MTA Turns to Cameras for Bus Lane Enforcement

Cusenza MTA New York City Transit plans to install an automated mobile camera system on buses to capture real-time bus lane violations as the agency and the City Department of Transportation step up combined enforcement efforts to increase bus speeds and keep traffic moving on congested streets in the five boroughs, the Metropolitan Transportation Authority announced on Tuesday.

According to the MTA, the $6.2 million contract was awarded to Siemens Mobility Inc. and includes the purchase, installation, and warranty of the cameras and supporting computer systems. New York City Transit will install an Automated Bus Lane Enforcement system on 123 new buses that will be delivered from 2019 to early 2020 and serve some Select Bus Service routes in Manhattan and Brooklyn. The ABLE system will be used for a pilot program to evaluate the efficacy of automated enforcement of bus lanes and its effect on bus speeds and travel times. According to the agency, the pilot is a result of a successful NYC Transit proof-of-concept test that determined an ABLE system could capture sufficient evidence to enforce bus lane traffic violations.

The pilot results will inform NYC Transit’s plans to expand the ABLE program.

“This advanced automated camera technology will make a real difference toward clearing the way for our buses as they navigate some of the most congested roadways in the nation,” said Darryl Irick, MTA Bus Company president and NYC Transit senior vice president of Buses. “Together

with our City partners, we are prioritizing public transit on city streets so that our buses and our customers spend less time sitting in traffic. We look forward to putting these cameras on the road and dedicating additional capital funds from congestion pricing and other means so we can expand the program even further.”

According to NYC Transit, the ABLE system captures the license plate information, photos and videos, as well as location and timestamp information, of vehicles obstructing bus lanes to document clear cases of bus lane violation. The system collects multiple pieces of evidence to ensure that vehicles making permitted turns from bus lanes are not ticketed. This information is transmitted to DOT for review and processing. The automated bus lane enforcement program will be administered in partnership with DOT and the City Department of Finance, according to MTA and City administration officials.

In his State of the City address in January, Mayor Bill de Blasio announced that to speed up buses citywide seven new Police Department teams will be towing cars parked in bus lanes as part of NYC’s “Better Buses for All” initiative.

“We are excited that the MTA is undertaking this critical effort to help keep bus lanes clear,” said DOT Commissioner Polly Trottenberg, who is also an MTA Board member. “Earlier this year, Mayor de Blasio announced a plan to speed buses by 25 percent over the next two years, and automated enforcement—where we hope to see every bus on every route equipped—will be one more step to reach that ambitious goal.”

Congestion Pricing Plan Inches Closer to Approval in Albany

Cusenza What once was a politically fraught vision for relieving the daily reality of Manhattan thoroughfares choked with traffic for miles seems set to become part of the State Budget on Monday as Albany lawmakers have already begun hashing out details of a congestion pricing plan aimed at saving the archaic subway system and unclogging crowded Central Business District streets.

“Safe to say that the Assembly is ready to go forward on congestion pricing,” Assembly Speaker Carl Heastie said on Monday via The New York Times. “We’re at the point where the Assembly members understand the need to fund the MTA.” In February, Gov. Andrew Cuomo indicated that such a plan was the only way to save the Metropolitan Transportation Authority. In a speech, the governor said the “only logical and realistic option” to provide an ongoing and dedicated revenue stream to the MTA, and prevent a nearly 30-percent MTA fare hike or further deterioration of the transit system, is through congestion pricing.

According to the group’s proposal, released in January 2018, all drivers would be charged to enter the CBD – an area bounded by 60th Street on the north and Battery Park on the south, the Hudson River on the west and the East River on the east – during weekday business hours. Fix NYC has crafted a number of variable rates that would incentivize drivers towards non-congestion hours by reducing tolls at certain times and it would be implemented with electronic tolling. Funds

would be put in a lockbox for MTA capital projects, the governor has pledged.

Cuomo isn’t the only one who has been urging legislators to adopt a congestion pricing plan. A coalition of Southeast Queens transit riders and labor and other advocacy organizations rallied on Thursday at the Jamaica Center Subway Station.

