State Budget Director Re-releases Blistering Open Letter on Amazon

By Michael V. Cusenza Last Friday, it seems, was the unofficial day of letters in the Empire State. Dozens of leading NY business and political figures signed a missive that ran in The New York Times and implored Amazon officials to reconsider their decision to pull out of the massive Long Island City HQ2 deal; and State Budget Director Robert Mujica on the same day re-released his scathing, 1,600word message detailing the myriad “lessons learned” from the terminated arrangement.

Following comprehensive, yearlong selection process, Amazon in November revealed plans to establish a new corporate headquarters in Long Island City. Overall, the project was estimated to create more than 107,000 total direct and indirect jobs and more than $14 billion in new tax revenue for the State and a net of $13.5 billion in City tax revenue.

To bring the enterprise to New York, the State offered Amazon a package of incentives and tax credits totaling several billion dollars.

This did not sit well with some; City Councilman Jimmy Van Bramer (DSunnyside) and State Sen. Michael Gianaris (D-Astoria) spearheaded the vocal opposition.

By Feb. 14, the e-commerce giant announced that it had decided to scrap plans to build HQ2 in LIC. “While polls show that 70 percent of New Yorkers support our plans and investment, a number of state and local politicians have made it clear that they oppose our presence and will not work with us to build the type of relationships that are required to go forward with the

project we and many others envisioned in Long Island City,” Amazon noted in a statement.

Cuomo, and, judging by the tone of his open letter originally issued on Feb. 22, Mujica, were livid, placing the blame squarely on the shoulders of “some Queens politicians.”

“While there is always localized opposition, in this case it was taken to a new level,” Mujica wrote. “The

State Senate transferred decisionmaking authority to a local senator [Gianaris], who, after first supporting the Amazon project, is now vociferously opposed to it, and even recommended appointing him to a State panel charged with approving the project's financing. Amazon assumed that the hostile appointment doomed the project. Of course the governor would never accept a Sen-

ate nomination of an opponent to the project and the governor told that to Amazon directly. The relevant question for Amazon then became whether the Senate would appoint an alternative who would approve the project.”

Mujica went on to rip opponents of the plan who claimed that “Amazon was getting $3 billion in government subsidies that could have been better spent on housing or transportation.

“This is either a blatant untruth or fundamental ignorance of basic math by a group of elected officials,” Mujica continued. “The City and State ‘gave’ Amazon nothing. Amazon was to build their headquarters with union jobs and pay the City and State $27 billion in revenues. The City, through existing as-of-right tax credits, and the State through Excelsior Tax credits—a program approved by the same legislators railing against it—would provide up to $3 billion in tax relief, IF Amazon created the 25,000-40,000 jobs and thus generated $27 billion in revenue. You don’t need to be the State’s Budget director to know that a nine to one return on your investment is a winner.”

Mujica closed the missive by warning, “Nothing was gained and much was lost. This should never happen again.”

Legislation Would Authorize New School Bus Safety Cameras

By Forum Staff A recently proposed piece of legislation aims to enhance student safety while nabbing drivers that fail to stop for a school bus displaying its stop sign in the act.

Under current Empire State law, a ticket for illegally passing a stopped school bus displaying a red visual signal can be issued only by a police officer who witnesses the violation. This bill, which was introduced last month in the Assembly, provides for additional enforcement options by authorizing a demonstration program to allow local governments to impose liability on the owners of motor vehicles for the failure of the drivers of such vehicles to comply with the law prohibiting the overtaking and passing of stopped school buses displaying stop signals.

The program allows for the use of mobile cameras mounted on school buses, as well as stationary cameras, with the cost to be borne solely by the municipalities.

“This bill will expand the enforcement tools available and seeks to significantly lessen the numbers of violations that continue to compromise the health, safety and wellbeing of our students who ride school buses,”

Several other states, including Georgia, Maryland, North Carolina, Iowa, Virginia, Connecticut, and Washington have enacted similar legislation in response to a grow-

ing national concern over illegal passing, or “stop arm violations,” Pheffer Amato noted.

