Howard Beach Basks in Italy’s Win over England in the 2020 European Soccer Championship

Cusenza Even if you didn’t catch a millisecond of the scintillating action during Sunday’s 2020 European Soccer Championship final between Italy and England, all you had to do is take a walk or ride to any one of the dozens of vibrant Italian enclaves across the City in the evening to know who took home the trophy.

Perhaps no impromptu street party was louder or more boisterous than the one on Cross Bay Boulevard in Howard Beach. Fueled by sheer pride for their heritage and gli Azzurri, hundreds danced in the streets well into the steamy summer night in support of their beloved homeland.

Campaign Calls on Katz to Reopen Karina Slay Case

By Michael V. Cusenza An online crowd-sourced petition supporting the reopening of the Karina Vetrano homicide case recently crested the 40,000 signature mark.

The campaign, started by “Mo Glover” on OrganizeFor.org, calls on Queens District Attorney Melinda Katz to give the high-profile slaying and conviction a second look.

“We demand that Melinda Katz immediately refer Chanel Lewis’ case to the Conviction Integrity Unit for investigation to reopen his case and release him on bail,” Glover wrote. “Under the guidelines of the CIU, investigations may be opened where there is ‘a credible claim of actual innocence or other wrongful conviction.’ In the case of Chanel Lewis’ murder conviction in the death of Katrina Vetrano [sic], multiple factors meet those criteria, including:

A history of prosecutorial misconduct on the part of prosecutor Brad Leventhal.

Concerns over the use of racial profiling in Lewis’ initial arrest.

Mid-trial disclosure of significant scientific evidence, constituting a 240.20 violation.

Credible claims by the defense that the confessions the prosecution relied upon in court were coerced by police.

In April 2019, Chanel Lewis, 24, of East New York, was sentenced to life in prison without the possibility of parole for the August 2016 murder of Karina Vetrano, 30, who was pulled from a Spring Creek Park running path, sexually abused, and strangled to death near her Howard Beach home.

Former Lawyer Charged with Bilking Clients out of more than $1M in Down Payments

By Forum Staff Queens District Attorney Melinda Katz announced today that suspended lawyer Freddie Berg, of the Berg Law Firm LLC, has been charged with grand larceny, conspiracy and other crimes for allegedly conning nearly two dozen would-be home buyers out of their down payments between September 2016 and December 2018.

Berg, 61, of Lefferts Avenue in Brooklyn, was arraigned yesterday evening before Queens Criminal Court Judge Saul Stein on a complaint charging him with grand larceny in the second and third degree, conspiracy in the fourth degree and two counts of scheme to defraud in the first degree. Judge Stein ordered the defendant to return to Court on August 11, 2021. If convicted Berg faces up to 5 to 15 years in prison.

According to the charges, in the summer of 2016, one of the victims, a woman, responded to an internet listing for two houses for sale on 12th Avenue in Flushing, Queens. The would-be buyer spoke to an unapprehended party who partnered with Berg to sell homes. Following a series of conversations, the victim agreed to buy the properties and paid $400,000 in three separate checks as the down payment. In May

According to the charges, in the summer of 2016, one of the victims, a woman, responded to an internet listing for two houses for sale on 12th Avenue in Flushing.

2017, the woman spoke to Berg about the properties and he allegedly told her a closing date was imminent. However, a date to complete the purchase of either property was never set and none of her money was returned.

As alleged, the victim’s three checks were deposited into the Berg Law Firm’s Citibank account. Soon afterwards, there was a withdrawal for $250,000, a debit for $7,500 that went to a Ford Dealership and

a bank check of $33,000 endorsed to another car dealership. There was also a wire transfer allegedly initiated by the unapprehended other to a travel agency. In all there were at least $337,500 withdrawn out of the $400,000 down payment made by the victim.

According to the charges, the defendant and the unapprehended other allegedly swindled a total of 18 people out of $1.3 million and not a single individual was able

to close on a property they sought to buy.

Only one person received any cash back.

That victim was refunded $4,950 – even though he allegedly gave defendant Berg a down payment of $205,000 for a home on Madison Street in Brooklyn.

DA Katz said, in February 2018, another victim made an offer through a real estate broker to buy a home on Eastern Parkway in Brooklyn. The offer was accepted, and in the meeting where the contract was signed, defendant Berg was allegedly the lawyer representing the home seller. Two checks for $25,000 each were allegedly given to the Berg Law Firm. A year later, in February 2019, while the buyer was waiting to close on the brownstone, he learned that the property had been sold to someone else. He did not receive a refund of his down payment.

Katz said, as of December 3, 2019, defendant Berg’s license to practice law had been suspended.

According to the complaint, in numerous instances money that was deposited into the Berg Law Firm account was wired out to various other banks.

Apply for Grants to Help Maintain Parks

The Forest Park Trust Inc. is among the Queens NYC Green Fund Direct Relief Grantees.