“This is about equity,” said Transport Workers Union Local 100 Vice President J.P. Patafio. “If you can drive a car into Manhattan, you can afford congestion pricing. If you’re taking a bus, you can’t afford poor equipment or crowded lanes that make you miss your transfer. If you’re late to work, there are real consequences. This is about proper funding for the most important transit system in America. We have to get behind it and we have to do even more than congestion pricing. The great majority of people depend upon it.”

However, it’s not like congestion pricing has universal support. On Sunday, Assemblyman David Weprin (D-Richmond Hill), one of the plan’s most vocal critics, led a press conference at Tramway Plaza at the base of the Queensborough Bridge.

“New York’s struggling middle class cannot afford another regressive tax in the form of a congestion pricing,” Weprin said.

“This debate should not be rushed and we need to look to alternatives that penalize congestion and tax the wealthiest New Yorkers. I look forward to a healthy discussion on alternative solutions that will be fairer to all New Yorkers.”

Budget Dance ‘not over until it’s over’: Addabbo

The senator also said that he has personally identified a number of priorities that he wants to see addressed in the final 2019-2020 State Budget, including increased funding for education, additional aid for senior citizens and public health programs, tax relief for low- and middle-income families, assistance for veterans, adequate funding for environmental protection programs, mobile sports betting and support for small businesses.

Pheffer Amato Tapped for Fellowship

Pheffer Amato is among 17 elected officials of the City Council and the State Legislature to be chosen to participate in the fellowship, which is administered through the CUNY Institute for State and Local Government.

According to Pheffer Amato, the program, which began in 2017, introduces City and State leaders to experts across a variety of policy areas and provides space for ongoing dialogue and learning.

The Lindsay Fellows were selected by an advisory board of former government officials who provide guidance to the program.

By Forum Staff The proposed Northeast Supply Enhancement Pipeline program for the Rockaway Peninsula will not be getting support from State Sen. Joe Addabbo, Jr. (D-Howard Beach), who represents the communities in which the pipeline would be installed, the senator recently announced.

Among Addabbo’s primary concerns are the environmental issues and the impact the NESE pipeline would have in both the construction and post-construction phases. Addabbo advised entities to retreat from pumping climate-changing gasses into the atmosphere, and said that he believes that construction of the pipeline has the potential to disrupt marine life in the area. An additional concern is the presence of toxins that could be released into the water where residents and visitors swim, Addabbo added.

“My first concern is for the people who live in the Rockaways and who have valid concerns regarding the project,” the senator said. “This pipeline would provide no clear, direct benefit to my constituents, and may actually negatively impact their quality of life. After suffering from Superstorm Sandy, with hundreds of people still not back in their homes more than six years later, I cannot support an initiative that may burden them even further.”

Addabbo said he also believes that the $926 million slated to be spent on the project would be much better spent on renewable- and cleanenergy initiatives. He pointed to New York’s Clean Energy Standard, which mandates the State receive 50 percent of its electricity from renewable energy by 2030 and a 40-percent reduction in greenhouse gas emissions by the same time frame.

“While I understand that natural gas is a bridge energy source before we fully integrate to cleaner forms, it does not mean we have to spend close to a billion dollars on advancing natural gas projects,” Addabbo said. “It seems to me we are moving backwards instead of moving forward environmentally.”

In 2010, Addabbo was a major opponent of fracking in New York and the process of hydraulic fracturing of gas, which he felt was dangerous and a contributing factor to climate change.

“In the end, after reviewing the many aspects of the NESE Pipeline project, I have determined that the negative impacts, cost and environmental direction outweigh any benefits the pipeline may bring,” the senator noted. “It is because of these reasons that I stand with my constituents in Rockaway in opposing construction of the NESE Pipeline and will continue to work toward addressing the energy needs and efficient practices of our State.”

In the spirit of community partnership, the Kiwanis of Howard Beach donated the funds to help cover the cost of supplies, while Bobby Pace of Cross Bay Hardware donated supplies and discounts on purchases.

“This is sure to bring smiles to students’ faces and let them know they have support at all times,” said MS 207 art teacher and event organizer Serena Loiacono.

The school’s principal, Eileen Davies, was very supportive of the project and pleased with the results.