“We recently experienced a horrible incident in Broad Channel in which a driver totally ignored a school bus warning sign and struck a child exiting the bus. The child

suffered serious injury and could have been killed,” said Broad Channel Civic Association President Dan Mundy. “It is a clear example that some motorists do not respect the bus warning indicator and that additional enforcement actions should be available to law enforcement to address those who would put our children in harm’s way.”

Some studies have estimated that more than 50,000 drivers throughout New York on a single school day illegally pass stopped school buses, according to the Assembly.

“The use of school bus photo violation monitoring systems (cameras) is necessary to prevent further deaths and injuries caused by dangerous motorists who ignore current law,” wrote bill sponsor Assemblyman Bill Magnarelli (D-Syracuse).

“The Heart of Rockaway supports the bill 110 percent. The safety of our children is endangered with reckless drivers not stopping when the school bus sign is open,” added Edwin Williams, 1st vice president of The Heart of Rockaway Civic. “I am hoping the State Legislature does the right thing and passes this bill.”

The measure is currently under review in the Assembly Committee on Codes.

City, U.S. Army Corps of Engineers Announce Partial Rockaway Beach Restoration

Cusenza The City and the U.S. Army Corps of Engineers have reached an agreement to use dredged sand to re-nourish and restore Rockaway Beach between Beach 92nd and Beach 103rd streets, Mayor Bill de Blasio, Queens Borough President Melinda Katz and several other elected leaders announced on Monday.

According to officials, USACE New York District has awarded a contract for $10.7M to Weeks Marine of Cranford, N.J., to perform needed maintenance dredging of the East Rockaway Inlet Federal Navigation Channel. The City Department of Parks & Recreation is contributing $2.7M to pump the sand two and a half miles farther west in order to avoid potential environmental impacts. The work will restore and ensure safe passage for both commercial and recreational vessel traffic through the inlet, the administration confirmed on Monday. USACE is expected to remove approximately, 300,000 cubic yards of sand from the inlet and place it between Beach 92nd and Beach 103rd streets to replace lost sand due to heavy erosion after last March’s back-to-back nor’easters.

By Michael V. Cusenza The State Senate and Assembly have approved legislation that establishes the crime of unlawful dissemination or publication of an intimate image—more commonly known as “revenge porn.”

The measure would make sharing or publishing an intimate image without consent a class A misdemeanor, according to one of the bill’s co-sponsors, Assemblyman Mike Miller (D-Woodhaven).

“This legislation ensures that someone who violates another’s trust in such a cruel and personal manner will

be held accountable for their abusive behavior. In the face of unprecedented technological advancement, we can’t allow privacy to become a thing of the past,” Miller added. “New York is sending a clear message that consent and bodily autonomy are just as important online as they are offline.”

The new charge, Miller noted, would apply in cases where the individual depicted had a reasonable expectation of privacy and the offender knew or should have known that the other party didn’t want their photo shared. The bill also allows a person to pursue civil action against the offending individual, regardless of whether criminal charges have been filed. The person whose photos or videos were shared can also petition the court to require websites that published the media to permanently remove them.

According to Assemblyman Ed Braunstein (D-Bayside), who introduced the bill last week, “Criminalization is preferable to civil suits by victims because civil suits don’t deter those who upload or disclose new images after a civil suit has ended. Furthermore, a lengthy trial is emotionally exhausting and prohibitively expensive. Moreover, the websites that distribute nonconsensual pornography are given broad immunity for civil liability under federal law through the Communications Decency Act. Therefore, criminalizing dissemination and publication of these photos may prevent websites from benefiting from the harmful images.”

On Monday, Ulrich said he was “pleased” that de Blasio “heeded our call” for more sand on the popular beach.

“While I am relieved the City is taking these important steps to protect our coastal communities, other areas of the beach remain vulnerable,” Ulrich added. “The City must continuously replenish sand throughout the Rockaway Peninsula while we wait for the USACE resiliency projects to begin.”

