sports programs for the Catholic Youth Organization of Brooklyn and Queens, despite being accused of child sexual abuse in two New York Child Victims Act lawsuits.

According to the firm, Caldera was appointed the position of director of the sports programs for the CYO in 2013. His recent departure from the position, along with the two New York CVA lawsuits, was seemingly unknown and unannounced to the public. One lawsuit alleges Caldera sexually abused a minor approximately twenty-four times over approximately four years, from 1993 to 1998. While the second lawsuit alleges Caldera sexually abused a minor approximately three times over approximately three years, from 1995 to 1998.

“The public has a right to know that an alleged perpetrator may have had access to their children for years.” Jeff Anderson said. “The blatant lack of communication confirms that the diocese prioritizes selfpreservation over child protection.”

According to diocesan newspaper The Tablet, the lawsuits stem from Caldera’s time as a CYO basketball coach at St. Joseph’s Church in Astoria in the 1990s.

According to the paper, in addition to Caldera, the defendants named in the lawsuits are the Diocese of Brooklyn, St. Joseph Church, Catholic Charities Community Services, and the Archdiocese of New York.

Borough-wide Overdose Deaths Surged during Pandemic: Katz

By Forum Staff Queens District Attorney Melinda Katz on Friday said drug overdose deaths in Queens surged during the COVID-19 pandemic, echoing recently-released national data.

According to Katz, in 2020, there were 391 overdose deaths, a 45.5 percent increase over 2019, when there were 268 overdose deaths.

According to data compiled from the City Police Department and the Office of the City Medical Examiner, 71 percent of all suspected drug overdose deaths in Queens are related to fentanyl and/or fentanyl derivatives.

Katz noted, “While there were 82 homicides in Queens last year, there were nearly five times as many deaths due to drug overdoses, and the overwhelming majority were attributed to fentanyl. Fentanyl is a dangerous, lethal drug—and often people don’t even know they are taking it because it is mixed with other drugs or sold as pills. Addressing this epidemic remains one of the greatest public health challenges facing current and future generations of Queens residents.”

As highlighted in recently released federal data, COVID-19 pandemic related factors such as stress, job loss, and lockdown restrictions have exacerbated the use of opioids and drastically increased reports of overdoses both across the nation and within Queens.

Doc Looks to Stimulate Richmond Hill Economy

Queens Economic Development Corporation recently released “We Are Richmond Hill” as part of its AvenueNYC program.

By Forum Staff The Queens Economic Development Corporation on Monday released “We Are Richmond Hill” as part of its AvenueNYC program that’s funded by the NYC Department of Small Business Services.

Narrated by food writer/tour guide Joe DiStefano, the almost five-minute documentary looks at commercial, cultural, and culinary wonders of the bustling central Queens neighborhood that’s going through a major renaissance, thanks in large part to immigrants from Guyana, India, Bangladesh, and Pakistan who have settled there over the past decades.

Filmmaker Devin T. Klos mixes candid images of local streets with interviews of small business owners who discuss their shops and reasons why they love Richmond Hill in a variety of accents hailing from the Southeast Asia Subcontinent and its Diaspora.

All the subjects praise the neighborhood—especially its people and vibrancy—and mention other local stores where

they like to shop. Then as a few more images splash across the screen and tabla music spices the background, DiStefano signs off by saying: “It’s a place where the American Dream is alive and well.”

With help from the restaurant-promoting nonprofit Queens Together, QEDC produced the video as part of the Richmond Hill Revitalization program.

“We did this to showcase the businesses and community that make Little Guyana [Liberty Avenue] and Punjab Way [101st Avenue],” said QEDC Program Manager Sam Smouha, referring to recent streetrenaming ceremonies led by the Mayor’s Office. “I hope people will come to support these businesses as they recover from the pandemic and visit an exciting neighborhood with some of the best food in the city.”

In early 2021, QEDC released a Commercial District Needs Assessment of the two most vibrant local shopping thoroughfares—Liberty Avenue and 101st Avenue between the Van Wyck Expressway and Woodhaven Boulevard—and made suggestions on improving commerce there.