“It looks fantastic!” Davies exclaimed. “This day was a great bonding experience for the moms and their daughters that participated.”

State Sen. Joe Addabbo, Jr. (D-Howard Beach) supplied pizza for the deserving volunteers. The senator said, “I was pleasantly surprised to see the progress on this project. I think it is really great” and took the time to deliver the pizza himself!

Senate Bill Looks to Save Parking Spots

According to Addabbo, the bill ensures that when future projects, like the Q52/Q53 Select Bus Service, are put forth, the City dedicates an equal quantity of publicly available commercial or residential parking spots within a one-block radius for each parking spot that is eliminated or removed.

By Michael V. Cusenza State Sen. Joe Addabbo, Jr. (D-Howard Beach) has reintroduced a bill requiring the City of New York to provide an equal number of public parking spaces for those spots that have been eliminated in order to accommodate bus lanes.

In November 2017, MTA New York City Transit and the City Department of Transportation launched the Q52/Q53 Select Bus Service route along Woodhaven and Cross Bay boulevards in an effort to “bring increased reliability for bus passengers, as well as greater safety to pedestrians and motorists,” Addabbo noted. This measure, the senator said on Monday, ensures that when future projects are put forth, the City dedicates an equal quantity of publicly available commercial or residential parking spots within a one-block radius for each parking spot that is eliminated or removed.

“Local businesses relying heavily on customer accessibility and parking availability have experienced great hardships as a result of City projects eliminating critical parking spaces,” Addabbo added. “A major part of the redesigned roadway along Cross Bay and Woodhaven boulevards eliminated public parking spaces, which has had a detrimental impact on the small businesses located along the route as customers are not able to gain access to these merchants.

Since small businesses are the heart of the thriving economy in a community, ample parking must be made available.”

In December 2017, after receiving a significant amount of negative feedback from shoppers and small-business constituents along the two thoroughfares, Addabbo introduced legislation to provide alternate

parking spaces to make up for those that disappear as a result of SBS or other municipal capital projects.

“Since SBS went into effect on Nov. 12 on Cross Bay and Woodhaven boulevards, many small businesses along these roadways have found that nearby customer parking spaces have been sacrificed to the bus routes and newly created bus stops,” Addabbo said in 2017. “This directly impacts the economic health of our community and the local companies that are the foundation of our local business areas. If customers can’t get to these stores owing to an elimination of parking, they will certainly decide to take their business elsewhere—therefore placing our stores in jeopardy.”

Addabbo’s 2017 plan featured a requirement that the City hold a public hearing to solicit community input, and consider alternative parking sites, prior to the elimination of any existing parking spaces. The recently re-introduced legislation also requires that the City “convene no less than one public hearing within the bounds of the community board affected no less than 30 days prior to consider alternative parking placements. The City of New York would also have to provide a minimum of 14 days’ notice prior to the public hearing.”

However, the legislation didn’t move the needle after it was referred to the Senate Committee on Transportation. The new measure is now in the Transportation Committee—but this time the political atmosphere is quite different up in Albany.

EDITORIAL Home Groan For years, in this space, we’ve warned that homelessness is a crisis, a very real epidemic that has negatively affected our city in innumerable ways. And it seems that Mayor Bill de Blasio and the Department of Homeless Services have proposed a plan for sheltering our way out of the problem.

The shelters that are proposed under de Blasio’s answer to the homeless crisis are bound to be poorly planned and ill-informed failures. Though the plan is to place these homeless shelters all over the five boroughs, let’s take a few minutes to explore those that are intended for the Rockaways and Staten Island. Let’s seek to understand the intentions and determine who will benefit from these structures.

The homeless shelter set to be built in Rockaway Park is intended for 120 single men.

While there is no doubt that there is a homeless crisis, will this shelter solve the problem or exacerbate it? While the plan has set forth a place and who will reside there, the plan fails to consider what else is needed for this to be successful.

The residents in the community assert that they are already overburdened. The shelter plan fails to consider that this community has yet to recover from the effects of 2012’s Superstorm Sandy and there is already an existing

unresolved crisis. Some people have yet to move back into their homes, business doors have yet to re-open and there is already a high unemployment rate. Placing a homeless shelter in Rockaway Park would further inundate a community that is still rebuilding and has limited resources to support the men who would reside in the facility.