Assemblywoman Stacey Pheffer Amato (D-Howard Beach) said, “The replenishment will serve as temporary relief for the years-long erosion plaguing our beaches. This is a positive first step towards the complete renourishment and in order to fully protect our community we need permanent measures as soon as possible.”

Depending on when dredging work commences and the severity of spring storms, the project should allow for the reopening of the Beach 92nd to Beach 103rd stretch of Rockaway Beach this coming summer, according to City officials.

City Medics Push for Equal Pay

Several unions representing more than 4,700 members of the City Fire Department’s Emergency Medical Service urged Mayor Bill de Blasio on Friday to rectify what they call “pay inequity.”

According to those organizations, a top FDNY EMS member will cap out around $48,000 annual salary; whereas, after five years, a member of the FDNY fire service will make approximately $86,000 per year.

Assemblywoman Stacey Pheffer Amato (D-Howard Beach; at lectern) called on Hizzoner to “treat the EMS workers in this city with more respect, and that includes raising their wages.”

“The long-standing practice of discriminatory pay towards EMS members is simply unacceptable and must be rectified immediately,” the assemblywoman added.

Assemblywoman Pheffer Amato called Mayor de Blasio’s proposal to address homelessness “misguided and irresponsible.”

By Michael V. Cusenza Two area legislators have introduced a bill that would require the City to release a neighborhood impact statement prior to establishing a homeless shelter in a community.

State Sen. Joe Addabbo, Jr. (D-Howard Beach) and Assemblywoman Stacey Pheffer Amato (D-Howard Beach) indicated that they crafted the measure after several communities in their districts, including Rockaway and Ozone Park, were selected for homeless shelters with little to no community outreach — with the public or local elected officials — or consideration to other factors such as infrastructure and mass transportation in the area or community concerns.

The Senate bill would require the City to conduct and release a neighborhood impact study for the area where a homeless shelter would be sited. The study would document the number and locations of daycare centers, schools, parks, playgrounds, senior centers, infrastructure and other information that the City Council deems relevant, Addabbo noted.

“In order to deal with the city’s homelessness crisis, the mayor has decided to do away with cluster apartments to instead create large-scale homeless shelters in local communities,” the senator said. “While each community wants to do their part to help with the crisis, there needs to be a practice where the community is involved in the early stages of the selection process and the concerns of residents can be address before a site is finalized.”

Addabbo also posited that in order to tackle the complex issue of homelessness, the government must put forth policies that address the long-term issues that sometimes lead to homelessness such as af-

fordable housing, creating jobs, and mental health treatment, along with alcohol and substance abuse rehabilitation.

In February 2017, Mayor Bill de Blasio unveiled “Turning the Tide on Homelessness, Neighborhood by Neighborhood,” his 114-page vision to address the homelessness crisis outlines the timing and logistics of ending the use of 360 cluster sites and commercial hotel facilities. Replacing the sites will be 90 traditional shelters distributed across the five boroughs. According to the administration, the new network will be able to more effectively house the homeless near the communities, jobs, school, houses of worship and support systems needed to help them get back on track.

“The mayor’s proposal to address homelessness is misguided and irresponsible — placing vulnerable individuals in an area with no resources to support them, without inclusion of community stakeholders, is a failed plan for everyone,” Pheffer Amato said. “I thank Senator Addabbo for introducing this vital piece of legislation, and I am proud to introduce this bill in the Assembly. The City must include us in the conversation — and this bill seeks to do just that.”

Last week, Pheffer Amato also emphasized her support of Home Stability Support: a statewide rent supplement for families and individuals who are eligible for public assistance benefits and who are facing eviction, homelessness, or loss of housing due to domestic violence or hazardous living conditions. HSS would be 100 percent federally and state-funded, and would replace all existing optional rent supplements. The HSS Act, which is sponsored by Assemblyman Andrew Hevesi (D-Forest Hills) and cosponsored by Pheffer Amato, has passed both legislative chambers and is being considered by Gov. Andrew Cuomo.