THE ACHES AND PAINS OF WEATHER: WHAT TO DO FOR RELIEF We’ve all heard it before, most likely from grandparents or even our own parents, “This weather is killing me.” As children we may have been left scratching our heads, but now, especially in weather like we’ve been experiencing, we now know exactly what they meant.

It might surprise you to learn how much havoc the weather can wreak on our bodies.

But our joints have sensory nerves, called baroreceptors, that respond to changes in the weather. When the weather changes, so does the air pressure and so does our body.

Rainy and damp conditions cause the barometric pressure to drop. When that happens our tendons, ligaments, and muscles expand. Baroreceptors come to our aid and help the central nervous system to regulate the resistance of blood vessels and the heart’s contractions. But people who suffer from muscle or joint pain, expansion in the muscles, tendons, and ligaments can really bring misery.

The kind of weather we’ve been having lately comes with high humidity which can thicken the blood, and increase pressure in blood vessels. Then our hearts have to work harder to pump blood through the body. Hot, humid days can also cause excessive sweating, which can be problematic because our bodies produce sweat to keep us cool, but sweat has

to evaporate for us to cool down. When it’s very humid there is already a lot of moisture in the air and it does not readily absorb moisture from our skin. This can lead to a loss of body fluid and dehydration.

Becuase joint cartilage and the discs in our spine have high water content, and dehydration can decrease the concentration of fluid, arthristis is subject to becoming very agitated and painful. Dehydration in the heat can also cause more serious conditions like heat exhaustion and heatstroke.

Your pharmacist can certainly lead you to a number of OTC preparations, often topical rubs that can help ease the discomfort from the painful and stiffening conditions brought on by weather changes.

To combat the effects of humidity drink lots of water. Drink 1-2 glasses of water for every hour you are outside. This will help you to restore your fluid levels and reduce water loss.

Dehydration can also cause stiffened tissues in the back, because circulation is off.

You should also take advantage of any opportunity you have to swim as it is great therapy for joint or back pain. If you have back or spinal pain, biking is also a great low-impact form of exercise that is easy on the back.

Community Comes Through for Fire Dept.

During its special “Donuts with Daddy” event last weekend, the Howard Beach Lindenwood Civic helped the West Hamilton Beach Fire Department—and smashed a fundraising goal in the process.

“Thanks to the community and a Howard Beach angel, we surpassed our goal of

raising $2,500 for the volunteer fire department!” the civic wrote on Facebook.

Mayor Calls on MTA to Expedite Congestion Pricing Launch

By Forum Staff Mayor Bill de Blasio on Thursday recommended Department of Finance Commissioner Sherif Soliman to the Traffic Mobility Review Board.

Hizzoner also called on the Metropolitan Transportation Authority to work faster to advance this crucial first-in-the-nation program, which will charge private vehicles for entering Manhattan’s Central Business District.

De Blasio urged the MTA to follow a more aggressive timeline for crucial parts of the congestion pricing launch, including: Immediately appointing and convening the Traffic Mobility Review Board.

Expediting the Environmental Assessment, TMRB recommendations, final MTA action including all pricing, exemptions, design and testing, to be completed at the latest by next June, for implementation in 2022.

The TMRB’s members are appointed by the MTA, with the requirement that one member is recommended by the New York City Mayor, one member resides in the Long Island Rail Road region, and one member resides in the Metro North region. The law also requires that members have experience in at least one of the following areas: public finance, transportation, mass transit, or management.

“Sherif Soliman has the vision and expertise to get the Traffic Mobility Review Board moving and deliver a congestion pricing plan that works for everyone,” de Blasio said. “The MTA should meet its obligation to convene experts like Sherif on this board and kick this process into overdrive.

Revenues will provide billions for the subway system’s signals, track, accessibility, and other critical transit infrastructure.

“Congestion pricing is a game changer – it will generate billions for mass transit investments, mitigate the ills of traffic congestion, improve air quality, and provide many more benefits for New Yorkers,” Soliman said. “A successful launch in America’s largest city will further validate congestion pricing as a paragon for sound transportation policy, and I thank the Mayor for recommending me to serve on a board that will play a pivotal role in the program’s design. I look forward to the MTA’s consideration of my candidacy.”