By Forum Staff The City Parks Foundation, the independent, nonprofit that offers programs in NYC green spaces throughout the five boroughs, announced on Thursday the selection of 109 grants through two competitive funding opportunities -the NYC Green Relief & Recovery Fund and GREEN / ARTS LIVE NYC. More than ever before, New Yorkers have come to rely on parks and open spaces, the most fundamentally democratic and accessible of public resources. Parks are critical to our city’s recovery and reopening –offering fresh air, recreation, and creativity -and a crucial part of New York’s equitable economic recovery and environmental resilience. These grant programs will help to support artists in hosting free, public performances and programs in parks, plazas, and gardens across NYC, along with the nonprofit organizations that help maintain many of our city’s open spaces. Both grant programs are administered by City Parks Foundation.

The NYC Green Relief & Recovery Fund will award nearly $2M via 64 grants to NYC-based small and medium-sized nonprofit organizations. Grants will help to support basic maintenance and operations within heavily-used parks and open spaces during a busy summer and fall with the city’s reopening. Notable projects supported by this fund include the Harlem Youth Gardener Program founded during summer 2020 through a collaboration between Friends of Morningside Park Inc. , Friends of St. Nicholas Park, Marcus Garvey Park Alliance, & Jackie Robinson Park Conservancy to engage neighborhood youth ages 14-19 in paid horticulture along with the Bronx River Alliance’s EELS Youth Internship Program and Volunteer Program to invite thousands of Bronxites to participate in stewardship of the parks lining the river banks.

New Law Protects NYers from Telemarketers that Text

Governor Andrew Cuomo Tuesday signed legislation (S.3941/A.6040) expanding New York State’s definition of telemarketing to include marketing by text message. New Yorkers have protection against unwanted robocalls under state law, but texting was not previously defined as telemarketing, exempting it from those protections. This legislation closes that loophole.

“Our consumer protections need

to keep pace with technology and New Yorkers who have long been plagued by the nuisance of annoying calls from telemarketers now have to contend with unwanted texts attempting to sell them things they don’t want,” Governor Cuomo said. “This legislation closes this annoying loophole and will help ensure our laws are modernized to confront the needs of New Yorkers.”

NY to Get $200M from Opioid Suit Settlement

By Michael V. Cusenza The owners of Purdue Pharma, the Sackler family, will be required to pay $4.5 billion over the next nine years, with the State expected to receive at least a $200 million slice of the settlement pie, Gov. Andrew Cuomo announced Thursday.

The pact with Purdue—one of the largest in U.S. history—seeks to define the massive company’s role in falsely marketing its products to get more Americans hooked on incredibly addictive opioid painkillers.

Funding from the settlement will be used to fund prevention, treatment and recovery programs in communities across the country, and thousands of individual victims will also receive compensation as part of Purdue’s bankruptcy process. Additionally, the settlement requires the Sackler family to relinquish control of family foundations to the trustees of a contemplated National Opioid Abatement Trust dedicated to abating the opioid crisis.

Additionally, the settlement shuts down Purdue Pharma and prevents the Sackler family from manufacturing opioids in the future.

If approved by the Bankruptcy Court, the settlement announced today would also resolve DFS’s bankruptcy claim against Purdue. In September 2019, Governor Cuomo and DFS announced a broad investigation into the opioid crisis and the effect

DFS’s investigation and administrative claims against opioid manufacturers and others remain ongoing.

Without such choices, Saturday nights can provide too many opportunities for getting into trouble. Brooklyn Resident Indicted for Allegedly Killing Man following Foot Chase

Cherry allegedly followed the victim moments after the man exited a basement apartment on Quencer Road where Cherry’s girlfriend lives.

By Forum Staff Queens District Attorney Melinda Katz announced today that Rayshawn Cherry, 27, has been indicted by a grand jury and arraigned in Queens Supreme Court on murder charges. The defendant allegedly shot a man to death in St. Albans, Queens, on June 11, 2021.

District Attorney Katz said, “As alleged,

this defendant used a firearm to exact his own version of revenge and now a life has been needlessly lost. Using a weapon cannot be the new norm for resolving grievances or disputes.”

Cherry, of Grove Street in Bushwick, Brooklyn, was arraigned today before Queens Supreme Court Justice Ushir Pandit-Durant on a three-count indictment.

According to the charges, at approximately 10:45 p.m. on June 11, Cherry followed the victim Wayne Joseph moments after the man exited a basement apartment

on Quencer Road where the defendant’s girlfriend resides. The defendant approached the victim and then proceeded to chase the 29-year-old man around parked vehicles and past several homes while allegedly holding a firearm. Moments later, the defendant allegedly shot the victim in his torso and leg.

Joseph was taken to a nearby hospital, where he died the following day.

Three Men Indicted in Shooting Death of Bronx Man in Rufus King Park

By Forum Staff Queens District Attorney Melinda Katz, joined by New York City Police Department Commissioner Dermot Shea, announced that Chance Goode, Torren King and Jabari Curtis have been indicted by a Queens County grand jury and arraigned in Supreme Court on murder charges and other crimes in the shooting death of a young man in Rufus King Park in Jamaica, Queens on October 15, 2020.