City Should Run Transit System: Council Speaker

Council Speaker Johnson delivered his debut State of the City address on Tuesday at LaGuardia Community College in Long Island City.

In order to achieve this authority, the City must have control over its public transportation system, according to City Council Speaker Corey Johnson, whose headline-stealing State of the City address made the case for municipal command of buses and subways in the five boroughs.

Johnson chose the Mainstage Theater at LaGuardia Community College in Long Island City for his debut SOTC; and he chose transportation as the main theme of a unique address heavy on style and substance.

“Transit is at the heart of who we are as a City. And transit is at the heart of the crisis we’re in right now,” the speaker said.

The speaker’s speech was based on “Let’s Go: A Case for Municipal Control and a Comprehensive Transportation Vision for the Five Boroughs,” Johnson’s 104page report that outlines his idea for revolutionizing mass transit in NYC. “It’s time for the City to take back control of the subway and buses so that we can establish and implement our own transportation priorities,” Johnson demanded.

“This report closely examines the problems associated with the current MTA governance structure and proposes a detailed plan, including proposed operating and capital budgets and new revenue streams, for a City-controlled entity to run our mass transit system. Recognizing that failures of government come from failures of accountability and responsibility, the report proposes three key elements for the new system: accountability, transparency, and oversight.”

Johnson’s vision even involves a new name for New York City’s mass transit system: the BAT.

“The State must transfer New York City Transit, the Manhattan and Bronx Surface Transit Operating Authority, the MTA Bus Company, the Staten Island Rapid Transit Operating Authority, MTA Bridges and Tunnels, and a portion of operations at MTA Headquarters to a new entity controlled by the City—Big Apple Transit,” he posited.

Johnson’s ambitious plan calls for: one person in charge. Under the BAT, that would be the mayor. Riders and taxpayers would know who controls the system and who to hold accountable.

Johnson noted that the BAT’s structure would be modeled on the Water Board.

The BAT would resolve issues of political interference and a lack of clear financial support by taking a page from the operations of what Johnson characterized as “a successful, capital-intensive municipal operation: the City’s water system.” Like that system, BAT’s operations would be part of the City’s budget and subject to the same oversight and planning process that other City agencies currently undergo. Similarly, BAT’s financial plan would also be periodically reviewed by a third party engineering firm to ensure that these financial plans provide sufficient resources to keep the system viable over the long-run. These steps will prevent any future backsliding in maintenance and investment to guarantee New Yorkers a reliable transit system, according to Johnson.

“If you think solving our transit crisis is too hard, look around when you leave here today. Take a look at Queens. Look at Brooklyn. At the Bronx. Upper Manhattan. The subways built that. New Yorkers built that. Immigrants built that,” Johnson concluded. “We are the greatest city in the world.”

The power of the internet is all that and even more superlatives. However, as we have documented in this space plenty of times, the internet’s power depends on who’s pounding out the keystrokes. It can be a source of enlightenment and happiness. But it can also be heinous.

Unfortunately, the internet can be a bottomless source of pleasure for bottom feeders; a boundless force of negativity. The latest iteration of internet evil comes in the form of something dubbed the Momo Challenge.

According to the Chicago Tribune, the Momo Challenge “threatens children by telling them that if they don’t do things like light the stove and blow out the flames, filling their house with gas, Momo will kill them.”

One sheriff remarked, “I can attest to it. It’s incredibly scary.”

In recent weeks it has been debunked as an urban legend or hoax about a nonexistent social media challenge that was spread on Facebook and other media outlets. It was reported that children and adolescents were being enticed by a user named Momo to perform a series of dangerous tasks including violent attacks and suicide.

“Momo was a fictional Japanese creature that was a piece of art, if you want to call it that, but someone took it to another level where they started sending videos of it to little kids through things like Musical.ly or YouTube that want the kids to engage in dangerous behavior like

sticking a knife into a socket,” Richard Wistocki, a retired Naperville police officer and cyber bullying expert who founded BeSure Consulting, told the Tribune.