Jessica Ramos added, “As more New Yorkers start heading back to work and tourism picks up, meaningful investments to make our public transportation system more reliable and accessible will be critical to support our city’s economic recovery. Speeding up congestion pricing will mean we can raise the necessary funds for long-overdue repairs to the MTA, clear up the traffic on our streets and allow New Yorkers to breathe cleaner air.”

Gillibrand, Colicchio Call for an Additional $60 Billion in Aid for Independent Restaurants

Kirsten Gillibrand (D-N.Y.) and restaurateur Tom Colicchio on Thursday called for an additional $60 billion in relief to help independent restaurants struggling to recover from the COVID-19 pandemic. The bicameral Restaurant Revitalization Fund Replenishment Act of 2021 would allow the Small Business Administration to continue awarding grants to applicants who were previously approved but have yet to receive funding.

Previously, Gillibrand and Colicchio advocated to include $28.6 billion in the American Rescue Plan for the Restaurant Revitalization Fund, prioritizing applications from women, veterans, and minority business owners. Due to the high volume of applicants and recent court cases that successfully halted the applicant prioritization provision, less than one-third of the 362,000 applicants received funding.

According to Gillibrand and Colicchio, the restaurant industry experienced unique long-term challenges as a result of the COVID-19 pandemic. Across the country, restaurants were devastated by stay-at-home orders and disruptions to the food supply chain, which led to operating restrictions and slashed revenue. In New York, the leisure and hospitality industry accounted for 31.6% of all jobs lost. Independent

restaurants employ 11 million people nationally; however, the impact of shuttered restaurants is felt far beyond their direct employees. The food supply chain industry provides a $1 trillion boost to the U.S. economy, in addition to tens of millions of jobs. The restaurant industry is a $51.6 billion industry in New York and employs nearly 1 in 10 New Yorkers. Those who work in the industry are disproportionately immigrants, people of color, and those who were formerly incarcerated – communities hit hardest by the pandemic. In August of

2020, nearly 90% of New York City bar and restaurant owners couldn’t pay rent and many have had to shut their doors permanently.

The Restaurant Revitalization Fund Replenishment Act of 2021 would help keep workers employed by providing a lifeline to small restaurants and bars that are still struggling to keep their doors open and pay their workers. While the American Rescue Plan established a formal $28.6 million Restaurant Revitalization Fund, as proposed by the bipartisan RESTAURANTS

Act, the SBA received hundreds of thousands of applications, amounting to nearly $75 billion worth of requests, which far exceeded the original fund. Additionally, when the Restaurant Revitalization Fund was originally constructed, Congress intended to prioritize funding for business owners who needed it most and who were disproportionately affected by the pandemic—including funding women, veterans, and minority business owners. Recent lawsuits successfully halted the applicant prioritization provision and put payments on hold for thousands of applicants. This bill would allocate $60 billion in additional funding to put in the hands of businesses owners, including those counting on previously approved funding.

“The $28.6 billion originally allocated in the Restaurant Revitalization Fund was a huge step in addressing the ongoing and unique economic crisis that our nation’s restaurants weathered this past year. The demand for the fund simply outpaced the supply, and we need to ensure these businesses get the resources they desperately need,” Gillibrand said. “Independent restaurants are critical to our economy and this additional $60 billion funding boost will provide direct aid to the restaurant owners Congress initially intended to assist and help these vital businesses keep their doors open.”

Each day New Yorkers turn another page in what is becoming one of the most chilling horror stories imaginable. Rampant and chaotic violence plague community after community throughout the city. Targeted attacks continually strike down people of every race, religion and economic background. Not one of us is sheltered from the threat of this urban terror.

The latest CompStat numbers reveal murders up thirty-seven percent compared to two years ago. The number of hate crimes increased a staggering 118% since last year.

Separate from the numbers is the sense of lawlessness that permeates our streets.