The shelter that is poised to be built in the heart of Tompkinsville, Staten Island, is another setting in which such a facility is poorly planned and would only embed one crisis within a larger crisis. Historically, this area of Staten Island has struggled with crime rates and financial burdens. The shelter that is pro-

posed for this area will house mostly women and children that have become homeless while living on Staten Island. The intention here is to keep the residents close to their families and for children to remain in their current zone schools. However, when Hizzoner is asked about the population, he has asserted that he is unsure if the shelter is limited to women and children and the City has yet to propose a way to prove that the residents will in fact be from Staten Island.

Furthermore, the decisions around building this shelter have excluded considerations and input from elected officials who would be able to speak to the level of negative impact

the shelter would have on the community. Regardless of opposition, he does not have the right to proceed without collaboration with and consultation of the communities.

In the current plan, the homeless people are going to benefit less than those who will be making money on the building these shelters. The City overpays the landlords to outbid anyone else so they can access the property they desire. The developers, who own the land, make an obscene amount of money on the deal because they would never make that consistent amount of revenue stream on a 30year lease on rentals.

The reality is that while many oppose these homeless shelters, very few would oppose finding the right solution to the problem. The goal should be to develop a plan that fosters the support and success of those we set out to help: the homeless. And in order to truly support the homeless, it is imperative that we develop a plan that would incorporate mandates and services; that would provide the residents with more resources, training and employment; moreover, that we develop a plan that would foster a system that can provide permanent affordable housing, rather than this proposed band-aid, which, over time would simply place one crisis inside another crisis and create a much larger problem.

Mob Loanshark Sentenced to 28 Months in Federal Prison

By Forum Staff A long-time made member of the Gambino organized crime family has been sentenced to 28 months in prison for conducting a loansharking scheme in which he extended extortionate loans with annual interest rates up to 54 percent, federal prosecutors announced on Thursday.

Paul Semplice, 55, of Brooklyn, engaged in a conspiracy with others to make extortionate extensions of credit to multiple victims, according to authorities.

“Semplice targeted victims desperate for loans and used his status as a Mafia soldier to make sure they paid the exorbitant interest rate,” said Brooklyn U.S. Attorney Richard Donoghue. “With today’s sentence, the defenSemplice’s sentence was handed down on Thursday at Brooklyn federal court. dant will pay for his crimes in prison.”

During one recorded conversation with a cooperating witness, Semplice boasted that he had a “very special relationship,” “like brothers,” with a captain in the family and “answer[ed] to nobody but him.” In another recorded conversation with the witness, Semplice explained that in connection with a $200,000 loan to victim John Doe #1, he collected $9,000 interest per month, or 54 percent, and personally kept $8,000. Semplice called the arrangement “a beautiful thing.”

On Nov. 18, 2016, during a lawfully intercepted conversation, Semplice boasted about assaulting John Doe #2. “I started abusing him, right. He was in his forties....Once I – I had to smack him. I go, ‘What?’ Bang! I go, ‘I’ll smack you again.’ He goes, ‘Why?’ ‘Cause I shouldn’t have to come see you.’”

Self-Professed Private Investigator Sentenced to up to Three Years in Prison for Bribing a Witness

By Forum Staff A Bronx man who claims to be a private investigator has been sentenced to up to three years in prison after admitting that he bribed a witness between from February 2013 and through April 2015, Chief Assistant District Attorney John Ryan, on behalf of Queens DA Richard Brown, announced on Monday.

Charles Gallman, 55, pleaded guilty last July to bribing a witness and was sentenced this week to one to three years’ incarceration. Frederick Freeman, Gallman’s co-defendant, pleaded guilty in May 2016 to second-degree criminal possession of a weapon in the original gun case and to third-degree tampering with a witness. He was sentenced in 2016 to nine and a half years in prison.