Hoax or urban legend—depending on the maturity of the audience, the threat can feel real.

That’s why parents and guardians have to carefully watch their little ones’ internet consumption.

“There is no such thing as privacy for children,” Wistocki told ABC 7 Eyewitness News.

So what is a parent/guardian/teacher to do? According to the Chicago Children’s Advocacy Center, it begins with maintaining open communication.

Other ways to limit a child’s exposure to horrific things like the Momo Challenge: • Demonstrate interest in your child’s online activity by using the internet with them • Keep computers in high traffic areas of your home like a living room • Use privacy settings and parent controls • Set rules and limits for when and how long kids can be online, and consider posting the rules or a pledge by the family computer • Be aware of who your child talks to online – be their Facebook friend and follow them on Instagram, Twitter and SnapChat And for those that would perpetuate the hoax, there’s a special, unique, revolutionary, infinite circle of Hell waiting for you whenever you log off for good.

By Forum Staff In his analysis of the City’s Preliminary Fiscal Year 2020 Budget, City Comptroller Scott Stringer said the plan revealed a lack of financial preparedness for potential future economic uncertainty, and an absence of tangible results despite increased record spending at three agencies.

Stringer’s scrutiny, delivered on Friday, found the proposed FY 2020 strategy relies on numerous one-time actions to balance the budget and called for a goal of increasing the City’s budget cushion to 15 percent of total spending to sufficiently prepare the City for unforeseen events and protect important social programs. The comptroller’s Agency Watch List—which spotlights City departments without demonstrable results for their spending—revealed record multi-agency spending on homeless services, which is projected to reach nearly $3 billion even as the shelter population continues to rise; the Department of Correction is spending more than $300,000 per detainee as incidents of violence increase; and the Department of Buildings has seen a 252-percent increase in construction accidents since FY 2014, despite increasing spending by 62 percent over the same period.

In his presentation, Stringer detailed the budgeting problems his office has discovered at DHS, DOC, and DOB: Department of Homeless Services • Citywide spending on homelessness across all agencies has more than doubled from $1.3 billion in FY 2014 to a projected $2.9 billion in FY 2020; • Spending on shelters alone has doubled since FY 2014 – from $1.1 billion to $2.2 billion in FY 2020; and • Despite major investments in pre-

vention and housing, the number of individuals residing in shelters has steadily increased from 51,770 in 2014 to 60,366 as of February 2019.

Department of Correction • In the last decade, the average daily jail population has declined by fully one third, from 13,850 in 2008 to under 9,000 in 2018; • But over the same period, the average annual cost of housing someone on Rikers Island has more than doubled, from about $117,000 in 2008 to over $300,000 in 2018, Stringer noted; and • The number of violent incidents against both detainees and correctional officers has more than tripled over the same period, from 441 per 1,000 average daily population in 2008 to 1,354 per 1,000 average daily population in 2018.

Department of Buildings • Since FY 2014, the DOB budget has grown 62 percent, and headcount has increased by more than 50 percent, to 1,565 employees; • Over the same period, however, the number of construction accidents—including fatalities—has skyrocketed, with accidents climbing 252 percent, and fatalities by 167 percent, Stringer said; and • Similarly, while the number of plan examiners has increased sixfold, the number of new construction permits issued has only grown by 13 percent.

“Our budget needs to be balanced for the long term, not just for the next year, so that we can ensure that vital initiatives and services for families and seniors go uninterrupted regardless of the broader economy,” the comptroller added. “To reach that goal we need to build up our budget cushion and conduct a more rigorous review of agency spending to root out inefficiencies and waste.”

The condition known as urinary incontinence (UI), is often a difficult one to face and discuss for many patients. UI is defined as the involuntary leakage of urine, and it is a frequent and problematic chronic condition for many patients.

Statistics demonstrate that an estimated 10 to 30% of men and women are affected nationally. The numbers are believed to be even higher however, because of the unwillingness in many patients to acknowledge or address the situation.