District Attorney Katz said, “As alleged, the defendants orchestrated and carried out a brazen robbery scheme that resulted in the broad daylight murder of a 22-year-old man, at a park frequented by children and teenagers. We must stop the scourge of gun violence in our communities.”

Police Commissioner Shea said, “Gun violence has no place in New York City or anywhere.

We are committed to finding those who are responsible and holding them to account. I commend the investigators and prosecutors whose efforts resulted in these indictments.”

and King, of Rockaway, Queens, both 18, and Curtis, 22, of St. Albans, Queens, were arraigned yesterday before Queens Supreme Court Justice Lenora Gerald on a nine-count indictment. The defendants are charged with murder in the second degree, attempted robbery in the first and second degree, criminal possession of a weapon in the second degree and conspiracy in the fourth degree.

Justice Gerald set a return date for July 19, 2021. If convicted, the defendants face up to 25 years-to-life in prison.

According to the charges, at approximately 4:30 p.m. on October 15, 2020, victim Numani Lambert, 22, and two others arrived at Rufus King Park after an alleged arrangement had been made on Facebook to sell marijuana to a buyer who went by the

online name “Pimmy Don.” As Mr. Lambert and his two companions walked in the park, one of his friends used Facebook to send messages to “Pimmy Don,” who responded that he was sending his “boys” to make the cash-for-marijuana exchange.

Continuing, said the DA, the group of three met with two males in the park, one of whom was defendant

King. There was a dispute between the groups on the money changing hands before the marijuana and when King refused to hand over the cash, Mr. Lambert and his friends turned and walked away. That’s when King called them back and with Mr. Lambert directly in front of him, the defendant allegedly pulled out a gun and stated, “Now you have to give it to me.”

As outlined in the charges, King allegedly fired two shots at Mr. Lambert. A single bullet hit the Bronx resident in the head. He died three days later at a nearby hospital.

DA Katz said that during a Court-authorized search of defendant Goode’s home, police allegedly recovered the murder weapon, a 9mm Luger, along with nine rounds of ammunition. Goode was later identified as the wouldbe buyer “Pimmy Don,” who had arranged the meeting on Facebook with one of the victim’s friends.

Goode also allegedly sent King to rob the three and instructed defendant Curtis to drive King to the park, wait for him to rob them and then drive them away from the scene.

Pols Pan Proposed Astoria Power Plant Overhaul

By Forum Staff With the State Department of Environmental Conservation recently opening the public comment period into the proposed overhaul of the Astoria NRG power plant, Senate Majority Leader Chuck Schumer and friends on Friday announced his opposition to the proposal.

The proposed power plant would be located at the heart of Astoria’s “Asthma Alley”—a corridor through Astoria and Long Island City known for abnormally high childhood asthma rates and an overconcentration of New York City’s power generating plants. The proposed overhaul could also undermine the Climate Leadership and Community Protection Act, a nation-leading state law enacted in 2019 that aims to reduce New York’s carbon pollution.

Schumer was joined by longtime project opponent and CLCPA champion, State Senate Deputy Leader Michael Gianaris, as well as State Senator Jessica Ramos, Assembly Member Zohran Mamdani, and Tiffany Cabán, organizers against the plant and climate justice leaders, along with other activists, organizers, and advocates.

“For too long, the people of western Queens have borne the brunt of the consequences of being home to far too many of New York’s pollution-belching power plants – that needs to stop today,” Schumer said. “A rebuilt NRG plant that will keep a fossil fueldependent power plant in Astoria for years to

come would directly undermine the urgently needed goals laid out in New York’s groundbreaking climate law, the Climate Leadership and Community Protection Act. A law I was proud to champion. I am also proud to stand with great local leaders and activists who are fighting for climate justice, and we won’t stop until we power-down this dangerous plan.”

The State Legislature passed the Climate Leadership and Community Protection Act in 2019 to mitigate the effects of climate change by drastically cutting greenhouse gases, diverting the State’s energy reliance to renewable sources, and creating green jobs to pro-

mote environmental justice across New York State. The bill is the most comprehensive and aggressive climate change legislation in the nation. The law targets include an 85-percent reduction in greenhouse gas emissions by 2050, 100 percent zero-emission electricity by 2040, and 70-percent renewable energy by 2030. The proposed overhaul of the NRG Astoria plant, which would be powered by fossil fuels, would be automatically in violation of the CLCPA and would require a waiver from the DEC to even operate.

Last week, the state DEC opened their public comment period on the project’s

draft permits. The public comment period lasts through Aug. 29. Schumer joined local elected officials in urging local residents to participate in the public comment period, to let the DEC know they should reject the permits.

“Given the severity of the climate crisis, no new fossil fuel plants should be getting built, period. I will continue working with my community to fight against this ill-conceived project until it is finally dead. I’m glad we are joined in this fight by Leader Schumer because failure is not an option,” Gianaris said.