Charges in the underlying case showed that Freeman, 30, went along with his girlfriend, Raneisha Williams, to an apartment in Jamaica where Williams’ brother was living. After knocking on the door, Williams’ brother refused to open it. When he looked through the peephole he noticed that Freeman had his hand in his waistband, so Williams’ brother opened the door. Freeman then raised a silver firearm and

pointed it toward the victim, ordering the man to back up so that he and Williams could enter the apartment. But Williams’ brother quickly reacted and slammed the door on them, locked it and called 911.

Police arrived and found Freeman and Williams in an apartment bedroom three floors below. Cops recovered a

loaded .380-caliber pistol inside a black purse they found under the bed.

Freeman and Williams were each charged with secondand third-degree criminal possession of a weapon.

In May 2014, Williams pleaded guilty to second -degree criminal possession of a weapon and was sentenced to three and half years in prison. The case against Freeman was pending when he and Gallman, working as a team between February 2013 and April 2015, tried to bribe, intimidate, and tamper with the witnesses slated to testify against Freeman in the gun case.

Specifically, according to the charges, Freeman and Gallman engaged in acts with the intention of instilling fear in Williams’ brother and other family members. The suspects made it evident that testimony or any cooperation with the DA’s Office would result in physical harm.

Court records show that Freeman contacted witnesses and family members and spoke with Gallman by phone from Rikers Island about offering bribes and tampering with and intimidating witnesses. Gallman contacted Williams’ brother and a member of the family in person and over the phone in an effort to tamper with them and/or intimidate them.

A Long Island woman has been charged in the death of her baby who was born prematurely in a Long Island City hotel bathroom in July 2018, Chief Assistant District Attorney John Ryan, on behalf of Queens DA Richard Brown, announced on Monday.

Lauren Becker, 36, who is currently hospitalized, was arraigned Friday via video conference on a complaint charging her with second-degree manslaughter and endangering the welfare of a child. Becker was remanded and ordered her to return to court on April 5.

According to the criminal complaint, on July 18, 2018, at approximately 7:30 p.m., emergency responders arrived at the Days Inn on Queens Boulevard near Thomson Avenue following a 911 call from a relative of Becker.

Becker allegedly gave birth to the little girl at this Days Inn in Long Island City.

The caller said that Becker had texted, informing the relative that she had delivered her baby in the toilet of the hotel room; and despite the family member directing Becker to take the newborn to the hospital, that Becker allegedly refused.

Following a brief search, authorities traced Becker’s whereabouts to a room on the sixth floor of the hotel, where, upon entering, they allegedly discovered Becker and her infant daughter, whose body was lifeless, blue and wrapped in a towel on top of a bed. Emergency medical tech-

nicians transported both Becker and the newborn girl to Elmhurst General Hospital, where the baby was pronounced dead. An autopsy determined that the baby was born approximately six to eight weeks early and was alive at birth.

According to the charges, the medical examiner determined the baby’s cause of death to be complications of prematurity due to failure to seek medical evaluation and treatment.

In addition, the autopsy showed the baby had liquid in her stomach—consistent with Becker allegedly stating she had breast fed the little girl—and toxicology results showed the infant had both cocaine and the anxiety disorder medication Xanax in her system. The drugs, however, were not at lethal levels that would have killed the baby, according to test results.

Becker was arrested last Wednesday. If convicted, she faces up to 15 years in prison.

Despite the dropping temps and the rain, spring is nearly upon us and the sights, sounds and smells we crave all winter, will be with us very soon.

Spring brings flowers, flowers bring bees, bees bring stings, and stings can bring problems–on very rare occasions they can be fatal.

This week we’d like to offer you some key information to help you deal with a bee sting situation should it arise.

It’s not the sting that kills people, it’s their allergy to the venom introduced into the body via the bee’s stinger.

Bee stings can be relatively easy to treat, most often requiring nothing more than minor first aid.

If the stinger is in the skin, it has to be removed. A common misconception is that it be squeezed or tweezed out, but that can cause the release of more venom.

Scraping the stinger out is the best removal method. Use the edge of a knife, a credit card or even a fingernail, just remember the quicker the better. As a side note, be aware that wasps, hornets and yellow jackets don’t leave a stinger behind when they sting you.