Patients who suffer with UI symptoms can develop poor self-rated health, depression, and mobility disability. And in addition to the varied psychological burdens on patients with UI, there are also significant financial taxation on these patients. Studies from 2014 show that over $65 billion dollars was spent on the condition, its treatment and supplies.

UI can be transient and reversible, or it can be established and chronic. There are four main types of UI–stress, urge, overflow, and functional incontinence. Incontinence differs and is categorized according to individual types based on the symptoms.

Stress incontinence is the involuntary loss of urine on effort or physical exertion or on sneezing or cough.”

Urge incontinence is the “complaint of involuntary leakage accompanied by or immediately preceded by urgency.”

Overflow incontinence is related to an obstructed urine flow and/or bladder underactivity where an individual has a full bladder, but is unable to completely void at time of urination, which later leads to leakage.

Functional incontinence, unlike the other forms of incontinence, occurs when an individual has issues getting to the rest room due to an external factor (i.e. dementia, immobility, etc.), but is not associated with urinary tract dysfunction.

While these conditions are most commonly found in the senior population, other pa-

tients who are much younger may be affected due to neurological diseases like prior stroke, high body mass index (BMI), recurring urinary tract infections (UTIs), and positive metabolic screening, which factors in triglycerides.

What actually causes UUI/OAB is unknown, however in patients with this condition, control is not well regulated. The main muscle of the bladder, contracts involuntarily even if the bladder is not full, resulting in the urge to urinate.

MTA Leaders Hail Cost-Reduction and Reform Initiatives

By Forum Staff Roughly 24 hours after Gov. Andrew Cuomo and Mayor Bill de Blasio jointly unveiled their 10-point plan to transform the Metropolitan Transportation Authority and create dedicated, sustained funding streams via congestion pricing, MTA leaders last Wednesday released their own series of steps toward reducing costs and reforming the embattled authority.

MTA Acting Chairman Fernando Ferrer acknowledged that the agency is under significant financial stress, facing massive gaps in both operating and capital budgets.

Without cost reductions, in addition to congestion pricing and additional revenue from State and City partners, Ferrer said the MTA will be forced to make service and staff cuts, as well as substantially raise fares to help cover capital costs. Not enacting congestion pricing alone would require the MTA to raise fares by nearly 30 percent, the chairman noted. MTA leadership said last week that it was “committed to doing its part” to address the crisis with cost reduction measures, which, they pointed out, are in addition to the $2 billion in annual reoccurring savings the MTA has secured since 2010.

Ferrer has shared these cost-reducing, reform steps with the MTA Board:

“The MTA’s new leadership team will accept nothing less than large-scale, organizational reform,” said MTA Acting Chairman Fernando Ferrer.

• Each of the MTA’s operating agencies has submitted consolidation proposals within their agencies. In light of looming deficits, the agencies have been asked to identify $500 million in annually recurring savings. These are not merely “targets.” They are hard, institutional requirements, Ferrer noted.

• The MTA is applying the same scrutiny to vendors and contractors by reducing their hourly rates by 10 percent across the board,

without cutting the scope of the work they do. This is expected to result in $75 million worth of savings.

• The MTA will be closely reviewing all current and upcoming consulting engagements, with the goal of working toward ending any relationship that is not absolutely necessary.

• The MTA will seek to consolidate back office functions. These include accounting, claims, communications, engineering, gov-

ernment relations, human resources, legal, marketing, planning and procurement. The MTA will also consider other, more expansive options at every level, Ferrer pledged.

• Board and key staff have begun implementing strategies to revolutionize the way procurements are handled, to increase competition and deliver projects more efficiently and effectively – better, faster, and cheaper.

• The MTA will work with the State, City and district attorneys to develop an enforcement strategy to combat fare evasions, which costs the agency approximately $215 million per year.

• MTA officials will continue to work, on an advisory basis, with academic experts and other outside innovators on large scale projects, following the successful efforts to avoid a complete L tunnel shutdown. All new major construction projects will be reviewed by construction and engineering experts who are not affiliated with the MTA or its consultants. The construction review team will be headed by the Deans of Cornell School of Engineering and Columbia School of Engineering to assure state of the art design and technology is being deployed.