The elected leadership of this city has blatantly discarded hard-won gains in the fight against crime. The ideology embraced by too many elected officials and city leaders says a criminal’s action is the fault of society, instead of the individual committing the offense. This ideology is as detrimental to our society as the crime itself. The champion of this ideology, Bill deBlasio and many City Council Members abandoned the “broken windows theory” of policing and fueled the fires of the anti-police movement.

The contempt political leadership heaps on our law enforcement officers has had a domino effect on crime. The summer of 2019 began with the infamous video of cowards throwing water on police officers.

Last summer saw riots that destroyed businesses, police cars and ripped the fabric of our society. This summer’s shootings continue to rise, up twenty-two percent compared to last year. Even our prison system

suffers. Department of Corrections officers are forced to work triple shifts, which in many cases means working twenty-four hours straight. Mayor de Blasio refuses to allow a new recruitment class of Corrections Officers and continues to push for Rikers to be completely closed.

Without public safety, this city doesn’t function. Consider this cascade - crime continues to rise - tourists stop coming – local businesses suffer beyond repair – the city’s revenue stream is crippled – government agencies are financially overwhelmed - workers don’t return to work – already lacking public transportation further deteriorates. The picture is strikingly clear, the crumbling infrastructure of the city will be the ultimate consequence for the antipolicing campaigns. In short, without safe streets, the New York we know and love will vanish.

What can be done? Start with supporting the NYPD. Without political support, the NYPD cannot do their job. But of course, vocal support is not enough.

The City needs policies grounded in data, practicality, and common sense. We need the disbanded NYPD Anti-Crime units

restored. These police officers were responsible for getting illegal guns off the street.

The dramatic rise in shootings is directly tied to disbanding these teams. We need the Neighborhood Community Officers (NCO) program fully funded. When the City Council cut $1 billion from the NYPD’s budget, many NCOs had to assist on active investigations, instead of spending time building the neighborhood relationships that are the cornerstone of community policing. And when the ideologues come to harass our heroes and blame the police for their own failed policies, we need to stand up and “Back the Blue.”

New York is the home of the Empire State Building, the New York Mets, Yankees and a host of other places and famous names that put us on the map. But ultimately, middle class, hardworking families built this city. The unsung heroes who go to work, pay taxes and play by the rules are New York’s foundation. These people support police and know we need common sense back in City Hall. Working together, we can bring safety to our streets, grow the economy, and remind everyone why New York is the greatest city in the world.

Cuomo Signs Sweeping Package of Voting Reforms into Law

By Forum Staff Governor Andrew Cuomo on Friday signed a sweeping package of voting reforms into law.

The reforms help voters, candidates and boards of elections more easily perform their functions.

The reforms include: Eliminating Signed Absentee Ballot Applications and Allowing Absentee Ballots Postmarked by Election Day to Be Considered Timely: This legislation brings the last day a ballot can be postmarked into line with the deadline for hand-delivered ballots. It allows absentee ballots to be requested by letter rather than a signed absentee ballot application. It also provides that federal write-in absentee ballots, military ballots, special presidential ballots and special federal ballots received after Election Day must contain a postmark, cancellation mark or witness dated Election Day or earlier.

Requiring the Posting of Information about Changes in the Location of Polling Places: Under this legislation, when the location of a polling place has changed since the last election, the relevant board of elections will be required to post a notice on yellow paper at the entrance to the old polling place informing voters that the polling

laws allow candidates to run on multiple party lines, but it was extremely difficult to decline a nomination prior to the signing of this legislation. This legislation provides an opportunity for candidates to decline nominations after a primary loss.

Increasing Election District Registrant Enrollment from 1,150 to 2,000: This legislation increases the maximum number of voters allowed in each election district from 1,150 to 2,000. The previous limit was set based on the limitations of old lever voting machines, which could only handle 1,000 votes per election. Optical scanners can read and hold up to approximately 4,000 ballots per election. This legislation also provides for additional county party committee representation to accommodate an increase in the size of election districts.