Cusenza An attorney admitted to practice in New York since 2011 has been convicted in Brooklyn of attempting to influence the U.S. Attorney’s Office for the Southern District of New York to remove a lien on her client’s four Queens real estate properties by misrepresenting that the properties would be sold and that the client—the attorney’s aunt—would not receive any proceeds from the sale, federal prosecutors recently announced.

Lydia Hills, 38, of Brooklyn, was found guilty by a federal jury of obstructing an official proceeding and conspiring to do the same, following a three-day trial.

According to prosecutors, Hills client, her aunt Faith Esimai, was convicted in 2010 in federal court in the SDNY of conspiracy to commit wire fraud and bank fraud. Esimai was sentenced to 70 months’ imprisonment and ordered to pay more than $4.9 million in restitution and more than $13.5 million in forfeiture. The SDNY U.S. Attorney’s Office filed a lien against four properties in Queens Village, Hollis, St. Albans, and Arverne to prevent Esimai from selling the properties without first satisfying the judgment and forfeiture order.

Hills, who was also a licensed as a real estate broker, subsequently represented Esimai in a mortgage “short sale” of the four properties. In a short sale, the mortgage holder can pay off the mortgage with the proceeds of the short sale, but the mortgager does not receive any of the proceeds, federal officials noted. During March and April 2016, Hills

conspired with Esimai to sell the four properties in a transaction where the client would receive the sales proceeds in a hidden cash transaction and conceal it from the SDNY U.S. Attorney’s Office, which was entitled to the proceeds to partially satisfy the judgment and forfeiture order.

On March 15, 2016, Hills faxed a letter to the SDNY U.S. Attorney’s Office requesting that the lien be released in order to proceed with the sale, falsely representing that Esimai would not receive any financial benefit from the short sale. However, on April 6, 2016, Hills, Esimai and the buyer met at the closing, and the buyer gave Hills a bag containing $33,100 in cash, representing $25,000 for one property and Hills’ broker fee of $8,100.

At the closing, which was recorded by Federal Bureau of Investigation agents, Hills told the buyer with regard to her client, “I’m afraid.

I’m an attorney... I don’t want her to say something... The wrong thing on the phone one day and it’s being recorded and I’m screwed.”

Esimai was Hills’ codefendant until the judge found she was not competent to stand trial, a Brooklyn U.S. Attorney’s Office spokesman told The Forum.

“When the government imposes a restitution and forfeiture agreement in response to a crime that’s been committed, the best course of action is to pay up. In this case, Lydia Hills masterminded a scheme so her client could skirt the system,” said FBI-NY Assistant Director-in-Charge Bill Sweeney.

When sentenced, Hills faces up to 20 years’ imprisonment on each count of the indictment.

Next, wash the area with soap and water and apply an antiseptic followed by a soothing ointment, like hydrocortisone or calamine, and cover the area with a dry, sterile bandage.

For swelling, apply an ice pack or cold compress. You can take an OTC oral antihistamine to reduce itching, swelling, and hives, but kids under two or pregnant woman can’t. To relieve pain, take an NSAID, such as ibuprofen.

One very interesting fact about stings is that you will not have an allergic reaction to a sting the first time you are stung by a particular insect. One or more stings are needed to sensitize your immune system, so don’t make the mistake of thinking because nothing happened the first time, you’re not allergic. And if you have an allergic reaction one time it doesn’t mean you’ll have one the next. That is why doctors often prescribe epipens for patients with a confirmed sensitization of bee venom. They should be taken with you at all times.

Miller Thanks Area Crossing Guards

Assemblyman Mike Miller (D-Woodhaven) recently hosted his annual 102nd Precinct School Crossing Guard Breakfast at Avenue Diner on Jamaica Avenue.

Miller passed a resolution in the Assembly for March to be Crossing Guard Appreciation month. All crossing guards from the 102nd Precinct this year received a certificate of merit from Miller; and three guards—SCG Dennis Hon, SCG Esperanza

Kotsias, and SCG Kelly Cooke—received plaques from the precinct “for going above and beyond the call of duty.” According to Miller, Hon has not missed a day of work since he was hired in 2016; Kotsias covers two schools and will be retiring in June after working 27 years as a crossing guard; and Cooke, who has been on the job less than a year, has become a favorite among many.