“No more tinkering. No more nibbling around the edges,” Ferrer added. “The MTA’s new leadership team will accept nothing less than large-scale, organizational reform.”

Astoria Boulevard NW Station to Close for Nine Months for Renovation Projects

By Forum Staff The Astoria Boulevard NW elevated station is set to close at 10 p.m. next Sunday, March 17, for nine months as MTA New York City Transit begins a multi-phase project to add four new elevators and other accessibility features, as well as demolish and rebuild the station mezzanine with more vertical clearance to prevent strikes by trucks and other over-height vehicles traveling below the station structure, NYCT President Andy Byford said on Monday.

The agency has been repairing and rehabilitating stations, switches, and track structure throughout the length of the entire elevated Astoria NW line, Byford noted, replacing deteriorated structural steel, installing new sections of track panels and repairing platforms, stairs and mezzanines to bring century-old stations to a state of good repair.

So far, NYC Transit has completed repairs and renovations at the 30 Av, 36 Av, 39 AvDutch Kills and Broadway stations. Crews also replaced thousands of feet of tracks and 10 switches along the line to address deteriorating track components and reduce train noise, Byford said.

molition of the existing station mezzanine and the construction of a newly designed structurally reinforced station mezzanine that will have more vertical clearance to reduce the number of strikes by trucks driving beneath the elevated structure. These vehicle strikes can damage the track structure, requiring personnel to make manual inspections so that trains can operate safely and that no critical operational infrastructure,

such as tracks, switches or signals, is damaged. These manual inspections, and any damage caused by each vehicle strike, delay service and can incur costly repairs or maintenance as a result.

The Astoria Boulevard work began in September 2018. The construction has moved forward to a phase requiring the full closure of the station for the next nine months. When the project is completed in

late 2020, the station will have two streetto-mezzanine elevators, two mezzanine-toplatform elevators, a new station mezzanine, repaired or replaced structural columns and foundations, repaired concrete platform surfaces, new street and platform stairs, new platform stair enclosures, and new platform canopies and mezzanine overpass walkway canopies. Lights, signs and gates will also be replaced. The new station structure will be reinforced to support the weight of the new elevators and facilities.

The elevator installation project will address platform gaps and install boarding areas, stairs, railings, and other elements of the station that meet ADA standards. Elevators will provide greater access to the Astoria NW line for wheelchair customers and customers with suitcases transferring to and from the M60 Select Bus Service to LaGuardia Airport, Byford noted.

The project will overlap with scheduled weekend track work on the Astoria Line that begins Saturday, March 16. According to NYCT, beginning March 17, Astoria Boulevard customers can use the Ditmars Boulevard and 30 Av stations as alternate subway service.

During limited periods of scheduled work affecting the track structure, N and W trains will terminate at Queensboro Plaza, and alternate Astoria Line service will be provided by shuttle buses making NW station stops.

Bronx Man Charged with Exposing Himself to Girl, 9, on Subway

By Forum Staff A Bronx man has been charged with sexual abuse, forcible touching, and other crimes for allegedly exposing his genitals to a 9-year-old girl and then touching her forearm with his exposed penis last month on a southbound 7 Train in Woodside, according to Queens District Attorney Richard Brown.

Ronald Dudley, 40, was arraigned on a criminal complaint charging him with first- and third-degree sexual abuse, forcible touching, and endangering the welfare of a child. The judge at Dudley’s arraignment set bail at $100,000 and ordered him to return to court on March 15. According to City Department of Correction records, Dudley has not been able to post bail.

side Avenue. It is further alleged that Dudley stood next to the 9-year-old victim and held onto the same pole as she did as the train pulled out of the station. Moments later, the

little girl felt something touching her arm.

She looked to see who had touched her and saw that Dudley had exposed his genitals and that he was using his hand to manipulate

his exposed penis to touch her and was purposely rubbing himself against her forearm.