“During the past 16 months, numerous obstacles thrown up by the COVID-19 pandemic imperiled one of our most basic and vital rights—the right to vote,” Cuomo added. “This sweeping, comprehensive package of legislation will make it easier for voters, candidates and boards of elections to perform their critical functions and keep our democracy running. Elections have enormous consequences for New Yorkers across the state, and these reforms will bolster their ability to use their voices at the ballot box.”

De Blasio Administration Touts New Health Benefit Program for City Retirees

By Forum Staff Mayor Bill de Blasio and Labor Relations Commissioner Renee Campion recently announced an agreement with the Municipal Labor Committee to implement the NYC Medicare Advantage Plus Program, a custom program for City retirees, beginning Jan. 1, 2022.

The agreement stems from the June 2018 Health Savings Agreement which established a Tripartite Labor Management Task Force to study ways to implement health care cost savings. Implementing the NYC Medicare Advantage Plus Program will produce approximately $600 million annually in health care cost savings for the system, according to the administration.

After consideration, City officials and the Municipal Labor Committee selected an alliance between Anthem Blue Cross and Emblem Health to provide the NYC Medicare Advantage Plus Program. This provides continuity for the majority of employees and retirees who are currently enrolled in the City’s CBP and Senior Care programs.

The program is rated four stars by Medicare.

The NYC Medicare Advantage Plus Program replaces both traditional Medicare and a Medicare Supplement plan with a single integrated program administered by an insurer approved by Medicare. The plan must follow Medicare rules and provide all benefits provided by Medicare. The

plan will not only cover all the traditional Medicare benefits as well as the benefits covered by the Senior Care supplemental plan, but will also add some important new benefits including 24 trips to doctors’ offices, home meals delivery for patients after they are discharged from the hospital, a fitness program, a wellness rewards program and telemedicine.

In conjunction with the insurer, the

City plans to have an extensive education program in the summer and early Fall that will include virtual and in person meetings, mailings and outreach calls to every one of our 250,000 retirees. Retirees will still be eligible for the reimbursement of the Medicare Part B benefit that they receive today.

A major concern for retirees is whether they can keep their current doctors and hospitals in a NYC Medicare Advantage Plus Program. In the City’s Medicare Advantage Plus Program, a retiree can go to any doctor or hospital that accepts Medicare. It doesn’t make a difference if that provider is in the insurer’s network or not.

As long as the provider takes payment from Medicare, they are obligated to accept the NYC Medicare Advantage Plus Program payment. That includes all the hospitals in the NYC area, including those at Memorial Sloan-Kettering and The Hospital for Special Surgery, and almost all hospitals nationally and 99.5 percent of all doctors. The program is a national program so it covers retirees in any State in which they work or reside and when they travel.

“We know that change can be difficult, but we are confident that this will be implemented with little disruption and that the City will continue to provide high quality healthcare to its over 1.2 million active employees, retirees, and dependents,” Campion said.

Senators Urge U.S. Department of Education to Expand Debt Relief for Student Loan Borrowers

By Forum Staff Nearly two-dozen senators recently reached out to Secretary of Education Miguel Cardona to expand student debt relief in the department’s upcoming higher education rulemaking.

In a letter to Cardona, the senator’s highlighted the need for policies that improve and expand existing student loan repayment and forgiveness programs to ensure borrowers can access the relief they are owed.

The senators offered the following suggestions for overarching approaches to major topic areas: The department should simplify and consolidate the income-driven repayment plans and expand the relief they provide to struggling borrowers. The department should use its authority to streamline IDR plans by sunsetting the current IDR plans and creating a new streamlined IDR plan that is easy to navigate and available to all current and future federal student loan borrowers.

The department should reverse the Trump administration rules that harmed student loan borrowers who had been cheated or defrauded by their schools and establish a single “borrower defense” standard for all federal student loans. The “borrower defense” rule established by the previous administration was a devastating blow for students cheated out of their education and savings by predatory for-profit colleges.

Requiring borrowers to submit an application, and be subject to a “monitoring period” of potential earnings, has created unnecessary and harmful barriers to these borrowers getting the relief they deserve, the senators said.

The department should close donut holes and improve eligibility for Public Service Loan Forgiveness and Temporary Expanded Public Service Loan Forgiveness.