Brown said, according to the charges, Dudley allegedly fled the scene shortly after the victim yelled out for her mother, with whom she was traveling. An anonymous tip led police to Dudley after video surveillance was widely circulated in the media.

“The defendant in this case is alleged to have violated this little girl by exposing his genitals and actually touching her with his penis. This was a horrible, disturbing act that no one—let alone an innocent child— should have to endure,” Brown said. “The defendant is a 40-year-old man who is alleged to have traumatized this little girl for his own demented sexual gratification. If the charges are proven true, he deserves to be locked away from society for a long time.”

If convicted, Dudley faces up to seven years in prison.

Leader of Borough-Based Nonprofit Group Cops to Role in Immigration Fraud Scheme

By Michael V. Cusenza The leader of a Rego Park-based nonprofit has admitted to her role in an immigration fraud scheme, federal prosecutors announced on Monday.

Stella Boyadjian, 48, who operated Big Apple Music Awards Foundation Inc., pleaded guilty to conspiracy to bring aliens unlawfully into the United States, visa fraud, and aggravated identity theft.

According to officials, between January 2013 and December 2014, Boyadjian and two others engaged in a widespread visa fraud scheme to bring foreign nationals illegally into the U.S. by fraudulently claiming to the United States Citizenship and Immigration Services that they were members of traditional Armenian performance groups and thus qualified for P-3 visas as “culturally unique” artists or entertainers.

The three conspirators, according to prosecutors, solicited foreign nationals and, in exchange for fees up to $10,000,

prepared and filed fraudulent P-3 visa applications. In furtherance of the scheme, the conspirators purchased fraudulent documentation to support the applications, including fake dance certificates and staged photo sessions where the foreign nationals wore Armenian dance costumes to make it

appear as though they were traditional Armenian musicians, singers, and performers. Once successfully in the U.S., some recipients of the fraudulently obtained P-3 visas paid additional fees to the conspirators to obtain extensions of their stays. Boyadjian and the other conspirators also furthered their visa fraud scheme by creating flyers and other documents purporting to hold BAMA-sponsored concerts and events in the United States.

“Fraudsters who undermine our immigration system threaten our public safety and our national security,” said Acting Assistant Attorney General John Cronan. “The Justice Department will not tolerate abuses of our nation’s immigration laws...We will root out immigration fraud and bring those responsible to justice.”

When sentenced, Boyadjian faces a maximum of 10 years’ imprisonment for visa fraud, and an additional mandatory consecutive sentence of two years’ imprisonment for aggravated identity theft.

Far Rockaway Man Charged in 2018 Shooting Death

By Forum Staff A borough grand jury on Monday returned an indictment charging a Far Rockaway man with murder, kidnapping, and other crimes for allegedly shooting and killing a man following a brawl in Far Rockaway in August 2018, according to Queens District Attorney Richard Brown.

Joaquin Bullock, 32, was arraigned on an eight-count indictment charging him with first-and second-degree murder, first-degree kidnapping, second-degree criminal possession of a weapon, and third-degree attempted assault. Bullock was remanded and ordered to return to court on May 1.

scene.

According to the charges, Brown said, approximately 30 minutes later, surveillance video shows Bullock returning to the scene.

Shortly after his arrival, Bullock is alleged to have grabbed and dragged Smith, 28, to a se-

cluded location around the corner from where the men had fought. While being forcibly removed, Smith attempted to resist Bullock.

Once in the secluded area on Brookhaven Avenue, Bullock allegedly shot the victim in the chest. Smith died as a result of his injuries.

Bullock fled the scene and was later apprehended in Spartanburg, South Carolina, the district attorney noted.

“The victim’s life was tragically cut short as a result of this senseless act of gun violence.

The defendant is alleged to have purposefully retrieved a gun and shot the victim—a fellow Far Rockaway resident—in cold blood following a dispute. The defendant now faces the possibility of spending the rest of his life in prison for his alleged actions,” Brown added.

If convicted, Bullock faces up to life in prison without the possibility of parole.
